«The best interests of the child»: un'analisi giurisprudenziale comparata per un approfondimento concettuale
La vera innovazione apportata dalla Convenzione ONU diritti dell'infanzia del 1989 è, senz'altro, costituita dall'introduzione del concetto di "best interests of the child". L'articolo 3 della CRC, infatti, sancisce espressamente che: «In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration». Ma in cosa consiste realmente questo "interesse superiore del minore"? A chi spetta indicarne il contenuto? E soprattutto quali sono i parametri di riferimento da tenere in considerazione nel valutarlo? Nell'arco di pochi anni dalla sua solenne introduzione, il principio del "best interests of the child" è stato recepito all'interno di numerose convenzioni e documenti a tutela dell'infanzia, sia livello internazionale che all'interno dei singoli Stati, e il suo utilizzo ha iniziato a caratterizzare le decisioni dei giudici ad ogni latitudine. Il contesto nel quale il superiore interesse del minore ha trovato maggiore accoglimento ed ha iniziato ad assumere connotati meno indeterminati è senz'altro quello relativo alla giurisprudenza della Corte europea dei diritti dell'uomo: tuttavia, a fronte di un ricorso sempre più frequente alla formula stereotipata del "best interests of the child", si è assistito nel corso degli anni a decisioni giudiziarie dagli effetti anche molto contrastanti tra loro. Proprio la perdurante indeterminatezza del contenuto da attribuire al principio del superiore interesse del minore nel caso concreto si pone come problema alla base del tentativo di approfondimento concettuale della presente ricerca. Tuttavia, al fine di rendere l'analisi quanto più obiettiva possibile, si è appositamente tralasciato di paragonare e sviluppare le diverse definizioni teoriche relative al principio in questione, volendo privilegiare un determinato approccio empirico: rilevare in che modo e in quali contesti, i giudici delle due maggiori Corti regionali del mondo (la Corte europea e la Corte interamericana dei diritti dell'uomo) utilizzano il criterio del "best interests of the child" e comprendere se sia possibile rintracciare un nucleo di caratteristiche comuni al suo utilizzo, con l'obiettivo di rinvenire il contenuto sostanziale di tale concetto, all'interno dei diversi ambiti tematici e nei differenti luoghi geografici, e cercando, infine, di verificare se e come la giurisprudenza delle due corti regionali dei diritti umani va ad incidere sulle pronunce dei tribunali interni, nella valutazione dell'interesse superiore del minore. ; What is meant by the concept of the "best interests of the child" introduced by Article 3 of the UN Convention on the Rights of the Child in 1989? Who has to determine the legal criterion? And, more importantly, what parametres are to be taken into account to ascertain it? Within a few years since its formal introduction, the principle of the "best interests of the child" has been assimilated into numerous conventions and documents concerning child protection, both in international and domestic jurisdictions; increasingly, it has begun to affect and shape the decisions of the judges all over the world. The context in which the "best interests of the child" find greater acceptance, meanwhile acquiring less indeterminate characteristics, is the jurisprudence of the European Court of Human Rights. In fact, despite being often used as a stereotyped formula, the principle has undoubtedly become a frequent reference. However, its persistent vagueness has caused numberous judgments to have very contradictory effects. The still constant uncertainty about the foundation of the principle in which the best interests of the child need to be rooted in specific cases, is the central question of this research, which is an attempt to give conceptual deepening and significance to the theme. In order to make the analysis as objective as possible, this study has purposedly neglected to consider and compare the different theoretical definitions of the principle in question, preferring to follow a predominantly empirical approach: detecting how and in what contexts judges of the two major regional Courts of the world (the European Court and the Inter-American Court of Human Rights) use the standard of the "best interests of the child"; trying to find out whether it is possible to find a core of common features so as to fix up the substance of this concept, within the different thematic areas and in different geographical locations; checking whether and to what extent, the jurisprudence of the two regional courts of human rights affects the decisions of domestic courts in assessing the interests of the child.

