The aim of the report is to help the state governments to develop regulations based on certain principles which makes the regulations predictable and transparent. The report suggests the way forward on how the state governments can learn from global best practices in creating uniformity in developing their pricing models, building transparency and creating more predictable policy environment through data driven and evidence-based policymaking. If the recommendations of this paper are implemented, it can help the state governments in meeting the objectives of earning higher revenue, addressing consumer health concerns, and creating employment. The recommendations can help India in bringing in more investments in to the sector, encourage innovation, improve ease of doing business, enable "Make in India", enhance exports and the country can be a key player in global value chains of alcoholic beverages.

The results of the research described above were obtained on a representative sample of Croatian youth from 15-24 years of age in the second half of 2002. The research was carried on in the context of a regional research project on youth under the auspices of the PRONI institute from Sweden. The main objective of the project was to provide empirical data on life, needs, attitudes and aspirations of young people as a means of assisting the process of youth policy review. The process was initiated by the Council of Europe with a view to strengthen youth participation in democratic changes of the countries in the region. This report is the most recent one in a long and well-established tradition of studying youth issues in Croatia. Therefore, it often includes comments and references to earlier research findings for the purpose of determining the changes in youth trends, as well as for the purpose of validity testing of our data. On the other side, the data presented in this report may, together with earlier studies, be used as a reference point in the process of reviewing the National Programme of Action for Youth, as well as in developing a comprehensive, efficient and youth-centred national youth policy. The core of the findings is probably that the criteria for determining the upper age-level of youth period should be reviewed and extended to include those who are 30 years of age. The fact that more and more young people remain longer in education, that they decide to marry and have children later in their life, that they consider changing their job and probably, if possible, enroll in re-training programmes for that purpose, as well as that they desire to reach full independence by relying on their own abilities and endeavour, speaks in favour of the need to redesign our traditional approaches to youth upper age-limits. Other findings that help us understand some important dimensions and trends of contemporary life of Croatian youth are summarised below. The most basic socio-demographic data demonstrate that very few young people from our research who are 24 and below are married and few think of having children before the age of 25. About half of them live in a two-child nuclear family in a house/apartment of their own that, averagely, comprises more than two rooms. Very few have an opportunity to live in an apartment of their own, although four fifths express desire to live separately. The aspiration towards such independence is mainly motivated by socio-economic and maturity factors: it is a prominent feature of young people who are university students, whose fathers have more education, and who are over 20. Since the chances of having their own apartment in a reasonable period of time are rather minimal, not only due to the difficulties in finding a job but due to extremely high prices in the housing sector, such prolonged co-habitation and dependency on parents and/or relatives is a frequent cause of young people' s frustrations and is probably related to, together with other factors such as poverty and limited capacity of pre-school child-care institutions, a constant decrease in the average number of children per family. On average, young people are satisfied with their present life and expect no change in the future. Despite a high unemployment rate especially among them, approximately three quarters assess their own present and future life, the life of their closest friends and their peers in Western Europe as good or excellent. Their optimism is somewhat even higher than it was found in the end of 1990s. When asked to imagine their life in 10 years ahead majority see it as a success, either in general terms or in specific terms of their professional advancement or family happiness. Dissatisfaction with present life grows with age and with opportunities to enter the world of work and become fully independent, since the young between 20-24 years of age, both employed and unemployed are more inclined to perceive their present life as unsatisfactory. Interestingly enough, the age does not have influence on the assessment of future, which means, in the context of this research, that young people in general, irrespective of age, equally believe that future brings better opportunities. In reference to their professional and educational aspirations, almost two thirds of the young want to continue education, while one fourth of them think of finding a job. The differences are mainly determined by residential, social, and age factors. Thus, a primary aspiration of pupils and university students, as well as of those who live in Zagreb or in families of higher socio-economic status, is to continue their education. Contrary to them, rural young people, those who live in low-income families, as well as those who are over 20 are more inclined to seek for a job or to continuing the job they currently hold. Over two fifths of young people plan to leave their present place of residence so as to be able to meet their professional and educational aspirations. Almost half of this group prefer to move somewhere inside the country, most often to a bigger city which is perceived as the place that offers better opportunities for career and social positioning, while other half think of going abroad. The percentage of the young planning to leave the country for good rose from 11% in 1986 and 18% in 1999 to 19% in 2002. Their migratory plans are connected to their residential status, i.e. to the conditions in the place or region where the young actually live. Young people from Zagreb are less willing to go somewhere else; rural youth and youth from Eastern Croatia wish to migrate to another place inside Croatia more than any other group, while all groups (except youth from Middle and Northern Croatia who want that somewhat more than others) equally (do not) want to settle abroad. Data on a desired place for living are quite similar to those on migratory plans. The number of youth preferring to remain in their present place of residence and the number of those having no migratory plans are almost identical. When compared to earlier studies, we see an increase in the number of young people preferring to live in large cities. In addition, almost one quarter express their preference for living abroad, majority of which opt for a Western European country. The fact that almost one fifth of all has plans and almost one fourth prefer to live abroad indicate the existence of two closely related but, nevertheless, separate dimensions of youth migratory thinking. While the preference for other counties may mean only an inclination, having plans on migrating abroad most certainly includes active search for such a possibility. In light of our findings it means that at least one fifth of Croatian youth not only dream of leaving the country but actually make plans how to make it a reality. Employed youth is far from being satisfied with their jobs. Every second confirms his or her disappointment. Approximately one fifth of both them and those that are still in the process of education desire jobs in the service or business sector; little less in number think of entering more creative and/or dynamic professions or professions related to education, health care and social services. This means that their professional aspirations are somehow higher that those of their parents, majority of whom have secondary school completed and are mainly employed as industrial, service and shop workers or clerks. Nevertheless, if their choices are compared to the structure of the employed force in Croatia and if we add to it a rapidly changing labour market in all transitional countries, their professional preferences seem rather realistic. This is probably why almost half of the young hold that their chances for getting a preferred job are high or very high. The data also confirm that their estimations are related to age and socio-professional status since pessimism increases with age (except for the university students) and is tightly linked to unemployment status. In any case, optimism prevails among the young and it, as well, may be linked to their strong motivation to succeed in life by relying on their own abilities despite unfavourable social and economic context in which they live. It is also possible, at least partly, that self-assurance of young people comes from positive educational experience. Over half of the young state they feel happy and satisfied when thinking of their schools or universities. However, it is not clear whether their satisfaction should be understood in terms of acquiring subject-matter knowledge and skills or in terms of developing certain personal qualities through participating in school life. Earlier studies on youth have proven that the young have complex relations towards education which are the outcomes of both institutional tasks and personal expectations. Moreover, our results document that feelings about school are correlated with sex and socio-professional status.Girls and university students, in general, are more satisfied with their education, while the unemployed are among the least satisfied. It is also possible that positive feelings about education also relate to school grades. Earlier studies have shown that female pupils receive somewhat better average scores than their male schoolmates, which may explain why girls have more positive feelings about school than boys. • On the other hand, it is clear that school is by no means a source of information about the events in the country and the world for young people since a great majority of them actually receive news through ordinary media (TV, radio, newspapers and magazines). Moreover, Internet has become an important source of information about the country and the world for approximately one fifth and over one fourth of them, respectively. This shift has to do with the fact that over two thirds of the young from our study are computer users and that more than half of them already have computer at home. It is, therefore, obvious that new information and communication technologies are becoming part and parcel of young people' s daily life what needs to be taken into account when policies and programmes of action for promoting their wellbeing are designed, especially in reference to underprivileged youth. Namely, our research confirms that the use of computer correlates with residence (urban environment), family background (parents with higher education and higher socio-economic status), age, and education factors (younger population and students). Nevertheless, young people are not enslaved by new information communication technologies. Most of them spend their free time associating with friends, engaging in sport activities, going to disco-clubs, watching TV or performing outdoor activities, while far less enjoy music, reading books or art exhibitions. In addition, many young people have no daily obligations, except in relation to school and spend their free time idling or sleeping. This means that the majority of youth either do nothing or engage almost solely in the so called passive and/or receptive activities for self-entertainment. Despite that fact, almost three fourths of them claim they are more or less satisfied with how they spend their free time what brings us to the conclusion that the main problem is not the quality of their free time activities but their lack of awareness that the quality itself is being at stake. However, it should be pointed out that their opinions are related to age and socio-professional status. Young people who belong to an upper age-cohort and who are unemployed exhibit far more dissatisfaction with their free time than the youngest. Overpronounced dissatisfaction among the unemployed seems to be an indicator of an overall discontent with one' s own life. For the unemployed, free time becomes a burden not only because they cannot perceive it in terms of an offduty activity but because they can not afford it financially. In reference to the use of psychoactive substances, it seems that tobacco smoking and alcohol consumption are the most widespread types of risk behaviour among the youth. Approximately one third of them smoke cigarettes or drink alcohol daily or weekly ; three fifths are non-smokers and one fifth never drink alcohol. Smoking increases with age and employment. Alcohol, on the other hand, is solely related to gender in a way that young women drink less than their male peers. Such trend may be the sign of a subtle male initiation rite de passage that has outlived its traditional context. Since the data on smoking are more favourable than those from earlier research it may be presumed that an anti-smoking media campaign, which has been going on rather aggressively throughout the country, has brought positive effect, whereas non-existence of similar anti-alcohol campaign may be the sign of a relatively high level of a social tolerance for alcohol consumption. As far as drug are concerned, Croatian youth is more inclined to the so-called 'soft' drugs. Over one third of the young have tried or used twice or more only marijuana ; hashish and ecstasy is mentioned by less than one tenth of them, whereas other 'hard' drugs have been only tried or are consumed by 1-3% of them. The consumption of marijuana is associated with a recognizable youth group, what confirms earlier studies. A group of highest risk is made of young people between 20 and 24, male, university students, the residents of Zagreb, Istria, Croatian Littoral and Dalmatia, and whose fathers have higher education level. A great majority of young people tend to see themselves in rather positive terms: they are self-assured, think they have a good number of personal qualities; believe in their capabilities when compared to other people and have no doubts that most people they know like them. This may be related to feeling of security they experience in the context of their immediate environment since a great majority of the young claim that they can almost always get warmth, care and support from their parents and support from their friends. On the other hand, only every second of them feel the same about their teachers. It seems that most Croatian families are characterised by an exercise of indirect and flexible control over their children in the course of their growing up. In over half of the cases parents or relatives hardly ever determine rules for their children' s behaviour although they do control the choice of their friends, as well as their evening outdoor activities. Moreover, young people claim that their parents are especially keen of their school progress since they almost regularly keep records on their children school situation. • When asked about the most serious problems of their generation, the majority of young people in Croatia mention socially unacceptable behaviour, such as drug abuse, alcohol consumption and violence, unemployment, low standard of living, the lack of life chances and mass migration of young experts abroad. Since unemployment was repeatedly displayed as the major problem of young generation in earlier studies, their present preoccupation with socially unacceptable behaviour may be related either to the sample structure (majority of them are students) or to a general social climate which is, due to predominance of media campaigns mainly geared against smoking and drug abuse (but not against alcohol consumption, except for safe driving), inducing an over-sensitisation to behavioural issues causing, on the other side, the lack of awareness of existentially important issues of young people that are of an utmost importance for their independence and self-satisfaction. Young people are inclined to attribute responsibility for solving these problems primarily to themselves, their parents and public authorities, i.e. firstly to those actors that function at the private level (personal and parents' responsibility), than to public sector (government, education system) and, finally, to the civil society (nongovernmental organizations, youth associations and religious institutions). This means that youth principally count on their personal strength and family support, as well as that they have explicit expectations of state institutions, whereas they think of receiving the assistance from the civil sector only exceptionally. Notwithstanding, since half of the young studied have failed to mention personal responsibility, it clearly demonstrates that both strong sense of self-responsibility and its avoidance stand side by side as two features of Croatian youth. Among the measures that Croatian youth see as the most efficient for solving their problems two are underlined: equal education and career opportunities, on the one hand, and strict punishment of drug dealers and restrictions on alcohol selling, on the other hand. Since the majority of youth consider socially unacceptable behaviour, including drug-addiction, to be the gravest problem of their generation, it is understandable that they see the way out in strict punishing of drug dealers, (rather than consumers), what is still inadequately determined by Croatian law. Other most frequently mentioned measure has to do with the youth quest for developing society of equal chances which is in line with their perception of unemployment as the second most frequently mentioned youth problem in Croatia. Although lesser in number, the young refer to their under-representation and require their participation in decision-making to be ensured at all levels. They also require better adapting of secondary and higher education to the needs of contemporary life, as well as better quality of education, in general; some speak in favour of establishing a ministry for youth affairs, developing national strategy for promoting youth well-being, setting up of funds for youth initiatives, better legal regulations of the places of youth entertainment, i.e., the issues majority of which have already been integrated into the recently adopted National Programme of Action for Youth that is seen as an initial step in developing a national youth policy. The values that the majority of young people hold personally important or very important are healthy environment, peace in the world, gender equality, and rights and freedoms of the individual. Second group of the most personally preferable values encompasses solidarity among people, social justice, economic security, respect for differences, rule of law, inalienability of property, civil society, free market, freedom of the media, protection of minorities, religion and democratic system. The bottom of the scale is occupied by social power, national sentiment, European integration, and high economic standard. The review of their preferences demonstrates a relatively respectable level of democratic potential of young people in Croatia. They are more oriented towards comfortable life based on key principles of democracy and civil society, which is in correspondence with earlier research that have documented the shift to a more individualistic value system, including youth' s preference for independence and their focus on self-realisation and material security. However, their relative devaluation of the importance of European integration may be, on the one hand, the sign of either their dissatisfaction with, or their criticism of the way new European order has been established, partly due to the fact that Croatia has been somehow unjustly left behind. On the other hand it may be the consequence of their perceiving the integration merely in terms of a political objective of which very little they experience in everyday life. This is not to say that they devaluate the importance of European integration for Croatia as such. It would be more accurate to say that Croatian young people are becoming more and more pragmatic in their social positioning of which many think not only in the context of Croatia but in the context of Europe and the world. Having in mind a long tradition of Croatian youth emigration to Europe and the fact that almost 20% of contemporary youth plan to leave the country for good (mostly for a European country), their relation toward European integration may mean that they see it only as an added value to an already established youth migratory pattern in Croatia. of young people about the determinants of upward social mobility in Croatia reflect their accurate perception of social anomalies that, if left unquestioned, threaten to deepen social inequalities and diminish democratic potential of the society. Namely, a great majority of the young see as important or highly important for social promotion in Croatia a combination of the following variables: adaptive behaviour, personal endeavour, knowledge and skills, and connections and acquaintances. University degree, money and wealth, and the obedience and submissiveness to the 'boss', are identified less but, nevertheless, reflect a combination of appropriate and inappropriate means of social promotion. Somehow more troublesome is the finding that one third to one half of the young consider belonging to certain nation or political party, as well as bribing and corruption as important determinants of one' s success in Croatia. These data present an index of youth's perception of Croatian society as the society of unequal chances since it, by allowing nondemocratic practice to play an important role in social promotion, actually discriminates against those who in this matter believe in, and rely on their own abilities and efforts. When compared to earlier studies, it is highly troublesome that almost the same factors of social promotion are estimated as important by both socialist and ' transitional' young people in Croatia. Overall examination of the above results may be seen as an indicator of a process of relative homogenisation of young people in today' s Croatia – certainly, within the issues here examined and at the present level of analysis. There is no doubt that young people here described have many characteristic in common, especially in reference to their marital status, family pattern, housing conditions, parent' s educational background, attitudes towards present and future life, professional and educational aspirations, desired accommodation, sources of information, satisfaction with free time, positive feelings about themselves, feeling of security in relation to their parents and friends, as well as in reference to their abuse of psychoactive substances. They also share their desire for autonomy and independence, and for the recognition by the society at large, as well as their dreams of a more just society in which life opportunities would match individual abilities and endeavour. When they differ, it is mostly due to their varied socio-professional status and age. Residential status, father' s educational background, gender, and regional background are less important. The tendencies that have been documented suggest that youth are divided primarily by their actual social status and stage of attained maturity, and only secondarily by socialization factors, such as social origin in a narrow and broad sense of the term, and a gender socialization patterns. However, further analysis of data should disclose youth dominating trends with more accuracy.

