Der frühere Benin-Direktor der BCEAO und Generaldirektor der Zentralbank von Dahomey versucht mit seinem voluminösen Buch einen großen Anspruch zu erfüllen: eine theoretisch begründete Wirtschaftspolitik zu entwerfen, die Afrika aus der Krise führt, die Armut überwindet und den Menschen in den Mittelpunkt allen Wirtschaftens stellt. Besonders bemüht sich der Autor um die Verknüpfung von Wirtschaftstheorie und -politik und christlich-katholischer Glaubenlehre ('Lumière de l'Église Catholique sur l'espace de l'économie"). L'Union économique et monétaire (UEM) est fondée sur une asymétrie originelle entre les piliers monétaire (centralisé) et économico-budgétaire (décentralisé). Ce dernier s'articule autour d'un triptyque normatif précis : responsabilisation financière des États membres par la triple interdiction de solidarité budgétaire, de financement monétaire et d'accès privilégié aux institutions financières ; coordination économique par les Grandes orientations de politiques économiques ; coercition budgétaire par le Pacte de Stabilité et de Croissance et la procédure concernant les déficits excessifs. Cette architecture originelle repose sur une logique spécifique : l'institution du marché comme instance de véridiction et de disciplinarisation des États. En approfondissant, d'une part, le cadre de surveillance et de contrôle des politiques économiques et budgétaires des États membres et en instituant, d'autre part, des mécanismes d'assistance financière sous stricte conditionnalité, les réformes post-crise des dettes souveraines se placent dans la continuité de la logique de disciplinarisation des États membres à l'aune du marché. Cependant, en marquant une évolution dans la sanction ultime de cette logique de marché, elles modifient en réalité la relation entre l'État et le marché et, partant, transforment in fine l'acception même du concept de « marché » dans l'organisation juridique de l'UEM. D'une conception du marché que l'on peut rapprocher des travaux de Hayek – en vertu de laquelle celui-ci n'existe qu'en tant que réalité concrète insusceptible d'être corrigée efficacement dans son fonctionnement par une intervention extérieure – l'on serait ainsi passé à une conception plus proche de l'ordolibéralisme des origines, selon laquelle le marché représenterait un idéal-type (une norme hypothétique abstraite) garanti en dernier ressort par la puissance publique elle-même. Cette évolution du cadre juridique de l'UEM nous amène alors à interroger, d'une part, la conformité de ces réformes au regard du droit primaire de l'Union et, d'autre part, les raisons implicites de cette consécration juridique de la logique de marché. ; The Economic and Monetary Union (EMU) is based on an original asymmetry between its monetary (centralised) pillar and its economic and budgetary (decentralised) pillar. The latter is structured around a specific normative triptych: financial accountability of Member States through the triple prohibition of budgetary solidarity, monetary financing and privileged access to financial institutions; economic coordination through the Broad Economic Policy Guidelines; budgetary coercion through the Stability and Growth Pact as well as the excessive deficit procedure. This original architecture is based on a specific logic: establishing the market as a veridictional and disciplinarizing body for States. By deepening the framework for the monitoring and control of Member States' economic and budgetary policies, on the one hand, and by establishing financial assistance mechanisms subject to strict conditionality, on the other hand, the reforms introduced in the aftermath of the sovereign debt crisis are in line with the logic of market-based disciplinarization of the Member States. However, by inducing an evolution in the ultimate sanction of this market disciplinary logic, they actually change the relationship between the State and the market and, therefore, transform the very meaning of the concept of "market" in the EMU legal framework. The latter would have moved from a Hayekian understanding – according to which it exists only as a concrete reality whose functioning could never be successfully corrected by external intervention – to an understanding closer to the original ordoliberalism, according to which the market would represent an ideal-type (i.e. an abstract hypothetical norm) guaranteed in the last resort by the public authority itself. This evolution of the EMU legal framework then leads us to question, on the one hand, the conformity of these reforms with the primary EU law and, on the other hand, the implicit reasons for this legal enshrinement of the market disciplinary logic. ; Die Wirtschafts- und Währungsunion (WWU) basiert auf einer ursprünglichen Asymmetrie zwischen der (zentralisierten) währungspolitischen Säule und der (dezentralisierten) wirtschafts- und haushaltspolitischen Säule. Letztere ist um ein spezifisches normatives Triptychon herum aufgebaut: Finanzverantwortlichkeit der Mitgliedsstaaten durch das dreifache Verbot der Haushaltssolidarität, der monetären Finanzierung und des bevorrechtigten Zugangs zu den Finanzinstituten; wirtschaftliche Koordinierung durch die Grundzüge der Wirtschaftspolitik; und haushaltspolitischer Zwang durch den Stabilitäts- und Wachstumspakt und das Verfahren bezüglich übermäßiger Defizite. Diese ursprüngliche Architektur beruht auf einer spezifischen Logik: die Einsetzung des Marktes als Instanz zur Abschätzung des objektiven Wertes ("véridiction" in der Foucault'schen Terminologie) und Disziplinierung der Staaten. Durch die Vertiefung des Rahmens für die Überwachung und Kontrolle der Wirtschafts- und Haushaltspolitik der Mitgliedstaaten einerseits und die Schaffung von Mechanismen für die Finanzhilfe unter strengen Auflagen andererseits stehen die nach der Staatsschuldenkrise eingeleiteten Reformen im Einklang mit der Logik der Disziplinierung der Mitgliedstaaten anhand des Maßstabs des Marktes. Indem sie jedoch eine Entwicklung in der letztendlichen Bestrafung dieser Logik in Gang setzen, verändern sie tatsächlich das Verhältnis zwischen Staat und Markt und somit auch die eigentliche Bedeutung des Marktbegriffs im Rechtsrahmen der WWU. Von einer Hayek'schen Vorstellung des Marktes - wonach dieser nur als eine konkrete Realität existiert, die in ihrer Funktionsweise durch externe Eingriffe nicht wirksam korrigiert werden kann - wären wir daher zu einer Vorstellung übergegangen, die dem ursprünglichen Ordoliberalismus näher kommt, wonach der Markt ein Idealtyp (eine abstrakte hypothetische Norm) darstellt, der letztlich von der öffentlichen Gewalt selbst garantiert wird. Diese Entwicklung des Rechtsrahmens der WWU führt dann dazu, dass wir einerseits die Übereinstimmung dieser Reformen mit dem Primärrecht der EU und andererseits die impliziten Gründe für diese rechtliche Verankerung der Marktlogik in Frage stellen. ; Peer reviewed
