Housing tenure structures differ considerably across OECD countries. Typically, the share of owner-occupied housing is very high in Southern European countries (Spain, Italy, Greece), while relatively low in Austria, Germany, France, the Netherlands and in some Nordic countries such as Sweden, Finland and Denmark (see Catte et al. [2004]). This share has increased in most OECD countries during last two decades. Italy, Spain, Portugal, the Netherlands and Belgium registered the largest increases from the eighties to the mid of the first decade of the century. In the UK, the homeonwership rate increased steadily up to 2005, then dropped sharply in the last few years. High homeownership rates and their increments have been in part determined by pro-ownership policies implemented throughout most OECD countries. Such policies can take the vest of tax reliefs for mortgage interest payments, exemptions for capital gains taxation applied to residential property, or generous subsidies for low-income families to reduce the costs of homeownership. Although the orientation of several governments, particularly in Europe, has been to promote homeownership, economists have raised several concerns about the consequences of large homeownership shares on the functioning of the labour market. The analysis of the relation between the housing tenure and the labour market dates back to mid-nineties, when Andrew Oswald pinned on high homeownership rates the blame for the high unemployment rates in Europe (Oswald [1996], Oswald [1997], Oswald [1999]). Making use of aggregate data, Oswald found a strong positive statistical association between the two rates at the international and regional level. Thus, his receipt to reduce unemployment was strikingly at odds with the prevailing political wisdom: "We can put Europe back to work . . . by reducing homeownership" (Oswald [1999])1. Oswald identified five mechanisms that drive the positive impact on unemployment. These are mostly related to the idea that the mobility constraints imposed by homeownership introduce frictions in the labour market which harm its efficiency. The first and most important, is a direct effect. Owner occupiers incur higher transaction costs for selling home and moving to a new accommodation, which can be even higher whenever capital gains for houses are taxed and there are no exemptions. The other four mechanisms can be thought as externalities of homeownership. Second, where the rental market is thin, everyone, regardless of the housing tenure, can have difficulties in finding the accommodation close to the job they aspire to, so that efficient job matches are hindered. This is the case even for mobile people who would be happy to move for job reasons, such as young still living in the family-home in a kind of free-rent status. Third, owning the accommodation hampers also job-to-job changes and prolong poor job matches hence harming the whole economic system efficiency. Fourth, owner-occupiers are more likely than renters to lobby for deterring entrepreneurs from investing in their residential area. Fifth, since owners commute much more than renters, and over longer distances, higher homeownership rates in the area lead to higher transport costs and possibly to congestion costs, which make getting to work more costly for everyone and act as a sort of unemployment benefits in increasing the relative attractiveness of not working. Although the argument underlying a positive relationship between homeownership and unemployment originates from macroeconomic evidence, its theoretical foundations are mainly microeconomic and a vast part of the empirical research carried out subsequently has been based on micro data. The typical test of the so-called "Oswald thesis" consists in estimating the homeownership effect on the duration of the unemployment spell or, less often, on the probability to be unemployed. The expected sign is positive, along the main idea that higher mobility costs due to property holding reduce the willingness to accept job offers which require a residential move. Fewer studies, and only recently, have focused on the employment duration, testing whether homeownership can reduce job finding rates also for people already employed. Generally, empirical tests on micro data find no support for the Oswald hypothesis, and in most cases even that homeowners have shorter unemployment spells and lower likelihood to be unemployed, which are exactly counter-Oswald results. However, homeownership seems to increase job stability by hampering job-to-job changes for people already employed. As regards unemployment outcomes, the existing literature has put forward two possible reasons for the falsification of the Oswald hypothesis. The first one looks at the different effect of mobility costs on job search behavior in the local and in the non-local labour market. In fact, homeowners may have higher reservation wages for jobs which require a residential move (nonlocal market), but also lower reservation wages for jobs which do not (local market), so that job finding rates for the latter may be as high as to offset the lower rates for jobs in a distant area. Thus, whether the total job finding rate is lower for homeowners or for renters is just an empirical matter which depends on the magnitude of these two opposite effects. The second explanation points out the need for a refinement in the definition of the residential status. On the one hand, one should distinguish between owners who have to comply with mortgage payments and outright owners, as housing financial commitments can bear higher pressure to return to work or to keep on with the current job. For mortgage-holders, these financial constraints can counteract the effect of the reduced mobility due to ownership. On the other hand, unemployment outcomes can be different also for private and social renters. In fact, below-market rent, long waiting lists, security of tenure and the restricted transferability within social housing, can harm the relative performance of social renters. In this work, we aim at investigating the validity of the "Oswald thesis" taking into account the recent refinements by following both a theoretical and an empirical approach. The focus will be on UK micro data. In particular, we will make use of the two leading UK Surveys, the UK Quarterly Labour Force Survey and the British Household Panel Survey. In the first chapter, we investigate the relation between job search effort of unemployed and housing tenure. We test this relation focusing on the impact of the UK Jobseeker's Allowance reform introduced in the UK in October 1996, whose main aspect was a strengthening of search requirements for eligibility to the unemployment benefit. We revisit a simple model of search in which we introduce moving costs and housing costs to capture the two channels through which the degree of attachment to the accommodation influences search behaviour. Our theory suggests that a tightening in job search requirements, as implied by this reform, raises movements off benefit of non-employed with low search intensity and that this effect should adjust in size depending on the different housing tenure. We draw a dataset from the Labour Force Survey for the period 1995-1997, and by means of a Difference-in-Differences approach we analyze the impact of the reform on the claimant outflow. Average Treatment Effect estimates suggest that the impact of the reform is related to housing tenure. Specifically, renters account for a major portion of claimants who were crowded out of the benefit without finding a job, while the effect on outright owners and mortgagers is lower. Empirical evidence from our dataset clearly confirms that mortgagers search for a job more intensively than renters, as our model predicts. This latter finding is consistent with a higher estimated treatment effect for renters, since a high initial search intensity seems the key to insulate oneself from the impact of the tightening of search requirements. In the second chapter we attempt to reconcile the empirical evidence with the argument in favour of a negative effect of homeownership on exit rates from unemployment. Taking into account some likely reasons for the falsification of the Oswald's thesis, we provide evidence which supports it. At first, in a theoretical model of endogenous job search adapted to distinguish between local and non-local labour markets, we show that homeowners higher moving costs imply unambiguously lower search and lower job finding rates, even though an opposite effect works for jobs which do not require a move. Then, in the empirical analysis we make use of data drawn from the British Household Panel Survey to compare job search intensity measures by housing tenure. In defining the residential status, we distinguish between outright owners and mortgage-holders, and between social and private renters. We find that, controlling for housing costs and for the four-fold tenure definition, non-employed outright owners have definitely a lower attachment to the labour market than renters, and that this effect is even more evident when we compare them to private renters. In the third chapter, we analyse the impact of the housing tenure on labour market outcomes using individual data from the UK labour Force Survey. We estimate both a binary model for the probability to be unemployed and a hazard model for exits out of unemployment. In both models we test for endogeneity of housing tenure. In the binary model, exogeneity is rejected so we perform endogenous multinomial treatment effects estimates. In the hazard model, we find no evidence of unobserved heterogeneity thus estimates are performed assuming exogeneity. Results show that mortgagers have the lowest probability to be unemployed and the highest job finding rates, while social renters exhibit the worst performance. Whether private renters perform better than outright owners is a matter of debate: while we have no evidence in favour of this claim, the evidence in favour of the opposite is only modest.
Oggetto della ricerca è stato lo studio e l'analisi del sistema dell'editoria d'arte contemporanea nella Milano degli anni trenta, a partire da una mappatura della produzione libraria specializzata uscita lungo il decennio di cui si sono messe a fuoco forme, meccanismi e protagonisti. Il lavoro ha avuto una frase preliminare di individuazione dei materiali di studio, di strutturazione dell'ambito e dei campi di ricerca, in una prospettiva storiografica sostanzialmente inedita, al confine tra la storia dell'arte e dell'editoria, in cui si intrecciano le dinamiche della promozione artistica e del suo consumo, del mercato editoriale e della filiera del libro. Le peculiarità dell'edizione d'arte, dal suo profilo materiale al pubblico a cui è indirizzata, ne fanno un prodotto con caratteristiche e problematiche distinte nel quadro allargato dell'industria editoriale. Tale specificità negli anni trenta si innesta in un dibattito cruciale sull'identità dell'arte contemporanea, prefigurando un quadro storico nuovo rispetto al periodo precedente in cui si assiste alla significativa fioritura di iniziative editoriali inedite tese alla codificazione e divulgazione dei valori della cultura figurativa del presente. L'intero studio si è fondato sulla mappatura sistematica delle pubblicazioni date alle stampe tra il 1929 e il 1943 – arco cronologico individuato come il più congruente ai fini dell'indagine – condotta sulla base dell'analisi di fonti d'epoca specializzate quali guide bibliografiche, bollettini, cataloghi di vendita dei libri, nonché i registri di carico delle biblioteche di settore. Il recupero, l'esame diretto e la schedatura delle singole edizioni attraverso parametri specifici, messi a punto tenendo conto della natura del libro d'arte e in particolare della centralità delle fotoriproduzioni nella filiera produttiva, ha portato alla realizzazione di un database, confluito in un repertorio organizzato in schede tecniche e indici delle presenze editoriali. I risultati scaturiti da questo ampio censimento hanno orientato la ricerca verso i grandi nodi del sistema produttivo, dei generi letterari emergenti e dei procedimenti di riproduzione e di stampa delle immagini, tra teoria e agganci ai testi, alle fonti a stampa e alla documentazione d'archivio, allargando il complessivo campo di indagine a una comparazione con la rispettiva produzione editoriale italiana e straniera coeva. La tesi si articola dunque in tre grandi parti, introdotte da un tentativo di definizione delle forme del libro d'arte contemporanea e da una verifica dell'andamento della produzione editoriale. Quest'ultima ha messo in luce l'esistenza di una periodizzazione interna agli estremi cronologici legata a doppio filo a una molteplicità di dinamiche in atto che incidono in modo diretto sull'editoria di settore, tra le quali il consolidamento di un nuovo collezionismo, i contestuali svolgimenti sul piano della politica delle arti e i progressi tecnici dell'industria grafica sono solo alcune delle più eloquenti. L'analisi del sistema editoriale si è rivolta anzitutto a definirne gli attori, vale a dire le figure direttamente coinvolte nella filiera produttiva, restituendo per la prima volta una mappa strutturata degli editori, dei fotoincisori, dei tipografi e stampatori. Tra le prerogative del settore spicca infatti la frammentazione dei soggetti imprenditoriali dovuta all'elevato standard di specializzazione richiesto dal libro illustrato, alla cui realizzazione concorrono necessariamente professionalità diverse. A monte, nel panorama degli editori è emersa una sensibile diversificazione tradotta in una sostanziale permeabilità al tessuto delle gallerie e del mercato e a quello delle riviste, permettendo di riconsiderare luoghi che per la storiografia vivono separati. Spostando l'obiettivo sulla produzione editoriale, ovvero sui libri oggetto d'indagine, si sono discusse le problematiche connesse alle forme della divulgazione dei nuovi valori figurativi, a fronte di un processo mobile teso a una loro compiuta definizione. Una prospettiva aderente alla mappatura, che facesse leva su uno sguardo d'insieme e sui molteplici aspetti del prodotto librario considerati nella ricerca, ha inteso mettere a fuoco i generi emergenti, dal libro-catalogo, al panorama, alle collane di monografie d'artista, riflettendo sulla loro fortuna, tra scarti, continuità ed elementi innovativi, anche attraverso un confronto con i modelli internazionali. Una parte centrale del lavoro è stata dedicata, infine, alla disamina dei diversi procedimenti fotomeccanici di riproduzione e di stampa impiegati nella realizzazione dei libri, un problema nodale, connaturato alle specificità stesse dell'editoria d'arte – fondata sulle riproduzioni e sulla loro mise en page – che tuttavia, allo stato degli studi, risulta sostanzialmente trascurato dalla storiografia. Attente alle attrezzature tecniche, ai passaggi di lavorazione e ai risultati grafici, le ricerche svolte hanno confermato il valore di questo filone di indagine, mettendo in luce il peso che negli anni trenta le innovazioni tecnologiche nel settore hanno giocato nel determinare non solo la fisicità e la grammatica delle immagini, e dunque la ricezione dell'arte, ma le stesse forme editoriali. Novità significative sono emerse, in particolare, in relazione alla riproduzione a colori e ai suoi rinnovati sistemi in rapida ascesa commerciale, come il fotocolor, di cui è stata ricostruita la prima diffusione. Il repertorio finale delle schede tecniche delle singole pubblicazioni, integrato da indici ed elenchi, tra cui i cataloghi completi delle collezioni editoriali, è presentato in appendice. ; The research aimed at studying and analysing the contemporary art publishing system in Milan during the Thirties, on the basis of a mapping of the specialised book production with a major focus on its forms, mechanisms and leading figures. The work spanned a preliminary phase designed to identifying the study materials, to defining the