Temsilde adalet ilkesi açısından genel seçimlerde ittifak ; Alliance in general elections in terms of the principle of justice in representation
Türkiye'de parlamento seçimlerinde 1961'den beri d'Hondt sistemi uygulanmaktadır. Ayrıca parlamento seçimlerinde ulusal düzeyde uygulanan yüzde onluk seçim barajı mevcuttur. Ülkemizde uygulanan barajlı d'Hondt sistemi, büyük partiler lehine sonuçlar ortaya çıkarmaktadır. Ulusal düzeyde uygulanan yüzde onluk seçim barajı da küçük partilerin parlamentoya girmesini engelleyerek büyük partilerin aşırı temsil elde etmesini sağlamaktadır. Bu nedenle ülkemizde genel seçim sonuçlarıyla parlamento aritmetiği arasında bir adaletsizlik ortaya çıkmaktadır. Ülkemizde uzun yıllar boyunca temsilde adaletin sağlanamadığı bir parlamento yapısı ortaya çıkmıştır. Buna karşılık "İttifak Yasası" olarak bilinen yeni düzenlemeden sonraki ilk seçimler olan 24 Haziran 2018 seçimleri sonucunda parlamentoda temsilde adaletin neredeyse tam olarak sağlandığı görülmektedir. "İttifak Yasası" yüzde ondan daha az oya sahip küçük partilerin parlamentoya girmesinin önünü açmaktadır. Bu nedenle ittifak kurumu, ilk etapta temsilde adalet açısından olumlu bir düzenlemeymiş gibi görünmektedir. Buna karşılık ittifak kurumunun büyük ittifakların d'Hondt sisteminden faydalanarak daha fazla aşırı temsil elde etmesi ve ittifak içinde bulunmayan küçük partilerin adaletsizliğe uğrayabilmesi gibi olumsuz sonuçları da olabilecektir. Sonuç olarak bu makalede ittifak kurumunun temsilde adalet ilkesi açısından gerçekte nasıl bir anlam ifade ettiği inceleme altına alınmaktadır. ; In Turkey, the d'Hondt system is applied in the parliamentary elections since 1961. There is also ten percent national election threshold in parliamentary elections. In Turkey, the d'Hondt system generally benefits to large parties. In addition, ten percent national election threshold provides environment for overrepresentation of large parties by prevents small parties from entering parliament. For these reasons, an injustice occurs between the results of the general elections and the arithmetic of parliament. Justice in representation hasn't provided for many years in Turkey. On the other hand, as a result of 24 June 2018 election which is the first elections following the new regulation known as the "Alliance Law', justice in representation in parliament is almost fully achieved. The alliance paves the way to enter parliament for small parties which has got under ten percent of vote to. Therefore, at first view, the alliance seems to be a positive regulation in terms of justice of representation. On the other hands, the alliance causes large parties in large alliances gain more overrepresentation by using of advantages of the d'Hondt system. And in the new election system, small parties which isn't in any alliance can't enter the parliament, so the "Allience Law" causes to injustice between parties within an allience and not within an alliance. As a result, this article examines what the alliance actually means in terms of the principle of justice in representation.
