En el marco de celebraciones políticas ocasionales, el constitucionalismo contemporáneo inscribe en los textos constitucionales los principios y normas de la soberanía y la seguridad alimentaria. Los derechos a la alimentación, considerados como meta-derechos a no tener hambre, se integran también en ese marco al sistema de los derechos sociales fundamentales. La esfera pública se satura de instantáneos debates sobre la trascendencia de la soberanía y la seguridad alimentaria, y sobre las técnicas de garantía al nuevo metaderecho; pero su pronta desaparición como materia a corregir y a ser debatida constantemente en la esfera pública evita reflexiones críticas sobre el sentido que puede asignársele a estos conceptos e instituciones. El presente estudio plantea la necesidad de aprehender el sentido de la soberanía alimentaria a través del itinerario histórico del concepto y la institución de la soberanía en la Modernidad, pues con una crisis de soberanía del Estado racional moderno, hoy en boga, sin la mediación de una reconstrucción conceptual e institucional los principios y normas constitucionales de soberanía y seguridad alimentaria suenan huecos y vacíos de contenido. ; Under occasional political celebrations the contemporary constitutionalism inscribed on texts the principles and norms of sovereignty and food security. Constituir órdenes soberanos, redefinir a los sujetos políticos y consolidar formas legítimas de inscripción y refrendación en un nuevo ordenamiento político global fueron retos políticos primordiales de la segunda mitad del siglo XIX. Esta mesa explora las principales tensiones y acuerdos, locales e internacionales, que la constitución y reconocimiento de órdenes regionales, nacionales y americanos supuso en la consolidación de dichas jerarquías globales. ; Constitute sovereign orders, redefine political subjects and consolidate legitimate forms of registration and endorsement in a new global political order were primary political challenges of the second half of the 19th century. This table explores the main tensions and agreements, local and international, that the constitution and recognition of regional, national and American orders supposed in the consolidation of said global hierarchies.
Health is a fundamental human right whose full enjoyment implies the access to medicines that cannot be diminished in front of the property right derived from patents, and therefore the State must ensure it through the implementation of legislative, administrative, budgetary actions as well as technological innovation for the local production of medicines, which represents a reconceptualization of the State's function, no longer as a watchdog and governing body of the market but as an economic agent. The right to health cannot be limited to the mere access to medicines classified as essential, nor can its assurance be affirmed only by the affordability of such medicines. Among the measures that the state must adopt in the exercise of pharmaceutical sovereignty in order to achieve effective access to health is innovation and national production of medicines through the promotion of science and technology in this sector in order to progressively stop depending on the transnational companies of the pharmaceutical industry and the importation of medicines. ; La salud es un derecho humano fundamental cuyo goce pleno implica el acceso a los medicamentos que no puede menguarse frente al derecho de propiedad derivado de las patentes y por ello el Estado debe asegurarlo mediante la implementación de acciones de carácter legislativo, administrativo, presupuestales, así como de innovación tecnológica para la producción local de medicamentos, lo que representa una reconceptualización de la función estatal, ya no como órgano vigilante y rector del mercado, sino como agente económico. El derecho a la salud no puede limitarse al mero acceso a medicamentos catalogados como esenciales ni su aseguramiento puede afirmarse solo por la asequibilidad de estos. Lo anterior invita a tornar la mirada a la soberanía farmacéutica del Estado colombiano, sobre todo para la consecución del acceso efectivo a la salud a través de la innovación y producción nacional de medicamentos, así como el fomento de ciencia y tecnología en este sector para progresivamente dejar de depender de las empresas transnacionales de la industria farmacéutica y la importación de medicamentos.
