The Italian Juvenile Law guarantees protection to unaccompanied foreign minors, which is a child coming from non-EU countries without parents. This phenomenon, in recent years, concerns the migratory flows of refugees, who arrive from Turkey or Libya to the coasts of Italy; the journey is often dramatic and sometimes it requires to pass through other European countries. The EU Regulation - Dublin III, which entered into force on 1 January 2014, points at the competence of the EU State in which the minors arrived at first; further transfers, except the need to be reunited with family members in other EU States, are not significant for the European law. The current system of granting refugee or other forms of international protection is based on this fundamental principle. The protection of unaccompanied foreign minors in Italy is achieved through a form of "multidisciplinary" support; the legal data is only one component. In addition, there are social and educational projects as well as protection for health; the need of an effective integration is perceived. Together with the social intervention, a legal public representative, the Guardian, is appointed for unaccompanied minor. The competence belongs to the Municipality in which the minor is found or where, following a first reception, will be transferred on the basis of a regional territorial assignment, within the national system of Italian reception for refugee minors, called "SIPROIMI". The legal Guardian's role is to guarantee children's rights and an adequate assistance. It's a very thorny topic in the Metropolitan Area of Bologna, which has more than a million inhabitants; all the local offices created a "Public Metropolitan Protection Office" with the aims to manage these aspects. L'attuale fase storica, caratterizzata dal termine di ogni forma di istituzionalizzazione dei minori in direzione della loro integrazione nella comunità, è segnata dal punto di vista legislativo dall'emanazione e dalla attuazione della L.149 del 2001 che all'Art. 1 recita: "Ogni minore ha diritto a crescere nella propria famiglia", ponendo come obiettivo prioritario il rispetto del diritto fondamentale dei bambini a mantenere i propri legami familiari e comunitari. L'emanazione della Legge 285 nel 1997 ha segnato altresì una svolta nel modo di intendere il concetto di domiciliarità che da mera funzione medica e assistenzialistica è andato connotandosi di funzioni educative e di promozione del minore e del suo contesto di vita (Milani, 2004), riconoscendo nella figura dell'educatore la professionalità adatta a svolgere tale compito. La questione dei servizi domiciliari di sostegno alle famiglie di bambini in difficoltà si configura, in un panorama nazionale così descritto, un problema evidente e sul quale necessariamente fare ricerca. Gli interventi educativi domiciliari si collocano all'interno di questi servizi con la finalità generale di mantenere, anche in presenza di situazioni di disagio familiare, il minore nella famiglia d'origine (Janssen, 2003). La ricerca si è focalizzata su come, nella Regione Emilia-Romagna, il dispositivo degli interventi educativi domiciliari venga interpretato e attivato dai diversi soggetti istituzionali (Tribunale per i Minorenni e Servizi Sociali territoriali-Area Minori), con un approfondimento relativo al contesto dei Servizi Sociali territoriali e con l'obiettivo generale di fornire informazioni utili a orientare le politiche e le realizzazioni a livello regionale e nazionale. La tematica oggetto della tesi è stata esplorata mediante un'analisi della letteratura internazionale e nazionale, la strutturazione e somministrazione di un questionario rivolto ai Responsabili dei Servizi Sociali territoriali della Regione Emilia-Romagna e la realizzazione di alcune interviste a giudici del Tribunale per i Minorenni di Bologna. ; The current historical phase, characterized by the end of every form of institutionalization of minors in the direction of their integration into the community is marked from a legislative point of view by enactment and implementation of Law 144 of 2001 that to the Article 1 establishes: "Every child has the right to grow in their own family", with the primary objective of respecting the fundamental right of children to maintain their family and community ties. In 1997, the enactment of Law 285, marked a turning point in the understanding of the concept of domiciliarity which, from a mere medical and welfare function, has become connoted with educational functions and the promotion of the minor and his life context (Milani, 2004), recognizing in the figure of the educator the professionalism suitable to carry out this task. The question of home care services to support families of children in difficulty is, in a national scenario described as such, an obvious problem and on which to do research. Home educational interventions are located within these services with the general purpose of maintaining, even in situations of family hardship, the minor in the family of origin (Janssen, 2003). The research focused on how, in the Emilia-Romagna Region, the device of home educational interventions is interpreted and activated by the various institutional subjects (Court for Minors and Social Services), with an in-depth analysis on the context of the Services Social territorial. The subject matter of the thesis was explored through a careful analysis of literature, the structuring and administration of a questionnaire addressed to the Heads of the territorial Social Services - Minor Area of the Emilia-Romagna Region and the realization of some interviews with judges of the Court for Minors of Bologna.
La tesi di ricerca analizza uno dei problemi più rilevanti: l'elusione fiscale sulla fiscalità diretta effettuata a livello europeo, tra l'uso abusivo delle libertà europee. Il punto di partenza è lo stato della legislazione fiscale nell'Unione Europea come conseguenza della difficoltà di raggiungere una vera e propria armonizzazione giuridica come risultato del cosiddetto veto fiscale. L'origine del cosiddetto ostacolo è la mancanza di un interesse fiscale comune tra gli Stati membri. La politica fiscale è un'area strategica per tutti gli Stati, quindi è impossibile legiferare accontentando tutti. Questa situazione costituisce un ostacolo al processo di integrazione giuridica ed economica e allo sviluppo del Mercato Interno, è per questo motivo che la Corte di giustizia europea, attuando in qualità di uno dei principali attori in quello che viene chiamata l'armonizzazione negativa e in pro di tale integrazione regionale, è valutato quelle libertà verso una interpretazione protezionista. Questa interpretazione protezionista è quella impiegata dagli operatori economici come strumento abusivo verso il quale eludere il complimento della norma fiscale nazionale. In questa situazione e con il fine di ottenere un sistema fiscale giusto, vero ed efficace, considerammo che il modo migliore per affrontare queste pratiche non è altro che attraverso l'uso della dottrina sul divieto del abuso del diritto europeo elaborata dalla Corte di giustizia, permettendo agli Stati membri di legiferare disposizioni che limitino l'esercizio delle libertà europee. Il problema dell'impiego della riferita teoria come strumento anti-elusivo si trova nella natura giuridica di essa. Questa è stata qualificata come principio interpretativo e non come un principio generale del Diritto Europeo, quindi se vogliamo utilizzarla come strumento anti-abuso bisognerà essere codificata negli Ordinamenti nazionali sotto forma di clausola generale anti-abuso mediante cui consentire all'autorità tributaria corrispondente ad agire di conseguenza. Codificazione che dovrà essere conforme al Diritto Europeo. ; This thesis examines one of the most important problems in the tax arena: tax avoidance on direct taxation at European level, through the abuse of fundamental freedoms. The starting point is the state of tax law in the European Union as a consequence of the difficulty of reaching a real legal harmonization in this area as a result of the so-called veto. The origin of this obstacle is the lack of a common fiscal interest between Member States. Fiscal policy is a strategic area for all States, so it is impossible to legislate pleasing everyone. This remains an obstacle to the legal and economic integration process and development of the Internal Market. For this reason, the European Court of Justice, as a major player in what is called negative harmonization, has estimated those freedoms through a protectionist interpretation. This protectionist interpretation is that one used by taxpayers as an abusive instrument to elude the compliment of national tax regulations. In this situation and with the aim of obtaining a fair, real and effective tax system, we considered that the best way to deal with these practices is through the use of the doctrine on the prohibition of the abuse of European law adopted by the Court of Justice, allowing Member States to legislate provisions which restrict the exercise of the European freedom. The problem of the use of that theory is its legal nature. It was qualified as a principle of interpretation and not as a general principle of European law, so if we want to use it as anti-abuse provision, it must be codified in the national legal systems as a general anti-abuse rule according to the requirements established by the European Court in the aforementioned doctrine.

La costruzione di tale strumento è guidata da criteri che fanno riferimento a scelte di tipo urbanistico più che di tipo trasportistico e che riguardano prevalentemente l'integrazione tra aspetti di salvaguardia ambientale, distribuzione delle attività e necessità di mobilità. Infatti, il percorso metodologico tende a coniugare le caratteristiche morfologico-insediative e ambientali del sito con la domanda di sosta che dipende dalle attività insediate nell'ambito urbano di rifermento, considerandole quali elementi-chiave nella costruzione di scelte compatibili di trasformazione della città, tanto nella fase di localizzazione, distribuzione e dimensionamento degli interventi quanto nella successiva fase di progettazione della tipologia costruttiva dei manufatti per la sosta. Il contributo, che fa riferimento ad uno studio più ampio, si compone di tre parti. La prima è dedicata alla definizione dell'algoritmo che rappresenta l'iter attraverso cui si definiscono le soluzioni praticabili e compatibili di localizzazione, distribuzione e tipologia delle aree di sosta e di progettazione degli spazi. This paper shares the position expressed in the report on sustainable European Cities, destined to the local authorities of any city in the states of the European Union, which belongs to those documents targeted to affect the development and implementation of innovating policies and actions for promoting a more sustainable urban Europe. Therefore, the paper is divided into three parts. The first part defines the algorithm showing the iter through which it is possible to define feasible and compatible solutions for envisaging localization, distribution and typology of the areas and spaces to be realized. The second part, through the real implementation in a particular case, the city of Naples, deals with the definition of further criteria that are time by time implemented according to the urban context of reference. The tird part deals with the application to Naples and individuates a specific typology of parking areas, as implementation of the worked out algorythm and of the above-said criteria. The central part of the paper deals, then, with defining a route through which, among the possible transformations, the feasible alternatives are univocally individuated according to the environmental, historical and geo-morphological compatibilities and on the base of the expressed demand. All the building process is targeted, from its beginning, to reach desired and chosen aims with the awareness, confirmed by the previous analysis phase, that there are limits, bonds and conditions circumscribing the field of physical transformation planning - concerning the parking realization in this case - within well defined boundaries. Although this paper shares the choice of mobility policies targeted to stop and discourage the vehicles transit in the city downtown and against the realization of parking in those areas, nevertheless the suggested algorithm leads to realize exclusively areas for residential parking in historical central areas.

