Producción Científica ; An ageing population in modern societies has put stress on public pension systems. To prevent Social Security deficits from increasing to unbounded stocks of public debt we focus on two policies: reducing the generosity of pension benefits, determined by the government, and post- poning the effective retirement age, chosen by employees. An atomistic employee would disregard the effect of his retirement decision on the public debt and would retire as soon as possible. Conversely, an ideal farsighted agency considering all current and future employees would postpone re- tirement, thereby alleviating the pressure on public debt and allowing for a more generous long-run pension. The government may design a proper incentive strategy to induce myopic atomistic decision-makers, to act non-myopically. This strategy is a two-part incentive with non-linear dependence on the stock of public debt. It is credible if deceiving em- ployees slightly adjust their retirement age decisions to increments in the public debt. ; MICINN under project ECO2008- 01551/ECON.
El aumento de las expectativas de vida en la sociedad actual determina que cada vez sea mayor el número de personas en la fase de prejubilación. Este fenómeno no es exclusivo de la población civil sino que también se da en la población militar, llamado en ella "Reserva". En el Ejército de Tierra, dependiendo del status militar que se desempeñe, pasas antes o después a la Reserva. El objetivo del presente estudio ha sido conocer de qué manera se ve afectada la salud en las personas del Ejército de Tierra que están a 1 ó 2 años de pasar a la Reserva. Para la evaluación de la variable salud se ha utilizado el cuestionario de salud de Goldberg GHQ-28. Los resultados indican que más del 80% de la población estudiada está "bien" o "muy bien" según dicho cuestionario.
Forced retirement is a complex, contradictory and conflictive figure, which allows the establishment of a limit to the right to work as a mechanism to create employment. This figure has been the object of numerous modifications throughout the democratic period and intense jurisprudence that has come to define its legitimacy and scope. It is of special interest to know its relationship with the guarantees against discriminatory acts and its current configuration, which incorporates rules from the gender perspective. ; La jubilación forzosa es una figura compleja, contradictoria y conflictiva, por la que se permite el establecimiento de un límite al derecho al trabajo como fórmula para crear empleo. Esta figura ha sido objeto de numerosas modificaciones a lo largo del periodo democrático y de una intensa jurisprudencia que ha venido a delimitar su legitimación y alcance. Resulta de especial interés conocer su relación con las garantías ante los actos discriminatorios y su configuración actual, que incorpora reglas particulares desde la perspectiva de género.
This paper evaluates the current Brazilian moment in which the pension reform is presented as the government priority. The work criticizes the purist vision as to the approach of the subject. A vision based only in law, or only in mathematics or economics. New technical aspects are presented that have never been bandied about in the Brazilian context, such as phased retirement and autonomy of the INSS. There are more sophisticated technologies than the current and traditional assessment of the matter in Brazil, in which the Actuarial Science is ignored, in the example of the populist "social deficit", or prioritizes the economic fiscalism of the minimum age of retirement. Interdisciplinarity is the most suitable answer for the pension and retirement problem in Brazil. Law, Economics, Accounting and especially Actuarial Science are presented within the inherent scientific areas concerning the Social Security field interface. ; Este artigo avalia o atual momento brasileiro no qual a reforma da previdência se enquadra na prioridade governamental. Critica-se a visão purista de abordagem do tema. Visão pautada somente em direito, ou somente em matemática ou economia. São apresentados aspectos novos que nunca foram aventados no contexto brasileiro, tais como aposentadoria fásica e autonomia do INSS. Existem tecnologias mais sofisticadas do que a aborgadem dicotomica atual e tradicional brasileira, na qual ou se ignora a atuária, o populista "déficit social", ou se prioriza o fiscalismo da idade mínima. A interdisciplinaridade é a mais adequada resposta ao problema previdencial no Brasil. Direito, Economia, Contabilidade e sobremodo Ciências Atuariais são apresentados dentro da interface inerente das áreas científicas para o campo de Seguridade Social.
