The Popular Legislative Initiative (PLI) was designed by the Austrian philosopher and jurist Hans Kelsen (1881–1973) as a mechanism of indirect participation that, on the one hand, allows citizens to express their demands through the institutions and, on the other, informs parliamentarians about citizens' preferences. This article answers the question on the conditions that the mechanism must meet, focusing on the analysis of the Colombian case: What are the variables that influence the performance of the PLI and can differentiate between an efficient mechanism and a «worthless piece of paper»? Three dimensions are proposed: inclusivity (from who/m and for what can the PLI be activated); the accessibility (or ease of activation, referred to the procedural requirements); and efficacy (the parliamentary procedure, and the participation guarantees inherent to it). As conclusions, the study shows that the Colombian design of the PLI before and after the 2015 reform presents limitations that explain its low performance. Accordingly, we propose some elements for its modification. ; La Iniciativa Legislativa Popular (ILP) fue originalmente diseñada por el filósofo y jurista austríaco Hans Kelsen (1881-1973) como un mecanismo de participación indirecta que, por una parte, permitiera a los ciudadanos expresar institucionalmente sus demandas y, por otra, facilitara a los parlamentarios conocer mejor las preferencias ciudadanas y darles respuesta. Este artículo responde a la pregunta sobre las condiciones que el mecanismo debe cumplir, centrándose en el análisis del caso colombiano: ¿cuáles son las variables que influyen sobre el desempeño de una ILP y pueden diferenciar entre un mecanismo eficiente y un «papel mojado»? Se proponen tres dimensiones: la inclusividad —quiénes y para qué pueden activar una ILP—; la accesibilidad —o facilidad de activación, referido a los requisitos procedimentales—; y la eficacia —el procedimiento parlamentario y las garantías de participación inherentes a este—. Se concluye que el diseño colombiano de la ILP previo y posterior a la reforma de 2015 sigue presentando limitaciones que explican su bajo desempeño y se proponen elementos para su modificación.

This article analyzes the Popular Legislative Initiative to regulate surrogacy in Spain. It is proposed to regulate this contractual figure guaranteeing the rights of all parties involved in the process by bringing this feature in the figure of the notary. Therefore, this article analyzes this notarial tutelage of the surrogacy contract. It will consider whether the functions of the Notary make possible this proposal or if it would be necessary to make changes either in the draft law on notary functions well. ; Este artículo tiene por objeto analizar la iniciativa legislativa popular para regular la gestación por subrogación en España, en la que se propone regular esta figura contractual garantizando los derechos de todas las partes intervinientes en el proceso, haciendo recaer esta función en la figura del notario. Se estudiará si las funciones propias del notario hacen posible esta propuesta o si habría que realizar cambios, bien en la propuesta de ley, bien en las funciones notariales.

Spanish citizens proposed a law that recognizes the legal personality of the Mar Menor lagoon and its basin and endows this valuable ecosystem with its own rights, based on the serious ecological damage it has suffered, the ineffectiveness of the existing legal regulations, and the empowerment of civil society to make participation in environmental matters effective. The new paradigm of the rights of nature opens a legal stage of universal scope, founded on Ecological Justice and the Earth Jurisprudence, which will condition the dogmatic development of the new legislative proposal. The development of the ILP is an expresión of the international movement in defense of the rights of nature in Spain, initiated in the six continents and which is advancing unstoppably. In this article we study the fiction of the recognition of the legal personality of the Mar Menor and its basin, as a presupposition for legal capacity and capacity to act. In the legal capacity we expose the charter of rights of the lagoon ecosystem and in the capacity to act, the defense of such rights. Conocer sobre la admisión y eventual éxito de aprobación, de las pe-ticiones e iniciativas ciudadanas de ley en Nuevo León y en Catalunya es el objetivo. La muestra neolonesa abarca desde la Legislatura LXX hasta la LXXIV, la catalana desde la Legislatura IX hasta la XII. Como aportación metodológica se elaboran fórmulas para dos indicadores: el de destino y el de éxito. Las hipótesis son: (1) el indicador de destino resultará más alto en el caso catalán, (2) el indi-cador de éxito resultará más alto para el caso neoleonés, (3) en Catalunya ambos indicadores serán superiores en las peticiones en contraste con las ILP, (4) la superioridad de ambos indicadores en las peticiones electrónicas. Los resultados validan dos hipótesis (1 y 3), invalidan la (2) y muestran matices en la última. The main aim of this study is the analysis of the normative reality and the possibilities of development of a popular initiative in Spain. Its insufficient reception in the Constitution, solely as a popular legislative initiative stricto sensu (art. 87 CE) and subject to important procedural and material limitations, lies within the framework of a constitutional normative which is suspicious and reluctant to the direct participation of citizens in politics. Its legal regulation, far from establishing an expansive development, designs a procedure that further limits its possibilities. De lege ferenda, substantial modifications in the established procedure are proposed; but if the intention is to progress towards a real participatory democracy, a reform of the Constitution must be defended; one that unties the bonds with which the Spanish constituent of 1978, for historical reasons, attempted to restrain the direct participation of citizens. ; [Primer premio.