Il Volontariato nella Governance dei Servizi Sanitari Toscani: Dall'Aggregazione all'Integrazione di Modelli Sociali, Organizzativi ed Individuali Il fenomeno del Volontariato sta ricevendo progressivamente attenzione dagli studiosi di management, con particolare riferimento al ruolo che le Organizzazioni Non-profit (NPO) svolgono nella società moderna, oltre alla modalità con cui i cittadini si impegnano attivamente nel Terzo Settore al fine di far fronte ai cosiddetti 'fallimenti' dello Stato (government failures) e dei mercati (business failures). La letteratura di riferimento studia come la Società Civile sia in grado di fornire efficacemente i servizi socio-umanitari, rappresentando in tal modo un importante attore sociale al pari dell'Ente Pubblico, rappresentato dalle Istituzioni Governative (GOV), e del mercato, rappresentato dalle imprese ed i business commerciali (BUS). Nella presente ricerca il fenomeno del Volontariato è concettualizzato ed analizzato empiricamente attraverso tre prospettive – macro, meso, micro – le quali corrispondono alle tre sezioni della tesi di ricerca. A tal fine, abbiamo preso in considerazione l'area geografica della Regione Toscana, che rappresenta uno standard di riferimento ed eccellenza per l'implementazione da parte delle NPO di servizi socio-sanitari, in particolare nell'ambito dell'emergenza ed urgenza (Servizio 118). Infatti, il Terzo Settore toscano ha un'antica tradizione storico-culturale sviluppatasi fin dal Medioevo – la nascita della prima associazione di Volontariato fiorentina risale al 1244 – e durante i secoli è stato in grado di contribuire in modo significativo all'evoluzione del social welfare regionale, grazie all'implementazione di servizi socio-sanitari nei confronti della propria comunità locale. Quali sono le ragioni essenziali, le caratteristiche peculiari, e le leve strategiche che permettono il successo di tale realtà filantropica regionale? Per rispondere a tale domanda, abbiamo in primo luogo analizzato l'evoluzione storica delle interazioni istituzionali tra GOV e NPO toscane. Facendo riferimento alla letteratura di partnership ed alleanze strategiche, il focus è stato sul fenomeno delle partnership sociali cross-settoriali (CSSP – Cross-Sector Social Partnership), che si riferiscono ad alleanze strategiche tra i tre attori sociali, ossia lo Stato, le imprese for-profit ed il Terzo Settore, al fine di perseguire obiettivi sociali capaci di creare valore per la comunità di riferimento e soddisfarne le esigenze. La letteratura pertinente concettualizza tale fenomeno attraverso tre fasi, denominate 'formazione', 'implementazione', 'risultati'. Inoltre, tali fasi sono costituite da stage i quali a loro volta sono suddivisi in micro-processi. Uno dei gap della letteratura fa riferimento agli aspetti dinamici e contingentali che influenzano l'evoluzione delle CSSP in relazione a tali fasi, stage e micro-processi. Il nostro obiettivo è stato di contribuire a tale letteratura analizzando la specifica fase di 'implementazione' della partnership sociale cross-settoriale tra Regione Toscana e Associazioni di Volontariato, indagando l'evoluzione dei tre stage definiti 'selezione', 'design' e 'istituzionalizzazione'. Attraverso la metodologia della 'critical event analysis', abbiamo analizzato archivi storici, documenti, report, norme legislative, interviste con Presidenti e Direttori delle NPO toscane e responsabili della Regione Toscana, al fine di esaminare l'evoluzione della CSSP toscana negli ultimi 35 anni, ossia dal 1978 (creazione del Sistema Sanitario Nazionale) ai giorni d'oggi (2013-2015). Per tale livello 'macro' di analisi, è emerso come la partnership sociale sia stata caratterizzata dal cosiddetto 'isomorfismo coercitivo' il quale ha imposto alle Associazioni di Volontariato di adattarsi dinamicamente al contesto ambientale di riferimento per essere in grado di rispondere a pressioni contestuali esterne. Tali fattori hanno scaturito 5 principali criticità, ossia la legittimazione, il potere, la fiducia, l'identità, l'absorptive capacity, che sono evolute dinamicamente nel corso delle interazioni storiche tra i partner regionali. Nella seconda sezione della tesi abbiamo utilizzato una prospettiva 'meso', in particolare l'analisi di uno specifico modello di business e governance che sempre più caratterizza le organizzazioni non- profit, ossia il modello 'ibrido'. Tale modello fa riferimento alla compresenza di attività filantropiche/non-profit e commerciali/for-profit nella stessa organizzazione. Il fenomeno dell'ibridizzazione è sempre più un elemento significativo per le moderne realtà organizzative, poiché molte imprese sia for-profit che non-profit stanno sempre più convergendo verso un modello di 'impresa sociale', che sottolinea l'orientamento e l'attitudine imprenditoriale verso la responsabilità sociale delle strutture organizzative nei confronti di stakeholder e ambiente di riferimento. In particolare, tale fenomeno sta progressivamente caratterizzando le Associazioni di Volontariato toscane le quali devono organizzare innovativi modelli di business e governance al fine di essere autonome finanziariamente, divenendo così sempre più indipendenti dalle Istituzioni Governative e più sensibili ai bisogni di volontari e comunità locale. La letteratura ha individuato due tipologie di modelli ibridi, ossia il modello integrato e quello disintegrato, focalizzandosi in maniera marginale sulle possibili implicazioni manageriali. Al fine di contribuire a tale filone di letteratura, abbiamo effettuato un caso di studio multiplo analizzando tre NPO toscane 'ibride'. Grazie alla coding analysis delle interviste semi-strutturate effettuate con i Presidenti e i manager delle Associazioni di Volontariato, è stato possibile individuare implicazioni manageriali significative per tali realtà organizzative. In primo luogo, abbiamo concettualizzato una terza tipologia di modello di business e governance ibrido, ossia il modello semi-intergrato; in secondo luogo, abbiamo individuato sei categorie concettuali emerse dall'analisi che influenzano la gestione di tali realtà, ossia legittimità interna, legittimità esterna, scambi e flussi monetari, struttura organizzativa, perdita di identità, limiti alla crescita organizzativa. I risultati dell'analisi sottolineano come il modello ibrido integrato sia caratterizzato da alti livelli di criticità in riferimento ai limiti alla crescita; il modello disintegrato dal rischio di perdita identitaria; infine, il modello semi-integrato da criticità concernenti la legittimità interna e limiti alla crescita. La terza sezione della tesi fa riferimento ad una prospettiva 'micro', analizzando in primo luogo il concetto socio-antropologico del dono all'interno del contesto di volontariato; in secondo luogo, indagando le motivazioni psico-socio comportamentali dei volontari, oltre che le loro attitudini ed intenzioni comportamentali. In particolare, mentre il primo capitolo della sezione fa riferimento all'analisi concettuale del dono utilizzando importanti teorie antropologiche – come la Teoria del Dono di Marcel Mauss – il secondo capitolo presenta un'analisi empirica attraverso un modello ad equazioni strutturali (SEM – structural equation modeling), in grado di analizzare simultaneamente le relazioni ipotizzate tra significative variabili latenti delle attitudini, intenzioni e comportamenti dei volontari. Abbiamo utilizzato scale di questionari convalidati in letteratura e collezionato 379 questionari completati da volontari di 20 NPO toscane. Dopo l'analisi esplorativa fattoriale delle dimensioni oggetto di analisi – motivazioni (sociale, carriera, valori, conoscenza, protezione dell'io, avanzamento dell'io), atteggiamento verso l'organizzazione, religiosità, reciprocità positiva e negativa, intenzione a donare – abbiamo costruito un modello SEM e analizzato sia gli indici di significatività (modello di misurazione) sia le relazioni ed 'influenze' esistenti tra variabili (modello strutturale). Le principali implicazioni manageriali fanno riferimento alla capacità del management delle NPO di analizzare e conoscere i segnali relazionali emanati dai volontari, al fine di rispondere in modo appropriato ed incentivare lo sforzo di tali preziose risorse strategiche. Infatti, i volontari non rappresentano solamente il principale 'fornitore' di tempo, risorse, know-how e abilità per le Associazioni di Volontariato, bensì al contempo sono i beneficiari di gratificazione, soddisfazione e spirito associazionistico ottenuti dalla