research boundaries and fields in a quite unusual historiographical perspective, poised between history of art and publishing, on a ground where the dynamics related to the artistic promotion and its consumption, to the publishing market and to the book production chain are mutually intertwined. Because of their peculiarities, such as the material profile as well as the target audience, art books prove to be products with distinct features and issues within the publishing industry. In the Thirties, such specificity interact with a crucial debate on the identity of contemporary art, prefiguring a new historical context characterised by the unprecedented development of editorial initiatives aimed at the codification and dissemination of the values of the current figurative culture. The entire study was based on the systematic mapping of publications issued between 1929 and 1943 – a chronological arc identified as the most congruent for the purposes of the investigation – carried out according to the analysis of coeval sources, such as bibliographic guides and bulletins, book sales catalogues, specialised libraries records. The evaluation and cataloguing of each editions took into account specific parameters selected depending on the nature of art books and more specifically considering the central role of photomechanical reproductions in the production chain. All information was gathered in a database converted into an organised repertory with technical entries and indexes of editorial presences. The results of this broad census led the research considering the great issues of the productive system, the emerging literary genres, and the reproduction and printing processes of images, making references to theory as well as to texts, printed and archive sources, until broadening the field of investigation to include a comparison with the related Italian and foreign coeval publishing. The thesis is thus divided into three main parts, introduced by an attempt to define the forms of contemporary art books and by a check of the performance of editorial production. This section shed light on an existing periodization within the chronological extremes closely intertwined with a wide variety of ongoing dynamics directly affecting the publishing sector, among which the consolidation of a new collecting, the contextual developments in the field of art politics and the technological advances of the graphic industry are just some of the most relevant. The analysis of the publishing system chiefly looked to define the players, actually the figures personally involved in the production chain, thus outlining for the first time a structured map of publishers, photoengravers, typographers and printers. In fact, among the prerogatives of the sector, one which undoubtedly stands out is the fragmentation of the entrepreneurial figures ascribable to the high specialization standards which illustrated books require and to the creation of which contribute multiple professional profiles and skills. The panorama of the publishers itself revealed a remarkable diversification corresponding to a consistent permeability to the context of the galleries and the art market as well as to the context of magazines, thus making it possible to reconsider places which according to historiography live apart. Shifting the goal to the publishing production, namely to the books object of the investigation, the work addressed the issues related to the forms of dissemination of new figurative values, in response to the coeval ongoing process aiming at their accomplished definition. In keeping with the mapping, and tapping into a comprehensive overview and a wealth of aspects typical of the product book considered in the research, the perspective aimed at highlighting the emerging genres, such as the book-catalogue, the panorama, the series of artist monographs, while reflecting on their fortune, among gaps, drifts, continuity and innovative elements, also based on a comparison with international models. Finally, a key part of the work consisted in examining the photomechanical reproduction and printing processes employed in the production of books: a crucial issue inherently belonging to the specificity of art publishing – based on reproductions and their mise en page – that, however, appears largely overlooked by historiography. Mindful of the technical equipment, the processing steps and the graphic results, the research carried out confirmed the value of this investigation line, while shedding light on the role that the technological innovations achieved in the Thirties played not only in determining the materiality and grammar of images, and hence the reception of art, but the very publishing forms. Significantly new features emerged, in particular, in relation to the colour reproduction and its renovated, quickly booming commercial systems, such as fotocolor, whose first diffusion this work retraced. The appendix presents the final catalogue of books entries as well as indexes and lists, including the complete listing of publishing series.
Dottorato di ricerca in Storia e cultura del viaggio e dell'odeporica in età moderna ; Expedition into Sicily di Richard Payne Knight, il testo argomento della presente tesi di dottorato, è il resoconto del viaggio svolto in Sicilia, sul finire del diciottesimo secolo, da un ricco inglese accompagnato da due altrettanto benestanti acquarellisti: il noto paesaggista tedesco Philipp Hackert e il ricco dilettante inglese Charles Gore. Creduto perso per più di due secoli, il manoscritto di Knight fu ritrovato soltanto nel 1980 e pubblicato nella sua interezza per la prima volta nel 1986. Scopo del mio lavoro di tesi è far conoscere quest'opera - a lungo considerata come 'minore' - al pubblico italiano attraverso una traduzione critica e metterne in luce l'originalità così come la coerenza interna. Rifacendomi agli studi di chi mi ha preceduto, ho infatti cercato di dimostrare la sostanziale unitarietà del testo, insieme al fatto che tale unitarietà avesse lo scopo di veicolare un messaggio ben preciso: la libertà è condizione necessaria per l'eccellenza umana. Si tratta di un messaggio di chiara matrice illuminista: il giovane Knight – illuminista convinto – legge il suo viaggio attraverso la Sicilia classica come un ritorno alle origini della cultura occidentale, un viaggio a ritroso nel tempo fino all'ideale Winkelmaniano di nobile semplicità e quieta grandezza. Il suo ritorno alle origini è però ostacolato dalla realtà della Sicilia del diciottesimo secolo. L'esperienza del presente va insinuandosi progressivamente nella sua concezione di un passato ideale, imponendo allo sguardo attento di Knight una realtà fatta d'ignoranza e miseria. Queste condizioni sono state portate dall'azione di una classe dirigente e di un clero troppo potenti e corrotti e quindi, in ultima analisi, dalla mancanza di libertà. Nei passaggi della Expedition che descrivono le sue esperienze di viaggio (che caratterizzano almeno due terzi del testo), Knight analizza questa dicotomia tra passato e presente e infine, nella parte finale, dà una forma più generale alle sue idee, fino a giungere alla conclusione che la Sicilia moderna potrebbe tornare alla grandezza delle origini soltanto in seguito a un moto rivoluzionario che coinvolgesse l'intera Europa. E' interessante notare come queste riflessioni precedano di pochi anni la Rivoluzione Francese che però, pur avendo alterato profondamente gli equilibri europei, non fu sufficiente per far emergere la Sicilia dalla sua arretratezza. Il primo capitolo della tesi riporta la traduzione integrale in italiano della Expedition into Sicily con testo inglese a fronte. Il secondo capitolo: L'autore, l'argomento e la storia del manoscritto, è suddiviso in due sezioni. La prima sezione [2.1]: Notizie sulla vita e le opere di Richard Payne Knight, si propone di inquadrare la figura dell'autore del diario e fornire una panoramica sulle sue opere, mentre la seconda sezione [2.2]: Il lungo viaggio di un diario di viaggio ricostruisce, sulla base di dati oggettivi e congetture, la genesi e la storia del manoscritto della Expedition. Il terzo capitolo: Il contesto del viaggio di Knight, tratta del contesto socio-culturale in cui si è svolto il viaggio in Sicilia ed è composto da cinque sezioni. La prima sezione [3.1]: Il contesto storico: dall'Inghilterra alla Sicilia, descrive brevemente la situazione storico-politica dell'Europa, dell'Inghilterra, dell'Italia e della Sicilia in pieno periodo di rivoluzione industriale e dopo la Pace di Utrecht. La seconda sezione [3.2]: Il contesto filosofico: l'Illuminismo inglese e il pensiero di Knight, traccia le linee generali dell'Illuminismo europeo, inglese e italiano che influenzarono Knight prima, e durante e dopo il viaggio in Sicilia. La terza sezione [3.3]: Il contesto artistico: alla riscoperta dei classici tra luci ed ombre, fornisce cenni sul contesto culturale e artistico sia europeo che inglese di quegli anni, soffermandosi in modo particolare sugli autori che svilupparono teorie per definire tali stili. La quarta sezione [3.4]: Il problema del tempo nel Settecento, tratta del dibattito scientifico sul significato e sull'età dei fossili collegato, a sua volta, a quello dell'età della Terra. Si tratta del principale dibattito scientifico del Settecento ed influenza l'idea del tempo, della storia e della geologia di Knight. La quinta sezione [3.5]: Il Grand Tour nella seconda metà del Settecento, presenta una panoramica sulle condizioni logistiche del viaggio in Italia e le motivazioni dei Grand Tourists. Il quarto capitolo: L'analisi del testo e il pensiero di Knight, si suddivide in due sezioni. La prima sezione [4.1]: Analisi del testo, ripercorre brevemente le tappe del viaggio di Knight, approfondisce le scene del diario che si rifanno al pittoresco letterario ed ai caratteri sociali dei siciliani e traccia le conclusioni finali del viaggio. La seconda sezione [4.2]: Gli stereotipi sull'Italia, discute la posizione di Knight su alcuni luoghi comuni che i viaggiatori del suo tempo avevano sugli italiani ed, in particolare, sui siciliani. Infine, aspetti di non stretta attinenza con l'argomento del presente lavoro, ma da me trattati in altra sede, hanno incontrato l'interesse e l'epprezzamento della comunità scientifica internazionale. Si tratta, in particolare, dello studio presentato a Malta in occasione del convegno Encountering Malta: British Writers and the Mediterranean 1760-1840 (novembre 2011), in cui ho proposto un'interpretazione originale del pensiero storico di Knight, collegandolo con quello del noto storico inglese suo contemporaneo Edward Gibbon. Il lavoro è stato accettato per la pubblicazione dalla rivista The Wordsworth Circle. ; Expedition into Sicily by Richard Payne Knight, the text subject of this PhD thesis, is the account of the journey through Sicily taken, at the end of the Eighteenth Century, by a rich Englishman, together with two equally wealthy watercolorists: the renowned German landscape painter Philipp Hackert and the English amateur Charles Gore. Believed lost for more than two centuries, Knight's manuscript was rediscovered only in 1980, and published for the first time in English in 1986. Aim of my thesis is to introduce this work to the Italian audience through a critical translation, and to point out its originality as well as its internal coherence. Referring to the studies of those who preceded me, I have tried to demonstrate the substantial unity of the text, along with the fact that this internal consistency was intended to convey a very precise message: freedom is a necessary condition for human excellence. This is a message clearly influenced by Enlightenment culture: the young Knight saw his journey through Sicily as a return to the classical origins of Western culture, a journey back in time to the Winkelmanian ideal of noble simplicity and quiet grandeur. His return to the origins, however, was hampered by the reality of Eighteenth Century Sicily. The experience of the present crept gradually into his conception of an ideal past, imposing to his watchful eye a reality of ignorance and misery. These dramatic conditions had been brought by a corrupted ruling class and a too powerful clergy, in other words by a lack of freedom. In the analysis of the scenes depicting his travel experiences (featuring at least two thirds of the text), Knight examines the dichotomy between past and present, and finally, in the end, he gives a more general form to his ideas, coming to the conclusion that Sicily could return to the greatness of its origins only after a revolutionary movement involving the whole of Europe. It's interesting to note that these reflections preceded of a few years the French Revolution, which, despite having profoundly altered the European balance, was not enough to bring out the Sicily from its backwardness. The first chapter of the thesis contains the complete translation of the Expedition into Sicily in Italian with the English text opposite. The second chapter: The author, the topic, and the history of the manuscript, is divided into two sections. The first section [2.1]: The life and works of Richard Payne Knight, intends to frame the figure of the author of the diary and provide an overview of his works, while the second section [2.2]: The long journey of a travel diary reconstructs, on the basis of objective data and conjectures, the genesis and history of the manuscript of the Expedition. The third chapter: The context of Knight's trip, traces the socio-cultural context of the trip to Sicily and is composed of five sections. The first section [3.1]: The historical context: from England to Sicily, briefly describes the historical and political situation of Europe, England, Italy and Sicily at the height of the Industrial Revolution and after the Peace of Utrecht. The second section [3.2]: The philosophical context: the English Enlightenment and the thought of Knight, traces the general lines of the European, English and Italian Enlightenment that influenced Knight before, during and after his trip to Sicily. The third section [3.3]: The artistic context: the rediscovery of classics between lights and shadows, provides an outline of the cultural and artistic contexts of the second half of the Eighteenth Century, focusing in particular on the authors who developed theories to define concepts like Beauty, Picturesque and Sublime. The fourth section [3.4]: The problem of time in the Eighteenth Century, focuses on the scientific debate on the significance and the age of fossils, which is linked, in turn, to the age of the Earth. This was the main scientific debate of the Eighteenth Century and it influenced Knight's ideas on time, history and geology. The fifth section [3.5]: The Grand Tour in the second half of the of the Eighteenth Century, presents an overview of the logistical conditions of travel in Italy and the motivations of the Grand Tourists. The fourth chapter: The analysis of the text and of Knight's thought, is divided into two sections. The first section [4.1]: Text Analysis, briefly reviews the stages of Knight's journey, discusses the scenes of the Expedition referring to the literary picturesque and to the social characteristics of Sicilians and, finally, draws the final conclusions of the trip. The second section [4.2]: The stereotypes about Italy, discusses Knight's position on some clichés that the travelers of his time had on Italians and, in particular, on Sicilians. Finally, aspects not strictly relevant to the topic of this work, which I have treated elsewhere, have met the interest and appreciation of the international scientific community. This is, in particular, the study presented at the conference in Valletta Encountering Malta: British Writers and the Mediterranean 1760-1840 (November 2011), in which I have proposed an original interpretation of Knight's historical thought, connecting it with that of the English historian Edward Gibbon's. The work has been accepted for publication by the journal The Wordsworth Circle.
