W opracowaniu omówiono przepisy regulaminów parlamentów narodowych wybranych państw członkowskich UE, a także Wielkiej Brytanii, Stanów Zjednoczonych i regulaminu Parlamentu Europejskiego, odnoszące się do kwestii objętych w regulaminie Sejmu RP pojęciem "wniosków formalnych". Pojęcie to nie zostało wyodrębnione we wszystkich omówionych regulaminach parlamentarnych. W wielu z nich regulacja odpowiadająca przedmiotowo poszczególnym wnioskom formalnym wyodrębnionym na gruncie regulaminu Sejmu pozostaje rozproszona. Z kolei w niektórych regulaminach, choć pojęcie wniosku formalnego zostało wyodrębnione, to nie zostało ono zdefiniowane i nie przewidziano zamkniętego katalogu takich wniosków. ; The paper concerns selected issues related to parliamentary procedures. The primary aim is to in‑vestigate a particular category of motions, defined by rules of procedure of the Polish parliament as points of order (literally "formal motions"). In Poland, points of order are recognised as a sepa‑rate category of motions. They may be submitted only in respect of matters being the subject of the orders of the day or the proceedings in a sitting and include, inter alia, motions to: suspend, postpone or close the sitting; close the discussion; alter the procedure of the discussion; close the list of speakers; limit the time of speeches; confirm a quorum. The authors examine how mo‑tions of similar subject scope are regulated in foreign national parliaments.

Converging the Global Standard of General Anti-Abuse Rule: Is There Room for an Application of the GAAR (ATAD) and PPT (MLI) in a Similar Fashion? ; Zbiegający się globalny standard przeciwdziałania nadużyciom prawa podatkowego: Czy GAAR (ATAD) i PPT (MLI) powinny być stosowane w podobny sposób?
Finding much needed funds from taxes to state budgets and an ever-increasing mistrust of politicians and public opinion to the tax optimization schemes of multinational enterprises (MNEs) and high net worth individuals (HNWIs) have sparked an unprecedented political enthusiasm to address international tax avoidance in the last decade. This enthusiasm morphed into a political mandate given by G20 to the OECD in 2012. Amid a plethora of anti-avoidance rules delivered by the OECD under the BEPS Project, the principal purposes test (PPT) and its derivative under the EU Anti-Tax Avoidance Directive (ATAD) – the General Anti-avoidance Rule (GAAR) – are pivotal. The purpose of this contribution is to take an attempt to answer the main research question: is there room for an application of the GAAR (ATAD) and PPT (MLI) in a similar fashion? The assumption positively verified under this study via the prism of tax policy and technical (legal) reasons is that the less dissimilar an application of the GAAR and PPT will be, the less tax avoidance and fewer disputes arising from this phenomenon appear. However, there is a major caveat: the GAAR and PPT must gravitate towards the General Anti-abuse Principle (GAAP) as follows from the jurisprudence of the Court of Justice of the European Union's (CJEU) rather than to the OECD's version of the GAAR in the MLI (PPT). Only such an interpretative approach may ensure the right balance between fiscal interests of countries and individual economic freedoms of taxpayers. This contention stems from an analysis of the wording and structure of the GAAR and PPT, tax policy aims articulated in the preambles to the MLI and ATAD, the Court of Justice of the European Union's (CJEU) case law, the OECD's Commentary, and the relevant literature. ; Potrzeba znalezienia środków z podatków na finansowanie funkcjonowania państw oraz coraz większa nieufność polityków i opinii publicznej wobec schematów optymalizacji podatkowej przedsiębiorstw wielonarodowych (multinational enterprises, MNE) i najbardziej majętnych osób fizycznych (high-net worth individuals, HNWI) wywołały bezprecedensowy entuzjazm polityczny dotyczący przeciwdziałania międzynarodowemu unikaniu opodatkowania. Ten entuzjazm przerodził się w mandat polityczny udzielony OECD przez G20 w 2012 r. Wśród mnogości propozycji środków prawnych przeciwdziałających unikaniu opodatkowania opracowanych przez OECD w ramach projektu BEPS, za kluczowe należy uznać: test jednego z głównych celów (principal purposes test, PPT) z MLI i ogólną klauzulę przeciwdziałania unikaniu opodatkowania (general anti-avoidance rule, GAAR) z unijnej dyrektywy przeciwdziałającej praktykom unikania opodatkowania (anti-tax avoidance directive, ATAD). Celem niniejszego artykułu jest znalezienie odpowiedzi na główne (tytułowe) pytanie badawcze: Czy GAAR (ATAD) i PPT (MLI) powinny być stosowane w podobny sposób? Hipotezą pozytywnie zweryfikowaną w ramach niniejszego opracowania jest to, że: im bardziej zbiegające się (koherentne) będzie stosowanie GAAR i PPT, tym mniej praktyk unikania opodatkowania i sporów wynikających z tego zjawiska będzie występować między podatnikami i organami podatkowymi. Istnieje jednak poważne zastrzeżenie: GAAR i PPT powinny być stosowane zgodnie z ogólną zasadą przeciwdziałania nadużyciom (general anti-abuse principle, GAAP) wynikającą z orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), a nie zgodnie z PPT zaprojektowanym przez OECD. Tylko takie podejście do stosowania GAAR i PPT może zapewnić właściwą równowagę między interesami fiskalnymi różnych państw a swobodami gospodarczymi podatników. Konstatacja ta wynika z analizy treści i struktury GAAR i PPT, celów polityki podatkowej wyrażonych w preambułach do MLI i ATAD, orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (TSUE), Komentarza OECD do Modelu Konwencji OECD oraz literatury.