Contemporary Ukrainian state and society pass through complicated and contradictory period of transformation of socio-economic, political, spiritual and moral relations. The youth, as subject and object of policy, social and cultural relations, mirrors the features of Ukrainian political system's evolution and cultural evolution in its vital activity. The youth is an important part of Ukrainian society, the medium of its intellectual potential, a main factor of socio-economic progress. Process of state building largely depends on capability of youth to be an active creative power.Nevertheless, it should be noted, that significant part of youth has no reliable political and socio-cultural reference points, civic consciousness isn't formed, spiritual and moral ideals are lost, increasingly the youth regards with negative to socially useful activities and becomes most separated from society and state than previous generations.Meantime effective socialization of youth is a necessary condition for a constant development of Ukrainian political system, largely depictures the future of the country. Perspective of society's further development primarily depend on the features of formation of the political culture of youth, its political values, socio-political orientation, political choice, attitude to power.In this regard, necessity of studying processes, what spread across youth subculture, political analysis of youth subcultural differentiation, production technologies and mechanisms for prevention deviant behaviour and crises among young people, appears.The socio-economic and spiritual development of Ukraine is impossible without concentration on resolving the problems of the youth as future of our country, a guarantor of social and economic progress, because an immutable truth is that further development mostly depend on providing young generations with decent conditions for life. In despite of declared realization of this truth, a majority of countries in the world starts new millennium with a significant burden of unsolved problems of youth, most of them, for a example, imparity of youth, unemployment, marginalization of young people, propagation of illegal social practices and asocial manifestations among young people, youth health problems and some marital and family problems etc., now shows tendency to intensification.Under conditions of deep economic and demographic crisis, crisis of culture and ideology, of post-Soviet countries, including Ukraine, youth problems in different areas of life become more specific, they entail hard and prolonged consequences, therefore, they need be analyzed deeply and regulated, realistic and balanced youth policy must be developed.The term "youth" is treated diversely in many branches of science - philosophy, sociology, political science, pedagogy, psychology etc. Its generalized version is suggested in encyclopedias and determines the youth as a separate socio-demographic group that differs in a complex of age characteristics, features of social status, that are determined by social system, culture, regularity of socialization, education in terms of a particular society.The youth, within the meaning of current age ranges of youth in Ukraine (according to national legislation an age range of youth is 15 - 34 years), makes up the significant part of the population of Ukraine. Now the youth contingent in Ukraine is demographically heterogeneous, because the youth unites in itself groups of rather a broad age range – from teenagers (15-17 years), post teenagers (18-19 years old) to much more experienced in age and socially persons and adults, that are over 30 years old (30-34 years).It should be considered that the youth is socially heterogeneous. Yong workers, villagers, students, political leaders, representatives of the business community, migrants, young specialists, marginal people with different degree of success adapt to market economy, frequently orient themselves on contradictory political and spiritual values.The position of youth political culture, as well as society generally, is largely fragmented. The separate groups of the youth differ from each other in the interest to policy, level of inclusion in the political life, orientations on different ideological and political currents of modern Ukraine. All this differences haven't characterized as acute antagonism and haven't led to excessive politicization yet.The young people significantly differ from older generations, because they almost got rid of illusions that somebody can solve their own problems. They are individualistic and pragmatic, relate to the modern authority rather neutrally and don't connect any positive changes with it.The young generation perceives the policy and the authority as entity that cause neither admiration, nor especially acute negative emotions. First of all, it proves in removal of a large number of the youth from political life. In some measure apathy of youth, first of all, appears because the reforms that take place in Ukraine impact on the youth most painfully, and because of absence of understanding policy towards youth as an independent socio-demographic group, also because the youth, on the one hand, doesn't see necessity to change something cardinally in environment, but, on the other hand, doesn't consider political activity as something important, it finds most perspective methods and forms of self-fulfillment. As a result – total alienation of the youth from the authority, that can be transformed into active rejection at any time.Today state only declares principles of political culture of participation and public culture. During period of formation of the youth generation it is necessary to examine the situation, to explore the depth and sharpness of social problems, to establish monitoring of youth life.Modern problems such as crisis of relationship of generations, impairment of vital parameters, formation of specific youth subculture and counterculture etc., demonstrate that all structures of socialization together – family, environment and even education, become not enough to solve the problems of society when new generations come on and it is not enough to solve the problems of youth, that takes on its historical subjectivity.Liberal views of youth are often formed under the influence of education, cultural environment, family socialization, but are not the result of a «rational» choice. State youth policy, as an innovative Institute, has it own particularities and the main one of them is that it is specialized and was built on innovative forms of activity. These forms are associated with deep process of knowledge and management. They need political will and great resources to be realized. The payment for that are guaranteed results of activity, without what society can't exist and develop no longer.As a result of new situation, what appeared because political activity in labor and educational groups had been prohibited, the policy moved on from industrial and academic areas to the sphere of free time of youth and led new youth organizations on the competition with traditional structures of free time. The youth structures could gain neither recognition, nor authority on broad stratums of the rising generation.The perspective of further development of society connects, first of all, with features of the formation of political culture of youth, its political values, a socio-political orientation, political choice and attitude towards the authority.The formation of consciousness of the category of population is strategically important for the state, because working politically active forces will be replaced exactly by today's youth. Now it is hard to manipulate the young people, they are very sensitive and note everything that takes place in society. May be, some part of them go to policy in order to make money, but for the most of them is important to realize their own opinions.The current political situation in Ukraine makes the youth think about a lot of questions: how can I, young man, decide something and affect the situation in the country (the region); how much does my vote weigh in elections etc. One of the most important factors that can push these people into active public deeds is confidence of an opportunity that something can be changed by their choice and decision.The modern politicians come to understanding that the slogans are ineffective and the youth can't be conquered with appeals on TV. The new generation is more independent than previous one and, the most important of this, that it has a choice. The votes of youth will not be cast without any reason – someone must work with it. The experience of last decades proves that only when countries pay much attention on work with youth they will success in policy and economy. A sustainable progress is demonstrated by societies that have looked over the system of traditional opinions about new generation and it importance for political and socio-economical development (for example, Germany, Sweden).In Ukraine a program of state and public actions in this sphere and mechanisms of solving these problems is determined by modern national policy. The especial attention should be paid to solving problems of youth self-realization and formation of young citizens.There is 367 003 persons (30,67 percent of all population of the region) of young people from 14 to 35 years old in Mykolaiv, including citizens - 251 712 persons and villagers - 115 291 persons. The youth needs permanent protection and help of state. However to give support to the youth doesn't mean to solve all its problems. First of all, it means to give the youth an opportunity to solve problems by itself.The Regional Program "The Youth of Mykolaiv Region" on 2011-2015 years becomes a strategic document. The conception determines directions of relationship's development between the state and the youth at the regional level. The chief purpose of this handbook is to provide government lawyers with a framework to evaluate the quality of a country's investment legislation (if it exists) and how the legislation relates to its investment policy and investment incentives. More specifically, it deals with creating new and reforming existing investment legislation in developing and transition economies in furtherance of the World Bank Group's (WBG's) mandate to promote private investment - domestic and foreign - in those economies. Handbook appendices contain drafting guidelines and checklist of issues that foreign direct investment (FDI) laws should include and that countries can use when drafting investment legislation. The report is structured as follows: chapter one defines key terms about investment law reform in an effort to clarify terminology and concepts and show how they are related. Chapter two examines how widespread investment codes are and explains their utility and limitations. Chapter three provides recommendations on the structure of investment legislation and the key provisions to be included such as definitions, investors' guarantees, incentives, framework for investment promotion, and transitional provisions. Chapter four discusses the fundamental issue of investor entry, in particular the conditions under which foreign investors can invest including sectoral restrictions, limitations on foreign ownership, authorization and screening, minimum investment, and performance requirements. Chapter five discusses key investor guarantees including fair and equitable treatment, national treatment, most-favored-nation (MFN) treatment, protection against expropriation, guaranteed convertibility and repatriation of profits, and settlement of disputes. Chapter six looks at the issue of investment incentives, (fiscal incentives in particular) and their effectiveness. Chapter seven summarizes key aspects of investment promotion to guide legal drafters, should policymakers want the investment code to set out the basic framework of investment promotion. Keywords: CARICOM, French for international trade, international conferences, Language for Specific Purposes (LSP), methodology Introduction Language for Specific Purpose (LSP) has developed with the expansion of international trade and the development of multilingual and multicultural working teams. Short language courses are designed at the request of enterprises or institutions in order to meet the specific demands related to the work environment. Though LSP courses have been in existence for more than three decades, their introduction in the academic programs of language majors is quite recent and has been a hot debate for several years at MLA and ADFL meetings. In the Caribbean, with the development of integration, the need for LSP has been felt as the CARICOM (Caribbean Community) started to look beyond the English-speaking Caribbean and opened itself to non-English-speaking territories (Surinam and Haiti joined the organization in 1995 and 2002 respectively while Cuba and the Dominican Republic have observer status). These political trends impacted on our foreign language offerings, stressing the need to open our curriculum to professionally oriented courses. The Department of Modern Languages and Literatures and the language sections of the two other campuses TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 74 had various responses: at the St. Augustine Campus (Trinidad and Tobago), a Latin American Studies program was developed; at Cave Hill (Barbados), a cross-faculty program in Management Studies with a minor in a foreign language was approved; at Mona, LSP courses were developed and students from other faculties were allowed to declare minors in French or Spanish. In this article, we present the circumstances surrounding the design of the latest addition to French for Specific Purpose courses offered at the University of The West Indies, Mona (UWI, Mona), the methodological choices made and their implication for assessment. Because the course has been offered twice since its approval by the University Academic Quality Assurance Committee and with two different schedules, we will compare and discuss these two delivery modes. Language for Specific Purpose at the UWI, Mona At the UWI, Mona, the introduction of French for Special Purpose came out of a pragmatic approach at a time when high schools were experiencing a high turnover of French teachers and a reduction of schools offering A-level French (equivalent to the Baccalauréat). Noting that our graduates were being hired in the insurance and tourism industries, it was thought that equipping them with professional language skills would give a 'practical' touch to our program. The recruitment of a colleague with professional experience in translation led to discussions about a more professionally oriented program. "French for Business" was the first LSP course to be designed in 1991–1992 with the creation of a level III course of French for business or "Business French." The course was developed as an elective in response to a situation in which French graduates were moving toward the business sector instead of education. In the subsequent years, other LSP courses were introduced: "French for Hospitality" in 1998–1999 and "French for International Conferences" in 2003. The introduction of this last course coincided with a drastic overhaul of the French curriculum. The offering of "French for International Conferences" came at a time when the French section of the Department was repositioning itself and revising its offerings. The course was designed with a view to attracting International Relations (IR) students while capitalizing on the latest trend in French foreign language teaching methods. The decision was based on the fact that IR majors and French majors minoring in IR outnumbered students majoring in French only. It was taken at a time when the section was going into a survival mode, taking drastic measures and moving away from the traditional language curriculum (36 credits equally divided between language and literature). The section opted for a mix of language, literature, film and culture, and French for specific purpose courses. It was a drastic choice since the section was moving away of the traditional literary offerings. Though the section has not fully recovered, it has increased its numbers and the majority of students pursuing French are double