It is proposed in this work a methodological premise and a reflection on the problems of effectiveness of the sentence, both the application and the utility and its implementation in prison. Based on the assumption that the penalty should be applied in certain first practice, only dialogue between different sciences criminals (criminal law, criminology, criminal politics) can groped to find a type of sanction that while respecting the constitutional principles, meets the needs of effectiveness and usefulness of sanctions reaction, that the criminal policy in particular puts on the table the issue. The penalty and its implementation must be in touch (and specialize), with the personality of delinquent who lives in a reality evolution continues.The study of delinquent may allow individualization of the exact penalty, adapting to his actual personality and social danger.This is close topical in the current criminal, where dangerous generalizations should be avoided and tolerances facade, since the consummation of certain types criminal is often an expression of certain socio-cultural and geographical segments: this place is essential to analyse and understand how, the criminal sanction, and should be able to converse with his basic values. This is to not ignore the citizen and needs of social defense, so that the policy is not to consider criminal, his dignity and psychological aspects of intellectual, to achieve his real resocialization end rehabilitation. ; In questo lavoro si propone una premessa metodologica e una riflessione sui problemi legati alla effettiva efficacia della pena,sia sotto l'aspetto applicativo che della sua esecuzione e utilità nel carcere. Partendo dal presupposto che la pena deve essere innanzitutto certa ed applicata concretamente,solo il dialogo fra le diverse scienze criminali (diritto penale, criminologia, politica criminale) può tentare di individuare un tipo di sanzione che, nel rispetto dei principi costituzionali, soddisfi le esigenze di effettività e utilità della reazione sanzionatoria, che la politica criminale in particolare pone sul tavolo della questione.La pena e la sua esecuzione, devono quindi essere in contatto (e specializzarsi), con la personalità del delinquente, che vive una realtà in evoluzione continua. Solo lo studio del delinquente può consentire la esatta individualizzazione della pena, adeguandola alla sua effettiva personalità e pericolosità sociale. Questo è di stretta attualità nell'attuale panorama criminale, dove vanno evitate pericolose generalizzazioni e tolleranze di facciata, dato che la consumazione di alcune tipologie delittuose è spesso espressione di determinate fasce socioculturali e geografiche: ciò posto è fondamentale analizzare e capire in che modo la sanzione criminale debba e possa dialogare con i suoi valori di fondo. Ciò al fine di non disinteressarsi del cittadino e delle esigenze di difesa sociale, di modo che la politica criminale non si distacchi dall'uomo, dalla sua dignità e dagli aspetti psico-intellettivi, ai fini di una sua reale risocializzazione e recupero.

