학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 지리학과, 2020. 8. 신혜란. ; 본 연구는 정책이동(policy mobility)의 관점에서 서울로 7017의 조성 과정을 분석하였다. 특히 본 연구는 정책이 이동하는 과정에 있어서 도시 정치가 어떠한 방식으로 개입하게 되는지를 집중적으로 살펴보았다. 정책이동은 도시 연구 분야에서 주요 연구 주제로 떠오르고 있다. 전 세계 도시 간 협력과 교류가 활발해짐에 따라 정책의 이동 - 선진 정책의 벤치마킹 및 수입과 모방, 정책 관련 국제 컨퍼런스 발표 및 수상 등 - 은 활발하게 진행되고 있고, 이러한 현상은 도시정책의 추진 및 의사결정에 있어서도 직접적인 영향을 미치고 있다. 한편 기존 정책이동 관련 연구들은 정책이 이동되는 과정자체에 초점을 맞추어 도시들 간의 지역적 맥락이나 정치구조의 차이가 정책의 적용과 변용 등에 어떠한 영향을 미치는지를 주로 살펴보았다. 이에 반해 정책 이동 현상이 넓은 범위의 도시정치와 거버넌스에 어떠한 영향을 미치는지를 활발하게 연구되지는 못하였다. 본 연구는 이러한 부분에 있어서 기여하고자 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹이나 정책 홍보 등의 정책이동 과정이 서울시 도시정책에 어떠한 영향을 미쳤는지를 분석하였다.연구의 결과는 다음과 같다. 첫째, 서울로 7017 조성과정에서 나타난 정책의 이동 – 뉴욕 하이라인의 벤치마킹 또한 서울로 7017 정책의 홍보와 선전 - 은 서울시가 도시정책을 정당화하는 주요한 방법으로서 활용되었다. 서울로 7017은 별다른 공론화 과정 없이 박원순 시장의 정치적 추진력을 통해 급하게 추진되었기 때문에 서울시는 사업에 대한 정당성을 보여주는 것이 필요했다. 이에 서울시는 이미 진행되었던 뉴욕 하이라인의 성공을 통해서 사업의 필요성과 당위성을 보여주었다. 또한 서울시는 사업의 가치와 성공을 국내와 해외로 홍보하는 과정을 통해서, 서울로 7017 대한 성공적인 이미지를 스스로 다듬어갔다. 이처럼 서울로 7017이 조성되는 과정에서 나타났던 벤치마킹과 정책 홍보는 서울시가 도시 정책을 정당화하기 위한 목적에서 진행되었다. 둘째, 서울로 7017의 조성에 있어서 서울시는 하이라인을 벤치마킹 하였지만, 이는 서울시의 정책적 목표와 필요에 따라 선별적으로 이루어졌다. 또한 이처럼 정책적 필요에 맞추어 벤치마킹과 모방이 진행되는 과정에서, 처음 모방하고자 하였던 하이라인의 운영방식과 내용은 큰 폭으로 변용되었다. 일례로 하이라인의 디자인은 유사한 형태로 모방되었지만, 시민참여를 대표하였던 하이라인의 운영방식은 보수적인 서울시의 행정 구조에 맞추는 과정에서 큰 폭으로 변용되었다. 또한 이와 같은 모방과 변용의 과정에서 서울시의 정책, 행정구조, 공간은 빠르게 변화되었다. 본 연구는 전세계적으로 활발하게 진행되고 있는 정책이동 현상이 도시를 어떻게 변화시키고 있는지를 서울로 7017의 실증사레를 통해서 확인하였다. 한편 본 연구는 정책이동을 통해서 이루어지고 있는 다양한 변화들을, 다소 개괄적인 범위에서 살펴보았다는 점에서 한계를 갖기도 한다. 발전된 후속 연구를 통해서 정책이동이 도시의 변화에 갖는 의미를 더욱 면밀하게 검토하고 구체적인 정책적 시사점이 제시할 수 있기를 기대한다. ; This study analyzes the development process of Seoullo 7017 through the theoretical lens of policy mobility. In the past few decades, transfers, diffusion, and movement of urban policies across national borders have increased rapidly. Accordingly, researches on policy mobility have developed in the fields of geography and urban studies. These studies have critically investigated the processes of adaptation, assemblage, and mutation of a certain policy, but have little focused on how the ordinary urban policymaking and the urban area has changed in the process of policy movement. In this regard, this study explores how the mobilization of certain policy has changed and reconstructed the urban policy and planning system. Especially, this research has focused on the interaction of local decision-making and policy mutation processes. The results of the study are as follows. First, the mobilization of policy that appeared in Seoullo 7017 including benchmarking and policy promotion was strategically used by the Seoul city government. The main purpose of these mobilizations was to legitimize the city's urban policy. Seoullo 7017, which was a mayor's landmark project, has proceeded rapidly without the civic consensus process. In this regard, the New York High Line's success was used as a tool to represent the legitimacy of the Seoullo 7017 project. Also, the branding and promotion of Seoullo 7017, which received great attention from the city government, was used as a self-curation tool to make the success story of Seoul's urban policy. Second, the mobilization and adaptation of the High Line were proceeded selectively according to specific political goals of the Seoul city government. Seoullo 7017 benchmarked both the design and governance of the High Line. Lots of critics pointed out that the design should be differentiated, as the regional context of Seoul and New York was different, However, the design was similarly imitated into Seoullo 7017 because of the symbolic image of the High Line's design itself. Also, the management style which emphasized citizen participation and governance were also imitated, but it ends with instrumental form due to bureaucratic political structure. As such, adaptation, mobilization, and mutation has been carried out in accordance with the process of legitimizing local policy and political authority. The importance of this research is that it investigates the consequences and implications of mobile urban policies through an empirical case at various points. However, it also has its limitations as this study looks into various aspects of mobile policies on a superficial level. 학위논문(석사)--서울대학교 대학원 :법과대학 법학과,2019. 8. 이동진. ; Throughout all the world, insolvency, at its essence, is about the treatment and disposition of prepetition claims and postpetition claims. Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. 학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy. Background Low-quality services of emergency medical institutions, unclear function of institution classification, and overcrowding of emergency departments (ED) of regional emergency medical centers (regional centers) have been major problems in the Korean emergency medical services system (EMSS). In 2015, the Middle East Respiratory Syndrome (MERS) outbreak spread from patients waiting for hospitalization in the overcrowded ED. The MERS outbreak was an event that revealed the vulnerability of EMSS and opened the policy window to solve the problem of EMSS in Korea. Several policies for EMSS improvement were implemented after the 2015 MERS outbreak focusing the improvement of emergency medical services (EMS) delivery system and ED infection control. This study investigates the policy processes for improving emergency EMSS and infection control program after the MERS outbreak. The purpose of this study was to examine the policy processes regarding EMSS from the view of policy actors and draw lessons for improving the EMSS in Korea. 