The juristic protection of cultural heritage in Libya has been divided into two distinct periods. The first before 1869 was characterized by the absence of specific legislation. Apparent remains and transportable archaeological pieces were exposed to pillage and bargaining, while intangible heritage was transmitted through a popular memory that lost part of its cultural heritage over time. The second period, from the mid-nineteenth century, is marked for the Libyan heritage by a desire for protection. From 1869 to the present and after independence, it has had different stages and varying degrees in the preservation of cultural property from a legal point of view.This doctoral research is particularly interested in the last 150 years when the definition of the heritage and the vision of the Muslim law on the heritage were taken into account, because the religious heritage remains deeply in the minds of the people and constitutes an obstacle to the acceptance of several forms of cultural heritage.From the various powers that have been exercised in Libyan territory, it is possible to understand the contributions and limits, the influences and developments, the stakes and the actors, the normative provisions and their application during the Ottoman period, Italian occupation and finally the British military administration. These two European countries have focused on the protection of the tangible cultural heritage and its rediscovery. As in other areas, intangible heritage has received special attention from both administrations.After the proclamation of independence, interest in cultural heritage was lessened despite the many laws and resolutions promulgated favorable to the emergence of a national heritage law and intended to protect cultural wealth due to the discovery large quantities of oil. The country then directs its economy towards the exploitation of a rent implying the abandonment of the other resources of the country. The economy was privileged and the state gave no importance to the development of archaeological tourism.In addition, awareness of the importance of heritage as a constituent part of the cultural identity of the people has not been anchored in the minds of most citizens, in particular because of educational programs that do not Heritage issue. On the other hand, they were saturated with discriminatory nationalist subjects to combat internal and external cultural diversity. The propaganda of the old regime has tried to do so over the decades. With the collapse of the regime of Colonel Gaddafi in 2011, a new patrimonial legislation made it possible to take into consideration new areas. Possible developments can be expected from the influence of international conventions.This thesis, by analyzing the evolution of the legal protection of the Libyan cultural heritage and making available the normative corpus elaborated over the centuries, is a first step for future research on cultural heritage and more broadly on the question Of Libyan law. ; La protection juridique du patrimoine culturel en Lybie a connu deux périodes distinctes. La première avant 1869 se caractérisait par l'absence de législation spécifique. Les vestiges apparents et les pièces archéologiques transportables étaient exposés au pillage et au marchandage tandis que le patrimoine immatériel se transmettait par une mémoire populaire qui perdait au fil du temps une partie de son héritage culturel. La seconde période, à partir du mitan du XIXe siècle, est marquée pour le patrimoine libyen par une volonté de protection. Il a connu depuis 1869 jusqu'à nos jours et après l'indépendance, différentes étapes et divers degrés dans la préservation de biens culturels d'un point de vue juridique.Cette recherche doctorale s'intéresse particulièrement à ces quelques 150 années où l'intérêt a été porté à la définition du patrimoine et à la vision de la loi musulmane sur le patrimoine car l'héritage religieux reste très ancré dans l'esprit des gens et constitue une entrave à l'acceptation de plusieurs formes de patrimoine culturel.A partir des différents pouvoirs qui se sont exercés sur le territoire libyen, il est permis de saisir les apports et les limites, les influences et les évolutions, les enjeux et les acteurs, les dispositions normatives et leur application pendant la période ottomane puis l'occupation italienne et enfin l'administration militaire britannique. Ces deux pays européens se sont intéressés à la seule protection du patrimoine culturel matériel et à sa redécouverte. Comme en d'autres espaces, le patrimoine immatériel n'a bénéficié d'une attention particulière de ces deux administrations.Après la proclamation de l'indépendance, l'intérêt porté au patrimoine culturel a été moindre malgré les nombreuses lois et les résolutions promulguées favorables à l'émergence d'un droit national du patrimoine et destinée à protéger les richesses culturelles en raison de la découverte d'importantes quantités de pétrole. Le pays alors oriente son économie vers l'exploitation d'une rente impliquant l'abandon des autres ressources du pays. L'économie a alors été privilégiée et l'Etat n'a donné aucune importance au développement du tourisme archéologique.Par ailleurs, la conscience de l'importance du patrimoine comme constitutive de l'identité culturelle du peuple n'a pas été ancrée dans l'esprit de la plupart des citoyens, notamment à cause des programmes d'enseignement ne faisant pas état de la question patrimoniale. Par contre, ils étaient saturés de sujets nationalistes discriminatoires pour lutter contre la diversité culturelle intérieure et extérieure. La propagande de l'ancien régime s'est efforcée d'agir ainsi durant les décennies. Avec la chute du régime du colonel Kadhafi en 2011, une nouvelle législation patrimoniale a permis de prendre en considération de nouveaux domaines. De possibles évolutions sont à attendre de l'influence des conventions internationales.Cette thèse, par une analyse de l'évolution de la protection juridique du patrimoine culturel libyen et la mise à disposition du corpus normatif élaboré au cours des siècles, est une première étape pour de futures recherches relatives au patrimoine culturel et plus largement à la question du droit libyen.

Based upon the graduate seminar tought in 2014-2015 by Valérie Gelézeau at l'École des hautes études en sciences sociales (EHESS), this essay tries to engage a reading of the North Korean movie 'The Wheels of Happiness' (2010). After an introduction briefly reviewing the condition of production and the nature of cinema in the Democratic People's Republic of Korea (North Korea), the paper proposes to go beyond usual readings of North Korean fictions that often limit their conclusions and demonstration to the fact that they convey State propaganda.Drawing from the film's aesthetics, we questioned its narrative structure and analyzed its discourse.What do' The Wheels of Happiness' tell us about North Korean cinema and society today? What can bring to the scholarship an engaged reading of this movie? The engagement involved is modest but significant: we tried to implement an approach that means to understand, before it judges. Our reading thus takes into account the context of cinematographic production in the DPRK (a cinema controlled by the censorship of a totalitarian State using art to impose its ideology), without drifting into the simplistic moral judgments that the analysis of art and literary productions coming from the DPRK usually instigates.In a first part, the paper gives an account of synopsis and the story, before discussing certain aspects of the movie's symbolic discourse and aesthetics, in the North Korean context. We particularly develop on the issue of temporality (symbolically evoked by the "Wheels" of the title) that structures the narration, which refers to certain aesthetics' standards of the national cinema. In the second part, we analyze what 'The Wheels of Happiness' tell us about contemporary Korean society. In the core of the discourse stand gender issues and the woman's role in society, between family, work, and patriotic dedication. But two other topics brought interesting discussions: the first one dealing with objects of the material civilization as diverse as food and computers; the other one dealing with the central issue, political and national, of architecture in Pyongyang.This work points out to the limitations of approaches via film and cinema without much access to the agents of their production or sources allowing us to approach them – which is the case of most North Korean materials. The essay questions what North Koreans say about themselves and their society, within the very logics of official discourse and propaganda; by doing so, it applies a state of mind that hopes to avoid the moralizing "Othering" of North Korea where many narratives about that country (by media, experts and even academics) are often trapped. In the end, it is a concrete application of the seminar that proposed to think about epistemological conditions to study North Korea, ways to approach fieldwork and available sources and materials. ; Ecrit à partir du séminaire de V. Gelézeau (« Etudier la Corée du Nord – une introduction », EHESS 2014-2015), cet essai propose une lecture « engagée » du film nord-coréen The Wheels of Happiness (2010). Après avoir brièvement rappelé en introduction les conditions de production et la nature du cinéma en République Populaire Démocratique de Corée (Corée du Nord), le texte propose de dépasser les lectures habituelles de toutes les fictions nord-coréennes, qui se limitent souvent au constat et à la démonstration que celles-ci véhiculent la propagande d'État.Partant de l'esthétique de ce film, nous en avons questionné la structure narrative et analysé le discours.Que nous disent « Les