Alcuni studi e indagini nazionali condotti in strutture di ricovero, hanno portato alla luce la realtà di reparti psichiatrici che, sovente, continuano ad impiegare pratiche fortemente radicate a istanze custodialistiche, tipiche del modello manicomiale., La diffusione epidemiologica della contenzione rivela una forte contraddizione tra la pratica clinica e i principi che hanno ispirato la riforma della legislazione psichiatrica del 1978. L'assunto su cui la tesi oggetto dell'elaborato pone le sue basi è il seguente: se le evidenze scientifiche mostrano che la contenzione può essere evitata, allora essa deve essere vietata. La partita, dunque, non si gioca solo sul campo dell'interpretazione delle norme giuridiche, ma coinvolge conoscenze pertinenti alla psichiatria, la quale deve indicare i comportamenti da adottare per affrontare le problematiche che riguardano la cura del paziente. A partire dalle evidenze scientifiche, l'obiettivo del presente lavoro è quello di dimostrare che la contenzione, sia sotto forma di contenzione meccanica che di contenzione fisica, poiché illecita, deve essere abolita. L'originalità della ricerca che risiede nella scelta di costruire le basi del ragionamento giuridico sulle evidenze scientifiche, che dimostrano che la contenzione non ha alcuna valenza di atto medico-terapeutico e che esistono numerosi strumenti idonei a prevenire o contenere gli eventuali comportamenti violenti (aggressivi o clastici) del paziente e, allo stesso tempo, in grado di preservare la sua integrità e dignità e di fortificarne l'alleanza terapeutica con gli operatori sanitari. Questa scelta ha l'ambizione di proporre una alternativa alla tendenza, attualmente assai diffusa, di convertire la medicina evidence based in una medicina dell'obbedienza giurisprudenziale. Al contrario, il giurista deve impegnarsi a costruire un modello integrato di scienza penalistica che tenga in debita considerazione le evidenze emerse in ambito scientifico e le metta in comunicazione con la tecnica giuridica. ; Some national studies and surveys conducted in hospitality facilities have brought to light the reality of psychiatric wards that often continue to employ practices that are deeply rooted in custodial instances typical of the manicomial model. The epidemiological spread of the containment reveals a strong contradiction between clinical practice and the principles that inspired the 1978 psychiatric legislation reform. The assumption on which the thesis object of the elaboration puts its bases is as follows: If the scientific evidence shows that restraint can be avoided, then it must be banned. The game, therefore, does not only play on the interpretation of legal norms, but involves psychiatry evidences, which must indicate the behaviors to be taken to address the issues that concern the patient's care. From the scientific evidence, the aim of this paper is to demonstrate that restraint, both in the form of mechanical and physical restraint, since it is unlawful, must be abolished. The originality of the research that lies in choosing to build the basis of legal reasoning on scientific evidence demonstrates that the containment has no validity as therapeutic act and that there are numerous tools to prevent or contain any violent behaviors and at the same time able to preserve its integrity and dignity and to strengthen its therapeutic alliance with healthcare professionals. This choice has the ambition to propose an alternative to the currently widespread trend of converting evidence-based medicine into a medicine of law-abiding. On the contrary, the lawyer must build an integrated model of legal science that takes due account of the evidence emerging in the scientific sphere and puts them in communication with the legal technique.

Through Suarez words, it is possible to understand what are the responsibilities of human being in the world and how she/he may exercise powers and will in the prepolitical and politica spheres.