majors (French and Spanish) with a professional objective of becoming translators or interpreters, followed by IR and Linguistics majors. Total Simulation in French Foreign Language Teaching and Learning Even though Total Simulation in French Foreign Language Education was initiated in the 1970s at the BELC (Bureau d'Enseignement de la Langue et de la Civilisation Françaises à l'Étranger / Office for the Teaching of French Language and Civilization TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 75 Abroad) it did not really become mainstream until the late eighties. This approach to language teaching evolved from role playing and the need to expand role playing over a longer period of time with a view to involving diverse aspects of communication (Yaiche, 1996). Total Simulation was borrowed from continuous professional education where staff received specific training to deal with job-related situations. Total Simulation for French Foreign Language Teaching was first conceptualized by Francis Debyser, a professor at the CIEP (Centre International d'Études Pédagogiques / International Center for Peda-gogical Studies). In the 1980s, Total Simulation became more broadly accepted and moved from experimental to established status. Publishers become interested and several textbooks were published by Hachette between 1980 and 1990 (Yaiche, 1996). By the 1990s, Total Simulation was redirected toward the teaching of French for Specific Purpose (Business French, French for International Relations, Hospitality French). Total Simulation benefits today from IT and its use in the classroom. It is still at the experimental stage as is the case of 'Virtual Cabinet' for the teaching of English, which has been developed by Masters' students at University of Lyon II (http://sites.univ-lyon2.fr/vcab/demo/) or 'L'auberge' developed by University Lille III for incoming French Foreign Language Students (http://auberge.int.univ-lille3.fr/). Characteristics of a Total Simulation Course in Foreign Language Learning Total Simulation in Foreign Language Teaching and Learning could be considered revolutionary in its approach and methodology. First, the role of the teacher is transformed as he or she becomes a facilitator and a participant in the simulation instead of an instructor. For instance, in the International Conference Simulation, the teacher plays the part of the Secretariat. He or she compiles and archives the material needed for the progress of the conference. He or she also provides documents and the linguistic tools needed for the project. Secondly, simulation follows a set pattern of five stages (See Bourdeau, Bouygue, & Gatein, 1992; Yaiche, 1996). The first stage is the creation of the setting. In the case of the International Conference, it means, choosing the theme and the place of the conference. The second stage is to identify the participants. At this point, the role playing starts as the learners have to choose an identity and the country that they will represent. Learners will have to play several roles: delegates from their chosen countries (Minister of Foreign Affairs or High Ranking Civil Servant or Ambassador). At one point, they also play the part of journalists. The countries are fictitious but based on the characteristics of real countries. During this stage, learners choose their identity and civil status; they invent a short biography indicating two physical, moral, psychological, intellectual characteristics, two distinctive objects, (Yaiche, 1996). The third and fourth stages consist in conducting the simulation: the official opening ceremony and the working sessions. At this point, learners are to present their country's respective position paper. Interaction takes place as well as negotiations for a common position and action plan. During this stage, the facilitator plays an important part in ensuring the archiving of all productions and the elaboration of a data bank for the progress of the conference. Students are provided with documents and assisted in acquiring the mastery of the linguistic tools needed for the exercise (e.g., mastery of high language register for official speeches; mastery of diplomatic lexicon for the phrasing of the final resolution and the press release, TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 76 ability to write an abstract or a synthetic report from a news article, etc.). The final stage is geared toward ending the simulation. In the case of the International Conference, it is marked by the writing of the final resolution and a press conference. Since IR students are to be prepared to face and manage diplomatic incidents/crisis during negotiations, elements that could lead to such incident are introduced between the fourth and fifth stage of the simulation when students are drafting the final resolution of the conference. Students are expected to draw on their negotiating skills in order to solve the problem or assuage the potential conflict and bring the conference to a positive closing ceremony. Assessment is blended in the simulation: oral expression is assessed during the opening ceremony (a five-minute presentation) and during the press conference. Students are video recorded and marking takes place afterwards. (See evaluation sheet in appendix B). Both examiners are present to abide by University Examination Regulations. Writing proficiency is assessed through a press release and the conference final resolution, which is done individually during a traditional in-class test. It is also assessed 'outside' of the simulation through the submission of a take-home assignment, the format of which is either a précis writing or a critical review of a newspaper article related to the theme of the conference. Students are provided with a choice of articles from Le Monde Diplomatique, a well-established and recognized reference journal from which they will select an article for review or summary. LSP and Total Simulation in Jamaica and at the UWI, Mona French teachers in Jamaica were introduced to Total Simulation in 1993 thanks to a new French Linguistics Attaché who was also appointed at The University of the West Indies from 1992–1997. A specialist in Total Simulation, she organized two workshops for the Jamaica Association of French Teachers and one for the Tourism Product Development Company (TPDCo), a Jamaican state agency responsible for the training of the workforce in the tourism sector. The co-authors received additional training at the annual training seminar organized by the Centre International d'Études Pédagogiques (CIEP) held in Caen in July 1996 (Nzengou-Tayo) and July 2009 (Lubeth) respectively. The first total simulation course at the UWI was developed in 2003. Two factors contributed to the choice of this methodology. One was the renewed interest in LSP with the review of the French program. After a quality assurance review in 2003, the French section, threatened by low numbers in registration, revised its program with a stronger professional component (introduction of an additional LSP course and translation modules). The second was the institutionalization of summer courses, which offered the possibility of using an intensive format. The idea was to design a course that could imitate a real life situation: an international conference taking into account that such an event is usually limited over a period of time (1–2 weeks) and requires a full work day. The course was submitted to the University Quality Assurance Committee for approval (See course proposal in Appendix A). In the initial submission, evaluation was by 50% coursework and 50% final examination (Appendix A). However, when the course was first taught in 2006, we requested a change of the evaluation scheme to 100% coursework (50% oral presentation and 50% written assignment). The reason for this change was directly related to the philosophy behind total simulation, which required a formative form of assessment that would blend seamlessly in the simulation. TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 77 Case Study: The 2006 and 2009 Experiences Since its creation, French for International Conferences (FREN 3118) has been offered twice: first, in 2006 as an intensive summer course over two weeks, and secondly, in 2009 as a regular semester course over thirteen weeks. These two modes of delivery will be compared and discussed in this section. Course delivery schedule. In 2005–2006, during the two-week period during which the course was offered, the timetable averaged 25 hours per week with 5 daily contact hours. FREN 3118 was the only course attended by the students. Students were put in an immersion situation as they interacted with a native speaker of French during the week. During the second week, ten hours were set aside for independent research in an attempt to give students an opportunity to develop learning autonomy. In 2009–2010, the course was taught during the first semester according to the regular schedule. The timetable featured 3 one-hour sessions per week. In addition to FREN 3118, students were simultaneously registered for four other courses whose demands were competing with the French course. The fast pace of the semester (13 weeks) did not allow for a scheduled independent research. Students had to use their free time for independent research to develop their learning autonomy. The difference between the schedules of the 2006 and 2009 course delivery had an impact on the course management as well as the students' learning experience. It is evident that 2009 students did not have the same learning stimulus as the 2006 ones. They had the pressure of their other courses in term of time and workload. In addition, regular attendance was an issue since students sometimes missed classes either due to timetable clashes or assignment deadlines to meet in other courses. The running of the course was affected as each student had a part to play in the progress of the simulation and absence from class meetings affected the proceedings of the conference. Student profile and number. The course targets third-year students and requires a general language module at level III as a co-requisite. However, the co-requisite can be waived depending on the level of the students. For instance, when the course was offered during the summer 2006, it was waived for second-year students who had received a B+ in the two modules of the level II language courses. In 2009, a third-year International Relations student who had completed level I of the French language courses with A and was reading the level II language course was allowed to register. The waiver was granted based on his outstanding results at level I and also after an interview in which he demonstrated a high level of motivation and learning autonomy. In 2006, the course was offered with 9 students and in 2009 there were 14 registered students. Numbers can be an issue for conducting a total simulation course. For instance, our experience taught us that, even though Cali, Cheval, & Zabardi (1992) suggest a number of 20 participants divided according to a ratio by type of countries1 in La Conférence Internationale et ses Variantes, country-ratio balance can still be observed TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 78 with lesser numbers. Based on our 2006 experience, we recommend a minimum of 8 students. Indeed, a lesser number would not allow their distribution according to the recommended country ratio. In addition, work in commissions, which is part of the simulation process, would be less productive. Similarly, 20 is the maximum manageable number of students during total simulation. The attention to be devoted to students' progress and the group dynamics become a challenge with larger numbers. Therefore, beyond 20, the group would be divided and two concurrent simulations conducted, provided that staffing is not an issue for the institution. Topics and scenarios. On both occasions, the theme of the conference was inspired by current affairs relevant to the Caribbean region. In 2006, the conference was titled "Libre circulation des travailleurs à l'échelle mondiale: Faisabilité et conditions" (Feasibility and Conditions for a Global Free Movement of Labour). The theme was inspired by discussions taking place in the media about the Caribbean Single Market and Economy (CSME) put in place by CARICOM countries that year. The scenario was developed to involve a group of 9 countries, members of a regional organization seeking to achieve integration through free movement of workers. The 2009 edition of the conference, "Réchauffement climatique: Stratégies et équité" (Global Warming: Strategies and Equity) was inspired by the then ongoing international negotiations on global warming. The course started in September, just three months before the Copenhagen Summit. The scenario was based on the creation of an international organization, the Group of 14 (G14) specially dedicated to addressing the issue of global warming, and therefore holding its first conference accordingly. The choice of topics related to current international or regional issues stimulates the students' interest as they can have access to current reference material. They develop their critical thinking as they are exposed to various diverging opinions and asked to present their country's position at the start of the conference. For example, at the 2009 conference, the delegate of "Bonangue" expressed the country's position as follows: Conscient des graves effets [du réchauffement climatique] sur l'environnement, nous tenons à prendre action immédiatement parce que les effets poseront un problème pour le pays. Par le passé, la Bonangue a donné priorité aux revenus, dans certains cas, au détriment de l'environnement. Le pays est disposé à porter [sic] les changements nécessaires. The delegate of "Kalasie," on the contrary, indicated, "La Kalasie est favorable au recours aux crédits d'émission de gaz utilisables par les investisseurs." Another delegate from "Lisérbie" chose to stress the social impact and the importance to reach a consensus on the matter. The multiple and sometimes diverging country positions will contribute to the life of the conference as the objective is to find a common ground and sign a final resolution, which would bring the conference to a close. TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 79 Resources and methods. The course outline was developed in accordance with the prescribed textbook La Conférence Internationale et ses Variantes (Cali et al., 1992). The authors' recom-mendations were followed with some adjustments, which will be presented below. Since countries have to be fictitious to respect the principle of Total Simulation, two websites, CIA: The World Factbook, and Quid were used to establish the profile of these invented countries.2 Using the principle of 'mots-valises' students invented the name of the countries they were representing. For instance, "Lisérbie," "Kalasie" or "Dukenyah" were obviously created in reference to existing countries or regions. Other names were arbitrary and left to the students' imagination as "Cadeaux d'Ouest," "Amapour" or "Kadia." Other web resources were used in accordance with the theme of the conference and a companion website was developed on the University Virtual Learning Environment (OurVLE) (UWI, Mona "Virtual Learning Environment") to take advantage of information technology at our disposal at the Mona Campus. The 2006 intensive format. We introduced some slight variations from the standard format of the simulation. First, the course started with a screening of the French movie Saint-Germain ou la Négociation (2003) with Jean Rochefort. The objective was to highlight the objectives, modalities of diplomatic negotiations as well as to insist on the high-language register used during negotiations, which the students would have to use. Despite the historical context (the 16th century), the film was particularly suitable as it showed protocol and behind-the-scene events taking place during political negotiations. Secondly, students were given an introductory lecture on the processes of international conferences coupled with a tour of the Jamaica Conference Centre in Kingston. This was facilitated by a colleague and professional translator who worked at international conferences