2. Methods A mixed method was utilized to identify and explain the complex subject of the policy processes of Korean EMSS during and after the MERS outbreak in 2015. As a quantitative study, changes in EMSS after MERS were investigated according to the WHO's model of a national health system infrastructure. Literature review and data analysis of Korean Health Insurance Service (NHIS) database were conducted. In Korea, the NHIS covers all citizens. A quantitative analysis was performed on 16,965,755 cases using ED during 2014-2016. In-depth interviews were conducted on 30 experts, who were involved in the emergency medical policy process, including clinicians, policy experts, and hospital management experts. The total interview time was 55 hours and 4 minutes. Changes in EMSS and the policy process after the MERS outbreak were evaluated from the view of policy actors. In this study, quantitative data was interpreted qualitatively, and independent qualitative evaluation was conducted, as well. Therefore, this research is a mixed-methods study focusing on qualitative research. SAS version 9.4 was used for the quantitative analysis and NVivo 12.0 was used for the qualitative analysis. 3. Results The quantitative analysis results showed that in the area of EMS delivery system, the human resource of ED and number of regional centers have been increased and facility, equipment, and manpower standards have been revised in order to expand emergency medical resources. As a result, the number of medical personnel and emergency intensive care units in regional centers increased and profitability of ED improved as well. The number of monthly ED visits temporarily decreased during the MERS outbreak but then recovered afterward. As ED overcrowding indicators were emphasized in the evaluation of EMS institutions, monthly mean ED length of stay of regional centers was decreased. However, despite the emphasis on providing critical care, transfer rate of severe emergency patients was not decreased. In the policy processes of EMS, experts evaluated that EMS delivery system was set up as a pseudo-agenda and exploration and comparison of policy alternatives were not sufficiently carried out. As a result, the physicians did not comply with the policy implementation and policy goals were not achieved. In the area of ED infection control program, the human resources for infection control and the number of isolation unit of ED were increased. Budgets for emerging infectious disease management were increased and profitability of infection control was also improved. The EMS Act was revised to respond to emerging infectious diseases and indicators related to infection control were strengthened in evaluation of EMS institutions. In the qualitative research, experts said that since the ED infection control program was such an intuitive and obvious problem, it was easy to become a policy-agenda. Despite the resistance of small hospitals, ED infection control program was implemented by powerful policy measures such as the revision of the Law. As a result, policy goals of expanding the infection control resources and improving the infection management environment were able to be achieved. From results of observing EMS policy process, the following characteristics of policy actors were found. First, there was difference of opinions within the physician subgroup as well as between government and medical professionals. ED staff, other department staff, and hospital executives, who have different views on policy alternatives could have all served as veto points in the policy process. Second, while the EMSS expert organization, which was an unofficial participant in the emergency medical policy process, could have played both roles of cause group and sectional group in the policy process, their sectional position has been emphasized, thereby weakening their insider status during policy process. Third, policy actors understood the publicness of EMS differently in terms of its ownership and function. The ED staff insisted that government support is needed because emergency medical care is based on public interest, however, some staffs were unwilling to provide less profitable cares, leading to conflict. Main characteristics of the emergency medical policy process that made it difficult to successfully implement are as follows: First, there was lack of consideration regarding variation of EMSS in Korea, such as distribution of medical resources among different regions, incentives to hospitals, and understanding of functional variations in ED. Second, the problem of the EMS delivery system was a problem of the low quality of emergency medical care. Third, the lack of professionalism in some physicians has lowered the capacity of emergency medical care, as well as trust between patient and doctor, therefore made the problem more difficult to solve. 4. Discussion Based on the analysis of the policy processes of the EMSS after the MERS outbreak in Korea, following lessons are suggested. First, setting the goals of EMS from the perspectives of citizen is warranted. The final performance goal should focus on improving health status of citizen and satisfaction with emergency medical care. Second, to close the gaps among policy actors in understanding policy content and policy process, actors should work together to explore the root causes of the problems and establish a policy agenda together. Third, a policy alternative should be causal in solving the problems in EMSS considering variation of EMS. Fourth, compliance with policies could be secured by internal persuasion among policy actors with proper incentives and reasonable punishment, especially EMSS expert organization. Fifth, policy outcomes should be evaluated based on both policy output and side effects together to identify policy impact. Sixth, policy governance regarding EMSS should be established and the roles of EMSS expert organization should be strengthened as the cause group rather than sectional group. This study examined the emergency medical policy processes from the view of policy actors through the 2015 MERS outbreak in Korea. