The article analyzes the current problems of using certain special knowledge in the investigation of murders. The essence and basic forms of special forensic knowledge (participation of a specialist in conducting investigative (search) actions, consultations of specialists, conducting forensic examinations) used in the process of investigation of these criminal offenses are determined. Emphasis is placed on the expediency of more frequent use of such types of expertise as phonoscopic, soil science and handwriting, the theoretical foundations and methodological basis of which need to be updated and adjusted to take into account the latest techniques and leading world practices. It is concluded that the level of development of relevant methodological recommendations in Ukraine in the field of phonoscopic, soil science and handwriting, their lack of focus on today's problems of investigative and judicial practice. The solution to this problem will be facilitate by the development at the state level and updating of the training program for novice experts, which should include a thorough study of both classical and modern methods and techniques, advanced foreign experience, which will expand the professional worldview research in proving the circumstances of committed criminal offenses, including murder.
The article is devoted to highlighting the issue of the use of special knowledge in the way of conducting an examination during the investigation of crimes committed with the use of violence. The study illustrates that the proposition that the expert's participation in the evidence in criminal proceedings is based on the laws and categories of dialectics and formal logic and, moreover, is carried out by combining practical and intellectual activity. Also, the main and atypical types of examinations are distinguished: forensic medical; forensic psychiatric; forensic psychological; forensic biological; ballistics; cold weapons examination; trans- and dactyloscopic. Depending on the investigative situation at the time of the forensic examination and the available evidence, a list of issues to be resolved by the expert is indicated, such as: forensic chemistry during the investigation of violent crimes; forensic and orological; soil science; molecular and other genetic examinations, depending on the type of crime, the situation under investigation and the physical objects available. It was concluded that the theoretical and methodological foundations of such examinations need to be updated and adapted to the latest technology and the best state-of-the-art world experience.
Pētījuma gaitā iezīmējās vairāki problēmjautājumi, kuru risinājumu priekšlikumus autors sniedz darba noslēguma daļā. Šo priekšlikumu ieviešana sasniegtu arī darba noteikto mērķi – subjektu ar speciālajām zināšanām darbību reglamentējošo tiesību aktu problēmu risināšana un pilnveidošana. Pirmajā nodaļā tiek apskatīta speciālo zināšanu izpratne kriminālprocesā, proti, pirmajā apakšnodaļā tiek izklāstīts īss vēsturisks pārskats par speciālo zināšanu un to subjektu attīstību, savukārt otrajā apakšnodaļā tiek izpētīts šo speciālo zināšanu saturs. Otrajā nodaļā ar apakšnodaļām tiek apskatīta eksperta kā subjekta ar speciālajām zināšanām darbības tiesiskais regulējums Kriminālprocesa likumā, kā arī apskatītas eksperta tiesības, uzdevumi un pienākumi. Trešajā nodaļā – citu kriminālprocesu dalībnieku ar speciālajām zināšanām darbības tiesiskais regulējums kriminālprocesā, šo subjektu ar speciālajām zināšanām atbildības regulējums, kā arī tiek izpētīta tiesu prakse attiecībā uz Krimināllikuma 300. un 302.pantu. Visbeidzot, darba ceturtajā nodaļā autors ar prakses materiāliem analizē speciālo zināšanu nozīmi pierādīšanā kriminālprocesā, kā arī "ne tiesas ekspertīžu" lomu kriminālprocesa ietvaros. ; During the research, a number of challenges appeared; the solution suggestions of these challenges are provided in the final part of the paper. The realization of these issue questions would help to reach the goal of the Master thesis – the solution of the problem that concerns the subject's with special knowledge regulatory legislation. The first chapter of the paper comprises a brief historical overview of the development of the subject's with special knowledge institute in criminal procedure and reveals the understanding of "special knowledge" in criminal procedure. The second chapter deals with the expert's with regulation in Criminal Procedure Law and Judicial Expert Law. Moreover, the third chapter deals with the other subject's with special knowledge in criminal proceedings and reveals responsibility and legal practice of the Criminal Law 300th and 302nd. Finally, the fourth chapter author analyzes the material practice of special knowledge role of evidence in criminal proceedings, as well as "no forensic expertise" role in criminal proceedings.