In Giangastone Bolla's Program for the Review of Agricultural Law (1922) land ownership was a testing ground for the «modern transformations of property law» – on which Enrico Finzi – primarily with the «social function». Bolla observed the shift from ownership to the company; asserted that the link between agriculture and the state required the scholar of agricultural law to undertake the «social and economic reconstruction of the country». In view of the «social function» Arrigo Serpieri – since 1923 Undersecretary of State for Agriculture – promoted various legislative measures for the «integral reclamation»; the policy for agriculture was linked to the organization of the corporate state in fieri (Brugi, Arcangeli). The 1933 Consolidated Law (TU) aimed at the rehabilitation of the land to increase its productivity and improve the conditions of the peasants with land transformations of public interest, with possible expropriation of large estates and forced execution of reclamation works on private lands; from 1946 the Consolidated Law of 1933 will be considered an indication for the agrarian reform (Rossi Doria, Segni). In the first Congress of Agricultural Law, (Florence 1935), Maroi, Pugliatti, Serpieri, D'Amelio, Bolla, Ascarelli, Calamandrei discussed some issues, in the first place agricultural law as a factual experience, linked to rural life, irreducible to a uniform juridical order; hence the 'long duration' of the Jacini Report on the various agricultural Italy. In view of the civil codification, the jurists noted the insufficiency of the individualistic system; placed the request for rules focused on the good and not on the subjects, up to the overcoming of the distinction between public and private law. The most illustrious Italian jurists intervened in the volume promoted by the Confederation of agricultural workers; The Fascist conception of property expressed the detachment from the liberal conception – with an emphasis on land ownership based on work (Ferrara, Panunzio) – and held firm to private initiative (Filippo Vassalli). Bolla reiterated the particularity of land ownership between the corporate system and the civil code project, «a private institution, aided and regulated by the State», with the owner «moderator et arbiter» of his own initiative. In the civil code of 1942, land ownership made sense of the dynamic aspect of productive activity, without contemplating the «social function» as a «new property right» (Pugliatti, Vassalli, D'Amelio).After the fall of the fascist regime, the struggles in the countryside forced Minister Gullo to plan agrarian contracts and regulate the occupation of uncultivated lands, with multiyear concessions to the occupying peasants; the De Gasperi award compensated the sharecroppers. The different economies of the 'different agrarian Italy' did not recommend a uniform agrarian reform; the reorganized political parties aimed at the distribution of expropriated lands, compensation to the private owner, without damaging the right of ownership. The initial action of the State to erode the large estates, with special reform bodies, had as its purpose the enhancement of small peasant property (Segni, Bandini). To combine private property and social interest in Constitution, Mortati motivated his proposal for a «constitutional statute»; Fanfani asked for «an article that speaks expressly of the land». The large estate was the most urgent but divisive issue, between Di Vittorio, who asked for its «abolition», and Einaudi for its «transformation», a choice that was imposed in the name of the various 'rural Italy'; the proposal for a rule intended to hinder large landholdings was not accepted. Article 44 of the Constitution provided for a law to impose «obligations and constraints on private land ownership», in order to «achieve rational land use and fair social relations». Bolla appreciated the choice of «transforming individual property into social property»; Vassalli wrote about a non-original «handbook for resolving the agrarian problem». In the project of the Minister for Agriculture Segni – who managed to launch a contested agrarian reform – art. 44 dictated tasks to the «future legislator»; the Sila law of 21 May 1950, the excerpt law of 21 October 1950 for particularly depressed areas, the bills on agricultural contracts were discussed in the Third Congress of Agricultural Law and in the first International Conference, promoted by Bolla, with interventions by Bassanelli, Segni, Capograssi, Pugliatti, Santoro Passarelli, Mortati, Esposito. Work was considered the architrave of land ownership, «a continually changing right, which must be modeled on social needs» (Bolla). In this context, the theoretical-practical, juridical-political reflection of Mario Bracci, professor of administrative law in Siena, rector, also in charge of teaching agricultural law, is interesting. Representative of the PdA at the National Council in the Agriculture Commission, Bracci proposed to write a «book on the socialization of the land», never published; the personal archive offers a wealth of notes previously unpublished on the subject. Bracci defined land ownership as the lintel of agricultural law and a crossroads of private and public law, between land reclamation laws, civil codification, art. 44 of the Constitution, the agrarian reform, understood as a «problem of justice». From Fascism tothe Republic, Bracci grasped technical continuities and ideological discontinuities in the structure of landed property, considered to be of constitutional significance, in referring to the person, «the conditions of the person are inextricably linked to those of landed property». As a scholar and professor of administrative law and agricultural law, since July 1944 Bracci intended to respond to the conflict in the countryside, mediating between «public purposes of agricultural production and the needs of social justice»; proposed «adequate legal forms which are forms of public law». ; Nel Programma di Giangastone Bolla per la Rivista di diritto agrario (1922) la proprietà fondiaria era banco di prova delle «moderne trasformazioni del diritto di proprietà» – su cui Enrico Finzi – in primo luogo con la «funzione sociale». Nell'azienda agraria Bolla osservava inoltre lo spostamento dalla proprietà all'impresa; asseriva che il legame tra l'agricoltura e lo Stato imponeva allo studioso del diritto agrario l'impegno per la «ricostruzione sociale ed economica del paese». In vista della «funzione sociale» Arrigo Serpieri – dal 1923 sottosegretario di Stato all'Agricoltura – promuoveva diversi provvedimenti legislativi per la «bonifica integrale»; la politica per l'agricoltura si legava all'organizzazione dello Stato corporativo in fieri (Brugi, Arcangeli). Il Testo unico del 1933 mirava al risanamento della terra per aumentarne la produttività e migliorare le condizioni dei contadini con trasformazioni fondiarie di pubblico interesse, con possibili espropri di latifondi ed esecuzione coatta di lavori di bonifica su terre private; dal 1946 il Testo unico del 1933 sarà considerato una indicazione per la riforma agraria (Rossi Doria, Segni). Nel primo Congresso di diritto agrario, (Firenze 1935), Maroi, Pugliatti, Serpieri, D'Amelio, Bolla, Ascarelli, Calamandrei discutevano alcune questioni, in primo luogo il diritto agrario come esperienza fattuale, legato alla vita rurale, irriducibile ad un ordine giuridico uniforme; da qui la lunga durata della 'fortuna' dell Relazione Jacini sulle diverse Italie agrarie. In vista della codificazione civile, i giuristi rilevavano l'insufficienza dell'impianto individualistico; ponevano l'istanza di norme incentrate sul bene e non sui soggetti, fino al superamento della distinzione tra diritto pubblico e privato. I più illustri giuristi italiani scrivevano nel volume promosso dalla Confederazione dei lavoratori dell'agricoltura; La Concezione fascista della proprietà esprimeva il distacco dalla concezione liberale – con l'accento sulla proprietà della terra fondata sul lavoro (Ferrara, Panunzio) – e teneva ferma l'iniziativa privata (Filippo Vassalli). Bolla ribadiva la particolarità della proprietà fondiaria tra ordinamento corporativo e progetto del codice civile, «istituto a base privata, aiutato e disciplinato dallo Stato», con il titolare «moderator et arbiter» della propria iniziativa. Nel codice civile del 1942 la proprietà fondiaria aveva senso dell'aspetto dinamico dell'attività produttiva, senza contemplare la «funzione sociale» come «nuovo diritto di proprietà» (Pugliatti, Vassalli, D'Amelio).Dopo la caduta del regime fascista le lotte nelle campagne imponevano al ministro Gullo di progare i contratti agrari e regolare l'occupazione delle terre incolte, con concessioni pluriennali ai contadini occupanti; il lodo De Gasperi indennizzava i mezzadri. Le differenti economie delle 'diverse Italie agrarie' sconsigliavano una riforma uniforme (Rossi Doria, Serpieri); i riorganizzati partiti politici miravano alla ripartizione delle terre espropriate e ad indennizzi al proprietario privato, senza lesioni del diritto di proprietà. L'iniziale azione dello Stato ad erosione del latifondo, con appositi Enti di riforma, aveva per scopo la valorizzazione della piccola proprietà contadina (Segni, Bandini). Per coniugare proprietà privata ed interesse sociale nella Costituzione Mortati motivava la sua proposta di «statuizione costituzionale»; Fanfani chiedeva «un articolo che parli espressamente della terra». Il latifondo era la questione più urgente ma divisiva; Di Vittorio ne chiedeva l'«abolizione » ed Einaudi la «trasformazione», scelta che si imponeva in nome delle diverse 'Italie rurali'; non si recepiva la proposta di una norma intesa ad ostacolare le grandi proprietà terriere. L'articolo 44 della Costituzione prevedeva una legge a imporre «obblighi e vincoli alla proprietà terriera privata», al fine di «conseguire il razionale sfruttamento del suolo ed equi rapporti sociali». Bolla apprezzava la scelta di «trasformare la proprietà individuale in proprietà sociale»; Vassalli scriveva di un non originale «prontuario di risoluzione del problema agrario». Nel progetto del Ministro per l'agricoltura Segni – che riusciva a far varare una contrastata riforma agraria – l'art. 44 dettava compiti al «legislatore futuro»; la legge Sila 21 Maggio 1950, la legge stralcio del 21 Ottobre 1950 per le zone particolarmente depresse, i progetti di legge sui contratti agrari erano discussi nel Terzo congresso di diritto agrario e nel primo Convegno internazionale, promosso da Bolla, con interventi di Bassanelli, Segni, Capograssi, Pugliatti, Santoro Passarelli, Mortati, Esposito. Il lavoro era considerato l'architrave della proprietà della terra, «diritto continuamente cangiante, che deve modellarsi sui bisogni sociali» (Bolla). In questo quadro è interessante la riflessione teorico-pratica, giuridico-politica di Mario Bracci, docente di diritto amministrativo a Siena, rettore, incaricato anche dell'insegnamento di diritto agrario. Rappresentante del PdA alla Consulta nazionale nella Commissione agricoltura, Bracci si proponeva di scrivere un «libro sulla socializzazione della terra», mai pubblicato; l'Archivio personale offre una mole di appunti finora inediti sul tema. Bracci collocava nella storia la proprietà della terra, che aveva senso nel «lavoro»; la definiva architrave del diritto agrario e crocevia di diritto privato e pubblico, tra le leggi di bonifica, la codificazione civile, l'art. 44 della Costituzione, la riforma agraria, intesa come «problema di giustizia». Dal fascismo alla Repubblica Bracci coglieva continuità tecniche e discontinuità ideologiche nell'assetto dell'istituto di rilevanza costituzionale, «le condizioni della persona sono indissolubilmente legate a quelle della proprietà fondiaria». Da studioso e docente di diritto amministrativo e diritto agrario dal luglio 1944 Bracci intendeva rispondere al conflitto nelle campagne, mediando tra «fini pubblici della produzione agraria e le esigenze della giustizia sociale»; proponeva «forme giuridiche adeguate e che sono forme di diritto pubblico».
