This paper provides a commentary on the evolution and position of petty offence law in the Polish legal system. For the sake of order, it should be noted that the nature of petty offences is ambiguous and not one-dimensional. Their status and role depend on the assumptions of the legislator, who may emphasise their various aspects. A petty offence may be an element of criminal law in the broad sense, as a "small crime" or an administrative tort. More-over, the development of Polish petty offence law and the arguments supporting the choice of specific legal solutions are presented. The probable future of Polish petty offence law was also indicated, aiming at the conclusion that the most serious petty offences would become crimes, and the rest would become administrative torts.

Über die Frage, ob Menschen willensfrei handeln können, diskutieren Neurowissenschaftler, Philosophen und Rechtswissenschaftler intensiv. Ist vor diesem Hintergrund ein Schuldvorwurf gegenüber einem Straftäter angemessen? Tatjana Hörnle, Professorin für Strafrecht und Rechtsphilosophie an der Humboldt-Universität zu Berlin, rekonstruiert das plausibelste Modell menschlicher Entscheidungsfindung und kommt zum Ergebnis, dass ein Schuldvorwurf problematisch ist. Die Autorin bewertet die Strategien, mit denen Strafrechtswissenschaftler auf die Herausforderungen der Neurowissenschaften reagieren, als unbefriedigend. Stattdessen spricht sie sich für einen Verzicht auf einen Schuldvorwurf aus und dafür, dass der Tätern gemachte Vorwurf konsequent auf das Tatunrecht zugeschnitten werden müsse. This paper examines the problems of incorporating norms of customary law into the substantive criminal laws of a Melanesian state system. It focuses on the particular crime of sorcery in Vanuatu. It explores the historical and sociological contexts to the belief in sorcery in society today, and also how behaviour generated by the belief (allegations of sorcery and sorcerer-related attacks) is dealt with by the non-state customary legal system. It then investigates how the state has treated the issue of sorcery, discussing both legislative initiatives and also a number of cases brought before the courts in recent years. The paper argues that merely transplanting substantive norms from the customary system into the state system without consideration of the procedural and institutional framework those norms were developed within, or the ramifications the law may have on other aspects of the legal system, is doomed to failure. Finally, it highlights a number of issues that must be considered in order to successfully initiate a more fruitful process of legal pluralism.

This article examines the most significant cases from the Supreme Court of Virginia and the Court of Appeals of Virginia over the past year. The article also outlines some of the most consequential changes to the law enacted by the Virginia General Assembly during the 2005 Session in the field of criminal law and procedure.
