In learning processes, the affective-relational aspect plays a strategic role of no less importance than the cognitive sphere. The traditional education offerings at schools and, even more, universities, very often neglect the necessary integration between these aspects. Art, in its various forms and its many languages, can promote motivation, interest, participation and passion in the learner and can be an effective element of connection between "the reasoning of the heart and the reasoning of the mind". The art languages are characterized by an uninterrupted flow of images, awesomeness, references, open-mindedness which predisposes to meta-learning, a crucial resource for the global education. A network connecting von Foerster, Van Gogh, Bateson and Frida Kahlo stems from narration about art, ethics, therapy, science and political activism. ; Nei processi di apprendimento, l'aspetto affettivo-relazionale ha un ruolo strategico di non minore importanza rispetto alla sfera cognitiva. Le offerte di formazione tradizionali delle scuole e, ancor più, delle università, molto spesso trascurano la necessaria integrazione tra questi aspetti. L'arte, nelle sue varie forme e nelle sue molte lingue, può promuovere la motivazione, l'interesse, la partecipazione e la passione nello studente e può essere un elemento efficace di collegamento tra "il ragionamento del cuore e il ragionamento della mente". I linguaggi dell'arte sono caratterizzati da un flusso ininterrotto di immagini, suggestioni, riferimenti, apertura mentale che predispone a un meta-apprendimento, una risorsa cruciale per l'educazione globale. Una rete che collega von Foerster, Van Gogh, Bateson e Frida Kahlo nasce dalla narrazione intorno all'arte, all'etica, alla terapia, alla scienza e all'attivismo politico.
In recent decades fascinating studies in developmental psychology, especially in infant research (for review see Lavelli, 2007) and recent discoveries in neuroscience (Welsh, et al, 2007; Siegel, 2001; Pally, 2007) have brought great interest to study the mode of sharing subjective experiences (affective states, intentions and attentional focus) in children and adults.It therefore appears today in the clinic is a growing consensus about the fact that the psychological disorder can be read as a deficit in intersubjective processes of affect regulation (see Benecke C. et al 2005; psychodynamic Diagnostic Manual-PDM, 2006) leading many authors to assume the centrality of affect regulation in the construction of the psychotherapeutic process of change (just to name a few Tronick, Greenberg, Stern, Sander, Fonagy, Beebe, Philippot, Rimé etc.). As previously stated, this study has led us to hypothesize that the long process of therapy is to assist with the sessions continue, a growing "emotional attunement" between the communication styles of both patient and therapist. And also to speculate that this synchronization can represent the existence of a significant positive correlation between the increased level of "emotional synchronization" and increased capacity for regulation of emotions by the patient.The research results despite the limitations of small sample showed encouraging results about the verification of the existence of an increasing degree of attunement between therapist and patient long psychotherapy sessions and also showed a good degree of positive correlation between the increase the latter construct and emotional regulation through the implicit mode of expression and nonverbal communication.
According to received literature, vertical integration may enjoy a social superiority due to the ability to internalize the externality that goes back from the pricing policy of the downstream firm to the profits of the upstream firm. We challenge this result introducing process R&D in a broad set of scenarios with vertically symmetric and asymmetric R&D commitments. In some of these contexts a reversed sequence of socially desirable vertical arrangements arises, making out-sourcing superior. In other circumstances disintegration is privately superior but socially in efficient. Finally, vertically asymmetric costs of R&D are considered to allow for a wider range of applications.
Sommario: Il principio del contraddittorio è cardine portante della struttura del processo. Sia l'ordinamento italiano, sia quello canonico si basano essenzialmente sul principio del contraddittorio e sul diritto di difesa, ponendo al centro la persona. L'ordinamento statale italiano e quello canonico non sono però immediatamente assimilabili, soprattutto per ciò che concerne i motivi che ne ispirano l'azione. Pur avendo in questa prospettiva elementi che contribuiscono alla divergenza tra i due ordinamenti ognuno dei due si ritrova di fronte alla necessità di dettagliare, in termini di diritto positivo, principi specifici, ma probabilmente sono molti di più i valori comuni, che rivendicano la loro normatività sia nei confronti della società civile sia di quella ecclesiale, anzi postulano una loro sana cooperazione. ; Abstract: The adversial principle is the pillar of a legal process. Indeed, both the Italian and canonical legislation hinge on the adversial principle and the right of defense, with the 'person' being centerstage. Albeit the two legislations diverge in several respects, the points in common seem to prevail, especially when considering their roles vis-à-vis the civil society and the canonical order, respectively, and the need to promote a healthy/peaceful cooperation between the two.