RIASSUNTO TESI Il concetto della performance, della sua misurazione, gestione e controllo, accanto a quelli di efficienza, trasparenza, accountability e responsabilità, rappresentano gli elementi fondanti la dottrina del New Public Management e in quanto tali sono stato oggetto di studi accademici e analisi da parte dei professionisti del settore pubblico. La crisi economica dei primi anni '90, le sue implicazioni e le conseguenti tensioni politiche hanno aumentato l'interesse dei governi e parlamenti italiani, che si sono susseguiti, sulle problematiche dell'aumento incontrollato della spesa e del debito pubblico. La conseguenza immediata di questa nuova attenzione, anche per le nuove esigenze di bilancio derivanti dal processo di adesione all'Unione Europea, è stata un incremento della produzione legislativa. In questo contesto gli interventi legislativi, a partire in primo luogo dalla legge n. 142 del 1990, hanno avuto tutti il medesimo filo conduttore, ovvero l'obiettivo di realizzare in concreto il disegno costituzionale di articolazione del governo centrale nei suoi livelli territoriali, quali Comuni, Province e Regioni (queste ultime previste successivamente nel 1970, operative con il d.P.R. n 616/77). I governi e i parlamenti hanno incentrato la loro azione legislativa su interventi finalizzati a favorire il decentramento amministrativo e l'autonomia locale, dapprima solo statutaria e regolamentare, poi anche impositiva, finanziaria e gestionale. L'attenzione nei confronti della programmazione dell'attività amministrativa locale, e successivamente anche sulle prestazioni pubbliche, è aumentato contestualmente al crescere delle esigenze informative dei cittadini sulle modalità di utilizzo delle scarse risorse pubbliche (derivanti in grande parte dal gettito fiscale), al fine di poter garantire i servizi essenziali alla collettività. Gli organi di indirizzo politico – amministrativo orientano la gestione tramite il complesso di decisioni ed azioni organizzative che seguono le linee di indirizzo generali (D.Lgs 165/2001), la definizione di piani, programmi e direttive generali. L'oggetto della Legge n. 150 del 2009 (c.d. riforma Brunetta) è la performance della pubblica amministrazione, la performance organizzativa ed individuale dei dipendenti pubblici. Quest'ultima in particolare è un tema sensibile nel dibattito pubblico, spesso con un'accezione negativa nell'opinione pubblica. A seguito dei più recenti interventi in materia di armonizzazione contabile, si è ritenuto fosse necessario e interessante avviare una riflessione sul complessivo sistema di programmazione e controllo della performance negli enti locali allo scopo di sviluppare un modello della performance integrato. In questo senso, la presente tesi di dottorato si è concentrata sugli strumenti a disposizione degli enti locali italiani per la programmazione, la misurazione e la gestione della performance, partendo dai primi dettati legislativi in materia di programmazione e controllo, analizzando successivamente quanto introdotto dal D.Lgs 150/09 e più recentemente dal D.Lgs 118/2011, al fine di giungere allo sviluppo di uno strumento che rispondesse alle principali esigenze informative in materia di performance della PA locale. A questo scopo, inizialmente è stata effettuata un'analisi della letteratura, il più completa possibile, sul concetto della performance e della sua misurazione, sottolineando i benefici e gli effetti inaspettati delle misure di performance, i limiti e la differenze esistenti tra misurazione e gestione della performance. La trattazione successivamente si concentrerà sull'illustrazione dei concetti di indicatori e misure di performance, dal punto di vista delle caratteristiche e differente principali, oltre che dell'utilità, dei possibili usi ed utilizzatori dell'informazione di performance (ad esempio: decision-makers, politici e cittadini). L'analisi del background teorico sarà finalizzata alla descrizione del complessivo contesto del tema della performance tramite i) il contesto internazionale del settore pubblico e ii) le dinamiche della performance delle pubbliche amministrazione. Il contesto specifico di rifermento è quello degli enti locali italiani, 1) descritto nei suoi aspetti normativi e dottrinali in termini di programmazione, performance, pianificazione e gestione della performance nonché di armonizzazione contabile e di controllo, con particolare riferimento ai controlli interni, e 2) analizzato con riferimento a principi, criteri, obiettivi e strumenti pluriennali ed annuali che ogni ente è tenuto e può utilizzare per poter al meglio pianificare, programmazione e controllare le proprie prestazioni di breve, medio e lungo termine. Una volta delineato il background teorico si procederà alla descrizione di un'ipotesi di piano integrato della performance, sotto il punto di vista del processo di sviluppo e degli strumenti, con l'evidenziazione di punti di forza, possibili benefici, ma anche dei limiti e delle questioni non affrontate o che rimangono senza una risposta efficace. A titolo di approfondimento verrà presentato un caso di studio per evidenziare come un sistema integrato di performance possa essere considerato un sistema di governance amministrativa. La definizione del modello è stato guidata da due principi guida: i) semplificazione del contesto e ii) riduzione della complessità degli strumenti. Il tutto, in una prospettiva di possibile futura applicazione pratica all'interno degli enti locali italiani di piccole dimensioni. Tali enti sono caratterizzati da strutture organizzative con un minor grado di complessità, minori risorse economiche, finanziarie, strumentali ed umane, rispetto ad enti di maggiori dimensioni. Per queste ragioni, questi enti rappresentano un miglior contesto in cui adottare uno strumento di pianificazione e programmazione semplice e chiaro che possa aggiungersi agli altri adempimenti previsti per legge, senza appesantire troppo la gestione amministrativa. Se da un lato il modello proposto ha il vantaggio di riunire in un unico documento gli elementi di pianificazione e programmazione della performance strategica con collegamenti chiari e diretti ai documenti di programmazione pluriennali dell'intera attività amministrativa degli enti (DUP) e a quelli di gestione amministrativa e di bilancio (PEG), dall'altro potrebbe incorrere nel rischio di recepimento dello stesso come mero elemento formale, senza un'utilità sostanziale. Lo strumento ipotizzato permette, da un lato, di rispondere a quanto previsto dalla riforma del 2009 e con i dettati derivanti dal processo di armonizzazione contabile, ma, dall'altro, potrebbe contribuire a creare confusione, soprattutto all'interno di quegli enti locali con competenze limitate e risorse inadeguate all'utilizzo di strumenti innovativi per la gestione strategica e dell'intero ciclo di programmazione e controllo A questi punti possono e devono essere aggiunte riflessioni in merito alle modalità di trasmissione, gestione e comunicazione dell'informazione di performance oltre che di conciliazione e sintesi con i processi di decentramento amministrativo, di sviluppo ed affermazione dell'autonomia locale, nel nuovo quadro dei vincoli finanziaria, economici ed istituzionali nazionali e comunitari. THESIS SUMMARY Performance, performance measurement, management and control, alongside the concepts of efficiency, transparency, accountability and responsibility are considered the basis of New Public Management by both scholars and practioners of public sector. The economic crisis at the beginning of the 90's, its implications and political tensions have increased the concern of Italian governments and parliaments (over the years) on uncontrolled growth of public expenses and public debt. An increasing legislative provision on local government dynamics and principles was a consequence of this concerning, amplifying also by the new European Union's budget procedures and needs. The State organization in different levels of government as stated by the constitutional prevision was the focus of main legislative measures (starting form the law no. 142/1990) . In particular Italian local governments are articled in three different levels: Municipality, Provinces and Regions (last are stated in 1970 but became operating with the republican president decree no. 616/77). Moreover governments and parliaments focused their attention on the promotion of administrative decentralization and local statutory, regulative, fiscal, financial and management autonomy. The focus on local government planning activity and performance increased as well as the attention on citizens' informative needs about the use of scarce public resources in order to guarantee the public services. Decisions and actions of the political and administrative bodies followed the general guidelines (legislative decree 165/2001), plans and programs. The object of the Law no. 150 of 2009 (Brunetta Law) is public administration performance, organizational and individual performance of public employees. The public performance is often a sensitive issue in the public debate and generates negative point of views. The last regulation on accounting harmonization generates i) a rethinking process about the overall local governments performance programming and control systems ii) to develop an integrated system to satisfy informative needs on local public administration performance. The present PhD thesis's focused on Italian local governments tools and procedures to i) program, ii) measure and iii) manage the performance by the analysis of the legislative provisions until the last legislative decree 150/09 and the legislative decree 118/2011. First, a full literature review about performance meanings and performance measurement has been carried out. This work highlighted the benefits and the unexpected effects of the performance measures, their limitations and the existing differences between performance measurement and management. Then, concepts of indicators and performance measures are introduced, their principal features and differences, utility and possible uses and the users of performance information (e.g. decision makers, politicians, citizens). The presentation of the theoretical background will be aimed to describe the overall context of performance issue through, i) the international context of public sector and ii) the local public administration performance dynamics. The specific context of this dissertation will be the Italian local government focusing on 1) the description of legislation and doctrine for the programming, planning and management of performance, as well as the accounting harmonization and internal controls and 2) the analysis of local governments' principles, criteria, aims and tools for long and short term performance planning, programming and controls. The next section will be dedicated to describe an hypothesis of integrated performance plan, its development process and tools, its strengths and weaknesses, and the non-addressed and unresolved issues. Further a case study is presented in order to highlight how an integrated performance system can be considered as an administrative governance system. The overall analysis is guided by two principles: i) context simplification and ii) tools' complexity reduction. The future perspective of its practical application is represented by small local governments, characterized by lower complexity and economic, financial, instrumental and human resources than larger ones. For these reasons small governments are better context to apply a new simple tool in addition to the traditional legislative fulfillments without increasing the administrative complexity. Elements of performance planning and programming and their connections with the others multiannual programming, budgeting and management documents (Single Programming Document: DUP, Executive Management Plan: PEG) are included in one single document. However, this system can be seen as another mere formality, without substantial benefits. It meets the aims of the 2009 reform and the principles of the accounting harmonization but it can also create confusion, in particular for local governments with limited skills and inadequate resources to use innovative tools of strategic governance, programming and control. Finally, it will be presented a reflection about systems of performance information transmission, management and communication and the settlement between decentralization processes, development and statement of local autonomy, national and European economic-financial constraints.
