RésuméL'auteur commence par soupeser le thème du numéro, «le droit comme facteur d'exclusion», en cherchant à débusquer la forte polysémie des termes pour conclure que les rapports du droit et de l'exclusion sont probablement ambigus. Comparer les différentes acceptions, jouer sur le flou que suscite leur coexistence, voilà l'objet de cet article qui s'attache au droit pénal car la suspicion d'exclusion y prend beaucoup de relief. Cependant la théorie pénaliste le présente, à l'inverse, comme un effort pour arracher l'humanité au jeu archaïque du vindicatif. S'appuyant sur des travaux souvent récents d'anthropologie, l'auteur propose de voir, au contraire, dans le vindicatoire et dans le pénal deux formes de juridicité également réglées dont la plus excluante, au moins dans son principe, est probablement la seconde. Mais comme rien n'est simple dans ce jeu du droit et de l'exclusion, il cherche ensuite à vérifier le propos en examinant les opérations contemporaines du pénal—la création de l'incrimination et sa mise en œuvre. En démontant plusieurs cas-types, l'auteur parvient finalement à montrer la complexité de la relation du droit et de l'exclusion et l'impossibilité d'une conclusion trop brève ou trop aprioriste.

Au cœur des motivations des terroristes de l'État islamique figure la vengeance, contre un Occident vu comme l'héritier du colonialisme, et plus généralement comme agresseur des musulmans. La dimension émotionnelle est donc forte, qui induit la définition d'une identité collective et la déshumanisation de l'adversaire. Si le revanchisme est au cœur du récit djihadiste, il faut démonter sur le long terme ce discours, qui ne disparaîtra pas avec l'emprise territoriale de Daech.

It is argued that the exponential growth of the criminal-industrial complex in the late 20th century US has been exported to US foreign policy & to foreign nations. Several circumstances that prompted the emergence of a more punitive criminal justice system in the US are identified including the replacement of the explanation of crime & the rehabilitation of criminals with policies that attempted to manage criminal activities while offering retribution to wrong individuals, the downsizing of the US military forces between 1970 & 2000, the middle & upper class combined fear of the emergence of an underemployed underclass, the growing suspicion among the American public that internal threats posed a greater danger to peoples well-being than communist & socialist governments, & the substantial popularity of television series about the US criminal justice system. After demonstrating the extent to which the George W. Bush administrations gunslinger mentality has contributed to the manifestation of a more vengeful foreign policy, multiple examples of the exportation of this system of vengeance to foreign nations are provided. The implications of maintaining the Bush administrations conflation of crime & war for future US foreign policy are also pondered. J. W. Parker