The process of legislative reform driven in Spain since 2010 within the framework of the economic crisis that is plaguing the country, has touched in a significanteffect on the legal regime of the retirement. Institution which is not outside to the reform of thelegal regime of collective bargaining, which, in parallel, has been practiced in these years. Inthis sense, the adoption of legislative measures in favor of the prolongation of the active life ofthe workers and the increase in retirement age, has coincided in time with the promotion of legalenterprise collective bargaining, by declaring its applicative preference. To analyze these issuesis dedicated this article, in which, on the other hand, it highlights the lack of a crediblelegislative action in favor of the development of complementary social protection in the area ofretirement. ; El proceso de reformas legislativas impulsadas en España desde 2010, en el marco de la crisis económica que asola al país, ha incidido de forma significativasobre el régimen jurídico de la jubilación. A esta institución tampoco es ajena la reforma delrégimen jurídico de la negociación colectiva que, paralelamente, se ha practicado en estos años. Eneste sentido, la adopción de medidas legislativas en favor de la prolongación de la vida activa delos trabajadores y el incremento de la edad de jubilación ha coincidido en el tiempo con lapromoción legal de la negociación colectiva de empresa, mediante la declaración de su preferenciaaplicativa. Al análisis de estas cuestiones se dedica el presente artículo, en el que, por otraparte, se destaca la falta de una acción legislativa creíble en favor del desarrollo de laprotección social complementaria en materia de jubilación.

En el presente trabajo se estudia la movilidad jubilatoria en la provincia de Buenos Aires como un instituto clave del Derecho Social, tratando inicialmente el concepto y los contenidos básicos de la Seguridad Social, en cuyo marco se inserta y adquiere sentido la garantía de la movilidad previsional. Respecto a la misma, se dan primeramente ciertas líneas conceptuales elementales, vinculándosela luego con el Derecho Constitucional Nacional y Provincial, y de manera particularizada con la legislación y jurisprudencia local, a la vez que se la compara luego con su marco federal. El recurso a las fuentes jurídicas locales, y el análisis paralelo con el sistema nacional, propenden concretamente a aclarar los contornos del instituto bajo análisis dentro de la provincia de Buenos Aires. Finalmente, se concluye acerca del carácter operativo de la movilidad jubilatoria, y de la importancia de destacar el rol activo que el Estado debe cumplir en tal tópico. ; This paper study of retirement mobility in the province of Buenos Aires as a key institute of Social Law, initially dealing with the concept and basic contents of Social Security, within which the guarantee of social mobility is inserted and makes sense. With respect to the same, certain basic conceptual lines are given first, linking it to National and Provincial Constitutional Law, and in a particular way with local legislation and jurisprudence, and then compared with its federal framework. The use of local legal sources, and the parallel analysis with the national system, tend specifically to clarify the contours of the institute under analysis within the Province of Buenos Aires. El presente artículo analiza la proyección de esta nueva contingencia sobre las normas comunitarias de coordinación de legislaciones de Seguridad Social. Peer reviewed ; [EN] Analysing multilocality as a specific integration pattern among retirement migrants is the aim of the paper. The study shows how the search for quality of life leads retirees to make use of different properties, placed either in origin and/or destination countries. The results of quantitative and qualitative research point out that the property in the origin country is a key factor to explain migrants' lifestyle and their social integration in Spain. Furthermore, the multilocal behaviour is not equally distributed among the retirees, as it is conditioned by some migrants' socio-demographic features such as nationality or household income. ; [ES] Este trabajo analiza la multilocalidad como un patrón específico de integración entre los migrantes de retiro. El estudio realizado muestra cómo la búsqueda de la calidad de vida lleva a los retirados a utilizar diferentes viviendas, ubicadas en el país de origen y/o de destino. Los resultados de la investigación cuantitativa y cualitativa señalan que la vivienda en origen es un factor clave para explicar el estilo de vida de los migrantes y su integración social en España. Además, el comportamiento multilocal es heterogéneo, condicionado por características sociodemográficas de los retirados como la nacionalidad y los ingresos del hogar.
