La presente ricerca ha lo scopo di indagare la tassazione dell'economia digitale, argomento cardine degli odierni dibattiti sul diritto tributario nazionale, internazionale ed europeo, convogliando le attenzioni, per ragioni diverse, di dottrina, prassi, giurisprudenza e politica nazionale ed estera. La tesi si compone di quattro capitoli. Con il primo si esperisce una actio finis regundorum per definire i confini propri dell'economia digitale, cercando di dimostrare che la ricchezza digitale non è facilmente sussumibile in categorie note, ma rappresenti un'evoluzione talmente significativa del contesto produttivo da trascendere i parametri classici di determinazione dell'imponibile. La seconda parte della ricerca analizzerà le principali strutture impositive, specificamente, in merito al presupposto d'imposta (what to tax?) valutandone l'adattabilità alla digital economy e immaginando eventuali varianti anche alla luce delle proposte dottrinali. Nel terzo capitolo si passerà a esaminare il profilo territoriale (where to tax?). All'uopo, si declineranno le possibili varianti della territorialità, intesa come principio, id est limite alla tassazione, o come criterio, cioè riparto delle potestà impositive. Conseguentemente, l'ultima sezione è dedicata allo studio di quale sia il livello normativo più adatto alla tassazione della ricchezza digitale (who to tax?). Attraverso l'analisi delle fonti del diritto, si avanzerà l'ipotesi di una tassazione europea dell'economia digitale, tenendo conto delle proposte avanzate in sede internazionale e nazionale, provando a individuarne uno schema essenziale (how to tax?). Infine, su un piano generale, si ricorderà come questa problematica possa diventare la chiave di volta nella storia politica dell'Unione Europea, potendo nascere dalla costruzione del Mercato Unico Digitale una nuova fiscalità, autenticamente, europea con l'obiettivo ulteriore di incoraggiare la nascita e la crescita di imprese digitali europee, attraverso un progressivo riequilibrio delle posizioni (level playing field). ; This research aims to investigate the taxation of the digital economy, cornerstone of the debates that are taking places in this period in relation to the national, international and european tax law, conveying the attention of the domestic and foreign doctrine, practice, jurisprudence and politics. The dissertation is composed by four chapters. With the first one an actio finis regundorum is carried out to define the boundaries of the digital economy, in attempting to show that it is not easy to subsume the digital richness into well-known categories. The second part of the research analyzes the main taxation structures focusing in particular on the tax chargeable event (what to tax?) assessing his adaptability to the digital economy while imaging possible variations in the light even of the proposals done by the doctrine. In the third chapter the examination will deal in particular with the territorial profile (where to tax?).Therefore, the last section is devoted to the study of which normative level is the most appropriate for the taxation of the digital richness (who to tax?). Through the examination of the various sources of law, the hypotheses of an euroepan taxation of the digital economy will be advanced, taking into account the proposals put forward on international and national level, trying to identify an essential scheme (how to tax?). Finally, on a general level, it will be recalled that this issue could became the centrepiece of the European Union's political history, as the construction of the digital Single Market could give rise to a new taxation that is truly european with the further aim to foster and encourage the birth and development of european digital businesses, through a progressive level playing field. ; Diese hier vorliegende Forschung hat zur Grundlage die Untersuchung der Besteuerung der digitalen Ökonomie, das zentrale Thema der heutigen Diskussionen über das europäische, internationale und nationale Steuerrecht, das die Aufmerksamkeit aus verschiedenen Gründen, der inländischer und ausländischer Recht-sprechung, - lehre, -praxis und Politik weckt. Die Dissertation besteht aus vier Kapiteln. Das erste Kapitel führt eine actio finis regundorum durch um die Grenzen der digitalen Ökonomie zu definieren, aufzeichnend wie schwer der digitale Reichtum sich in bekannte Kategorien fügt, aber eine solch bedeutende Weiterentwicklung des produktiven Kontext darstellt, dass er die traditionellen Parameter der Ermittlung des steuerpflichtigen Gewinns übersteigt. Der zweite Teil der Recherche analysiert die wichtigsten Besteuerungsstrukturen, speziell gegenüber der vorausgesetzten Steuerpflicht (what to tax?) in dem die Anpassungsfähigkeit an die digital Economy beurteilt und eventuelle Varianten angesichts der doktrinären Vorschläge vorgestellt werden. In dem dritten Kapitel wird das territoriale Profil (where to tax?) untersucht. Hierfür werden die möglichen Varianten der Territorialität dekliniert, verstanden als ein Prinzip, id est der Begrenzung der Besteuerung, oder als Kriterium, also als Aufteilung der Steuerhoheit vorgestellt. Dem entsprechend widmet sich der letzte Abschnitt der Untersuchung damit, welche normative Ebene die geeignetste ist für die Besteurung des digitalen Reichtums (who to tax?). Mittels einer Analyse aus Rechtsquellen, avanciert die Hypothese einer europäischen Besteuerung der digitalen Ökonomie, unter Berücksichtigung der eingebrachten Vorschläge auf internationaler und nationaler Ebene, in dem man versucht ein essentielles Schema zu ermitteln (how to tax?). Letztendlich, auf allgemeiner Ebene, wird daran erinnert, dass diese Problematik, ein Eckpfeiler der politischen Geschichte der Europäischen Union werden kann, daher dass aus der Konstruktion des digitalen Binnenmarktes eine neue Besteuerung entstehen kann, die wahrhaftig europäisch ist, mit dem zusätzlichen Ziel der Entstehung und des Wachsen von europäischen digitalen Unternehmen zu fördern durch eine schrittweise Angleichung der Positionen (level playing field).