Il trattore agricolo è una macchina complessa, progettata per fornire potenza ad un numero consistente di attrezzi diversi sotto forma meccanica, idraulica e modernamente anche pneumatica ed elettrica. Il tutto viene fornito all'operatore per il tramite di un motore endotermico (tipicamente a ciclo Diesel), che sfrutta l'energia chimica contenuta nel combustibile, trasformandola in lavoro meccanico. Il continuo aumento del costo del gasolio, unitamente ad una maggiore attenzione ai problemi ambientali, hanno aumentato notevolmente l'attenzione degli agricoltori ai consumi. Proprio per questo, negli ultimi anni molte organizzazioni nazionali ed internazionali hanno cercato di definire dei metodi per calcolare un indice di efficienza energetica (EEI) anche per i trattori, similmente a quanto già fatto, ad esempio, per le automobili o per diverse tipologie di elettrodomestici. In particolare, l'efficienza energetica di un qualsiasi sistema rappresenta la capacità di sfruttare l'energia ad esso fornito per soddisfarne i fabbisogni. Minori sono i consumi relativi al soddisfacimento di questo fabbisogno, e migliore risulta l'efficienza energetica del sistema. Nel settore della meccanizzazione agricola, diverse nazioni (Spagna, Corea, Turchia) hanno introdotto dei programmi per la definizione di questo indice, basandosi su dati già disponibili, come quelli delle prove del Codice 2 OCSE o delle prove di omologazione del motore endotermico. La DLG (una associazione di agricoltori tedeschi), invece, ha messo in opera un sistema diverso, basato su prove in pista che cercano di simulare dei cicli di lavoro reali, tipici dell'agricoltura centro-europea. Tuttavia, storicamente sia i codici OCSE che questi nuovi protocolli di prova hanno riguardato nella gran parte dei casi i trattori standard; viceversa, i trattori specializzati, impiegati nei vigneti, frutteti, nell'orto-floro-vivaistica e nella manutenzione del verde non hanno potuto finora godere delle medesime attenzioni. Scopo di questo lavoro è quindi quello di costruire una metodologia per poter calcolare un Indice di Efficienza Energetica anche per i trattori da vigneto. Una prima fase del lavoro ha visto l'analisi dell'operatività dei trattori da vigneto, per poter definire quali cicli lavorativi rilevare in quanto maggiormente impattanti. Si è quindi proceduto all'analisi, per diversi motivi solo parziale, di questi cicli reali di campo, analizzando le potenze trasmesse dal trattore alla macchina operatrice e (ove possibile) anche i consumi. Successivamente questi dati sono stati elaborati per costruire dei cicli teorici facilmente riproducibili in laboratorio, per il tramite di banchi prova appositi (freno motore in particolare). La ridotta collaborazione dei costruttori non ha però permesso di replicare in laboratorio questi cicli creati. Si è quindi deciso di tentare un'altra strada, ovvero utilizzare dei dati di prove motore già liberamente disponibili, ovvero quelli relativi alle prove Codice 2 OCSE. Nel periodo 2011-2015, su un totale di 278 test report emessi, solo 11 purtroppo erano relativi a trattori da vigneto e frutteto. Analizzando i report si è valutata la corrispondenza tra potenza rilevata nelle prove in campo e potenza rilevata nel test Codice 2, verificando inoltre la compatibilità della modalità di prova (con riguardo alla posizione dell'acceleratore). I diversi cicli sono stati quindi parificati a 4 diverse condizioni di prova del Codice 2 OCSE. I dati relativi ai consumi specifici (espressi in g/kWh) sono stati quindi analizzati introducendo un impegno temporale previsto per la singola operazione, espresso come percentuale del tempo totale di lavoro, questo in quanto l'agricoltore non utilizza il trattore per un'unica operazione, ma per più operazioni. L'agricoltore può inoltre variare le percentuali di utilizzo del trattore per la singola operazione, ricalcolando quindi sulla effettiva operatività aziendale l'Indice di Efficienza Energetica complessivo. Come spesso succede, però, un singolo numero, soprattutto se non immediatamente confrontato con altri, non dice molto all'utilizzatore finale. Si rende quindi indispensabile, come effettuato in molti altri casi, una definizione delle diverse classi energetiche, per poter facilmente confrontare i risultati ottenuti dal foglio di calcolo sopra indicato. Si è deciso di optare per l'introduzione di 7 classi, dalla A alla G, differenziate tra di loro per un intervalli di 30 g/kWh. Si tratta di una decisione puramente arbitraria, e ovviamente soggetta a futuri adeguamenti, anche in base al ridotto campione di trattori che è stato in questo momento analizzato. In conclusione, il progetto sviluppato durante questa tesi ha lo scopo principale di offrire all'utilizzatore di trattori specializzati diversi indici riguardanti l'efficienza energetica (e quindi, indirettamente, i possibili costi di gestione) dei trattori stessi in diverse condizioni operative, tipiche del settore viticolo e frutticolo. Futuri approfondimenti del lavoro dovranno sicuramente riguardare tutte le parti di questo lavoro. Si dovrà infatti implementare l'analisi reale delle diverse lavorazioni, con una misurazione puntuale delle potenze assorbite da diverse attrezzature (anche della stessa tipologia ma con capacità operative differenti), ricreando dei cicli teorici più affidabili possibili. Inoltre, la fase critica sarà quella per l'ottenimento dei dati reali da prove di laboratorio riferite ai cicli, e non più ai soli dati del codice 2. Si ritiene poi importante anche ottimizzare il database, creando un software apposito con un database periodicamente aggiornato, e in grado di guidare l'agricoltore nella compilazione del suo "uso tipico". Inoltre, è ovvio che il consumo di combustibile, per quanto sia uno dei fattori principali che guidano l'agricoltore nella scelta del trattore, non è sicuramente l'unico. Dal punto di vista ambientale potrebbe essere utile analizzare anche le emissioni di gas in atmosfera, misurandole con l'apposita sensoristica (opacimetri, sonde lambda, etc.) durante le prove di laboratorio. Questi dati, confrontati tra loro su di un utilizzo medio ragionato, potrebbero essere utilizzati anche come base per l'erogazione di sussidi in agricoltura: come già avviene in molti altri settori o in altri paesi, dove le macchine maggiormente efficienti (sia come consumi che come emissioni) sono finanziate dai Piani di Sviluppo Rurale, soggette a defiscalizzazioni o comunque oggetto di contribuzione pubblica. ; The agricultural tractor is a complex machine, designed to provide power to a broad number of different types of equipment, be it mechanical power, hydraulic power, and in recent times even pneumatic and electric power. All this power is harnessed through an endothermic engine (typically diesel cycle), that harnesses the chemical energy of the fuel transforming it into mechanical energy. The constant increase in fuel prices, together with a higher awareness of environmental issues, have significantly increased farmers' concern over their consumptions. In the last few years, this has led many national and international organisations to come up with methods to calculate an energy efficiency index for tractors, in line with what has already been done for cars or different types of household appliances. In particular, the energy efficiency of a system can be defined as its ability to harness the supplied energy to meet its needs. The less the system consumes in order to meet its needs, the higher will be its energy efficiency. Within the farm mechanisation industry, several countries (Spain, Korea, Turkey) have introduced programmes in an attempt to define this index, based on currently available data such as the OECD Code 2 tests or performance testing on endothermic engines. The DLG (German Agricultural Society) has implemented a different system, based instead on field tests that replicate real work cycles typical of central- European farming. However both the OECD codes and these new testing protocols were mainly designed and tested on standard tractors, whereas specialised tractors, the ones used in vineyards, fruit orchards, greenhouses and vegetation maintenance, have been neglected up until now. The purpose of this project is to devise a methodology in order to be able to calculate an Energy Efficiency Index also for vineyard tractors. The first part of the project consisted in analysing the work of tractors in viticulture, in order to pick out the most impactful, and therefore most relevant work cycles. This was followed by an only partial (for several reasons) analysis of these real-life field cycles, by studying the power transmitted from the tractor to the implements/equipment and (where possible) assessing consumption as well. This data was then used to devise theoretical cycles, easily reproducible in the lab thanks to dedicated testing areas (especially for the engine brake). But due to a lack of cooperation from the manufacturers, it was not possible to test these cycles in the lab. A different strategy was then decided on: using engine testing data from sources that were already freely available, such as data from the OECD Code 2 tests. Between 2011 and 2015, only 11 out of 278 test reports issued involved vineyard and orchard tractors. When analysing these reports, the power detected in field tests was compared to the power detected in Code 2 tests, and the compatibility of the test setting was also assessed (especially the position of the throttle). The various cycles were then compared against 4 different test conditions of the OECD Code 2. The specific consumption data (expressed in g/kWh) was then assessed against a given time allocated to the task, expressed as a percentage of the overall work time, as the farmer doesn't use the tractor for a single task but for multiple tasks. The farmer can also change the percentages of tractor usage for each task; thereby recalculating the overall energy efficiency index according to the farm's actual operational performance. However, as often happens, one single figure, especially if not immediately checked against other numbers, does not mean much to the end user. Therefore it is essential, as it has proved to be in many other cases, to provide a definition of the different energy brackets in order to facilitate the comparison of results by using the spreadsheet shown above. It has been decided to introduce 7 energy brackets running from A to G, each one separated by an interval of 30g/kWh. This is a purely arbitrary distinction, which is obviously subject to future amendments also due to the small numbers of tractors analysed so far. In conclusion, the main goal of the project outlined in this paper is to provide the user of specialised tractors with different energy efficiency indexes (and therefore also, indirectly, with an idea of the possible operating costs) of tractors under diverse operating conditions within the vine and fruit culture industry. Any future research on this project should take into account all the aspects that have been touched on. It will be necessary in fact to implement a real-life analysis of the different activities, with accurate measurements of the power used by each piece of equipment (even if they are of the same type but with different operating systems), devising in this way theoretical cycles that are as reliable as possible. In addition, a key part of the project should revolve around obtaining real data from laboratory tests based on these cycles, and not just data from Code 2 tests. We also consider it important to optimise the database, by creating a dedicated software with a regularly updated database, which can guide the farmer in tracking his "typical use". Moreover it is clear that the consumption of fuel, despite being one of the main factors that guide the farmer's choice of tractor, is definitely not the only one. From an environmental point of view, it could be useful to also analyse gas emissions into the atmosphere, by measuring them with the appropriate instruments (opacimeters, lambda waves, etc.) during laboratory tests. All this data, if it was compared and evaluated against a reasoned average utilisation, could then be used as a basis for the distribution of agricultural subsidies, as is already the case in many other industries or in other countries, where the most efficient machines (both in terms of consumption and emissions) are funded by Rural Development Plans, or benefit from tax deductions or some form of government contribution.
