The article is devoted to the analysis of the status of observance of the rights of prisoners in Ukraine. Attention is drawn to torture, inhuman treatment, medical treatment and the conditions of detention in prison. Reports of the European Committee for the Prevention of Torture or Inhuman or Degrading Treatment or Punishment have been analyzed. The effectiveness of the visits of the European Committee for the Prevention of Torture or Inhuman or Degrading Treatment or Punishment to the penitentiary institutions in Ukraine has been investigated. The situation of the rights of prisoners is difficult. The analyzed periodic and extraordinary reports of the CPT track down a number of systematic violations of prisoners' rights. The conditions of detention, medical care and treatment of prison staff violated their rights, in particular Art 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms. According to this article, no one shall be subjected to torture or to inhuman or degrading treatment or punishment. The remarks made by the CPT in their reports do not go unheeded by the government and public monitors. The CPT's periodic and extraordinary visits to the penitentiary institutions make it possible to effectively monitor the situation of prisoners in prison in Ukraine. Moreover, they can be seen as a driving force for reform in the enforcement of prisoners' rights.
The article is devoted to the analysis of the advantages and disadvantages of the current state of legal regulation of social rights of persons sentenced to imprisonment. The signs of social rights of convicts are determined: - guarantee - social rights of convicts are enshrined in national and international regulations; - they serve as a means of meeting the needs of life at a level not lower than the subsistence level established by law; - are sold voluntarily, in the absence of coercion; - the core is the presence of social risks and/or difficult life circumstances and/or the insured event, regardless of the time of their occurrence - before or after imprisonment; - the scope of social rights of convicts, as a rule, varies with the length of insurance and the amount of earnings received; - can be implemented both on a regular basis and temporarily; - financing of expenses for realization of social rights of convicts is carried out at the expense of means of the State budget of Ukraine and other sources which are not forbidden by the current legislation. The concept of social rights of persons sentenced to imprisonment is formulated as a system of rights enshrined in national and international regulations, aimed at neutralizing complex social and life circumstances and/or ensuring a standard of living at least the subsistence level in the event of social risks, and also the proper functioning of the human body of citizens who have been found guilty in court of a crime, in the event of social risk or difficult life circumstances. The results of monitoring visits to places of detention in previous years in the framework of the implementation of the national preventive mechanism allow us to say that violations of social rights of persons sentenced to imprisonment are widespread in practice. The above facts give grounds to allege a violation of social rights of convicts under Art. 43, 46, 48, 49 of the Constitution of Ukraine by the administrations of penitentiary institutions. The Basic Law establishes the inviolability of social rights for citizens of Ukraine, however, as practice shows, due to the closed nature of the penitentiary system, convicts are effectively deprived of the opportunity to exercise social rights properly. Based on a study of legal regulation of social rights of persons sentenced to imprisonment, it is established that, on the one hand, Ukraine has significant achievements and positive results in the above area. On the other hand, in practice, cases of mass neglect and violation of the relevant rights of the above-mentioned category of citizens remain widespread to this day. ; Проаналізовано переваги та недоліки сучасного стану правового регулювання соціальних прав засуджених до позбавлення волі. Визначено ознаки соціальних прав засуджених: - гарантованість - соціальні права засуджених закріплені в національних та міжнародних нормативно-правових актах; - вони слугують засобом задоволення життєвих потреб на рівні не нижчому, ніж розмір прожиткового мінімуму, встановленого законом; - реалізуються в добровільному порядку, за відсутності примусу; - серцевиною слугує наявність соціальних ризиків та/або складних життєвих обставин та/або страхового випадку, причому незалежно від часу їх виникнення - до ув'язнення чи після; - обсяг соціальних прав засуджених, як правило, варіюється із тривалістю страхового стажу та розміру отримуваного заробітку; - можуть реалізовуватись як на регулярній основі, так і на тимчасовій; - фінансування витрат на реалізацію соціальних прав засуджених здійснюється за кошт Державного бюджету України та інших, не заборонених чинним законодавством, джерел. Сформульовано поняття «соціальні права засуджених до позбавлення