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(행정학전공), 2012. 2. 정광호. ; 국문 초록 본 연구에서는 고구려연구재단과 동북아역사재단의 설립과정을 역사적 사회 환경적 관점, Allison의 정부정치 모형적 관점, 그리고 Kingdon의 정책흐름 모형적 관점에서 비교 분석하여 두 기관의 설립, 두 기관의 제도적 성취 및 역할 범위의 차이를 가져온 요인이 무엇인가를 밝혀보고자 하였다. 일반적으로 조직설립을 다루는 이론으로서 역사적 사회 환경적 관점에서는 조직 환경론, 특히 구조적 상황이론과 조직생태이론이 유용한 분석도구로 활용되어져 왔다. 이러한 이론들은 조직설립이 그것을 둘러싼 맥락 또는 상황에 의존한다는 결정주의적 입장을 취하고 있기 때문에 특정 상황적 요인의 존재 또는 발생으로 조직이 설립되었다는 것을 설명하는 데는 유용한 관점인 것으로 인식되어져 왔다. 하지만, 본 연구에서는 조직 환경론적 관점만으로는 왜 특정 공공조직은 특정 상황 또는 맥락의 존재에도 불구하고 설립 또는 사멸되지 않으며, 왜 유사한 공공조직간 제도적 성취의 차이가 발생하는 가를 설명하는 데는 한계가 있다고 보고 조직설립과 관련된 조직 환경론적 관점의 한계를 적시함과 동시에 준 정부조직 설립과정의 특수성을 감안하여 정부정치모형과 정책흐름 모형을 추가로 적용함으로써 고구려연구재단 및 동북아역사재단 설립과정에 대한 비교분석을 시도하였다. 먼저, 역사적 사회 환경적 관점에서는 구조적 상황이론과 조직 생태이론을 적용하여 두 기관의 설립을 가져온 역사적 배경이 무엇이며, 동북아역사재단 설립과 더불어 이에 흡수 통합된 고구려연구재단의 사멸 요인이 무엇인지를 밝혀보고자 하였다. 동 연구 결과에 의하면, 고구려연구재단의 사멸은 낮은 신뢰성 및 예측가능성, 신생조직의 불리, 작은 조직 규모 및 예산, 핵심적 조직 변화의 시도 및 동북아역사재단의 설립에 기인한 것으로 나타났다. 두 번째로, Allison의 정부정치 모형을 통하여 두 기관 설립을 둘러싸고 벌어진 참여자들의 흥정과 타협을 분석하여 이들의 입장·선호·인식·기대이익 등의 차이가 두 기관의 설립 및 제도적 성취에 어떠한 영향을 주었는가를 설명하였다. 그 결과 두 기관의 설립 및 제도적 성취의 차이 발생은 핵심참여자로서의 대통령과 행정기관의 인식 및 선호의 차이에 의해 크게 영향을 받은 것으로 나타났다. 다시 말해, 고구려연구재단 설립과 관련된 대통령 및 행정기관의 인식 및 입장은 한·중 양국의 외교관계 등을 의식해서 상당히 유화적이었던 반면, 일본의 역사교과서 왜곡 및 독도 영유권 도발로 시작된 동북아역사재단 설립과 관련하여서는 대통령과 행정기관의 인식이 매우 단호하였던 것으로 밝혀졌다. 세 번째로, Kingdon의 정책 흐름 모형을 적용하여, 두 기관 설립을 둘러싼 문제 및 정책의 흐름의 차이가 어떠하였는지를 비교 분석하였다. 먼저, 문제 흐름의 측면에서 고구려 역사 왜곡 문제에 대한 정책 당국자 또는 학계의 인식은 약했으며, 정책의 흐름도 시민단체 주도로 이루어져 일관성 및 강도가 약했다는 것을 확인하였다. 반면, 일본의 역사 교과서 왜곡 및 독도 영유권 도발로 촉발된 동북아역사재단 설립을 둘러싼 문제의 흐름은 강하고 일관성이 있었으며, 정책 흐름 역시 대통령과 행정기관의 주도하에 하향식으로 이루어져 일관되고 강하게 진행되었다. 이러한 두 가지 흐름상의 차이가 두 조직간 제도적 성취의 차이를 가져온 또 다른 설명 요인이었다고 할 수 있다. 본 연구의 결과, 발견된 시사점은 다음과 같다. 먼저, 역사적 사회 환경적 관점만으로는 공공조직 설립과정을 명확히 이해하는 데는 한계가 있다는 것을 확인하였다. 다시 말해, 역사적 사회 환경적 관점은 조직의 구조나 기능을 결정하는 요인으로 특정 환경 혹은 맥락을 강조해왔지만, 동 관점만으로는 왜 특정 환경의 존재에도 불구하고 왜 특정시점에는 조직 설립 또는 사멸이 이루어지지 않다가 다른 시점에 와서야 이루어지는가에 대해서는 명쾌한 해답을 제공하지 못하는 한계가 있다는 것이다. 두 번째, 준 정부조직은 민간조직과는 달리 법적·행정적·제도적 제약 조건하에서 설립되는 경우가 많기 때문에 준 정부 조직의 설립과정을 보다 명확히 이해하기 위해서는 보다 다양한 관점 즉, 정부 정치적 관점 및 정책 흐름적 관점 등을 통한 기존 이론의 보완 또는 대체가 필요하다는 것이다. 특히 우리사회가 다원화된 사회로 진행되어감에 따라 공공조직 설립과정을 이해하기 위해서는 참여자의 정치적 흥정과 타협을 다루는 정부정치적 관점에 대한 고려가 필요할 것으로 본다. 주요어: 역사적 사회 환경적 관점, 구조적 상황이론, 조직 생태이론, Allison의 정부정치 모형, Kingdon의 정책흐름 모형, 준 정부조직 ; ABSTRACT A Comparative Analysis of the Establishment Processes of Two Quasi-Governmental Organizations: The Cases of the Koguryo Research Foundation and the Northeast Asian History Foundation Si Yung Jung Department of Public Administration Graduate School of Public Administration Seoul National University The purpose of this study is to analyze through a comparative approach the establishment processes of the Koguryo Research Foundation and the Northeast Asian History Foundation from the perspectives of historical-social environment, Graham Allison's Governmental Politics Model, and John W. Kingdon's Policy Streams Model in order to clarify the establishment processes of these two organizations and to identify which factors determined their institutional achievements. Generally, both contingency theory and organizational ecology theory have been widely used as tools for analysis of organizational establishment. These theories have strengths for explaining the contingencies and contexts which determine the establishment of organizations. However, these theories have weaknesses in explaining the reasons why an organization fails to be established in the presence of a certain contingency or why there are differences of institutional achievements between certain similar organizations. To further the understanding of organizational establishment and the incidence of differences of institutional achievement between the two organizations, this study adopted the Governmental Politics Model and the Policy Streams Model. In the perspective of the historical-social environment, both contingency theory and organizational ecology theory were adopted as tools for analysis. Contingency theory assumes that the structure or management style of an organization depends on the environment which surrounds the organization. In the perspective of contingency theory, the creation of the Koguryo Research Foundation was initiated by the Chinese distortion of Koguryo history, while the Northeast Asian History Foundation was created by the Japanese distortion of history and sovereignty provocation over Dokdo. The perspective of organizational ecology theory was adopted to explain the reasons why the Koguryo Research Foundation was closed and then merged into the Northeast Asian History Foundation after two and one-half years of activity. Through this perspective, this study found that the closure of the Koguryo Research Foundation resulted from such factors as lower reliability and accountability, the liability of newness, the small size of its organization and budget, the attempt of essential organizational change, and the creation of a new organization, the Northeast Asian History Foundation. In the perspective of the Governmental Politics Model, this study examined how the political resultants, the Koguryo Research Foundation and the Northeast Asian History Foundation, were drawn through bargaining and negotiation by the players involved in the game. This study revealed that the differences in the institutional achievements between the two quasi-governmental organizations resulted from the differences of