The essay investigates some stylistic and pragmatic variations across two genres and text-types pertaining to political oratory in Early Modern England. The speaker in question is the Renaissance monarch who, as many studies have shown from a cultural perspective, appropriates the forms of stage performance and, by manipulating them, acts his power and performs a relationship with his subjects. In this respect my study proposes to analyse and compare some aspects of non-literary and literary texts, Queen Elizabeth I's parliamentary speeches and Shakespeare's Henry V's monologues, as text-types which share a strong persuasive and argumentative aim and are both speech-purposed. The working hypothesis of my case study is that, by drawing attention to two specific speech-acts, directives and commissives, the evaluation of the illocutionary force of their speeches will shed light also on some typical features of the political discourse of Early Modern England.
Il dibattito alimentato dalla recente proposta di legge "Fiano" sull'inasprimento del reato di apologia del fascismo ha riportato all'attenzione dell'opinione pubblica e del dibattito politico il tema della libertà di espressione del pensiero e i suoi limiti. Le leggi pongono dei divieti e delle restrizioni per tutelare alcuni beni giuridici ed evitare che qualsiasi attore subisca danni ingiusti a causa di un altro. Il presente lavoro intende affrontare il tema della libertà di espressione del pensiero e dei suoi limiti nella legislazione europea ed in Italia, non tralasciando sia l'accenno e il confronto con l'ordinamento statunitense, sia le problematiche che le nuove tecnologie di comunicazione hanno introdotto, soffermandosi sulle motivazioni e le giustificazioni che spingono i legislatori europei a comprimere tale libertà. Non saranno invece oggetto di questa trattazione tutti quei reati di parola che non riguardano la manifestazione del pensiero (violazioni copyright, segreti industriali o di stato, istigazioni a delinquere e via dicendo) essendo il bene giuridico tutelato e i possibili danni emergenti correlati evidenti. Nel primo capitolo verrà introdotto il tema centrale della tesi, ossia la libertà di manifestazione del pensiero, attraverso un percorso sintetico sulle sue radici storiche nel diciottesimo secolo, e sulle tutele moderne di questo diritto, in ambito internazionale, europeo e nazionale. Nel secondo capitolo sarà introdotto il tema dell'hate speech e reati di opinione che sono ad esso collegati poichè da qui sorgono le principali problematiche alla libera manifestazione del pensiero. Nel terzo capitolo verrà fatta una breve comparazione con gli Stati Uniti d'America, per evidenziare come questi abbiano maturato un approccio diametralmente opposto a quello del vecchio continente. Nel quarto capitolo verrà brevemente osservato come e in quale misura l'avvento di Internet, delle nuove tecnologie ad esso legate e dei social network abbia influito sulla regolamentazione della libertà di espressione e quali misure sono state prese al riguardo. Infine il quinto capitolo approfondirà in particolare i limiti alla libertà di manifestazione del pensiero in Italia e il contributo che la giurisprudenza ha dato in questo ambito. L'ultimo capitolo è dedicato al reato di opinione "politica", sia all'estero che dentro i confini nazionali. Tale capitolo condurrà infine alle conclusioni e alla riflessione che deriva da questo scritto.
In this intervention the idea is submitted that the interim measures in the case Casapound v. Facebook, by means of which Fb Ireland was ordered by the Rome Tribunal (on December 12, 2019) to reactivate the profile of the extreme right wing political association Casapound - previously closed as a consequence of an alleged violation of fb standards concerning hate speech - can be criticized under international and european law. Such criticisms stem both from the overall picture of the international and european legal standards concerning hate speech (par. 2) and from the relevant case law of the European Court of Human rights (paras. 3 and 4).