The article deals with problematic issues regarding the forms of special knowledge use while crime investigation, legislative acts are analyzed. Based on the opinion analysis of criminalistic scientists, forms of special knowledge use divided according to different criteria into procedural and non-procedural, direct and indirect, basic and optional are detailed. The most commonly used forms are indicated, among them: appointment of forensic examinations, involvement of specialist for performing investigative actions, consulting and reference, auditing and monitoring of records, the presence of an investigator during an examination, expert questioning. Legislation changes concerning of examination by a Forensic science institution (expert) only according to the investigating judge decision or court made on the petition of one of the parties to criminal proceedings are analyzed. Positive reform aspects, as well as the argument about the loss of procedural independence of the investigator while decision making under such circumstances were highlighted; it was suggested to review the above changes. Taking into account legislation changes, the role of the specialist during the search relatively of mandatory fixation of this act by means of audio and video recording is indicated. Proposals are offered on the use of several cameras, the use of quadcopters, 3D scanners to capture of the important points for proving of the search. Problem issues existing in the units of criminalistic support during investigative actions are outlined and the mechanism of their solution is proposed. Attention is focused on the use of automated records and prospects for their development. ; Рассмотрены проблемные вопросы, касающиеся форм использования специальных знаний при расследовании преступлений, проанализированы законодательные акты. На основании анализа позиций ученых-криминалистов выделены формы использования специальных знаний, разделяющиеся по различным критериям на процессуальные и непроцессуальные, непосредственные и опосредованные, основные и факультативные и т.д. Обозначены наиболее часто используемые формы, среди которых: назначение судебных экспертиз, привлечение специалиста для проведения следственных действий, консультационно-справочная, ревизии и проверка по учетам, присутствие следователя при проведении экспертизы, допрос эксперта. Проанализированы изменения законодательства, касающиеся проведения экспертизы экспертным учреждением (экспертом) только по постановлению следственного судьи или суда, вынесенным по ходатайству одной из сторон уголовного производства. Отмечены положительные стороны реформы, а также аргументирована точка зрения об утрате процессуальной самостоятельности следователя в принятии решения при таких обстоятельствах, предложено пересмотреть указанные изменения. Учитывая изменения в законодательстве, обозначена роль специалиста во время проведения обыска относительно обязательной фиксации этого действия с помощью аудио- и видеозаписи. Даны предложения по поводу использования нескольких камер, использования квадрокоптеров, 3D сканеров для фиксации важных для доказывания моментов обыска. Очерчены проблемные вопросы, существующие в подразделениях криминалистического обеспечения при проведении следственных действий и предложен механизм их решения. Акцентировано внимание на использовании автоматизированных учетов и перспективы их развития. ; Досліджено проблемні питання, що стосуються форм використання спеціальних знань при розслідуванні злочинів. In Criminal Process Code that is currently in force in Lithuania, the following of special knowledge usage are distinguished: a specialist's participation in investigation actions, a specialist's conclusion, the expertise and the revision. In Criminal Process Codes of many countries, only one form of special knowledge usage is distinguished, i.e. expertise. In the new Criminal Process Code of Lithuania, they propose to regulate only these forms of special knowledge usage: the expertise and a specialist's participation in investigation actions. The perspectives of special knowledge usage might be subdivided into the following groups: the adjustment of legal basis, the solution of organisational issues, the preparation of specialists and the raising of their qualification, the development of technical basis. It is proposed to prepare criminalists-technicians and experts in the Law Academy of Lithuania since there are several important and considerable reasons for this. First, criminalists-technicians work in me police structure and the specialists for the structure are prepared by the Law Academy of Lithuania. Second, a well-prepared modern teaching basis is available here and a sufficient material and intellectual potential is accumulated. Currently, there are no laws in Lithuania regulating the activities of non-expert institutions carrying out expertises and the issue of licences granting the right for persons to carry out expertises. A governmental Public Coordination Service for Expertise Issues should solve this by coordinating the activities of all expert institutions, licensing expert work and organising scientific methodological activities.