and was familiar with the facility. Various documents were made available online on a range of topics: international organizations pursuing regional integration through implementation of free movement of labor (the European Union, CARICOM) and a compilation of documents on immigration and globalization. In 2006, the course page on OurVLE was used only for archival purposes. The instructor, playing the part of the conference Secretary, uploaded for future reference documents that had been identified as relevant to the conference. Since the students' time were dedicated to the course, it was easy to simulate the rhythm of a conference with meetings in commission and plenary sessions. The course outline was design to be the "agenda" of the conference. The intensive format helped to develop a group dynamic based on solidarity and conviviality, which stimulated weaker students to make efforts to improve their proficiency. The 2009 semester-long format. The semester-long delivery of FREN 3118 differed from the intensive summer course on some points. The presentation by the guest lecturer and the film screening were maintained, but, due to timetable constraints, the tour of the Conference Centre did not take place. The main innovation was in the extensive use of the online module and the exploration of the functionalities offered by the Moodle platform supporting OurVLE TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 80 where all the material necessary for the presentation of the theme and the conduct of the activities of the conference were uploaded. All documents were made available online via OurVLE, expanding from print and website links to audio and video. Students' productions were added to the resources identified by the instructor. The instructor/facilitator provided the following resources: explanatory documents on global warming (its geopolitical implications and the negotiation process); documents with terminology used in diplomatic language; and audiovisual documents from France2, France3, and YouTube. A link to Yann Arthus-Bertrand's documentary Home (2009) was also put on the course portal. As Secretariat, the instructor/facilitator uploaded reports of sessions held during the preparatory phase (the preconference meetings). These reports gave students a regularly updated overview of progress made, a review of notions covered as well as the calendar of events (the schedule of meetings). Using the functionalities offered by Moodle, students were able to contribute to the development of the course portal. Using the 'upload a single file' and the forum features, they uploaded their own production, including country and delegate profiles, reports resulting from the sessions in commission and plenary sessions, and draft resolutions. The course portal was useful for archiving the various activities conducted during the course. Students were able to refer to a central repository outside of the contact hours. This tool also had financial and ecological benefits as it reduced the cost of photocopying. Indeed, whereas all documents had to be printed in 2006, only documents produced during the conference (student-generated commission and plenary reports, agenda and list of speakers) were printed for circulation in 2009. Because of the discontinuity of the timetable (3 hours spread over 13 weeks), the 2009 conference did not flow as harmoniously as the 2006 one. With competing interests, students found it difficult to dedicate themselves to the conference. Running from one class to another, they sometimes lost track of the conference objectives, which in turn had an impact on the group dynamics and progress as indicated by the results of the continuous assessment (i.e., the coursework). Evaluation and students' results. As mentioned earlier, the course assessment was done by 100% coursework. The percentage was equally divided between oral and writing proficiency (50% each). Oral proficiency was assessed as follows: delegate's address at the opening ceremony weighting 25%; delegate's interview at the press conference (15%); and one intervention as a journalist interviewing the delegates at the press conference (10%). Writing proficiency was assessed through a press release (10%), an individual proposal for the final resolution (15%), and one précis writing/critical review of document(s) (25%). Students' oral and written productions were graded using a criterion-referenced assessment grid (See Appendix B for details). In 2006, we got a 100% pass rate with results ranging from A+ to C. In 2009, the pass rate was 71.42%. With the intensive format, students demonstrated their mastery of high-level register. Students who were considered 'weak' based on their low grade in the general language courses, managed to improve their proficiency level and achieve acceptable performances in oral presentations. In 2009, there was a large gap between the TOTAL SIMULATION IN TEACHING LSP Scholarship and Teaching on Languages for Specific Purposes (2013) 81 best and the weakest students (2 students got As, 4 students failed, and 8 students' grades ranged from B+ to D). Group average was 49.79%. When comparing the two groups' results, we have to admit that we had some doubts initially about the intensive format because of the limited time given to students to properly absorb the notions and the various tasks required in the course. Yet, it appears that stretching the process over a semester is not a decisive factor for improved performance. The role of group dynamics in total simulation is yet to be measured though it is generally recognized in class interaction and learning. During the regular semester, the group dynamics did not play a cohesive role as it did in the summer course where more proficient students helped to strengthen the weaker ones. Competing academic interests and irregular attendance during the regular semester also had an impact on students' low performance. Conclusion At the UWI, Mona, we introduced LSP courses in our academic programs as part of our major from a pragmatic standpoint in reviewing our curriculum. Though we are aware that LSP courses generally target professionals already in the field, as a result, the design and offering of such courses is usually preceded by a need analysis and the identification of the language processes (i.e., register, lexicon, syntax, speech acts) needed to achieve the requested proficiency (Mangiante & Parpette, 2004). Both "Business French" and "French for International Conferences" count toward the major, though only one can be taken as a core course, the other being an elective. Because LSP courses have a professional orientation, they give undergraduates the impression of being prepared for the world of work. The use of total simulation comforts this impression because of its task-based approach and the fact that it recreates a work environment with its idiosyncrasies. Combined with information technology (OurVLE), it becomes an original and valuable method. The dual-mode adds flexibility to the course and expands access to authentic material. However, success depends heavily on students' learning autonomy, which is enhanced by a tool like OurVLE. Motivation and participation are essential for the success of students as evidenced by the results of the third-year student who was accepted while doing the first module of level II French and was one of the top two students in the course. Our experience suggests that the intensive format yields better results because it reinforces student concentration, dedication, and performance, which also benefit from the positive impact of the group dynamics. Recent development in the field shows an orientation toward multimedia and information technology to create virtual worlds where Total Simulation is made possible on a large scale. The combination of the two is very promising for language learning and teaching but presents new challenges to foreign language teachers and course developers. 2012/2013 ; There is an increasingly widespread acknowledgement among all active actors in the development co-operation sector that the Public Private Partnership (PPP) can be a new important tool, not only to build important infrastructure (public works) but also to provide services to the citizens at central and local level as well as to have a strategic value in the Cross-Border Co-operation (CBC) in the next future. The European Commission defines PPPs in a rather broad and general way without giving a proper legal definition of this partnership. For the EU PPP is a form of cooperation between public authorities and economic operators concerning design, funding, execution, renovation or exploitation (operation and maintenance) of public infrastructure, or the provision of public utility service. However, there is not a uniform, common definition of this form of partnership. Considering the present global economic and financial crisis affecting almost all the regions of the world and bearing in mind that the public resources destined on development cooperation are decreasing more and more, building partnerships and synergies between these two ranges of actors is not only a great possibility but a compelling necessity in order to continue to sustain the development cooperation sector. This is also a good chance for both public and private sector, not only to mutually reinforce each other but also to learn lessons and best practices from one another. The PPPs, in fact, if applied correctly, enable a reduction in total costs, better distribution of risks, a more rapid execution of public services and activities, as well as a better quality of offered services and implemented activities. Not to mention the fact that the overcoming of the rigid distinction between public and private opens the possibility to find solutions and to respond to questions that the public administration itself is not able to answer independently. In international cooperation and in particular in the cross-border cooperation, more and more public administrations in beneficiary and donor countries are acknowledging the subsidiary role of civil society and private sector in the activities of general interest, and therefore, also in the delivery of public functions and services. Considering the extensive work experience in the international development cooperation sector with the Italian Ministry of Foreign Affairs and other International Organizations in different areas in the world, i.e. OSCE, believing on the utility and potentiality of this instrument and directly verified that it could be more utilized in the international cooperation, it was decided to analyse the use of PPPs in this sector with a special focus on IPA CBC Programme. In fact, the scope of the dissertation and of the implementation of its conclusions is steaming from the author interest and working ties. Indeed, the author is living and working in Albania and has a huge experience on it due to the fact that she was the Albania Desk Officer for the Italian Development Cooperation for several years. She is also studying the Albanian language and she is very fascinated from the history of this small country so close, not only geographically speaking, to Italy. The focus on Macedonia as neighbour country is due simply to the fact that to collect information on this IPA CBC Programme was easier than others similar financial instruments. Building on extensive field experience, this dissertation will try to answer the following question: 'Which is the winner strategy to increase the effectiveness of the CBC projects through the use of PPP?'. The thesis overall objective is to identify a set of strategies that can enhance the effectiveness of cross-border cooperation through the use of the PPP instrument, beyond specific cross-border project interventions that until now have mainly been carried out though institutional channels and implemented through European projects and programs. The strategies that the conclusion of the dissertation draws are based on the SWOT analysis of five projects funded by the EU through the IPA CBC Albania – Macedonia during the 2007-2013 programming period and the consequent elaboration of the results. These strategies would hence open up new possibilities for the development of CBC's activities applicable in the ambit of the EU's regional policy 2014-2020, without necessarily relying upon more EU financial means. This is also in line, with the EU auspices for the CBC not to be just another way to access funding but rather to become a model of cross-border cooperation sustainable on its own devise. The dissertation is based on collection and analysis of data available within the existing legal-institutional framework and will make use of the investigative qualitative method with the aim of verifying the hypothesis mentioned above. The thesis envisages a number of working phases chronologically distinct and mutually supportive and it is based on the utilisation of a number of diverse theoretic constructs and methodologies. The dissertation makes use of different sources such as for instance existing literature, statistics, on line documentation available and its content is conducted on the various official documents and projects documentation obtainable. The results are cross referenced and presented based on a SWOT analysis and process of data/results interpretation. As far as the structure of the work is concerned, the first Chapter, after an analysis of the theoretical tools supporting PPP, presents a background and an overview of the PPP in Europe, and the way it is applied in the context of international cooperation and cross-border cooperation; this is to understand how it was established and what its original objectives were, and to explain its evolution up to now. In particular, the chapter after shows that PPP was born in '30s mostly linked to the energetic and mining sectors, it presents that PPPs are growing and are seen as an important instrument of economic and social development also in the international and cross-border cooperation. It is seen that an instrument which opens the way to potential PPPs is the Inter-Municipal Cooperation Instrument (IMC) which permits to bridge the gaps in the municipalities and make them stronger also in applying to donor funds. Through this instrument established by the Council of Europe (CoE) the municipalities can also sub-contract a private company or creating an IMC entity constitutes a viable market attracting private investors. PPP is also encouraged by United Nations (UN) since 1999 through the 'Global Compact' project and different are the example of PPP around the world established by various UN Agencies. It can be affirmed that PPP is considered useful in the public sector also because can contribute in solving difficulties caused from public balance cuts as well as to overcome the bureaucratic and the scarcity of technical and management competencies of the public administration. The PPP is therefore an actual, innovative and complementary instrument to promote development, reforms as well as investments, policies and good practises in different sectors including the development cooperation also at trans-border level. Therefore, thanks to PPP it can be affirmed that the private sector also has become at all its effects a privileged actor of the international development cooperation. The second Chapter of the dissertation analyses the European Policies interconnecting PPP and their related instruments, as well as more in detail how these policies have applied PPPs in the cross-border cooperation as well as how CBC became more explicit in the EU context and in particular in the context of the stabilisation and association processes. In fact, starting from the 1950 Schuman Declaration, the chapter introduces the founding EEC Treaty, examines the Single European Act and analyses the European Cohesion Policy (or Regional Policy). In addition the chapter views the European Enlargement Policy (Pre-accession Policy) analysing the three membership criteria established during the Copenhagen European Council in 1993, the various stages of the membership process and the reasons for further enlargement taking into consideration the historic enlargement of 2004, the different strategic objectives involved in it and its new approach in view of the so-called