волі» як система прав, котрі закріплені в національних та міжнародних нормативно-правових актах, спрямовані на нейтралізацію складних соціально-життєвих обставин та/або забезпечення рівня життя в розмірі не менше прожиткового мінімуму за умови настання соціальних ризиків, а також належного функціонування людського організму громадян, які визнані в судовому порядку винними у вчинені злочину, під час настання в них соціального ризику чи складних життєвих обставин. Результати моніторингових візитів до місць несвободи попередніх років у межах реалізації національного превентивного механізму дозволяють констатувати, що порушення соціальних прав засуджених до позбавлення волі на практиці є загальнопоширеними. Вищезазначені факти дають підстави стверджувати про порушення соціальних прав засуджених, передбачених ст.ст. 43, 46, 48, 49 Конституції України з боку адміністрацій установ виконання покарань. Основним Законом установлено непорушність соціальних прав для громадян України, однак, як показує практика, через закритість кримінально-виконавчої системи засуджені фактично позбавлені можливості реалізовувати соціальні права належним чином. На основі дослідження правового регулювання соціальних прав засуджених до позбавлення волі встановлено, що, з одного боку, Україна має суттєві здобутки та позитивні результати у вищезазначеній сфері. З іншого - на практиці й донині залишаються поширеними випадки масового нехтування та порушення відповідних прав щодо вищезазначеної категорії громадян.

Мета роботи – дослідження та аналіз ключових нормативно-правових актів, якими регулюється право на медичну допомогу осіб, яких позбавили волі, та з'ясування проблем, що виникають пыд час реалізації цього права.Методи дослідження – історичний, соціологічний, процесуальний та інституційний аналіз, біхевіористський і синергетичний підходи, цивільно-правовий метод.Результати. Проаналізували нормативно-правову базу, що регулює питання права на медичну допомогу та порядок його реалізації. Теоретично обґрунтовано, що від того, наскільки якісною є юридична система захисту прав людини у сфері охорони здоров'я, наскільки кожна людина може скористатися наданими їй правами, багато в чому залежить успішний і динамічний розвиток як медичного права зокрема, так і держави в цілому. При цьому правові норми у сфері охорони здоров'я не повинні залишатися тільки деклараціями, тобто нормами, що не супроводжуються створенням системи їхньої реалізації, охорони й захисту.Висновок. To study and analyze the key regulatory legal acts regulating the right to medical care of persons deprived of their liberty and to find out the problems that arise in implementing this right.Methods: historical, procedural and institutional analysis, behavioral and synergetic approaches, civil law method.Results. The analysis of a normative and legal basis that regulates issues of right to medical care and its implementation has been conducted. It has been theoretically justified, that successful and dynamic development of both medical low in particular and the State as a whole depends largely on the system of legal protection for human rights quality in the field of health care and to what extent everybody can enjoy the rights given. At the same time, the legal norms in the field of health care must not remain declarations only - standards unaccompanied by creation of a system for their realization, protection and defence.Conclusions. A greater focus needs to be placed on the legal framework improvement and actual use of the legislative provisions relating to the investigation of complaints concerning ill-treatment and violation of human dignity, a failure to provide or inappropriate medical care, inadequate custody of persons deprived of their liberty. ; В статье рассматривается проблема обеспечения права заключенных на надлежащую медицинскую помощь.Цель работы – исследование и анализ ключевых нормативно-правовых актов, регулирующих право на медицинскую помощь лиц, лишенных свободы, и выяснения проблем, возникающих при реализации этого права.Методы исследования – исторический, социологический, процессуальный и институциональный анализ, бихевиористский и синергетический подходы, гражданско-правовой метод.Результаты. The article is devoted to the analysis of problems of labor use of prisoners of war in the sugar industry in the Chernihiv province in the period from the beginning of the First World War to the October Revolution. A comparative analysis of the dynamics of the sugar industry in the prewar and war periods was carried out. The author aims to evaluate the personnel supply of the sugar industry in the region during the First World War. The purpose of the article is to characterize the order of distribution of prisoners between departments and enterprises, as well as to analyze their legal status, social and domestic situation on the example of the sugar industry in Chernihiv province. For an analysis of the question the regional and statistical collections of the beginning of the XXth century were used. In the course of the study, the method of mathematical calculation was actively