roues du bonheur » du cinéma coréen et de la société nord-coréenne d'aujourd'hui ? Que peut apporter une lecture engagée de ce film à la recherche sur ce pays ? L'engagement dont il s'agit est modeste, mais signifiant : il s'agit de mettre en œuvre une approche traduisant d'abord une volonté de comprendre, avant de juger. Nous avons donc tenté de lire en ayant certes à l'esprit le contexte de la production (la production cinématographique contrôlée par la censure d'un État totalitaire utilisant l'art pour véhiculer son idéologie), mais sans se laisser aller aux simplistes jugements moraux que l'analyse de productions artistiques et littéraires venant de RPDC suscite habituellement.Dans une première partie, après avoir rendu compte du synopsis et de la dynamique de l'intrigue, nous discutons certains aspects saillants du discours symbolique du film et de son esthétique, dans le contexte nord-coréen. Nous développons ainsi particulièrement la question de la temporalité (représentée symboliquement par la roue du titre), qui structure la narration, ce qui s'inscrit dans certains canons de l'esthétique d'un cinéma national. Dans une deuxième partie, nous analysons ce que « Les roues du bonheur » nous disent de la société nord-coréenne d'aujourd'hui. Au cœur du sujet, on trouve bien sûr la femme et son rôle dans la société, entre famille, travail et mission patriotique. Mais deux autres directions nous sont apparues intéressantes : l'une traitant d'objets de la civilisation matérielle aussi différents que la nourriture et les ordinateurs ; l'autre portant au contraire sur la question centrale, politique et nationale, de l'architecture à Pyongyang. Ce travail souligne la limitation des approches par le matériau filmique sans aucun accès aux agents de production ou à des sources permettant de les approcher – ce qui est le cas de la plupart des matériaux nord-coréens. Le texte, qui s'interroge sur ce qui, dans la logique-même du discours officiel et de la propagande, est dit, par les Nord-Coréens eux-mêmes, de leur société, met aussi en pratique une manière de travailler sur la Corée du Nord qui parvient à éviter l'approche orientalisante et moralisante de ce pays, dans laquelle s'enferment la plupart des discours le concernant. Au final, il s'agit d'une application concrète du séminaire qui proposait de réfléchir aux conditions d'études de la Corée du Nord, à la manière d'aborder le terrain et les matériaux disponibles.

The age-old link and "socialist friendships" between China and various African states have enjoyed a privileged position in Beijing's foreign policy since the proclamation of the People's Republic of China in 1949. As a "proving ground" of China's soft power and an exceptional place to project the "Chinese Dream", Africa has become a valuable target of Beijing's socialist development model. China weaves relationships with African populations through intense public diplomacy. Such practice revolves around its promise to sustain economic growth and to improve the daily lives of people in Africa. The Confucius Institute is currently a flagship brand of China's statecraft in Africa through which Beijing advances its reputation among local publics. Beyond its pedagogical and cultural missions, the Confucius Institute is an effective but subtle spokesperson for Beijing. Within its local branches, trained employees actively participate in a long-term strategy of influence based on affective engagement. They engage local students in numerous group activities and build strong bonds with them. Their voices are individual, but their homogenous discourse resonate with "China's voice" to deliver formulated Communist Party of China's propaganda to foreign publics. In doing so, these teachers wield China's soft power. The aim of this Ph.D. dissertation is to examine public diplomacy with Chinese characteristics, its conceptualization, institutionalization, and practices. From a communication perspective, this study is an exploration of the hybrid and complex nature of China's public diplomacy, which Beijing has strategically organized to deploy its soft power in Africa.Ethnographic observation in Nairobi, Beijing, and Shanghai shed light on the strategic communication practices associated with the Confucius Institute. By mobilizing institutional discourse and media discourse studies and conducting semi-structured interviews, I investigated the daily educational and cultural activities conducted by Confucius Institute employees for African students. This investigation captured the intra- and inter-organizational relationships among a local Confucius Institute in Nairobi, its Headquarters (also named Hanban) in Beijing, and its various Chinese and foreign partners.The Confucius Institute in Nairobi is at the heart of several networks involved in implementing Chinese public diplomacy, working to improve Kenyans' perception of China, and legitimizing Beijing's foreign policy and economic presence. First, within a strategic interpersonal relationship management network, the Confucius Institute's employees use various cultural, artistic and social practices and narratives to engage students (micro-level). Second, cooperative and interdependent relationships between actors within and around the Confucius Institute facilitate the implementation of the public diplomacy with Chinese characteristics (meso-level). Finally, China's domestic and foreign policy and the Forum on China-Africa Cooperation enable the Chinese Party-State to implement a legitimization strategy based on the weaving of an "institutional network". This network allows the Confucius Institute, in subtle and soft ways, to defend Beijing's economic interests in Africa and to disseminate its political model (macro-level). ; Le lien millénaire qui relie la Chine-Afrique jouit d'une position privilégiée dans la diplomatie chinoise depuis la proclamation de la République populaire de Chine en 1949. The age-old link and "socialist friendships" between China and various African states have enjoyed a privileged position in Beijing's foreign policy since the proclamation of the People's Republic of China in 1949. As a "proving ground" of China's soft power and an exceptional place to project the "Chinese Dream", Africa has become a valuable target of Beijing's socialist development model. China weaves relationships with African populations through intense public diplomacy. Such practice revolves around its promise to sustain economic growth and to improve the daily lives of people in Africa. The Confucius Institute is currently a flagship brand of China's statecraft in Africa through which Beijing advances its reputation among local publics. Beyond its pedagogical and cultural missions, the Confucius Institute is an effective but subtle spokesperson for Beijing. Within its local branches, trained employees actively participate in a long-term strategy of influence based on affective engagement. They engage local students in numerous group activities and build strong bonds with them. Their voices are individual, but their homogenous discourse resonate with "China's voice" to deliver formulated Communist Party of China's propaganda to foreign publics. In doing so, these teachers wield China's soft power. The aim of this Ph.D. dissertation is to examine public diplomacy with Chinese characteristics, its conceptualization, institutionalization, and practices. From a communication perspective, this study is an exploration of the hybrid and complex nature of China's public diplomacy, which Beijing has strategically organized to deploy its soft power in Africa.Ethnographic observation in Nairobi, Beijing, and Shanghai shed light on the strategic communication practices associated with the Confucius Institute. By mobilizing institutional discourse and media discourse studies and conducting semi-structured interviews, I investigated the daily educational and cultural activities conducted by Confucius Institute employees for African students. This investigation captured the intra- and inter-organizational relationships among a local Confucius Institute in Nairobi, its Headquarters (also named Hanban) in Beijing, and its various Chinese and foreign partners.The Confucius Institute in Nairobi is at the heart of several networks involved in implementing Chinese public diplomacy, working to improve Kenyans' perception of China, and legitimizing Beijing's foreign policy and economic presence. First, within a strategic interpersonal relationship management network, the Confucius Institute's employees use various cultural, artistic and social practices and narratives to engage students (micro-level). Second, cooperative and interdependent relationships between actors within and around the Confucius Institute facilitate the implementation of the public diplomacy with Chinese characteristics (meso-level). Finally, China's domestic and foreign policy and the Forum on China-Africa Cooperation enable the Chinese Party-State to implement a legitimization strategy based on the weaving of an "institutional network". This network allows the Confucius Institute, in subtle and soft ways, to defend Beijing's economic interests in Africa and to disseminate its political model (macro-level). ; Le lien millénaire qui relie la Chine-Afrique jouit d'une position privilégiée dans la diplomatie chinoise depuis la proclamation de la République populaire de Chine en 1949. Prestigious genre, heir to a long tradition, the history painting experiences multiple evolutions throughout the 19th century. Under the Second Empire, for a long time a regime marked by its "black legend", the genre still remained to be defined. Its characteristics fix it deeply in its century, while conferring it an originality : an emanation of the history painting and its transformations