Arab Spring. In addition, the chapter analyses the European Neighbourhood Policy (Proximity Policy) as well as its related instruments, with regard to both its partner countries and candidate states. Moreover the chapter identifies the possibilities of PPP within the EU's financial instruments that are currently being concluded. Even where those policies do not provide explicitly the adoption of PPP instrument, it is however not excluded. This means that the policies at issue give valuable support to the adoption and use of PPP. The dissertation is interested in to give evidence of the strong points of PPP application, and shows that, when there is a lack of applied PPP framework, as it is the case of the country cases (Albania and Macedonia) under analysed, the CBC component of IPA programme may be due not to give envisaged results to achieve the objectives. After having looked into the European policies intersecting PPPs and CBC, the third Chapter introduces a brief analysis of the concept of border, not only in the physical administrative sense, due to the fact that this concept is a key element to understand the cross-border co-operation processes existing in the EU and in general all over the world. With this aim in mind, after studying the main theoretical approaches on this domain, the analysis focuses on the cross-border co-operation not only in its theoretical dimension but also in its deriving pragmatic aspects. The analysis of the border concept and of the border and peripheral area, as well as the general theory of the system applied to the general theory of boundaries, is essential to anticipate the concept of the cross-border cooperation and its practical application. After this analysis, the chapter describes the legal institutional framework in order to analyse the effectiveness of the various legal instruments that have been put in place to encourage and facilitate forms of cooperative engagement across borders. Starting with the European Outline Convention of Transfrontier Co-operation between territorial communities or authorities (Madrid Convention 1980), a central instrument for the CBC that was born in the frame of CoE, the chapter introduces the three protocols of the Madrid Convention. The additional Protocol essentially gives the possibility to create an organism for cross-border cooperation; the second Protocol (no 2) provides above all a legal framework for the inter-territorial cooperation between the parties; and the third Protocol (no 3) concerns the possibility of forming the ECG by creating the legal status, the institution and the functioning of such Groups. In addition, in view of how cross-border cooperation has acquired more importance through time, the chapter explains the functioning of European Grouping of Territorial Cooperation (EGTC) institution, its modality of action and its fields of applications. The EGTC has come to be a new legal/financial instrument that integrates the Madrid Convention and the relevant Protocols. The chapter also touches upon the various aspects of cross-border co-operation and in particular some milestones from the EU experiences, and presents the European Macro-Regional Strategy and its related legislative framework as an example. In addition the chapter shows the Baltic, the Danube and the Adriatic – Ionian Macro-Region and describes the main differences between EGTs and Macro- Regions. In addition, the chapter considers appropriate to present the steps that have been taken from the EU with regard to the cross-border cooperation which, more particularly, have consisted of making available important financial instruments such as INTERREG that supports from the top to the bottom the Strategy of Macro-Regions. Following the fourth Chapter describes the 2014-2020 EU's Regional Policy as the context of application of the PPP and its change with respect to the 2007-2013 EU's Regional Policy. In particular after introducing the EU programming period 2007-2013 and the changes intervened in the following programming period also having a political/historical nature like the Arab spring and the interests to further develop economic interactions between the EU and the Middle Eastern partners, the chapter analyses the useful instruments for the realization of the cross-border cooperation; especially the European Regional Development Found (ERDF). In addition, this chapter, will identify the possibilities of PPP within the financial instruments that are about to be activated in the new European Programming Cycle. To this regard it is important to mention that, in general, all the EU policies must contribute to the implementation of the Europe 2020 Strategy that in order to fulfil its ambitious objectives identified as key instrument the instrument of partnership, among which that with the private sector. Here it is worth to emphasize that, generally, the overall objectives of the regional policy, both at national and European level, are all of an economic nature, i.e. increasing the national economy by attenuating and eliminating economic disparities between different development levels of the regions. In particular, the European Policies aim to improve the investment climate through public investment in the regions presenting some gaps and to manage the local regional resources in a more efficient way. The dissertation shows how in both cases, PPPs can help in the achievement of these important aims. In addition, the chapter observes that there are changes in various aspects and procedures of the implementation of the new regional policy as well as in the legal frame, and examines the IPA instrument and the ENPI instrument in the two seven-years programming periods because they are closely related to the European Territorial Cooperation (ETC). Between this two latter instruments IPA is a more relevant for this dissertation. For this reason, after on overview of the Albanian context considering some economic, demographic, social and political aspects, including the criteria Albania has to fulfil to receive the candidate status from the EU as well as a brief introduction to the Albanian Law on PPP, the fifth Chapter presents its relations in the region, especially with the Former Yugoslav Republic of Macedonia (FYROM) and stresses the IPA CBC Albania – FYROM related to 2007-2013 and 2014-2020 programming periods. In addition, the chapter presents the main differences between these two programming periods focussing mainly on the Albanian part. With the aim to focus on the Albanian opportunities in the new programming period, it will be stressed what will change in the next future and which are the positive effects on PPP considering also the concept of Social Corporate Responsibility and the UN Global Compact initiative already mentioned in the first Chapter. All this to introduce the last Chapter which, through the analysis of the methodologies used during the various phases of this work, and especially through the explanation of the SWOT analysis, aims to identify a set of winning strategies to increase the effectiveness of the Cross-border cooperation through the use of the PPP instrument. The first part of the dissertation made use of several documentary sources, most notably and especially in the early stage the work will carry out what it is commonly defined as a secondary analysis, in particular this was articulated through: collection and review of existing literature and of the official documentation and statistics available mainly on-line but also with the Albanian Ministries and national institutes, i.e. the Albanian National Institute of Statistics, as well as with the various donors and international organisation in the Country, and especially with the Delegation of the European Commission to Albania. Instead, the second part of the dissertation focuses on the analysis of the IPA CBC program in general, and IPA CBC Albania - Macedonia in particular. To this end it was decided to proceed with the analysis of specific projects activated in the context of this program to highlight the role of actual or potential PPP projects in developing virtuous CBC. Although the PPP is not explicitly defined among the tools used in the implementation of these projects, it was decided to identify the prodromal factors present in some PPP projects with the end purpose of assessing their potentials, especially in view of the next programming period of the EU (2014-2020). The detailed information on the projects carried out or that are in progress are not publicly available as they are under the 'ownership' of the Delegation of the European Commission in Albania and of the Managing Authority of the program. In order to collect the necessary materials to identify the most relevant projects and, subsequently, to proceed to their analysis, it has proved necessary to proceed through in-depth interviews with qualified actors. Given that, interviews have been conducted with interlocutors, mainly from the European Commission in Albania, the Albanian Ministry of Integration and of Austrian Cooperation. Through these interviews, specific information relating to five concluded projects, in which the instrument of the PPP was present at least in embryonic form, has been added to the data relating to the context and to the program. The information gathered has been structured so as to proceed to a qualitative analysis of the data through the development of a SWOT analysis of these five projects funded by the IPA CBC Albania - FYROM - First Call for Project Proposals. Finally, this work presents the results of this analysis through a process of data interpretation. After this presentation, and before starting the SWOT analysis, the chapter presents the Annual Work Programme for Grants 2009 of the DG Enlargement related to the first Call for Proposals and the Guidelines related to the CBC Programme Albania - FYROM which aims is to facilitate the cooperation between the two countries to improve living conditions in the target area. The Programme in fact, already mentioned in the fifth Chapter, it aims to fostering cross-border economic, environmental and social development and includes three different measures and for each measure a list of potential activities for projects. Furthermore, the chapter analyses - through the SWOT analysis above mentioned - five projects funded by the EU within the IPA I CBC Albania – FYROM first call. In particular, in this dissertation, the SWOT analysis is the tool to identify the strengths (S), weakness (W), opportunities (O) and threats (T) that characterize projects which are analysed in relation to PPPs. In other words, it seeks to identify the strengths and internal resources of projects capably to push the development of PPPs (strengths), as well as the internal project limitations and weaknesses that impede PPP development in the relevant area (weaknesses), the external project opportunities that can be developed to overcome identified weaknesses (opportunities) and external factors that may hamper the future development of PPPs (threats). Considering that there is no project where the applicant is a PPP, although an analysis of the guidelines of the Call for Proposals relative to IPA Albania - FYROM CBC Programme found an explicit reference to PPPs, it has been choose to make a screening of projects in which the instrument of the PPP was present at least in embryonic form, in other words having the private sector as a direct or indirect beneficiary. As already mentioned, Macedonia was chosen as an example because of the availability of information related to projects. So, on these terms, 5 projects were selected out of 15 under review. The projects are the following: • Cross-border shared integrated alternative tourism, • Business without borders, • Cross-border Civil Society Forum, • Promoting business women enterprises in the cross-border area, • Borders without boundaries. The dimensions chosen for the analysis are: • related to the internal context to identify strengths and weaknesses: objectives, actors and target, • related to the external context to identify opportunities and threats: actors, target and expected results. After the SWOT analysis, the chapter finally presents the key results of the dissertation proposing some possible actions that could improve the CBC through the use of the PPP emerged from the initiatives analysed. The conclusion reviews the major points of the dissertation showing the main results such as the strategies, which may result from the conclusions, thus potentially establishing an alternative approach aiming at opening up new possibilities for the development of better, more effective and sustainable CBC project/programs/activities, without necessarily relying upon more EU funds. For what above mentioned and to answer to the question 'Which are the winner strategies to increase the effectiveness of the CBC projects through the use of PPP?', it is possible to affirm that to present more successful projects in the future increasing the effectiveness of the CBC projects through the use of PPP, the development strategies are essentially the enhancement strategy and the overcoming strategy. In particular, to reinforce the internal and external positive aspects and factors in the cross border area and to mitigate and/or dissipate internal negatives as well as to attenuate the external ones, the recommended actions referred to the public and private sectors are: • to organize jointly regular meetings in which they can know each-other, exchange information and best practices in either of the neighbouring countries, so that there can be discussions on the potentials of development and the new economic undertakings and new instruments to be employed, such as the PPP. Tourism can serve as a pilot sector in which it can be started with the actualization of gender policies facilitating in some way the inclusion of women in business activities, • jointly organize awareness campaigns on PPPs and training courses, which could serve to overcome the lack of ability to establish efficient PPPs for both public and private sector, • to organize, for the numerous actors present in the territory, specific courses and/or informative events related to the revision processes of normative policies that could facilitate and reinforce both the cooperation between different stakeholders and the capacity of doing business and create PPPs, • to enhance the existing networks and creates new ones through continuous meetings between different stakeholders with the aim of overcoming the threats considering that the improved and expanded relations between the various actors could bring an improvement in raising needed funds. Finally, it is important to mention that there are also some actions recommended only to the public sector. These are: • (especially at local level) institutions such as the municipalities can organize meetings, inviting the traditional and non-traditional private actors, in order to facilitate communication. Through this communication there could be achieved the introduction between various stakeholders interested in the PPP instrument, by at the same time laying the basis for the foundation of a network. This would be useful for increasing the credibility of each other and also to contributing to the overcoming of the lack of cooperation problem. These meetings could be used for an exchange of best practices in the sectors that are present in the certain areas. By employing a participatory methodology, these meetings could also serve to the construction of a sort of roadmap (lines of action during a defined time) that could enable the definition of the obstacles to be overcome in order to effectively and efficiently realize this type of partnership, • the authorities should first change their national optics and then transform their national policies into regional ones, starting from the cross-border policies with neighbouring countries, in which PPP should be promoted as a development instrument. In addition, when necessary, they should review the legal framework in order to facilitate the establishment of PPP. After this, they should organize meetings between the different stakeholders, and more generally between citizens living in the border areas of the neighbouring countries, with the end objective of promoting the necessary