partecipazione all'organizzazione. In particolare, la dimensione di reciprocità insieme all'intenzione di donare sottolineano come la relazionalità sia un elemento cruciale per la gestione delle NPO, che presuppone una profonda conoscenza dei tratti psicologici dei volontari, oltre alle loro attitudini ed intenzioni comportamentali. Tali fattori sono importanti per rendere le Associazioni di Volontariato il veicolo sociale efficace in grado di rispondere ai bisogni della comunità locale e cercare di risolvere i 'fallimenti' dello Stato e dei mercati, grazie in modo particolare alle loro risorse più importanti, ossia i volontari. Voluntarism in the Governance of Tuscan Socio-health services: From the Aggregation to the Integration of Social, Organizational, and Individual Models The phenomenon of voluntarism is increasingly achieving attention by management scholars, specifically focusing on the role of Non-profit Organizations (NPOs) in modern society and the way citizens actively commit themselves in the Third Sector in order to cope with government and business failures. Pertinent literature questions how the organized Civil Society successfully provides human service delivery, thus traditionally representing an important societal actor along with both the Public Entity, represented at a local level by Governmental Institutions (GOV), and the market, represented by enterprises and for-profit business (BUS). In the present thesis, such a phenomenon has been conceptually and empirically analyzed following three perspectives, namely a 'macro', 'meso', and 'micro' perspective, which correspond to the three sections of the research. To this purpose, we chose an emblematic geographical area, the Region of Tuscany, which represents a paradigmatic excellence and national benchmark for the provision of emergency-urgency socio-health services. Actually, the Tuscan Third Sector has a historical and long-lasting tradition that started in the medieval period, precisely 1244 in Florence, and during the Centuries has significantly contributed to the evolution of regional welfare, especially by providing socio-health services to its own local community. What are the essential reasons, peculiar characteristics, and strategic levers that allow such a regional successful philanthropic reality? To answer this question, we firstly analyzed the historical evolution of the institutional interactions between regional GOV and Tuscan NPOs. Drawing on partnership and strategic alliances literature, we focused on the notion of cross-sector social partnership (CSSP), which refers to strategic arrangements between the three societal actors, namely GOV, BUS, and NPOs, aiming at social purposes. CSSP literature conceptualizes such arrangements through a tripartite framework which is composed by three phases, namely formation, implementation, and outcome of the social partnership. Further, each phase is characterized by stages which in turn are composed by micro-processes. However, scarce attention has been given to the analysis of evolving CSSP focusing on dynamic and contingent elements influencing and affecting such arrangements. We attempted to contribute to this stream of literature by choosing the implementation stage of the CSSP between Tuscan GOV and NPOs, and its three stages, namely selection, design, and institutionalization. By using critical event analysis, we examined historical archives, documents, reports, legislative frameworks, interviews with NPOs Presidents and Directors and GOV representatives, in order to assess the evolution of the Tuscan CSSP in the last 35 years, particularly from 1978 (the creation of the Italian NHS) to the present period (years 2013-2015). At this first 'macro' level of analysis, it emerged how the examined Tuscan CSSP has been characterized by an institutional 'coercive isomorphism' which imposed NPOs to adaptively respond to external pressures. These environmental factors resulted in five main CSSP internal outputs, namely legitimacy, power, trust, identity, and absorptive capacity, which dynamically evolve throughout the historical interactions between partners. In the second section of the thesis we used a 'meso' perspective, particularly the analysis of a specific business and governance model which is increasingly characterizing NPOs realities, the hybrid model. Such a model refers to the implementation of both for-profit and non-profit activities within a single organization. Hybridization is actually an important element in modern organizations, mainly because many for-profit enterprises and traditional NPOs are converging toward the so-called 'social enterprise' model, which stresses the socially responsible entrepreneurial mindset of modern management and organizational structures. Such a phenomenon is progressively characterizing Tuscan NPOs, which have to arrange innovative forms of business model in order to be financially autonomous and thus becoming, on the one hand, more independent of regional GOV and, on the other hand, more trustworthy toward its own volunteers and local community. Pertinent literature has individuated two types of hybrid business and governance models, namely the integrated and disintegrated ones, although few attempts have provided managerial implications for such hybrid arrangements. We attempted to contribute to this stream of literature by conducting a multiple case study of three Tuscan 'hybrid' NPOs. Specifically, the coding analysis of semi-structured interviews with NPOs Presidents and Directors resulted in significant managerial implications for these organizations. Firstly, we conceptualized a third hybrid business and governance model, the semi- integrated one; second, we individuated six conceptual categories affecting the hybridization phenomenon – internal legitimacy, external legitimacy, monetary exchange and flows, organizational structure, loss of identity, growth constraints. Interestingly, the integrated model resulted affected by high critical levels of growth constraints; the disintegrated model by risk of loss of identity; and, finally, the semi-integrated model by internal legitimacy and growth constraints. The third and final section of the thesis builds on a 'micro' perspective by firstly analyzing the socio- anthropological concept of the gift and donation in the voluntary context, and secondly investigating volunteers' motivations, attitudes, and behavioral intention to donate in order to deepen how these essential strategic resources of NPOs behave. While the first part of the section is a conceptual analysis of the notion of gift-giving building on anthropological theories (e.g. The Theory of the Gift by Marcel Mauss), the second part presents an empirical analysis using a structural equation model (SEM), which allowed to simultaneously assess the hypothesized relationships between important latent dimensions of volunteers' behavior, intention to donate, and attitude toward the NPO. Particularly, we used validated psychological and managerial scales and collected 379 questionnaires completed by Tuscan volunteers of 20 NPOs. After an exploratory factor analysis of the analyzed latent dimensions – volunteers' motivations (social, career, values, understanding, ego protection, ego enhancement), attitude toward charities, religiosity, positive and negative reciprocity, intention to donate – we implemented SEM procedure and evaluate both the 'measurement' model (fit indices) and the 'structural' model (hypothesized relationships) of the proposed constructs. Main managerial implications refer to the importance for NPO board to assess and understand volunteers' relational signals, in order to appropriately respond to and incentive such crucial strategic resources of the organization. Actually, volunteers represent not only the main 'provider' of time, resources, know- how, and ability for NPOs, but also and at the same time the main 'beneficiary' of gratification and satisfaction derived from being part of a committed philanthropic association. Particularly, the reciprocal dimension of volunteers' behavior, along with their intention to donate, stress how the relational element is important in the management of such realities, which presupposes a deep understanding of individual psychological traits, attitudes, and behavioral intention. Such elements make NPOs the effective and successful societal vehicles able to respond to community needs and to cope with government and market 'failures', thanks to their most precious resources, the volunteers.
