"In this book, Michael Matheson examines the Security Council's new, expansive exercise of legal authority in this period and its devising of bold and innovative methods - coercive and noncoercive - to stop nascent wars and "threats to the peace," including international terrorism. He also surveys the many roles assumed by the Council in postconflict environments, acting in a variety of ways to rebuild a war-torn country or territory and reintegrate it into the world community - from prosecuting war criminals, to providing compensation for war victims, to exercising governmental authority in postconflict territories such as Cambodia, Bosnia, and recently, Kosovo and East Timor. Arms control has undoubtedly a role to play in conflict resolution. It can enhance stability through deterrence in the case of settlements based on partition, or it can support the military transformation process for national reconciliation. The problem with arms control in conflict resolution is that there neither exists conceptual clarity -- especially in relation to classical arms control -- nor has norm-building in this area been very successful. Moreover, the short life cycles of most postconflict arms control arrangements raise questions about sustainability. This study argues that these deficiencies could be effectively addressed by embracing "generic best practices" & by strengthening the interface of peace implementation with multilateral frameworks of politico-military cooperation. This article sets out to analyze the current peace process in Sri Lanka. It is argued that the prospects for peace are better than at any other point in time since the inception of the armed conflict in 1983, because the parties' concerns about the consequences of continued conflict, as well as the consequences of settlement, have changed. In the first section of the article we demonstrate how the costs -- militarily, financially, & politically -- for continuing the war have drastically increased for the parties. Furthermore, with the involvement of the international community & the special approach to the peace process by the Wickremasinghe government, the perceived risks involved in a peaceful settlement have decreased. These parallel developments in the incentives structures of war & peace, explain the readiness of both primary parties to engage in serious efforts to solve the protracted conflict. From this perspective, the role of Norway as a mediator, & the Nordic countries as ceasefire monitors, are analyzed. The second section explores prospects for a solution by looking at the reconciliation of positions that have taken place between the parties. The major obstacles, such as the LTTE's intentions, the Muslim minority, & divisions within the Sinhalese community, are also discussed. We end the analysis with the observation that even though the prospects for a stable, negotiated settlement between the adversaries appear promising, several problems related to postconflict reconstruction & democratic development are likely to remain obstacles in the future. The terrorist attacks of September 11 (2001) serve as a springboard for a discussion of the need to foster democratic governance in postconflict societies & the responsibilities of the UN Development Program (UNDP) toward promoting not only sustainable development but also sustainable peace. The UNDP's ongoing efforts in Nigeria, Guatemala, Sierra Leone, & Afghanistan are described, & goals for the international community affirmed. These goals include recognizing indigenous norms & dynamics that may have served to promote political participation & stability, & then bolstering their reform or recuperation. This monograph provides a contemporary analysis of the frictions between peacemaking and international human rights law based on the cases of postconflict power-sharing in Lebanon and Bosnia-Herzegovina. In this context it evaluates the long-standing debate in the United Nations and human rights bodies about the 'imperfect peace'. Written from a practitioner–scholarly viewpoint and drawing from new authentic sources, the book describes the mechanisms used in peace agreements and post-conflict constitutions for managing ethnic or religious diversity, explains their legal limits under international human rights law, and provides a conceptual framework for analysing the nexus between law and peacemaking. The book argues that the relationship between the content of peace agreements and post-conflict constitutions, their negotiation process and the element of time, needs to be untangled to better understand the legal limits of statebuilding in the aftermath of armed conflict. It is a key resource for scholars in human rights law and peace and conflict studies, advisers in peace processes, constitution-makers, and peace mediators.