in the first half of the century, a precursor of its reformulation under the Third Republic, the history painting under the Second Empire is marked by its singularity. The study of the representations of history painted between 1860 and 1870 is revealing there. Straightaway, the correlation between the creations and the term of "history painting" raises questions. Indeed, while remaining in a classic subject (history), these "paintings on historic subject" get closer alternately to the genre painting and the historic genre, and are contaminated by the realism and the interest in the local colour. If the academic expression of "history painting" still suits for the painting of battle, the latter is also touched by the modernity and transformed into military painting. The approach of the painters of historic subjects presents recurrences. An important preparatory work, on texts, sources, even archaeological discoveries, is put in the service of positivist reconstructions of the events, in order to raise the interest of the public. The choice of the subjects varies according to the intentions: educate the spectator, show an idealised past used as directory of moving scenes, or develop an ideology. Beyond the historicist dimension of education about the national past, these pieces of art show a certain state of the historic thought, the main currents of ideas that influenced the painters. Moreover, the latter convey and spread a conception of history that reaches the contemporary through the press and the illustration, and so they contribute to build the image that will be anchored in the memory. A traditional mean of propaganda and "manufacturing" of the power, the history painting raises the question of the cultural practices of the government of the Second Empire. The instrumentalisation of the image by the State is real, but is restricted to the paintings of battle and of the imperial splendour. Napoleon III, in his acquisition policy, adapts himself to the creations more than he generates them. On the other hand, he exercises an indirect influence: the staging of his person, the imperial couple and its tastes in history, offer a series of themes exploited by the painters. The painting of historic subject is not instrumentalised within the framework of the envois of the State. The local elites play an essential role in the development of this genre: municipalities and Learned societies, town councillors and scholars encourage creations on national or local history. The representation of the history between 1860 and 1870 reveals the essential place of history, in its erudite and popular aspects, on a national and local scale, inspired by the feeling of attachment to the "small homeland" as well as the nation. ; Genre prestigieux héritier d'une longue tradition, la peinture d'histoire connaît de multiples évolutions tout au long du XIXe siècle. Sous le Second Empire, régime longtemps affecté par sa « légende noire », ce genre restait encore à définir. Il présente des caractéristiques qui l'inscrivent véritablement dans son siècle, tout en lui conférant une originalité : émanation de la peinture d'histoire et de ses mutations dans la première moitié du siècle, précurseur de sa reformulation sous la Troisième République, la peinture d'histoire sous le Second Empire est marquée par la singularité. L'étude des représentations de l'histoire peintes entre 1860 et 1870 en est révélatrice. D'emblée, la corrélation entre les créations et le terme même de « peinture d'histoire » pose question. En effet, tout en se maintenant dans un sujet classique (historique), ces « peintures à sujet historique » se rapprochent tour à tour de la peinture de genre et du genre historique, et sont contaminées par le réalisme et le goût de la couleur locale. Si l'expression académique de « peinture d'histoire » convient encore à la peinture de bataille, cette dernière subit aussi les assauts de la modernité et connaît une mutation sous la forme spécifique de la peinture militaire. La démarche des peintres de sujets historiques présente des récurrences. Un important travail préparatoire, à partir de textes, de sources voire de découvertes archéologiques, est mis au service de reconstitutions positivistes des événements, permettant de susciter l'intérêt du public. Le choix des sujets varie selon les intentions : édifier le spectateur, montrer un passé idéalisé utilisé comme répertoire de sujets émouvants, ou encore exposer une idéologie. Au-delà de la dimension historiciste d'éducation par le passé national, ces œuvres donnent à voir un certain état de la pensée historique, des principaux courants d'idées qui ont influencé les peintres. Plus encore, ces derniers véhiculent et diffusent une conception de l'histoire qui rejaillit sur leur présent par l'intermédiaire de la presse et de l'illustration, et ils contribuent ainsi à construire l'image qui va s'ancrer dans les mémoires. Support traditionnel de propagande et de « fabrication » du pouvoir, la peinture d'histoire conduit à se poser la question des pratiques culturelles du gouvernement du Second Empire. L'instrumentalisation de l'image par l'État est réelle, mais se cantonne aux peintures de bataille et aux figurations du faste impérial. Napoléon III, dans sa politique d'acquisition, s'adapte aux créations plus qu'il ne les génère. En revanche, il exerce une influence indirecte : la mise en scène de sa personne, du couple impérial et de ses goûts historiques, offre une série de thèmes exploités par les peintres. La peinture à sujet historique n'est pas instrumentalisée dans le cadre des envois de l'État. Les élites locales jouent un rôle essentiel dans le développement de ce genre : municipalités et Sociétés savantes, édiles et érudits encouragent les créations sur l'histoire nationale ou locale. La représentation de l'histoire entre 1860 et 1870 donne à voir la place primordiale de l'histoire, dans ses aspects savants et populaires, à échelle nationale et locale, inspirée par le sentiment d'attachement à la « petite patrie » comme à la nation

Cette thèse propose une étude du langage des arts martiaux Shaolin (Shàolín 少林) en spectacles vivants dans trois œuvres des arts de la scène. Deux spectacles sont d'origine chinoise, et se situent sous un paradigme ouvert, dit de spectacles populaires ou grand public, à savoir Chun Yi: The Legend of Kung Fu et Shaolin Warriors: The Legend Continues. Le second paradigme est plus fermé, puisque Sutra est un spectacle de danse contemporaine dont la valeur artistique est reconnue. Sutra a été créé par une équipe sinoeuropéenne, dans la chorégraphie de Sidi Larbi Cherkaoui avec des moines du temple Shaolin (Shàolín Sì 少林寺). Nous avons utilisé la théorie de l'anthroposémiotique (Jacques Fontanille et Nicolas Couégnas, 2018) et des méthodes hybrides d'investigation relevant de l'Observation-Analyse du mouvement (OAM de Nicole Harbonnier, 2014), de la sémiotique de la martialité (Mahamadou Lamine Ouédraogo, 2018), des sciences de la culture (Joseph Melançon, 2002) et du Soft Power (Joseph Nye, 1990). Les deux grilles d'analyse que nous avons construites en fonction des différents apports théoriques et méthodologiques, nous ont permis de mettre au jour la structure d'un récit canonique et les moyens de la mise en scène des arts martiaux Shaolin, les usages politiques de ces spectacles et, finalement, les fonctions de la puissance culturelle douce chinoise (PCDC) telle que manifestée dans les trois spectacles du corpus. Les codes culturels de la Chine et de l'Occident se retrouvent en situation de dialogisme interculturel, soit dans la structure même des spectacles ou dans les usages qui en sont faits. Cette fonction dialogique du Kung Fu Shaolin (Shàolín gōngfu 少林功夫 ) dans les arts de la scène s'est manifestée à plusieurs niveaux de lecture et d'analyse des spectacles. Entre autres, nous avons établi que la puissance culturelle douce chinoise participe d'une stratégie de mise en valeur de la culture traditionnelle chinoise via la représentation des valeurs de la culture socialiste avancée, par la culture d'harmonie, par le « rêve chinois », par le « consensus de Pékin » et, finalement, par le socialisme avec des caractéristiques chinoises. La Chine ne valorise pas uniquement les outils traditionnels de la culture Shaolin (Shàolín 少林), elle favorise aussi les innovations culturelles par les coopérations internationales, notamment avec l'Europe. Le spectacle Sutra du corpus en fait foi. Les codes culturels Shaolin (Shàolín 少林) y sont modifiés, restructurés, éclatés dans une explosion (Juri Lotman) de nouveauté et d'ouverture vers l'Autre. Cette conscience dialogique de l'ipséité et de l'altérité dans un produit culturel transgénique fait preuve d'une ouverture commune vers l'Autre et d'une collaboration constructive dans un échange égalitaire. La valeur de prestige mise en place dans les produits culturels chinois rend compte de phénomènes reliés au continu de la tradition ou bien au discontinu de l'explosion d'une nouveauté. Notre regard de spectateur et d'analyste nous a permis de saisir l'ampleur du phénomène de la puissance culturelle douce chinoise dans un discours politique officiel émanant du président Xi, Jinping ou de la politique culturelle chinoise mise en place par Xi, Chinese Culture Going Global, visant à combler le déficit de la soft power chinoise. Ces discours prônent la culture socialiste aux caractéristiques chinoises tant à l'intérieur de la sémiosphère de la Chine qu'à l'extérieur du pays sur la scène internationale, soulignant ainsi son désir d'affirmation de son statut de superpuissance à l'échelle planétaire. L'initiative de la Ceinture et de la Route de la soie et des projets associés contribuent à l'affirmation nationale et au discours de propagande dissimulé dans la structure et