La Regione Friuli Venezia Giulia ha avviato nel 2005, in qualità di Lead Partner, il progetto ANSER, che mira a valutare il ruolo ecologico delle zone umide per la sosta e lo svernamento degli uccelli acquatici nell'Adriatico settentrionale ed a definire linee guida per la conservazione del patrimonio naturale marino costiero. Il progetto viene realizzato in partenariato con le Università degli Studi di Udine e Trieste, la Regione Emilia- Romagna, l' Ente pubblico per la gestione delle aree protette nella contea di Spalato e Dalmazia (Croazia) ed il Museo di Scienze Naturali di Tirana (Albania). L'esigenza di mettere in atto tale progetto deriva dalla considerazione dell'eccezionale importanza dell'area adriatica per la nidificazione, la sosta e lo svernamento di molte specie di uccelli, della contestuale fragilità delle zone umide costiere, tradottasi spesso in degrado degli habitat, e della odierna necessità di conciliare le esigenze di conservazione con il diritto, per gli abitanti delle aree interessate dalla presenza di zone umide, al raggiungimento di livelli economici e occupazionali analoghi a quelli di altri territori. Il progetto trova quindi ulteriore motivazione nella necessità per le amministrazioni competenti di dare piena attuazione agli strumenti legislativi di riferimento per la protezione della natura nei paesi dell'Unione Europea come la "Direttiva Uccelli" (79/409/CEE) e la "Direttiva Habitat" (92/43/CEE) che hanno permesso di individuare le aree particolarmente meritevoli di conservazione in previsione di un loro piano di gestione e sviluppo. Da questo punto di vista l'acquisizione di dati attraverso studi, ricerche, attività di monitoraggio costituisce la premessa indispensabile per orientare le scelte gestionali, affinché qualsiasi intervento di conservazione non si riveli inefficace o addirittura dannoso. In questa direzione, il progetto si pone tra gli obiettivi di individuare i fattori di sovrapposizione ecologica delle diverse componenti ambientali ed antropiche e di raggiungere un forte coordinamento ed una forte sinergia tra Amministrazioni pubbliche, Istituti di ricerca e Università, ai fini di una corretta gestione di un sistema così complesso quali sono le zone umide. A tale scopo si prevede la messa a punto di metodologie di monitoraggio che, ricorrendo a indicatori di interesse gestionale, possano fornire dati certi e immediatamente utilizzabili relativamente alla situazione in atto e alle tendenze evolutive degli ecosistemi considerati, così da consentire l'adozione di provvedimenti correttivi adeguati. Il progetto inoltre individuerà nuove metodologie strumentali di ricerca e contribuirà concretamente alla formazione di nuove professionalità tecniche nel settore del biomonitoraggio, che portino ad una maggiore integrazione tecnico-scientifica delle istituzioni partner e delle altre realtà, istituzionali e non, territorialmente coinvolte. acquatici nell'Adriatico settentrionale ; Since 2005, the Region Friuli Venezia Giulia is the lead partner of the project ANSER, aimed at evaluating the ecological role of wetlands for waterbird resting and wintering in Northern Adriatic. One of the final aims of the project is to define a series of guidelines for the conservation of coastal wetlands and waterbirds. The project is carried out in collaboration with the universities of Udine and Trieste, the Region Emilia-Romagna, the Institution for protected area management of Spalato and Dalmatia (Croatia) and the Natural History Museum of Tirana (Albania). With regard to the Region Friuli Venezia Giulia, the project will be carried out until december 2008 and will involve all regional coastal wetlands. The reason for carrying out such a project is related to the great importance of the Adriatic area for the breeding, resting and wintering of a high number of birds, to the fragility of coastal wetlands, that are often characterized by habitat degradation, and to the need of integrating the conservation requirements to the social and economic development of such areas. The project is also related to the need of implementing the European environmental legislation, and in particular the Birds (79/409/EEC) and Habitats (92/43/EEC) directives, that have allowed to identify the areas where conservation, management and development plans should be applied. Data collection through research and monitoring activities is of the utmost importance for the definition of efficient and exhaustive management strategies. Indeed, the project aims at determining the factors of ecological overlap between environmental and human components, and at reaching a strong coordination among public administrations, research institutions and universities, in order to achieve a proper management of wetlands. For this reason, the monitoring methods are related to the development of indicators of management interest, that are accurate and can be immediately used for describing the evolutionary tendencies of the ecosystems, and adopt the required adjustments. The project will also define new research methods and form experts in biomonitoring, leading to a stronger technical-scientific integration of the partner institutions and of the other stakeholders.
In Italy, Protection System for Asylum Seekers and Refugees (SPRAR) manages the second reception of forced migrants. This organization was founded by the Bossi-Fini law n. 189/2002 and is composed by the network of local governments, which uses the available resources of National Fund for Asylum Policies and Services provided by Government finance law and managed by the Ministry of Interior. Its principal goal is to realize integrated reception projects for refugees, asylum seekers, subsidiary and humanitarian protection holders in order to ensure their socio-economic inclusion within local contexts in cooperation with voluntary and third sector organizations. On 10th July 2014, local governments were signed an agreement between national and regional executive to create a national reception system to face the growing number of people who have arrived on the Italian coasts. The main goal of this system is to overcome only a material reception (food and lodging), in order to offer a "widespread reception" within urban areas. The strategy is to create an individual project and an accompaniment to ensure the integration of each person in the local community. The services provided consist in inclusion of migrants in the national health and scholastic system, orientation and access to other local services, professional training, job placement, legal assistance and social and housing integration . Indeed, it is crucial to emphasize that the Italian reception system is characterized by extreme fragmentation. Only SPRAR provides these services with the goal of enabling social and economic inclusion of hosted people in local context, which is why we talk about second reception centres. In Italy, there are, however, many different types of first and extraordinary reception centres for migrants . They are managed by the prefectures and differ in terms of goals, structural characteristics, services and receptive capacity. Only 18.7% of migrants are hosted in the SPRAR structures, while the remainder incurs the possibility of carrying out the entire procedure of the asylum application in the centres of first and extraordinary reception (IDOS, 2017). In recent years, the Italian reception structures have undergone a reorganization and redenomination phase, in which the SPRAR should have become a reference standard. In fact, this system has positively distinguished itself for its objectives, the structuring of his interventions and many best practices. This did not prevent bad reception occurrences even within SPRAR structures, as well as a large number of violent and verbal conflicts, some of which carried out by Italian citizens to the detriment of asylum seekers and owners of a status of international protection. These episodes, exacerbated by a political and media discourse that represents migrants as a threat (Battistelli et al., 2016), are the consequence and symbol of the fragmentary and contradictory reception policies adopted at a European level, in the individual countries and at a local level (IDOS, 2016). Instability and political, economic and social uncertainty, rulers in this historical period, are manifested in an emergency approach that is characterized by insufficient planning and a lack of coordination between the reception agencies. This orientation, supported by many and incongruent legislative changes, deprives the system of a strong structure and facilitates the overturning of the same principles of "widespread reception" of migrants in local communities. Moreover, this facilitates the affirmation of nationalist, xenophobic and localist drifts, as well as reception situations in which human rights are violated and which do not provide real opportunities for inclusion in the territories in a safe and dignified manner. Therefore, the conceptual distinction of the terms danger, risk and threat, used as the interpretative line of this work, appears fundamental to understand why subjective responses, in terms of perception and actions, differ according to the situations, as well as to manage the effects that derive in a consistent manner (Battistelli e Galantino, 2018). In order to realize the analysis, I decided to use an ethnographic approach that is traced back to the constructivist philosophical paradigm, where the vision of facts is investigated locally. Ethnographers, indeed, study subjects, artefacts and actions in their interactions, from an interpretative-dialectical point of view, without the claim of absolute objectivity of the results (Piccardo and Benozzo, 1996). Then, I have chosen to use focused narrative interviews because they turn to individuals, they aim for their "understanding", and this is part of the renewed interest in the subject's centrality and in the "deliberately intentional" social action (Weber, 1922). It is also an approach that allows investigating deeply the phenomena. It is very interactive, flexible and able to empathize in the perspective of the subject being studied. This makes it easier to interview marginal subjects neglected by "official knowledge" and to rediscover the social function of research, which is "giving voice to those who do not have it" (Crespi, 1985, pp. 351) In addition, observation and fieldwork are supported by a strong theoretical basis that offers its help to the researcher for the understanding of the social world, providing an order that supports they in their critical analysis of the facts. So, empirical work and theory support each other (Silverman, 2002). Then, narrative approach is highly adaptable to the study of organizations and to analyse the collected data. In fact, this approach is characterized for attention given to concrete situations and not to general theorizations (Czarniawska, 2000). Hence, the empirical research carried out in 2016-2018 can be summarized in the following phases: 1- Analysis of secondary data and documents produced by European and national statistical institutes, private associations, protection bodies and by SPRAR itself. 2- Participant observation in: - a political protest demonstration against the opening of a SPRAR centre in XIII Town Hall, on the north-western suburb of Rome; - nine meetings of social operators working in SPRAR network of Rome and in the national CARA and CAS reception centres; - a SPRAR centre (20 reception places increased to 40 in the south-eastern suburbs of Rome, VII Town Hall). One year of observation and shadowing of operators: 16th January 2017 – 22th January 2018; - a SPRAR apartment (14 reception places for families in the residential area of Monte Sacro neighbourhood, Town Hall III). Five days of observation and shadowing of operators in January 2018; - a seminar of reflection organized by SPRAR and ANCI on the reception system in Lazio, focused on the role of the Regions and Municipalities. 