Rated both positively and negatively, Shinzō Abe has achieved a lot as prime minister. He contributed to a new perception of Japan in the international arena. During the eight years of his rule in power, his administration carried out reforms aimed at better coordination of security policy, strengthened the position of the prime minister in this field, and increased the involvement of the SDF in ensuring security. They resulted primarily from changes taking place in its security environment: the development of North Korea's missile and nuclear program, the assertive attitude of the People's Republic of China, and an increase in arms spending and the intensification of Chinese military activity in the region (around the disputed Senkaku/Diaoyu islands and in the South China Sea). The article aims to analyze the changes in the security policy introduced during the rule of Shinzō Abe in the internal aspect.

The article is a brief comparison of the documentation system of the Communist Party ruling Poland from 1944 to 1989 and in Kazakhstan from 1918 to 1991. Despite considerable geographical remoteness, there are strong similarities between them in terms of party organisation, office rules and provisions regulating archives. This was caused by the reflection of Soviet models in communist Poland after 1944. The regaining of sovereignty by Poland in 1990 and independence by Kazakhstan in 1992 led to the transfer of documentation from party archives to the state archive service in both countries. As a result, it was possible to study and make them publicly available.

The aim of this article is to analyse the fulfilment of the Stability and Growth Pact rules by the EU 15 member states in the period 1999–2015. The article also presents the evolution of the EU fiscal rules since their formulation, including, in particular, the influence of the crisis on both meeting the rules by the member states and their substance. The conclusion of the article is that the construction of the rules is the main cause of the ineffectiveness of the pact in eliminating the deficit bias in the EU. In the analysed period, there were years when the member states did not follow the limits defined by the rules (the whole period, but in particular the years before the crisis), years without anticyclical influence of the rules (in fact, the whole period 1999–2015), and years when the rules turned out not to be elastic enough (the years after the crisis). It leads to the overall conclusion that the EU fiscal rules are not the best tool to counteract the deficit bias in the EU. ; Celem niniejszego artykułu jest przeanalizowanie stopnia przestrzegania przez 15 krajów UE reguł fiskalnych zawartych w pakcie stabilności i wzrostu w latach 1999–2015 i ewolucji tych reguł od początku ich sformułowania. Analiza stopnia wypełniania poszczególnych reguł prowadzi do wniosku, że na nieskuteczność reguł w eliminowaniu zjawiska deficit bias rzutują w dużej mierze ich błędy konstrukcyjne. W trakcie całego analizowanego okresu, a zwłaszcza okresu przedkryzysowego, można było stwierdzić, że limity określone przez reguły nie były przestrzegane, właściwie przez cały analizowany okres nie prowadziły do antycyklicznej polityki fiskalnej, a po kryzysie nie były wystarczająco elastyczne. Prowadzi to do konkluzji, że reguły fiskalne nie są najlepszym środkiem do walki ze zjawiskiem deficit bias w Unii Europejskiej.

The article covers the legal and tax aspects of the implementation of general anti-avoidance clause in Polish tax law, including the historical outline of the clause, its essence, and the usefulness of achieving the legislator's intended effects. The article deals with the disadvantages and advantages of the clause, its compliance with constitutional regulations, as well as the institution of GAAR protective tax opinions and the position of the Council on counteracting tax evasion. ; Artykuł omawia prawne i podatkowe aspekty wdrożenia do polskiego prawa podatkowego klauzuli o przeciwdziałaniu unikania opodatkowania, rys historyczny klauzuli, jej istotę oraz przydatność dla osiągnięcia zamierzonych przez ustawodawcę efektów. Civil defence means actions aiming at protecting population, industrial plants, utility companies, and cultural goods, saving and helping the injured in times of war, as well as cooperating in fighting natural disasters and environmentas threats and in deletion of their effects. Vivil defence should function on the basis of the principle of generality, obligation, unvariability of organizational structure, complexity of operation, adequacy, readiness, decentralization of management, planning, support, and interterritorial solidarity. The central organ of government administration for civil defence is the Chief of Civil Defence of the Country, who is appointed by the Prime Minister. The motion is put forward by the minister of internal affairs. Provincial governors, starosts, borough leaders, presidents of towns or cities are local organs of civil defence. ; Obrona cywilna to działania mające na celu ochronę ludności, zakładów pracy i urządzeń użyteczności publicznej, dóbr kultury, ratowanie i udzielanie pomocy poszkodowanym w czasie wojny oraz współdziałanie w zwalczaniu klęsk żywiołowych i zagrożeń środowiska oraz usuwanie ich skutków. Since 1990, the president of the Republic of Poland has been elected by direct popular vote. In this period, the position of the office of president has undergone significant change. Each consecutive legal act of a constitutional nature (the Small Constitution of 1992 and the Constitution of the Republic of Poland of 1997) imposed limitations on the range of competences (powers) of the president. Is it thus necessary to revise the current rules of how the head of state is elected? To help answer this question, an attempt was made to view the issue raised in the title of the paper from three perspectives: 1) systemic rationality, 2) political parties as the main political actors and 3) a citizen-based approach as reflected in the preferences and behaviours of the sovereign.

