The creative forces of university law in Africa ; Les forces créatrices du droit universitaire en Afrique
The reflection embodies this philosophical controversy in the field of legal sociology. More than an admission of the limits of knowledge, chance is a form of sociological or psychological necessity that flires with the nature of things. The rules governing the status and career of academics are hardly escaped, as evidenced by demographic, budgetary or historical constraints in training and adoption of the Staff Regulations, the creation or abolition of categories of academics, the institutionalisation of academic disciplines and the development of academic franchises. These creative forces of university law, which are apories of legal logic, must be supplemented by legal constraints, in particular constitutional constraints. The difficulty of ensuring faithful traceability of the causes of the law and the difficulty of summoning them in order to take the measure of free arbiter into them reveal the complexity of the social facts and justify recourse to the method of explaining the argument to the detriment of that of demonstration in the context of sociology without rigour of university law. ; The reflection writes down this philosophical controversy on the land of the legal sociology. More than a confession of the knowledge's limits, the luck is a form of sociological or psychological necessity which flirts with the nature of the things. The rules which govern the academic's condition and career there hardly escape as testifies the demographic, budgetary or historic constraints's weight in the statute's formation and the adoption, the creation or the deletion of academic's categories, the academic disciplines's institutionalization and the academic exemptions's evolution. These academic law's creative forces, aporias of the legal logic must be completed by the legal constraints notably constitutional. The faithful reconstruction's difficulty of the law's reasons and the one to classify it to take the measure of the free will there reveals the social facts's complexity and justifies the explanatory method of ...

Perception by general practitioner about their role in the care of the stress disorders ; Perception par les médecins des forces de leur rôle dans la prise en charge des troubles psychiques post-traumatiques
Introduction: Post-traumatic stress disorder is a major concern of the French Army Health Service who made military GPs the pivot of care courses and field actions. Previous works have shown that despite a good theoretical understanding of pathologies, difficulties remain in the care. We wanted to understand the motivations and the practices of military GPs about TPPT disregarding local opportunities. Patients and methods: A questionnaire by clinical cases was sent electronically to a sample of 400 metropolitan GPs. Results: 151 physicians answered our study. 66.1% had already established an initial diagnosis of traumatic mental disorder. They were related mainly with a military psychiatrist (93%). A restriction of fitness searched mainly to protect the patient from further traumatic encounter (44.5% in 1st choice). The identification of trauma patients had to apply to all personnel returning from foreign countries (88.1%) and by a self-administered questionnaire like PCL-S (23.9% in 1st choice) or collective information (21.8% in 1st choice). Responders were taking care of the direct and indirect witness of a traumatic event risk (71.9%) mainly to diagnose acute stress disorders (54.4% in 1st choice) using a collective information on psychological trauma (25.7% in 1st choice). The information provided to the patient on the evolution of disturbances was mainly focused on the need to support (36.3% in 1st choice) to positively support the evolution of symptoms (46.8% in 1st choice). Discussion: Despite the diversity of experiences and local practices, many principles of action are shared by military GPs. Early identifying and treat is approved by a large proportion of responders. Our study also shows the high exposure of healthcare professionals to traumatic situations. ; Introduction : Les troubles psychiques post-traumatiques sont une préoccupation majeure du Service de Santé des Armées qui a fait du médecin des forces le pivot du parcours de soin et des actions de terrain. Les travaux précédents ont montré que, malgré une bonne connaissance théorique des pathologies, des difficultés persistent dans la prise en charge. Nous avons donc voulu connaître les motivations et les pratiques des médecins généralistes militaires concernant les TPPT en faisant abstraction des possibilités locales. Matériels et méthodes : Un questionnaire par cas cliniques a été adressé par voie électronique à un échantillon de 400 médecins des forces métropolitains. Résultats : 151 médecins ont répondu à notre étude. 66,1% avaient déjà établi un diagnostic initial de traumatisme psychique. Ils étaient en lien principalement avec un psychiatre des armées (93%). Une restriction d'aptitude visait surtout à protéger le patient d'une nouvelle rencontre traumatique (44,5% en 1re modalité). Le repérage des patients traumatisés devait s'adresser à tous les personnels revenant de mission (88,1%) et ce par un auto-questionnaire de type PCL-S (23,9% en 1re modalité) ou une information collective (21,8% en 1re modalité). Les répondeurs prenaient en charge les témoins directs et indirects d'un évènement à risque traumatique (71,9%) en majorité pour diagnostiquer les états de stress aigu (54,4% en 1re modalité) en utilisant une information collective sur les traumatismes psychiques (25,7% en 1re modalité). L'information apportée au patient sur l'évolution des troubles étaient principalement focalisée sur la nécessité de prise en charge (36,3% en 1re modalité) afin de soutenir positivement l'évolution des symptômes (46,8% en 1re modalité). Discussion : Malgré la diversité des expériences et des pratiques locales, de nombreux principes d'action sont partagés par les médecins des forces. Le repérage et la prise en charge précoces des troubles sont approuvés par une large majorité de répondants. Notre étude montre également l'exposition élevée des professionnels de santé aux situations traumatiques.

Definition of an outsourcing theory in the armed forces : the case of the French Army Aviation ; Définition d'une théorie de l'externalisation dans les armées : le cas de l'Aviation Légère de l'Armée de Terre
Outsourcing is an age-old phenomenon that has not been described in operational terms by any theory. Through a review of the literature on transaction cost economics and an approach based on core competencies; this thesis proposes a theory of outsourcing, which has an empirical basis in a case study on aircraft maintenance in l'Aviation Légère de l'Armée de Terre (the French Army Aviation), and which we regard as HRO (High Reliability Organization). Outsourcing is therefore defined dynamically through an adaptive approach based on four main variables: the outsourcing propensity, the economic profitability of the project, the cardicity and the organizational learning. Based on an original practitioner-researcher approach and by using an innovative method of analysis, we demonstrate the applicability of this theory and its possible uses for all HROs with a view to a more widespread application. ; L'externalisation est un phénomène ancien qui n'est décrit de manière opérationnelle par aucune théorie. Au travers d'une revue de la littérature sur la théorie des coûts de transaction et les approches basées sur les core competencies, cette thèse propose une théorie de l'externalisation dont le fondement empirique repose sur une étude de cas dans le contexte de la maintenance aéronautique de l'Aviation Légère de l'Armée de Terre, que nous considérons en tant que HRO. L'externalisation est ainsi définie de manière dynamique au travers d'une approche évolutive fondée sur quatre grandes variables : la propension à externaliser, la rentabilité économique du projet, la cardicité et l'appréciation de l'apprentissage organisationnel. Se reposant sur approche originale de praticien chercheur et par l'utilisation d'une méthode d'analyse innovante, nous démontrons l'applicabilité de cette théorie et sa possible utilisation à l'ensemble des HRO en vue d'une généralisation plus marquée.