The argumentative analysis on human rights and human sovereignty, is conceived with the purpose of reflecting on the complexities that represent as a social phenomenon, either human rights or sovereignty. Human rights, sovereignty, globalization and external debt are interconnected issues, which explain a correlation between them, that can be positive if there is citizenship capable of undertaking actions in progress of their people, and will be negative in the measure this citizenship does not exist and society becomes dependent on external agents to work on its development. If sovereignty is overturned, the human rights of the people who inhabit a certain territory are violated, this violation can be by the State itself or by external States. To be sovereign, it is necessary to have citizens in knowledge and fulfillment of their constitutional rights and duties. Democracy and human rights are a complex network, as the model of political philosophy that develops in a particular country, will be the management of human rights. ; El análisis argumentativo sobre los derechos humanos y soberanía humana, se concibe con la finalidad de reflexionar sobre lo complejo que representan como fenómeno social, tanto los derechos humanos como la soberanía. Los derechos humanos, soberanía, globalización y deuda externa, son temas interconectados entre sí, lo cual índice en una correlación entre los mismos, la cual puede ser positiva si existe ciudadanía en capacidad de emprender acciones en progreso de su pueblo, será negativa en la medida que esta ciudadanía no exista y la sociedad se constituya en dependiente de agentes externos para trabajar en su desarrollo. Si se trastoca la soberanía, se violan los derechos humanos de las personas que habitan un determinado territorio, esta violación puede ser por el propio Estado o por Estados externos. Para ser soberanos es necesario contar con ciudadanos en conocimiento y cumplimiento de sus deberes y derechos constitucionales. La democracia y los derechos humanos se constituyen un entramado complejo, por cuanto sea el modelo de filosofía política que se desarrolle en un determinado país, será el manejo de los derechos humanos.
The aim of this paper is to explain some biopolitic's shifts in texts by Jacques Derrida. In order to do this, first it is established a framework of understanding of the category of biopolitics and the difference between Foucault and Derrida about it. Secondly, it is shown the displacements produced by Derrida: a critique to the historical periodization, a deconstruction of negative biopolitics (showing the link to sovereignty) and a deconstruction of affirmative biopolitics (showing the constitutive link between life and death). This is all to say that there are two different ways to think of contemporary political thought. ; El objetivo del presente artículo es precisar algunos desplazamientos en la biopolítica desde textos de Jacques Derrida. Para ello, en primer lugar, se establece un marco de comprensión de la categoría de biopolítica y se muestra la diferencia entre Foucault y Derrida al respecto. This paper focused on the review of the literature to know the main definitions of food security and sovereignty, establish their differences, and how globalization intervenes in the application of these concepts in the world. It is concluded that food security and sovereignty constitutes a fundamental part for all sectors in developing countries, as in the case of Nicaragua. In education and rural development, food security and sovereignty is very important to evaluate its effects.Globalization as a new form of domination, tries to impose on countries like ours what needs to be produced, and also how to do it to satisfy the demands and needs of the most powerful nations. They also impose what we must consume, forcing us to be consumers and importers of junk food. Regrettably, the guidelines of a healthy diet are subject to the laws of the international market, and oblige us to consider the formulation of a Food Policy that equitably distributes the goods that we produce, that guarantees the right of our people to Food, which guarantees Food Security and above all, the Food Sovereignty of this country that we love. The link between hunger and climate change is already known and is not new in the literature, especially if we take into account only the national level and trade related. The intense land use to produce just one cultivation, the burning and deforestation methods applied to clear the soil and to make the crops rotations, which damage the mineral resources and displace animals from their habitats, jointly with the intense use of pesticides and transgenic technology in the agriculture, such as in soy and corn cultures, are related to the increase of hunger in the world because hunger is not only about production, but also consumption (income of people and quality of food choices) and distribution (food waste and poor people access to food), and the way the soil is managed is crucial for the production of nutritious quality food. However, an underexplored approach has great potential to provide important elements in the search for a sustainable and lasting solution to those issues. This approach is the concept of food sovereignty. The concept of food sovereignty