O artigo enfoca, pela óptica do direito econômico, as influências das políticas econômicas privadas (basicamente do capital transnacional) e dos entes internacionais sobre as políticas econômicas públicas, especialmente as realizadas pelos Estados em desenvolvimento. Enfatiza a mutação do neoliberalismo de regulamentação para o de regulação como exigência dos poderes econômicos privados, identificando entre os seus resultados o enfraquecimento do Estado e a descrença na democracia. E, ainda, defende a existência de espaços para a execução de ações econômicas endógenas por parte dos Estados Nacionais, a fim de viabilizar a eficácia de suas Constituições econômicas e suprir as carências de seus povos. ; This paper deal with, by Economical Law view, the effects of private economic policy, essentially of foreign capital, and the international organizations above the public economic policy, mainly that politics performed by the development nations. ABSTRACT Introduction: This article analyzes the issue of Capacities for the implementation of public policies. The article examines the concepts of state capacity, policy capacities and policy work to analyze the role of bureaucratic roles in the implementation process. The article criticizes the concept of state capacities and advocates a perspective that the analysis of capacities should be focused on the performance of agents for the fulfillment of public policy functions. Materials and methods: Based on a survey analysis with agents of civil service bureaucracy, the article lists the central capacities for the performance of functions necessary for the implementation of public policies. Results: The theoretical finding is that capacity analysis should consider the role of individuals in the performance of policy functions and the organizational context in which they are embedded. This article is the result of a narrative literature review. The objective is to show the development of an overview on the ideological debate on the design of state health policies. We argue that the role of the state in the development of health policy, even under the pressure of the global market, may create alternatives to promote and drive economic and social development, meaning they are not subject to economic constraints imposed by the liberal ideal of market. Here is a part of a theoretical discussion about the construction and presence of the State in Latin America, particularly in Brazil. We take the approaches of the Marxist tradition and liberal to the issue as reference. This discussion allows us to understand the historical role of the state in the maintenance of social policies, specifically health, is an alternative to public control eases the intense capital mobility promoted by economic globalization. In this sense, the theme makes the Brazilian health an important issue of social sciences, why is the historicity of the construction of the Brazilian health system, as a public policy that can mirror the actual reconstruction of the institutional framework of the Brazilian state with the establishment instances of negotiation between the various spheres of power that strengthen the state in this process of democratization of Brazilian society. ; Este artigo é resultado de uma revisão bibliográfica narrativa, visando o desenvolvimento de um panorama acerca do debate ideológico sobre a concepção de Estado nas políticas de saúde. Nele, argumentamos que o papel do Estado brasileiro no desenvolvimento da política de saúde, mesmo sob a pressão do mercado globalizado, pode criar alternativas para promover e direcionar o desenvolvimento econômico e social, e que isso não significa submeter-se às restrições econômicas impostas pelo ideal liberal de mercado. Apresentamos parte de uma discussão teórica acerca da construção e presença do Estado na América Latina e, particularmente, no Brasil, tomando como referências as abordagens da tradição marxista e da liberal sobre a questão. Essa discussão permite-nos entender que o papel histórico do Estado na manutenção de políticas públicas sociais, especificamente as de saúde, é uma alternativa para que o controle público amenize a intensa mobilidade de capital promovida pela globalização econômica. Nesse sentido, o tema torna a saúde nacional uma questão importante das Ciências Sociais, por que é na historicidade da construção do sistema de saúde brasileiro, como política pública, que se pode espelhar a própria reconstrução do arcabouço institucional do Estado brasileiro, com a instauração de instâncias de negociação entre as diversas esferas de poder que fortalecem esse mesmo Estado no processo de redemocratização da sociedade brasileira.

