The conclusion of the Concordat between the Holy See and the Republic of Poland on July 28, 1993 was undoubtedly an important event in the recent history of the mutual relations between the Polish state and the Catholic Church. However, due to the political disputes, the process of ratification of this international agreement was significantly delayed. The present paper discusses one element of this process, that is, the debate that was held at the sitting of the Sejm Committee for Foreign Affairs on 16 December, 1997. The debate concerned, among other things, the legislative procedure for ratification of the Concordat and the issue of including the Government's interpretive declaration of 15 April, 1997 in the ratification act. As a result of the work undertaken by the Committee, the draft ratification act was submitted to the Sejm and subsequently adopted on 8 January, 1998. Konkordatu między Stolicą Apostolską a Rzecząpospolitą Polską było ważnym wydarzeniem w najnowszej historii wzajemnych stosunków Państwa polskiego i Kościoła Katolickiego. Spory polityczne sprawiły jednak, że proces ratyfikacji tej umowy międzynarodowej znacząco przeciągnął się w czasie. W niniejszym opracowaniu przedstawiony został jeden z elementów tego procesu, a mianowicie debata przeprowadzona w trakcie obrad sejmowej Komisji Spraw Zagranicznych, jaka odbyła się 16 grudnia 1997 r. W jej trakcie poruszone zostały kwestie dotyczące trybu uchwalenia ustawy ratyfikacyjnej oraz włączenia do niej deklaracji interpretacyjnej Rządu RP z dnia 15 kwietnia 1997 r. W wyniku prac Komisji do Sejmu skierowany został projekt ustawy ratyfikacyjnej, którą uchwalono 8 stycznia 1998 r. Ratyfikacja Konkordatu nastąpiła w dniu 23 lutego 1998 r.

Umowy handlowe nie są obecnie kategorią normatywną w przeciwieństwie do regulacji kodeksu handlowego, wyróżniane są jednak w doktrynie. Umowa komisu jako umowa handlowa jest regulowana w kodeksie cywilnym zgodnie z koncepcją monizmu prawa prywatnego. Powrót do dualizmu wymagałby uwzględnienia obecnego stanu obrotu handlowego, jego zróżnicowania oraz występowania umów konsumenckich.

One of the fundamental categories of general sociology concerns power. Regardless of differences in interpretation, power can be defined as the dependence between subordinator and subordinated. This relation is unidirectional. When discussing influence, this property is significant, as otherwise it could be reciprocal, or an influence could be exerted by many other entities that are not bound by the relationship of subordination. The nature of international relations is too specific to allow a simple transfer of power-related phenomena from the realm of domestic relations. One can indicate the presence of delegated power, resulting from the mutual assignment of subordination rights to international decision- making bodies. The processes of international power are divided into procedures of hard power, soft power and smart power, the latter signifying the manifestation of effective power, making use of the mechanisms of the former two. It is also important to take into account the specificity of the legitimization of international power and manifestations of accountability. Also not without significance is the capacity for the implementation of international power, equipped with the relevant enforcement instruments.

Konsekwencją zasady swobody umów jest funkcjonowanie w obrocie prawnym obok umów nazwanych, umów nienazwanych oraz umów mieszanych. Praktyka obrotu gospodarczego wykazuje, że pojawiają się nowe typy umów, których nie można zaklasyfikować do żadnej tradycyjnej postaci prawa zobowiązań, a kwalifikowanie ich do kategorii umów nienazwanych nie jest właściwe. W niniejszym artykule autorzy poruszają historyczno-porównawczą problematykę umów mieszanych. Dokonują analizy tej instytucji prawnej w prawie rzymskim, w średniowieczu, w systemie francuskim, a następnie przedstawiają funkcjonowanie tej instytucji w oparciu o kodeks austriacki, Niemiecki kodeks cywilny z 1896 r. Opisują ją w obligacyjnym systemie szwajcarskim i w prawie włoskim. Publikacja stanowi początek serii artykułów naukowych dotyczących charakterystyki umów mieszanych, począwszy od przedstawienia ich w wymiarze historycznym aż po ich funkcjonowanie aktualnie w praktyce w systemie prawnym