La diffusione del processo penale telematico è ostacolata da molteplici cause. Aspetti di natura normativa poiché, tra l'altro, non è ancora possibile esimersi dal deposito cartaceo della notizia di reato ai sensi dell'art 109 Disp. Att.c.p.p. e degli atti successivi anche se telematicamente trasmissibili senza, però, poter essere, per ragioni tecniche, firmati digitalmente. Inoltre la segretezza delle indagini preliminari e le esigenze garantistiche proprie del processo penale sono state un deterrente all'implementazione dei sistemi informativi nel corso degli anni. Aspetti di natura tecnica, in quanto, in ambito penale, vengono utilizzati diversi sistemi informativi a differenza del processo civile dove l'applicativo è unico. Aspetti di natura organizzativa: la peculiarità propria dell'ufficio giudiziario consiste nella coesistenza di due differenti tipologie di categorie lavorative: da un lato i magistrati che si caratterizzano per le forti logiche d'azione autonoma e dall'altro il personale amministrativo, categoria all'interno della quale i rapporti sono regolati rigidamente. Tale profonda differenza ha ostacolato la diffusione dei sistemi informativi negli uffici giudiziari e l'unica soluzione realisticamente percorribile, per arginare il problema, consiste in un approccio conciliativo e di mediazione tra le differenti tipologie dei soggetti operanti nel settore giustizia italiano, come confermato dalle interviste effettuate negli uffici stessi. Approccio finalizzato alla condivisione dell'importanza della diffusione dell'Information Technology, che, se condivisa dal personale togato e non, arginerebbe, fin dall'inizio, il rischio di rigetto del sistema informativo. Condivisione non solo degli obiettivi da perseguire, ma anche delle problematiche informatiche, giuridiche ed organizzative che le due tipologie di organizzazione si trovano a dover affrontare nel corso dell'implementazione del sistema informativo al fine di trovare di volta in volta soluzioni concrete, ragionate collettivamente, al problema specifico che si deve risolvere. ; The spread of the criminal justice process is hampered by multiple causes. Moreover, the secrecy of preliminary investigations and the safeguarding needs of the criminal process have been a deterrent to the implementation of a telematic informative systems over the years. Aspects of a technical nature, a criminal justice process uses different telematic information systems unlike the civil process where a unique telematic application is used. Organizational aspects: the peculiar nature of the judicial office consists in the coexistence of two different types of work categories: on one hand, magistrates are characterized by the strong logic of independent action and, on the other hand, the administrative staff, a category within which relations are rigidly regulated. Such a profound difference has hindered the spread of information systems in the judicial offices, and the only realistic solution to solve this problem lies in a conciliatory approach and mediation between the different types of people working in the Italian justice sector, as confirmed by the interviews Carried out in our offices. An approach towards sharing the importance of the dissemination of Information Technology, which, if shared by the hired staff and freelancers, would eliminate the risk of rejection of the information system. Sharing not only the objectives to be pursued, but also the IT, legal and organizational issues that the two types of organizations face when implementing the information system in order to find concrete collective solutions, to specific problems that needs to be resolved.
Il contributo rappresenta una rielaborazione del progetto "Dove va l'Europa? Percorsi e prospettive del federalizing process europeo" con cui il Gruppo di ricerca composto dalla Sapienza –Università di Roma, l'Università degli Studi di Milano, l'Università degli Studi di Torino e l'Alma Mater Studiorum–Università di Bologna ha partecipato con esito positivo al Bando PRIN 2017. Lo scopo di tale progetto è quello di comprendere le prospettive reali del processo di integrazione attraverso un'analisi scientifica di quelli che sono allo stesso tempo i suoi aspetti fondanti e problematici e a cui fanno capo i profili di ricerca che sono stati individuati in vista del conseguimento degli obiettivi del progetto.