The expansion of citizenship and rights in countries in countries with democracies sanctioned to the State provision of social protection, leading to the coverage expansion of Welfare State. The Welfare is a type of political and economics organization that position the State as an agent of social promotion and organizer of the economy. However, the economic difficulties experienced by Latin American countries boosted target actions. In this context, the first national cash transfer programs in the region was established between the 80 and 90s, expanding to almost every country in the 2000s. Thus, the main objective of this work is to develop a case study qualitative research, by describing the experiences of Brazil, Mexico, Colombia and Honduras, in order to identify their historical trajectories, proposals and specificities, besides allowing identifying possible influences they exert on other social policies. For this, this work is characterized by a study of case, through the qualitative approach of the social programs of Brazil, Colombia, Mexico and Honduras. For Cash Transfer Programs if constitute useful and effective tools of Social Protection, it is concluded that these should be objective, with defined powers and responsibilities. ; A expansão da cidadania e das dimensões dos direitos nos países com democracias sancionou ao Estado a provisão da proteção social, levando à expansão da cobertura de Bem-estar. O Welfare State ou Estado de Bem-estar Social é um tipo de organização política e econômica que posiciona o Estado como agente da promoção social e organizador da economia. Porém, as dificuldades econômicas vivenciadas pelos países latino-americanos impulsionaram ações focalizadas. Neste contexto, os primeiros programas nacionais de transferência de renda na região estabeleceram-se entre as décadas de 80 e 90, expandindo-se à praticamente todos os países nos anos 2000. Deste modo, o objetivo principal deste trabalho é desenvolver um estudo de caso com abordagem qualitativa, por meio da descrição das experiências do Brasil, México, Colômbia e Honduras, no intuito de identificar suas trajetórias históricas, propostas e especificidades, além de possibilitar identificar as possíveis influências que exercem sobre as demais políticas sociais. Para isso, este trabalho se caracteriza por um estudo de caso, através da abordagem qualitativa, dos programas sociais do Brasil, Colômbia, México e Honduras. Para que os programas de transferência de renda se constituam instrumentos úteis e eficazes de Proteção Social, conclui-se que estes devem ser objetivos, com competências e responsabilidades delimitadas.

This article analyses a series of legal and illegal state policies and ruling-party strategies, of a repressive nature or involving political persecution, which were implemented by Peronist governments between 1973 and 1976, in the period prior to the military dictatorship that imposed State terrorism in Argentina. The observation of these practices is combined with the study of the discourses of diverse members of the political system from the period. The study reveals the gradual establishment of a discourse about "national security", that is to say, based on the idea of a subversive enemy of a domestic nature and alien to the "national spirit". The Argentinian case study shows that this type of discourse, which is generally associated with the military regimes of the Southern Cone, also existed and was put into practice in constitutional regimes

Despite the extensive privatization achievements over the last decades, government ownership of publicly traded companies remains pervasive around the world. Consistent with past evidence of structural change in the beta coefficient during financial crises, the more recent economic recession of 2014 to 2016 in Brazil presents an opportunity to demonstrate the disadvantages of allocating investment in companies that are publicly traded, but are controlled by the government. Constructing a portfolio of publicly traded State Owned Enterprises, we find that the financial crisis produced a significant increase in risk exposure, results that were much more pronounced when compared with a portfolio of privatized companies. The results also indicate that, in addition to a market factor, the poor performance can be explained by controllership. We believe this study adds to the longstanding debate on whether state-owned firms perform worse than private firms, with higher volatility and lower returns, particularly, during a period of financial crisis. ; Apesar de extensas conquistas da privatização nas últimas décadas, a governo ainda permanece como acionista controlador de empresas de capital aberto em todo o mundo. Consistente com as evidências anteriores de mudanças estruturais no coeficiente beta durante as crises financeiras, a recessão econômica mais recente de 2014 a 2016 no Brasil apresenta uma oportunidade para demonstrar as desvantagens de investir em empresas de capital abertocontroladas pelo governo. Construindo um portfólio de empresas públicas de capital aberto, descobrimos que a crise financeira produziu um aumento significativo na exposição ao risco, resultados muito mais pronunciados quando comparados a um portfólio de empresas privatizadas. Os resultados também indicam que, além de um fator de mercado, o baixo desempenho pode ser explicado pelo tipo de controle. The objective of this article is to investigate the space-time dynamics of vegetation cover and land use and the Environmental State of the landscape regions of the southwestern portion of the Brazilian state of Mato Grosso.The vegetation cover and land use maps were generated from the Landsat 5 satellite images from 1984, and Landsat 8 from 2013 in the SPRING software. Map quantifications and layouts were elaborated withArcGis. The regionalization and analysis of the environmental state of the landscape were made through a regional geoecological matrix. From the results obtained, it was verified that the anthropic uses in the period of study were expanded by 134.08% while the vegetal coverings were reduced by 21.66% and the water bodies by 39%. Pasture is the predominant land use in the region, 24.09% (31,335.86 km²), mainly occupying the flat and smooth wavy terrain. Forest cover totaled 66.36% (84,967.12 km2), being found mainly in forest fragments, in which the larger territorial dimensions are either protected by environmental legislation or located in indigenous lands. Eight landscape regions were delimited in the southwest portion of Mato Grosso, including the Paraguay River Depression, which presents the landscape with the highest percentage of anthropic uses, predominantly the Degraded Environmental State. It was concluded that there is a need to adopt land use practices that minimize the environmental degradation of landscape regions, considering that during the period under investigation, the expansion of anthropic uses, mainly Livestock, directly influenced the suppression of vegetation cover.