L'esigenza di prospettare una riforma della fiscalità appare assai rilevante nella dimensione del Welfare state, poiché è in tale ambito che la funzione tributaria assolve ad un compito essenziale del patto democratico, incidendo sulla portata (e sulla fruibilità) dei diritti fondamentali dell'individuo. Si prospetta, pertanto, l'obiettivo di una riforma della funzione fiscale da inquadrare soprattutto nella prospettiva del processo di revisione del moderno Welfare state.

Moral i moralne vrijednosti u današnjem društvu postaju sve više upitne, kada je riječ o mnogobrojnim aktivnostima koje postaju dostupne sve većem broju populacije. Igre na sreću, kao jedan od oblika hazardnih aktivnosti, digitalizacijom dopiru do svakog prostora i svake imalo liberalnije zemlje. Upravo internet i online poslovanje učinili su mogućim raširenost igara na sreću te time povećali broj sudionika u njima. Osim temeljnih dvojbi povezanih s moralnosti takvih igara, osobito u pogledu mladih igrača, javlja se i pitanje državnih interesa upotporenim monopolskim sustavima organiziranih nacionalnim zakonima. Politika potaknuta državnim interesima utkala je put ograničavanju priređivača internetskih igara na sreću blokiranjem, odnosno zabranom pristupa sadržaju pojedinih mrežnih stranica. Spomenuta je zabrana u najmanju ruku raspravljiva sa stajališta ustavnosti same mjere. Osim toga, mjere zabrane pristupa određenom internetskom sadržaju trebaju biti vrednovane pojedinačno u skladu s načelom razmjernosti uz zahtjev za ostvarivanjem pravne sigurnosti. Ovaj se rad stoga bavi razmatranjem potrebe za uvođenjem takve mjere u hrvatsko porezno zakonodavstvo s komparativnim primjerima njezine opravdanosti te s problemom mogućih zloupotreba Porezne uprave pri njezinu korištenju, čime bi se potiho uvela potpuna kontrola sadržaja mrežnih stranica. ; Moral and moral values are increasingly questioned in today's society when it comes to a multiplicity of vices that are becoming available to a larger number of people. Gambling, as a form of hazardous activity, is reaching every space and every liberal country through digitalization. Internet and online business have made it possible to spread gambling and thus to increase the number of participants in such games. The article discusses the Italian tax regime for small and medium-sized enterprises, in particular in regard to income tax. The first topic which is examined is the EU policy for small and medium enterprises (SMEs), especially the documents held by the institutions of the European Union to promote the implementation of a favourable SME tax regime. Then the relevant Italian tax law for SMEs is discussed. Given the lack of Italian tax regimes that favour the development of small and medium-sized enterprises, the article focuses on specific tax provisions for industry districts; these provisions were included in the Italian Financial Act of 2007, but they were never implemented. The analysis of both the positive and negative aspects of the industry districts system is the basis for evaluating proposals by tax academics and political figures for tax provisions for firm networks. Firm networks could represent a permanent factor that will contribute to economic growth, in particular for small and medium-sized enterprises, provided that this regime is defined coherently, and respects both national constitutional principles and the principles of the European Union.