les usages des divers produits culturels chinois ou en co-productions avec des artisans de l'Occident. ; This thesis proposes a study of the language of Shaolin (Shàolín 少林) martial arts in live performances in three works of the performing arts. Two shows are of Chinese origin and fall under an open paradigm known as popular or mainstream shows, namely Chun Yi: The Legend of Kung Fu and Shaolin Warriors: The Legend Continues. The second paradigm is more closed, since Sutra is a contemporary dance show whose artistic value is recognized. Sutra was created by a Sino-European team, in the choreography of Sidi Larbi Cherkaoui with monks from the Shaolin temple (Shàolín Sì 少林寺). We used the anthroposemiotic theory (Jacques Fontanille and Nicolas Couégnas, 2018) and hybrid methods of investigation relating to the Observation-Analysis of movement (OAM by Nicole Harbonnier, 2014), the semiotics of martiality (Mahamadou Lamine Ouédraogo, 2018), cultural sciences (Joseph Melançon, 2002) and Soft Power (Joseph Nye, 1990). The two analysis grids that we have built according to the different theoretical and methodological contributions, have enabled us to bring to light the structure of a canonical narrative and the means of staging Shaolin (Shàolín 少林) martial arts, aesthetic uses, performance policies and, ultimately, the functions of Chinese Soft Cultural Power (CSCP) as manifested in the three shows in the corpus. The cultural codes of China and the West are therefore found in intercultural dialogism, either in the very structure of performances or in the uses made of them. This dialogical function of Shaolin Kung Fu (Shàolín gōngfu 少林功夫) in the performing arts has been shown to be at several levels of performance reading and analysis. Among other things, we have established that the Chinese soft cultural power participates in a strategy of enhancing traditional Chinese culture through the representation of the values of advanced socialist culture, through the culture of harmony, through the "Chinese dream", by the "Beijing consensus" and, finally, by socialism with Chinese characteristics. China not only values the traditional tools of Shaolin (Shàolín 少林) culture, it also promotes cultural innovations through international cooperation, especially with Europe. The show Sutra of the corpus proves this. Shaolin (Shàolín 少林) cultural codes are modified, restructured, shattered in an explosion (Juri Lotman) of novelty and openness to the Other. This dialogical awareness of ipseity and otherness in a transgenic cultural product demonstrates a common openness to the Other and a constructive collaboration in an egalitarian exchange. The prestige value put in place in Chinese cultural products accounts for phenomena linked to the continuation of tradition or to the discontinuity of the explosion of a novelty. Our gaze as spectator and analyst has allowed us to grasp the extent of the phenomenon of Chinese soft cultural power in an official political discourse emanating from the president Xi, Jinping or from Chinese cultural policy implemented under Xi, as Chinese Culture Going Global, aiming to fill the deficit of Chinese soft power. Those discourses advocate socialist culture with Chinese characteristics both inside the Chinese semiosphere and outside the country on the international stage, thus affirming its desire to assert its status as a superpower. The Belt and Road Initiative and associated projects contribute to national affirmation and the propaganda discourse hidden in the structure and uses of various Chinese cultural products or in co-productions with artisans from the West.

"The image is the symbolic representation of the alive". It is about a notion difficult to qualify legally given that the law in particular in France does not dedicate in a textual way the freedom of the image which it is advisable to connect at the same time with the free artistic creation, with the freedom of information, with the freedom of communication which the term is not defined by the law or more widely in the freedom of expression guaranteed by the D.D.H.C of 1789 in the article 11 but also in European law (article 10 of the C.E.D.H). The image as the paper is a real way of expression and communication which most of the media use through what today what it is advisable to call "century of the image ".The construction of a legal status of the image passes by the intervention of the judges. It takes place at the European level (C.E.D.H, C.J.U.E) but also in French internal law with, for example, the consecration of the law for the image that, competitor, of a law for the information limiting this one. The image thus has more and more need for law, while the latter seems to abandon her or to ignore it. It is due to the fact that she is partially established on the imagination thus on the irrational, while the law claims to be a rigorous and objective discipline. Nevertheless, the image is a great communications tool which always fascinated the Man, which always tries to control the images, to censor them even to use them for purposes of propaganda, as political tool but also as economic tool. Indeed, the political power was in control for a long time images as gives evidence of the practice of the administrative censorship of movies in France, for example, or of the State monopoly about the public broadcasting. The papers were protected thanks to the important law of 1881 on the press. The judges played a crucial role in the emancipation of the image its emancipation and to promote its free circulation in the "public place" while protecting the individuals of the drift that these can entrained if they are not suitably regulated. Besides, the succession of the new information technologies mainly the Internet, contributed to release the image of the constraints bound to supports favoring its traffic: the appearance of the digital technology favored its fragmentation and thus its democratization in a pluralistic prospect. The image is from now on within the reach of all, it is popularized and circulates regardless of borders, what raises marginally a problem of harmonization of the law and the jurisprudences. A regulation seems however necessary since we pass gradually of the logic of the image and power (control) in the logic of the image and knowledge (democracy). The object is rationalize while the idea is popularized. The thesis suggests raising a typology of the existing images in the democratic public place, in the alder of the various approached disputes, while looking for on the way, the solutions which are reasonably possible, to favor this process of democratization of the knowledge by the image (right collective in the image), even if it means joining, to do it, within the framework of a new disciplinary field which we suggest calling the " right of the environment multi - communicationnel ". These proposals were formulated at the end by the work. ; " L'image est la représentation symbolique du vivant ». L'image comme l'écrit est un véritable moyen d'expression et de communication dont la plupart des médias se servent aujourd'hui à travers ce qu'il convient d'appeler le « siècle de l'image ». La construction d'un statut juridique de l'image passe par l'intervention des juges. Cela a lieu au niveau européen (C.E.D.H, C.J.U.E) mais aussi en droit interne français avec, par exemple, la consécration du droit à l'image confronté au droit à l'information limitant celui-ci. L'image a donc de plus en plus besoin de droit, alors que ce dernier semble la délaisser ou l'ignorer. Cela tient au fait qu'elle est fondée en partie sur l'imaginaire donc sur l'irrationnel, alors que le droit prétend être une discipline rigoureuse et objective. Pourtant, l'image est un formidable outil de communication qui a toujours fasciné l'Homme et de tout temps ce dernier a cherché à contrôler les images, à les censurer voire à les utiliser à des fins de propagande, comme outil politique mais aussi comme outil économique. En effet, le pouvoir politique a longtemps eu le contrôle des images comme en atteste la pratique de la censure administrative des films en France ou le monopole de l'Etat sur l'audiovisuel public. Les écrits ont été mieux protégés grâce à l'importante loi de 1881 sur la presse. Les juges ont joué un rôle crucial dans l'émancipation de l'image et pour promouvoir sa libre circulation dans l' « espace public » tout en protégeant les individus des dérives que celles-ci peuvent entrainer si elles ne sont pas convenablement régulées. Par ailleurs, l'avènement des nouvelles technologies de l'information principalement l'Internet, a contribué à libérer l'image des contraintes liées aux supports permettant sa circulation : l'apparition du numérique a favorisé sa fragmentation et donc sa démocratisation dans une perspective pluraliste. L'image est désormais à la portée de tous, elle est vulgarisée et circule sans considération de frontières, ce qui soulève à la marge un problème d'harmonisation du droit et des jurisprudences. Une régulation apparait cependant nécessaire dès lors que nous passons progressivement de la logique de l'image-pouvoir (contrôle) à la logique de l'image-savoir (démocratie). L'objet est rationnalisé alors que l'idée est vulgarisée. La thèse se propose de dresser une typologie des images existantes dans l'espace public démocratique, à l'aune des différents contentieux abordés, tout en recherchant chemin faisant, les solutions qui sont raisonnablement envisageables, en vue de favoriser ce processus de démocratisation du savoir par l'image (droit aux images), quitte à s'inscrire, pour ce faire, dans le cadre d'un champ disciplinaire nouveau que nous proposons d'appeler le « droit de l'environnement multi-communicationnel ». Ces propositions ont été formulées à la fin de l'ouvrage.