Przedstawiany artykuł jest testem efektów, jakie przyniosło wprowadzenie przez kodeks wyborczy systemu większości względnej w okręgach jednomandatowych jako sposobu wyłaniania rad polskich gmin. Przeprowadzone badania pokazują, w jakim zakresie nowy system zmienił równowagę sił pomiędzy lokalnymi partiami władzy i ich konkurentami. Prowadzą one do wniosku, że partie władzy mają wyraźną przewagę nad pretendentami. Ma ona jednak złożony i warunkowy charakter. Zmiana systemu wyborczego powiększyła taką przewagę, jednak nie dotyczy to wszystkich kategorii gmin i wszystkich scenariuszy rywalizacji o władzę w samorządzie lokalnym. Obserwowane zmiany mają najpewniej nieoczywiste, złożone przyczyny. Generalnie jednak zmiana systemu uwypukliła problem integracji lokalnych ugrupowań politycznych i decydującą rolę, jaką ma na tym polu samo sprawowanie władzy. Analizy statystyczne dokonane zostały na podstawie danych zastanych – wyników wyborów samorządowych z 2010 i 2014 r. ; This article analyses the results of the implementation of the new role for a single mandatory constituency in the local election law in Poland. The investigation shows how the new role changes the balance of power between local leader parties and their competitors. It leads to a conclusion that parties holding power have explicit supremacy which is, however, of a complicated and conditional nature. The change of the voting system has strengthened this supremacy but its extend varies from municipality to municipality and is not present in all. The statistical analyses conducted for the purpose of this article have been based on the data contained in tables and graphs presenting the results of local elections in Poland in 2010 and 2014.

The rule of adequacy of financial resources to the local government's responsibilities is one of the basic rule of local government finance, which was expressed in Polish Constitution and in the European Charter on Local Self Government. Because of the fact, that the system of own resources of Polish local governments was not reformed since 2004 – any amendment causes decrease of their transferable resources (grants, subsidies) should be regarded as the inconsistent with the rule of adequacy and therefore – unconstitutional. Such nature has the new 80% limit for the amount of the specific grant from the State Budget to local government own tasks, which was introduced by Article 128 of Public Finance Act. The paper presents argumentation proving the above thesis and also raises an increasing problem of inadequacy of subsidies for the central government's task delegated to local authorities. ; Jedną z podstawowych zasad finansów lokalnych wyrażonych w Konstytucji RP i Europejskiej Karcie Samorządu Lokalnego jest zasada adekwatności zasobów finansowych społeczności lokalnych do przydzielonych im zadań. Ponieważ system dochodów własnych polskich jednostek samorządu terytorialnego nie był reformowany od 2004 r., wszelkie zmiany powodujące zmniejszenie wysokości ich dochodów transferowanych (dotacji i subwencji) należy obecnie uznać za sprzeczne z zasadą adekwatności. Zmianą taką z pewnością jest 80-procentowy limit wysokości dotacji celowej na zadania własne jednostek samorządu terytorialnego wprowadzony w art. 128 ustawy o finansach publicznych. Artykuł przedstawia argumentację na poparcie powyższej tezy, a także porusza wzrastający problem niewystarczalności dotacji celowych przekazywanych samorządom na zadania zlecone z zakresu administracji rządowej.