Podważenie pozycji ustrojowej Trybunału Konstytucyjnego przez większość rządzącą po 25 października 2015 r. wpisuje się w ciąg zdarzeń głównie o charakterze ustawodawczym, które w istocie przekreślają status Rzeczypospolitej Polskiej jako państwo prawa. Rządzący, na czele z prezydentem, podejmują liczne działania i zaniechania stawiające ich ponad Konstytucją. Tryb i tempo uchwalania przez Sejm regulacji dotyczących ważnych dziedzin życia państwowego, takich jak ustawy: o policji, o mediach elektronicznych, o służbie cywilnej czy o prokuraturze, bez społecznych konsultacji i w atmosferze lekceważenia praw opozycji, niweczy demokrację proceduralną i rodzi najwyższy niepokój o cele, które rządzący stawiają przed sobą. Towarzyszące temu ruchy personalne na wysokich stanowiskach w administracji państwowej, w policji czy w agencjach rządowych, spółkach Skarbu Państwa i mediach publicznych, sprawiają wrażenie niekontrolowanych w pełni – ich gwałtowne nasilenie może wywołać chaos w życiu publicznym i pokusę wprowadzenia rządów autorytarnych. ; The undermining of the political position of the Constitutional Tribunal by the ruling majority seen since 25 October 2015 is one of a sequence of events, of largely legislative character, which in fact put an end to the status of the Republic of Poland as a state governed by the rule of law. The government, as well as president, is, by taking numerous measures or omitting to take others, putting itself above the Constitution. The manner as well as the speed at which the Seym passes resolutions concerning major spheres of public life such as legislative acts with respect to the police, electronic media, the civil service, or the prosecutor's office, which are being adopted without public consultation and in an atmosphere in which the rights of the opposition are ignored, is a blight on procedural democracy, stirring deep concerns about the goals that the current government is setting itself. The accompanying movement of personnel in high official positions in the state administration, the police, government agencies, companies with State Treasury participation and public media would seem to escape full control and the intensity with which it is forcedthrough may lead to chaos in public life and result in a temptation to impose authoritarian rule.

Effectiveness of Mediation in Administrative Proceedings ; Efektywność mediacji w postępowaniu administracyjnym
The institution of administrative mediation is a legal instrument, i.e. a measure aimed at achieving the objective of amicable settlement of a case. This nature of mediation is highlighted by the standards of the Code of Administrative Procedure. This study explores an impact of the Code-based mediation on the effectiveness of administrative proceedings. In this context, effectiveness signifies the accomplishment of goals that underlay the incorporation of mediation into the Code of Administrative Procedure as pertinent to the basic principles of administrative proceedings. Those goals include: the promptness of proceedings, the principle of citizens' trust in the administrative authority and the principle of amicable dispute resolution. The article elaborates upon the following four issues: grounds for the incorporation of mediation into the Code of Administrative Procedure, the essence and principles of mediation, the application extent of mediation, conclusions on how the way mediation is governed affects the effectiveness of administrative proceedings. ; Instytucja mediacji w sprawie administracyjnej jest instrumentem prawnym, czyli środkiem służącym osiągnięciu celu, jakim jest polubowne załatwienie sprawy. Taki charakter tejże instytucji podkreślają normy kodeksu postępowania administracyjnego. Niniejsze opracowanie ukazuje wpływ regulacji mediacji w Kodeksie postępowania administracyjnego na efektywność postępowania administracyjnego. Poprzez efektywność rozumiemy realizację motywów wprowadzenia mediacji do Kodeksu postępowania administracyjnego w związku z podstawowymi zasadami postępowania administracyjnego takimi jak: szybkość postępowania, zasada zaufania obywateli do organu i zasady polubownego rozwiązywania sporów. Artykuł omawia 4 zagadnienia: uzasadnienie wprowadzenia mediacji do kodeksu postępowania administracyjnego, istota i zasady mediacji, zakres zastosowania mediacji, wnioski dotyczące wpływu sposobu regulacji instytucji mediacji na efektywność postępowania administracyjnego.

