Ukraine crisis is a manifestation of acute geopolitical rivalry between the West and Russia for inluence in Ukraine. A particular, bilateral aspect of this crisis is the limited conlict between Russia and Ukraine, in which the latter has lost Crimea and combats separatism in its eastern oblasts, Donetsk and Lugansk. The classical theories of political realism represented by Hans Morgenthau and Frederick Hartmann as well as offensive realism of John Mearsheimer are used to conduct the analysis of international aspect of this crisis. From this research perspective the article presents a brief history of the crisis and the motives of engaged parties, the West – including the United States, Poland and the European Union, as well as the motives of Russia. The paper highlights the rivalry level: geopolitical area over the spheres of influence, moreover military-strategic area as well as economic one. The author presents the consequences of the crisis for Ukraine, Poland and international order. And finally reflects on the key question – how out of the crisis? He presents proposals that suggest more restraint in the position of all parties involved in the crisis, and concludes that the crisis has shown that without cooperation with Russia is not possible an extension of Western influence and to realize the dream of Ukrainians of joining the European Union.

Po drugie, jako globalnego przywódcy w latach 90., w czasie uważanym za "jednobiegunowy moment" (B. Clinton). Po trzecie, upadłego hegemona po fiasku narzucenia światu globalnej hegemonii w czasie podwójnej kadencji G.W. Busha. Wreszcie, powściągliwego przywództwa USA sprawowanego przez B. Obamę. Trzydziestoletnie globalne przywództwo jak się zdaje wyczerpało moralnie Amerykę, co pokazała elekcja D. Trumpa. Ten wybór stawia pod znakiem zapytania przyszłość USA jako globalnego przywódcy. ; Article presents an international role of the United States during the last thirty years. More specifi - cally, we can talk about four subsequent roles of America in this period. First, as a leader of free world and a rival of the Soviet Union at the end of Cold War (G.H. Bush). Second, as a global leader in the 90s: time of the "unipolar moment" (B. Clinton). Third, a failed hegemon after unsuccessful bid for hegemony during the double term of G.W. Bush. And fourth, restraint leadership of the US exercised by B. Obama. Thirty years of global leadership seems to have exhausted morally America as it has been shown by the election of D. Trump. This choice puts under question future of the U.S. as a global leader.

The right to freedom of expression and the irremovability and appointment of judges - democratic standards of the Council of EuropeThe right expressed in Article 10 of the Convention stresses the importance of the freedom of expression and the freedom of information as the cornerstones of ademocratic and pluralistic society. The main issue in this article is defining the limits of the freedom of expression enjoyed by judges in those circumstances when they are the authors of critical statements, not only when the critical opinions are addressed at judges and courts. The apolitical nature of judges means that their participation in apublic debate on current political issues should be subject to special rules. The parent value of participation in apublic debate is the special restraint. However, that does not change the fact that judges should comment on the current problems of the judicial system and the system of common courts. Judicial freedom of expression cannot be limited by asanction threat violating the principles of the irremovability and appointment of judges. ; Przepis art. 10 Konwencji oOchronie Praw Człowieka iPodstawowych Wolności podkreśla znaczenie wolności ekspresji wypowiedzi oraz wolności informacji jako kamieni węgielnych demokratycznego ipluralistycznego społeczeństwa. Celem niniejszego artykułu jest wskazanie granic korzystania przez sędziów ze swobody wypowiedzi wtej sytuacji, gdy to oni są autorami wypowiedzi krytycznych dotyczących aktualnych problemów demokratycznego ustroju państwowego, nie zaś tylko wówczas, gdy wypowiedzi krytyczne kierowane są pod adresem sędziów isądów. Apolityczność sędziów powoduje, iż ich udział wdebacie publicznej poświęconej aktualnym problemom politycznym powinien zostać poddany szczególnym zasadom. Wartością nadrzędną nadającą ramy udziału sędziów wdebacie publicznej jest powściągliwość. Nie zmienia to faktu, iż sędziowie powinni zabierać głos wsytuacji, gdy publiczna debata dotyczy funkcjonowania wymiaru sprawiedliwości czy ustroju sądów powszechnych. Wolność wypowiedzi sędziego nie może być jednak ograniczana przez groźbę sankcji przyjmującą postać naruszenia zasad nieusuwalności oraz powoływania sędziów.
