Die Forschung über internationale Sanktionen hat sich in der Vergangenheit vor allem auf die Implementierung und Wirksamkeit konzentriert und die Beendigung außer Acht gelassen. Traditionelle Erklärungsansätze, die Sanktionen als Instrument rationaler, zwischenstaatlicher Verhandlungen betrachten, erklären die Dauer und das Ende von Sanktionen mit Hilfe von Kosten-Nutzen-Rechnungen. Dabei wird jedoch das Wechselspiel zwischen Lockerung, Stagnation und Intensivierung von Sanktionen unzureichend erfasst. Auch die vielfältigen sozialen Beziehungen und die politischen Signale, die von einer Beendigung von Sanktionen ausgehen, finden nicht ausreichend Beachtung. Um diese Lücken zu schließen, schlägt der Artikel ein prozessorientiertes und relationales Verständnis der Beendigung von Sanktionen vor. Es wird auch berücksichtigt, dass die Aufhebung von Sanktionen die politische Isolation des Sanktionszieles beendet, was Gegenstand intensiver diskursiver Auseinandersetzungen sein kann. Fallstudien zu Simbabwe und dem Iran veranschaulichen, wie ein solcher Ansatz Aufschluss über verschiedene Handlungslogiken gibt, die Prozesse der Sanktionsbeendigung prägen, und so zu einem ganzheitlicheren Verständnis von Sanktionen beiträgt.

The German Yearbook of International Law, founded as the Jahrbuch für Internationales Recht, provides an annual report on new developments in international law and is edited by the Walther Schücking Institute for International Law at the University of Kiel. Since its inception in 1948, the Yearbook has endeavored to make a significant academic contribution to the ongoing development of international law. Over many decades the Yearbook has moved beyond its origins as a forum for German scholars to publish their research and has become a highly-regarded international forum for innovative scholarship in international law. In 1976, the Yearbook adopted its current title and began to publish contributions written in English in order to reach the largest possible international audience. This editorial decision has enabled the Yearbook to successfully overcome traditional language barriers and inform an international readership about current research in German academic institutions and, at the same time, to present international viewpoints to its German audience. Fully aware of the paramount importance of international practice, the Yearbook publishes contributions from active practitioners of international law on a regular basis. The Yearbook also includes critical comments on German state practice relating to international law, as well as international reactions to that practice. Prof. Dr. Andreas von Arnauld ist Inhaber des Lehrstuhls für Öffentliches Recht mit Schwerpunkt Völker- und Europarecht an der Universität Kiel und Direktor des Walther-Schücking-Instituts für Internationales Recht. Zuvor lehrte er als Professor für Öffentliches Recht, insbesondere Völker- und Europarecht an der Helmut-Schmidt-Universität der Bundeswehr in Hamburg (2007–2012) sowie an der Universität Münster (2012–2013). Seine Forschungsschwerpunkte umfassen das internationale Friedenssicherungsrecht, den Grund- und Menschenrechtsschutz, Rechtsstaatlichkeit (rule of law), rechtswissenschaftliche Grundlagenforschung sowie Recht und Literatur. Prof. Dr. Kerstin von der Decken (geb. Odendahl) ist Inhaberin des Lehrstuhls für Öffentliches Recht mit Schwerpunkt Völkerrecht, Europarecht und Allgemeine Staatslehre an der Universität Kiel sowie Geschäftsführende Direktorin des Walther-Schücking-Instituts für Internationales Recht. Davor war sie von 2004 bis 2011 Professorin für Völker- und Europarecht an der Universität St. Gallen, Schweiz. Ihre Forschungsschwerpunkte liegen bei den Grundlagen des Völker- und Europarechts sowie dem internationalen Umwelt,- Kultur- und Sicherheitsrecht. Prof. Dr. Nele Matz-Lück, LL.M., ist seit 2011 Professorin für Seerecht an der Universität Kiel und Ko-Direktorin des Walther-Schücking-Instituts für Internationales Recht. Seit 2004 war sie als Referentin am Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht in Heidelberg beschäftigt. Für die Dauer von zwei Jahren war sie als wissenschaftliche Mitarbeiterin an das Bundesverfassungsgericht abgeordnet. Ihre Forschungsschwerpunkte liegen im Seerecht, Umweltvölkerrecht und in grundlegenden Fragen des Völkerrechts.