The article expresses the author's position on the definition of general principles (principles) for the use of special knowledge in the investigation of crimes. identify and characterize the legal and organizational basis for the use of special knowledge in the investigation of crimes. In our opinion, the principles of using special knowledge by certain subjects of criminal proceedings coincide primarily with the norms and principles of criminal procedure legislation and are the most important and defining legal provisions on which the process of criminal investigation is based. The author establishes that the use of special knowledge in the pre-trial investigation is based on the following principles: the principle of legality of the use of special knowledge; the principle of independence of a person with special knowledge; the principle of objectivity, comprehensiveness and completeness of the use of special knowledge; the principle of non-disclosure by a person who applies special knowledge in the process of conducting investigative (search) actions of pre-trial investigation data; the principle of impartiality of a person who applies special knowledge in the process of conducting investigative (search) actions; the principle of observance of the constitutional rights and freedoms of citizens involved in the pre-trial investigation process; the principle of observance by each participant of criminal proceedings in the course of use of special knowledge strictly within the competence. The author emphasizes that the general legal basis for the use of special knowledge in the investigation of crimes should include the rule of law, legality, equality of law and court, respect for human dignity, the right to liberty and security of person, inviolability of home or other property, secrecy communication, privacy, inviolability of property rights, legality, independence, objectivity and completeness of the study. The article notes that the correct understanding, interpretation and observance of the above principles by these entities are guarantees of the tasks of criminal proceedings, the implementation of a prompt, complete, impartial and effective investigation and the provision of criminal proceedings with appropriate evidence. The conclusions formulated in the article are theoretical categories that are part of the fundamental foundations of the activities of specialists, experts and law enforcement officers, which determine the content and directions of their activities in the investigation of crimes. ; У статті висловлюється авторська позиція щодо визначення загальних засад / принципів використання спеціальних знань у процесі розслідування злочинів. Визначено й охарактеризовано правові й організаційні засади використання спеціальних знань під час розслідування злочинів. На наш погляд, принципи використання спеціальних знань визначеними суб'єктами кримінального провадження збігаються насамперед із нормами та принципами кримінально-процесуального законодавства, являють собою найважливіші й визначальні правові положення, на яких ґрунтується процес розслідування злочинів. Автором встановлюється, що використання спеціальних знань на досудовому слідстві здійснюється на підставі таких принципів: принципу законності використання спеціальних знань; принципу незалежності особи, що володіє спеціальними знаннями; принципу об'єктивності, усебічності та повноти використання спеціальних знань; принципу нерозголошення особою, яка застосовує спеціальні знання у процесі проведення слідчих (розшукових) дій, даних досудового слідства; принципу неупередженості особи, яка застосовує спеціальні знання у процесі проведення слідчих (розшукових) дій; принципу дотримання конституційних прав і свобод громадян, залучених у процес досудового слідства; принципу дотримання кожним учасником кримінального провадження у процесі використання спеціальних знань строго в межах своєї компетенції. Автором підкреслюється, що до загальних правових засад використання спеціальних знань під час розслідування злочинів варто віднести такі, як: верховенство права, законність, рівність перед законом і судом, повага до людської гідності, забезпечення права на свободу й особисту недоторканність, недоторканність житла чи іншого володіння особи, таємниця спілкування, невтручання у приватне життя, недоторканність права власності, законність, незалежність, об'єктивність і повнота дослідження. У статті відзначається, що правильне розуміння, тлумачення та дотримання наведених засад указаними суб'єктами є гарантією виконання завдань кримінального провадження, здійснення швидкого, повного, неупередженого й ефективного розслідування, забезпечення кримінального провадження належними доказами. Сформульовані у статті висновки є теоретичними категоріями, що становлять складову частину тих фундаментальних підстав діяльності спеціалістів, експертів та працівників правоохоронних органів, що визначають зміст та напрями їхньої діяльності у процесі розслідування злочинів.
The article is devoted to the formation of a system of theoretical provisions that form the concept of forensic doctrine on the implementation of special knowledge outside forensic expertise (hereinafter - the Doctrine). With regard to the proposed Doctrine, the article reveals its following elements: the objective existence of the object of knowledge in the form of social relations arising from the implementation of special knowledge outside the forensic examination, and the identification of a set of elements that form the subject of knowledge; principles of the Doctrine; scientifically grounded goals, objectives and functions of the Doctrine; formed methods of the Doctrine; developed structure and content of the Doctrine; features of interaction and interrelation of the Doctrine and particular forensic theories (doctrines), sciences, etc. On the basis of the conducted independent scientific research, the author, under the forensic doctrine of the implementation of special knowledge outside forensic expertise, proposes to understand the branch of the section of forensic science, called the general theory of criminalistics, investigates the patterns of using special knowledge outside forensic expertise in the disclosure and investigation of crimes and develops methods and means of attracting persons possessing special knowledge, as well as the collection, research and use of their own and other special knowledge in legal proceedings.