IntroductionThe Report that the AIB has decided to publish starting from this year aims at presenting, even if synthetically, the main characteristics of an overview of Italian libraries, each time pointing out the questions, tendencies and some of the events that are of most interest to those who are interested in the development of the library service in our country.When it is proposed to describe a national picture of the situation of the libraries of the various types (public, university, state, scholastic, ecclesiastic, private, etc.) one finds oneself before the almost total absence of comparable and trustworthy organic information. Using the various sources available, it is possible to estimate with a certain approximation that the over 15,000 Italian libraries (in which approximately 20,000 people work) possess almost 200 million documents, that they acquire annually almost 7 million books, that their annual users are little less than 10 million and the loans made are around 65 million. It is believed that in the year 2001 the running costs exceeded 1000 billion lire, of which a little more than 10% were destined to the purchase of documents.LegislationThe year 2001 was rich in new details with regard to the sector of legislation for libraries. This was also due to the effect of the constitutional reforms and the new scenarios relative to the responsibilities and federalist arrangement of the State.Regulations of particular importance for libraries and indirectly linked to the overall institutional situation are those contained in the law of 28 December 2001, no. 448 (finance law 2002). This prescribes that the management of services aimed at the improvement of the public use and development of the artistic patrimony (and therefore also of the state libraries) can be entrusted to subjects other than those of the state. It also introduces an art. 113 bis in the sole text of the laws on the organization of local bodies (legislative decree 18 August 2000, no. 267), on the basis of which "local public services without industrial importance are managed through direct entrusting to: a) institutions; b) special businesses, including consortiums; c) joint-stock companies" and only as a residual solution (paragraph 2) "is economic management permitted when, due to the small dimensions or the characteristics of the service, it is not opportune to proceed to entrusting it to subjects as described in paragraph 1". Awaited on many sides as the chance to respond to a number of the age-old problems that have afflicted the sector of state public libraries for decades, the new organization regulations of the Ministry for cultural and artistic heritage, issued with the Presidential Decree of 29 December 2000, no. 441, actually only indicate, without solving, some fundamental questions that regard the sector, postponing their settlement, without any time limits, to subsequent second degree regulations.As regards the more strictly library themes of interest, the necessity to solve the problems of the legal deposit drove the AIB to revive the bill proposal, which had already been discussed and had arrived at the threshold of final approval in Parliament in the 13th legislature.During the year 2001, moreover, the European Parliament and the European Union Council finally approved the Directive 2001/29/CE, that aims at integrating the laws of the member countries regarding reproduction rights, rights of communication of works to the public and distribution rights, in reference to those works, on every kind of medium, including digital medium, subject to authors' rights. Art. 5 provides the faculty of member states to order exceptions and limitations to the above mentioned rights, to guarantee the right balance between authors' rights and other social interests. This article furthermore contains the "exceptions" that are to the advantage of libraries or of didactics and scientific research.Cooperation and consortiumsThe last two years have shown considerable progress in the field of cooperation activities, confirming also in Italy the current tendencies at international level. These developments generally - but with different nuances - regard various types of libraries and involve different sectors of activity, from those already established (such as cataloguing and purchases) to emerging activities, more directly linked with the diffusion of Internet (management and development of digital resources, etc.).Access to information and the development of electronic collections are surely the areas that are most involved in the new cooperation initiatives. The university sector is that which demonstrates most vitality in this area, but a certain recent enterprise of state and public libraries should be noted. The initiatives promoted by two large university computer consortiums should also be mentioned: the Cilea and Caspur.The CiBit project for digitalisation, archiving and networking, with a special research interface for Italian literature texts should be noted.In Italian universities, as in other developed countries, the idea of creating alternative models of academic electronic publishing is being increasingly encouraged: in this field mention must be made of the initiative of the University of Florence with the Firenze University Press project.On-line cataloguesThe catalogues of Italian libraries available through Internet number 420. For the year 2001 growth stabilized around 15% and mainly regarded the local body systems, the libraries of which cover municipal or provincial areas.The Italian university OPACs (On line Public Access Catalog) form approximately 40% of the total.National Library Service (SBN) and national projectsIn the last two years the SBN network has been established as the largest public network of libraries in Italy, both due to the number of libraries participating and to the considerable increase in the information in the catalogue: at the end of the year 2001 the libraries numbered approximately 1400, the size of the national collective catalogue was 5,500,000 titles (corresponding to approximately 12 million localizations, that is mentions of the presence of the works in the participating libraries). Daily hits, also as a result of the availability on Internet of the catalogue, are currently on average 160,000 on weekdays, with high points on some days of over 200,000 hits.Other cooperation projects are underway in the field of antique books and manuscripts.The Anagrafe delle biblioteche italiane (Registry of Italian libraries) data base, it too available for consultation on Internet, provides an instrument of general information on the patrimonies, services to the public and specializations of approximately 12,500 libraries.But it is "SBN on line" that has really marked a further step forward towards the improvement of the services: from a single access point, with identical modalities, users can consult catalogues of different institutions (libraries, archives, museums); they can compile a bibliography according to their own specific requirements by integrating information sources; they can also locate documents and ask for them on loan or in reproduced form.Formation, occupation and professionItaly also considers university formation as the basis for the initial preparation of librarians. In the nineties especially, the degree course in Preservation of Cultural Heritage was a source of considerable attraction among young people and in the year 2000/01 it ended up having over 23,000 students registered in the 17 universities offering the course as well as almost 3,000 registered in various related diploma courses (Operators of Cultural Heritage), for a total of 26,339 students. As a whole this is a small sector with respect to all university education (1.6% of the total of students, 2% of those enrolled, 0.6% of those graduated or having obtained diplomas), but a large group with respect to the degree or diploma "arts" group into which it is statistically inserted (16% of those registered, 23% of those enrolled and 7% of those graduated or having obtained diplomas).In the year 2000/01, the first year of the "3+2" university reform, among the 42 first level degree classes, that in Sciences of Cultural Heritage is at the 12th place as regards number of enrolled (9079) and is generally in the first place among the characteristic courses in the Arts Faculty (in the order Arts, Sciences and technologies of figurative arts, of music, entertainment and fashion, Philosophy, Historical Sciences). Sixty-six percent of the students in the degree courses in the archive-library field are female.As a whole the number of students registered is certainly greatly increased with the new courses (9079 enrolled in 2001/02 as against the 5920 of the previous year, +53%). The current offer is of 71 courses in 41 universities: among these, 9 (in a like number of universities) are specifically dedicated to the formation of librarians and archivists, while 33, 2 of which by distance-learning, have a general nature (18 with a specialization for librarians and archivists), and 29 regard other specific sectors (artistic, archaeological, musical, etc., heritage ). Overall, there are therefore at least 27 courses aimed at the formation of librarians, in 26 universities and with locations in 25 different cities.Those who graduated in Cultural Heritage have up to now obtained rapid and effective insertion into the world of work, initially above all with assistance initiatives or contract jobs but also with permanent employment, demonstrating among other things their capacity to temporarily or permanently exploit employment opportunities even in related fields (publishing, multimedia production, Web services, communications, etc.).Generally speaking, the offer of long-term employment in public administration is about 180 positions per year. The main employers are the local bodies, with 64%, followed by the Universities with 27%. Absent for years now is the Ministry for Cultural Heritage (except for two small competitions in 1998 and 1999); some offers come from the sector of research (institutions of the CNR and other bodies, for 7% in the three-year period under consideration), and exceptionally from other public bodies.From the point of view of geographic distribution, the vast majority of the jobs offered is in the North (72%, as against 11% in the Centre and 17% in the South and in the islands), and the percentage exceeds 80% for places in the local bodies: about half of the jobs offered by Italian local bodies are in the region of Lombardy; this is followed at a great distance by Emilia Romagna and then the Veneto region. In the universities, the distribution is a little less unbalanced, again with Lombardy in the first place but with a good offer also in regions of the Centre (Lazio) or of the South (Campania, Puglia).The offer of contract employment or with assistance positions is very active, both through competitions and screening for contract jobs in public administrations and through the search for assistants by service companies, mainly in the field of cataloguing, and of library structures: we can consider that through these forms of selection approximately 300 persons per year find temporary employment.The Italian Libraries Association and the Professional RegisterAn indicator of the dynamism of the profession is given also by the activity of the Italian Libraries Association (AIB) which, during the year 2000 extended to include all twenty Italian regions and considerably increased its number of members: 4407 members (+2% with respect to the previous year). This shows a much larger and clearer growth than that of employment in the sector, which therefore testifies to a greater group thrust, of "self-recognition" and identification, while a considerable number of occasional registrations remain: these are not renewed with any continuity.Since 1998, the AIB manages the Italian Professional Register of librarians, a private register that was established along the lines indicated by the European directives on the recognition of professional titles and by the bills on the unrecognised professions presented in the last legislatures but not yet approved. Il volume Tommaso Maria Napoli Utriusque Architecturae Compendium Roma 1688 Breve trattato sulle fabbriche civili e militari e la conservazione delle architetture del frate domenicano Tommaso Maria Napoli, vuole contribuire ad accrescere le nostre conoscenze sui principi che dovevano sottendere alla realizzazione dell'architettura civile e militare del periodo barocco e tardo barocco, così come espressi nel breve trattato scritto dal frate architetto, nato a Palermo, Tommaso Maria Napoli (1659-1725), e pubblicato a Roma alla fine del Seicento. Alla traduzione dal latino del trattato, redatta da esperti (Fabio Zarbo e Pietro Zarbo), è inclusa un'interessante ricerca, redatta congiuntamente con Giuseppe Tantillo, sullo stato di conservazione di alcune delle architetture fatte realizzare o attribuite all'architetto Tommaso Maria Napoli. Infatti, al volume sono allegate alcune schede sulla consistenza e stato di conservazione della cattedrale dell'Assunzione di Maria a Dubrovnik, nell'odierna Croazia, delle ville Valguarnera e Palagonia a Bagheria, del monumento all'Immacolata e di uno dei campanili della chiesa di San Domenico a Palermo. Il volume è arricchito della presentazione e postfazione di Francesco Tomaselli che, tra l'altro, partendo dalla definizione di Restauro espressa da Tommaso Maria Napoli nel suo volume, presenta una stimolante riflessione sul significato dell'espressione Restauro. Il volume Tommaso Maria Napoli Utriusque Architecturae Compendium Roma 1688… inaugura la collana Monumento Documento Il restauro per la conservazione del patrimonio architettonico ed ambientale: Teoria, conoscenza, interventi, della casa editrice Aracne di Roma, con Direttore Francesco Tomaselli, e con Comitato scientifico e di redazione internazionale.