The first chapter summarises and anticipates most of the research topics. Paragraphs 1 and 2 show the surprise and perplexity of some pre-eminent liberal-democratic intellectuals facing Berlusconi's victory in 1994, which, along with the transformation of the electoral law in the previous years, mark out the passage to the "second republic" according to the current opinion. My research suggests that 1994 instead marked the return to an anti-political culture which was repressed for a long time and Berlusconi was able to interpret and represent, both in his television channels and in the direct political propaganda. I believe that the defeat of the referendum in 1995 for the repeal of television duopoly and the limitation of advertising (§.3) are, on the other hand, a much clearer clue of his hegemony as public figure and "commanager" ("communication manager" – P. Musso), but traditional politicians are highly responsible for the origin of the duopoly and his achievement of "neotelevision" (Casetti-Odin) hegemony (§.4). In §.5, 6 and 8, I expound the two keys to understand the history of "neotelevision" (Casetti-Odin) which will guide my research especially in chapters 5, 6 and 7: the "Meyrowitz effect" and the "Chomsky effect" (quotation marks are necessary because I do not expect them to be theories which can be formalised and universalised, but they can only be clues for the organization and interpretation of historical data). The first theory suggests the possibility that "neotelevision" in Italy caused the progressive loss of aura, prestige and authority of parents, politicians and adults in general. Meyrowitz theory, inspired by Goffman's dramaturgical sociology, aimed to explain the rise of protest movements in America with the widespread of television sets among American families (almost half of them had a television set in 1954). Nevertheless "paleotelevision" in Italy cannot significantly explain these same movements: it was less widespread, it had a smaller amount of hours of transmission, it had only one channel at first, then two…; in addition to this many other stimuli (starting from the "contagion" of the movement from abroad) appeared at that time. On the contrary "neotelevision" was a sudden change which concerned all the variables (hours of transmission, channels, etc…), therefore a further loss of adults' prestige could be expected from it, but in a form different from protest. The "Chomsky effect" can integrate the "Meyrowitz effect". According to Chomsky, media that lives off advertisement have to "produce" (I would say: attract, select, shape) the public, which then they will have to "sell to advertisers". Program schedules of "neotelevision" will be, therefore, at complete disposal of the advertisers' demands. It is certainly not a new idea, nor an idea had only by Chomsky, who uses it in an apodictic way against media mainstream: among others Antonio Pilati shares this idea, but with an apologetic intent (cf. §.8). Of course this "effect" is even less scientifically definable, because the educational process itself requires a long period of time, it is the result of too many crossed factors and its consequences are considered to be hardly predictable, or even unpredictable. Nevertheless, from those years, Italians' attitude towards advertising and brands has gone through changes so drastic (as evidenced by Eurisko researches) that we cannot avoid relating them to the contemporary development of "neotelevision". Moreover advertising targeting children and youngsters aims to make them consumers that are independent from their parents and to some extent it reinforces the "Meyrovitz effect". Both the "effects" aim to develop television as independent educational curriculum. ; Le premier chapitre résume et anticipe une grande partie des thèmes de la recherche. Le §.1 et le 2 montrent la surprise et l'égarement de certains autorisés intellectuels libéraux démocratiques face à la victoire de Berlusconi en 1994, qui, avec les transformations de la loi électorale en 1993, marquerait, selon l'opinion courante, le passage à la « deuxième République ». Ma recherche suggère plutôt que 1994 a été le retour à une culture antipolitique longtemps refoulée, que Berlusconi a bien su interpréter et représenter, tant dans ses télévisions que dans sa propagande politique directe. En revanche à mon avis c'est la défaite des référendums de 1995 pour l'abrogation du duopole télévisuel et pour la limitation de la publicité (§.3) qui montre des indices bien plus forts de son hégémonie en tant que personnage public et « commanager » (« communication manager » - P. Musso), mais les politiciens traditionnels ont de graves responsabilités en ce qui concerne les origines du duopole et le développement de son hégémonie télévisuelle (§.4). Dans le §.5,6 et 8 j'expose les deux clefs d'interprétation de l'histoire de la néo-télévision qui guideront ma recherche surtout dans les ch. 5, 6 et 7 : l' « effet Meyrowitz » et l' « l'effet Chomsky » (les guillemets sont nécessaires car je ne prétends pas qu'il s'agisse de théories pouvant être universalisées et formalisées, mais seulement de critères pour l'organisation et l'interprétation des données historiques). La première suggère la possibilité que la néo-télévision en Italie ait stimulé la perte progressive de l'aura, du prestige et de l'autorité des parents, des politiciens et en général des adultes. La théorie de Meyrowitz, inspirée à la sociologie dramaturgique de Goffman, visait à expliquer l'époque des mouvements de la contestation en Amérique par le biais de la diffusion de la télévision parmi les familles américaines (50% environ d'entre elles avaient un poste en 1954). Mais le recours à la paléotélévision ne peut pas donner de contributions importantes à la compréhension de ces mêmes mouvements en Italie : elle y était moins répandue, avait beaucoup moins d'heures d'émission, avait une seule chaîne au début et au maximum deux, etc ; et de toute façon beaucoup d'autres stimulations (la contagion étrangère, p.ex) se sont manifestées. La néotélévision en revanche a constitué un changement rapide qui a concerné tous les aspects (heures d'émission, nombre de chaînes,etc), donc ont peut s'attendre à une ultérieure perte de prestige des adultes, mais dans une forme différente par rapport à la contestation. L' « effet Chomsky » peut intégrer l' « effet Meyrowitz ». Selon Chomsky, les médias qui vivent de publicité doivent « produire » (je dirais : attirer, sélectionner, former) leur public, qu'ils devront « vendre aux annonceurs ». Les grilles de la néo-télévision seront donc au service des exigences des ces derniers. Il ne s'agit certes pas d'une idée nouvelle, ni d'une idée de Chomsky seulement, qui l'emploie de façon apodictique dans sa polémique contre les media mainstream : elle est partagée entre autres par A. Pilati avec une intention décidemment apologétique (cf. §.8). Naturellement cet « effet » est encore moins déterminable de manière scientifique, car la formation concerne notamment en tant que telle la longue période, est le résultat de trop de facteurs croisés et ses conséquences sont difficilement prévisibles, sinon carrément imprévisibles. Néanmoins les attitudes des italiens envers la publicité et les marques ont changé depuis de façon si radicale (cf sondages Eurisko) que l'on ne peut que les mettre en relation avec le développement contemporain de la néotélévision. En outre la publicité adressée aux enfants vise à en faire des consommateurs autonomes par rapport à leurs parents.

