Handel und ausländische Direktinvestitionen sind für Wirtschaftswachstum und Wohlstand eines Landes von ausschlaggebender Bedeutung. In den Jahren 1980 bis 1996 haben Direktinvestitionen um das Siebenfache zugenommen und gelten derzeit als Motor für die Entwicklung armer bzw. wirtschaftlich nicht voll industrialisierter Staaten. Dementsprechend schließen Kapitalimportländer mit investitionswilligen ausländischen Privatunternehmen Investitionsschutzverträge ab, welche Meinungsverschiedenheiten zwischen dem Gastland und dem Kapitalanleger einem Schiedsgericht unterwerfen. -- Die Entscheidung über solche Streitigkeiten erfordert in der Praxis ein hohes Standing und große Sensibilität im Umgang mit beiden Parteien. Aber auch rechtlich handelt es sich um ein äußerst schwieriges Terrain, da es um Fragen der internationalen Wirtschaftsschiedsgerichtsbarkeit geht, welche auch eine erhebliche völkerrechtliche Dimension besitzen. -- Aufgabe der vorliegenden Arbeit soll es daher sein, auf sämtliche Probleme, welche bei einem Investitionsschutzvertrag auftreten, einzugehen. In einem größeren ersten Teil werden die klassischen Probleme des Einzelrechtsschutzes bei Investitionsschutzverträgen erläutert. Der kürzere zweite Teil behandelt neuartige Regelungstypen und Schutzmechanismen für Investitionsschutzverträge vor Schiedsgerichten, wobei der Schwerpunkt auf neue Instrumente zur Fortbildung des internationalen Wirtschaftsrechts wie die MIGA-Konvention, die FTA und NAFTA-Abkommen und zuletzt das WTO-Übereinkommen gelegt wird. Im Ergebnis wird gezeigt, daß die Fragen der Qualifikation der rechtlichen Beziehungen zwischen Staaten und privaten Investoren in einem Investitionsschutzvertrag zu den umstrittensten Problemen unserer Zeit gehören und daß das Bedürfnis nach verläßlichen, eindeutigen und transparenten internationalen rechtlichen Rahmenbedingungen im Bereich der Auslandsinvestitionen, welche ausländischen Investoren einen effektiven Schutz gewähren würden, noch nicht in vollem Maße befriedigt ist

This study assesses the rules of international law relevant to the use of force against non-State actors. The rules of international law on the use of force are the lynchpin of the project of international law for a more secure and peaceful world. Yet, as important as they are, the rules of international law on the use of force are also highly contentious. With the shift in the nature of conflicts from inter-State wars to conflicts involving non-State actors, and with the growth in the threat of global terrorism, the focus of the law on the use of force has shifted to the use of force against non-State actors. To assess the permissibility of the use of force against non-State actors, this study will focus on two grounds that have been advanced as bases for the extraterritorial use of force against non-State actors: the right of a State to act in self-defence and intervention by invitation. While there are other grounds that have been advanced for the extraterritorial use of force in international law, it is only in respect of these two grounds that the role of non-State actors has a significant influence on the legality or not of the use of force

The recent "liberal international order" (LIO) debate has been vague about the institutions and issue areas that constitute the order. This is likely driven by competing views of "liberal" and, perhaps more importantly, by security scholars dominating the debate. From the perspective of scholars who explore the elements of the global monetary order (reserve currencies, international financial institutions, and central banks), the picture is different. Where security scholars point to a decline in US influence, scholars of global monetary politics see continued US dominance. Moreover, monetary prominence has been a precondition for the viability of great power projects of order building more generally. This symposium offers such a counter narrative. While the security challenges are real, the crises of the last decade have actually reinforced the centrality of the US dollar and American financial power in the international system.

In March 2022, the 27 member states of the European Union (EU) want to adopt a "Strategic Compass" (SC) that is intended to make the Union a provider of inter­national security by 2030 and strengthen its strategic sovereignty. The first draft of this document has been available since mid-November, and it shows serious deficits: strategic fragmentation, over-institutionalization, and diffusion of responsibility remain hallmarks of EU security and defense policy. In the upcoming revision of the compass, Berlin is called upon in particular to clarify its status and set a clear target of ambition. Otherwise, the Strategic Compass is likely to encourage an EU security policy whose motto is "Everything can be done, nothing must be done." (author's abstract)

"Die Studie analysiert die mediale Auseinandersetzung mit dem politisch wie wirtschaftlich aufstrebenden Land China in der deutschen Presse. Als Vorlage für die Untersuchung dienen die Vorarbeiten des Politikwissenschaftlers Thomas Heberer, der argumentiert, dass sich das positive Chinabild der 90er‐Jahre aufgrund des wirtschaftlichen Aufstieges Chinas in ein negatives Bild gewandelt habe. Eine Medienanalyse von 1993 bis 2007 soll zu einer Bewertung der Annahme Heberers führen und untersuchen wie China in den deutschen Medien dargestellt wird, welche Stereotypen aufgegriffen werden und mit Hilfe welcher Frames ein Zugang zu diesem Land geschaffen wird. Die Ergebnisse zeigen, dass über China im gesamten Untersuchungszeitraum eher kritisch berichtet wurde. Dabei leidet das Chinabild vor allem an kurzfristigen, negativen Schlagzeilen. Es konnte kein eindeutiger Wandel, lediglich ein leichter Negativtrend in der Berichterstattung festgestellt werden. Insgesamt ist die Berichterstattung durch die Verwendung von Stereotypen und Frames charakterisiert, die sich vorwiegend auf die politische und wirtschaftliche Macht des Landes beziehen und vereinzelt ein bedrohliches Bild zeichnen." The Kremlin rulers told the hard-line East German leaders to solve their refugee problem not by closing the border, but by alleviating their domestic and foreign problems. The book describes how, over the next seven years, the East German regime managed to resist Soviet pressures for liberalization and instead pressured the Soviets into allowing them to build the Berlin Wall. Driving the Soviets Up the Wall forces us to view this critical juncture in the Cold War in a different light. Harrison's work makes us rethink the nature of relations between countries of the Soviet bloc even at the height of the Cold War, while also contributing to ongoing debates over the capacity of weaker states to influence their stronger allies.