2009/2010 ; Lo scopo di questa ricerca di dottorato è l'analisi geopolitica di una regione transfrontaliera dell'Asia centrale: la valle del Fergana. Tre anni di ricerca sul campo: l'analisi delle frontiere di questa regione attualmente divisa politicamente tra Uzbekistan, Tagikistan e Kirghizistan, la cartografia analitica, le osservazioni, le interviste alla popolazione e agli esperti, la ricerca nelle biblioteche della regione, nella capitale dell'Uzbekistan, Tashkent (presso l'Istituto Francese di Studi sull'Asia centrale – IFEAC) e la ricerca svolta in Francia principalmente presso l'Istituto Francese di Geopolitica (IFG) e la Biblioteca Nazionale di Francia (BNF), sono gli strumenti che hanno permesso lo studio di questo territorio. Il principale obiettivo del lavoro è l'analisi delle rivalità di potere della valle del Fergana. Grazie alla sua fertilità e alla sua importante posizione strategica all'interno del contesto geopolitico centrasiatico, il bacino del Fergana è stato e continua tuttora ad essere una posta in gioco ambita da differenti attori territoriali. La rivalità di potere tra i diversi attori si gioca soprattutto sullo scenario transfrontaliero della regione. Il secondo scopo di questa ricerca è la presentazione e la valutazione di un particolare attore territoriale della valle, il Regionalismo culturale. La parte introduttiva della ricerca si concentrerà su una presentazione del contesto centrasiatico e sulle peculiarità derivanti dalle sue frontiere. In seguito verrà introdotta la "posta in gioco" Fergana con le sue risorse fisiche ed economiche al fine di legittimare l'importanza del territorio. Infine l'introduzione si concluderà con la teoria geopolitica: il perché della scelta della scuola di geopolitica del geografo francese Yves Lacoste per questa ricerca e una prima analisi dello spazio Fergana come regione divisa tra confine e frontiera. Il lavoro è strutturato in due grandi parti. La prima, più teorica, è relativa all'analisi dei tre attori territoriali. Le rappresentazioni dei differenti attori che verranno presentate, non seguiranno un ordine cronologico, ma un ordine concettuale: eventi simultanei verranno dunque analizzati non nello stesso momento, perché relativi a rappresentazioni differenti del territorio Fergana. Il primo capitolo è consacrato all'attore Nazione. Con questa espressione si intende non solo l'attore Stato-Nazione in sé, o meglio gli Stati-Nazione (Uzbekistan, Tagikistan e Kirghizistan), ma anche la Nazione come idea, come politica nazionalistica applicata ad un territorio. La valle del Fergana è diventata una regione transfrontaliera da quando, negli anni '20, fu divisa tra i tre Stati, allora all'interno della Unione delle Repubbliche Socialiste Sovietiche (URSS). Negli anni '90, in seguito alla caduta dell'URSS, il Fergana divenne una regione divisa da frontiere non più interne ma internazionali. Questo capitolo ha come scopo l'analisi di tutte le rappresentazioni dell'attore Nazione per quanto riguarda il contesto Fergana, dalla sua nascita (anni '20) fino all'indipendenza delle Repubbliche (anni '90). Sicuramente la rappresentazione più importante da analizzare è quella della creazione delle sue frontiere. L'attore Nazione è senza dubbio l'attore geopolitico più importante anche perché quello più legittimato in questo contesto territoriale. Il capitolo approfondirà anche le relazioni tra i differenti Stati-Nazione che rappresentano allo stesso tempo: un unico attore (contro la Religione e il Regionalismo culturale) e tre attori differenti quando competono tra loro per il territorio Fergana. Il secondo attore è la Religione. La valle del Fergana è una delle aree centrasiatiche più credenti e praticanti e la religione islamica ha sempre avuto un ruolo importante nella gestione della società ferganiana. Verrà proposta un'analisi di tutte le rappresentazioni della religione nel Fergana: il sufismo autoctono con un'analisi sulla geografia sacra dei luoghi ferganiani importanti per questa corrente dell'Islam; l'Islam tradizionale del periodo sovietico, divenuto un'arma legale utilizzata da Mosca per combattere l'ortodossia religiosa sufi del Fergana; il fondamentalismo wahabbita degli ultimi anni importato dall'Afghanistan, dal Pakistan, dall'Arabia Saudita, come conseguenza dell'invasione sovietica dell'Afghanistan del 1979 e dunque in seguito all'incontro tra i musulmani sovietici e i mujaheddin afgani. In seguito verrà analizzato come le differenti varianti dell'attore Religione si sono opposte, negli anni, all'attore Nazione per il controllo del potere e delle risorse del territorio Fergana. Un fenomeno particolarmente analizzato sarà la politicizzazione dell'attore Religione e come questa politicizzazione ha portato l'attore in questione ad essere l'elemento protagonista di numerosi eventi nel Fergana. Il terzo attore è il Regionalismo culturale. Con questa espressione si fa riferimento all'identità geo-culturale di questo insieme regionale che persiste nonostante le pressioni nazionalistiche e religiose. La valle del Fergana è sempre stata un insieme geografico, politico, sociale, malgrado negli ultimi secoli la sua popolazione si è sempre distinta per il suo alto livello di multietnicità e di disomogeneità linguistica. Questo però, non ha impedito un'amalgamazione sociale di tale popolazione che ha sempre considerato la multietnicità come la normalità e ha sempre attribuito ad ogni "etnia" un ruolo sociale integrato all'interno del sistema Fergana. Popolazioni di lingua e cultura persiana e sedentaria e popolazioni di lingua e cultura turca, sedentaria o nomade hanno sempre condiviso, ognuna con il proprio ruolo sociale, una vita comunitaria all'interno della regione e questa è sicuramente la caratteristica principale del Regionalismo culturale del Fergana. Questo equilibrio cambiò con la perdita di sovranità politica della regione, con l'istituzione dei nazionalismi e la conseguente spartizione della regione tra tre dei cinque nuovi Stati nazionali dell'Asia centrale sovietica. In questo capitolo verranno analizzate le principali rappresentazioni nel tempo dell'attore Regionalismo culturale e come esso si sia opposto agli altri attori territoriali, soprattutto all'attore Nazione. La seconda parte di questo lavoro è stata dedicata all'impatto che gli attori territoriali hanno oggi nella valle del Fergana, soprattutto nelle sue aree di frontiera. Questa parte è il risultato delle interviste e delle osservazioni sul campo effettuate in Asia centrale e in particolare nel Fergana nelle spedizioni del 2007, 2009 e del 2010. Nel primo capitolo verrà analizzata la frontiera di questa regione dal punto di vista teorico, in particolar modo con l'analisi del Fergana come" prima o ultima linea di difesa". Nel secondo capitolo, all'interno di un contesto di base: la differenza tra la frontiera all'epoca sovietica e all'epoca dell'indipendenza, ci sarà un approfondimento della definizione di frontiera centrasiatica, l'esame della burocrazia di frontiera, del posto di blocco e dei documenti del soggetto transfrontaliero. Saranno trattate, inoltre, le tematiche relative alle relazioni commerciali transfrontaliere, come i "tre" Fergana riescono ancora ad interagire malgrado la crescente rigidità delle frontiere e verranno studiate le relazioni sociali transfrontaliere sempre all'interno del panorama ferganiano di oggi. In questo contesto, verranno considerate le interviste svolte nel Fergana, le opinioni riguardo le difficoltà di passaggio e di comunicazione nella valle ed analizzeremo la presenza dei tre attori geopolitici che tuttora giocano un ruolo fondamentale nelle relazioni e nei conflitti di frontiera. Il terzo capitolo sarà dedicato ai centri urbani del Fergana; la loro storia, il rapporto dei ferganiani con le città e soprattutto le rappresentazioni interne ed esterne che i centri urbani hanno assunto all'interno di una regione oggi del tutto transfrontaliera. Il quarto capitolo si concentrerà sulle evoluzioni demografiche della popolazione: il Fergana, che durante gli anni zaristi e sovietici era terra di immigrazione, con l'indipendenza e dunque con la concretizzazione delle frontiere, si ritrova terra di emigrazione. Il quinto capitolo sarà dedicato al Fergana delle infrastrutture: come la strada ferrata e la rete stradale influiscono e sono influenzate dalle mutazioni frontaliere di questa regione. Il sesto capitolo riprenderà degli interrogativi teorici posti all'inizio del lavoro, con un analisi conclusiva sull'odierno "Fergana delle frontiere". La conclusione di questa ricerca, in realtà, è una vero e proprio capitolo di analisi, dove si farà il punto della situazione e si constaterà la persistenza dell'attore Regionalismo culturale, la sua evoluzione e il suo rapporto attuale con gli altri attori geopolitici. Un punto di arrivo fondamentale della ricerca è il fatto che la regione Fergana è cambiata, sotto differenti punti di vista e la popolazione ferganiana ha nuovi punti di riferimento culturali, politici e sociali. Differenti forme politiche e nuove strutture culturali hanno portato la popolazione del Fergana, nel tempo, a mutare la propria immagine e la propria identità: "russa, musulmana, ferganiana", in seguito "sovietica, uzbeca (o tagica o kirghiza), atea, ferganiana" e infine "uzbeca (o tagica o kirghiza), laica, ferganiana". Il territorio, le sue frontiere e la società che lo abita sono cambiati, ma vedremo che, nonostante i forti ostacoli posti dall'attore Nazione, il Regionalismo culturale riuscirà a sopravvivere, adattandosi alle nuove tendenze e ai nuovi modi di interpretare il Fergana. Come ultimo studio sul territorio, faremo degli esempi riguardanti gli eventi più recenti concernenti il Fergana (massacro di Andijan nel 2005, scontri ad Osh nel giugno 2010) ed analizzeremo questi fenomeni alla luce delle rivalità di potere geopolitiche che ancora persistono nella regione. ; Cette thèse de Doctorat propose une analyse géopolitique d'une région transfrontalière de l'Asie centrale, la vallée du Ferghana, aujourd'hui divisée entre les Républiques d'Ouzbékistan, du Tadjikistan et du Kirghizistan. Des séjours sur le terrain répartis sur trois ans ont constitué la base de la recherche, au travers de l'analyse des frontières, de la cartographie analytique, d'entretiens qualitatifs avec experts et habitants, et de recherches bibliographiques dans le Ferghana ainsi que dans la capitale ouzbèke Tachkent – notamment près l'Institut Français d'Etudes sur l'Asie Centrale (IFEAC). Ces périodes de terrain ont été complétées par un séjour de recherche en France, articulé principalement autour d'un approfondissement théorique à l'Institut Français de Géopolitique (IFG) de l'Université Paris VIII-Vincennes et de recherches bibliographiques à la Bibliothèque Nationale de France. L'objet de ce travail est donc l'analyse des rivalités de pouvoir entre les acteurs territoriaux sur l'enjeu territorial de la vallée du Ferghana, bassin fertile à la position stratégique dans le contexte géopolitique centrasiatique élargi. Si le Ferghana a toujours constitué un enjeu disputé par différents acteurs territoriaux, les rivalités des acteurs actuels jouent aujourd'hui surtout au niveau frontalier et transfrontalier. Ce faisant, cette thèse introduit un nouvel acteur dans le schéma d'analyse géopolitique classique: le Régionalisme culturel. Le Régionalisme culturel en tant qu'acteur territorial y fait donc l'objet d'une présentation approfondie ainsi que d'une évaluation de son importance passée et actuelle. Concentrée d'abord sur le contexte centrasiatique et les particularités qui découlent de ses frontières, l'introduction présente ensuite « l'enjeu » Ferghana et ses ressources physiques et économiques, qui expliquent l'importance de ce territoire. Elle se poursuit sur un rapide point théorique sur la géopolitique et la justification du choix de l'école de pensée géopolitique de Yves Lacoste comme cadre théorique de cette recherche, avant de s'achever sur une première analyse de l'espace Ferghana à l'aune des catégories de frontières et de confins. La thèse est structurée en deux grandes parties. La première, à dominante théorique, analyse à tour de rôle les trois acteurs territoriaux qui rivalisent pour le pouvoir sur le Ferghana: il s'agit de la Nation, de la Religion, et du Régionalisme culturel. La présentation des acteurs, de leurs différentes incarnations et de leurs représentations respectives du territoire ferghanien sont ainsi abordés selon un ordre conceptuel ; des évènements s'étant produits simultanément ne sont ainsi pas analysés chronologiquement mais séparément, en tant qu'ils se rapportent aux acteurs évoqués. Le premier chapitre est consacré à l'acteur Nation. Par cette expression nous entendons non seulement l'entité effective Etat-Nation et ses trois incarnations (Ouzbékistan, Tadjikistan, Kirghizistan), mais aussi la Nation comme idéologie qui agit sur le territoire au travers de politiques nationalistes. La force de légitimation de l'acteur Nation n'est pas étrangère à l'accroissement de son importance sur ce territoire, qui l'a sans aucun doute mené au sommet de la hiérarchie des acteurs géopolitiques dans cette région. Ce chapitre analyse les représentations du Ferghana définies et mises en oeuvres par l'acteur Nation depuis son apparition dans les années 1920. La vallée du Ferghana est en effet devenue une région transfrontalière à cette époque, avec son intégration à l'Union des Républiques Socialistes Soviétiques (URSS) et sa partition entre trois des cinq Républiques Socialistes Soviétiques nouvellement créées en Asie Centrale. Dans les années 1990, avec la chute de l'URSS et l'indépendance des trois Républiques, les frontières qui divisaient le Ferghana ne sont plus simplement internes, mais deviennent bel et bien internationales. Parmi les représentations majeures qui font l'objet d'une étude dans ce chapitre, une attention particulière est portée aux frontières nationales, leur création et leur évolution. Le chapitre s'intéresse également aux relations entre les différents Etats-Nations, qui constituent un acteur unique lorsqu'ils rivalisent contre les autres acteurs territoriaux – la Religion et le Régionalisme culturel – mais aussi trois acteurs différenciés lorsqu'ils se disputent le territoire Ferghana entre eux. Le deuxième chapitre est consacré au deuxième acteur territorial, la Religion. La vallée du Ferghana est l'une des régions d'Asie centrale les plus croyantes et pratiquantes, et la religion islamique y a toujours eu un rôle important dans la gestion de la société. Ce chapitre propose d'abord une analyse des représentations de la religion dans le Ferghana : le soufisme autochtone et la "géographie sacrée" des hauts lieux de ce courant de l'Islam dans le Ferghana ; l'Islam traditionnel de la période soviétique, devenu une arme légale utilisée par Moscou pour combattre l'orthodoxie soufie du Ferghana ; le fondamentalisme wahabbite récemment apparu, importé d'Afghanistan, du Pakistan et d'Arabie Saoudite à la suite de l'invasion de l'Afghanistan par les Soviétiques en 1979 et de la rencontre qui s'en est ensuivie entre les musulmans soviétiques et les moudjahiddines afghans. Ensuite est examinée la manière dont les différentes variantes de l'acteur Religion se sont opposées, au cours des années, à l'acteur Nation pour le contrôle du pouvoir et des ressources du territoire Ferghana. Nous y voyons comment la rivalité géopolitique entre deux acteurs varie du tout au tout selon que l'on parle de l'acteur Nation au cours de la période Soviétique ou bien au cours de l'ère ayant succédé à l'indépendance. Une attention particulière est portée au phénomène de politisation de l'acteur Religion et à la manière dont cette politisation a amené la Religion à assumer un rôle de protagoniste dans de nombreux évènements du Ferghana. Le troisième acteur est le Régionalisme culturel. Avec cette expression nous faisons référence à l'identité géo-culturelle de cet ensemble