This article is devoted consideration of some features to creation of "alternative" forms of a family and marriage, namely, to studying of such phenomenon as, co-habitation which conducts to loss of values of traditional forms of marriage, and also growth of process of illegitimate birth rate and other consequences. Now in a modern society "civil marriage" has got the certain legitimacy, with the given relations already to surprise nobody, and many justify its existence. In Russia "civil marriage" is a co-habitation of the people, doing not wish to connect itself the matrimonial both parental rights and the duties, therefore the traditional family gradually loses the appeal to a considerable part of the population. And the family based on alternative forms to marriage, namely, co-habitations, cannot is high-grade to carry out functions inherent in it. This modern phenomenon completely is not studied yet, and reserves weight of questions, and value for the most social institute of a family demands definition of its place, and. Article has the research character expressed in a teoretiko-methodological basis of research. As a material publications of domestic and foreign researchers in the periodicals acting, as a part of extensive mass media which form public opinion are used.

The article deals with issues affecting the resolution of disputes in the field of marriage and family relations, which are complicated by a foreign element: the right to be applied to the conclusion, as well as the dissolution of the marriage. The analysis of fundamental acts that regulate marital relations at the international level, as well as national legislation. There are indicated collision bindings at marriage, as well as examples of the rule of law in practice when a marriage is dissolved between Russian and foreign citizens.

In this article, on the basis of historical, comparative legal structural-functional and dialectical methods of research, the author examines the institution of marriage and family in the spiritual and moral dimension. The sources of Byzantine law have influenced the modern understanding of the family and its consolidation in the legislation of the Russian Federation. Particular attention in this article is given to the duties of spouses. After analyzing the family legislation of a number of Slavic states (Bulgaria, Serbia, etc.), the author found that little attention was paid to the duties of spouses in these documents. The duties of spouses are considered in the context of property relations, which emphasizes the modern influence of Western European liberal concepts of law. The author comes to the conclusion that the institution of the family cannot be measured by any material values in their utilitarian perception. That is why, when society perceives the moral essence of a family union based on obligation, having passed the path of «knowledge testing», such institutions for regulating property relations as a marriage contract will become unclaimed, which even today carries destructive properties for people who are not only married, but also on the way to it, a priori laying the motives of doubt and distrust between spouses (future spouses). Modern family legislation of the Russian Federation requires consistent and progressive ethization and implementation of a wider «catalog of duties» of spouses, based on the sources of Russian law (church law) and theological sources, which will gradually free the Family Code of the Russian Federation from neo-liberal tendencies that significantly impede the development of native Russian family tradition, family policy, which must be protected from vulgar positivism and ideological labels.

В данной статье поднимаются проблемы, не нашедшие своего законодательного разрешения. Действующий СК РФ лишь говорит о невозможности заключения брака однополыми лицами, однако далее существует правовая неопределенность, поскольку имеющиеся нормативные акты не определяют правовые последствия смены пола одним из супругов в семейных отношениях. Серьезной проблемой смены пола одним из супругов во время брака является защита прав и законных интересов детей, родившихся в подобном браке или у лиц, зарегистрировавших брак после смены пола при применении методов искусственного оплодотворения. Анализируется возможность квалификации смены пола родителем в качестве основания для ограничения родительских прав. Автором сделана попытка разрешения указанных вопросов и внесены предложения по совершенствованию законодательства. ; This article raises problems that have not found their legislative solution. The current Family Code of the Russian Federation only "speaks" of the impossibility of marriage by same-sex persons, but there is further legal uncertainty, as the existing normative acts do not determine the legal consequences of the change of sex by one of the spouses in family relations. The protection of the rights and legitimate interests of children born in such a marriage or of persons who have registered a marriage after a change of sex in the application of artificial insemination methods is a serious problem of sex change by one of the spouses during marriage. The possibility of qualifying a parent 's sex change as a basis for restricting parental rights is analysed. The author tried to resolve these issues and made proposals to improve the legislation

The study of sex characteristics in characterological types distribution of
pubertal and adolescent population showed that histeroid character traits (42,4 %)
and psychastenic character traits (20,7 %) which form a character type or a mixture
occur more often in a female sampling group; schizoid (28,8 %), epileptoid (44,7 %)
and unstable character (15,2%) traits are common for a male sampling group.
However epileptoid character traits manifestation in a population can be transient.
In general, selected groups are mainly represented by epileptoid (39%), histeroid
(34,7%) and schizoid (23,2%) character traits.

The article introduces the creative work of the famous American playwright Sam Shepard, whose works are almost unknown to our Uzbek reader. His plays are wellknown throughout the world; they influenced the formation of the worldview of readers of different nations and show the peculiarities of American culture. Despite the worldwide fame of Sam Shepard's works, they are not studied well by literary critics. In America and Europe his works have been studied in details for a long period, and even several monographs in English have been written. However, neither in the Russianspeaking, nor in the domestic literary criticism there is yet no major work on Shepard's works. The article also deals with the artistic features of the political myth of the "American dream" in one of the most scandalous plays, "The God of Hell," dedicated to the protest against the war in Iraq. Thus, this study, which touches upon some issues of Shepard's creative work in connection with his innovative artistic originality, to a certain extent, seeks to fill this gap.

Vl. Solovyov wrote extensively about love in his romantic and mystical poetry, in his correspondence and in his memoirs. He composed a whole book about love («The Meaning of Love», 1892-1894). The present paper is about the theme of love in Solovyov's moral philosophy as expounded in his «Justification of the Good» (1897). Love in the framework of society is legitimised in marriage, both religious and civil. Solovyov sees in marriage and family a positive consequence of the development of statehood. The problem is that he considered for a long time that the sexual act is unable to restore the lost integrity of the human being. Only chastity can. To get out of the difficulty, Solovyov invokes an «inner» (spiritual?) procreation different from an «outer» procreation. But it does not make things clearer. It seems that, in the last year of his life, Solovyov abandoned that spiritual maximalism, as is proved a contrario by the character of the Prince in «Three Conversations», who is both a celibate spiritualist and a precursor of the Antichrist.

