This article will examine the impact of the Europeanization of punishment, and of criminal justice in general, on the focus of criminal law on dangerousness and on dangerous citizens, rather than on harm and facts. It argues that the EU criminal law is part of a growing global trend pushing towards preventive criminal justice, namely the exercise of state power in order to prevent future acts that are deemed to constitute security threats, which at EU level is problematic in terms of fundamental rights and citizenship rights. The article argues EU criminal law is contributing to three main shifts: a shift from an investigation of acts that have taken place due to an emphasis on suspicion, a shift from targeted action to generalized surveillance, or, underpinning both, a temporal shift from the past to the future. It develops this argument looking at administrative terrorist sanctions, criminalization of terrorist acts, mass surveillance and expulsion of convicted criminals.

In present article are investigated a modern condition and tendencies of development of the Eurasian economic integration. In these purposes the analysis legal and institutional bases of functioning of the Eurasian union which participants at the present moment are the Republic Belarus, the Republic of Kazakhstan and the Russian Federation will be carried out. In article the author allocates some problems of customs regulation in the Eurasian union.

Im Jahre 2015 verhandelte das Landgericht Lüneburg gegen den seinerzeit 93 Jahre alten Oskar Gröning, einen ehemaligen Angehörigen der SS. Man legte ihm zur Last, 1944 im Vernichtungslager Auschwitz-Birkenau Beihilfe zum Mord in 300.000 Fällen geleistet zu haben.Jahrzehnte nach der Tat war die Arbeit der Verfolgungsbehörden schwierig. Sie erstreckte sich auf rechtliche, geschichtliche und medizinische Aspekte. Überlebende und ihre Angehörigen sollten die Möglichkeit erhalten, sich vor einem deutschen Gericht zu äußern. Unerlaubtes Verhalten wird nach dem Vertrauensgrundsatz bestimmt, wenn der Handelnde für die Kompensierung fremden Fehlverhaltens zuständig ist. Die Anwendung des Prinzips ist deshalb in solchen Lebensbereichen von maßgeblicher Bedeutung, in denen sich der Akteur in ständigem Kontakt mit anderen befindet, wie etwa im Straßenverkehr, in der Medizin oder im Unternehmen. Die Arbeit befasst sich mit der dogmatischen Funktion dieses Kriteriums in der Strafrechtslehre und grundlegend mit der Frage seiner Begründung in der freiheitlichen Rechtsordnung. Diese Analyse wird insbesondere unter Berücksichtigung der Prinzipien der dabei angenommenen normativen Zurechnungslehre entfaltet. So setzt die Anwendung des Vertrauensgrundsatzes die Begründung der Garantenstellung des Vertrauenden für den Ausgleich fremden Fehlverhaltens voraus. Vertrauensschutz muss ferner in der freiheitlichen Rechtsordnung bereits gegeben sein. Die Frage des Vertrauensgrundsatzes ist mithin eine grundlegende Frage der Strafrechtswissenschaft.

Powołując się na odnośne przepisy Prawa Ukrainy, artykuł skupia się na tych postanowieniach, które dotyczą gwarancji bezpieczeństwa osób biorących udział w postępowaniu karnym dla zapewnienia właściwego przestrzegania prawa. Po analizie rozmaitych ról, w których jednostka może wystąpić w postępowaniu karnym, wymieniono środki gwarantujące bezpieczeństwo i omówiono je w nawiązaniu do poszczególnych ról. W dalszej części artykuł przedstawia prawa osób objętych ochroną oraz obowiązki prokuratury i sądów. Artykuł zamyka lista czynności i środków zaradczych, które mogą zostać wykorzystane przez inspektorów wobec osób biorących udział w postępowaniach karnych. ; Ссылаясь на соответствующие положения законодательства Украины, автор концентрируется на решениях, касающихся гарантий безопасности лицам, принимающим участие в уголовном процессе для обеспечения соответству- ющего соблюдения закона. После анализа разнообразных ролей, в которых может выступать человек в уголовном процессе, были приведены средства га- рантирующие его безопасность и проведен их анализ на отдельных примерах. В статье указаны права лиц находящихся под охраной, а также обязанности прокуратуры и судов. Статья заканчивается списком действий и предохранительных шагов, которые могут использовать инспекторы в отношении к лицами принимающим участие в уголовном процессе. ; Referring constantly to relevant regulations of the Law of Ukraine, the article examines Ukrainian legislation pertaining to the safety guarantee for persons participating in criminal legal proceedings to ensure appropriate enforcement of justice. An analysis of an array of roles one may assume in criminal legal proceedings is followed by a listing of measures for guaranteeing safety, discussed in reference to the roles. Further, the rights of persons taken under the protection and relevant obligations of public prosecutors and courts are quoted. The article closes by listing safety guarantee-related activities and remedial actions that inspectors may use towards persons participating in criminal legal proceedings.