La tesi affronta il tema dell'abuso del processo all'interno del sistema penale italiano, tentando una ricostruzione che, muovendo dal piano interno, adotta come ulteriori punti di riferimento l'indagine comparatistica (in particolare, diretta verso il sistema anglosassone) e l'analisi sintetica della nozione di Abuse of Right a livello sovranazionale (più nello specifico, con riguardo alla Convenzione europea dei diritti dell'uomo e delle libertà fondamentali e alla Carta dei diritti fondamentali dell'Unione europea). Da una ricognizione dello scenario maturato nel sistema interno, si tenta di tracciare una delimitazione dei connotati della categoria dogmatica in oggetto (attraverso l'analisi, in particolare, della pronuncia della Suprema Corte (Sez. un., 29 settembre 2011 (dep. 10.1.2012) n. 155, Rossi). Si prosegue con lo studio comparatistico: il sistema preso a modello è quello anglo-gallese, con uno studio diretto ad evidenziare punti di divergenza e, al contempo, l'esistenza di tratti comuni che possano consentire un'eventuale mutuazione delle soluzioni adottate in quella sede. Si procede con la ricognizione del panorama normativo ed interpretativo sovranazionale in materia: i summenzionati testi legislativi rendono contezza del radicamento di tale categoria anche a tale livello, palesando concretamente l'idea della necessità di un adeguamento interno in materia. Le riflessioni finali convergono in una critica delle impostazioni giurisprudenziali emerse nell'ordinamento italiano e dei limiti dell'inquadramento offerto, nonché dell'incapacità della categoria dogmatica così elaborata di offrire adeguate soluzioni ai reali generati dall'abuso del processo; donde la necessità di pervenire alla prospettazione di un diverso paradigma della nozione, secondo una ricostruzione che, pur non negando l'essenzialità del principio di stretta legalità in ambito processuale, ne concepirebbe un temperamento, con l'ipotesi di una elaborazione per via interpretativa di una clausola generale di divieto di abuso, diretta ad offrire una risposta sia agli eventuali comportamenti scorretti dell'accusa (capaci di minare alla radice le garanzie della difesa), sia a quelli dell'imputato. ; The thesis faces the topic of the abuse of process within the Italian criminal system, through an analysis which, moving from the national view, adopts as further points of reference the comparative research (particularly, focused on the England and Wales legal system) and the synthetic analysis of the notion of Abuse of Right on to international level (more in the specific one, with respect to the European Convention of the Human Rights and the Fundamental Chart of Human Rights). From a recognition of the scenario, matured in the italian system, I attempt to trace a delimitation of the essential elements of the dogmatic category (through the analysis, particularly, of the pronunciation of the Supreme Court (Sez. Un., September 29 th 2011, Rossi). The research keeps on with the comparative perspective: I focus the England and Wales system, with a study aimed at highlighting points of divergence and, at the same time, the existence of common traits that may allow to mutuate solutions adopted in that headquarters. Therefore, I conduct a recognition of the international legal scenario and interpretative panorama on the subject is made. Final reflections converge in a critique of the jurisprudence made in Italian law and of the limits of the framing offered, as well as of the inability of the dogmatic category so elaborated to offer appropriate solutions to the real problems generated by the abuse of process and, perhaps, the necessity to come up with the prospect of a different paradigm of the notion, according to a reconstruction that, while not denying the essence of the principle of strict legality in a procedural context, would conceive of a temperament of it, intended to offer an answer to any untrue behavior of the prosecution (capable of undermining the defense's defense), as well as those of the defendant.
This dataset contains the underlying data of the following article that has been accepted for publication in the Journal of Adolescent Research: Albanesi, C., Prati, G., Guarino A., Cicognani, E., (in press) SCHOOL CITIZENSHIP EDUCATION THROUGH YPAR: WHAT WORKS? A MIXED METHOD STUDY IN ITALY. Journal of Adolescent Research The dataset consists of quantitative and qualitative data. Longitudinal quantitative data were collected in Italy within Work Package 9 of the Horizon 2020 research project CATCH EyoU (Constructing AcTive CitizensHip with European YOUth: Policies, Practices, Challenges and Solutions). The sample consists of 56 Italian students who completed the fours waves. The dataset was used in the analysis of evaluation of the school intervention based on YPAR approach, considering school climate, quality of participation and peer norms. The four times of data collection are identified by the following letters: T1 (October 2016) = all variables with "A"; T2 (May 2017) = all variables with "KA"; T3 (October 2017) = all variables with "B"; T4 (May 2018) = all variables with "KB" The National report contains the evaluation of the overall school intervention, integrating qualitative and quantitative data. This data is made available for open access in compliance with H2020 Program regulation, following the guidelines stipulated by the Data Management Plan adopted by the CATCH-EyoU research project.