Данная статья посвящена научному рассмотрению и анализу текущей ситуации, связанной с молодежной брачностью в Китае. В статье также подробно, с учетом национальных реалий, разбирается отношение молодежи к брачности и меры, предпринимаемые властями рассматриваемой страны, для корректировки текущей политической ситуации в сфере молодежной брачности. Дан авторский анализ эффективности предпринимаемых политических действий.
Целью данной статьи является проведение всестороннего анализа государственной молодежной политики Китая в сфере брачности.
Задачи статьи: анализ мер, реализуемых руководством Китая, для увеличения числа официально зарегистрированных браков среди молодежи; анализ эффективности мер, проводимых руководством Китая, для увеличения брачности среди молодежи.
Выдвигаемая гипотеза состоит в том, что в настоящее время уровень брачности на территории Китая снижается.
Концептуально-методическая база исследования состоит из метода дескриптивной статистики, социокультурного метода, цивилизационного метода, ценностного метода, а также компаративного метода.
Результат проведенного исследования – комплексное понимание реалий рассматриваемого вопроса.
Полученные выводы позволяют говорить о постепенном прогрессе эффективности существующих в КНР в настоящий момент мер по данному вопросу.

Раздел "Международное право" ; В статье исследуются вопросы коллизионного регулирования института брачного договора. Особое внимание уделяется выявлению оптимальных подходов коллизионного регулирования брачного договора путем анализа национального законодательства государств — участников СНГ, европейских государств (Бельгии, Германии, Нидерландов, Польши, Франции), а также международных договоров, регламентирующих данный вопрос. В статье сформулированы предложения по совершенствованию законодательства Республики Беларусь о браке и семье, осложненного иностранным элементом. = The article is devoted to the issues of confl ict regulation of the institution of the marriage contract. Particular attention is given to identifying optimal approaches to confl ict regulation of relations governed by the marriage contract through the analysis of the national legislation of the CIS member states, the European countries (Belgium, Germany, the Netherlands, Poland, France), as well as international agreements. The article provides recommendations for improving marriage and family legislation of the Republic of Belarus.

The article deals with the concept of a marriage contract, its subject composition, a comparative analysis of the marriage contract in the Russian legislation and the CIS countries. The work emphasizes that the marriage contract is currently objectively the most universal tool for pre-trial settlement of disputes between spouses on the division of property, and in the proceedings of the relevant disputes in court and, importantly, with its competent drafting, the marriage contract is an indisputable proof of ownership, use and disposal of property that were acquired in marriage, one of the spouses. This important aspect of the characteristics of the marriage contract is undoubtedly one of its most significant advantages since it turns out that it provides protection to the subjects who concluded it in case of any dispute. The author analyzes the provisions of the legislation of the CIS countries and notes that this institution of civil and family law in different countries has some differences. Undoubtedly, this particular circumstance is influenced by a considerable number of factors, such as the level of development of legislative technology, property and family relations, the role of traditions, political characteristics, etc. At the same time, the author highlights a large number of common features in the definition and characteristics of the marriage contract in the legislation of the CIS countries.

Анализируются особенности коллизионного регулирования вопросов заключения, расторжения брака и признания брака недействительным по законодательству стран Евразийского экономического союза и Европейского союза. Делается вывод о том, что отсутствие соответствующих положений в семейном законодательстве Республики Беларусь не удовлетворяет современным потребностям регулирования отношений с иностранным элементом. Формулируются предложения о наиболее прогрессивных коллизионных нормах, которые могут быть инкорпорированы в национальный правопорядок. = This article looks at the peculiarities of conflict regulation of marriage, divorce and recognition of a marriage as invalid under the EU and EAEC legislation. The conclusion is that, the absence of corresponding provisions in the family legislation of the Republic of Belarus does not meet the modern needs of the regulation of relations with a foreign element. Suggestions are made about the most progressive conflict rules that can be incorporated into the national legal order.

The article presents the results of a study of the institution of the modern Russian family, the purpose of which was to determine the nature of the transformation processes experienced by the modern Russian family.
It is substantiated that without this complex sociocultural education, stability and sustainable development of society is impossible: the family, being part of the social structure, performs the functions prescribed by society and ensures that the new generation acquires basic values, cultural norms, and socially approved forms of behavior, thereby socializing it.
It is indicated that the family is influenced by external dysfunctional social phenomena characteristic of both Russian society and the entire world community in general. The authors of the article analyzed scientific approaches to assessing the nature of changes experienced by a modern family. It has been established that researchers' assessment of the transformation processes that have caused changes in marriage and family relations is carried out in the context of two paradigms — the modernization of the family and the crisis of the institution of marriage and family relations. Supporters of the modernization paradigm believe that the modern Russian family is evolving along with society, experiencing a process of modernization that is predominantly positive. Researchers, whose assessment of modern marriage and family relations is made from the standpoint of a crisis approach, argue their position by the fact that transformation processes not only destructure the family, but also undermine the institution of marriage and family relations, which without radical measures will lead to large-scale destructive consequences up to the loss of statehood.
The significance of the study lies in the fact that a theoretical understanding of the features of institutional transformations will make it possible to develop appropriate control mechanisms and take certain «protective» measures aimed at preserving the family's essence as a basic stabilizing factor in modern Russian society.