used to explore the number of prisoners of war and production capacities of sugar factories in the region. The historical-system method was used during the study of the interaction of public authorities at different levels and administrations of enterprises with prisoners of war. The author concludes that the presence of prisoners of war in the sugar industry of Chernihiv province did not solve the personnel crisis caused by the mobilization measures of the state. Costs of keeping prisoners of war and security costs have become an additional destabilizing factors for the development of the sugar industry in the region. The author pays special attention to the analysis of the legislation of the Russian Empire, which regulated the legal status and conditions of detention of prisoners of war. Theauthorreachedtotheconclusioninrelationto the necessity of appeal to historical experience of overcoming of the crisis phenomena in the economy. The article reveals the peculiarities of the development of the educational movement in the camp of captured Ukrainian soldiers Freistadt (Austria-Hungary) in 1915-1917. It was established that despite all the initial difficulties (due to the opposition of the Black Hundreds) due to the systematic work of members of the Education Department, the Education Section Social and educational circle, the Society «Prosvita» M.Drahomanov during 1915-1917 it became possible to organize the teaching of a fairly wide range of courses and literacy schools (for the illiterate). The decisive role in the organization of educational life was initially played by the Union for the Liberation of Ukraine Educational Department, which included Ukrainian public figures, educators, cooperators with university or high school education, who had developed a national worldview. Through their efforts, the Ukrainian camp organization in Freistadt created appropriate structures from among the prisoners (educational section and the Enlightenment Society), which over time took over the main burden of educational work. Its content differed significantly – if at first the emphasis was on general education courses (so as not to provoke criticism of «politics» from prisoners), then within a year educational institutions paid more and more attention to Ukrainian studies (history of Ukraine, Ukrainian language and history of Ukrainian literature). At the same time, a large number of training hours were devoted to the elimination of illiteracy among prisoners. For many prisoners, education became the meaning of their camp life, and at the same time their national awareness took place, when they – sometimes even unnoticed – began to worry about the problems of Ukraine's self-affirmation in political terms and became adherents of its independence. Статтю присвячено проблемі військового полону. Проведене дослідження фаз сучасного військового полону дозвол ило виявити їх характеристики. І фаза "Вітальних реакцій", яка триває від декількох секунд до 5 - 15 хвилин та характеризується підпорядкуванням всіх дій збереженню власного життя. ІІ фаза "Шокова" з проявами надмобілізаціі – триває від 3 до 5 годин та характеризується загальним психологічним напруженням, граничною мобілізацією психофізіологічних резервів. ІІІ фаза "Психофізіологічної демобілізації", на думку опитаних її тривалість до трьох діб. В абсолютній більшості випадків вона зв'язується з розумінням масштабів трагедії ("стрес усвідомлення"). У ІV "Фазі дозволу" (від 3 до 12 діб) динаміка стану та самопочуття військовополонених багато в чому визначається специфікою впливу екстремальних факторів. V фаза "Фаза відновлення" психофізіологічного стану починає ться переважно з кінця другого тижня після впливу екстремального фактора. The research of phases of modern military captivity revealed their characteristics. I phase is the "phase of vital reactions" that lasts from a few seconds to 5-15 minutes, and is characterized by the subordination of all actions to preservation of life. II phase is the "shock phase" with displays of excess mobilization, it lasts from 3 to 5 hours and is characterized by a general psychological stress, ultimate mobilization of psychophysiological reserves. Phase III is the "psychophysiological demobilization phase", according to the respondents, its duration can last up to three days. In most cases it is associated with understanding the scale of the tragedy ("stress awareness"). In the IV "resolution" phase" (from 3 to 12 days) the dynamics of POW's state of health is largely determined by the specific impact of extreme factors, obtained damage and moral and psychological situation after the tragic events. V phase – "recovery phase" of psychophysiological state starts as a rule at the end of the second week after exposure to extreme factors. In the last, VI phase, "phase of conflict" (lasts a month), according to 100% of the respondents, the majority developed persistent sleep disturbances, unmotivated fears, repetitive nightmares. The article describes the conditions for the collaboration of prisoners of war in different phases of the captivity.
