The adversarial principle, the evolution and current shape of civil procedure – outline of subject matter
The adversarial principle has a long tradition in Polish civil procedure. It was one of the main principles under the Polish Civil Procedure Code of 1930. Later on, the change of the state system to socialism brought significant modifications to the shape of the subject principle. Due to the different bases of socialist civil procedure, the adversarial principle was almost completely forgotten. It was later resurrected, with another change of state system. The contemporary lawmaker is much interested in shaping the adversarial principle in the right way. The latest amendments to the Polish Civil Procedure Code of 1964 were focused on creating the proper bases for the functioning of the courts and for proper regulations regarding parties remaining active throughout the process. The presented analysis leads to the conclusion that the adversarial principle is, and always has been, of very high importance to civil procedure.

The article examines if Poland can, in accordance with international law, effectively combat pressure on the border with a country de facto supporting an aggressor. Analysis of, among others, the Geneva Refugee Convention, EU law, the European Convention on Human Rights and Fundamental Freedoms and jurisprudence validate previous findings that right to life and prohibition of torture are non-derogable, permitting to protect borders and fight with terrorism. National procedures are challenged by a need to individualize decisions refusing entry and denying protection. Still, this does not justify violating human rights.
Civil Procedure Code Amendment and its Impact on Enforcement Proceedings ; Wpływ nowelizacji Kodeksu postępowania cywilnego na usprawnienie postępowania egzekucyjnego
Discussed amendment of Civil Procedure Code has entered into force on 3 May 2012 and it is still very speculative. Polish Civil Procedure Code is an act of 17 November 1965 which regulates actions in civil cases. It has been changed many times up till now. The amendment from 3 May 2012 implements big change in enforcement proceedings. It is obvious that enforcement proceedings may be undertaken only by the legally entitled bodies. This kind of proceedings are essential for creditors. Execution must be short and effective to provide creditors protect them rights. In order to improve the service of civil courts many responsibilities are now imposed on court referendary. In addition, to improve the quality of the enforcement proceedings it was necessary to implement rise of fines. The Polish legislator implemented new institution astreinte which may force debtors to obey the executive law. The amendment introduces also new definition of executory entitlement, shorter terms for some of actions and many other changes in Polish civil procedure. Now, there is huge possibility that debtors would obey the law more successfully. Even if the amendment dated 16 September 2011 seems positive there are opinions that there were too many changes in Polish Civil Procedure Code yet. The doctrine postulate implementing new civil procedure code in order to guarantee legal certainty and stability. ; Na przestrzeni lat polski Kodeks postępowania cywilnego był poddawany licznym zmianom, którym zawdzięcza swój obecny kształt. Jedną z ważniejszych nowelizacji była ta, która weszła w życie z dniem 3 maja 2012 r. Jej źródłem była ustawa z dnia 16 września 2011 r. o zmianie ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw. Wśród głównych założeń nowelizacji wymieniono: likwidację odrębnego postępowania gospodarczego, rozszerzenie dyskrecjonalnej władzy sędziego, udzielenie dodatkowych kompetencji referendarzom sądowym oraz wprowadzenie zmian w zakresie postępowania zabezpieczającego i egzekucyjnego. Niniejsze opracowanie koncentruje się głównie na zmianach dotyczących postępowania egzekucyjnego, które miały doprowadzić do usprawnienia i przyspieszenia postępowania egzekucyjnego. Szeroko omówiono również zwiększenie zakresu kompetencji referendarzy sądowych oraz zmiany w zakresie środków przymusu, z naciskiem na wprowadzenie nieznanego do tej pory środka w postaci tzw. astreinte oraz innych. W konkluzji autorka starała się dokonać oceny zmian wprowadzonych nowelizacją.