We focus here on one year: 1936. François Colbert recognizes four models of State (State in the sense of nation). The models concern the cultural politics of each type of State. One State model is the Sponsor State. The typical example is England. But in 36, this Sponsor State was not very active yet. The BBC just decided not to promote any continental modernism, and particularly not the Germanic one. Edward Clarck, who was a Schönberg's pupil, left then the Corporation. Finally, we couldn't find any remarkable work composed in England (or in Canada, another sponsor State), during 36. But it is true that Elgar just died two years before and Britten would start to compose only one year after.France would present another model. It might be an Architect State, notably from 36 on, because of the new social government, le Front Populaire of Leon Blum. In june, it generated the first "congés payés", the first payed holidays: two weeks of vacation given to the workers. A song of 36 (Quand on se promène au bord de l'eau performed by Jean Gabin) speaks about this new society of hobbies, now possible for every worker.Christopher L. Moore underlines the cultural interventionism of this French Architect State, a research of a real « modernisme populaire ». The result has not passed clearly the exam of posterity. There is, for example, the Suite provençale by Darius Milhaud. This Mediterranean work perhaps resounds with the idea of holiday, so with the new "congés payés". That occupies the popular aspect. For the modernist one: it is polytonal.But another Mediterranean music, recorded in august 36, is far more famous in France today, perhaps more than any orchestral work of 36, even Litanies à la Vierge noire by Poulenc or Poèmes pour mi by the young Messiaen. This Marinella, song by Tino Rossi, doesn't work for a "modernisme populaire", but for an industrial aesthetics, that of the recording company. Adorno's great fear about cultural industry is already pertinent in this time. Because Marinella has become the "music of the front populaire", according to Yves Borowice, and perhaps the most famous French musical work of 36, still now.Another model is the Aesthetical State, that of the totalitarian regimes. The dictators personally rule many affairs, including aesthetical ones. Stalin wrote a musical critic of Chostakovitch in January (36). According to Laurent Feneyrou, the Wagnerian Gesamtkunstwerk was the model of the Nazi State. And Hitler began with studying painting. Goebbels wrote a novel, during his youth, in which he pretended : "politics is the plastic art of the State". One could have imagined that the works, written in these regimes and approved by these regimes, now would have been totally forgotten by history.This doesn't seem to be the case of Karl Orff's Carmina burana. At this time, the political pressure on musicians is strong in Germany, between the nazi critics represented by Gerigk, the cultural politics of Rosenberg (for the party) and Goebbels for the ministry of propaganda. In this impossible context, Albrecht Riethmüller wonders "how composition was actually possible in the Reich in 36". A little cantata by Georg Blumensaat seemed possible, also an Anthem by Werner Egk, written for the Olympic games in Berlin this year, and The Carmina burana by Carl Orff, because "Car Orff and Egk were both disposed to fully negociate their aesthetics with the nazi State", according to Eva Hanau. Carmina Burana was first rejected by Gerigk but rehabilitated by Rosenberg in 40. Rosenberg heard in it "the clear, burning and disciplined music that is demanded by its time"Another composer, the same year, but somewhere else, in another dictatorship, another aesthetical state, chose to return in his country after a long exile 18 years. He composed the ballet Romeo and Juliet, in 36, for his new totalitarian government. Was it Opportunism? Or a paradoxal and late sovietic conviction ? One could think that Prokofiev was victim of a Stockholm syndrome, Stalin (and his new hardened regime of 36, where death penalty was then possible for children) becoming a kind of hostage taker, finally "cherished" by Prokofiev. For Deborah Rifkin, the composer wanted a new simplicity for a long time, already present in Lieutenant Kijé (1933) or the Second violin concerto (1935). But Romeo and Juliet goes far more than on a new "simple" way. It is a machine built for Stalin and Prokofiev together. The brass in the low register, familiar to Prokofiev already, but here with the simple arpeggios of the strings, become, in a way, the march of the Red Army. Neoclassicism, is the fastest parts, is put to its climax of seducing energy. And the work is not only martial and neoclassic. For the first time at this level, a work by Prokofiev contains neo-romantic textures. It is because of this love story by excellence: Romeo and Juliet. But it is also because Staline was fond of Tchaïkovski.At the opposite side appears the Facilitator State. The State, in this case, is almost inexistent. But the pressure (perhaps the violence), is also strong in this case : the composer knows he's totally alone. The "public law" becomes his. That gave this work for example, also in 36: Adagio for strings by Samuel Barber. In a way, Barber had to become his own cultural industry, his own pressure. The State "came", but after, electing the work for the national funerals, that of Roosevelt in 1945 and Kennedy in 1963. But the cultural industry was not so far from this aesthetics, and the proof is that industry ravished the work, took it, particularly during the Reagan decade, the postmodernist one. This "saddest music ever written" (according to Thomas Larson) was "customised" in many American films like Elephant man by David Lynch, Platoon by Oliver Stone, Lorenzo's oil by George Miller, also in TV serials (Seinfeld or The Simpsons), or in recent popular music (Puff Daddy, William Orbit, DJ Tiësto). Like in Carmina burana, the notes are often conjunct, the ambitus is narrow. It is a music also technically under pressure. Diether de la Motte was wondering about Carmina burana : Darf Musik 1936 so einfach sein? » : « Can Music in 36 be so simple ? » For Diether de la Motte, it is a real aesthetical provocation. In Orff's case also, the bound with cultural industry will be natural: the work will be used in the film Excalibur by John Boorman. It will strongly serve its ambiguous aesthesis of violence, of Barbarian fascination, perhaps building a neo-Nazi aesthetics in a way, which seems to show that a problematic aesthetics would be deeply related to the work from the beginning, not only historically but viscerally.Cultural industry and totalitarian regimes finally show a common position of pressuring music. And they finally had a relative success in this exercise, at least in 1936. Another example would be this other work by Prokofiev, also composed for Stalin in 1936, in the joy of the return home. Let's consider here a modified version of the work (Peter and the wolf): captured by cultural industry, to show, once again, the paradoxal bound, finally the common authority, (the common politics), between Staline and Walt Disney pictures.The final question is: Who has written musical history ? Seeing the particular year of 1936, we build a parataxis which emphasizes that the winners may have been more Industry and dictatorships than European democratic states and their modernist views. The posterity would not be moral, in this way. Amaury du Closel has already shown that the Nazi had decided for us what we had to listen and specially not to listen: not to listen the Entachtete Musiken which are still not really rehabilitated today, Schreker the first.Or the paratax shows a critic of historicism. It may show that we shoudn't trust in posterity, that posterity is not working.Let's consider a last example, also composed in 36. It is one of the most famous works, nowadays, of the modernist tradition, so of the real Hegelian "historicist history". The Work is posterity like it is attempted. Every reader here, then, will choose if this work, Music for strings, drum instruments and celesta, by Bartók, is more the centre, the reason, the justification of 1936 than the others we mentioned before and then, what is real history in general.