There is no law making without law writing. Creating an act of law means organizing (coding) a rule into a strictly designed form. That form and the knowledge of coding allows a reader to extract rules from statues. The knowledge necessary for law writing includes but is not limited to the following elements of acts of law: statues, directives, editing, text structure, rules for amending and unifying etc. Development of legislative techniques and quality control in law writing are necessary to provide high quality law that citizens can trust.
Issues of Sources of Remuneration and Reimbursement of Expenses of the Curator of the Estate Appointed by the Administrative Court ; Problematyka źródeł pokrycia wynagrodzenia oraz zwrotu wydatków kuratora spadku ustanowionego na wniosek sądu administracyjnego
The curator of the estate may be established by a common court not only from office but also at the request of an administrative court. The rules determining the award of remuneration for actions taken before an administrative court in such a case come from procedural and material law provisions. However, they do not provide in an exhaustive way all the cases of granting remuneration to the curator of the estate in respect of the performed function. As a result, there is a need to solve such problems involving rules that are not explicitly expressed in the applicable regulations. This leaves the possibility to propose solutions for this kind of situation in practice. Due to the demand for consistency of the legal system, it is necessary to attempt to identify the entities responsible for covering receivables on the basis of the applicable regulations. Depending on the actions taken by the curator of the estate, this may be a court of inheritance or a governmental or local government administration body. Due to the postulate of legal certainty, it is necessary to postulate taking into account the legal opinions functioning in the literature in order to introduce regulations that will be considered exhaustive, from the point of view of entities applying the law. ; Kurator spadku może zostać ustanowiony przez sąd powszechny nie tylko z urzędu, lecz także na wniosek sądu administracyjnego. Reguły określające przyznanie wynagrodzenia za czynności podejmowane przed sądem administracyjnym w takim przypadku pozostają zawarte w przepisach prawa procesowego oraz prawa materialnego prywatnego. Nie przewidują one jednak w sposób wyczerpujący wszystkich przypadków przyznania wynagrodzenia kuratorowi spadku z tytułu sprawowanej funkcji. W efekcie pojawia się potrzeba rozwiązania takich problemów za pośrednictwem reguł, które nie zostały wprost wyrażone w obowiązujących przepisach. Stwarza to zatem możliwość zaproponowania rozwiązań tego rodzaju sytuacji w praktyce. Z uwagi na postulat zachowania spójności systemu prawa należy podejmować próby określenia podmiotów odpowiedzialnych za pokrycie omawianych należności na podstawie obowiązujących regulacji. W zależności od czynności podejmowanych przez kuratora spadku może to być sąd spadku bądź organ administracji publicznej lub samorządowej. Z uwagi na postulat pewności prawa należy postulować uwzględnienie funkcjonujących w literaturze poglądów prawnych w celu wprowadzenia regulacji, które będą uznawane za wyczerpujące z punktu widzenia podmiotów stosujących prawo.

In the article there was shown the issue of the power division and balance, which is regulated by the Republic of Poland Constitution. The rule of power division appears in the shaped constitutional state organs. There are different practical solutions connected with the realization of the power division and the agreement between the rules and their effects is described as the rule system. The real meaning of the tree division power rule accomplishes by the description the relations of the model between the legislature and executive. The Constitution of the Republic of Poland regards the division and balance rule of the legislature, executive and judiciary as the base of the Polish political system and expresses it directly in the content of the art.10 of the Constitution. The base of the democratic law state is the rule of the power division. The most important is the Constitution of the state and international treaties which regulate the human and civil rights.

Due to amalgamation of Polish and EU systems, the shape of many public policies in the country is the consequence of decisions taken within the EU – but what is more important – with participation of Poles. Complexity of the challenges ahead demands making decisions that the society shall feel are acceptable, or even proceeded with their co-authorship. Relevantly high degree of cooperation, co-decision making and shared responsibility – between executive and legislative power and non-public entities, within political decision making, is important in order to get as properly stable as possible standpoint of Poland, and for efficient implementation. Because of that, the aim of this analysis is the search for the answer to the question whether within challenges that await the EU, we may find those, that will lay especially in the field of interest of Polish non-public entities. In addition – is it justified (and to what extend) to include in such cases those entities into processes of working out standpoints of Polish officials. With such a research objective a thesis is being advanced, that in Poland awareness of EU functioning mechanisms, but also the level of inclusion of non-public entities into political decision making, is little and in face of challenges awaiting the union it is necessary to raise it.