includes production and consumption in local level, but aiming the collective well-being, through using sustainable techniques to produce food (natural fertilizers, adequate planting and collection cycles for each type of food, no use of artificial pesticides and adequate soil management without deforesting, polluting or burning areas), prioritizing family farming and the supply of more nutritious and quality food. This concept addresses some possible solutions to two of the most bother issues in the present time in a multi-level analysis to counter economic and political marginalization. Food sovereignty practices would lead us to end, or at least reduce, the hunger situations and the problems related to climate changes as long as we improve our food systems to efficient, but also more human ones. El vínculo entre el hambre y el cambio climático ya es conocido y no es nuevo en la literatura, especialmente si lo tenemos en cuenta solo a nivel nacional y el comercio relacionado. El uso intensivo de la tierra para producir un solo cultivo, los métodos de quema y deforestación aplicados para limpiar el suelo y hacer rotaciones de cultivos, que dañan los recursos minerales y desplazan animales de sus habitats, sumado al intenso uso de pesticidas y tecnología transgénica en la agricultura, como en los cultivos de soja y maíz, están relacionados con el aumento del hambre en el mundo, porque el hambre no es solo producción, sino también consumo (ingresos de las personas y calidad de la variedad de alimentos) y distribución (alimentos desperdiciados y acceso de la gente pobre a los alimentos), y la forma en que se maneja el suelo es crucial para la producción de alimentos nutritivos de calidad. Sin embargo, un enfoque poco explorado tiene un gran potencial para proporcionar elementos importantes en la búsqueda de una solución sostenible y duradera para esos problemas. Este enfoque está en el concepto de soberanía alimentaria. El concepto de soberanía alimentaria incluye la producción y el consumo a nivel local, pero teniendo como objetivo el bienestar colectivo, mediante el uso de técnicas sostenibles de producción de alimentos (fertilizantes naturales, ciclos adecuados de siembra y recolección para cada tipo de alimento, no usar pesticidas artificiales y un adecuado uso del suelo sin deforestación, contaminación o quema de áreas), priorizando la agricultura familiar y el suministro de comida más nutritiva y de mayor calidad. Este concepto aborda algunas posibles soluciones a dos de los problemas más problemáticos en el presente en un análisis a varios niveles para contrarrestar la marginación económica y política. A balance of CARICOM leadership performance through the first 50 years of the organization is presented, focusing on the participation or exclusion of common people in the evolution of the organization and its member states. It is shown that leaderships have been acting as single persons, mainly supported on their individual authority. This behaviour has led to the exclusion of people from the regional integration process since the construction of sovereignty has resulted in the personal sovereignty of political leaders. Limitations and restriction on people mobility within member states, among other issues, have also arisen as a result of this type of leadership in opposition to the declarations of good intentions in this direction. In accordance with the diagnostic, the need of a new agenda pretending to attain the popularisation of the sovereignty of CARICOM is stated as a component to be taken into account in a wide framework in the projection for the next 50 years of the organization. The required agenda should be constructed on the basis of a sovereignty bargain built around some essential features which allow the attainment of a popular sovereignty involving common people and considering simultaneously the regional and national sovereignties. ; Se presenta un balance del liderazgo la dirección del CARICOM a lo largo de los primeros 50 años de la organización, haciendo énfasis en la participación o exclusión de la gente común en la evolución de la organización y sus estados miembros. Se muestra que los liderazgos han actuado como personas individuales, apoyados principalmente en la autoridad individual. Este comportamiento ha llevado a la exclusión de la gente en los proceso de integración regional ya que la construcción de soberanía ha devenido en la soberanía personal de los líderes políticos. Este tipo de liderazgo también ha dado lugar, entre otras cosas, al surgimiento de limitaciones y restricciones en la movilidad de la gente entre los estados miembros, contrario a las declaraciones de buenas intenciones en este sentido. De acuerdo con el diagnóstico, se establece la necesidad de instaurar una nueva agenda con miras a alcanzar la popularización de la soberanía del CARICOM, como un componente a ser tenido en cuenta como parte de un marco de referencia amplio en la proyección de los próximos 50 años de la organización. La agenda requerida debería construirse sobre la base de un acuerdo de soberanía construido alrededor de algunas condiciones esenciales que permitan el logro de una soberanía popular que involucre a la gente común y que considere simultáneamente las soberanías regionales y nacionales.