3- Forty-one narrative focused interviews: - Twenty-four SPRAR operators working in SPRAR centres of Rome; - Seventeen asylum seekers and refugees from SPRAR centre observed in Town Hall VII of Rome. The intent behind this ethnographic research started in a restructuring phase aimed to make the SPRAR a reference standard of reception for all asylum seekers who came to our country. But it was characterized, as still today, by speculative situations, the high presence on the territory of large collective reception centres and managing bodies without the necessary experience (Olivieri, 2011; Lunaria 2016). Therefore, the analysis of the risk management and the operators perception of the SPRAR of Rome has the objective to unveil and analyse the contradictions and weaknesses that may arise within this model due to a reckless management that produces specific factors of risk. The hypothesis underlying the case study is that, although the SPRAR has been recognized as an ordinary model, it can also be reproduced in a distorted manner, not respecting the reference guidelines. The alteration between SPRAR in books, the theoretical expression of a principle, and SPRAR in action, its implementation (Pound, 1910), is caused by specific factors that can cause significant effects from several points of view. To bring to light these aspects, closely related to the risk management and the perception that its operators have, I achieve a classification of the risks that I applied to three different types of SPRAR structures (large, medium and single apartment). Then, I identified a series of outcomes involving the people hosted, the operators, the local community and the SPRAR organization itself. The decision to draw the case study at the SPRAR of the city of Rome is driven by the complexity that distinguishes this territory on a social, cultural and political level. In fact, I believe it can bring out the contradictions of the model as new forms of confinement compared to territories with reduced complexity. However, allowing a glimpse of a reception of asylum seekers and holders of a protection status also possible within urban and metropolitan areas. The empirical survey shows that an increase in the distortion compared to the assumptions of an integrated and widespread reception in the territories corresponds to a greater possibility that specific risk factors are produced. Which in their turn, crystallizing into unhealthy forms, can involve the people hosted, the operators, the local community and the SPRAR organization itself. The case study and the application of the risk classification, which I achieved based on the evidence revealed from the field, reveal how the identified risk areas (socio-spatial context, production of the service, recipients) and the corresponding categories, do not produce in itself a negative result. However, this can occur if a short-sighted management acts on these aspects and does not align with the proposed guidelines. Therefore, this classification appears to be a useful tool to identify problems and to develop preventive measures, aimed to improve the management of SPRAR centres in metropolitan cities such as Rome (and other contexts), by intervening on the identified risk categories and reducing the factors that eventually emerge. The analysis, focused on three different types of SPRAR structure (large, medium, single apartment) of the Capital, shows how this alteration occurs in a disruptive way in the large collective centres, the most represented in Rome. Meanwhile, greater adherence to the model is shown, with a modality proportional to the size, in the medium-sized structure and in the apartment. The distortion detected in the large SPRAR collective centres of Rome and partly also in the medium-sized centre, reflects the ambivalence of the general reception system. It promotes on the one hand the principles of a good reception that respects human rights and the autonomy of people and by another implements foreclosure practices and new forms of borders (Vacchiano, 2011; Van Haken, 2008). The field research shows that this happens on different levels due to specific material factors (location and capacity of the centres, management of internal spaces, activation of the services provided, etc.) and through the daily practices of the operators who, in a more or less assenting, controlling and disciplining the people hosted, shape their conduct. Therefore, in the daily life of the structures in which the situations described are involved, the principles of freedom, inclusion and autonomy supported by the rhetoric of reception system are governed by a neoliberal logic of citizenship that suggests the criteria to distinguish, in the same integration paths, who is more worthy than other beneficiaries (Van Haken, 2008). Although the case study highlights strong contradictions and weaknesses that come to life in the implementation of the SPRAR model, it also shows the realization of a good reception. That which, despite being included in an extremely complex context such as Rome, attempts to oppose the "logic of large numbers and profits" of large cooperatives and which implements functional inclusion paths to achieve the objectives. Alignment and consistency with the guidelines and the SPRAR operating manual, in fact, allow the construction of a real project of individualized socio-economic integration for the person hosted. Only by acting in a widespread manner on the territory, in apartments or small centres, the genesis of new forms of borders beyond those already present is avoided. In fact, through this management most of the risks identified are eliminated or at least reduced, precisely because the "trajectory of opportunities" of risk (Reason, 1997) towards unfavourable outcomes generally develops within large collective centres. Research on economic growth and development in developing countries has often highlighted the role of liberalisation policies (economic and political) in improving economic performance in the developing world. In sub-Saharan Africa, in particular, efforts at fostering economic growth and development have not only resulted in the adoption of these policies, but have also led to the proliferation of regional economic integration (include monetary unification). Nonetheless, the impact of these policies on economic performance continues to be a subject of debate among policy makers, development partners, academic researchers, and the international community at large. This debate has become increasingly important in light of the challenges facing the aforementioned agents in helping to improve the economic performance of these countries. This thesis focuses on this topic providing empirical evidence for sub-Saharan African countries. The first chapter uses post-liberalisation data on Ghana and focuses on the extent to which trade openness and foreign aid inflows impact on economic growth. Ghana, being one of the forerunners to adopt liberalisation policies in sub-Saharan Africa, has received commendations from the international community for its post-liberalisation economic growth performance. This has increased government commitment in recent years to open the economy to international competition. Moreover, foreign aid inflows over the period have been relatively large. The study, which employs the Autoregressive Distributed Lag (ARDL) bounds testing approach to cointegration, provides empirical findings, which clearly indicate that the impact of both trade openness and foreign aid on Ghana's post-liberalisation economic growth is positive and statistically significant in both the short-run and the long run, although this is somewhat reduced by their interaction. In addition, the study reveals long run economic growth benefits of Ghana's political system whilst government spending and labour force performance retarded economic growth over the study period. The empirical findings and policy recommendations are relevant for Ghana's long-term economic growth policy reforms. The second chapter, taken cognisance of the fact that sub-Saharan Africa has been characterised by low-income levels for decades, analyses the impact of economic globalisation and democracy on income levels in the area using panel cointegration techniques. The study considers a composite indicator for economic globalisation and several indicators of democracy and highlights the essence of the simultaneous adoption of economic globalisation and democracy for sub-Saharan African countries. The empirical results, based on a sample of 31 countries over the period 1980-2005, clearly indicate that, whilst the total long run impact of economic globalisation on income levels has been beneficial, the total long run impact of democracy has been the bane of the level of income in sub-Saharan Africa. The study concludes that policy reforms should be aimed at improving democratic institutions in sub-Saharan Africa for its potential benefits to be realised The third chapter focuses on the implications of trade openness, foreign aid and democracy for the fulfilment of Wagner's law in West African Monetary Zone (WAMZ) countries. Although the impact of trade openness, foreign aid and democracy on government expenditure in developing countries has been emphasised in the literature in recent decades most recent studies of Wagner's law have often neglected the increasing role played by these policy variables. The study provides an empirical analysis of the long run implications of trade openness, foreign aid and democracy for the fulfilment of Wagner's law in WAMZ countries using panel data techniques for the period 1980-2008. The study finds the existence of Wagner's law in WAMZ countries, but only when the role of these policy variables has been catered for. The analysis concludes that, if these countries are to meet the fiscal convergence criteria and ensure the sustainability of a single currency area, explicit sets of restraint on the national authorities and innovative and efficient ways of domestic revenue generation necessary to ensure that government revenue keep pace with its expenditure become crucial, because the monetary union by itself may not necessarily ensure fiscal discipline. The fourth chapter focuses on the relationship between democracy, government spending, and economic growth. Although, economic theory predicts that various core functions of governments are growth enhancing, its spending in non democratic countries often goes beyond these core functions, namely into rent-seeking and non-productive activities. The study employs the Autoregressive Distributed Lag (ARDL) bounds testing approach to cointegration to investigate the extent to which democracy and government spending have had an impact on economic growth in Ghana over the period 1960-2008. The empirical results obtained are encouraging, revealing support for the high efficiency of government spending in democracies hypothesis. The study demonstrates that democracy and government spending go hand in hand in providing a complementary role to impact positive on economic growth in Ghana in both the long-and short-run. The fifth chapter investigates the impact of trade openness on economic growth and development for a sample of 85 middle-income countries over the period 1970-2009. The study employs non-stationary heterogeneous panel cointegration techniques that take into consideration the impact of cross-section dependence. The analysis reveals four important findings. Firstly, that trade openness has been one of the main drivers of the level of development, but not of economic growth in middle-income countries. Secondly, that trade openness is both a cause and a consequence of the level of development in middle-income countries. Thirdly, that neglecting the impact of cross-section dependence overestimates the coefficient linked to the long-run relationship between trade openness and development. Lastly, and most importantly, that these results are consistent for all the 20 middle-income sub-Saharan African countries included in the sample.
