This work concerns the mutualist governance. From a frame of analysis based on legitimacy theory, we tried to understand how appears legitimacy in mutual organisation context today. The proposal is that it exists inevitably a gap between the legitimacy built by managers and the legitimacy perceived by the stakeholders. Managers display then strategies of legitimization by a communication based on mutualist references. The mutualist model would become a management tool. In a phase of quantitative research with the involved stakeholders, we identify a common base shared between stakeholders, as well as a mutualist gap, which concerns the perception that the company masters its projet and contributes to the territory. A typology of the stakeholders is drawn up around a horizontal split. The qualitative analysis of speech reveals different patterns, based on communication, politics and management. ; Ce travail porte sur la gouvernance mutualiste. A partir d'un cadre d'analyse fondé sur la légitimité, nous avons cherché à comprendre comment s'exprime la légitimité en contexte mutualiste aujourd'hui. For the first, territorial concerns lie mainly in the choice of locations of activities and forms of business cooperation. For the second, the recurring issue is that of regional planning that lean to the territorial governance. Thus, starting from the inherent idéology in this thesis, our main objective was to determine and assess the governance factors highlighting the role of territory and proximity to industrial development in Douala. The development of our ideas was structured in a lecture divided into two parts, each comprising two chapters. Before discussing the analytical framework for space management and industrial proliferation in Douala (part two), we reviewed the theoretical and empirical framework of industrial location and territorial dynamics (first part). The objective of the first part was to trace the outline of the evolution of the location of industrial activities such as they are set by certain works like those of A.MARSHALL (1890), P.KRUGMAN (1991), and territorial theories on the one hand, and to specify the theoretical analysis of the setting regulation on the other hand. The regulation approach (part two) challenges the rules of mutual coordination between government interventions and strategies of private actors in the process of industrial location and local development in Douala. The General States of 2010 were aimed at reforming the Health governance in Agriculture in France. One of the aims was, in particular to give a better definition of the notion of "health veterinarian" (habilitated or mandated). Since these, a new organization was set up. It affects in particular the settlement of new consultative committees for animal protection at the national level as well as at the regional level. In addition a project of a single "Welfare Law" is being setting up by the European institutions in the context of the other laws: Food Law and Health Law. This follows the New 2012- 2015 Animal Welfare Strategy of the European commission. This strategy would modernize and simplify the old European texts and would be inspired by the HACCP system. This new paradigm would give more responsibilities to operators. It would be based on auto controls which results would be checked at the end by official veterinarians in all Member states of the Union ; Depuis les États généraux du sanitaire de 2010, destinés à réformer la gouvernance sanitaire en France et en particulier à mieux redéfinir les missions du vétérinaire sanitaire (habilité ou mandaté), une nouvelle organisation s'est mise en place concernant notamment la construction et la consultation de comités dédiés à la protection animale au niveau national et régional. Cette nouvelle organisation est explicitée dans cet article. Par ailleurs, dans le contexte général de la mise en place de « Paquets cadres » par l'Union Européenne comme le Paquet Hygiène ou le Paquet Santé « Health Law », est prévue, pour faire suite au Plan d'action 2012-2015 de la Commission européenne, une « Welfare Law ». Le but de ce projet, affiché par les instances communautaires, est de moderniser et simplifier les textes communautaires actuels concernant la protection des animaux. Pour ce faire, la Commission se base, comme dans les autres « Law » d'une obligation de résultats primant sur l'obligation et le contrôle des moyens, système inspiré des pratiques « HACCP ». Ce système octroie plus de responsabilités aux opérateurs ou professionnels. Il prévoit, entre autres, des autocontrôles dont les résultats seront à postériori contrôlés par les vétérinaires officiels (en France : inspecteurs de santé publique vétérinaires)

L'exploitation illégale des forêts est une menace importante pour la plupart des grands massifs forestiers tropicaux. Afin de lutter contre l'exploitation et le commerce illégaux du bois, l'Union européenne a mis en place le Plan d'action « Forest Law Enforcement, Governance and Trade » (FLEGT) qui a ouvert la négociation de l'Accord de partenariat volontaire avec le Cameroun. En 2010, les deux parties ont signé cet accord qui engage le Cameroun à assurer la légalité du bois à destination des marchés extérieurs et intérieurs pour tous les titres forestiers. Les forêts communautaires ont de ce fait été incluses dans cet accord et devront assurer la légalité de leur production de bois. Pour ce faire, une grille de légalité spécifique a été élaborée. Cette grille de légalité a été testée au sein de la moitié des forêts communautaires actives afin d'analyser les écarts existant entre les activités telles qu'elles sont conduites sur le terrain et les indicateurs de légalité inclus dans la grille. Les résultats montrent qu'aucune des forêts échantillonnées ne respecte entièrement les exigences de cette grille. Cette étude a permis d'identifier les goulets d'étranglement qui s'avèrent liés à des procédures complexes et au coût excessif qu'impose le respect de la légalité. Certains vérificateurs actuellement non conformes pourraient le devenir en renforçant les capacités des communautés et aussi en modifiant diverses réglementations. C'est à ces conditions que ces forêts pourront constituer une source d'approvisionnement légal du marché national du bois. ; Illegal logging is a threat to the world's tropical forests. To act against overexploitation of timber, the European Union has set up the Forest Law Enforcement, Governance and Trade action plan (FLEGT), which opened the Voluntary Partnership Agreement (VPA) negotiating agenda with Cameroon. In 2010, the two parties signed the VPA, committing Cameroon to ensure the legality of timber from all logging concessions sold on external and domestic markets. Community forests (CF) were included in the agreement and must therefore ensure the legality of their timber production. To do that, a specific legality grid has been developed. This was tested in half of active community forests in Cameroon to analyse any gaps between activities as practiced in the field and the legality criteria set out in the legality grid. The result show that no CF fully complied with this grid. The study identified obstacles due to complex procedures and to the excessive costs of compliance. Some criteria not currently met could be complied with through community capacity-building and by amending certain regulations. Under these conditions, community forests could become a source of legal supplies at least for the domestic timber market. ; Peer reviewed