The Underwater Cultural Heritage is a kind of heritage that is little studied and, for that reason, protection to Underwater Cultural Heritage is yet one of the greatest novelties of the present times. There was no standard to regulate it at the international level by 2001. In turn, at a domestic level, the legislation of the Spanish State fails to have a law to protect it in a specific way, except for Law 16/1985 dated June 25 and issued by the Spanish Historic Heritage - LPHE, which includes it within the archeological heritage.The present legal paper addresses the legislation in force in the Spanish State on Underwater Cultural Heritage, with special attention given to Law 16/1985 dated June 25 of the Spanish Historic Heritage.

Geotechnologies are a set of technologies geared towards collection, processing, analysis and availability of information with geographic reference. Therefore, the objective of this research is to demonstrate through the spatial analysis the environmental characteristics of an enterprise located in the municipality of Currais – PI, object of the environmental licensing procedure of the state competent body, using the tools of geotechnologies. The methodology consisted in using the Geographic Information System Quantum GIS (QGIS) for the creation and processing of the geographic database. Through the generation of thematic maps, it was possible to conclude that the uses of geotechnologies aid in the control and environmental monitoring, in which, it facilitates the visualization and characterization of several environmental features in the environmental licensing procedure. It was also possible to identify the areas that deserve greater attention from the environmental agency due to some damage to the environment, as well as, it assists in environmental inspection and current legislation. ; As geotecnologias são um conjunto de tecnologias voltadas para coleta, processamento, análise e disponibilização da informação com referência geográfica. Diante disso, o objetivo dessa pesquisa é demonstrar por meio das análises espaciais as características ambientais de um empreendimento localizado no município de Currais – PI, objeto do procedimento de licenciamento ambiental do órgão competente estadual, utilizando as ferramentas das geotecnologias. A metodologia consistiu na utilização do Sistema de Informações Geográficas Quantum GIS (QGIS) para a criação e tratamento do banco de dados geográfico. Por meio da geração de mapas temáticos, foi possível concluir que as utilizações das geotecnologias auxiliam no controle e monitoramento ambiental, no qual facilita a visualização e caracterização de diversas feições ambientais no procedimento de licenciamento ambiental. Também foi possível identificar as áreas que merecem uma maior atenção do órgão ambiental em virtude de algum dano ao meio ambiente, bem como auxilia na fiscalização ambiental e legislação vigente.

The paper analyzes the process of constitution of the Movimento de Educação de Base – MEB –, reflecting about the dynamics of relations between Church and State in Brazil, at a time when education in the rural environment was disputed by diverse social groups. Its objective is to understand how, within an officially secular state, an agreement can be signed and justified in which the Brazilian Government financed a movement proposed and coordinated by the Catholic Church. Theoretically based on the notions of elite groups and influence, it investigates the approximations between governmental and religious agents involved in establishing the agreement. Finally, it analyzes the decree formalizing the agreement, relating some of its main points with the previous process. ; El artículo analiza el proceso de constitución del Movimento de Educação de Base - MEB -, reflexionando sobre la dinámica de las relaciones entre Iglesia y Estado en Brasil, en un momento en que la educación en el medio rural era disputada por diversos grupos sociales. Tiene por objetivo comprender cómo, en un Estado oficialmente laico, pudo ser firmado y justificado un convenio en el cual el gobierno financió un movimiento propuesto y coordinado por la Iglesia Católica. Fundamentado teóricamente por las nociones de grupos de élite e influencia, investiga los acercamientos entre los agentes gubernamentales y religiosos involucrados en la consecución del acuerdo. Por meio de uma análise etnográfica das interfaces sociais entre agentes do Estado e estudantes cabo-verdianos em Portugal, observadas através da observação participante em consultas médicas, em trabalho social, no Serviço de Estrangeiros e Fronteiras e no serviço jurídico de apoio ao imigrante, este artigo pretende examinar as práticas disciplinares do Estado e as negociações e lutas de poder que ocorrem. Os casos etnográficos discutidos demonstram como a ideia de um Estado neutro e justo que trata todos os cidadãos em pé de igualdade é simultaneamente reproduzida e negada na prática, elucidando como o Estado constitui um símbolo de união de uma efetiva desunião. Os exemplos etnográficos também apontam para outras dimensões da prática do Estado, além dos micropoderes disciplinares, onde se cria espaço para flexibilidade e adaptação. E é nesse sentido que etnografias das interfaces entre Estado e cidadão servem para relativizar interpretações excessivamente sistemáticas da governamentalidade, ilustrando como os efeitos das práticas contraditórias do Estado são tão imprevisíveis como a ação humana. ; Using an ethnographic analysis of the social interfaces between state agents and Cape Verdean students in Portugal, observed through participant observation in medical appointments, social work, immigration services and legal support to immigrants, this article aims to examine disciplinary state practices and the negotiations and power struggles that take place. The ethnographic cases discussed demonstrate how the idea of a fair and neutral state is simultaneously reproduced and denied in practice, thus elucidating the state as a symbol of union of an effective disunity. The ethnographic examples also indicate other dimensions of state practice, besides micro-disciplinary powers, which create room for flexibility and adaptation. And it is in this sense that ethnographies of interfaces between state and citizen offer a more relative perspective of excessively systematic interpretations of governmentality, illustrating how the effects of contradictory state practices are as unpredictable as human action itself.