Dottorato di ricerca in Diritto dei contratti pubblici e privati ; La trattazione vuole offrire un inquadramento generale della cessione di cubatura a seguito dell'emanazione della legge 12 luglio 2011 n. 106 di conversione del d.l. 13 maggio 2011 n. 70. La normativa ha introdotto all'articolo 2643 c.c. rubricato ‹‹atti soggetti a trascrizione››, il numero 2-bis che ha disposto in modo del tutto innovativo la necessità di trascrivere ‹‹i contratti che trasferiscono, costituiscono o modificano i diritti edificatori comunque denominati, previsti da normative statali, regionali o da strumenti di pianificazione territoriale›› . I problemi teorici e applicativi posti dalla novella sono numerosi e particolarmente complessi. L'espressione utilizzata dal n. 2-bis, infatti, pur definendo la disciplina pubblicitaria, non esplicita né quali siano i caratteri essenziali di cui si compone il contratto che trasferisce la volumetria, né la natura dei ‹‹diritti edificatori››. L'obiettivo dello studio è pertanto quello di identificare oltre ai tratti caratteristici della cessione di cubatura, un modello contrattuale idoneo a garantire la circolazione della potenzialità edificatoria e soluzioni operative che possano rimanere immuni ai mutamenti giurisprudenziali, con la finalità precipua di verificare se il n. 2–bis, abbia posto le basi per un mercato dei ‹‹diritti edificatori›› volto ad un più efficace sfruttamento della proprietà immobiliare. Per farlo, nel Capitolo I si è ritenuto opportuno prendere le mosse da problematiche antiche e mai del tutto risolte inerenti agli accordi di ‹‹micropianificazione ad iniziativa privata›› (di cui la cessione di cubatura è espressione) ed allo ius aedificandi, al fine di individuare i limiti e le modalità di esercizio del potere di costruire soprattutto con riferimento ai rapporti con la p. a. La disamina non ha inoltre potuto prescidere da un'analisi dei più recenti strumenti di perequazione, compensazione ed incentivazione che rappresentano un'evoluzione rispetto all'originaria prassi applicativa. Indagato il ‹‹contenuto complesso›› dello ius aedificandi e la natura giuridica del permesso di costruire, si è potuta affrontare nel Capitolo II la spinosa problematica della natura giuridica dei trasferimenti di volumetria. A seguito di un esame dei principali teorizzazioni come ‹‹bene immateriale››, come ‹‹chance›› e come nuovo ‹‹diritto reale tipizzato›› si è potuto rilevare, anche attraverso un'analisi applicativa dell'istituto a vari negozi tipici ed ai diritti di godimento e di garanzia (Capitolo III), come la sola ricostruzione che possa assicurare un effettivo utilizzo dell'istituto è quella che riesca a farne interagire la natura privatistica e pubblicistica in uno sforzo di integrazione coerente tra le diverse materie. Pertanto, sul presupposto che l'interprete debba, prima di tutto, attenersi al dettato della norma, la soluzione di un nuovo diritto reale, caratterizzato da un'imprescindibile connessione con il provvedimento amministrativo, è apparsa maggiormente in linea con il dettato normativo ed in grado di assicurare un ampio utilizzo dell'istituto. Nel Capitolo IV l'attenzione si è quindi focalizzata sui caratteri costitutivi del contratto. In primis si è sottolineata l'importanza dell'accordo privatistico quale momento genetico della vicenda circolatoria attraverso una nuova lettura del tradizionale rapporto soggetto-oggetto, in cui l'autonomia negoziale assume una forza creatrice divenendo il veicolo mediante il quale si sostanzia il processo creativo voluto dalle parti atto a ‹‹generare l'oggetto del contratto›› (la cubatura). In secundis si è tentato di individuare il modo in cui diritto privato e diritto amministrativo convivono all'interno della cessione di cubatura, rinvenendo la chiave di congiunzione nell'elemento accidentale della ‹‹condizione››, rappresentata dal provvedimento amministrativo. Ne è emerso un istituto complesso che si compone necessariamente di due momenti: uno genetico (regolato dal diritto privato) ed uno applicativo (disciplinato dal diritto amministrativo). La particolare struttura dell'istituto esprime d'altra parte una tendenza sempre più diffusa a considerare l'ordinamento come un unicum, in cui i distinti sistemi normativi ‹‹perdono›› il proprio primato se collocati all'interno dell'ordinamento giuridico unitario. Stabilito in che termini diritto privato e diritto amministrativo dialogano tra loro e superato l'impasse della qualificazione giuridica, è stato possibile valutare le prospettive future di un mercato dei trasferimenti di volumetria. Considerato il quadro generale esistente in Italia e facendo tesoro delle considerazioni che sono derivate da uno studio del TDRs statunitense (Capitolo V), si è giunti a ritenere come agli intenti ambiziosi dei lavori preparatori non sia corrisposta un'opera di codificazione all'altezza dei propositi perseguiti a causa della mancanza di un framework di principi comuni da imporre su scala nazionale. In una prospettiva de iure condendo si è dunque tentato di ovviare alla carenza di un (auspicabile) intervento legislativo volto a definire più chiaramente i caratteri dell'istituto, proponendo alcune soluzioni applicative e teorizzando le possibili modifiche normative da introdurre nel codice civile per assicurare un maggiore e più sicuro utilizzo dei trasferimenti di volumetria. ; The Ph.D. thesis aims to provide a general framework of the transfer of development rights, following the issuance of the law 12 July 2011 n. 106 of converting d. l. 13 May 2011 n. 70. The legislation introduced in article 2643 c.c. entitled ‹‹instruments subject to registration››, the number 2-bis which places, in a completely innovative way, the need to record in a public register ‹‹contracts that transfer, constitute or modify the development rights, however denominated, provided by State or regional regulations, or by planning instruments››. The theoretical and applied problems posed by the new provision are numerous and very complex. In fact, the expression used by n. 2-bis does not express what are the essential characteristics of the contract which transfers the ‹‹development rights›› and their legal status. Therefore the aim of the thesis is to identify the characteristic features of the institute and also a contract scheme that could be able to ensure the transmission of the development rights for finding practical solutions, immune to judicial decisions. The principal aim is to verify whether the n. 2-bis has laid the foundations for a market of development rights, for a more efficient use of real estate. The Chapter I deals with ancient and never fully resolved problems related to the microplanning agreements (of which transfer of development rights is an expression) and related to the power to built, in order to identify the limits and procedures for exercising the right to build, especially in relation to the powers of the public administration. Moreover the analysis does not leave aside the latest tools of equalization, compensation and incentives that represent an evolution from the original archetype. After reviewing the complex content of the right to build and the legal status of building permits issued by the municipality, the Chapter II deals with the issue of the legal status of transfer of development rights. The analysis of the main theories as an ‹‹immaterial good››, such as ‹‹chance›› and as a ‹‹new land right›› show that the only feasible solution that can ensure an effective use of the transfer of development rights is the one that can make interact the private nature and public one in an effort of coherent integration between the different fields of law. On the assumption that the interpreter must, first of all, follow the wording of the rule, the solution of a new land right, characterized by an essential connection with the administrative measure, it appear nearer with the provision of the law and can ensure wide use of the institute. Therefore in Chapter IV, attention is focused on the characteristics of the contract. In the first place it is emphasized the importance of private agreement like ‹‹fundamental moment›› of transfer of development rights, through a new interpretation of the traditional relationship between ‹‹subject›› and ‹‹object››, in which the contractual autonomy has a creative force and became the vehicle through which the land rights is generated. Second attempt is made to identify the way in which private law and administrative law coexist, finding the key junction of the two moments in the element of the accidental ‹‹condition››, represented by building permit. What emerges from the examination is a complex institution that consists of two parts: one governed by private law and one determined by administrative law. The particular structure of the institute shows that the two areas of law, lose their primacy if placed within the unit legal system. After determining how private and administrative law interact with each other and overcoming the deadlock of the legal status, it is possible to assess the future prospects of a market of transfer of development rights. Based on the current Italian situation and building on the considerations that are derived from a study of the USA TDRs (Chapter V), it can be argued that the number 2-bis is not able to achieve the ambitious goals that the legislator wanted to accomplish, due to the lack of a framework of common principles to be imposed at national level. In the concluding remarks, in a proactive perspective, are proposed some application solutions and are theorized some possible legislative changes to be introduced in the Civil Code, to ensure a greater and safer use of development rights.