Minority and community are concepts that have dominated the analysis of Christians in the Arab world, leading to a perception of Middle-Eastern societies as confessional or sectarian mosaics. This paradigm posits that religious and political identities and dynamics are closely intertwined in countries where the dominant culture is Islam, and that religious and ethnic groups live side by side, maintaining limited interactions while their immutable identities offer a strong potential for conflict. This work questions the paradigm of the mosaic by focusing on identity formation and interaction across religious boundaries over a period that extends from the later decades of Ottoman rule in Transjordan (1870) to present Jordan (1997). It asks whether confessionnal identities are by nature conflictual and if the 'minority' concept is the only relevant one to evaluate the degree of social, political and economic participation of non-Moslems in countries where Islam is the dominant culture. The approach is inductive and historical but mobilises concepts from the disciplines of social and political anthropology and political sociology. The dissertation comprises of 10 chapters set chronologically and covering the period 1870 to 1997. Taking a historical approach, it focuses on the modalities of exchanges, transactions, cooperation and communication (looking at kinship, mariage patterns, the role of women, economic cooperation, and various aspects of local and national politics) between Christians and Moslems and between several Christian denominations in Jordan (Orthodox and Roman Catholic, or Latin, in particular), more particularly in the town of Madaba however set within a broader national and international context. These broader contexts (that encompass the politics of states and of transnational Church actors over time) allow to bridge between the local and other levels to document how institutions regulate identity formation and cross-communal interactions. Over a century, Madaba provides the background, widely open to the rest of the country and the world, of a social, religious and political history of Arab Christian families. The work combines historical and anthropological approches and sources (in particular so far unexploited parish and Vatican archives, together with other archival sources). It questions the nature and the maintenance of the social and political link between Christians and Moslems in Madaba and in Jordan, and the changes that have affected identity boundaries between groups: both as Christians and Moslems, but equally as members of different Christian denominations, particularly in the context of missionary activities. The thesis defended here is that it is time to 'break the mosaic' so as to cast light from the inside on the societies and polities within which Christians in the Arab world are inserted. The title of the dissertation refers both to this paradigm and to the Byzantine mosaics that have made Madaba famous as an archaeological site. In place of the static image of the mosaic, the dissertation offers successive episodes of a moving picture where political powers, Churches (missionary or not), those local families that transfer their assets to Amman, the Jordanian capital, and the national arena, negotiate the organisation of local social interactions. One important contribution of the dissertation is to document how the tribe, over more than a century, remains a central social form to express identities, regulate economic and political interactions, and manage conflict both between Christians and between Christians and Moslems. Communal identities, however central they have become since the inception of the modern state, do not appear to threaten the cohesion of the society and the polity, either at the local or national levels. The maintenance of tribal identities is dealt with throughout the dissertation as a dynamic process in which both successive states, regimes, social actors at the national and local levels play a part, in particular in the historical context of the arrival of the Palestinians in Jordan and in the town of Madaba. At another level, the dissertation deals extensively with the institutional relations between the Greek Orthodox and the Roman Catholic Churches and the Jordanian state, bringing a new insight into a previously under-studied domain. Finally, this work offers an argument about the relationships between state and society in contemporary Jordan by interrogating the changing nature of the social pact between the Hashemite regime and local constituencies, more specifically with non-Moslems but also with Transjordanians as opposed to Palestinians. This work is therefore not a mere monograph about Christians in the town of Madaba: looking at a 'marginal' and local phenomenon, it enlightens broader social, political and historical dynamics. ; En partant d'un phénomène observé 'à la marge' afin de mieux illustrer ce qui se passe au centre, ce travail aborde des questions fondamentales pour la compréhension des sociétés du Moyen-Orient en déconstruisant notamment la catégorie de 'minorité', en s'interrogeant sur la nature du lien social entre chrétiens et musulmans dans l'agglomération de Madaba et au-delà dans la Jordanie contemporaine et en analysant la construction des identités collectives sur plus d'un siècle (1870-1997). Sont proposés d'autres paradigmes que ceux des traditions orientaliste et développementaliste pour l'analyse des minorités en pays musulmans. Ces traditions postulent la primauté du facteur religieux dans la formation et l'expression des identités sociales et envisagent les sociétés arabes comme des 'mosaïques' formées de groupes ethnoconfessionnels homogènes, relativement hermétiques les uns aux autres et inscrits dans une hiérarchie de statuts. On s'est plutôt inspiré ici de l'approche sur les frontières et les interactions entre groupes ethniques proposée par F. Barth en lui adjoignant une certaine profondeur historique et en intégrant une analyse des rapports entre le pouvoir politique et les groupes sociaux. Il s'agit de poser les affiliation religieuses et confessionnelles comme des constructions sociales et historiques dont on peut étudier le développement, les méandres et les interactions avec d'autres types d'affiliation. S'inspirant de tous les travaux récents portant sur la construction des identités collectives, qu'il s'agisse de nations ou d'ethnies, l'approche choisie défend une conception plurielle et mouvante des identités décrites en termes de processus dynamiques et interactionnels en s'interrogeant sur les temporalités et les facteurs de continuité/changement et en montrant des continuité beaucoup plus longues que celles qui posent la période coloniale comme période charnière de fixation des identités collectives. En plus d'une méthodologie d'observation anthropologique du terrain et des acteurs, quatre types principaux de sources ont été exploités : la littérature des voyageurs occidentaux, les archives paroissiales et missionnaires (en particulier celles de la Propaganda Fide à Rome), les témoignages oraux, la littérature d'histoire locale produite à Madaba. On a adopté un plan chronologique découpé en trois périodes principales. A l'intérieur de chaque partie, l'analyse thématique a été privilégiée en suivant, dans l'agglomération de Madaba depuis sa fondation en 1880, les alliances matrimoniales, politiques et économiques entre chrétiens et musulmans et entre groupes de différents rites chrétiens (essentiellement orthodoxes et latins) afin de déterminer où passent les frontières de l'identité et comment elles changent. Une variété d'acteurs institutionnels et individuels, dont certains apparaissent à un moment historique donné, influent sur la forme de ces frontières : les administrations des États qui se succèdent et leur personnel, les hiérarchies ecclésiastiques, les prêtres, les Grandes Puissances occidentales et leurs représentants locaux, les intellectuels de formation moderne, les partis politiques, les notables traditionnels et modernes, les organisations de la société civile, les émigrés et les immigrés, les tribus et leurs membres. Centré sur l'agglomération de Kérak, dont sont issus les chrétiens qui fondent Madaba en 1880, le prologue fait apparaître que, dans la Syrie du Sud (Transjordanie) du milieu du XIXe siècle, les institutions ecclésiastiques (grecques orthodoxes) et impériales (ottomanes) n'ont que très peu d'influence sur ce territoire situé à l'extrême périphérie de l'empire. Minoritaires sur le plan démographique et dispersés sur le territoire, les chrétiens ne sont pas marginalisés du fait de leur appartenance religieuse car l'ordre tribal des relations sociales assure différents niveaux d'intégration sociale et de coopération politique et économique entre lignages chrétiens et