[ita] I costanti e rapidi mutamenti economici e sociali che investono le società contemporanee si ripercuotono inevitabilmente sulle attività di impresa. È opinione diffusa che tali cambiamenti incidono non poco sulla certezza del diritto e sulle aspettative che le imprese ripongono nello stesso per poter agire nel pieno rispetto delle regole. Gli operatori economici hanno la necessità di sapere in anticipo, se i propri comportamenti siano o meno rispondenti al diritto in maniera tale da poter prevedere sia le conseguenze degli stessi, sia l'esito di eventuali controversie. I rischi derivanti dall'incertezza del diritto moltiplicano infatti gli ostacoli rispetto agli obiettivi perseguiti delle imprese e tale percezione è forse maggiore in quelle realtà medio-piccole che già per dimensioni, capacità di accesso al credito, sostenibilità dei costi e pressione fiscale, faticano ad esser competitive. Stando ai dati forniti dall'Istat nel rapporto NoiItalia1, il tessuto italiano produttivo del sud è rappresentato per lo più da P.M.I. sulle quale gravano in maniera consistente i costi derivanti dall'eccessivo carico fiscale, aumentato in maniera esponenziale dal 2005 ad oggi. In tale contesto, l'incertezza normativa in materia tributaria rappresenta uno dei costi maggiori per le imprese che intendono pianificare ed appare immediatamente evidente l'importanza delle attività di compliance fiscale quale strumento in grado di assicurare una "certezza preventiva" in merito all'interpretazione e all'applicazione delle norme. L'importanza delle attività di tax compliance è ormai nota, tant'è che sia il legislatore italiano che quello spagnolo, al pari degli altri ordinamenti europei, hanno previsto meccanismi di cooperazione col contribuente – impresa. In particolare, se in Italia, con l'ultima riforma è stato introdotto un meccanismo di adempimento collaborativo limitato alle grandi imprese, sulla scorta delle indicazioni fornite dalla delega fiscale contenuta nella l. n. 23/2014, nell'ordinamento spagnolo è stato disegnato un meccanismo di collaborazione, sempre limitato alle grandi imprese, strutturato su base volontaria, mediante l'adesione al cd. Código de buenas prácticas tributarias. In tale contesto, è chiaro quanto sia forte la necessità che il contribuente-impresa, possa far affidamento sulle norme da applicare ai singoli casi di specie che si pongono quotidianamente all'attenzione nell'esercizio delle proprie attività produttive senza che revirement interpretativi dell'amministrazione finanziaria e della giurisprudenza, norme dalla incerta interpretazione o peggio ancora, norme retroattive, si ripercuotano sulle stesse. Fra le maggiori ragioni di incertezza fiscale per le imprese di medie dimensioni sono comprese in primo luogo le frequenti variazioni normative, seguite dalla carenza di coerenza e univocità delle decisioni giurisprudenziali nonché dall'assenza di chiarezza delle norme. Il presente progetto di ricerca è stato sviluppato a seguito di un confronto "pratico" con l'azienda che ha ospitato lo stage previsto dal programma di dottorato. Partendo dunque dallo studio dei rapporti intercorrenti fra legittimo affidamento, violazioni tributarie e circostanze esimenti e trasponendo i risultati nell'ambito delle attività di pianificazione tributaria dell'azienda interessata, si è proceduto all'analisi dei quesiti posti dall'impresa nei casi pratici. Fra le istanze avanzate dall'azienda vi è quella di procedere ad un'attività di pianificazione tributaria nazionale ed internazionale, nell'ambito della quale si possa procedere all'analisi di tutti quegli elementi che ne impediscono e rallentano lo sviluppo e l'internazionalizzazione. I quesiti posti dall'impresa hanno indirizzato sia l'attività di stage, sia l'intera attività di studio rivolta alla ricerca di soluzioni pratiche a diverse problematiche, prima fra tutte quella relativa alla prevenzione della crisi di impresa, attraverso la riduzione delle perdite derivanti dalla mancata riscossione dei crediti e sotto un profilo prettamente fiscale attraverso l'individuazione del momento in cui si verificano i fatti che consentono la deducibilità delle perdite su crediti. È stata infine analizzata la questione inerente la scusabilità degli errori commessi dal contribuente e la gestione efficace del tax risk da parte delle p.m.i. ; [spa] La tesis aborda los temas de los mecanismos de prevención del riesgo tributario y de la importància de los principios de confiança legítima y buena fe en la relación entre la administración financera y los contribuyentes. A partir de un anàlisis de las razones que determinan inseguridad jurídica y que pueden aumentar los riesgos de incumplimiento, la tesis analiza los sistemas de coperative compliance existentes en Italia y España y pasa en reseña el sistema de cooperación holandés, único mecanismo abierto a la participación de las pequeñas y medianas empresas. De hecho, los mecanismos de cumplimiento cooperativos introducidos en muchos paises en los últimos años, si no se considera el sistema holandés, están dirigidos solo a las grandes empresas, excluyendo las pymes que más necesitarían medidas y principios capaces de simplificar su cumplimiento y reducir