Dottorato di ricerca in Scienze e tecnologie per la gestione forestale e ambientale ; La Commissione europea ha richiesto, ai paesi membri, una maggiore finalizzazione degli interventi, secondo un percorso logico e conseguente fra analisi dei fabbisogni, strategia di intervento e misure proposte, con il rispetto degli Orientamenti strategici comunitari (OSC) 2007- 2013 per lo sviluppo rurale. L'Italia ha recepito le indicazioni europee delineando un Piano strategico nazionale (PSN) per lo sviluppo rurale la quale finalità è quella di garantire la coerenza strategica tra i piani comunitari, nazionali e regionali e di garantire il raccordo strategico e finanziario tra gli strumenti di sviluppo rurale, la PAC e le politiche di coesione. In esso si definiscono: - L'analisi del contesto; - Le linee di indirizzo generale per le politiche di sviluppo rurale; - La coerenza con le altre politiche di intervento nazionali comunitarie; - Il quadro finanziario comune; - Aspetti comuni per il monitoraggio e la valutazione, controlli e le sanzioni; - I Piani di sviluppo rurale (PSR) e la loro dotazione finanziaria. Nell'ambito del Piano strategico vengono individuate alcune tipologie di indicatori da utilizzare nel processo di programmazione quali strumenti necessari per conoscere i progressi, l'efficienza e l'efficacia dei Programmi di Sviluppo Rurale (PSR). Infatti, oltre ai tradizionali indicatori finanziari, di realizzazione, di risultato e di impatto vengono introdotti gli indicatori di baseline, con i quali è possibile definire la situazione iniziale del contesto su cui agisce il programma, descrivendola anche in termini di punti di forza e debolezza, permettendo così di inquadrare al meglio la strategia d'intervento della politica di sviluppo rurale e creando i parametri su cui valutare successivamente l'efficacia della programmazione. In particolare, per l'analisi della situazione ambientale sono stati proposti i seguenti indicatori baseline: biodiversità: avifauna delle aree agricole, aree ad alto valore naturale, composizione delle specie forestali. Sulla base di questi orientamenti, sia a livello europeo che nazionale, questo lavoro propone una metodologia alternativa alle linee guida proposte dall'EEA, in cui si tenga conto dei fattori strutturali del territorio per l'individuazione delle aree agricole ad alto valore naturalistico (HNVF). Lo scopo principale dell'individuazione delle aree agricole ad alto valore naturalistico è legato al mantenimento della biodiversità nelle aree agricole, ciò implica un aumento del valore paesaggistico e crea allo stesso tempo il mantenimento delle pratiche agricole tradizionali o specifiche. L'individuazione delle HNVF è una questione di notevole rilevanza sia a livello di pianificazione territoriale il cui obiettivo è quello di preservare in un contesto dinamico queste aree per una agricoltura sostenibile, sia a livello esecutivo per redigere piani operativi di intervento e finanziamento. La gestione del territorio dipende da delle decisioni che agiscono a livello spaziale. Per questo motivo si è deciso di utilizzare i Sistemi Spaziali di Supporto alla Decisione (Spatial Decision Support Systems). Sono sistemi informatici che lavorano attraverso un'integrazione di diverse informazioni e determinano l'ordinamento delle alternative sulla base di specifici criteri. Tali strumenti integrano i Sistemi Informativi Geografici, i modelli spaziali e l'Analisi Multicriteriale per arrivare a definire una gestione che rispetti le dinamiche dei sistemi naturali ed esprima una decisione integrante i diversi criteri. Questo studio ha lo scopo di proporre un percorso metodologico per l'individuazione delle aree agricole ad alto valore naturalistico alternativo a quello attualmente proposto dall'EEA. Si prefigge lo scopo di identificare "aree sensibili" della Provincia di Viterbo dove più rilevanti possono essere gli impatti delle attività antropiche e più efficaci le misure di mitigazione, cioè, dove pratiche agricole opportune possono quindi condurre a risultati migliori. Questo obbiettivo può essere raggiunto attraverso una pianificazione per "processi" cioè che tenga conto delle peculiarità del territorio. L'obiettivo della presente ricerca è quello di sviluppare un Sistema Spaziale di Supporto alla Decisione, applicato all'individuazione delle aree agricole di elevato valore naturalistico, che tengano conto della complessità del sistema rurale, ambientale, sociale ed economico e delle relazioni fra le sue variabili. Alle aree rurali viene, quindi, riconosciuto un ruolo all'interno del sistema dinamico ambientale, come elemento di connessione con gli ambienti naturali limitrofi, tale approccio si basa sull'individuare e preservare il rapporto tra sistemi di habitat al fine di migliorare il grado di biodiversità. Principale obiettivo è la realizzazione di una cartografia delle "aree sensibili" ottenuta seguendo una procedura di analisi multicriteriale valutando il grado di influenza dei fattori "strutturali" ambientali e antropici in funzione della loro distanza e densità. ; The European Commission demanded from the member countries a better finalisation of the intervention following a logical and consequent path between analyses of needs, strategy of intervention and proposed measures, regarding the Community Strategic Guidelines 2007-2013. Italy has acknowledged the European guidelines outlining a national strategic plan (Piano strategico nazionale, PSN) for rural development, with the aim to guarantee the strategic coherence between the communitarian, national and regional plans and to guarantee the strategic and financial connection between the instruments of rural development, the PAC and the policies of cohesion. In this strategic national plan are defined the following aspects: - Analysis of the context; - The general guidelines for the policies of rural development, - The coherence between other national communitarian policies of intervention; - The common financial table ; - Common aspect for monitoring evaluations, controls and sanctions; - The national strategic plans of rural development and their financial endowment. In the ambit of the strategic plan are singled out several typologies of indicators, which can be used for the programming process as necessary instruments to understand the progress, the efficiency and efficacy of the programs of rural development (PSR). In fact, in addition to traditional indicators of finance, realisation, result and impact, are being introduced the baseline indicators, with which it is possible to define the initial state of the context in which the program operates, describing it in terms of points of strength and points of weakness. This baseline indicators permits to define in the best possible way the strategy of intervention of the policy of rural development, and creating the parameters, which help to evaluate successively the efficiency of the programming. In particular for the analysis of the environmental state, have been proposed the following baseline indicators: Biodiversity: bird population of the agricultural areas, High Nature Value Farmland, composition of the forest species. Based on this directions, both on the European level and on the National level, this work proposes a alternative methodology to the guidelines proposed by the EEA, in which are taken in account the structural factors of the territory that locates the High Nature Value Farmland (HNVF). The principal aim, to locate the High Nature Value Farmland, is linked to the maintenance of the biodiversity of the agricultural areas. This implicates an increase in the value of the landscape and creates in the same time the maintenance of the traditional, specific and agricultural practices. To locate the High Nature Value Farmland is an important matter both in a territorial planning level, in which the aim is to preserve in a dynamic context these areas for a sustainable agriculture, and in an executive level to draw up the operational plans of intervention and finance. The management of the territory depends on the decision that act in a spatial level. For this reason it has been decided to use Spatial Decision Support Systems. They are information systems that work with the integration of different information and they determine the arrangement of the alternatives based on specific criteria. This instruments integrate the Geographical Information Systems, the Spatial Models and the Multi-Criteria Analyses with the aim to define a management that respects the dynamic of the natural systems and that shows an integrated decision between different criteria. The aim of this thesis is to propose an alternative methodological path for the location of the High Nature Value Farmland, to the actual path proposed by the EEA. It has the aim to identify "sensitive areas" of the province of Viterbo, where the impacts of the anthropic activity can be more relevant and the measures of mitigations more efficient, that is, where opportune agricultural practice can lead to better results. This aim can be reached through planning of "processes", that is taking in account the peculiarity of the territory. The goal of this research is to develop a Spatial Decision Support System, applied to the location of the High Nature Value Farmland that takes in account the complex city of the rural, environmental, social and economical system and of the relation between its variables. To the rural areas then it is recognised a role within the environmental dynamic system as a connecting element with the surrounding environments. This approach is based on locating and preserving the relation between habitat systems with the aim of increasing the level of biodiversity. The main objective is the realisation of a cartography of the sensitive areas obtained following a multi-criteria analysis procedure, evaluating the level of influence of the environmental and anthropic structural factors depending on their distance and density.