the players' perceptions, preferences, and stands on the issue. In terms of perception, the perception of key players such as the president of the Republic of Korea and his administration on the issue of the Chinese distortion of Koguryo history was pacificatory, while the perception of the president and the administration on the issue of the Japanese distortion of history and the issue of Dokdo was quite determined. Through this lens, this study also found that the players perceived the issue not only on the basis of national interests, but also on the basis of their organizational interests and personal concerns. Finally, through the viewpoint of the Policy Streams Model, this study examined how the streams of problems and policy alternatives proceeded along the processes of the founding of the two quasi-governmental organizations. According to the analysis, the streams of problems surrounding the founding of the Koguryo Research Foundation were weaker than the streams of problems concerning the Northeast Asian History Foundation. In the perspective of policy streams, those concerning the founding of the Northeast Asian History Foundation were consistent and strong due to the determined stand of the president on the issue, while the policy streams regarding the Koguryo Research Foundation were incremental, inconsistent, and mutated due to the lack of presidential support and the passive attitude of the administration toward the issue. The first implication of the study is that a variety of aspects of organizational establishment should be reviewed to understand the process of organizational founding more clearly. Though organizational environment theories have assumed that environment or context determines the structure or function of the organization, the theories can not clearly explain why the birth or closure of an organization occurred in a specific time in spite of the presence of previous contingencies. The second implication is that policy makers or researchers should consider such factors as politics, administration, and the legality of the issues regarding the establishment of a quasi-governmental organization, because quasi-governmental organizations are governed by legal, administrative, and other institutional constraints unlike private organizations. The third implication is that, as Korea society is growing more pluralistic, the relevance of the Governmental Politics Model is likely to become higher in explaining the establishment processes of quasi-governmental institutions in the Republic of Korea. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 임도빈. ; 신 공공관리론의 영향으로 행정기관으로의 시장경제원리 도입에 대한 관심이 지속되고 있다. 정부는 고권적 입장에서 시민을 바라보았던 기존 관점에서 벗어나 시민을 고객으로 보고 고객만족행정을 실현하는데 힘을 기울이고 있다. 그리고 그러한 행정에 대한 측정지표로써 '시민 만족도'를 조사하여 연구하는 경향이 활발해지고 있다. 시민 만족도에 대한 조사는 시민들이 시 행정에 얼마만큼 만족하고 있는지를 살펴보고 이를 행정에 대한 성과로 치환할 수 있다는 점에서 의의가 있다. 그러나 기존의 만족도 조사로는 '과거' 성과에 대한 측정으로서의 역할을 할 뿐 '미래'에 어떤 정책을 추진해야하는지 한정된 자원을 어디에 투입해야하는지를 알려주는 지표로서는 한계를 가진다. 이러한 관점에서 시장부문에서 활용되고 있는 IPA 분석(중요도-성과 분석)을 행정학에 도입하려는 움직임이 대두되고 있다. 사부문과는 달리 성과를 가시적인 산출물로 나타내기 힘든 공공부문의 특성상 행정학에서의 성과는 시민 만족도로 대체되는 경향이 있어 이를 중요도-만족도 분석이라고 부르기도 한다. 여기서 주목할 점은 기존의 만족도만 조사하였던 방식에서 탈피하여 '중요도'에도 초점을 맞추기 시작했다는 것이다. IPA분석을 통해 한정된 자원을 좀 더 효율적으로 투입할 수 있는 방안이 생겼는데 이는 중요도와 만족도를 함께 조사하기 때문에 가능한 일이다. 그러나 '성과'를 '시민 만족도 조사' 로 치환하여 사용할 수 있는지, 그 방법에는 어떠한 것이 있는지 등 '만족도'에 대한 논의는 활발함에도 불구하고 아직까지 '중요도'에 대한 논의는 국내에서 미미한 실정이다. 이러한 이유에서 본 연구는 개별 행정서비스의 '중요도' 를 좀 더 정확하고 설명력있게 파악하기 위한 작업으로 사부문에서 활용되는 Derived importance를 소개하고 직접 설문을 통한 결과를 도출하여 기존에 활용되던 Stated importance 와는 어떤 점에서 다른 특성을 갖는지 살펴보았다. Derived importance 는 개별행정서비스에 대한 만족도를 독립변수로, 전체 행정 만족도를 종속변수를 두고 다중회귀분석을 통하여 나온 설명변수값(Beta)으로 중요도를 도출해내는 통계학적인 수치이다. 이는 Stated importance 보다 더 설명력이고 예측성이 있으며 심층적인 시민의 의식을 엿 볼수 있다는 점에서 실질적인 중요도로서의 가치가 증대되고 있다. 직접 설문조사를 통하여 각각의 중요도 값을 도출해낸 결과 24개의 개별 행정서비스의 중요도로 Stated importance 에서는 '공원과 여가활동시설'의 중요도는 12순위 밖에 되지 않았으나 Derived importance 에서는 1순위임을 확인할 수 있었으며, '공중보건 및 의료' 항목도 Stated importance 는 14위이나 Derived importance 에서는 2순위의 값을 가지는 등 여러 차이를 확인할 수 있었다. 이는 일반인들이 '실업문제 해결 및 경제활성화'나 '주택가격안정 및 주택공급' 과 같이 상대적으로 범주가 크고 사회적으로 이슈가 되는 문제해결을 위한 행정서비스 개선이 중요하다고 표면적으로 응답하나 실질적, 심층적으로 서울시의 전체 행정 만족도의 개선을 증진시키는 가장 중요한 서비스는 자신의 주변에 '공원과 여가활동시설' 이 얼마만큼 있는지, 자신이 아플 때 이용하는 '공중보건 및 의료'에 대한 행정이 잘되어있는지의 여부라는 것을 의미한다. 즉, 개인이 중요시 여기는 실질적인 개별 행정서비스의 개선은 자신의 피부에 직접 와닿고 자신이 느낄 수 있는 범주의 것이라는 점이다. 정책결정자의 최종 목표는 전반적인 만족도의 향상이다. 시장의 경우 전체적인 시의 운영 및 시 행정에 대한 만족도가 올라가는 것을 가장 첫 번째 목표로 삼을 것이며 시민들이 실질적으로 원하는 곳에 자원을 투입해야 한다는 측면에서 Derived importance 의 활용은 획기적인 시도라 할 수 있다. Derived importance 에 따라 개별 행정서비스 부문 중 높은 중요도를 가진 부문에 예산과 자원을 투입한다면 지방정부의 가장 첫 번째 목표인 지방 정부의 전체 만족도의 상승 효과를 예상할 수 있어 매우 효과적인 지표로써 활용될 수 있을 것이다. ; New Public Management lead consistent attention of introducing market economy principle to administrative institutions. As index of measuring such administration, there is a growing tendency of studying 'citizens' level of satisfaction'. Survey on citizen's level of satisfaction has the implication that finding out to what extent citizens are satisfied with municipal administration and apply it to administrative performance. Previous survey on the level of satisfaction, however, previous index only had a role of measuring 'past' performance but had limitation in guiding which policy should be promoted in the 'future' as well as where limited resources should be inputted. For such reasons, so as to figure out 'the level of importance' of each administrative service more accurately and in a more explanatory manner this study introduces Derived importance which is utilized in private sector and takes results through direct survey to find out which features are different from Stated importance which is utilized previously. Derived importance is statistical figure