The thrust of this Paper is to analyse the transformation of international custom construction and creation from the model of state practice supported by opinio iuris to a new concept reflected in the judicial decision of the international criminal tribunals, with the main emphasis being on the case law of the International Criminal Tribunal for the former Yugoslavia. The following questions are examined in analysing the interpretation, application, and in some instances, also the creation of customary international norms: from which sources do the judges look for evidence of customary international law? Is the requisite of actual state practice diminishing? What is the significance of international treaties, reports of international committees, and international case-law as sources of custom? Does the case law of the tribunals show that the role of the judge is more prevalent than traditionally in the formation of customary international law, at least in the area of international criminal law? The first part of the paper offers an analysis of customary law in the International Military Tribunal of Nuremberg, which, along with many post-Second World War legal instruments, case law, and academic commentary, has contributed to and clarified the content of customary norms in international criminal law. The second part reviews the decisions of the International Criminal Tribunal for the former Yugoslavia in relation to the concept, formation, and context of customary norms. In addition, the aim is to examine if the approach of the Tribunal on the construction of customary norms has changed during its period of functioning. The role of the judge in construction and in some instances, creation of customary international norms is discussed with references to the judicial decisions of the Yugoslavia Tribunal. I conclude that the dynamic approach adopted by judges in the construction of customary law in some cases of the Yugoslavia Tribunal is not unprecedented in the decisions of international courts. The third part discusses the problem of conflicting norms that may arise in the application and construction of customary criminal norms in international criminal tribunals. First, I conduct a limited conceptual and historical analysis of the principles of legality, the nullum crimen sine lege and the nulla poena sine lege principles, and I attempt to answer the substantive issues: how can the principles of legality be retained in the application of customary international norms by the international judge, and whether the progressive formation of custom (moving away from the requirement of 'constant and uniform state practice' supported by opinio iuris) destabilises legal certainty, which should be especially endorsed when an individual's (here meaning the accused) freedom is at issue? The final dilemma in relation to conflicting norms is that of deducing international criminal norms that give rise to individual criminal responsibility directly from treaties that were intended to be applied between the state parties. I conclude this paper by stating that the judges not only interpret, but also have an impact on the formation of customary international law because their decisions can be seen as evidence of (international) practice or as a reflection of opinio juris. Finally, this paper shows that there is a definite need for greater consistency in the formation of customary international norms in international criminal tribunals.

ABSTRACT
International relations (IR) has been criticized for its poor response to the challenges of the Anthropocene. Since the 1950s, IR, especially in its US form, was driven by immediate Cold War concerns of security and relations between great powers. Yet, this IR of the later twentieth century superseded a more materialist IR that had flourished in the first half of the century. Derwent Whittlesey's political geography, which was one aspect of this material international thought, had directly explored the relationship between global politics and the environment. This article explores Derwent Whittlesey's international environmental thought, showing how it emerged from a more environmentally determinist tradition, but came to understand the relationship between human society and the environment as fungible and complex. Prioritizing time and profound changes linked to the machine age, Whittlesey warned about the damage that human society inflicted on its habitat. Yet, despite his contacts with early IR scholars at Yale, Whittlesey and his work would come to be forgotten in IR. Consequently, his work represents a path not taken, and his marginalization helps to explain why IR was so ill-equipped to understand the new global politics of the Anthropocene.
Las Relaciones Internacionales (international relations, IR) han sido criticadas por su pobre respuesta ante los desafíos del Antropoceno. Desde la década de 1950, las IR, especialmente en su forma estadounidense, fueron impulsadas por inquietudes inmediatas de la Guerra Fría en cuanto a la seguridad y las relaciones entre las grandes potencias. Sin embargo, estas IR de finales del siglo XX reemplazaron a las IR más materialistas que habían prosperado en la primera mitad del siglo. La geografía política de Derwent Whittlesey, que era un aspecto de este pensamiento internacional pertinente, había explorado de manera directa la relación entre la política global y el medioambiente. Este artículo explora el pensamiento ambiental internacional de Derwent Whittlesey y explica cómo surgió de una tradición más determinista a nivel ambiental, pero llegó a comprender la relación entre la sociedad humana y el medioambiente como fungible y compleja. Al priorizar el tiempo y los cambios profundos vinculados a la era de las máquinas, Whittlesey advirtió sobre el daño que la sociedad humana infligió a su hábitat. Sin embargo, a pesar de sus contactos con los primeros académicos en IR en Yale, Whittlesey y su trabajo serían olvidados en el campo de las IR. En consecuencia, su trabajo representa un camino aún no recorrido y su marginación ayuda a explicar por qué las IR estaban tan mal preparadas para comprender la nueva política global del Antropoceno.
Les relations internationales (RI) ont été critiquées pour leur mauvaise réponse à l'anthropocène. Depuis les années 50, les RI, tout particulièrement dans leur forme américaine, ont été déterminées par les préoccupations immédiates de la guerre froide en matière de sécurités et de relations entre grandes puissances. Ces RI de la fin du vingtième siècle ont toutefois supplanté des RI plus matérialistes qui s'étaient développées durant la première moitié du siècle. La géographie politique de Derwent Whittlesey, qui constituait l'un des aspects de cette pensée internationale matérielle, avait directement exploré la relation entre politique mondiale et environnement. Cet article étudie la pensée environnementale internationale de Derwent Whittlesey en montrant comment elle a émergé d'une tradition plus déterministe sur le plan environnemental mais en est venue à comprendre la relation entre société humaine et environnement comme étant fongible et complexe. Priorisant le temps et les profonds changements liés à l'ère de la mécanisation, Whittlesey avait mis en garde contre les dommages que la société humaine infligeait à son habitat. Pourtant, malgré ses contacts avec les premiers chercheurs en RI à Yale, Whittlesey et son travail ont fini par être oubliés en RI. Par conséquent, son travail représente une voie qui n'est pas empruntée et sa marginalisation contribue à expliquer pourquoi les RI sont si mal équipées pour comprendre la nouvelle politique mondiale de l'anthropocène.

À la fin de la Seconde Guerre mondiale, les États, effrayés par le déchaînement de la violence qui avait ravagé le monde pendant plus de cinq ans, ratifient une refonte des Conventions de Genève dans l'espoir de se doter d'un instrument de droit solide, destiné à préserver, même dans la guerre, la dignité de tous les individus. Ils s'engagent à respecter, dans les conflits armés, internationaux ou non, les droits fondamentaux de la personne humaine, et à limiter au strict nécessaire l'usage de la force pour mettre l'ennemi hors de combat. Les deux Protocoles additionnels de 1977 confirment cette volonté.