The principle of efficiency of administrative procedure in selected Scandinavian countries and Poland ; Zasada szybkości postępowania administracyjnego w wybranych krajach skandynawskich i Polsce
The subject of this study is an analysis of legal norms focused on the efficiency of administrative procedure, including norms establishing the time limits for the administrative authorities to deal with cases and legal remedies to ensure that cases are settled without unnecessary delay. The considerations seek to verify whether the currently applicable regulations in the Polish legal system protect the right for cases to be considered in a fair manner, without undue delay, and whether they do not differ from the solutions adopted in other countries of the European Union. To compare models of administrative procedure in these terms, two Scandinavian procedures were chosen: Swedish and Finnish. It is widely accepted that Scandinavian countries are mature democracies, highly regarded for the administrative services provided to citizens and their guarantees of human rights protection. The Swedish model of administrative procedure was chosen due to the introduction of a new Administrative Procedure Act. In turn, the Finnish legal system is considered one of the most citizen-friendly public administration systems. In both Sweden and Finland, a number of improvements have been made to popularize e-administration, including actions taken to facilitate administrative procedure. ; Przedmiotem niniejszego opracowania jest analiza regulacji dotyczących sprawności postępowania administracyjnego, w tym w szczególności norm ustanawiających terminy załatwienia spraw administracyjnych i środków prawnych przysługujących stronom w celu zagwarantowania realizacji przez organ administracji publicznej obowiązku załatwienia sprawy bez zbędnej zwłoki. Założeniem, które zostanie zweryfikowane w toku prowadzonych rozważań, jest stwierdzenie, że obecnie obowiązujące regulacje w polskim systemie prawnym zapewniają możliwość realizacji prawa jednostki do rozpatrzenia sprawy w sposób sprawiedliwy, a równocześnie bez nieuzasadnionej zwłoki i nie odbiegają od rozwiązań przyjętych w innych krajach Unii Europejskiej. Koncepcje postępowania sądowoadministracyjnego w okresie funkcjonowania Rządu Tymczasowego Rosji ; Concepts of judicial administrative procedure during the Russian Provisional Government period
Publikacja recenzowana / Peer-reviewed publication ; Artykuł przedstawia tradycję i proces kształtowania się sądownictwa administracyjnego przed 1917 r. w Rosji oraz reformę Rządu Tymczasowego z dnia 30 maja 1917 r., która wprowadzić miała w tym państwie niezależne sądy administracyjne. Zgodnie z omawianą w artykule regulacją, sądownictwo administracyjne w demokratycznej Rosji miało być trójinstancyjne, co oznaczało, że wykonywane będzie przez sędziów administracyjnych w powiecie, wydziałach sądów administracyjnych sądów okręgowych w guberniach lub obwodach i wreszcie przez Senat Rządzący. Szybkość wprowadzania nowych sądów motywowana była planem przeprowadzenia reformy organów samorządu terytorialnego i wyborów do nich – legalność tych wyborów chronić miały nowe sądy. Rozpad państwa i przewrót bolszewicki sprawiły jednak, że nowych regulacji nie zastosowano w praktyce. ; Th is article presents the tradition and process of shaping the administrative judiciary before 1917 in the Imperial Russia and the reform of the Provisional Government of 30 May 1917, which introduced independent administrative courts in that country. According to this regulation, the administrative judiciary in democratic Russia was to be tri-state, which meant that it would be performed by administrative judges in the ujezd, the departments of the administrative courts of the district courts in the provinces or vicissitudes and fi nally by the Ruling Senate. Th e speed with which new courts were introduced was motivated by the fact that the reforms of local self-government bodies and the elections to them were legally protected by new courts. However, the breakup of the state and the Bolshevik revolution made it impossible to apply the new regulations in practice.

Mediacja w Kodeksie postępowania administracyjnego jako instytucja służąca realizacji zasady polubownego rozstrzygania kwestii spornych ; Mediation as an instrument for the implementation of the principle of amicable settlement of disputesin the Code of Administrative Procedure
Celem niniejszego artykułu jest omówienie instytucji mediacji jako realizacji zasady polubownego rozstrzygania kwestii spornych, zawartej w art. 13 Kodeksu postępowania administracyjnego. Na wstępie zostało przedstawione znaczenie mediacji jako alternatywnej metody rozwiązywania sporów zarówno w kontekście społecznym, jak i prawnym. Ponadto poddano analizie cel wprowadzenia do polskiego ustawodawstwa zasady polubownego rozstrzygania kwestii spornych oraz instytucji mediacji, zasady dopuszczalności mediacji z uwzględnieniem przesłanek pozytywnych oraz negatywnych, a także omówiono przebieg samej mediacji. ; The purpose of this article is to discuss the institution of mediation as an instrument for the implementation of the principle of amicable settlement of disputes set forth in article 13 of the Code of Administrative Procedure. At the beginning, the importance of mediation as an alternative method of resolving disputes in both the social and legal context was presented. In addition, the purpose of introducing the principle of amicable resolution of disputes and the institution of mediation to the Polish legislation was analyzed, as well as the principle of admissibility of mediation taking into account positive and negative premises, and the course of mediation itself was briefly discussed.

W opracowaniu omówiono przepisy regulaminów parlamentów narodowych wybranych państw członkowskich UE, a także Wielkiej Brytanii, Stanów Zjednoczonych i regulaminu Parlamentu Europejskiego, odnoszące się do kwestii objętych w regulaminie Sejmu RP pojęciem "wniosków formalnych". Pojęcie to nie zostało wyodrębnione we wszystkich omówionych regulaminach parlamentarnych. W wielu z nich regulacja odpowiadająca przedmiotowo poszczególnym wnioskom formalnym wyodrębnionym na gruncie regulaminu Sejmu pozostaje rozproszona. Z kolei w niektórych regulaminach, choć pojęcie wniosku formalnego zostało wyodrębnione, to nie zostało ono zdefiniowane i nie przewidziano zamkniętego katalogu takich wniosków. ; The paper concerns selected issues related to parliamentary procedures. The primary aim is to in‑vestigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally "formal motions"). In Poland, points of order are recognised as a sepa‑rate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how mo‑tions of similar subject scope are regulated in foreign national parliaments.