of which independent variable is the level of satisfaction on each administrative service and dependent variable is the level of satisfaction on general administration, and derives the level of importance through multiple regression analysis in the form of explanatory variable (Beta). As the result of the level of importance through direct survey, among 24 individual administrative services, it is found out that the rank of 'park and leisure facility', which is only 12th in Stated importance, is the first in Derived importance; the rank of 'public health and medical treatment', which is only 14th in Stated importance, is the second in Derived importance. This result means that citizens ostensibly answer that it is important to enhance administrative services concerning subjects, which are relatively big and receive attention from society, such as 'solution of unemployment and economic revitalization' or 'stabilization of housing price and housing provision', however, the most important service to them in substance and in depth, which enhances the level of satisfaction on Seoul city administration in whole, is 'park and leisure facility' around the neighbor and 'public health and medical treatment' which they can use when they are sick. That is, the substantial enhancement of individual administrative service which is important to individuals is about categories which people click and feel. The final goal of policy maker is to raise overall level of satisfaction. In case of mayor, it may be fairly said that the utilization of Derived importance is epoch-making attempt from the aspect that the first priority will be enhancement of general municipal operation and satisfaction on municipal administration and resource should be inputted where citizens want in substance. This study examined the influence of the separation of prescribing and dispensing roles(SPD) policy implemented in Korea in July 2000, especially on the change in the net profit of medical institutions. Using the data set from the Korea's National Health Insurance and the previous research, this study elicited the following main results. First, tertiary care institutions was estimated to lose about 631 billion won after the SPD policy. Second, general hospitals and hospitals gained about 557 billion and 564 billion won, respectively. Third, it is shown that clinics also gained 389-659 billion won. Finally, however, the change in net profit of medical institutions after the SPD policy largely depends on different estimation models. Moreover, it also varies from the assumptions on the price differential of a reimbursable drug which worked as cross-subsidy to insufficient physician's fee before the SPD policy. Despite such limitations as lack of data outside of the National Health Insurance's coverage, this study differs from others. This is the first research to explore the effect of the SPD policy on different types of medical institutions and to attempt to purely focus on the SPD policy. In this study, we can draw the policy implication that preparing for a policy change, the government should set up the policy evaluation system to collect the concerned data and develop the methodologies in advance to the policy implementation. ; open

Background: Bankrupted households have recently been increased due to excessive medical expenditure in Korea. They have not been protected from economic risk when household's member has severe diseases that need a lot of money for treatment. Purpose of this study examines policy effect by comparing unmet needs' change of policy object households and non-object groups. Methods: We used Korea Health panel 2nd 4th data collected by Korea Institute for Health and Social Affairs and National Health Insurance Service. Analysis subjects were 381 households (pre-policy) and 393 households (post-policy) that had cancer and cardiovascular and cerebrovascular diseases. Since it was major concern that estimates benefit strengthening policy started by certain time, we setup comparing households which had diabetes, hypertension disease. Comparison subjects were 393,247 households, respectively and we evaluated policy effect using difference in difference (DID) model. Results: Although unmet needs of policy object households were higher than non-object groups, policy execution variable affected negative direction. But interaction-term which shows pure effect of policy was not statistically significant. We utilized multi-DID model to examine factors affecting unmet needs causes. Copayment assistance policy did not significantly affect households that responded to 'economic reason,' and 'no have time to visit' for unmet needs causes. Conclusion: The second copayment assistance policy did not significantly give positive effect to beneficiary households than non-beneficiary groups. When we consider that primary purpose of public insurance guarantee high medical expenditure occurred by unexpected events, it needs to deliberate on switch of benefit strengthening policy that can assist vulnerable people. Also, we suggest that government forward a policy covering non-reimbursable medical expenses as well as switch of benefit strengthening direction because benefit policy do not affect non-covered medical cost which accounts for quarter of total health expenditure. ; open