As a result, policies are largely guided by the commitments made by Governments to meet international orders, but also by pressure from donors and sponsors (international NGOs, foundations, cooperation agencies…) for a Sustainable Development. This shift towards sustainable forest management has led the country to significant reforms: new modes of governance (with the involvement of "new" actors in different ambitions), new forest code, a new organization of institutions, new ways of uses of forests. A break seems to be marked here from independence and even colonial times management. Between a claim of national sovereignty and management of a resource that touches on global issues, forest governance is complex for a state limited in technical and financial resources. Forest areas and people who depend on them become the battleground of various and diverse strategies, sometimes divergent, which do not always correspond to the local socio- cultural reality, but legitimized by the single label for sustainable management. Our thesis provides keys for the reading of this governance and the dynamics of forest policies in Gabon, with emphasis on the observation of certain players. While it is often assumed that southern states forest's are under the influence of powerful international NGOs, a symbol of a prescribed governance and environmental intervention, Our study shows that the presence of these players may also reflect a southern Governments strategy to regain their resources and their territories. From dominants to dominated relationship, we go to a win-win relationship, sometimes at the risk of a local population exploited and designated. Les politiques qui en découlent sont largement orientées par les engagements pris par le gouvernement pour répondre aux injonctions internationales, mais aussi à la pression des bailleurs de fonds et aux promoteurs du développement durable (ONG internationales, fondations, organismes de coopération…). Cette orientation vers une gestion durable des forêts a ainsi conduit le pays à des réformes considérables : nouveaux modes de gouvernance (avec l'implication de « nouveaux » acteurs aux ambitions diverses), nouveau code forestier, nouvelle organisation des institutions, nouveaux modes d'usages des forêts. Une rupture semble être marquée ici avec une gestion héritée des indépendances, voire de l'époque coloniale. Entre revendication d'une souveraineté nationale et gestion d'une ressource qui touche à des enjeux planétaires, la gouvernance des forêts s'avère complexe pour un État aux moyens techniques et financiers limités. Les espaces forestiers et les populations qui en dépendent deviennent ainsi le terrain d'affrontements de stratégies diverses, parfois divergentes, souvent calquées sur des modèles ne correspondant pas toujours à la réalité socio-culturelle locale, mais légitimées par le seul label de gestion durable. Notre thèse donne des clés de lecture sur cette gouvernance et sur les dynamiques des politiques forestières au Gabon, en mettant l'accent sur l'observation de certains acteurs. S'il est souvent admis que les États forestiers du sud sont sous l'emprise de puissantes ONG internationales, symboles d'une gouvernance prescrite et d'une ingérence écologique, notre étude montre que la présence de ces nouveaux acteurs peut aussi témoigner d'une stratégie des gouvernements du sud pour la reconquête de leurs ressources et de leurs territoires. De dominants à dominés, on passe à une relation de gagnants à gagnants, au péril parfois d'une population locale instrumentalisée et résignée. En abordant les jeux et le rôle des acteurs pour comprendre le territoire, cette thèse offre des perspectives pour porter un nouveau regard sur la gestion des ressources forestières au Gabon.

Pour répondre à cette question, l'auteur de ce livre (Simpson, 2014), directeur du Centre pour la Paix et la Sécurité au Hawke Research Institute de l'Université d'Australie du Sud, a mené une enquête de 15 ans, en Thaïlande et au Myanmar, en se concentrant sur les mouvements activistes multi-niveaux et multi-échelles dans les zones frontalières : individus, organisations et groupes non-gouvernementaux, coalitions et réseaux, locaux comme transnationaux. Ces deux pays connaissent des régimes politiques autoritaires mais aux caractéristiques bien distinctes, ce qui permet à l'auteur de procéder à une analyse comparative des stratégies, des tactiques et des formes d'organisation au niveau local et transnational des mouvements activistes. Ce livre traite donc de politiques environnementales, mais aussi de science politique, de relations internationales, d'économie politique internationale, et d'études critiques environnementales. L'ouvrage est fondamentalement activiste, dans la lignée du courant de recherche « émancipatoire » (Humphries et al., 2000), dont la contribution académique se double d'un soutien aux activistes (Reitan, 2007).