knowledge for overcoming the prejudices and for opening way to partnerships and cooperation activities, • to implement policies for purposes of facilitating investments in diversified sectors, taking an advantage of the actors from different sectors and directing them to training courses to gain knowledge in areas of investment that are different from their traditional ones. ; Vi è un riconoscimento sempre più diffuso tra tutti gli attori attivi nel settore della cooperazione allo sviluppo che il partenariato pubblico privato (PPP) può essere un importante nuovo strumento, non solo per costruire grandi infrastrutture (quindi per il settore dei lavori pubblici), ma anche per offrire servizi ai cittadini sia a livello centrale, sia locale e avere, in un prossimo futuro, un valore strategico nella cooperazione transfrontaliera (CBC). E' stato visto come la Commissione Europea definisca il PPP in un modo piuttosto ampio e generico, senza dare una definizione giuridica adeguata di questo partenariato. Infatti, per l'Unione Europea il PPP è una forma di cooperazione tra le autorità pubbliche e gli operatori economici riguardante la progettazione, il finanziamento, la realizzazione, il rinnovamento o lo sfruttamento (funzionamento e manutenzione) delle infrastrutture pubbliche, così come la fornitura di un servizio di pubblica utilità (CIT). Tuttavia, non vi è un'uniforme, comune definizione di questa forma di partenariato. Considerando che l'attuale crisi economica e finanziaria globale ha colpito quasi tutte le regioni del mondo e tenendo presente che le risorse pubbliche stanno diminuendo sempre più, tra cui soprattutto quelle destinate alla cooperazione allo sviluppo, costruire partenariati e sinergie tra il settore pubblico e privato non è solo una grande possibilità ma una necessità che diventa impellente se si vuole continuare a sostenere gli interventi di cooperazione. Inoltre, questo tipo di partenariato è una buona occasione per entrambi i settori in quanto aiuta non solo a rafforzare i rapporti reciproci, ma anche a scambiare le reciproche esperienze e le migliori pratiche. Si è visto come se applicato correttamente, il PPP consenta una riduzione dei costi totali, una migliore distribuzione dei rischi, un'esecuzione più rapida dei servizi e delle attività pubbliche, nonché una migliore qualità dei servizi offerti e delle attività prodotte. Senza contare che il superamento della rigida distinzione tra pubblico e privato apre la possibilità di trovare soluzioni e di rispondere alle domande a cui la pubblica amministrazione non è in grado di rispondere autonomamente. Si sottolinea come nella cooperazione internazionale ed in particolare nella cooperazione transfrontaliera, sempre più spesso le amministrazioni locali dei paesi beneficiari e donatori stiano riconoscendo il ruolo sussidiario della società civile e del settore privato nelle attività d'interesse generale e quindi anche nell'erogazione di servizi e funzioni pubbliche. Considerando la vasta esperienza di lavoro nel settore della cooperazione allo sviluppo con il Ministero degli Affari Esteri italiano in diverse aree del mondo così come con altre organizzazioni internazionali, da ultimo con l'Organizzazione per la Sicurezza e Cooperazione in Europa (OSCE), credendo sull'utilità e le potenzialità dello strumento del PPP e verificato direttamente che potrebbe essere utilizzato maggiormente nella cooperazione internazionale, l'autore ha deciso di analizzare l'uso di tale partenariato in questo settore focalizzandosi in particolare sul programma IPA I CBC Albania - Macedonia. Infatti, lo scopo di questa tesi e della potenziale applicazione delle sue conclusioni deriva dall'interesse personale e dall'attività lavorativa dell'autore. Infatti, vive e lavora in Albania e ha una grande esperienza del paese perché è stato per diversi anni responsabile per la Cooperazione Italiana dei progetti che questa ha realizzato nello stesso. Inoltre, sta anche studiando la lingua albanese ed è molto affascinato dalla storia di questo piccolo paese così vicino all'Italia, non solo geograficamente parlando. L'attenzione per la Macedonia come paese confinante, invece, è dovuta semplicemente al fatto che è stato più facile reperire informazioni sul programma IPA I CBC Albania - Macedonia rispetto agli strumenti finanziari simili. Sulla base di una ricca esperienza sul campo, questa tesi cercherà di rispondere alla seguente domanda: "Quali sono le strategie vincenti per aumentare l'efficacia dei progetti di cooperazione transfrontaliera attraverso l'uso del PPP?". L'obiettivo generale della tesi è di individuare, infatti, le strategie che possono migliorare l'efficacia della cooperazione transfrontaliera attraverso l'uso di tale partenariato, al di là di specifici interventi che fino ad ora sono stati principalmente effettuati attraverso canali istituzionali e attuati attraverso progetti e programmi europei. Le strategie che la conclusione della tesi identifica si basano sull'analisi SWOT di cinque progetti e la conseguente elaborazione dei dati/risultati. Questi cinque progetti sono stati selezionati tra quelli finanziati dall'UE tramite l'IPA I CBC Albania/Macedonia durante il periodo di programmazione 2007 - 2013, in quanto presentanti il PPP almeno in fase embrionale. Tali strategie potrebbero aprire nuove possibilità per lo sviluppo di attività di CBC applicabili nell'ambito della politica regionale 2014 - 2020 dell'Unione Europea, senza necessariamente fare affidamento su ulteriori mezzi finanziari della stessa. Questo è anche in linea con gli auspici dell'UE che crede che la CBC non sia solo un altro modo per accedere ai finanziamenti, ma possa piuttosto diventare un modello di cooperazione sostenibile di per sé. La tesi si basa sulla raccolta e l'analisi dei dati disponibili nell'ambito del quadro giuridico-istituzionale esistente e fa uso del metodo qualitativo di ricerca con l'obiettivo di verificare l'ipotesi di cui sopra. La tesi prevede una serie di fasi di lavoro cronologicamente distinte e reciprocamente sostenibili e si basa sull'utilizzo di diversi costrutti teorici e varie metodologie avvalendosi di diverse fonti come ad esempio la letteratura esistente, le statistiche effettuate e più in generale la documentazione disponibile soprattutto in internet. Il suo contenuto deriva quindi dal reperimento e dall'analisi di varia documentazione ufficiale e di cinque documenti progettuali, così come verrà maggiormente esplicato qui di seguito. Seguendo la struttura della tesi, si può affermare che il primo capitolo presenta il quadro normativo e finanziario dei PPP in Europa, così come il modo in cui questo strumento viene utilizzato nel contesto della cooperazione internazionale e della cooperazione transfrontaliera, al fine di comprendere quando è nato questo tipo di partenariato e quali siano i suoi obiettivi e le evoluzioni che ha avuto fino ad oggi. Nello specifico, il capitolo mostra come il PPP sia nato negli anni '30 soprattutto collegato al settore energetico e minerario e come, pur non avendo ancora una comune definizione a livello europeo, oggi sia in crescita e venga visto come un importante strumento di sviluppo economico e sociale anche nel settore della cooperazione internazionale e transfrontaliera. Il capitolo, inoltre, presenta la cooperazione inter-municipale (IMC) come uno strumento che può aprire buone potenzialità all'applicazione del PPP in quanto permette di colmare le deficienze delle municipalità. Attraverso questo strumento, stabilito in seno al Consiglio d'Europa (CoE), le municipalità possono infatti anche sub-contrattare imprese private o creare un'entità nuova (IMC) per poter attrarre investitori e donatori. Il capitolo inoltre mostra come lo strumento del PPP venga incoraggiato anche dalle Nazioni Unite (UN) fin dal 1999 - anno in cui viene creato il progetto 'Global Compact' - e come vi siano diversi esempi di PPP nel mondo realizzati da Agenzie UN. E' importante sottolineare che il PPP è considerato utile dal settore pubblico anche perché può contribuire a risolvere difficoltà causate dai tagli di bilancio così come dalla burocrazia e dall'insufficiente capacità tecnica e manageriale che spesso caratterizza la pubblica amministrazione. Il PPP è quindi uno strumento attuale, innovativo e anche complementare capace di promuovere sviluppo, riforme ed investimenti oltre a promuovere politiche e buone pratiche in diversi settori tra cui quello della cooperazione allo sviluppo anche a livello transfrontaliero. Grazie al PPP si può quindi affermare che il settore privato è diventato a tutti gli effetti un attore privilegiato della cooperazione allo sviluppo internazionale. Il secondo capitolo della tesi analizza le politiche dell'Unione Europea e i relativi strumenti che presentano una connessione con i PPP. Più nel dettaglio, viene visto come attraverso queste politiche sia stato applicato il partenariato in parola nella cooperazione transfrontaliera e come la stessa sia divenuta più esplicita a livello europeo, soprattutto nel contesto del processo di stabilizzazione ed associazione. Infatti, partendo dalla Dichiarazione di Schumann del 1950, il capitolo introduce il Trattato istitutivo della CEE del 1957, esamina l'Atto Unico Europeo, per poi prendere in considerazione la politica di coesione o regionale. Proseguendo, il capitolo analizza la politica di allargamento o pre-accessione inclusi i tre criteri necessari per l'adesione stabiliti durante il Consiglio Europeo di Copenaghen nel 1993, i vari stadi del processo di adesione e le ragioni per cui l'Unione Europea promuove l'allargamento, considerando le diverse tappe di tale processo tra cui quella storica del 2004 e le sue prossime sfide. Dopo aver inoltre analizzato il quadro delle negoziazioni e gli strumenti previsti in ambito della strategia di pre-adesione, si è finito per affrontare la politica di vicinato o prossimità prendendo in analisi i suoi relativi strumenti, i suoi diversi obiettivi strategici e il suo nuovo approccio in seguito alla primavera araba. Dopo aver identificato come queste politiche presentino un'intersezione con la cooperazione transfrontaliera, è stata analizzata la loro intersezione con il PPP con il risultato di sottolineare che anche laddove tali politiche non prevedono esplicitamente il ricorso a questo tipo di partenariato, non lo escludono. Questo significa quindi che esse forniscono validi supporti all'uso di tale strumento, elemento importante per la tesi che è infatti volta a mettere in evidenza i punti di forza di tali politiche per l'applicazione dei PPP e a mostrare al contempo che vi è una mancanza applicazione degli stessi. Questo verrà evidenziato nel corso della tesi dal caso preso in esame di IPA I CBC Albania - Macedonia. Il terzo capitolo presenta come prima cosa il concetto di confine. E' importante sottolineare come questo concetto viene esplicitato non solo da un punto di vista fisico-amministrativo ma in un senso più ampio, tenendo conto di come il concetto di confine sia un elemento chiave per capire la cooperazione transfrontaliera. Infatti, è solo partendo dall'analisi di questo concetto e da questo a quello di frontiera e area periferica, passando anche alla teoria generale dei sistemi applicata alla teoria generale dei confini, che si può pervenire alla nascita del concetto di cooperazione transfrontaliera e della sua applicazione pratica. Per tale motivo si è ritenuto necessario esplicare i concetti sopra menzionati secondo le definizioni di vari studiosi di varie discipline, per poi presentare i principali strumenti legali che regolano e facilitano la cooperazione transfrontaliera a livello europeo così come i meccanismi ad hoc che la implementano. Si è partiti da quelli nati in seno al CoE e precisamente dalla Convenzione di Madrid del 1980, strumento quadro per il tipo di cooperazione oggetto di questa tesi in quanto introduce per la prima volta la possibilità di cooperare e concludere accordi ad enti di Paesi contigui geograficamente. Vengono poi presentati i suoi 3 Protocolli: il Protocollo aggiuntivo, che dà essenzialmente la possibilità di creare un organismo di cooperazione transfrontaliera ad essa preposto, il secondo Protocollo che fissa soprattutto un quadro giuridico della cooperazione interterritoriale tra le parti e il terzo Protocollo che concerne la possibilità di istituire i Gruppi Europei di Cooperazione (GEC) dotati di personalità giuridica. Inoltre, a dimostrazione di come la cooperazione transfrontaliera nel tempo abbia acquistato sempre più importanza, si è ritenuto opportuno illustrare l'istituzione dei Gruppi Europei di Cooperazione Territoriale (GECT), le loro modalità di azione e i loro ambiti di applicazione. Tali Gruppi, che si rivelano quindi essere un nuovo strumento giuridico/finanziario che integra la Convenzione di Madrid ed i relativi Protocolli, sono stati creati al fine di facilitare la cooperazione transfrontaliera e superare gli ostacoli incontrati fino ad allora. Il capitolo continua focalizzandosi sui passi compiuti dall'UE in relazione a questo tipo di cooperazione che in particolare consistono nella messa a disposizione di importanti strumenti finanziari quali per esempio INTERREG. Il terzo capitolo si conclude quindi affrontando anche la Strategia delle Macroregioni che, pur non avendo una loro definizione ufficiale in ambito europeo, forse anche a causa della loro recente istituzione e pratica, si dimostra essere veramente utile nel contribuire a realizzare la politica di coesione e più nello specifico il suo obiettivo n. 3 (Cooperazione Territoriale Europea). Considerando che all'interno di questa politica vi è una programmazione settennale, nel quarto capitolo vengono presentate sia quella appena terminata 2007-2013, sia la nuova 2014 - 2020 per verificarne i cambiamenti nel contesto di applicazione dei PPP. Viene infatti introdotta la programmazione dell'UE 2007-2013 per comprendere maggiormente cosa sarebbe cambiato nel settennio successivo, anche a causa di avvenimenti storico/politici avvenuti durante gli ultimi anni come la cosiddetta primavera araba e l'interesse a sviluppare maggiormente l'integrazione economica tra l'Unione Europea e i partner orientali. Si prosegue con l'analisi più dettagliata degli strumenti utili per la realizzazione della cooperazione transfrontaliera (CBC) nel nuovo settennato e le possibilità di applicazione del PPP all'interno di questi. A tale riguardo è importante sottolineare come in generale tutte le politiche europee, tra cui quella regionale ha un ruolo centrale, dovrebbero contribuire al raggiungimento degli obiettivi della Strategia Europa 2020. Si sottolinea come questa strategia, che ha portato alla definizione della nuova programmazione 2014-2020, sia molto ambiziosa e abbia individuato come uno degli strumenti chiave per la sua realizzazione quello del partenariato, tra cui anche il partenariato con il settore privato. Qui è importante evidenziare che gli obiettivi generali della politica regionale, sia a livello europeo, sia a livello nazionale, sono principalmente di natura socio-economica per es. orientati ad attenuare le disparità esistenti tra regioni aventi diverso livello di sviluppo. In particolare, le politiche europee hanno l'obiettivo di migliorare l'ambiente/contesto per attrarre investimenti al fine di incrementare investimenti in lavori pubblici nelle regioni che presentano maggiori necessità e migliorare la gestione delle risorse regionali locali in maniera più efficiente ed efficace. La tesi mostra come in entrambi i casi, lo strumento del PPP può essere di aiuto nel raggiungere questi importanti obiettivi. Inoltre, il capitolo in parola, dopo aver osservato che nella nuova programmazione settennale vi sono diversi cambiamenti dovuti al nuovo quadro legislativo e alle nuove modalità di attuazione della nuova politica regionale, esamina i due strumenti collegati alla CTE, IPA ed ENPI, nei due settenni di programmazione sopra menzionati. Il quinto capitolo invece, dopo una presentazione generale del contesto Albanese che prende in considerazione alcuni aspetti economici, demografici, sociali e politici del paese, includendo anche i criteri che questo deve soddisfare per poter ricevere lo status di candidato dall'Unione Europea, presenta brevemente la legge albanese sui PPP. In seguito, descrive le relazioni tra l'Albania e la Macedonia