학위논문(석사)--서울대학교 대학원 :행정대학원 행정학과(정책학전공),2019. 8. 우지숙. ; 본 논문은 브라질의 인터넷권리보호법(Marco Civil da Internet)이 어떠한 전개과정을 거쳐서 지금에 이르게 되었는지 고찰한다. 각국이 인터넷의 자유와 규제의 딜레마 속에서 접점을 찾기 위해 노력하고 있는 가운데, 라틴아메리카의 브라질에서는 1990년대 이래 인터넷 규제에 관한 정책의제가 국가 내부에 존속하다가 오랜 논의 끝에 2014년 3월 25일 인터넷 이용자 표현의 자유, 개인정보보호, 망중립성(Net Neutrality) 보장 등을 골자로 하는 세계 최초의 인터넷 권리장전의 제정으로 이어진다. 연구는 '브라질의 Marco Civil은 어떠한 계기로 다른 정책들을 우선하여 정책결정자가 주목하는 주요 의제로 채택되어 제정으로 이어졌는가?'를 질문하고, 이러한 정책변동 사례를 Sabatier의 ACF 모형과 Kingdon의 MSF 모형의 결합모형에 적용하여 체계적으로 답을 모색하였다. 연구의 결과는 다음과 같다. 먼저, Marco Civil 정책은 각각 '평등주의'와 '시장주의'라는 상충하는 신념체계를 가진 찬반 옹호연합으로 분화되어 정책결정과정에서 첨예한 대립을 펼쳤으며, 정책학습의 기회에도 자신들의 신념체계를 견고화하였다. 둘째, 이들 옹호연합은 브라질 사회의 다양한 외적 변수에 직간접적인 영향을 받아 신념체계를 형성하였다. 셋째, Marco Civil은 수차례 입법 지연을 겪다가 Snowden 사건이라는 강력한 외부적 촉발기제에 의하여 정책의 창이 열리고 정책변동으로 이어질 수 있었다. 넷째, Marco Civil 정책결정과정에서 정책중개자와 정책선도자의 역할이 두드러진 것으로 나타났다. 특히 정책선도자인 Lula 대통령과 Dilma 대통령의 적극적인 역할은 Marco Civil 제정에 있어 결정적인 영향 요인이라고 판단할 수 있다. 연구의 함의는 다음과 같다. 먼저 이론적 함의로는 첫째, 연구는 ACF 모형과 MSF 모형의 적용 사례로서 비교적 새로운 분야인 인터넷 규제정책을 연구대상으로 삼았다. 인터넷 정책은 찬반 옹호연합의 첨예한 갈등이 나타나는 정책이라는 점에서 결합모형에 따른 설명력이 높게 나타났다. 둘째, 모형이 개발된 다원주의적인 서구사회가 아닌 권위주의와 엘리트주의가 뿌리 깊게 작용하고 있는 브라질의 사례를 분석함으로써 ACF 모형과 MSF 모형의 유용성을 입증하였다. 셋째, 일반적으로 대통령의 적극적 관심을 가질 경우 빠른 정책 대안의 마련으로 합리적인 대응 방안을 찾아낸다는 합리적 모형으로는 쉽게 설명되지 않는 사례로서, 룰라 대통령의 적극적인 지원에도 불구하고 임기 내 법안 제정에 실패한 원인을 추적할 수 있다. 넷째, 정책의 흐름이 열려 정책산출에 이르는 데 정치의 흐름은 정책의 창을 여는 데 결정적인 역할을 하지는 않았다. 호세프 정부 시기 정치의 흐름은 법안 제정에 부정적인 영향으로 작용하여 Marco Civil 폐지의 위기에까지 갔으나 외부적 초점사건에 의해 제정에 이르게 된다. 정책적 함의는, 먼저 정책선도자의 리더십과 정책 방향의 중요성을 함의한다. 국민의 인권 보장을 위한 룰라 대통령의 일관된 사회정책과 리더십은 우리나라에도 시사하는 바가 많다. 둘째, Marco Civil 법은 국가가 인터넷을 어느 범위까지, 어떠한 방식으로 규율해야 하는가와 관련된 가치충돌적이고 논쟁적인 쟁점을 되짚어보고 추후 유사한 인터넷 권리법 제정 논의에 적용할 수 있는 교훈적인 사례이다. 셋째, 본 정책은 참여민주주의를 실천한 사례로서 정부에 대한 국민적 신뢰를 반영한다. 마지막으로 한국과 브라질은 공통적으로 2006년도 인터넷상 사이버범죄 규제안을 제정하였으나, 한국의 경우 해당 법이 임기만료로 폐기된 이래 의미 있는 논의가 이루어지지는 않은 반면, 브라질은 사이버범죄법 발의라는 '초점사건'이 휘발되지 않고 정책선도자의 적극적인 의지 아래 인터넷권리법의 제정으로 이어진다. 브라질의 인터넷 정책결정과정에 대해 검토하고 구체적인 법안의 추진 동기, 과정, 정책의 결정요인 등을 모색함으로써 우리나라의 인터넷 규제정책이 어떠한 위치에 놓여 있는지 비교해볼 수 있을 것으로 생각한다. ; One of the most significant policy goals in the internet arena in the last decade has been striving to seek a reasonable balance between freedom and regulation of the Internet. Brazil, as Latin America's economic giant, has also spent a long time finding the balance point between creating economic profits and protecting human rights under the pressure of mediating the conflicting values of regulating and protecting users' behaviors from circumstances of the internet. And it is one of the key policy initiatives associated with this shift to pass the world's first Internet Bills of Right which is called Marco Civil da Internet on March 25, 2014 after years of discussion, which calls for freedom of expression for the Internet users, protection of personal information and guarantee of network neutrality. This case study explores the policymaking process of the Marco Civil da Internet in Brazil. It examines specifically how Brazilian internet policy came into being applying the combination frameworks of Sabatier's Advocacy Coalition Framework and Kingdon's Multiple Streams Framework, in order to learn more about the linkages between research and policy. The study began with a relatively simple question, 'On what occasion was Brazilian Marco Civil da Internet adopted as a major agenda for policymakers, prioritizing other public policies and being eventually enacted after long debate' and systemically sought an answer applying the example of this internet policy change through these policymaking process frameworks. The results of the study are as follows: First, the stakeholders in the policymaking of this legislation were divided into the a pro-MCI coalition and an anti-MCI coalition with a conflicting belief system between 'Equalityism' and 'Marketism' and strengthened their own belief system even in the opportunities of policy learning. Second, these advocacy coalitions formed these belief systems, directly or indirectly being influenced by various external variables in Brazilian society. The Snowden event in 2013 worked as a powerful external trigger mechanism of this policymaking process, as a strong variable that opened the window of policy and lead to policy changes after going through several legislative delays. Third, it was indicated that the role of a policy broker and a policy entrepreneur in MCI policymaking process was shown to be outstanding. In particular, the active role of policy entrepreneurs, the two Brazilian Presidents, Lula da Silva and Dilma Rousseff, could be judged as a decisive factor in enacting this legislation. Next, the implications of the study are twofolds. Firstly, the theoretical implications are as follows. First, the study targeted the Internet regulatory policy which is a relatively new field as an example of the application of the ACF and the MSF. The Internet policy might be highly adequate research topic, given that it is a policy that showed a strong conflict between a pro-MCI and an anti-MCI advocacy coalitions. Second, the study proved the usefulness of the ACF and the MSF by analyzing Brazilian case where authoritarianism and elitism have been deeply rooted rather than a pluralistic western society in which these theoretical frameworks were developed. Third, the study could track the causes for failure to enact this legislation within his term, despite President Lula's active support, which is not reasonably explained with a rational model supposing if the president has a active interest, he could find a reasonable and quick policy alternative. Fourth, Political Stream in this policymaking process did not play a crucial role in opening the window of policy. The political stream during the Rousseff administration had influenced a negative effect on enacting the legislation and reached the crisis of the abolition of the MCI, but an external focus event led it to be enacted in the conclusion. Political and practical implications are as follows: first of all, this study implies the importance of leadership and policy direction of policy entrepreneurs. President Lula's consistent social policy and leadership