Apesar da literatura sobre o recente enfraquecimento de funções básicas do Estado Nacional por obra da globalização, o Estado-nação vem demonstrando admirável resiliência, isto é, flexibilidade e capacidade de adaptação às mudanças. Partindo da perspectiva das relações internacionais, o artigo realiza levantamento da geografia política do mundo contemporâneo, indicando as razões que levaram à criação, no século XX, de nada menos de 150, do total de cerca de duzentos Estados existentes. Analisa o caráter ambivalente dos fatores de mudança, nem sempre no sentido do enfraquecimento do Estado, e se detém no caso da União Européia, única exceção de êxito na construção, ainda incompleta, de configuração pós-nacional. ; Notwithstanding recent studies about the alleged weakening of some basic functions of nation-states on account of globalization, national states have been showing remarkable resiliency, that is, flexibility and adaptability to change. Starting from the perspective of international relations, the article undertakes a review of contemporary world's political geography, pointing out some of the reasons that explain the creation, during the XXth century, of 150 out of a total number of 200 existing national states. It analyses the ambivalent nature of some of the forces for change, not always towards national state weakening, and devotes special attention to the European Union, the only example of a still unfinished construction of a post-national configuration.

This paper is the result of the study Apreensões de drogas no estado de São Paulo: Um raio-x das apreensões de drogas segundo ocorrências e massa [Drug Seizures in the State of São Paulo: An In-Depth View of Drug Seizures Broken Down by Number of Incidents and Drug Amounts], conducted by Instituto Sou da Paz to encourage a discussion about Brazil's drug policy. The study focuses on drug incidents in the state of São Paulo, the richest and most populous in Brazil, which accounts for 28% of all drug incidents in the country. São Paulo is also the state with the largest police force—about 100,000 policiais militares [ostensible police officers] and 30,000 policiais civis [investigative police officers]. São Paulo law enforcement seized over 100 MT [metric tons] of drugs in the state in 2015. In 2016, drug seizures totaled over 160 MT.1 Data on drug seizures in Brazil are still scarce. It is crucial to have those data to assess the performance of the institutions comprising the criminal justice system as far as drugs are concerned. Based on statistical resources, we found that a large number of drug incidents involve small amounts of drugs, whereas large seizures account for a significant share of the total amount of drugs seized. By comparing those data, we show police resources are largely used in incidents that have no impact on the drug trafficking chain and in which only drug users and small drug dealers are charged. Este artigo deriva da pesquisa "Apreensões de drogas no estado de São Paulo: Um raio-x das apreensões de drogas segundo ocorrências e massa", realizada pelo Instituto Sou da Paz para fomentar a discussão sobre a política de drogas no Brasil. O trabalho se debruça sobre as ocorrências de drogas do Estado de São Paulo, o mais rico e populoso da federação, que responde por 28% de todas as ocorrências do país. São Paulo é também a unidade federativa com o maior efetivo policial, com aproximadamente 100 mil policiais militares e 30 mil policiais civis. Em 2015, as forças de segurança de São Paulo ultrapassaram a marca de 100 toneladas de drogas apreendidas em seu território. No ano seguinte foram mais de 160 toneladas .Os dados sobre as apreensões de drogas no Brasil ainda são escassos. Esses dados são fundamentais para analisarmos a atuação das instituições do Sistema de Justiça Criminal no que concerne à questão das drogas. Utilizando recursos estatísticos, observamos que grande parte das ocorrências envolve quantidades pequenas de droga, ao passo que as grandes apreensões têm significativa participação no total de quantidade de drogas apreendidas. Com esses cruzamentos, demonstramos que boa parte dos recursos policiais são empregados em ocorrências que não impactam na cadeia de tráfico de drogas, autuando usuários e pequenos traficantes.