Legitymizacja władzy Unii Europejskiej - wybrane aspekty instytucjonalno-proceduralne ; Legitimization of the European Union's authority - selected institutional and procedural aspects
Unia Europejska jako specyficzna organizacja międzynarodowa dysponuje szczególnie szerokim zakresem kompetencji zaś stanowione w jej ramach akty wiążące wywołują skutki prawne nie tylko względem państw członkowskich, lecz również wobec ich obywateli. Rozumiana w ten sposób "działalność władcza" UE ma zatem szeroki wymiar. Niniejsze opracowanie koncentruje się wokół zagadnień związanych z charakterem legitymizacji władzy UE w świetle aspektów proceduralno- instytucjonalnych. Kto, w wymiarze instytucjonalnym, piastuje władzę na szczeblu unijnym, jakie relacje zachodzą między "nosicielami" unijnej władzy i czy konstrukcja procesów decyzyjnych w UE wraz z zakresem partycypacji poszczególnych instytucji w tej materii może być postrzegana jako czynnik legitymizujący Unię "w kierunku" demokracji? Problemy te zostaną omówione przez pryzmat instytucjonalnych i proceduralnych aspektów podejmowania decyzji na szczeblu unijnym. Zaznaczone i zasygnalizowane zostaną wątki kluczowe w odniesieniu do kwestii: unijnej władzy, aktorów instytucjonalnych oraz procesów podejmowania decyzji w ramach Unii Europejskiej. ; Being a specific intemational organization, the European Union enjoys a particularly extensive range of powers, while the laws enacted within its framework have legał conseąuences not only for EU member states, but their citizens as well. Understood in this manner, the 'sovereign activity' of the EU has an extensive scope. This study is focused on issues related to the naturę of the legitimization of the EU's authority as concems its procedural and institutional aspects. The issues of who institutionally wields power at EU level and what relations occur between the ' camera' of EU authority, as well as whether the decision-making processes and the scope of individual institutions in this matter might be perceived as factors legitimizing the European Union's democratic character, are discussed from the point of view of the institutional and procedural aspects of decision-making at EU level. Key issues pertaining to the topics of EU authority, institutional actors and decision-making processes within the European Union are indicated.

Admissibility of the Use of Animals for Scientific Purposes in the Light of International Public Law and EU Law ; Dopuszczalność wykorzystywania zwierząt do celów naukowych w świetle prawa międzynarodowego i prawa Unii Europejskiej
The article is aimed at assessing the regulations of the European Convention for the protection of vertebrate animals used for experimental and other scientific purposes, opened for signature in Strasbourg on 18 March 1986, and Directive 2010/63/EU of the European Parliament and of the Council of 22 September 2010 on the protection of animals used for scientific purposes in the context of their impact on the number of procedures which set out a model for the protection of animals used for scientific purposes in European countries, in the perspective of their impact on the reduction of the number of scientific procedures using animals carried out in European countries, including especially those involving the highest degree of suffering for animals. The starting point for this assessment was the identification of rules determining the admissibility of scientific use of animals in European countries and the impact that certain measures implemented under these rules may have on the reduction of the number of procedures involving animals. In principle, the analysis of these solutions is to specify the directions of further development of regulations aimed at protecting animals used for scientific purposes. ; Celem artykułu jest ocena regulacji Europejskiej Konwencji w sprawie ochrony zwierząt kręgowych wykorzystywanych do celów doświadczalnych i innych celów naukowych, sporządzonej w Strasburgu w dniu 18 marca 1986 r., oraz dyrektywy Parlamentu Europejskiego i Rady 2010/63/UE z dnia 22 września 2010 r. w sprawie ochrony zwierząt wykorzystywanych do celów naukowych w kontekście ich wpływu na liczbę procedur, które wyznaczają model ochrony zwierząt wykorzystywanych do celów naukowych w państwach europejskich, w perspektywie ich wpływu na ograniczenie liczby procedur naukowych z wykorzystaniem zwierząt przeprowadzanych w państwach europejskich, w tym w szczególności procedur wiążących się z najwyższym poziomem doznawanych przez zwierzęta cierpień. Punktem wyjścia do tej oceny było określenie zasad determinujących dopuszczalność wykorzystania zwierząt do celów naukowych w państwach europejskich, a także wpływu, jaki określone środki wdrażane w ramach tych zasad mogą wywierać na ograniczenie liczby procedur z wykorzystaniem zwierząt. W założeniu analiza tych rozwiązań ma pozwolić na wskazanie kierunków dalszego rozwoju regulacji mających na celu ochronę zwierząt wykorzystywanych w celach naukowych.
