A person is considered employed, after the conclusion and signing of an employment contract. The employment concract is not only a written legal labor relations locking document, but first of all, it is some kind of negotiating, contractual relations, agreements evolving among parties, which make satisfied not only legal expectations of the work, but also guarantee an individual's social status in society and in general each person's individual and constitutional right to work and express himself at work. The way to the signing of the contract can be divided into the following stages, as the right of the choise of employment, which should be interpreted as covering employment, the right to choose the desired job, the right to non-compulsory, voluntary, legal work, as well as the next stage can be distinguished, as each person's right to determine the contents of the employment contract. In labor law the principle of equality of persons guarantees to every person to be treated equally, precludes the application of different conditions of employment, to negotiate to estabilish such conditions, to treat identical relations differently based on sex, age, disability, race, ethnicity, nationality and other basis, unrelated to the employee's professional qualities. The person, who has suffered of discrimination in employment should to be available for an effective, legal protection to defend his damaged individual right to be treated equally with others for his constitutional right to a personal, unique characteristics, attitudes, beliefs. Fast development of information technology allow employers to monitor, collect personal data and to control workers and with such actions prejudice personal privacy. But by law it is difficult to determine the employer's abligations not to disseminate certain information about the job candidate, because precontractual labor relations can not fully protect the personal data for their transmission of computer technologies. Collecting and using personal data for the employment purposes, granted by the Constitution, must be guaranteed the person's right to freely express his thoughts, beliefs and also respect his privacy and human dignity, especially if the information relates to a person's racial or ethnic origin, political options, religious, philosophical or other beliefs, health or sex life, also person's criminal record.

The purpose of this study was to identify problems in performing the functions of the investigating judge related to the protection of human rights and freedoms during detention and to offer solutions to them. The study is based on the use of methods of sampling and prognosis; system approach; descriptive statistics; comparison and collation; descriptive analysis method. We found out that the restriction of certain rights and freedoms of a person, detained on suspicion of having committed a crime, is quite legitimate, but some rights are violated due to abuse of police authority. The right to liberty and the right to security of person, the right to effective remedy and fair trial, and the right to respect for private and family life are most often violated during detention. Judicial control should be carried out in compliance with the following principles: immediacy, automaticity, conducting trial proceedings within a reasonable time. In order to universalize judicial control over the protection of human rights and freedoms during detention, we propose to develop an international legal document, regulating the conduct of judicial control.

Abstract.This article covered some issues regarding the principles of administrative and legal regulation ofrestrictions on the rights and freedoms of a person and citizen in the Russian Federation and at the international level. The authors presented the definition of these principles and their system. Here, the main international acts, the Constitution and current legislation of the Russian Federation are analyzed, and the system of principles for legal consolidation and regulation of restrictions on human rights and freedoms is fixed. According to the research findings, conclusions were made on the role of legal principles in the administrative and legal regulation of legal restrictions.Keywords: legal restrictions, restriction of rights and freedoms of man and citizen, legality, proportionality.

Liberalism, of course, is quite a capacious theory, with room for liberals to debate quite vigorously among themselves, as well as with others, the meaning and significance of freedom, rights and other concepts. It is also capacious enough to allow for a rethinking of these concepts at a time of pressing environmental problems. Such a rethmking, I shall argue, should lead us to conceive of freedom and rights less as barriers or shields that protect individuals against interference - as forms of independence - and more as matters of organic growth and connection, or interdependence. Indeed, we must conceive of freedom and rights in this organic, interdependent way if we are to respond adequately to the ecological challenge. If Garrett Hardin is right, we shall have to rely upon 'mutual coercion, mutually agreed upon' if we are to avoid environmental tragedy (Hardin I 968). But it will be easier to agree to this mutual coercion if we see our rights not as inviolable barriers agamst others but as forms of relations that entail responsibilities to others. I shall argue, therefore, for a move away from the negative conceptions of rights and freedom and toward an understanding that relates both concepts to autonomy. If this seems to be a self-defeating leap from one negative, atomistic way of thinking to another, I can only ask the reader to bear with me until I explain what I mean by 'autonomy'.
