National Parks (NPs) and Areas of Outstanding Natural Beauty (AONBs) in England have, since the late 1970s, been identified as relevant fields of research to study rural gentrification. The hypothesis of this research is based on the fact that in these protected areas, the dynamics of rural gentrification are intense and specific. The Dartmoor National Park, the Peak District National Park, and the Cotswolds AONB, are emblematic and attract new affluents inhabitants who implement residential strategies and transpose, after settling, their representations nourished by environmental ideals, inherited from a long-standing movement. Through their pratices (like those of rewilding), they seize their territories and model them according to their expectations. Some gentrifiers master the keys and codes of the planning system, form alliances and stimulate eco-fronts which sometimes lead to litigation and increasingly lock out these coveted and exclusives areas of nature. This thesis is based on an exploratory approach which allowas us to follow the footsteps of rural gentrification and to take the measure of the intensity of the social and territorial change. Despite local initiatives, local populations are often unable to return to live in the National Parks and the AONB. The costs of access to housing are prohibitive and can be interpreted as one of the consequences of rural gentrification. The (in)visible communities are also kep away from these territories of protected nature and, if they live thre, suffer from symbolic exclusions, close to environmental injustices. When it comes to management in English law, trust law often is an important issue. Company directors, solicitors, trustees managing estates equally are fiduciaries and therefore have to take similar rules into account notwithstanding specific legislation. Thanks to Equity, the English share a common framework which allows them to deal with almost every situation in which management is required. Frenchmen do not rely on Equity and its principles to manage property. This work analyses the following case : an owner enters into a contract in order to have his property managed by a manager. Numerous techniques are available under French law.All of them are related to ownership or agency. Since a fiducie inspired by trusts has been introduced as an ownership-based technique trusts are studied alongside ownership-based techniques. The key role of fiduciary duty is analysed. The first part of this work shows that to manage effectively across time a manager must exercise two powers. The first one called organisation is the ability to act, the second one called direction is the ability to decide whether to act. The second part focuses on framing a new approach of management in French law. ; Les situations de gestion sont souvent complexes. Le premier est celui d'accomplir une action c'est-à-dire un acte ou une série d'actes juridiques ou matériels. Le second permet d'apprécier l'opportunité d'une action. La seconde partie est consacrée à la recherche d'un cadre juridique adapté à la gestion.

Lebanon's history along with its pluri-confessional nature explain the difficulties in carrying out reforms in the country. A culture of secrecy and a lack of political will have created a breeding ground for corruption in the Land of the Cedars. Long disillusioned and disinterested in the country's politics, Lebanese citizens have contributed themselves by their passivity to the worsening of the country's economic, political and social situation.Exacerbated today by the accumulation of scandals and supported by a new generation, Lebanese citizens took to the streets for the first time in more than 15 years and demanded accountability for political and economic management. In solidarity, the Lebanese people demanded the right to a sincere, transparent, non-corrupt, accountable and responsive government.The current situation – a mixture of political, economic and health crises – has created or reinforced the "need for statehood" among Lebanese citizens. This need concentrates the expectations of a new form of government, a moral government capable of truly protecting citizens and guaranteeing their welfare. The Lebanese demand a responsible state capable of assuming and fully performing its functions. The establishment of a new governance; one that is more transparent, participatory and collaborative, is more than needed today.The Open Government Partnership (OGP) is one of the means to re-establish relations, facilitate the modernization of the state and enable Lebanon to benefit from greater openness. Joining the OGP will promote transparency and collaboration within Lebanese public administrations and will lead to a deepening of democratic life.To better understand Lebanon's interest in joining the OGP, it is necessary to review the main requirements of the OGP, starting with transparency. We will first examine the level of transparency existing in Lebanon (§ 1) and then move on to the importance of developing a policy of openness (§ 2).