The article presents the policy of the Galician conservatives towards the Ukrainian in the years 1895–1898. During this period, Prince Eustachy Sanguszko was the governor of Galicia. According to an unanimous opinion, he was to be a continuator of Kazimierz Badeni's political line in the field of Polish-Ukrainian relations. Unfortunately, the governor did not manage to normalize mutual relations. This was due to, on the one hand, the rise in radical sentiment among the Ukrainian society, and on the other hand, the weakening of the political camp ruling the country caused, inter alia, by internal reshuffles. All this meant that instead of easing the mutual opposites, the Polish-Ukrainian conflict began to grow more and more. ; The article presents the policy of the Galician conservatives towards the Ukrainian in the years 1895–1898. The establishment of the communist regime in Poland in 1944 is a current subject of reflection in the doctrine and practice of legislation and judiciary. There has been no uniform position on these events, which means that the then sanctioned political and normative order continues to produce controversial assessments and, above all, certain legal effects. This results from the fact that the new people's power, empowered by force, and not by legal or social basis, has given itself the competence to establish a normative order. The lack of legitimacy for the rightful rule and legislative activity, in principle – from the point of view of the idea of the rule of law – undermines the political and legal status of the people's authorities. This is all the more so because the system of unified power and sources of law created at that time was evidence of building a totalitarian state modelled on the Soviet Union. The events and legal behaviours of that time led to numerous, often radical changes in many areas of private and public life. They caused certain social and material effects, difficult to reverse today, which Polish society still faces. Therefore, modern standards of the rule of law require that public authorities undertake comprehensive and effective activity. They require that the principles of just and fair compensation for material damage and compensation for moral losses resulting from the rule of this system be implemented. This seems all the more important because some regulations of the people's power, especially those concerning changes in the ownership structure, are still in force and form the basis of court and Constitutional Tribunal decisions. ; Ustanowienie reżimu komunistycznego w 1944 r. w Polsce stanowi w doktrynie oraz w praktyce legislacyjnej i orzeczniczej aktualny przedmiot refleksji. Nie wypracowano bowiem jednolitego stanowiska wobec tych wydarzeń, co powoduje, że usankcjonowany wówczas porządek polityczno-normatywny nadal skłania do kontrowersyjnych ocen i przede wszystkim wywołuje określone skutki prawne. Wynika to z faktu, że nowa ludowa władza, umocowana siłową, a nie prawną czy społeczną podstawą działania, sama nadała sobie kompetencje do stanowienia porządku normatywnego. Brak legitymacji do prawowitego panowania i działalności legislacyjnej w zasadzie – z punktu widzenia idei państwa prawa – podważa status ustrojowo-prawny organów władzy ludowej, tym bardziej że stworzony wówczas system jednolitej władzy i źródeł prawa świadczyły o budowaniu wzorowanego na Związku Radzieckim państwa totalitarnego. Ówczesne zdarzenia i zachowania prawne doprowadziły do licznych, często radykalnych zmian w wielu płaszczyznach życia prywatnego i publicznego. Ponadto wywołały określone, trudne dziś do odwrócenia skutki społeczne i materialne, z którymi wciąż mierzy się polskie społeczeństwo. Współczesne standardy państwa prawa stawiają zatem wymóg podjęcia kompleksowej i skutecznej aktywności przez władzę publiczną w zakresie słusznego i sprawiedliwego naprawienia szkód materialnych oraz zadośćuczynienia strat moralnych powstałych w wyniku panowania tego ustroju. Wydaje się to tym bardziej istotne, że niektóre regulacje władzy ludowej, zwłaszcza dotyczące zmian struktury własnościowej, nadal obowiązują oraz stanowią podstawę orzeczeń sądowych i Trybunału Konstytucyjnego.

The article focuses on the functions, types, transfer rules and principles of granting of subsidies and specific grants from the state budget to local government units in Poland, however, it also contains international references. The author indicates the key issue related to the use of transfer revenues in financing local government units. Special attention is given to the analysis and assessment of importance and the change in the share of transfer revenues for municipalities, cities with powiat status, powiats and voivodeships for creating their budgetary revenues in 2010–2020. The research was based on data obtained from the database of Statistics Poland.