Background: Il potenziamento umano consiste in una modifica volta a migliorare caratteristiche e capacità umane attraverso interventi scientifici o tecnologici sul corpo umano, partendo da una "condizione di integrità" e non da uno stato di malattia. Occorre pertanto valutare se il potenziamento sia lesivo della dignità umana oppure strumento utile a migliorare le condizioni di vita dell'uomo. Metodi: In un primo momento si è proceduto alla ricerca bibliografica dedicata all'inquadramento dello HE mediante l'analisi dei concetti di salute e potenziamento, affrontando gli aspetti di pertinenza biogiuridica come ad esempio i possibili impatti negativi su dignità, identità, libertà ed uguaglianza, e mettendo a confronto teorie scientifiche ed umanistiche. In un secondo momento si è proceduto all'analisi dettagliata del quadro normativo nazionale e sovranazionale degli ultimi dieci anni, dallo Human Enhancement Study dello Science and Technology Options Assessment ai pareri del Comitato Nazionale per la Bioetica. A partire da tale inquadramento sono state individuate e trattate alcune tipologie di potenziamento, utilizzando un approccio metodologico medico sociale ed approfondendo ciascuna tematica sotto il profilo sia dottrinario sia giurisprudenziale. Risultati: Doping, chirurgia estetica e divieto di selezione eugenetica sono tecniche già disciplinate. Smart drugs e deep brain stimulation sono tecniche già disciplinate per utilizzo a scopo terapeutico, ma talvolta il loro utilizzo esula dalla cura di patologie. Potenziamento militare e Potenziamento biologico sono tecniche in fase sperimentale. Di ciascuna di esse sono state rappresentate le peculiari difficoltà nell'identificazione dei limiti di liceità. Conclusioni: Sembrerebbe ipotizzabile un approccio "case by case" del diritto, poiché duttile ed in grado di adattarsi alle caratteristiche peculiari di ogni singola forma di potenziamento valutandone al contempo l'impatto politico, legale, etico, sociale e di sicurezza, in un quadro di disomogeneità delle Tecnologie di Potenziamento Umano che non permette una cornice normativa unitaria in grado di soddisfare pienamente i bisogni individuali e collettivi. ; Human Enhancement is a modification aimed to improve human's characteristics and capabilities through scientific or technological interventions in the human body, starting from an 'integrity condition' and not from a state of disease. Therefore, we need to value if the enhancement is harmful of the human dignity or if it's an useful tool to improve the human life's condition. Methods: At first we focused on the bibliographic research dedicated to the HE's classification through the analysis of health's and enhancement's definitions, confronting with the bio-juridical perspective as for example the possible negative effects over a person's dignity, identity, freedom, equality; and comparing scientific and humanistic theories. We later examined in detail the national and the supranational legal framework of the last ten years, from the Science and Technology Options Assessment's Human Enhancement Study to the Comitato Nazionale per la Bioetica's opinions. Starting from this classification we located and analyzed some typologies of enhancement, using a medical social methodological approach and deepening each subject matter from both doctrinaire and jurisprudential profile. Results: Doping, cosmetic surgery and prenatal genetic enhancement's prohibition are techniques already disciplined. Smart drugs and deep brain stimulation are techniques already disciplined for therapeutic purpose, but sometimes their application lies outside the disease's therapy. Military and biological enhancementare techniques in an experimental phase. We have represented the particular difficulties inidentifying the limits of lawfulness of each of these typologies of enhancement. Conclusions: We could hypothesize a 'case by case' law's approach, because it's ductile and able to adapt on the peculiar characteristics of every single form of enhancement, evaluating at the same time political, legal, ethical, social and safety impact, in a context of inhomogeneity of the Human Enhancement Technologies that it doesn't allow an uniform normative framework able to fully satisfy individual and collective needs.