This article examines such forms of restrictions on rights of prisoners as an obligation and a specific subjective right. Examples of how these forms of restrictions may appear in legislation are disclosed. It is shown that obligations of prisoners should be always considered as restriction of prisoners' rights. The cases in which a specific right can be recognized as a form of restriction on rights of prisoners are described. ; В статье анализируются такие формы ограничений прав осужденных, как обязанность и специфическое субъективное право. Приведены примеры, как эти формы ограничений могут проявляться в законодательстве. Показано, что обязанность всегда является ограничением прав осужденных. This article examines such forms of restrictions on rights of prisoners as an obligation and a specific subjective right. V phase – «recovery phase» of psychophysiological state starts as a rule at the end of the second week after exposure to extreme factors. In the last, VI phase, «phase of conflict» (lasts a month), according to 100% of the respondents, the majority developed persistent sleep disturbances, unmotivated fears, repetitive nightmares. The article describes the conditions for the collaboration of prisoners of war in different phases of the captivity. ; Статья посвящена проблеме военного плена. Проведенное исследование фаз современного военного плена позволило выявить их характеристики. І – фаза «Витальных реакцій», которая длится от нескольких секунд до 5-15 минут и характеризуется подчинением всех действий сохранению собственной жизни. ІІ фаза «Шоковая» с проявлениями сверхмобилизации – длится от 3 до 5 часов и характеризуется общим психологическим напряжением, предельной мобилизацией психофизиологических резервов. ІІІ фаза «Психофизиологической демобилизации», по мнению опрошенных ее длительность до трех суток. В абсолютном большинстве случаев она связывается с пониманием масштабов трагедии («стресс осознания»). В ІV – «Фазе разрешения» (от 3 до 12 суток) динамика состояния и самочувствия военнопленных во многом определяется спецификой воздействия экстремальных факторов. V фаза – «Фаза восстановления» психофизиологического состояния начинается преимущественно с конца второй недели после воздействия экстремального фактора. VІ – фаза «Конфликторенности» (через месяц), характеризовалась стойкими нарушениями сна, немотивированными страхами, кошмарными сновидениями. В статье рассмотрены условия коллаборации военнопленных в различных фазах плена.
Статтю присвячено проблемі військового полону. Проведене дослідження фаз сучасного військового полону дозволило виявити їх характеристики. І фаза «Вітальних реакцій», яка триває від декількох секунд до 5-15 хвилин та характеризується підпорядкуванням всіх дій збереженню власного життя. ІІ фаза «Шокова» з проявами надмобілізаціі – триває від 3 до 5 годин та характеризується загальним психологічним напруженням, граничною мобілізацією психофізіологічних резервів. ІІІ фаза «Психофізіологічної демобілізації», на думку опитаних її тривалість до трьох діб. В абсолютній більшості випадків вона зв'язується з розумінням масштабів трагедії («стрес усвідомлення»). У ІV «Фазі дозволу» (від 3 до 12 діб) динаміка стану та самопочуття військовополонених багато в чому визначається специфікою впливу екстремальних факторів. V фаза «Фаза відновлення» психофізіологічного стану починається переважно з кінця другого тижня після впливу екстремального фактора. VІ фаза «Конфлікторенності» (через місяць), характеризувалася стійкими порушеннями сну, невмотивованими страхами, жахливими сновидіннями. The research of phases of modern military captivity revealed their characteristics. I phase is the «phase of vital reactions» that lasts from a few seconds to 5-15 minutes, and is characterized by the subordination of all actions to preservation of life. II phase is the «shock phase» with displays of excess mobilization, it lasts from 3 to 5 hours and is characterized by a general psychological stress, ultimate mobilization of psychophysiological reserves. Phase III is the «psychophysiological demobilization phase», according to the respondents, its duration can last up to three days. In most cases it is associated with understanding the scale of the traged ("stress awareness"). In the IV «resolution" phase» (from 3 to 12 days) the dynamics of POW's state of health is largely determined by the specific impact of extreme factors, obtained damage and moral and psychological situation after the tragic events.