musulmans en fonction d'autres critères que ceux de l'appartenance religieuse. Les chrétiens sont fragmentés en plusieurs clans et tribus sans que l'on puisse repérer de cohésion confessionnelle. Sur le plan de la pratique religieuse, c'est une forme de syncrétisme qui prévaut. L'impossibilité des échanges matrimoniaux entre chrétiens et musulmans n'est pas nécessairement perçue comme témoignant d'un frontière religieuse infranchissable mais s'inscrit dans le contexte plus vaste des règles qui régissent les alliances matrimoniales entre tribus. L'appartenance religieuse est avant tout un marqueur d'identité tribale. La première partie analyse comment l'ordre communautaire religieux apparaît dans les dernières décennies du XIXe siècle, sous l'action conjuguée des organisations missionnaires (protestantes et catholiques) et de l'administration alors que les Ottomans entreprennent de rétablir leur autorité sur la Syrie du Sud. Autour de la fondation du village de Madaba par des lignages chrétiens immigrés de Kérak sous l'impulsion des missionnaires latins, on montre comment de nouveaux acteurs religieux et civils entreprennent d'imposer un ordre communautaire des relations sociales à travers l'éducation missionnaire, le marquage d'espaces chrétiens, le contrôle des alliances matrimoniales, de nouvelles pratiques cultuelles, l'accès aux instances de représentation administratives et juridiques ottomanes. Les modalités d'insertion des tribus chrétiennes qui fondent Madaba dans leur environnement permettent de mettre en lumière les résistances à l'ordre communautaire par l'établissement de partenariats économiques et d'alliances politiques avec les tribus musulmanes du lieu selon des logiques lignagères persistantes où les acteurs instrumentalisent à leur profit les nouvelles ressources communautaires fournies par les Églises ou les consulats européens. Au cours du XXe siècle, la Transjordanie, d'abord sous mandat britannique, accède à l'indépendance. Malgré ce changement politique, le régime monarchique se perpétue sans que les modalités d'insertion sociale des chrétiens ne soient bouleversées au niveau du pays dans son ensemble ou au sein de l'agglomération de Madaba. La deuxième partie se penche alors sur la manière dont l'État hachémite et les Églises majoritaires (grecque orthodoxe et romaine catholique) négocient les frontières des espaces communautaires à travers la législation sur les communautés confessionnelles et leurs prérogatives religieuses, éducatives et caritatives. Le traitement différencié accordé par l'État aux différentes Église en présence ainsi que des relations diverses entre les hiérarchies ecclésiastiques et les laïcs des communautés sont deux dimensions qui contribuent à empêcher la cohésion des chrétiens pris comme un ensemble. Le statut politique des chrétiens est ensuite étudié non en isolation mais en parallèle avec celui d'autres groupes sociaux, Circassiens, bédouins, réfugiés palestiniens, familles musulmanes transjordaniennes du nord et du sud, etc. afin de poser question quant à la réalité d'un statut minoritaire et à l'existence d'une majorité politique dans le royaume hachémite. Il ressort que le régime octroie aux communautés chrétiennes et aux familles chrétiennes de notables (anciens ou modernes) un espace privilégié d'expression et de représentation qui leur permet d'occuper une place centrale, et non marginale, dans la société. Dans le même temps, il est difficile d'identifier une norme identitaire autre qu'hachémite et il apparaît qu'une des modalités d'exercice du pouvoir monarchique repose sur la cooptation d'individus et de familles appartenant à tous les groupes de la société. Dans un second temps, recentrer l'analyse sur l'agglomération de Madaba permet d'observer comment les acteurs locaux relaient les efforts de l'État qui visent à maintenir une fragmentation sociale selon des clivages communautaires et lignagers afin de résister à la formation d'identités politiques transversales qui mettraient en danger sa stabilité. La modernité politique et économique n'en engendre pas moins un système de relations multiples entre chrétiens et musulmans que l'on peut repérer à travers les alliances politiques lors d'épisodes électoraux, dans les mouvements associatifs, dans les partenariats économiques, dans les partis politiques ou lors d'épisodes de conflit aigus tels celui de Septembre noir. En parallèle, les logiques tribales continuent à ordonner conflit et coopération entre groupes de religions différentes qui se définissent d'abord selon leur affiliation lignagère. C'est le cas, en particulier, dans les domaines de l'économie agricole et pastorale traditionnelle, dans les épisodes de règlement de conflits de sang ou d'honneur où prévaut encore le droit coutumier, parfois à l'encontre des prescription du droit musulman. La fragmentation des chrétiens en groupes lignagers est ainsi préservée sans que ne s'effectue une communautarisation incluant une dimension politique. De même, les valeurs qui permettent aux chrétiens de participer pleinement à l'échange social, telles l'honneur individuel ou collectif, le prestige familial, la limitation de l'autonomie des femmes, ne sont pas menacées par l'imposition de normes islamiques. A partir des années 1970, la polarisation de la population du royaume hachémite entre Jordaniens 'de souche' et Jordaniens 'd'origine palestinienne' amène un processus de différenciation identitaire dans lequel l'organisation tribale en vient à symboliser l'identité jordanienne. Dans le même temps, les islamistes deviennent la principale force d'opposition que le régime tente d'endiguer en réaffirmant son propre caractère musulman et en islamisant de nouveaux espaces de la vie publique. Ces changements de paradigmes de la société politique jordanienne touchent Madaba, ville mixte où cohabitent Jordaniens des tribus et Palestiniens réfugiés, chrétiens et musulmans. De plus, les équilibres démographiques et politiques de la ville penchent de plus en plus en faveur des musulmans. Les chrétiens, autrefois majoritaires, entreprennent alors de défendre leur position de prééminence dans la ville. Les stratégies qu'ils mettent en place pour combattre une double logique de minorisation (en tant que chrétiens et Jordaniens 'de souche') font l'objet de la dernière partie de ce travail. On montre tout d'abord comment les chrétiens résistent sur le terrain à un recul de la neutralité religieuse de l'espace public et à leur mise en minorité démographique et politique (conseil municipal) dans l'agglomération et comment ils se redéploient dans l'espace urbain, créent des réseaux de soutien financier avec les immigrés, amorcent un rapprochement entre Églises, compensent dans le champ politique national la perte de leur hégémonie locale. Dans un second temps, on se penche sur la littérature d'histoire locale que produisent les chrétiens de Madaba afin d'analyser comment ces derniers, en reformulant leur histoire ancienne et récente, se construisent à la fois des identités confessionnelles, ethniques et lignagères et comment elles sont rendues compatibles afin de lutter contre une marginalisation symbolique. Le dernier chapitre se penche sur les élections législatives de 1997 afin d'illustrer la manière dont les chrétiens utilisent leurs imaginaires identitaires comme vecteurs de mobilisation politique à l'occasion des élections législatives, nouvelle arène de compétition depuis la libéralisation de la vie politique intervenue en 1989. Malgré l'existence d'un siège chrétien réservé pour la circonscription de Madaba, ce n'est pas la mobilisation communautaire qui apparaît comme efficace mais bien plutôt le discours des solidarités tribales, éventuellement (mais non nécessairement) en conjonction avec l'appartenance partisane ou confessionnelle. On peut alors avancer que les chrétiens participent pleinement aux dynamiques de la société dans son ensemble. Tout au long de la période étudiée, la parenté joue un rôle central comme vecteur essentiel de l'identification des groupes, que ceux ci soient dans un espace rural ou urbain. Les chrétiens de Madaba mobilisent les mêmes ressources symboliques que les autres groupes avec lesquels ils sont en contact. Comme l'ensemble de la société, les chrétiens participent à une multitude d'échanges et d'interactions et se positionnent en fonction de ces interactions. Au-delà de l'étude de cas qui s'ancre dans une ville moyenne de la Jordanie centrale, ce travail s'interroge en conclusion sur le système politique jordanien et sur les modes de légitimation de sa monarchie. Les analyses en termes de construction nationale sont critiquées, le terme de 'minorité' est mis en question tout comme le présupposé classique d'une imbrication nécessairement étroite du religieux et du politique dans les pays dits, ou qui se disent, musulmans.