The article is devoted to the use of special knowledge by the parties in criminal proceedings. On the basis of analysis of current legislation the necessity of granting additional guarantees for the participants of the criminal process on the implementation of right to protection through the use of special knowledge by making additions and amendments to the Criminal Procedure Code of the Russian Federation is justified. ; Статья посвящена проблемам использования специальных знаний сторонами в уголовном судопроизводстве. "In den letzten Jahren ist die Einrichtung klinischer Ethikkomitees wie eine Welle aus den Vereinigten Staaten nach Europa und Deutschland geschwappt. Diese Komitees haben von ihrer formellen Ausrichtung her - im Gegensatz zu medizinischen Ethikkommissionen - eine beratende Funktion für Patienten wie für medizinisches Personal in ethisch problematischen Fällen. Als drei Hauptaufgaben klinischer Ethikkomitees wird in der einschlägigen Literatur zwischen Entwicklung von Leitlinien für wiederkehrende ethische Dilemmata, Schulung des medizinischen Personals in ethischen Fragen sowie Besprechung und Beratung ethischer Problemfälle unterschieden. Die Institution eines Komitees erscheint als eine Reaktion auf Problemlagen im klinischen Alltag, die entweder als neu wahrgenommen werden - hier wäre vor allem an einen steigenden Druck bisher ungekannter Entscheidungssituationen zu denken, die durch technischen Fortschritt und Möglichkeitszuwachs in der medizinischen Wissenschaft aufgeworfen werden - oder aber für die bisher im Krankenhaus übliche Lösungen fraglich bis obsolet geworden sind. Das interdisziplinäre DFG-Projekt 'Ethik und Organisation' an den Universitäten München (Prof. Nassehi/ Prof. Schibilsky) und Göttingen (Prof. Anselm) hat in einem methodischen Dreischritt (biographische Interviews, teilnehmende Beobachtung, Experteninterviews) umfangreiches Material u.a. zu der Frage erhoben, wie es den Mitgliedern der klinischen Ethikkomitees gelingt, ein ethisches Sonderwissen im Krankenhauszu beanspruchen und zu etablieren, über das in Beratungen im Komitee und auf Station Beratungsautorität hergestellt wird. Der Vortrag will zeigen, dass dieses Wissen der Ethikexperten stets das Problem lösen muss, wie es sich von Begründungen und Deutungshoheiten des klassischen medizinischen Professionswissens abgrenzen und sich gegenüber diesen behaupten kann. Die Ethikkomitees dringen dabei als formelle Struktur in den Bereich des Arzt-Patienten-Verhältnisses ein, das traditionell als besonderes lebensweltliches Vertrauensverhältnis zwischen professionellem Mediziner und seinem Klienten gedacht wird. Es ist ein Professionalisierungsprozess zu beobachten, in dem Ethik als Begründungs- und Reflexionswissen den Exklusivitätsanspruch der Medizin im Zugang zum Patienten aufzuweichen beginnt." Some issues of application of special knowledge in the course of investigation of crimes related to illegal drug trafficking are considered. Analyzed the scientific literature, regulatory legal acts devoted to the use of special knowledge in the study of narcotic drugs, psychotropic substances and precursors. The statistical data of the Office of the Prosecutor General of Ukraine are presented, indicating a significant increase in the level of drug-related crime in Ukraine. The increase in the number of drug-related crimes entails an increase in the need for the use of special knowledge in their investigation. In the process of applying special knowledge, a number of problematic issues arise that require legislative solutions. The purpose of the article is to identify theoretical and organizational problems arising in the process of applying special knowledge in the investigation of crimes related to drug trafficking. Attention was drawn to the project "Action — EU: EU Action on Drugs and Organized Crime. Intensive cooperation and capacity building to combat organized drug trafficking along the heroin route. " Under the auspices of this project, the Ukrainian Working Group for the Study of Psychoactive Substances was formed, one of the main goals of which is to improve the quality of forensic services in Ukraine, and one of the main forms of work is to conduct interlaboratory exercises. The results of participation in an interlaboratory exercise provide an opportunity to either confirm the performance of a particular laboratory, or indicate problems in such a laboratory. For the examination of narcotic drugs, psychotropic substances and precursors, access to comparative (standard) samples is required, the free receipt of which (or their exchange between institutions) is complicated by many factors. ; Розглянуто деякі питання застосування спеціальних знань під час розслідування злочинів, пов'язаних із незаконним обігом наркотичних речовин. Проаналізовано наукову літературу й нормативно-правові акти, присвячені питанням застосування спеціальних знань, дослідженню наркотичних засобів, психотропних речовин і прекурсорів. Наведено статистичні дані рівня наркозлочинності в Україні, оприлюднені Офісом Генерального прокурора України. Збільшення кількості наркозлочинів зумовило зростання вимог до застосування спеціальних знань, що, зі свого боку, потребує нагального законодавчого розв'язання низки проблемних питань. Мета статті — визначити методологічні й організаційно-правові проблеми, які виникають у процесі застосування спеціальних знань під час розслідування злочинів, пов'язаних із незаконним обігом наркотичних засобів. Звернено увагу на діяльність проєкту «ДІЯ — ЄС: Заходи ЄС з питань протидії наркотикам та організованій злочинності. Інтенсивне співробітництво та нарощування потенціалу для боротьби з організованою злочинністю у сфері наркоторгівлі вздовж героїнового маршруту». Для реалізації цього проєкту сформовано Українську Робочу Групу з дослідження психоактивних речовин (далі — УРГ ДПАР), однією з головних цілей якої є вдосконалення якості судово-експертних послуг вУкраїні. Поміж основних форм роботи УРГ ДПАР — проведення міжлабораторних вправ (далі — МВ). Результати участі у МВ свідчать про ефективність роботи лабораторії або про потенційні проблеми, які в ній виникли. Для проведення експертизи наркотичних засобів, психотропних речовин і прекурсорів фахівцям необхідні порівняльні (стандартні) зразки, отримання яких відповідними експертними установами вельми ускладнено через значну кількість різноманітних чинників.
