International audience ; La communication auprès des habitants des quartiers prioritaires de la ville présente un défi considérable, dans le sens où elle connecte questions institutionnelles et organisationnelles d'une part, et questions de vie quotidienne d'autre part. Ces deux sphères peuvent être réunies grâce à la recherche de « noeuds sémantiques » communs, permettant de travailler le sens avant la forme. La communication comme partage de sens I l n'y a rien de nouveau à dire que chaque type de communication doit s'appliquer à un public précis ; le souligner en guise d'introduction peut paraître peu pertinent. Toutefois, il convient de préciser la probléma-tique de la communication à destination de publics de manière plus complète, dans la mesure où tout type de communication s'inscrit dans une dynamique systémique, qui implique émetteur(s) et récepteur(s), en plus du contenu même du message (Meunier 2003). Pour le dire autrement, et sans reprendre inutilement les questionnements de base des théories de l'information et de la communication, une transmission bien comprise du message, c'est-à-dire dans des dispositions acceptables et efficientes à la fois pour l'émetteur et le récepteur, ne peut se faire que sur une base mutuelle et partageable de sens. En tant que chercheur, nous avons traité la question du rapprochement de ces deux instances de multiples fois (Wagener 2012 ; Wagener 2015). En tant qu'acteur professionnel de ces thématiques, nous avons pu observer, au cours d'interventions diverses, que les personnes qui doivent transmettre un message et concevoir une communication « efficace » ne sont pas toujours au clair sur leurs propres représentations de 1/ ce qu'est une communication « efficace », 2/ du public cible auquel ils doivent s'adresser et 3/ de leur propre rôle d'émetteur et de ce que cela implique. La question devient plus épineuse encore lorsqu'un ou plusieurs paramètres sociaux éloignent les émetteurs et les récepteurs, comme cela peut être le cas dans le cadre de la communication auprès des habitants de quartiers prioritaires de la ville. Nous sommes déjà intervenus, dans ce périmètre précis, auprès de professionnels et d'élus : l'objectif de cet article est de pouvoir proposer une méthodologie d'intervention en prenant appui sur une théorisation systémique et discursive de ce qu'implique concrètement la problématique de communication, notamment lorsque celle-ci concerne la politique de la ville et les quartiers prioritaires qui y sont associés. The traditional residents of urban historical areas have played a central role, but ambivalent, in the construction of meanings, actions and effects of enhancement and management processes of Latin American urban heritage. The article presents some reflections arising from an investigation about the construction and management process of cultural heritage of the city of Valparaiso -Chile and Mexico D.F. The article analyzes and reflects four main aspects : a) The traditional role that people have played in patrimonial processes of urban spaces in Latin America; b) the role of the Government in the inclusion of communities in the construction and management of their assets; c) the role of the communities in the construction and management of their assets which becomes more active progressively; d) finally some thoughts about the conceptualization of the heritage and the challenge implied to the public policies, in light of the background seen, by the development of activation and property management processes more inclusive and participatory . ; Los habitantes tradicionales de las áreas históricas urbanas han tenido un rol central, pero ambivalente, en la construcción de los significados, acciones y efectos de los procesos de puesta en valor y gestión del patrimonio urbano latinoamericano. El artículo expone algunas reflexiones surgidas a partir de una investigación sobre el proceso de construcción y gestión del patrimonio cultural de la ciudad de Valparaíso-Chile y México D.F. El trabajo analiza y reflexiona sobre cuatro aspectos centrales: a) El rol tradicional que los habitantes han ocupado en los procesos de patrimonialización de espacios urbanos de América Latina; b) el papel del Estado en la inclusión de las comunidades en la construcción y gestión de sus patrimonios, c) el cada vez más activo papel de las comunidades en la construcción y gestión de sus patrimonios; y d) finalmente algunas reflexiones sobre la categoría de patrimonio cultural mundial y el desafío que implica para las políticas públicas, a la luz de los antecedentes vistos, el desarrollo de procesos de activación y gestión patrimonial más inclusivos y participativos. ; Os habitantes tradicionais de zonas urbanas históricas estiveram desempenhando um papel central, porém ambivalente, na construção de significados, ações e efeitos dos processos da valorização e gestão do patrimônio urbano latino-americano. O artigo apresenta algumas reflexões decorrentes de uma pesquisa sobre o processo de construção e gestão do patrimônio cultural da cidade de Valparaiso-Chile e México D.F. O trabalho analisa e tece reflexões sobre quatro aspectos centrais: a) O papel tradicional que os habitantes estiveram ocupando nos processos de patrimonização de espaços urbanos da América Latina; b) o papel do Estado na inclusão das comunidades na construção e gestão de seus patrimônios; c) o posicionamento das comunidades na construção e gestão de seus patrimônios que progressivamente tornaram-se mais ativos; e d) finalmente algumas reflexões sobre a conceitualização do patrimônio e o desafio que implica para as políticas públicas, a partir dos antecedentes vistos, o desenvolvimento de processos de ativação e gestão patrimonial mais inclusivos e participativos.

Purposes of land law as a separate branch of legal system of Ukraine are researched. Purpose is an obligatory part of any social mechanism. So legal regulation of land relations must be oriented on achievement of some legal purposes. It was stated in legal literature that purpose of law (legal purpose) is regarded as form of future in temporary times. It is a kind of proper status of social relations in current legislation. That is why purpose in law plays a role of legal instrument which serves to lawmakers as a mode of organization of all system of legal regulation of social relations. It was also stated in the legal literature that the most significant peculiarities of any purpose in law is its normativeness, because most of legal purposes are not only desired result but is obligatory way of activity. That is why legal purpose serves as a regulator of social relations in any society. Besides, legal purpose is regarded as some model of social order which is guaranteed by state. So legal purpose is an official orient for legal practice. It is proved in the article that modern land law of Ukraine has two legal purposes. The first purpose of land law of Ukraine is protection of land, but second its purpose consists in promotion of realization of rights and legal interests of participants of land legal relations. However, the purposes of land law of Ukraine are not equal by its legal force. The purpose of protection of land should be regarded as the main purpose of land law of Ukraine. It means that the second purpose of land law of Ukraine might be achieved only in case of achievement of the first its purpose. Bu other words, modern land law of Ukraine has to be based on principle provision "no land – no right to land". The author of the article proves that if society are not able to protect land it also is unable to secure any rights to the land. Finally, to streamline activity of all participants of land legal relations at achievement of the main purpose of land law of Ukraine it is necessary to adopt legal normative (requirements) of quality status of all types of land in Ukraine.