Resumen Las finanzas conductuales han brindado herramientas útiles para mejorar la aplicación las políticas públicas al reconocer la existencia de errores sistemáticos en la toma de decisiones. En esta investigación se analiza el efecto marco y la teoría de descuento temporal como estrategias para promover el ahorro para el retiro bajo un escenario hipotético. Participaron 117 estudiantes de posgrado de dos universidades de México y Guatemala a los que se les aplicó un instrumento de alfabetismo financiero y una tarea de ahorro para el retiro presentado desde marcos de ganancia y pérdida en el que debían decidir cuándo retirar los recursos. Se encontró que, entre mayor era el monto acumulado y se tenía un marco de pérdida, los participantes estuvieron dispuestos a esperar más tiempo para retirar sus recursos. Los resultados pueden ser de utilidad para mejorar el diseño de políticas públicas para incrementar el ahorro para el retiro. Abstract Behavioral finance has provided useful tools to improve public policy application by acknowledging the existence of systematic errors in decision making. This research analyzes the framing effect and temporal discount theory as strategies to enhance retirement savings under a hypothetical case. 117 graduate students of two public universities from Mexico and Guatemala participated in the study. The first task consisted in a financial literacy survey, and the second consisted in a multiple-choice task presented in profit and loss frames, in which the participant must choose when to withdraw the savings. It was found that, the higher the amount accumulated and the greater the loss frame; the longer participants were willing to wait to withdraw their funds. The results may be useful for improving the design of public policies to increase retirement savings. ; Código JEL: G41
This study examines health care utilization of immigrants relative to the native-born populations aged 50 years and older in eleven European countries. Methods. We analyzed data from the Survey of Health Aging and Retirement in Europe (SHARE) from 2004 for a sample of 27,444 individuals in 11 European countries. Negative Binomial regression was conducted to examine the difference in number of doctor visits, visits to General Practitioners (GPs), and hospital stays between immigrants and the native-born individuals. Results: We find evidence those immigrants above age 50 use health services on average more than the native-born populations with the same characteristics. Our models show immigrants have between 6% and 27% more expected visits to the doctor, GP or hospital stays when compared to native-born populations in a number of European countries. Discussion: Elderly immigrant populations might be using health services more intensively due to cultural reasons.
The present research project presents an application of an analytical methodology that studies constitutionally the central theme, whose aim is to try to demonstrate how the aforementioned Legislative Act No. 01 of 2005 modifies article 48 of the Political Constitution, in addition to opposing provisions that Enshrines the same Political Charter in relation to the right of trade union association and collective bargaining for the restriction that was established when exercising the right to collective bargaining, article 55 of the Constitution Which is essentially rooted in the fundamental right of trade union association, enshrined in Article 39 of the Constitution, ignoring the provisions of the International Labor Conventions, particularly Convention 87 and 98 (ILO). Constitutional doctrine as an integral part of the so-called Constitutionality Block, pursuant to paragraph 2 of article 93 of the Political Constitution, a feature reinforced by what is determined in paragraph 4 of article 53 Political Constitution. In the same way, the constitutional amendment by which Article 48 of the Political Constitution was reformed, clearly shows how the right to private property and freedom of enterprise is not known by prohibiting collective bargaining between individuals, colliding with the established In article 58 of the Political Constitution and the provisions of article 333 of the Constitution, which guarantees the right to property and recognition of rights acquired under the law, as well as the right to freedom of enterprise under a social function Determined. In the analysis of the work, it was determined that the exclusion to the restriction of collective bargaining established by Legislative Act No. 01 of 2005 in pension matters constitutes a constitutional