The essay focuses on organ donation as a possible choice for those patients seeking euthanasia or assisted suicide whose informed and free consent has to be carefully preserved. In that case, indeed, concern for the welfare of others, on the one hand, and dying for having relief from illness, on the other hand, could confused- ly converge in the will of a vulnerable person receiving medical treatments. The Dutch and the Belgian statutory frameworks governing organ donation after eutha- nasia can shed light on this such ethical theme involving human dignity that should be ignored by the Italian legislator anymore.

ANTECEDENTES: La mejora humana es una modificación destinada a mejorar las características y capacidades humanas a través de intervenciones científicas o tecnológicas en el cuerpo humano, comenzando desde una "condición de integridad" y no desde un estado de enfermedad. Por lo tanto, debemos valorar si la mejora es perjudicial para la dignidad humana o si es una herramienta útil para mejorar la condición de la vida humana. MÉTODOS: En un principio nos centramos en la investigación bibliográfica dedicada a la clasificación de la HE a través del análisis de las definiciones de salud y mejora, confrontando la perspectiva biojurídica como, por ejemplo, los posibles efectos negativos sobre la dignidad, identidad, libertad, igualdad de una persona; y comparar teorías científicas y humanísticas. Posteriormente examinamos en detalle el marco legal nacional y supranacional de los últimos diez años, desde el Estudio de Mejoramiento Humano de la Evaluación de Opciones Científicas y Tecnológicas hasta las opiniones del Comité Nacional de Bioética. A partir de esta clasificación localizamos y analizamos algunas tipologías de mejoramiento, utilizando un enfoque metodológico social médico y profundizando cada tema desde el perfil tanto doctrinario como jurisprudencial. RESULTADOS: El dopaje, la cirugía estética y la prohibición del mejoramiento genético prenatal son técnicas ya disciplinadas. Los fármacos inteligentes y la estimulación cerebral profunda son técnicas ya disciplinadas con fines terapéuticos, pero a veces su aplicación se encuentra fuera de la terapia de la enfermedad. La mejora militar y biológica son técnicas en fase experimental. Hemos representado las dificultades particulares para identificar los límites de legalidad de cada una de estas tipologías de mejora. CONCLUSIONES: Podríamos plantear la hipótesis de un enfoque de derecho 'caso por caso', porque es dúctil y capaz de adaptarse a las características peculiares de cada forma de mejora, evaluando al mismo tiempo el impacto político, legal, ético, social y de seguridad, en un contexto de homogeneidad de las Tecnologías de Mejoramiento Humano que no permite un marco normativo uniforme capaz de satisfacer plenamente las necesidades individuales y colectivas. ; BACKGROUND: Human Enhancement is a modification aimed to improve human's characteristics and capabilities through scientific or technological interventions in the human body, starting from an 'integrity condition' and not from a state of disease. Der Band versammelt in italienischer Sprache die Beiträge zweier Konferenzen zum Gedenken an die Unterzeichnung des Gruber-Degasperi-Abkommens in Paris am 5. September 1946 (auch Pariser Vertrag genannt), das den Schutz der kulturellen Eigenart der deutschsprachigen Bevölkerung in der Region Trentino-Südtirol garantiert. Zunächst geht es um eine historische Reflexion über die Ursprünge des Abkommens und die Umstände, unter denen es geschlossen wurde, sowie eine Bewertung des 1946 erzielten Ergebnisses im Hinblick auf seine Bedeutung für die Südtiroler Autonomie und das europäische Friedensprojekt. Überlegungen zur grenzüberschreitenden Zusammenarbeit in der EU und den internationalen Minderheitenschutz ergänzen den interdisziplinären Sammelband.
In the contest of a wider pluralism of the Italian society, legislation still struggles to guarantee an real equal treatment to all religious minorities. Religious denominations - who ratified an intesa with the Government - are for sure in a privileged position compared to those who are still regulated by the general law. Among the last ones, the Italian jurisprudence is playing an important role to find a balance especially on those issues that ask for a more decise government of religious diversity.

This PhD thesis aims at understanding the problems, both theoretical and practical, related to the applicability of international humanitarian law and human rights law to peacekeeping operations. The four chapters of the thesis discuss the nature and the variety of peacekeeping operations, the attribution of conducts, the interpretation of art. 103 of UN Charter and specific problems linked to the applicability of international humanitarian law and human rights law. The conclusion reached is in the sense that the role of troop-contributing States is fundamental in the compliance with the rule protecting human dignity during peacekeeping operations.

The essay focuses on the different legislative rules which allow seriously ill patients to legally receive euthanasia or assisted suicide in Europe to examine the Italian legislation currently being approved on the same matter from a comparative legal perspective. The research about such an ethical theme involving several fundamental principles, like human dignity, life and solidarity, analyses the approaches of the Belgian, Dutch, Luxembourg and Spanish legal systems. The study will shed light on the essentiality of some preventive safeguards to support patients' autonomy in consenting or refusing an end-of-life treatment, in line with the Italian Constitutional Court suggestions.

Following the XVIII century Declarations, rights have progressively occupied the whole space of legal, political and moral debate; with the UN's Declaration of Human Rights, the language of rights has been established as a universal ground for expressing human needs and claims, despite allegations of Western ethnocentrism. Rights are an indispensable tool for expressing the value of human dignity, because they allow right-holders to claim certain actions as due to them: they endow the individuals with a moral authority, the absence of which would dramatically impoverish moral (political, legal) discourse. However, 1) the abuse and uncontrolled proliferation of rights talk threatens such language with inflation. Moreover, 2) not all plausible moral concerns can be expressed in terms of rights, since rights presuppose an individualist anthropology and are particularly well-suited to situations in which individuals can be seen as both independent and equal: in situations where individuals depend on others and have little or no power of negotiation, values like respect and dignity cannot be adequately expressed by rights language. Finally, 3) if we reduce all moral discourse to rights talk, we are unable to ascribe the due importance to values like autonomy, which presuppose collective goods. A reasonable use of rights language would avoid such shortcomings, although this seems to conflict with the basic tenets of some so-called "right-based" ethical theories.