La presente tesi propone un'analisi comparatistica sull'attuale fenomeno dell'hate speech online, sotto i profili filosofico-giuridico, informatico, sociologico e giuridico, al fine di delineare una soluzione informatico-giuridica alle relative criticità emergenti. Ripercorrendo l'evoluzione teorica del principio fondamentale della libertà di espressione, con particolare attenzione sul contesto storico e culturale di riferimento, si affronta, in primis, il rapporto tra tale libertà e l'hate speech, con la rievocazione dei fondamentali principi del danno e dell'offesa, emersi nella teoria giuridica del XIX e XX secolo. Successivamente, approfondito il peculiare contesto informatico in cui si sviluppa il fenomeno, l'esame si concentra, sotto il profilo sociologico, sui comportamenti umani che lo caratterizzano, focalizzando poi sulle diverse sfaccettature di cui si compone l'hate speech online: dall'odio politico, razziale, religioso alle emergenti manifestazioni di odio interpersonale, fino a giungere alle più rilevanti e preoccupanti forme di molestia online, quali il cyberstalking, il cyberbullismo e il revenge porn. Premessa, dunque, una panoramica teorica e sociologica sulla libertà di espressione e sulle forme espressive di odio e molestia in Rete, la tesi propone un'analisi giuridica del fenomeno, al tempo stesso comparatistica, critica e propositiva. Dopo un confronto critico tra i due principali pensieri teorico-giuridici che si contrappongono sul tema della regolamentazione dell'hate speech, quello europeo e quello americano, e una panoramica comparatistica sull'evoluzione legislativa e giurisprudenziale, la ricerca affronta le principali criticità connesse al fenomeno online, riguardanti i criteri di determinazione della competenza giurisdizionale, l'efficacia delle decisioni giudiziarie e il ruolo dei provider e dei gestori di spazi web. In una prospettiva de iure condendo, viene infine proposta l'attribuzione ai provider di responsabilità e compiti di immediato intervento come soluzione idonea al contenimento del fenomeno dell'hate speech online, non dimenticando la strategica rilevanza, nel lungo periodo, delle politiche educative di alfabetizzazione digitale e contrasto all'espressioni di odio in Rete. ; This thesis proposes a comparative analysis of the current phenomenon of online hate speech, under the philosophical, juridical, informatic, sociological and legal profiles, in order to outline a legal-informatics solution for its emerging critical issues. Looking back on the theoretical evolution of the fundamental principle of freedom of expression, with particular attention to the historical and cultural context of reference, it first addresses the relationship between freedom and hate speech, re-establishing the fundamental harm principle and offence principle, emerging in the juridical theory of the 19th and 20th centuries. Subsequently, the exam concentrates, from the sociological profile, on the different facets of which online hate speech is composed: from the political, racial, and religious hate to the emerging manifestations of interpersonal hate, to reach the most important and worrying forms of online harassment, such as cyberstalking, cyberbullism and revenge porn. Thus, stated a theoretical and sociological overview of freedom of expression and the expressive forms of hate and harassment on the Internet, the thesis proposes a legal analysis of the phenomenon, at the same time comparative, critical and proactive. After a comparison between the two main theoretical and legal thoughts contrasting the subject of the regulation of hate speech, both the european and the american one, and a comparative overview of legislative and jurisprudential approaches and developments, the research addresses the main criticalities connected with the online phenomenon, regarding the criteria for determining jurisdiction, the effectiveness of judicial decisions, and the role of providers and web site operators. Finally, in a de iure condendo perspective, it is proposed to assign to providers responsibility and immediate intervention tasks as a suitable solution to contain the phenomenon of online hate speech, not forgetting the long-term strategic relevance of the education policies on digital literacy and contrast to hate expressions in the Internet.

This work deals with lobbying from a legal point of view, and in particular legal-constitutional (comparative): it analyzes that is how this practice, whose impact on the democratic process is very high and constantly growing, is regulated, and above all which both the constitutional framework in which this regulation moves, and what this tells us about the legal system as a whole in some particularly significant systems: USA, Europe (EU and Council of Europe) and Italy.
The great speech of the Protagoras (320c–328d) still leaves many questions open. Particularly striking is the presence of doctrines that later on will be taken up and further developed by Plato in such dialogues as the Politicus, the Timaeus and the Laws. For this reason, many scholars tend to think that the words of Protagoras are just a product of Plato's invention that bear no relation to Protagoras' actual doctrines. Nevertheless, it is possible to propose a different interpretation. At the beginning of the Protagoras (313a–314b), Socrates develops the image of the sophist as the merchant of various μαθήματα: to sell his products, the sophist praises them all indiscriminately without knowing which of them are useful and which are harmful. But he who has the ability to make this distinction can still purchase the μαθήματα from Protagoras or anyone else. The title of this essay is intentionally provocative, for there are many who believe that freedom of speech is the preeminent academic value. Stanley Fish's challenge to that popular view depends on a distinction between freedom of speech and freedom of inquiry. Freedom of speech is a democratic value. It says that in a democracy government should neither anoint nor stigmatize particular forms of speech, but act as an honest broker providing a framework and a forum for the competition of ideas and policies. In this vision, every voice has a right to be heard, at least theoretically.