antinomy, which seriously damages the mechanism of concertation through collective bargaining, That workers have to agree and improve the minimum conditions of work foreseen in the legal regulations. ; El proyecto de investigación presenta una aplicación de una metodología analítica que estudia constitucionalmente el tema central, que tiene como objeto el procurar demostrar cómo el referido Acto Legislativo No. 01 del 2005 modificatorio del artículo 48 de la Constitución Política, además de contrariar disposiciones que consagra la misma Carta Política, en materia del derecho de asociación sindical y negociación colectiva por la restricción que se estableció al ejercicio del derecho a la negociación colectiva, artículo 55 de la C.P., derecho este cuyo arraigo en esencia tiene origen en el derecho fundamental de la asociación sindical, consagrado en el artículo 39 de la Constitución Política, desconociendo lo señalado en los Convenios Internacionales del Trabajo, particularmente el Convenio 87 y 98 (OIT), disposiciones calificadas por la doctrina constitucional como parte integral del denominado Bloque de Constitucionalidad, en virtud del inciso 2° del artículo 93 de la Constitución Política, característica reforzada por lo determinado en el inciso 4° del artículo 53 de la Constitución Política. De la misma manera, la enmienda constitucional por la cual se reformó el artículo 48 de la Constitución Política deja ver ostensiblemente cómo se desconoce el derecho a la propiedad privada y a la libertad de empresa al prohibir la negociación colectiva entre particulares, chocando de contera con lo establecido en el artículo 58 de la Constitución Política y lo dispuesto en el artículo 333 constitucional, que garantiza el derecho a la propiedad y el reconocimiento a los derechos adquiridos conforme a la ley, al igual que el derecho a la libertad de empresa bajo una función social determinada.El análisis del trabajo determinó que la exclusión a la restricción de la negociación colectiva que estableció el Acto Legislativo No. 01 de 2005 en materia pensional configura una antinomia constitucional, que lesiona en forma grave el mecanismo de concertación por medio de la negociación colectiva, que tienen los trabajadores para acordar y mejorar las condiciones mínimas del trabajo previstas en la normativa legal.
Este trabajo es un análisis orientado a evidenciar la evolución de la discrecionalidad en la jurisdicción Contencioso Administrativa, la cual disentía el criterio jurisprudencial de la Corte Constitucional en el deber de motivar los actos administrativos discrecionales de retiro de los miembros de la Fuerza Pública, avalándolos de forma inmotivada, para desvincularlos del servicio activo, en donde se trasgreden los derechos fundamentales al debido proceso y a la igualdad; a su vez, se presenta una propuesta de solución con base en los mismos reglamentos que tienen las instituciones, en donde se habla de una jerarquía , estructura piramidal y escalafón, los cuales son interpretados subjetivamente por el nominador, desconociendo la supremacía de la Constitución Política y la observancia del precedente constitucional; el acatamiento de estas normas evitan la desnaturalización de la discrecionalidad y se respetaría el debido proceso, en el retiro de los integrantes de la Fuerza Pública, teniendo en cuenta las evaluaciones y antecedentes de trayectoria profesional, antes de tomar las decisiones de retiro del servicio activo y de hacerlo, motivar el acto administrativo con razones de hecho y de derecho. ; This work is an analysis oriented to show how the contentious administrative jurisdiction doesn't accomplish with the duty of motivate the administrative discretionary acts of retirement of the public force members, endorsing it in a unmotivated way, for the purpose of unlink them from de active service, fundamental rights of the due process and the equality are violated; at the same time, it is shown a proposal of solution based on the same regulations that have the institutions, where it is spoken about a hierarchy, pyramidal structure and scale, which are subjectively interpreted by the nominator, disowning the supremacy of the constitution and the observance of the constitutional preceding; the abidance of this rules avoid the perversion of the discretion and it will respect the due process, in the retirement of the members of public force, considering the assessments and the records of professional path, before to make decisions of retirement of active service and to do it, motivate the administrative act with reasons of the fact and right.