to ensure the human rights of Brazilian people provide a lot of implications for Korean administration. Second, the MCI is an instructive example that could be applied later in the discussion of enacting an Internet Bills of Right in other countries, which reflects on the value-conflicting and contentious issues concerning how the country should regulate the Internet. Third, as an example of practicing participatory democracy, the MCI policymaking process reflects public trust about the government. Finally, although each Korea and Brazil enacted regulations of cybercrime on the Internet in 2006, no meaningful discussion had been made in Korea since the law was scrapped at the end of its term, while Brazil's 'focus event' of trying to introduce the cybercrime law eventually led to the enactment of the Internet Bills of Right under the active will of policy entrepreneurs. The database Cretan Institutional Inscriptions was created as part of the PhD research project in Ancient Heritage Studies Kretikai Politeiai: Cretan Institutions from VII to I century BC, carried out at the University of Venice Ca' Foscari by Irene Vagionakis from 2016 to 2019, under the supervision of Claudia Antonetti and Gabriel Bodard. The research project aimed at collecting the epigraphic sources related to the institutional elements of the many political entities of Crete, with a view to highlighting the specificity of each context in the period between the rise of the poleis and the Roman conquest of the island. The main component of the database consists of the epigraphic collection of the 600 inscriptions constituting the core of the documentary base of the study, for each of which an XML edition compliant with the TEI EpiDoc international standard was created. Each EpiDoc edition includes a descriptive and a bibliographic lemma, the text of the inscription, a selective apparatus criticus and a commentary focused on the institutional data offered by the document. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 김상헌. ; 중앙정부는 지방정부의 부족한 재원을 지방교부세, 국고보조금과 같은 지방재정조정제도를 통해 보전하고 있다. 우리나라의 경우 지방 재정조정제도의 하나인 지방교부세에 보통교부세와 특별교부세가 있 다. 특별교부세는 보통교부세의 경직적 산정에 따른 배분의 한계를 보완하여 각 지방재정력의 격차를 고려하여 보전한다는 방침으로 행 정안전부에서 운영하고 있다. 그러나 특별교부세는 배분의 기준과 결 정이 모호하고 불투명하여 그 결정이 정치적으로 이루어진다는 문제 점을 지적하는 연구가 있다. 선행연구로 이루어진 특별교부세 배분에 관한 실증분석에서는 배분의 결정에 영향을 미친다고 상정한 정치적 행위자를 국회 행정안전위원회 소속, 지역구 국회의원 수 등 의회의 영역으로만 한정하였다. 본 논문은 정치적 요인에 의회의 행위자뿐만 아니라 정부의 행위자 를 포함시켜 분석하였다. 본 논문은 전국 234개 시‧군‧구의 2003~2006년도 4개년도의 특별교부세 자료를 이용하여 특별교부세 배분의 결정에 영향을 미치는 요인들에 대해 정부 정무직 공직자를 포함하여 실증분석을 시도하였다. 그 결과 정부 정무직 공직자로 상 정한 변수가 배분의 결정에 영향을 미친다고 파악되었고, 정부 정무 직 공직자 중에서도 국무총리와 국무조정실‧차장이 다른 정무직 공직 자에 비해 더 큰 영향을 미친다고 파악되었다. 특별교부세 배분에 정무직 공직자가 자기 출생지에 더 많이 배분하 려 결정 과정에 영향을 미치는 것뿐만 아니라 정무직 공직자가 임기 후 선출직에 출마할 경우 특별교부세 배분의 결정에 더 큰 영향을 미 친다는 것을 보았다. 이로써 특별교부세 배분의 결정에 정부의 정무 직 공직자가 영향을 미친다는 것을 확인할 수 있었다. ; The national government makes up for any shortfall in finance of the local governments by the local finance coordination system, which includes local revenue sharings and national subsidies. The local revenue sharing, as a kind of the local finance coordination system, consists of an ordinary revenue sharing and a special revenue sharing. The latter is introduced to remedy the shortcomings of the former's allocation system caused by the rigidity of its calculation, and is currently operated by the Ministry of Public Administration and Security. There are some literature criticizing the problem that the SRS allocation is decided politically due to the fact that the principles for its allocation are equivocal and the decisions are arbitrary and not transparent. In previous studies analyzing the SRS allocation empirically, the scope of the political actors who are assumed to exert influences on the allocation decision is limited to the legislative area, such as the members of the National Assembly Public Administration and Security Committee and the number of lawmakers in each electoral district. This study presents a further analysis with a new political factor, the government actors, in addition to the existing legislative actors. Specifically, using the SRS data for the period of 2003 ~ 2006 for the entire 234 cities- counties-districts in the country, the present study attempts to analyze the factors, which affect SRS allocation decisions, including the new variable, the government's political masters. The results demonstrate that the new variable indeed affects the allocation decisions and that, among the political masters, prime ministers and directors generals and deputy directors in the Prime Ministers Office are shown to exert greater influences than others. Moreover, it is also shown that they exercise their power in the SRS allocation decision making process to provide more sharings to their places of birth, and in particular, their intervention is even greater when they decide to run for an elective office from their places of birth after the termination of their government offices. As such, this study verifies that the government's political masters exert influences on the SRS allocation decision. ; Master

