Abstract: Private for‐profit prison corporations are expanding in Australia faster than in any other country. These corporations are based in the USA and form part of the correctionscommercial complex. It is the contention of this paper, from observations in NSW, Australia, that the nature of these newly internationalised private prison corporations is neo‐colonialist, both economically and culturally. It can be compared with the expansion of the nuclear power industry by transnational US corporations in the 1960s and 1970s and other transnationals more recently. Using this perspective, the appropriateness of transnational private for‐profit prison corporations running prisons in Australia is severely questioned.

Until December 2015, the University of California maintained $25 million of indirect investments in three major private prison corporations and almost no one knew. The UC is now the first U.S. public university system to sell its shares in private prisons, however it was activism that propelled the victory. Black students from the Afrikan Black Coalition, a statewide Black youth organization, used research from Enlace and strategic planning to demand private prison divestment. This personal reflection on the path toward prison abolition examines some of the strengths and resurgence of Black student organizing in the era of #BlackLivesMatter.

This article is focused on the problem of studying the phenomenon of prison privatization and the political and economic aspects of the functioning of modern multinational prison corporations. The issue of transferring the penitentiary function of the state to private actors with the subsequent transfer of this function to the supranational level is at the heart of this study. A separate object of study of this article is a complex political and economic dualistic process, which is characterized by both the opposition between transnational prison corporations and nation states, and the coexistence of the above entities at the same time. The article focuses on the problem of morality of modern tendencies of supranationalization of penitentiary policy and civilizational values that drive transnational prison corporations. A special place in the article is occupied by the position on the transformation of transnational prison corporations into quasi-state entities with appropriate attributes, functions and powers. The article also contains the author's analysis of the problem of transition from the state to the private sector of power to use force (including physical coercion). On the other hand, the variety of numerous modern forms of social control leads to the original competition "bullet against armor" in the context of the nation-state's opposition to transnational business, where the efforts of nation-states to maintain control over it resembles attempts to hold water in the palm. In the Western world, prison privatization and the supranationalization of the prison business is an almost commonplace phenomenon that is phenomenal for the post-Soviet countries, making this area of research in Ukraine even more relevant and topical. This author's study should be seen not only as an analysis of the transfer of power from the nation state to transnational private actors. The focus of the study is the question of the profound transformation of the "power of punishment". ; Ця стаття присвячена проблемі дослідження феномену в'язничної приватизації та політико-економічним аспектам функціонування сучасних транснаціональних в'язничних корпорацій. У центрі цього дослідження перебуває проблематика передачі пенітенціарної функції держави приватним акторам з подальшим винесенням цієї функції на наднаціональний рівень. Окремим об'єктом дослідження цієї статті є комплексний політико-економічний дуалістичний процес, який водночас характеризується як протидією між транснаціональними в'язничними корпораціями й національними державами, так і одночасно вимушеним співіснуванням зазначених вище суб'єктів. У статті фокусується увага на проблемі моральності сучасних тенденцій наднаціоналізації пенітенціарної політики та цивілізаційних цінностях, які рухають транснаціональні в'язничні корпорації. Окреме місце у статті посідає позиція щодо перетворення транснаціональних в'язничних корпорацій на квазідержавні утворення з відповідними атрибутами, функціями та повноваженнями. Стаття також містить авторський аналіз проблеми переходу від держави до приватного сектора повноважень з використання сили (у тому числі фізичного примусу). З іншого боку, різноманіття численних сучасних форм соціального контролю призводить до споконвічного змагання «куля проти броні» у контексті протистояння національної держави проти транснаціонального бізнесу, де намагання національних держав зберегти контроль над ним нагадує спроби втримати воду долонею. У статті робиться висновок, що для сучасного західного світу в'язнична приватизація та наднаціоналізація в'язничного бізнесу – це майже буденне явище, яке для країн пострадянського простору є феноменальним, ще надає ще більшої актуальності цьому напрямку досліджень в Україні. Це авторське дослідження варто сприймати не лише як аналіз переходу влади від національної держави до транснаціональних приватних акторів. У фокусі дослідження перебувають саме питання глибинної трансформації «влади карати».