los riesgos de errores. La relación que se instala a partir de los mecanismos de cumplimiento cooperativo se funda en la confianza, comprensión mutua, transparència y permite conocer mejor las razones que guían las acciones de las empresas. Para el contribuyente, la cooperación representa una oportunidad para obtener una reducción de los riesgos de cumplimiento, una fortificación de su reputación comercial en el mercado en el que opera, así como en una mayor Seguridad jurídica en cuanto a la interpretación y aplicación de las reglas y sus consecuencias. Es por esta razón que en la segunda parte se realiza un anàlisis de los principios de confianza legítima y de buena fe y de sus reflejos en los sistemas sancionadores poniendo particular atención en los sistemos legislativos italiano, español y holandés. Los dos principios constituyen una garantia por ambas partes de la relación tributaria y permiten facilitar y mejorar el cumplimiento voluntario. En este sentido se aspira a demostrar que son estos dos principios que deberían guiar la relación cooperativa con todos los contribuyentes y marcar sus fases, desde la aplicación de las normas hasta la posible aplicación de sanciones

This PhD thesis investigates the role of the reduction of fiscal autonomy and uncertainty in the allocation of resources in driving the behaviour of Italian municipalities in non-autonomous regions and of the central government. Focusing on the uncertainty of grants to compensate the abolition of the property tax on main dwellings, we construct a regression discontinuity (RD) and regression kink (RK) design to test how the behaviour of municipalities changes depending on whether they are in a "bad" state (when they manage fewer resources after property tax reform) or in a "good" state (when they manage more resources after property tax reform), and also in light of the "partisan effect" (the mechanism that allows central governments to allocate more resources to the lower layer of government politically aligned with it). An empirical analysis of Italian municipalities suggests that: 1. Municipalities acted differently in terms of waste tax implementation. Their behaviour depended on the benefits or costs they assumed af- ter the abolition of the property tax on main dwellings: in particular municipalities that suffered a loss of resources increased the waste tax more; 2. Property tax reform led to an imperfect substitution between the prop- erty tax on the main dwelling and the waste tax, with a consequent loss in equality; 3. Despite the weakness of the ex-post control and the absence of pun- ishment for lying municipalities concerning the definition of a compen- satory grant may allow the presence of a weak "partisan effect", the reform of the main dwelling property tax was transparent in resources allocation.

The dramatic health emergency that has hit Europe has put the issue of a thorough reform of the European budget financing system back on the political discussion table, in order to support the expenditure required to cope with the new tasks that are increasingly expected to be assigned to the Union. The ensuing debate concerns both the nature of the new resources and the new tasks that are to be assigned to the European budget. And it also concerns how the distribution of resources between the different levels of government is to be defined. European taxation has so far been based, without any particular discussion, on the principle that taxation power remains a competence of the Member States. However, the impetus induced by climate change and the need to find resources to combat it is changing the situation. The idea of introducing a carbon tax at European level could be the embryo of a fiscal autonomy of the Union.

Taxation is what the European Union lacks today. EU is an area of rights without duties or, rather, in which duties (including taxation) exist only vis-à-vis the individual member states to which they belong. European citizenship is therefore halved, because it is indistinguishable from national citizenship and does not express solidaristic belonging to a supranational community. The investigation into the Union's own tax is the means to address broader issues related to the being of the European Union and its citizens and having at their core the transnational declination of solidarity. The economic and financial profile - inextricably linked to the tax and its revenue - transcends into the centrality of the uses, i.e. the goods and services that the Union may be able to provide, and the indispensable overcoming of the national particularisms that this implies.
Theory of tax evasion is reviewed. The Marrelli approach is studied in a more general environment. Indirect tax evasion by firms is extended to the general case of oligopolic markets with a conjectural variations model and either a price discrimination model, considering both ad valorem and specific taxation. From the normative point of view, cut-off rules of tax enforcement are studied and modified inverse elasticity rules for optimal taxation are derived and shown to depend on the level of distortion on the supply side, i.e. on firms` collusion, shifting and tax evasion decisions.