Celem artykułu jest wykazanie, że niektóre ustawy w państwach demokratycznych o ugruntowanych rządach prawa są nieakceptowalne ze względu na ich imitacyjność. Ustawy imitacyjne to takie akty normatywne stanowione przez parlament, których celem jest pozorne rozwiązanie problemu społecznego. Przy tak rozumianej pozorności brak woli ustawodawcy wywołania skutków swej działalności, a jedynie występuje zamiar wytworzenia przekonania u adresatów norm, że taki skutek powstaje. W artykule wskazuje się na cztery rodzaje racji na rzecz odrzucenia ustaw imitacyjnych. Po pierwsze, ze względu na niezgodność regulacji prawnych ustawodawcy z standardami moralnymi wspólnoty politycznej (Ronald Dworkin); po drugie, ze względu na imitacyjny cel ustawodawcy, tj. brak związku między nakazanym/zakazanym zachowaniem a pozornym charakterem celu ustawodawcy (Lon L. Fuller); po trzecie, brak racjonalnego związku między nakazem prawnym a cechami objętej tym nakazem kategorii podmiotów/przedmiotów (Ofer Raban); po czwarte, brak związku konwencjonalno-normatywnego pomiędzy danym treścią przepisu nakazującego a celem ustawodawcy (Marek Smolak). W artykule postuluje się, by w argumentacji opartej na powyższych czterech racjach przyjąć, że mamy do czynienia z racją publiczną i w konsekwencji stosować test rozumnego sceptyka zaproponowany przez Ron den Ottera. ; This paper seeks to demonstrate that certain enactments in democratic countries where the rule of law is well established are inadmissible in view of their imitative nature. Imitative statutes are normative enactments of parliament which aim at an ostensible solution to a social problem. Ostensibility thus comprehended is accompanied by the absence of will on the part of the legislator to achieve any effect of their activity, as their sole intention is to engender a conviction among the addressed of the norms that such an effect actually takes place. The author discusses four types of reasoning in support of rejecting imitative statutes. These are as follows: first, given non-compliance of legislation with the moral standards of the political community (Ronald Dworkin); second, in view of the imitative goal of the legislator, or absence of a link between a prescribed/prohibited behaviour and the ostensible nature of legislator's goal (Lon L. Fuller); third, the lack of a rational relationship between a legal prescription and the features of the class of subject/objects to which the prescription applies (Ofer Raban); fourth, the lack of a conventional-moral relationship between the substance of a prescriptive provision and the goal of the legislator (Marek Smolak). The author argues further that argumentation based on the above four reasons should presume that public reason is involved and, consequently, administer the test of the reasonable sceptic as suggested by Ron den Otter.

Problem języka w klasztorze sióstr katarzynek w Krokach w pierwszej połowie XX wieku ; The language question in St Catherine's Convent in Krakės in the first half of the twentieth century
After 1918, the two Catholic convents on the territory of the Republic of Lithuania faced the issue of Lithuanisation, which was solved in different ways. The Benedictine Convent in Kaunas, the provisional capital of Lithuania, had been firmly Lithuanised by 1924. However, St Catherine's Convent in Krakės in Samogitia chose a different path. This article aims to find out how the Krakės convent dealt with the challenges of nationalism in the context of ongoing modernisation of its life at that time. The main objective is to present the shift from the Polish to the Lithuanian language in public and private life of the convent. The study is mostly based on original documents held in the archives of St Catherine's Convent in Kaunas. The Polish language was very important for the Krakės convent (established in 1645). According to the modified Rule of St Catherine the Virgin and Martyr adopted in Krakės in 1673, the language of prayers and sermons was Polish. Only daughters of noblemen were accepted to join; they were obliged to donate a dowry, which meant that only wealthy girls could become nuns. The Krakės convent stemmed from the cultural traditions of the nobility of the Grand Duchy of Lithuania. The establishment of the independent Republic of Lithuania meant that St Catherine's sisters of Krakės needed to re-evaluate their political (civic), national and cultural identities. The study indicates that the solution to the language question in the Krakės convent was not enforced. The sisters were able to naturally reconcile to the situation, with time left to adapt. The article provides a detailed account of the reasons behind the gradual shift from Polish to Lithuanian. Initially, the nuns used Lithuanian to communicate outside the convent. It was not until 1930 that it began to be used in their community life, including prayers. Even then nuns could use Polish to communicate among themselves, say their private prayers or write letters. The study reveals various tensions which existed during this transitional period. However, the conclusion is that the convent successfully managed to avoid hasty decisions and resist emotions, as well as to balance between the universal and local church, the congregation of St Catherine in Braniewo (Braunsberg), the aims of various Lithuanian institutions, and the needs of the convent itself. The greatest achievement can be seen in the fact that the language issue in Krakės was not given unnecessary prominence and prioritised. As the study shows, giving it time was the best solution as the issue of language became resolved naturally, although the transition period lasted for a decade.