A saner and safer prison policy in the United States begins by ending the scourge of the private prison corporation and returning crime and punishment to public function. We continue by radically reimagining our sentencing policies and reducing them significantly for non-violent crimes. We end the War on Drugs, once and for all, and completely reconfigure our drug and prison policy by legalizing and regulating marijuana use and providing health services to addicts of harder drugs and using prison for only violent drug kingpins and cartel bosses. We stop the current criminalization of immigration in its tracks and block the private prison lobby from influencing legislation in our current immigration policy debates. We provide prisoners a fair wage for work done in prison, allowing them a re-entry account upon release filled with the money they earned while working in prison. We provide humane and habitable prison cells populated by one inmate, as saner and safer crime and punishment policies will imprison far fewer American citizens. At their core, private prisons reflect a continuation of policies that have tainted the criminal justice system with perceptions of arbitrariness, unfairness, and injustice. As this article has shown, the continued proliferation of private prisons does not save taxpayers money, increase prison safety, or elevate the conditions of the prison environment. Conversely, they do the opposite. Inmates are being physically abused, denied medical care, and forced to endure inhumane living conditions, as corporations like CCA and GEO Group realize higher profits from a marketplace in which prisoners are in high demand. Indeed, CCA is a textbook example of the grave injustices that can occur when profit maximization clashes with human dignity. The time has arrived for private prisons to be eliminated and for legislators and courts to realize that this experiment is one that has failed. Until that time comes, Congress should implement purpose-driven reforms to ensure that private prisons can no longer be institutions where inmates have rights but no remedies.

Research has done a fine job in noting the utility of mass incarceration for social control and the creation of quiescence, especially in the face of economic precariousness and growing wealth inequalities. Some of this scholarship also posits a profit-centered motive, activated through the growth of for-profit prison corporations or forced prison labor. I build on this work in this article but extend the emphasis on profit by suggesting that incarceration also acts as a locus for the coercion of demand and consumption. In postindustrial economies characterized by chronic crises of demand, mass incarceration compels minimally market-attached residents to participate in the market in the capacity in which they are most required—as consumers. I construct estimates of the increase in national aggregate demand associated with incarceration and find it to be equivalent to the addition of a small country of consumers to the national economy.

The perpetuation of colonization within the US prison-industrial complex & the transformation of female criminals into racialized enemies are studied. After illuminating the close connection between US corporations & penal institutions, it is contended that the prison-industrial complex is the continuation of Western colonization; the authors conversations with female prisoners & fieldwork are resourced & contemporary research documenting the exportation of US penal institutions to foreign nations are cited to bolster this contention. Attention is then dedicated to demonstrating how the fervor for domestic & international security has resulted in the criminalization of entire racial minority communities, especially single mothers of color; moreover, it is demonstrated that these individuals who have been targeted by US neo-liberalism are typically those who are most severely plagued by structural inequalities in US society. In addition, the implications of adopting this perspective toward the US prison-industrial complex for future feminist international relations & approaches to realizing social change are also pondered. The past two decades have witnessed an explosion in the population of women prisoners in Europe, North America and Australasia, accompanied by a boom in prison construction. This article argues that this new pattern of women's incarceration has been forged by three overlapping phenomena. The first is the fundamental shift in the role of the state that has occurred as a result of the neo-liberal globalization. The second and related phenomenon is the emergence and subsequent global expansion of what has been labeled a 'prison industrial complex' made up of a intricate web of relations between state penal institutions, politicians and profit-driven prison corporations. The third is the emergence of a US-led global war on drugs which is symbiotically related and mutually constituted by the transnational trade in criminalized drugs. These new regimes of accumulation and discipline, I argue, build on older systems of racist and patriarchal exploitation to ensure the super-exploitation of black women within the global prison industrial complex. The article calls for a new anti-racist feminist analysis that explores how the complex matrix of race, class, gender and nationality meshes with contemporary globalized geo-political and economic realities. The prison industrial complex plays a critical role in sustaining the viability of the new global economy and black women are increasingly becoming the raw material that fuels its expansion and profitability. The article seeks to reveal the profitable synergies between drug enforcement, the prison industry, international financial institutions, media and politicians that are sending women to prison in ever increasing numbers.