The project of a tax as an own resource of the European Union stems from dissatisfaction with the financial set-up of the EU, which has never had true financial autonomy. It also draws new and unexpected inspiration from the proposals for reforming the European budget, aimed at containing the crisis generated by the Covid-19 pandemic and supporting the economic recovery of the member states. In this context, an own tax would allow the Union greater financial autonomy, new own resources to support post-pandemic economic recovery, and greater visibility to European citizens. The essay outlines the possible legal basis and the essential features of a European corporate income tax, while highlighting the implementation perplexities related to the unanimity mechanism for its approval.
Dottorato di ricerca in Diritto dei mercati europei e globali. Crisi, diritti, regolazione ; Il diritto penale tributario è stato, nel corso del tempo, oggetto di profondi mutamenti ed oggi l'area di intervento della sanzione penale risulta, in concreto, estremamente circoscritta rispetto al passato. In particolare, con il Decreto Legislativo 24 settembre 2015 n.158, il ricorso alla sanzione penale è attenuato sia mediante una rimodulazione delle singole fattispecie delittuose, sia attraverso la previsione di una specifica causa di non punibilità collegata al pagamento integrale dell'obbligazione tributaria. Dalle scelte operate dal legislatore nel recente passato appare evidente la tendenza sempre più spiccata verso un diritto penale della riscossione, in cui la rinuncia alla sanzione penale trova giustificazione nella piena soddisfazione degli interessi patrimoniali dello Stato. Proprio dall'opportunità offerta al contribuente di eliminare la rilevanza penale della propria condotta, attraverso una controazione compensativa idonea a garantire la piena soddisfazione dell'Erario, emerge chiaramente il ruolo centrale assunto dall'effettiva percezione del debito fiscale. In tale ottica, il diritto penale assume un ruolo ancillare all'apprensione del tributo da parte dell'Erario: la rinuncia alla pena è funzionale alla riscossione, per cui, una volta ottenuto il pagamento dell'imposta dovuta è legittima la rinuncia alla pena. A fronte di una normativa tributaria variegata e spesso non di agevole interpretazione, in un sistema fiscale basato sull'autoliquidazione dell'imposta che demanda alla valutazione ex post del fisco la correttezza dei comportamenti del contribuente ulteriori spazi di non punibilità, o meglio di scusabilità possono essere individuati nella disciplina dell'errore. Da ultimo, si evidenzia l'introduzione nell'ordinamento di una serie strumenti di tax compliance e di disclosure, i quali trovano proprio nell'esclusione della sanzione penale per il contribuente che intende avvalersene il principale elemento di attrattiva. In tal senso la rinuncia alla pena diviene funzionale, oltre che alla riscossione del tributo, anche all'instaurazione di cooperazione tra Fisco e contribuente. ; Criminal tax law has deeply changed over the years, today the application criminal penalties is, in practice, extremely limited when compared to the past. In particular, under the Legislative Decree 24 September 2015 no.158, the application of criminal penalties has been reduced through both an amendment of some criminal offences and the provision of a specific "non-punishment cause" related to the payment of the full tax liability. From the choices made by legislator in the recent past, it is evident that the trend is more pronounced towards a criminal sanction based on the collection, in which dropping the criminal charges finds justification in increasing the State treasury. The opportunity offered to the taxpayer to benefit from the non-application of criminal charges, through a compensatory counteraction to guarantee the full satisfaction of the Treasury, underlines how important is the effective payment of the tax debt. In this perspective, criminal law plays an ancillary role in the collection of the tax by the Treasury: the drop of the charges is subject to collection, so, once obtained the payment of the tax due, the waiver of the penalty is legitimate. In relation to a varied and not easy to interpret tax legislation, a fiscal system, based on the self-liquidation of taxes, which assesses through an ex- post evaluation from the tax authorities the correctness of the tax payer's behaviour, further exclusion clauses of punishment, or rather reasons of excusability can be identified in the provisions regarding the error. Finally, it is highlighted the introduction of a series of instruments of tax compliance and disclosure, which can prevent the application of criminal penalties for the tax payer who decides to make use of them. In this sense, the renounce of the penalty becomes functional, as well as to the collection of the tax, also in establishing cooperation between the tax authorities and the tax payer.
