The article examines the doctrine of the rights and freedoms of man and citizen. The connection between the theory of human rights and freedoms and the history of the development of society is traced. The works of thinkers of the past are analyzed. The dynamics of views on the development of rights and freedoms is shown. Special attention is focused on two basic concepts of rights and freedoms – natural-legal and positivist, the general and special in their content are highlighted. Both of these concepts consider human rights as a certain view of the world outlook, worldview, which are based on the principle of humanism, and also as a system of humanistic values that determine relationships in society. Attention is drawn to the essential features of human rights. A brief analysis of three generations of human rights is carried out. It is emphasized that this classification is classical. However, new times force us to look at the classification problem in a new way. The classification of human and civil rights allows you to see their evolution, the historical connection of times, the general trend of development. The conclusion is substantiated that in the current period of human development, taking into account the achievements of science, primarily biomedicine, we can talk about the fourth generation of human rights, the socalled somatic rights. In this century, the focus on somatic human rights has become a feature. They increasingly occupy the attention of international organizations, become the subject of discussion at the national and international levels, since through their prism the nature of the relationship between a person and a state is assessed.

Issues related to restrictions on the rights and freedoms of a person and a citizen aiming at ensuring security, are considered in the scientific article, in a generalised form. Analysing the legal mechanism for restricting constitutional rights and freedoms, the author examines a number of federal laws, judicial practice allowing to substantiate the conclusion of existence of such types of restrictions as emergency and permanent ones. The article draws attention to a number of debatable issues related to restrictions during the COVID-19 pandemic, as well as in the context of countering extremism, and such a fact is noted that right restrictions are disproportionate to the existing threat to public safety. The author of the work insists on maintaining a balance between public and private interests when establishing restrictions on the rights and freedoms of a person and a citizen; he comes to the conclusion that it is necessary to consolidate a legal mechanism for restricting the rights and freedoms of a person and a citizen in the Federal Law "On Security" in order to ensure security, legally justified principles of restriction of constitutional rights and freedoms, including those developed in the legal positions of the Constitutional Court of the Russian Federation, certain legal guarantees against unreasonable restrictions on human rights and freedoms, issues of responsibility of public authorities when restricting the rights of citizens and other conditions for the functioning of this mechanism.

This article analyzes the information activity of the main institutions of civil society in modern Russia. It is shown that the institutions of civil society in Russia have significant information potential.

В статье ставится задача рассмотреть понятия личности, права, государства: правовое государство, права и свободы человека, гражданина. Определить идеи гармонизации отношений личности и государства, фактическое положение человека, масштаб его свободы. Ставятся задачи на определение основных прав и свобод человека и гражданина. Так же в статье классифицируют обязанности: личные; политические; экономические; социальные; культурные. В связи с этим устанавливаются и рассматриваются обязанности гражданина Украины, которые прописаны в Конституции и приведены для общей наглядности. ; The article raises the problem of the study of personality, law and state: the legal state, rights and freedoms of the individual citizen. It addresses the responsibilities of a citizen of Ukraine, which are set out in the Constitution and provides for total visibility. The materials of this article highlight the authority of government and its definition, provides the analysis to understand the state and society.

The article is devoted to an urgent problem - the analysis of the methodological foundations of the study of the concept of "culture" and the institution of cultural rights and freedoms of man and citizen in the Russian Federation. In particular, the influence of the dialectical method on the institute of cultural rights and freedoms is studied, the cultural method in the study of cultural rights and freedoms is analyzed, a formal legal, historical-legal, comparative legal, and statistical method is studied for the study of cultural rights and freedoms.

Abstract.This article covered some issues regarding the principles of administrative and legal regulation ofrestrictions on the rights and freedoms of a person and citizen in the Russian Federation and at the international level. The authors presented the definition of these principles and their system. Here, the main international acts, the Constitution and current legislation of the Russian Federation are analyzed, and the system of principles for legal consolidation and regulation of restrictions on human rights and freedoms is fixed. According to the research findings, conclusions were made on the role of legal principles in the administrative and legal regulation of legal restrictions.Keywords: legal restrictions, restriction of rights and freedoms of man and citizen, legality, proportionality.

The right of citizens to meet peacefully and to hold meetings, rallies, marches and demonstrations is prescribed by Art. 39 of the Constitution of Ukraine. Participation in such public activities could be regarded as a form of direct and independent expression of the people's will, as well as the reaction of a society to the actions of the state. In order to prevent a conflict between the society and state, as well as disunity between them, the state should not ignore above-mentioned people's activities. The specified right belongs to the subjective person' srights, the principal purpose of which is to influence the state bodies for solving the most important society-state issues by coordinating and forming the citizens' opinion and the way of its expression, as well as an element of democracy, a mode of participation in the management of state and local affairs. At the same time, it should be noted that such meetings may not always have the nature of political events, and the mentioned right is not always the political one.The vast majority of specialists in the field of law, in particular, the constitutional law, regards the aforementioned right as a type of citizens' political rights that belong exclusively to Ukrainian citizens who have reached 18 years of age and have acquired full legal personality (with some exceptions concerning the right to association in public (non-political) organizations and the right to individual and collective appeals), and express the content of legal relationship between the individual and the state.However, not all scientists agree with the fact that mentioned right belongs exclusively to citizens of a certain state.The right to peaceful assembly is one of the inalienable, inherent rights in a democratic world. It should be noted that resembling rules are accommodated in the acts of international law, as the part of national legislation, in particular, the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights. Furthermore, the international documents establish it as the right of any person, not only the citizen's one. This right is an inalienable one of every person that is provided for both foreigners and stateless persons, hence the subject matter should be considered not as political rights of citizens, but as civil rights of people. Therefore, the appropriate amendments should be made to the current legislation of Ukraine and, primarily, to the Constitution of Ukraine. ; Статтю присвячено визначенню місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина.На основі проведеного аналізу думок фахівців з питань конституційного права, конституційних положень та міжнародних документів щодо місця права на мирні зібрання в системі конституційних прав і свобод людини і громадянина наголошується, що вказане право варто розглядати не як політичне право громадян, а як одне з особистих, громадянських прав людини.Запропоновано внесення відповідних змін до статті 39 Конституції України.

The protection and promotion of human rights and freedoms is a key criterion for building a democratic state governed by the rule of law and a prosperous civil society. Therefore, in any country, first of all, the rights and freedoms of citizens are a priority. The personal rights of citizens are natural, inalienable right. This paper covers this theme.