본 논문은 대외정책 분야에서 드러나는 미국 대통령제의 운용원칙인 권력분립을 미국식 민주주의의 사각지대로 접근하는 시각을 제시하여 선행연구와 차별성을 추구한다. 구체적으로 헌법이 천명하는 권력분립 원칙에도 불구하고 오히려 그 권력분립의 기제인 상호간 독자적 선거제에 의해 미국의 유권자 전체가 선출한 대통령은 각 지역구에서 선출된 입법부 구성원이 내세우는 집합적 통치 위임과 확연하게 구별되는 유일한 공공리더십(public leadership)을 정책결정과정에서 독점할 수 있다는 점을 주시하고자 한다. 결국 미국 대통령제의 과제는 미국식 민주주의의 주요 통치원칙인 권력분립을 중시하는 동시에 성공적 통치를 위해 권한공유의 묘(妙)를 찾는 부단한 노력을 경주해야만 가능하다는데 있다. 특히 국내정책 분야보다 대외정책 분야에서 이 난제의 해법을 모색하는데 있어서 법제도적 및 정치적 장애물이 가로막혀 있다. 게다가 선거결과와 무관하게 통치 위임을 생성하는 정치의 사법화가 입헌 대통령제의 근간을 흔들 수 있는 위험성을 목격했다. 이에 본 논문은 대외정책 분야의 미국 대통령제에 대한 평가를 권력분립의 양면성, 즉 권력분립은 권력공유를 전제로 한다는 패러독스에 중점을 두고 대통령의 우위에 대한 주장을 가능하게 하는 헌법적 및 정치적 근거를 대조하면서 미국식 민주주의의 사각지대를 재조명하고자 한다. ; In this paper, I argue that the principle of separation of power in foreign policy under presidentialism invites a blind spot in American democracy. Although the Constitution specifies separation of power both in the conduct of domestic and foreign affairs, independent elections of President and legislators differentiate the kind of collective mandates on Capitol Hill from the unitary mandate bestowed upon President, thus prompting him to proclaim public leadership. The key to a successful governing, then, lies in the art of pursuing "separated institutions sharing powers" persistently. However, the realm of foreign affairs poses a more challenging task, both constitutionally and politically, than its counterpart in domestic policy. Furthermore, we came to witness a modern presidency whose relentless claim on mandate, or what is dubbed as judicialization of politics, was found irrelevant to the electoral outcome itself, thus creating a peril in constitutional presidency. 학위논문(석사)--서울대학교 대학원 :행정대학원 공기업정책학과,2019. 8. 금현섭. ; 본 연구는 국민이 가지는 정부에 대한 신뢰는 정책의 수용과 지지에 영향을 주는데 그 중 특정 정책인 부동산 정책시행에 따른 부동산 가격에 미치는 영향을 실증적으로 분석하고자 하였다. 먼저 정부신뢰와 부동산 정책에 대한 이론적 배경을 확립하고, 정부신뢰, 부동산정책과 신뢰, 부동산 가격요인, 부동산 정책의 효과에 대한 선행 연구를 검토하였다. 본 연구의 목적에 따라 독립변수로 정부신뢰를, 통제변수로는 사회·경제적 요인(물가, 지역내총생산)과 국제경제적 요인(환율)을, 조절변수로 정책변수(각 정부별 부동산 정책)인 연구모형을 수립하였다. 그리고 이를 분석하고자 회귀분석방법을 이용하였다. 연구결과를 요약하면 다음과 같다. 첫째, 사회ㆍ경제적 요인과 국제경제적 요인, 지역, 정부신뢰를 통제한 상태에서는 부동산 정책은 부동산 가격지수에 정(+)의 영향을 미친다. 이명박과 박근혜 정부의 부동산 정책은 효과가 있는 반면 문재인 정부의 부동산 정책은 효과가 없는 것으로 나타났다. 둘째, 정부에 대한 신뢰는 정책의 지지와 수용, 협력을 이끌어내며, 이러한 정책이 정책의 성공으로 이어지는 데에는 시차를 두어야 한다는 것이다. 셋째, 각 정부별 정부신뢰의 차이가 실제로 부동산 가격에 영향을 미치는지를 실증 분석한 결과, 차이는 존재하지만 특정 정부가 모든 부동산 가격에 영향을 미쳤다고 말할 수 없었다. 넷째, 사회ㆍ경제적 요인(지역내총생산, 환율)과 정책적 요인(각 정부별 부동산 정책), 정부신뢰를 통제하고 본 지역별 부동산 가격변화에서 수도권과 비수도권이 크게 달랐다. 다섯째, 여러 요인들을 통제하고 시차별, 정부별, 지역별 정부신뢰와 부동산 가격간의 관계를 살펴보았을 때, 일관되게 부(-)의 영향관계가 있었다. 종합하면, 그동안의 부동산 정책 중 가격활성화 정책은 어느 정도 효과가 있었으며, 정부신뢰에 따른 정책의 효과는 시차를 두고 나타나며, 정부신뢰 및 부동산 정책에 따른 부동산 가격변화는 지역에 따라 달리 나타난다. 본 연구 결과를 통해 도출한 시사점은 다음과 같다. 첫째, 정부신뢰의 중요성에 대한 연구는 많았지만, 실증적으로 정부 신뢰가 어떤 영향을 미치는지를 살펴본 것은 적었다. 하지만 정부신뢰의 영향을 분석하였다는 점과 정책수용자인 국민들이 정책에 순응·지지하는 데는 시간이 필요하다는 것을 실증적으로 보여주었다는 점에서 의의가 있다. 그리고 이는 정책이 가진 정책의 효과보다 정부신뢰로 인한 해당 정책에 대한 지지와 수용이 달라져 정책의 효과·성과가 더 크게 나타난다고 볼 수 있다. 둘째, 부동산 정책 중 가격활성화 정책은 부동산시장에 효과가 있었다. 다만 가격활성화 정책에 대한 정책수용 측면에서 살펴보면 정부신뢰와 부동산 가격 간에는 부(-)의 관계가 존재한다. 셋째, 지역별로 구분하여 살펴본 분석결과 전세가격이 매매가격보다 민감하게 반응한다는 점인데, 주거복지 측면에서 부동산 정책에 대해 제고해야 한다는 것을 보여준다. ; This study was intended to empirically analyze the impact of the public's trust in the government on real estate prices under certain policies: real estate policy implementation. First of all, the theoretical background on government trust and real estate policy was established, and then the prior study on the effects of government trust, real estate policy and trust, real estate price factors, and real estate policy was reviewed. In accordance with the purposes of this study, a research model was established, which is Government trust as an independent variable, Social, economic and international economic factors as a control variable, government policy(real estate policise for each administration) as a moderator variable. And the regression analysis method was used to analyse. The results of the study are summarized as follows. First, the real estate policy has a positive effect on the real estate price index under the control of socioeconomic factors, international economic factors, region and government trust. The real estate policies of Lee Myungbak and Park Geunhye are effective, but the real estate policies of Moon Jaein government are not effective. Second, trust in the government leads to the support, acceptance and cooperation of policies, and time differences should be placed in the way that these policies lead to the success of the policies. Third, after empirical analysis of whether the differences in government trust in each government actually affect property prices, it was not possible to say that a particular government had influenced all real estate prices, although differences existed. Fourth, social and economic factors (GRDP(Gross Regional Domestic Product), exchange rate) and policy factors (real estate policies for each government) and government confidence were controlled, and the capital and non-capital areas were significantly different in real estate price changes for each region. Fifth, when controlling various factors and looking at the relationship between government confidence and real estate prices by time lag, each government and region, there was consistently a negative influence. In sum, the price revitalization policy of the past real estate policy has had some effect, the effect of policy on government trust appears at a time lag, and changes in real estate prices according to the government trust and real estate policy vary depending on the region. The implications of this study are as follows. First, Although there have been many studies on the importance of government trust, few have examined how government trust affects empirically. However, it is significant that the analysis of the influence of government trust and the fact that the people who are policy adopters need time to conform and support the policy. This suggests that the effectiveness and the performance of the policy are shown to be larger because the support and acceptance of the policy is more different than the effect of the policy. Second, the price revitalization policy among real estate policies was effective in the real estate market. Though terms of policy acceptance of price activation policy, there is a negative relationship between government trust and real estate prices.