Gli eurobond non sono un tema nuovo. Sono presenti nella letteratura economica, meno in quella giuridica, da oltre trent'anni, con denominazioni che spesso mutano a seconda delle formulazioni proposte. Rientrano in quella categoria di idee che hanno valore non solo sotto il profilo della tecnica finanziaria o della finanza pubblica, ma anche perché rappresentano un primo passo verso la realizzazione di un'unione politica dell'Europa. I favorevoli vedono in questo tipo di proposte non solo una risposta alla crisi attraverso il finanziamento degli investimenti pubblici, ma anche la costruzione di una politica fiscale europea da affiancare a quella monetaria della Banca centrale europea. Gli scettici pongono, invece, l'accento sui tempi troppo lunghi che tali proposte richiederebbero per essere attuate e sul consenso non unanime che esse riscuotono da parte dei Paesi dell'Eurozona. L'introduzione degli eurobond presenta, infatti, ostacoli legali e distributivi. Quelli legali hanno a che fare, in particolare, con l'articolo 125 del Trattato sul Funzionamento dell'Unione europea (TFUE), che dispone il divieto di salvataggio da parte dell'Unione a favore di un Paese membro in difficoltà e, in particolare, vieta a ciascuno Stato membro di rispondere o di subentrare nei debiti di altri Stati membri (cosiddetta "clausola di no bail out"). Gli ostacoli distributivi sono legati alle modalità di partecipazione dei Paesi membri alle emissioni congiunte dei titoli del debito europeo in termini di risorse finanziarie e ai timori dei Paesi virtuosi del Nord Europa di dover fornire un contributo maggiore rispetto ai Paesi meno virtuosi del Sud Europa. La tesi affronta, innanzitutto, il tema della fragilità della costruzione europea, che dipende essenzialmente dall'aver creato – contrariamente a quanto avvenuto nella storia dei popoli – "una moneta senza Stato". Questa circostanza ha condotto, alla fine del 2009, alla crisi dell'euro e dei debiti sovrani. Per rimediare a tale fragilità istituzionale, bisognerebbe por mano a una serie di riforme come il rafforzamento del ruolo della Banca centrale europea come prestatore di ultima istanza, il completamento dell'unione bancaria, l'approfondimento dell'unione del mercato dei capitali, l'allargamento del bilancio europeo e l'accentramento delle politiche fiscali nazionali. Tra queste riforme rientra anche quella di dar vita all'emissione congiunta di debito sovrano a livello di Eurozona, o, in alternativa, a schemi che non prevedono la mutualizzazione del debito. Al riguardo, la ricerca prende in esame l'esistenza di eventuali basi giuridiche per emettere un debito federale dell'Unione europea, distinto dal debito degli Stati membri o, in alternativa, per procedere alla mutualizzazione dei debiti degli Stati membri. La tesi passa, poi, in rassegna le varie proposte avanzate in tema di eurobond, classificandole in due gruppi principali, a seconda che prevedano o meno la mutualizzazione del debito. Nell'ambito delle proposte che si basano sulla mutualizzazione del debito rientrano gli eurobond in senso stretto, gli union bond, gli stability bond, le obbligazioni blu e rosse. Tali proposte, in quanto fondate sulla mutualizzazione del debito, non sono compatibili con l'articolo 125 del TFUE e richiederebbero pertanto la sua modifica. Nel secondo gruppo di proposte – che non contemplano la mutualizzazione del debito e pertanto non richiedono la modifica del TFUE – rientrano il programma PADRE (Politically Acceptable Debt Restructuring in Europe), il Fondo di ammortamento del debito a livello europeo (European Redemption Fund), gli European Safe Bond - ESB (acronimo inglese di "Titoli europei sicuri"), i Sovereign Bond Backed Securities - SBBS (acronimo inglese di "Titoli garantiti da obbligazioni sovrane"). La ricerca esplora i possibili approcci alla prosecuzione del progetto europeo: la via della riduzione del rischio (risk-reduction), la via della condivisione del rischio (risk-sharing), la via della sintesi tra riduzione e condivisione del rischio. Quest'ultima via appare a chi scrive come l'unica politicamente percorribile. La stessa unione monetaria si è realizzata come combinazione tra i due approcci: il processo di convergenza delle finanze pubbliche (risk reduction) ha condotto alla creazione di un'unica banca centrale con il compito di mettere in atto un'unica politica monetaria e del cambio (risk sharing). Vi è però la necessità per l'Italia di fare la propria parte invertendo la traiettoria del rapporto debito-Pil attraverso un serio e rigoroso piano pluriennale di rientro dal debito (risk reduction), per acquisire, agli occhi dei principali partner europei, quella credibilità necessaria per convincerli a dar vita a un vero e proprio debito federale europeo (risk sharing). Gli eurobond non sono l'unico mezzo per raggiungere la finalità di una unificazione politica dell'Europa ma hanno il pregio di mettere insieme l'approccio funzionalista dei passi graduali con quello federalista della meta finale. Analogamente a quanto avvenuto nella storia di alcuni popoli (in particolare negli Stati Uniti d'America) in cui il processo di unificazione dei debiti ha segnato la nascita dello Stato, anche nel vecchio continente l'europeizzazione del debito degli Stati membri, al di là della valenza in termini di finanza pubblica, potrebbe assurgere a un vero e proprio atto "costitutivo" di un futuro Stato federale europeo. Sotto il profilo metodologico, la ricerca è stata condotta attraverso la strumentazione propria dell'analisi economica del diritto, nella consapevolezza che il mercato – vale a dire il meccanismo economico che orienta il comportamento di individui e gruppi – da solo non è sufficiente ma ha bisogno di regole per poter funzionare. Anzi, se ben regolato, il mercato può essere fattore di sviluppo e di benessere. Questo ragionamento vale anche per il mercato comune e per la moneta unica europea, che da soli non bastano più. Come si è tentato di mostrare in questo lavoro, anche l'Eurozona, per poter sopravvivere e progredire, ha bisogno di un adeguamento delle proprie istituzioni che passa anche attraverso l'emissione congiunta di debito sovrano. Coerentemente con tale impostazione, l'indagine cerca di avere un approccio critico al tema degli eurobond, tentando di analizzarne i singoli aspetti con indipendenza di giudizio. La stesura dei capitoli e dei singoli paragrafi è stata preceduta da un lavoro di documentazione e consultazione di testi, riviste specializzate e articoli. Le conoscenze teoriche acquisite e le idee maturate sono state verificate sul campo, grazie ad un confronto diretto con i dirigenti che, nell'ambito del Dipartimento del Tesoro del Ministero dell'Economia e delle Finanze, hanno la responsabilità dell'emissione e della gestione del debito pubblico italiano. Chi scrive lavora presso la direzione del Debito pubblico del Dipartimento del Tesoro; cionondimeno, le opinioni che qui esprime sono personali e non rappresentano o impegnano in alcun modo l'amministrazione di appartenenza. Alla luce delle considerazioni svolte, si ritiene che davvero gli eurobond possano spingere l'Eurozona verso una maggiore integrazione politico-istituzionale. L'analisi economica e giuridica può dare il proprio contributo alla comprensione della questione, ma la scelta dei passi da compiere in concreto spetta alle leadership politiche europee in quanto investite del consenso popolare. Il ricercatore può esporre gli effetti che derivano dall'adozione di una particolare misura o di uno specifico strumento. Oltre non può andare. ; Eurobonds are not a new topic. They have been present in the economic literature, less in the legal literature, for thirty years, with denominations which change according to the proposed formulations. They are relevant not only in terms of financial economics or public finance, but also because they represent a first step towards the realization of a political union of Europe. Those in favor look at eurobonds not only as a response to the crisis through the financing of public investments, but also as a tool to build up a European fiscal policy in addition to the monetary policy of the European Central Bank. On the contrary, the skeptics underline the fact that such proposals would require too mach time to be implemented and the fact that they have short consent in the Eurozone countries. The introduction of eurobonds presents legal and distributive barriers. The legal barriers are linked to the Article 125 of the Treaty on the Functioning of the European Union (TFEU), which provides for so-colled "no bail out clause" ("A Member State shall not be liable for or assume the commitments of central governments, regional, local or other public authorities, other bodies governed by public law, or public under¬ takings of another Member State"). The distributive obstacles, on the other hand, are linked to the way in which Member States could participate in joint issuance of European debt securities. In particular, the virtuous countries of Northern Europe are afraid that they would pay a greater share than the less virtuous countries of the Southern Europe. First of all, the thesis analyzes the fragility of the European institutions, which depends essentially on having created – contrary to what has happened in the history of peoples – "a currency without a State". In the end of 2009, this fragility led Europe to the crisis of euro and sovereign debts. To face this fragility, some institutional reforms should be carried out, such as the strengthening of the role of the European Central Bank as a lender of last resort, the completion of the banking union, the deepening of the capital market, the enlargement of the European budget and the centralization of national fiscal policies. These reformes also include the joint issuance of sovereign debts of Eurozone Member States. In this regard, the research examines the existence of possible legal bases for issuing a federal debt of the European Union, different from the debt of the Member States or, alternatively, for joint issuing the debt securities of the Member States. Secondly, the thesis examines the various proposals of eurobonds, classifying them in two main groups. The first group, based on the joint issuance of debt, includes eurobonds in the strict sense, union bonds, stability bonds, blue and red bonds. These proposals, being based on the joint issuance of debt, are contrary to Article 125 of the TFEU and therefore would require its modification. The second group of proposals – which do not contemplate the joint issuance of debt and therefore do not require the modification of the TFEU – include the PADRE program (Politically Acceptable Debt Restructuring in Europe), the European Redemption Debt Fund, the European Safe Bonds, the Sovereign Bond Backed Securities. Thirdly, the research explores the possible approaches to the continuation of the European project: the risk-reduction path, the risk-sharing path, the synthesis between risk reduction and risk sharing. This third path seems to be the only politically feasible. As we know, also the monetary union was realized as a combination of the two approaches: the process of convergence of public finances (risk reduction) led to the creation of a single central bank with the task of managing a single monetary policy (risk sharing). However, Italy has to reverse the trend of the debt-to-GDP ratio through a serious and rigorous long-term debt reduction plan (risk reduction), in order to convince the main European partners to issue European federal debt (risk sharing). Eurobonds are not the only tool to achieve the goal of a political unification of Europe but they have the merit of putting together the functionalist approach based on the gradual steps with the federalist approach based on the final goal. Similarly to what has happened in the history of some peoples, such as the United States of America, where the process of unification of debt of the single States has marked the birth of the federal State, even in Europe the consolidation of debt of the Member States might be a constitutive act of the United States of Europe. Methodologically, the research is based on the economic analysis of law. According to this view, market – the economic mechanism which guides the behavior of individuals and groups – is not enough but needs good regulation. Indeed, if it is well regulated, market may be a factor of development and welfare. This way of thinking is also valid for the European single market and for the euro, which are no longer enough. As we have tried to show in this work, also the Eurozone institutions need a deep reform – including the joint issuance of sovereign debt – for their surviving and progress. This work tries to have a critical approach to the topic of eurobonds. The theoretical knowledge and ideas have been checked thanks to a direct dialogue with managers who, within the Treasury Department of the Ministry of the Economy and Finance, are responsible for issuance and management of the Italian public debt. The author of this research works in the Public Debt Directorate at Treasury Department; nevertheless his opinions are personal and do not represent the Treasury Department. For these considerations, eurobonds might really push the Eurozone towards a greater political and institutional integration. The economic and legal analysis may give its contribution to the debate, but the actual choices are up to the European policy-makers.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