e il relativo Programma IPA CBC in relazione ai due periodi di programmazione suddetti 2007 - 2013 e 2014 - 2020 per presentarne le principali differenze. Concentrandosi sulle opportunità che l'Albania potrà avere nel prossimo futuro, viene sottolineato cosa cambia nel nuovo periodo di programmazione e con quali effetti positivi sul PPP, tenendo in considerazione anche il concetto di Responsabilità Sociale e l'iniziativa 'Global Compact' delle Nazioni Unite già menzionata precedentemente. Tutto questo per introdurre l'ultimo capitolo che, attraverso un'analisi della metodologia usata nelle varie fasi di preparazione della presente tesi, tra cui la SWOT analisi, identifica le strategie considerate vincenti per accrescere e migliorare l'efficacia della cooperazione transfrontaliera attraverso l'uso dello strumento di PPP. Nello specifico, la prima parte della tesi si è avvalsa di diverse fonti documentarie. Specialmente nella sua fase di inizio, il lavoro è stato definito attraverso ciò che è comunemente chiamata 'analisi secondaria'. E' stata effettuata infatti la ricerca e analisi della letteratura esistente e della documentazione ufficiale disponibile on-line e nei Ministeri albanesi così come nell'Istituto Nazionale di Statistica albanese. E' stata inoltre reperita e analizzata la documentazione in possesso di diversi donatori e organismi internazionali presenti nel paese e in particolare della Delegazione della Commissione Europea in Albania. La seconda parte della tesi si è concentrata sull'analisi del programma IPA CBC in generale ed IPA CBC Albania - Macedonia in particolare. A tal fine si è voluto procedere con l'analisi di progetti specifici attivati e conclusi nel contesto di tale programma per evidenziare il ruolo effettivo o potenziale del PPP nello sviluppo virtuoso di progetti di CBC. Sebbene il PPP non venga esplicitamente definito tra gli strumenti utilizzati nell'attuazione di queste iniziative, si è scelto di individuare i fattori prodromici del PPP presenti in alcuni progetti al fine di valutarne le potenzialità soprattutto nell'ottica del prossimo periodo di programmazione europea (2014-2020). Le informazioni dettagliate relative ai progetti realizzati o in fieri non sono pubblicamente disponibili essendo 'proprietà' della Delegazione della Commissione Europea in Albania e dell'Autorità di Gestione del programma. Per raccogliere dunque il materiale necessario ad identificare i progetti più rilevanti e, successivamente, a procedere alla loro analisi si è dimostrato necessario procedere attraverso interviste in profondità con attori qualificati. Sono state così condotte interviste con interlocutori principalmente della Delegazione della Commissione Europea in Albania, del Ministero dell'Integrazione albanese e della Cooperazione Austriaca. Attraverso queste interviste, ai dati relativi al contesto ed al programma si sono quindi aggiunte informazioni specifiche relative a cinque progetti in cui lo strumento del PPP fosse presente almeno in forma embrionale. Le informazioni raccolte sono state strutturate in modo da procedere ad un'analisi qualitativa e ad un incrocio dei dati attraverso lo sviluppo di una SWOT analisi dei suddetti cinque progetti finanziati da IPA I CBC Albania - Macedonia al fine di presentare i risultati di tale analisi attraverso un processo di interpretazione dei dati. Prima di iniziare la SWOT analisi, il capitolo presenta anche il programma annuale per i fondi 2009 della Direzione Generale Allargamento dell'Unione Europea che specifica anche gli obiettivi della CBC tra i due paesi presi in esame che consistono essenzialmente nella promozione dell'economia transfrontaliera e dello sviluppo sociale e ambientale. Il quinto capitolo, così come sopra detto, analizza quindi attraverso una SWOT analisi, cinque progetti finanziati dall'UE all'interno del programma IPA I CBC Albania - Macedonia primo bando. In particolare, in questa tesi, la SWOT analisi, è lo strumento che permette di identificare i punti di forza (S), di debolezza (W), di opportunità (O) e di minacce (T) che caratterizzano i progetti che verranno analizzati in relazione al PPP. In altre parole quali sono i punti forza/risorse interne ai progetti che possono favorire lo sviluppo di tale partenariato e quali le loro limitazioni/punti di debolezza che lo possono ostacolare, così come le opportunità/fattori positivi esterni al progetto che possono, del caso, essere sviluppati per superare i punti di debolezza individuati e quali le minacce/fattori negativi esterni che derivano dal contesto locale e che impediscono lo sviluppo del PPP nell'area di interesse. Basandosi sulle informazioni ottenute non essendoci progetti in cui i candidati sono formati da un PPP, anche se da un'analisi delle linee guida del bando ('Call for Proposal') relative al Programma IPA I CBC Albania - Macedonia primo bando, è stato rilevato che non vi è un riferimento esplicito a questi, è stato scelto di fare uno screening dei progetti verificando quelli che nel loro interno presentavano almeno come beneficiari diretti e/o indiretti il settore privato. Così come sopra illustrato, tra i paesi confinanti l'Albania è stata scelta la Macedonia a titolo esemplificativo. Tra i 15 progetti presi in considerazione, i 5 progetti selezionati sono: 1. 'Cross-border shared integrated alternative tourism' (Turismo transfrontaliero alternativo integrato e condiviso), 2. 'Business without borders' (Impresa senza confini), 3. 'Cross-border Civil Society Forum' (Forum transfrontaliero della società civile), 4. 'Promoting business women enterprises in the cross border area' (Promozione dell'impresa femminile nell'area transfrontaliera), 5. 'Borders without boundaries' (Confini senza limiti). Queste le dimensioni scelte e di volta in volta da verificare per ogni progetto selezionato: • relativamente al contesto interno, al fine di identificare i punti di forza e di debolezza, sono obiettivi, attori e beneficiari, • relativamente al contesto esterno, al fine di identificare le opportunità e le minacce, sono attori, beneficiari e risultati attesi. Dopo la SWOT analisi, il capitolo da ultimo presenta i risultati chiave della tesi proponendo le strategie che potrebbero migliorare la cooperazione transfrontaliera attraverso l'uso del PPP. Le considerazioni conclusive della tesi riprenderanno tali strategie ripercorrendo inoltre i punti principali del lavoro svolto. Per rispondere alla domanda che sottende questa tesi, le strategie identificate come approcci alternativi che si possono applicare al fine di consentire ai programmi/progetti di cooperazione transfrontaliera di essere sviluppati in misura maggiore e in maniera più sostenibile, efficace ed efficiente utilizzando lo strumento del PPP e senza usare necessariamente ulteriori strumenti finanziari europei sono quelle cosiddette del 'rafforzamento' e del 'superamento'. In particolare, per rafforzare gli aspetti e i fattori positivi nell'area transfrontaliera e per mitigare e/o dissipare quelli negativi emersi dall'analisi effettuata, le azioni raccomandate sia al settore pubblico, sia al settore privato, possono essere così riassunte: • organizzare congiuntamente degli incontri regolari nei quali i diversi attori possano conoscersi meglio reciprocamente così come scambiare informazioni e migliori pratiche relativamente ai paesi vicini in modo che la discussione possa vertere man mano sul potenziale sviluppo in particolare dell'economia attraverso l'impiego di nuovi strumenti come il PPP, iniziando magari da un settore pilota quale il turismo, • organizzare congiuntamente campagne di informazione sul PPP e corsi di formazione che potrebbero servire al superamento della comune mancanza di capacità di istituire efficienti PPP, • organizzare per i numerosi attori presenti sul territorio dei corsi o eventi finalizzati ad informare sui processi di revisione normativa utile a facilitare e rafforzare la cooperazione tra i diversi attori, la capacità di fare impresa e creare PPP, • rafforzare congiuntamente le reti esistenti e crearne delle nuove attraverso continui incontri capaci di mettere assieme i diversi attori aventi l'obiettivo di superare gli ostacoli/minacce e consideranti il rafforzamento delle relazioni un valore aggiunto atto a migliorare anche la capacità di reperire i fondi necessari. Social acceptance is considered to be a decisive factor for the development of wind energy. Surveys repeatedly show that while people support wind energy in general, specific wind farm projects often cause local opposition. Local resistance against wind energy cannot be explained by singular issues such as simple cost-benefit calculations, the public support for renewable energy sources, the implementation strategy of the developer, the number of wind turbines installed, the intensity of the turbine noise, the protection of local birds and animals, or the "not-in-my-backyard"-effect (Stadlober and Hahn 1998; Warren et al. 2005; Wolsink 2000, 2007a), although a very dominant influence seems to be the specific value of the landscape, the familiar surroundings and the habitat (Wolsink 2007b). Hence, the acceptance of wind energy depends on a complex set of individual and societal indicators, perceptions and preferences rooted in institutional and socio-political arrangements.
The project's approach was based on the concept of social acceptance (Wüstenhagen et al. 2007), which is composed of socio-political, market and community acceptance. Wüstenhagen et al. investigated spatial planning and financial procurement systems to assess socio-political acceptance, market innovation, consumer and investors behaviour to explain market acceptance, procedural and distributional justice and trust to contribute to the understanding of community acceptance. The three levels of acceptance do interact, have main actors associated and are influenced by their interactions and contributing expectations.
We recur to this triangle model because it provides a broad holistic framework widely recognised not only in a scientific but also in a practical context. TransWind established a conceptual and methodological reliable participatory integrated assessment in order to test various factors of social acceptance. On a macro scale the integrated assessment was based on semi-structured interviews, participatory workshops and a group discussion (WorldCafé) with the experts from our stakeholder group, an estimation of the theoretical wind area potential in Austria and a participatory modelling approach to analyse the levelized cost of electricity (LCOE). On the community level focus groups, semi-structured interviews and presentations/tests of visualisation tools were conducted. Both the integration of results from the macro analyses to the community scale and the use of a mixed-method design ensured the inter- and transdisciplinary character of TransWind.
This approach is needed to gain new, practical and relevant insights, which could not have been obtained merely from scientific or interdisciplinary sources. The conceptual framework of TransWind therefore aimed at integrating in a systematic way the analytical perspectives of the scientists and their approaches with the preferences and perceptions of the persons concerned about the issue (stakeholders) through establishing a reference group, holding workshops and organising interviews and focus groups. The assessment was complemented by a GIS based modelling tool (Where the wind blows - WTWB), which allowed the participatory assessment of optimal locations for wind power, depending on the spatial distribution of wind resources. Inputs from the reference group were summarized in a criteria catalogue to define three scenarios (min, med and max) for potentially suitable wind turbine sites. These three scenarios were complemented by a fourth scenario that reflects the wind energy potential with suitability zones for wind energy already defined by Austrian federal states. For all potential locations we calculated the levelized cost of energy generation (LCOE) to derive wind energy supply curves for each scenario of potentially suitable wind turbine sites. Under the assumptions of the min scenario, only 3.5TWh of wind energy could be produced at relatively high costs of 96 to 243 € MWh-1. Thus, it would not be possible to meet the wind energy targets of 3GW installed capacity (equivalent to about 6.3TWh assuming current capacity factors) of the Austrian Eco-Electricity-Act 2012. The med and max scenario would allow for further expanding the wind energy share at reasonable cost of about 95 EUR MWh-1 even if electricity demand keeps steadily rising. The modelling results raised our understanding of the related costs and benefits and served as a basis for the case study selection.
In the case studies, TransWind worked with interactive 3D visualisation tools based on latest visualisation developments to provide real-time and realistic visualisations for discussing and assessing different planning strategies and siting processes related to the visual impact on the landscape. Our research on technologies for 3D modelling in the context of Wind turbine visualisations has shown that different concepts and methods exist. The simple image visualisations (static images) are state of the art in planning processes but they are increasingly criticised as there is no easy way to prove their reliability and the number of viewpoints is very limited. From a cost perspective it is still the most efficient technology and the images can be easily shared in reports, presentations or websites. Interactive 3D visualisations allow users to change their viewpoints interactively depending on personal motifs. Therefore, personal fears and expectations can be addressed which may lead to more objective discussions and exchange of opinions during planning processes. During the project, two very new technologies entered the stage: Augmented reality (AR) and Virtual reality (VR) applications. Both are driven by the fast spread of mobile phones and may provide some additional insights in the visual impact of wind turbines. Nevertheless there are still some technological barriers that leads to positioning errors or unrealistic views due to the missing masking of 3D objects by real world objects (in AR) or are lacking quality due to low screen resolutions of mobile phones (in VR).
Through the research in the case studies and the preferences expressed by the stakeholders of the reference group TransWind identified different and sometimes contrasting patterns of social acceptance, which enhanced our understanding about the economical, political, ecological and social feasibility of wind power plants. Our empirical results showed that all interview partners and focus group participants consider vertical and horizontal cooperation and coordination across different political levels and parties (stakeholders; experts; local to regional decision makers; citizens) to be important. The problem is that the process of interaction between these actors is often conflictual. Different factors could be highlighted explaining this divergence. Such factors can be seen in the conflict of interests, rationales and beliefs which strengthen the problems of coordination and cooperation. Furthermore, any wind energy project is characterised by the basic systemic conflict between nature conservation (protection of wildlife, habitat and landscape) and narratives of ecological modernisation (e.g. climate protection or energy transition). These moral concepts (core beliefs) and policy cores (general beliefs and perceptions in a specific policy field like wind energy) of the participants are unlikely to change. Only the so called secondary aspects, which relates to the implementation of a policy (e.g. instruments, concrete actions), are most likely to change and are subject to learning processes.
Solutions for local wind energy projects can only be found in coordinated processes of cooperation taking into account all patterns of social acceptance. In order to ensure acceptance, decision-making processes have to be reformed, justice sustained and thereby both input and output legitimacy enhanced. All of these factors were taken into account when TransWind finally established a guideline for various user audiences interested in handling the acceptance and non-acceptance of wind energy.