The palladium of the people's rights. Freedom of the press as a counterpower in Kant and in the revolutionary writings When, in 1793, Kant described the «freedom of the pen» as «the sole palladium of the rights of the people», he was using a widely known expression that had been circulating for almost a century. The term «palladium» had in fact been used to qualify freedom of expression and freedom of the press, in different years, countries and contexts, similarly to terms such as «bulwark», «guardian» or «sentinel». These conceptual constellations, which provided the theoretical arsenal to the American Independents and the French Revolutionaries, can been seen to be interwined with English republicanism, Lockian theory of natural rights and with the thought of Montesquieu and Rousseau. This article attempts to trace and map the circulation and reinterpretation of political theories across England, its overseas colonies and France, which identified freedom of expression and of the press with a sui generis right. Such right was placed as a guardian of all other rights, in order to protect them from the abuses of constituted power. It was a right that citizens held within, but also against the state and, as such, was a fragile yet powerful right, frowned upon by governments because of its intrinsic link with the right of resistance and its potentially subversive nature. Since 1698, Matthew Tindal's arguments in favour of freedom of the press have included the thesis of the essentially dialogical nature of knowledge (and the consequent identification of rational activity with a public process) and the insinuation that it was opposed by governments dedicated to activities that feared the light of day. 1915 and in Storia d'Europa nel secolo decimonono, as observed by the
most perceptive interpreters of the historiographical activity of Croce,
excludes the conflict phases that preceded the historical periods taken
into consideration (The Risorgimento for the History of Italy and the
French Revolution for the History of Europe). This paper shows how the
perplexity of the historiographical setting of Croce is also found in the
book about the Baroque period in Italian history that was published in the
same year of the two most important and well-known historical works by
Benedetto Croce.
HAGHIA TRIADA NEL PERIODO TARDO MINOICO I
In the centenary of the Italian researches at Haghia Triada, we propose a review of the LM I archaeological evidence from the old (1902-1914) and the new (1977-1999) excavations at the site. On the basis of recent analytical examination of the new pottery deposits, we distinguish two phases in the LM IA settlement, and one in the LM IB, and we assume an immediate reoccupation of the site after the destruction of the Villa Reale. Regarding the functional interpretation of the architectural structures, we emphasize the religious role of the Villa Reale. It was provided whit «Residential Quarters» and porticoed courts (Piazzale Superiore, Piazzale Inferiore) for ritual/ceremonial purposes and was perhaps a sacred and public building. Furthermore, we hypothetically recognize two other cult centres at the site, Casa Est and Casa del Lebete. Finally, we discuss the possibility that c.d. Tomba degli Ori had been used forfunerary depositions since LM I and the adjoining Complesso della Mazza di Breccia was connected with the minor activities of death rituals. Therefore, we would identify four functional poles in the settlement's structure: a religious one (Villa Reale, PiazzaleSuperiore, Casa Est, Piazzale Inferiore, Casa del Lebete), one for storage (Edificio Ciclopico, Bastione, Piazzale Inferiore), a residential (Villaggio) and a funerary one (c.d. Tomba degli Ori).In conclusion, we observe a strong continuity in the urban and architectural organization of the settlement, starting from the general reconstruction at the end of MM IIIB/TM IA until the LM IB destruction (and later, in the LM IIIA2 rearrangement), and we assume that the political power in LM Messarà had a collective and not a very hierarchical structure.

The author argues for reducing horizontal disparities with objective criteria to improve the exercise of the functions assigned to sub-central governments.

La scoperta, sistemazione e conservazione della grande Iscrizione di Gortina, nell'isola di Creta (1884-1921): la protezione delle testimonianze e le esigenze della fruizione
La scoperta e la conservazione della Grande Iscrizione di Gortina a Creta, da parte degli studiosi italiani, fra la fine del XIX sec. e i primi decenni del XX sec., rappresentò un grande riconoscimento scientifico-culturale per la giovane nazione italiana. Nel passato, l'isola di Creta era stata legata alla Repubblica di Venezia e anche questo rapporto favorì l'invio a Creta del giovane epigrafista F. Halbherr, il quale fra notevoli peripezie rinvenne, assieme all'epigrafista tedesco E. Fabricius, la famosa l'iscrizione nell'antica città di Gortina. L'iscrizione, fra le più antiche e complete finora conosciute in tutta Europa, conteneva le norme sulla famiglia, l'eredità e in generale i diritti e doveri di alcuni dei popoli della civiltà cretese (480-450 a.C.). L'iscrizione era scolpita su blocchi squadrati di biocalcarenite, inseriti in un antico edificio, che successivamente, in epoca romana, era stato trasformato in odeon. Le Leggi di Gortina erano incise sui resti del muro costituente l'ambulacro antistante la gradinata dell'odeon. Il saggio ripercorre gli avvenimenti che portarono alla scoperta e alla successiva conservazione effettuata da Halbherr, soprattutto con l'aiuto dell'archeologo L. Pernier e infine con il contributo dell'architetto E. Stefani, che progettò una moderna copertura posta sulla sommità dei conci dell'ambulacro contenenti l'iscrizione. Detta copertura venne fatta eseguire, durante la I Guerra Mondiale, sulla base del progetto italiano, dal Governo Greco, in modo da proteggere l'iscrizione da eventuali danni bellici, ma soprattutto dagli atti vandalici. La copertura, in mattoni di laterizio, delle Leggi di Gortina, ancora oggi assolve alla sua funzione e assicura la fruizione del monumento, testimoniando la cultura della conservazione italiana in Grecia e più in generale nel mondo. Invece in Sicilia, nei resti della villa del Casale di Piazza Armerina (Enna), la sua elegante protezione (realizzata nel 1957) rappresentativa di un intero periodo della cultura del restauro italiano, viene rimossa e sostituita perché non si è stati capaci di effettuare una continuativa e dovuta manutenzione. Un cattivo esempio di conservazione e gestione di un monumento dell'Unesco, dal quale sorgerà, dopo i lavori per la realizzazione delle nuove coperture, un altrettanto oltraggio al patrimonio archeologico e paesaggistico italiano e mondiale.

Tutela e sicurezza del lavoro tra centro e periferia: la sicurezza sui luoghi di lavoro
Il saggio prende in esame la complessa questione del riparto di competenze tra Stato e Regioni alla luce del Titolo V della Costituzione in materia di salute e sicurezza sui luoghi di lavoro. Il riparto di competenze tra centro e periferia è stato oggetto di una limitata analisi da parte della dottrina e della giurisprudenza, che si sono concentrate in particolare sulla disciplina del mercato del lavoro. L'Autore descrive un sistema multilivello, caratterizzato dalla compresenza di fonti nazionali e regionali, della contrattazione collettiva, nonché di codici di condotta. Sulla scorta di una ricostruzione del quadro normativo e dei percorsi della giurisprudenza, il saggio propone una lettura dinamica di rapporti tra centro e periferia, in cui l'asse del sistema rimane, comunque, ancorato alla competenza statale, con spazi regolativi comunque importanti per la legislazione regionale.