The decade 2009-2019 was particularly intense in rhetoric about efforts to tackle the climate crisis, such as the 2015 United Nations Climate Change Conference, COP 21. However, the carbon dioxide emissions at the world scale increased constantly from 29.7 (GtCO2) in 2009 to 34.2 in 2019. The current gap between rhetoric and reality on emissions was and is still huge. The Intergovernmental Panel on Climate Change proposed different mitigation strategies to achieve the net emissions reductions that would be required to follow a pathway that limits global warming to 1.5°C with no or limited overshoot. There are still pathways to reach net-zero by 2050. Several reports propose detailed scenarios and strategies to achieve these targets. They remain narrow and highly challenging, requiring all stakeholders, governments, businesses, investors, and citizens to take action this year and every year after so that the goal does not slip out of reach. In most of these trajectories, electrification and an increased share of renewables are some of the key pillars. The transition towards a carbon-free society goes through an inevitable increase in the share of renewable generation in the energy mix and a drastic decrease in the total consumption of fossil fuels. In contrast to conventional power plants, renewable energy is subject to uncertainty. Most of the generation technologies based on renewable sources are non-dispatchable, and their production is stochastic and complex to predict in advance. A high share of renewables is challenging for power systems that have been designed and sized for dispatchable units. Therefore, this thesis studies the integration of renewables in power systems by investigating forecasting and decision-making tools. Since variable generation and electricity demand both fluctuate, they must be forecast ahead of time to inform real-time electricity scheduling and longer-term system planning. Better short-term forecasts enable system operators to reduce reliance on polluting standby plants and proactively manage increasing amounts of variable sources. Better long-term forecasts help system operators and investors to decide where and when to build variable plants. In this context, probabilistic forecasts, which aim at modeling the distribution of all possible future realizations, have become a vital tool to equip decision-makers, hopefully leading to better decisions in energy applications. When balancing electricity systems, system operators use scheduling and dispatch to determine how much power every controllable generator should produce. This process is slow and complex, governed by NP-hard optimization problems such as unit commitment and optimal power flow. Scheduling becomes even more complex as electricity systems include more storage, variable generators, and flexible demand. Thus, scheduling must improve significantly, allowing operators to rely on variable sources to manage systems. Therefore, stochastic or robust optimization strategies have been developed along with decomposition techniques to make the optimization problems tractable and efficient. These two challenges raise two central research questions studied in this thesis: (1) How to produce reliable probabilistic renewable generation forecasts, consumption, and electricity prices? (2) How to make decisions with uncertainty using probabilistic forecasts to improve scheduling? The thesis perimeter is the energy management of "small" systems such as microgrids at a residential scale on a day-ahead basis. The manuscript is divided into two main parts to propose directions to address both research questions: (1) a forecasting part; (2) a planning and control part. The forecasting part presents several techniques and strategies to produce and evaluate probabilistic forecasts. We provide the forecasting basics by introducing the different types of forecasts to characterize the behavior of stochastic variables, such as renewable generation, and the tools to assess the different types of forecasts. An example of forecast quality evaluation is given by assessing PV and electrical consumption point forecasts computed by standard deep-learning models such as recurrent neural networks. Then, the following Chapters investigate the quantile forecasts, scenarios, and density forecasts on several case studies. First, more advanced deep-learning models such as the encoder-decoder architecture produce PV quantile forecasts. Second, a density forecast-based approach computes probabilistic forecasts of imbalance prices on the Belgian case. Finally, a recent class of deep generative models, normalizing flows, generates renewable production and electrical consumption scenarios. Using an energy retailer case study, this technique is extensively compared to state-of-the-art generative models, the variational autoencoders and generative adversarial networks. The planning and control part proposes approaches and methodologies based on optimization for decision-making under uncertainty using probabilistic forecasts on several case studies. We introduce the basics of decision-making under uncertainty using optimization strategies: stochastic programming and robust optimization. Then, we investigate these strategies in several case studies in the following Chapters. First, we propose a value function-based approach to propagate information from operational planning to real-time optimization in a deterministic framework. Second, three Chapters focus on the energy management of a grid-connected renewable generation plant coupled with a battery energy storage device in the capacity firming market. This framework promotes renewable power generation facilities in small non-interconnected grids. The day-ahead planning of the system uses either a stochastic or a robust approach. Furthermore, a sizing methodology of the system is proposed. Finally, we consider the day-ahead market scheduling of an energy retailer to evaluate the forecast value of the deep learning generative models introduced in the forecasting part. (1) Forecasting techniques of the future. The development of new machine learning models that take advantage of the underlying physical process opens a new way of research. For instance, new forecasting techniques that take advantage of the power system characteristics, such as the graphical normalizing flows capable of learning the power network structure, could be applied to hierarchical forecasting. (2) Machine learning for optimization. Models that simplify optimization planning problems by learning a sub-optimal space. For instance, a deep learning model can partially learn the sizing space to provide a fast and efficient tool. A neural network can also emulate the behavior of a physics solver that solves electricity differential equations to compute electricity flow in power grids. Furthermore, such proxies could evaluate if a given operation planning decision would lead to acceptable trajectories where the reliability criterion is met in real-time. (3) Modelling and simulation of energy systems. New flexible and open-source optimization modeling tools are required to capture the growing complexity of such future energy systems. To this end, in the past few years, several open-source models for the strategic energy planning of urban and regional energy systems have been developed. EnergyScope TD and E4CLIM are two of them where we think it may be relevant to implement and test the forecasting techniques and scheduling strategies developed in this thesis. (4) Psychology and machine learning. Achieving sustainability goals requires as much the use of relevant technology as psychology. Therefore, one of the main challenges is not designing relevant technological tools but changing how we consume and behave in our society. Thus, machine learning and psychology could help to identify appropriate behaviors to reduce carbon footprint. Then, inform individuals, and provide constructive opportunities by modeling individual behavior.

Despite the significant amount of the foreign experience study in land resourses study, it is urgent to develop new grounds for mechanism formation of the efficient land resources management in nowadays conditions of the state power decentralization based on the examined international experience considering the national peculiarities ensuring social-economic development of the territorial communities.Paper main body. Today, at the stage of land decentralization completion, the issues of land resources management in the territorial community are extremely acute at the national level. The land for the territorial communities is an important resource, which their economic and social development depends on. Efficient and rational use of land has become possible after the expansion of the territorial communities authorities in the field of land management, which in turn made it necessary to ensure the control and supervision function of the country in accordance with the delegated powers of the territorial communities. The issue of rational use of land resourses becomes increasingly important in the system of decentralization. The modern reformation of the land relations in UKraine is due to the solution of the rational land use tasks as the most important resourse of the territorial community.Three-level system of land resource management is peculiar for the vast majority of the countries: governmental, regional, local (municpal). But at the same time a uniform model of land relations regulation does not exist, each country in this respect is unique. Management in the sphere of land regulation and land transactions in European countries differs depending on the territorial structure and system of public administration. The system of land regulation in the federal countries is much more diverse, since many issues on land use is given to the jurisdiction of individual territories. All countries have special governmental, public or private structures engaged in regulation and management of land resources.The article examines and analyzes the experience of the old members of the European Union of Germany, Italy, France and new EU members – Poland and Latvia, as well as China, a country where the main form of land ownership is state.The entire territory of the federal state of Germany is divided into communities. Only territories owned by the state do not belong to the territories of communities, for example, military airfields, highways, and governmental forests. Within the territory of the community, the primacy of planning within land plans belongs exclusively to the community.An important aspect of the Italy's experience for Ukraine is land for those who are engaged in its processing, assistance from the state in the form of affordable credit and control by the state for effective use through forced leasing, namely the transfer of the right of use to a more efficient user.French legislation is aimed at preserving the purpose of agricultural land and developing farming. It is forbidden to buy and sell particularly fertile land for non-agricultural use, the owner must not leave agricultural land without cultivation for more than five years, otherwise the land may be transferred to other persons.The goal of the land reform in Poland was to move to market-based principles of economic development, increase agricultural productivity, and improve the standard of living and social-economic development of rural areas.The negative experience of Latvia, where agricultural land was in free circulation after independence, should be a warning factor for Ukraine in order to prevent a similar situation from occurring.The experience of China shows that in order to effectively manage the land resources, which will lead to the social-economic development of the territorial community, it is necessary to provide affordable credit to the farmers and avoid mass land sales.Conclusions of the research and prospects for further studies. Summarizing, we can conclude that the world integration processes in the sphere of land management have proven to mankind that land is one of the main sources of economic well-being, which needs to be organized for rational use and protection. Land resources management directly influences upon the social-economic development of the territorial communities. The modern state of land resources management requires new approaches aiming to increase management efficiency and ensure rational use. The foreign experience demonstrates us that from the perspective of national interests and national security there should be control and limitations on the part of the government considering the agreements implementation as to the right to own, use and dispose the land resources.The international experience makes it possible to point out the principal guarantees of efficient management and rational use of the land resources, in particular:– determination of legislation restriction as for the foreigner-buyers;– granting preferential right to purchase agricultural land plots to persons who are associated with agricultural activities and have appropriate education, as well as to take into account the availability of production means and required capital;– fullness of the state land cadastre and continuous updating of data;– establishment of the State Land Bank Institute for long-term lending to the agricultural sector;– state control over effective use through compulsory leasing, in particular, transfer of the right of use to a more efficient user.The promising areas for further research are development of substantive proposals for improving modern land management based on the foreign experience and recommendations for their practical application. ; Розглянуто особливості закордонного досвіду управління земельними ресурсами територіальної громади. En este artículo se abordan dos elementos que han estado presentes en la conformación de nuestra identidad nacional: la bandera y la capitalidad. En primer lugar, se analiza el papel de los símbolos en la relación entre socialización e individualidad, entre lo racional y lo emocional, lo mítico o lo intuitivo, algo esencial en los Estados democráticos para alejarnos de los totalitarismos, teniendo en cuenta la capacidad de los nacionalismos, los fascismos y los populismos de manipular en ese espacio. En segundo lugar se estudia la bandera como símbolo del Estado tanto desde una perspectiva de derecho comparado y de historia constitucional como teniendo en cuenta su actual regulación constitucional. Igualmente se analiza la exhibición de la bandera como elemento de integración voluntaria y consciente de los ciudadanos en la comunidad y como defensa de la unidad de España y de reivindicación de la CE y de las libertades de todos, también de los ciudadanos catalanes, ante el problema de libertad que ha supuesto la declaración unilateral de independencia, como ha ocurrido recientemente con la presencia masiva de la bandera española en los balcones. También se estudia la constitucionalización de las banderas autonómicas y el establecimiento de una obligación de utilización conjunta de éstas junto a la bandera de España, símbolo de una España constitucional y democrática, que reconoce un alto nivel de autogobierno a sus nacionalidades y regiones. Asimismo se abordan los conflictos por el uso de las banderas —la llamada guerra de las banderas— , analizándose las Sentencias más recientes, que ponen de manifestó la crisis en el sentido de pertenencia a España derivada de nuestra diversidad territorial. Así, se analiza el incumplimiento de la obligación de utilizar la bandera de España en edificios públicos y actos oficiales. También se aborda la bandera como bien jurídico merecedor de protección penal y el cuestionamiento del delito de ultrajes a la bandera, un límite a la libertad de expresión querido por el legislador, lo que proscribe una conducta expresiva como la quema de la bandera. Igualmente se analiza la doctrina de la JEC sobre la prohibición de la exhibición de banderas esteladas en edificios públicos en aplicación del principio de neutralidad política de la Administración Pública, sin perjuicio de su uso legítimo por entidades privadas en virtud de la libertad de expresión, así como la prohibición de la utilización de la bandera de España como símbolo oficial de un partido político, que traslada a la sociedad la idea de que la bandera es patrimonio de una parte de la población. En tercer lugar, se analiza el concepto constitucional de capitalidad. La capitalidad no es en puridad un símbolo aunque tiene un importante componente simbólico. Atribuir a una ciudad la capitalidad significa convertirla en cabeza política de un territorio y concederle una posición central dentro del Estado. Igualmente la capitalidad hace referencia a un lugar fijo donde se ejerce la soberanía y, por tanto, sede de los órganos de poder del Estado. Este estudio aboga por una interpretación flexible que no vacíe de contenido constitucional la noción de capitalidad y que al mismo tiempo permita un margen de maniobra al legislador en el marco de un Estado fuertemente descentralizado. Así, los órganos de poder del Estado y los órganos constitucionales deben tener su sede en Madrid, si bien la existencia de alguna excepción no vulneraría el precepto constitucional. Finalmente el trabajo aborda cuáles son las materias objeto del régimen de capitalidad y las otras singularidades de Madrid. ; This article deals with two elements that have been present in the shaping of our national identity: the flag and the capital. Firstly, it analyzes the role of symbols in the relationship between socialization and individuality, between the rational and the emotional, the myth or the intuitive, something essential in democratic states to steer ourselves away from totalitarianism, taking into account the capacity of the nationalisms, fascism and populisms to manipulate in that space. Secondly, it studies the flag as a symbol of the State, both from the point of view of Comparative Law and constitutional history, as well as considering its current constitutional regulation. Thus, the display of the flag is also analyzed as an element of voluntary and conscious integration of citizens in the community, and as a defense of Spain`s unity and the Constitution and the freedoms of all citizens, including Catalan citizens, in response to the problem of freedom that the unilateral declaration of independence of Catalonia has implied, as we have seen recently with a massive presence of the Spanish flag on the balconies. The article also studies the constitutionalization of the regional flags and the establishment of an obligation of the joint use of these together with the flag of Spain, which is a symbol of a constitutional and democratic Spain, that recognizes a high level of self-government towards its nationalities and regions. Furthermore, it also studies the conflicts that arise from the use of flags —the so-called «war of the flags»— , analyzing the most recent cases, which highlights the crisis in the sense of belonging to Spain derived from our territorial diversity. In the same manner, it also examines the breach of the obligation to use the Spanish flag in public buildings and official acts. Moreover the flag is also analysed as a constitutional value worthy of criminal protection; this also study the crime for flag desecration as a limit on the freedom of speech, which outlaws the burning of the flag as expressive conduct. It also discusses the JEC doctrine on the prohibition of the display of the «estelladas» in public buildings as a result of the application of the principle of political neutrality of the Public Administration, even though they can be used legitimately under the freedom of expression by private entities. Furthermore, the article also examines the prohibition of the use of the flag of Spain as an official symbol of a political party, which consequently conveys to society the idea that the flag belongs to a part of the population rather than to the entire country. Thirdly, the study analyzes the constitutional concept of the capital. The capital is not strictly speaking a symbol, but it has an important symbolic meaning. To attribute to a city the capitality means to turn it into the political head of a territory and to grant it a central position within the State. Likewise, the capital status refers to a fixed place where sovereignty is exercised and, thus, is the seat of the general institutions of the State. This study pleads for a flexible interpretation that does not empty the constitutional content of the notion of capital and at the same time allows a margin of freedom to the legislator in the framework of a strongly decentralized State. Therefore, the organs of state power and constitutional bodies must have their headquarters in Madrid, although the existence of any exception would not violate the constitutional provision. Finally, the paper addresses which the competences regulated by the Capital Law are as well as other singularities of Madrid.