régional, qui persiste malgré les pressions nationalistes et religieuses. Car aussi loin que remonte son existence en tant que lieu, la vallée du Ferghana a toujours constitué un ensemble géographique, politique et social à part entière. Bien que sa population se soit distinguée au cours des derniers siècles par une grande multiethnicité et hétérogénéité linguistique, cela n'a pas empêché un amalgame sociétal de cette population qui a toujours considéré la multiethnicité comme normale, et toujours a attribué à chaque « ethnie » un rôle social déterminé au sein du système Ferghana. Qu'elles soient de langue et de culture persane et sédentaire, de langue et de culture turque et sédentaire, ou bien de langue et de culture turque et nomade, ces populations ont toujours partagé, chacune dans son propre rôle social, une vie communautaire au sein de la région, et ce phénomène est la caractéristique principale de ce que nous appelons le Régionalisme culturel du Ferghana. Cependant, cet équilibre change avec la perte de souveraineté politique de la région, l'avènement du nationalisme sous l'action de l'URSS, et la partition de l'espace entre trois Etats nations de l'Asie centrale soviétique. Ce chapitre analyse ainsi les principales représentations de l'acteur Régionalisme culturel au cours du temps, et comment il s'est opposé aux autres acteurs territoriaux, en particulier à l'acteur Nation. La seconde partie de ce travail est dédiée aux manifestations actuelles des acteurs territoriaux dans la vallée du Ferghana, plus spécialement dans ses zones de frontière. Cette partie est le résultat des entretiens et des observations de terrain réalisés en Asie centrale et dans le Ferghana au cours de séjours en 2007, 2009 et 2010. Le premier chapitre analyse la frontière de cette région du point de vue théorique, à la lumière notamment des catégories géostratégiques de "première ligne de défense" ou "dernière ligne de défense". Dans le contexte d'une modification de la frontière entre l'époque soviétique et celle de l'indépendance, le deuxième chapitre approfondit la définition de frontière centrasiatique, au travers principalement de l'analyse de la bureaucratie de frontière, des postes de contrôle et des documents requis pour le passage de la frontière. Les thématiques liées aux relations commerciales transfrontalières y sont examinées : comment les "trois" Ferghana parviennent encore à interagir malgré la rigidité croissante des frontières, quelles relations sociales transfrontalières subsistent au sein du Ferghana d'aujourd'hui. Les entretiens qualitatifs réalisés dans le Ferghana jouent un rôle majeur pour recenser les difficultés de passage et de communication dans la vallée et déceler, dans les descriptions et jugements recueillis, la présence des trois acteurs géopolitiques qui toujours jouent un rôle fondamental dans les relations et conflits de frontière. Le troisième chapitre est dédié aux centres urbains du Ferghana : leur histoire, le rapport que les Ferghaniens entretiennent avec eux, et surtout les représentations internes et externes que les centres urbains assument au sein d'une région désormais tout à fait transfrontalière. Le quatrième chapitre se concentre sur les évolutions démographiques de la population. Jusque là terre d'immigration tout au long des années tsaristes et soviétiques, le Ferghana est devenu une terre d'émigration avec l'indépendance et la concrétisation des frontières. Le cinquième chapitre s'intéresse au Ferghana des infrastructures, notamment les réseaux ferré et routier, et leur rapport d'influence réciproque mutations frontalières de cette région. Le sixième chapitre reprend les interrogations théoriques posées dans l'introduction et développe une analyse conclusive sur le Ferghana des frontières aujourd'hui. La conclusion de cette recherche dresse le bilan actuel du Ferghana et des rapports entre les différents acteurs géopolitiques, et observe la persistance de l'acteur Régionalisme culturel. Force est de constater l'existence de changements dans la région Ferghana à différents points de vue. La population ferghanienne dispose de nouveaux cadres de référence culturels, politiques et sociaux qui ont pris une importance majeure. Des nouvelles formes politiques et de structures culturelles ont eu un impact sur son image d'elle-même, sur son identité: "russe, musulmane,ferghanienne", puis "soviétique, ouzbèke (ou tadjike ou kirghiz), athée, ferghanienne", et enfin "ouzbèke (ou tadjike ou kirghiz), laïque, ferghanienne". Cependant, bien que le territoire, ses frontières et la société qui l'habite aient changé, et malgré les obstacles forts posés par l'acteur Nation, que Régionalisme culturel a réussi à survivre, en s'adaptant aux nouvelles tendances et aux nouveaux modes d'interprétation du Ferghana. La conclusion s'achève sur les évènements les plus récents du Ferghana; massacre d'Andijan en 2005 et affrontements à Osh en juin 2010, qui sont analysés à la lumière des rivalités de pouvoir géopolitique qui persistent encore dans la région. ; This PhD dissertation proposes a geopolitical analysis of a centrasiatic transborder region, the Ferghana Valley, which is today divided between the Republics of Uzbekistan, Tajikistan and Kyrgyzstan. A basis of the research, field trips spread over the past three years enabled the development of instruments such as border analysis, analytical cartography, qualitative interviews with experts and inhabitants, and bibliographical research in the Ferghana as well as the Uzbek capital city Tashkent – noticeably at the French Institute for Central Asian Studies (IFEAC). As a complement to the field trips in Central Asia, a research period in France permitted both a consolidation in geopolitical theory at the French Institute of Geopolitics (IFG) of the University of Paris 8-Vincennes, and additional bibliographical research at the French National Library (BNF). The topic of the research is hence the analysis of power rivalries between "territorial actors" over the "territorial stake" of the Fergana Valley, a fertile basin of strategical location within the larger geopolitical context of Central Asia. Always a stake disputed by various territorial actors over time, the Fergana Valley now experiences power rivalries from contemporaneous territorial actors first and foremost on the border and transborder levels. By doing so, the dissertation introduces a new actor in the classical geopolitical pattern of analysis: the cultural regionalism. The dissertation hence offers a detailed presentation of the cultural regionalism as well as an evaluation of its past and current importance. First focusing on the centrasiatic context and the peculiarities which stem from its borders, the introduction presents the "stake" Fergana and its economic and physical resources which explain its importance as a territory. A rapid summary of the theory of geopolitics follows, with the justification of the choice of the French Lacostian school as the theoretical frame of this work. The introduction closes on a first analysis of the Fergana as a space of border or frontier. The thesis is structured in two main parts. The first, more theoretical, analyses each of the three territorial actors which aim for power over the Fergana: the Nation, the Religion, and the Cultural Regionalism. The presentation of the actors, of their respective embodiments and of their manifestations within the ferganian territory is organised according to a conceptual rationale; events that occurred simultaneously are thus not considered following a chronological order, but separately, according to their respective relations with the actors evoked. The first chapter focuses on the actor Nation. By this word we understand not only the effective entity of the Nation-State, and its three embodiments (Uzbekistan, Tajikistan, Kyrgyzstan), but also the Nation as an ideology which acts upon the territory through nationalistic policies. The force of legitimation of the actor Nation did certainly not have a neutral role in the rise of this actor in the Ferganian landscape, a process which led the Nation to the top of the geopolitical actors' hierarchy in the region. This chapter also analyses the representations of the Fergana which are defined and implemented by the actor Nation since its birth in the 1920s. In fact, the Fergana valley first became a transborder region only in these years, through its integration to the Union of the Socialist Soviet Republics (USSR) and its partition between three of the five newly created Socialist Soviet Republics in Central Asia. In the 1990s, following the fall of the USSR and the independence of the three Republics, the borders which divided the Ferghana stopped being only internal, but became real and proper international borders. Among the main representations that this study looks at, a particular attention is devoted to the study of the national borders , their creation and their evolution. The chapter also looks at the relations between the different Nation-States, which form a unique actor when they rival against the other territorial actors – the Religion and the Cultural Regionalism –, but three well different ones when they rival among themselves. The second chapter concentrates upon the second territorial actor, the Religion. The Fergana valley is one of the most pious and practicing region of Central Asia, and the Islamic religion always played a major role in the society's administration and organization. The chapter proposes first an analysis of the religion's representations in the Fergana: the autochthonous sufism and its sacred geography within the Fergana valley ; the traditional Islam of the soviet times, which became a legal weapon used by Moscow to fight the sufi orthodoxy in the Fergana ; the recently appeared wahabbite fundamentalism, imported from Afghanistan, Pakistan and Saudi Arabia following the Soviet invasion of Afghanistan in 1979 and the encounter it induced between the soviet muslims and the afghan mujaheddins. It is then examined how the different variations of the actor opposed themselves to the actor Nation, over the years, for the control over the power and the resources of the Fergana. We look at how the geopolitical rivalries vary dramatically from the soviet era to that of the independence. A special attention is devoted to the phenomenon of politization of the actor Religion and the way this led the Religion to endorse a role of protagonist in many of the Fergana's events. The third actor is the Cultural Regionalism. It is hereby referred to the geo-cultural identity of this regional entity, which persists in spite of nationalistic and religious pressures. In fact, as long as the Fergana has existed as a place, it has always constituted a geographical, political and social whole. Although its population has been characterized during the past centuries by high levels of multiethnicity and linguistic heterogeneity, this did not prevent the societal amalgamation of populations which always held multiethnicity as normality, and always attributed to each "group" a specific social role within the system Fergana. Be they of language and culture persian and sedentary, turk and sedentary or turk and nomadic, these populations always shared, each in its own social role, a common life within the region. This very phenomenon is the main characteristic of what we call the Cultural Regionalism of the Fergana. However, this equilibrium changes with the loss of political sovereignty of the region and the rise of nationalism under the soviet sovereignty. This chapter analyzes the main representation of the actor Cultural Regionalism over time, and how it took stand against the other territorial actors, especially the Nation. The second part of the dissertation as dedicated to the current manifestations of the territorial actors in the Fergana valley, particularly in its border zones. This part results from the interviews and field observation undertaken in Central Asia and the Fergana in 2007, 2009 and 2010. The first chapter analyzes the border of this region from a theoretical point of view, especially in the light of the geostrategical categories of "first line of defence" or "last line of defence". In the context of a transformation of the border from the soviet era to that of the independence, the second chapter explores the definition of the centrasiatic border, mainly through the analysis of border bureaucracy, control posts and documents required to cross the border. The chapter looks at themes connected to the commercial transborder relations : how the "three" Fergana still manage to interact despite growing border rigidity, which social relationships subsist today. The qualitative interviews led in the Fergana are a major source in this process of reviewing the difficulties of passage and communication within the valley, and of tracking the actual presence of the three geopolitical actors which play a major role in the border relations and conflicts. The third chapter focuses on the Ferganian urban centres: their history, the relations that the Ferganians have with them, et above all the internal and external representations of these centres in a now fully transborder region. The fourth chapter concentrates on the demographical evolutions of the Ferganian population. Up until then a land of immigration, the Fergana became a land of emigration following the independence and the materialization of the borders. The fifth chapter deals with the Ferganian infrastructures, especially the rail and road networks, and their relationship of reciprocal influence with the mutation of the borders in the region. The sixth chapter builds on the theoretical interrogations evoked in the introduction of the dissertation and develops a conclusive analysis of the Fergana of the borders nowadays. The conclusion of this research depicts the current Fergana, the relations between the different geopolitical actors and underscores the persistence of the actor Cultural Regionalism. It establishes the existence of tremendous changes in the region Fergana from various viewpoints: the Ferganian population has new frames of cultural, political and social reference whose importance increased dramatically ; new political forms and cultural structures influenced its self-image, its very identity: "russian, muslim, ferganian", then "soviet, uzbek (or tajik or kyrgyz), atheist, ferganian", finally "uzbek (or tajik or kyrgyz), secular, ferganian". However, although the territory, its borders and inhabitants changed, and despite the strong obstacles set by the actor Nation, the cultural regionalism succeeded in maintaining itself, by adapting to the new tendencies and ways of interpretation of the Fergana. The conclusion ends with the most recent events of the Fergana, the Andjian massacre in 2005 and the Osh clash in 2010, which are both analysed in the light of the geopolitical power rivalries which persist in the region. ; XXIII Ciclo
Sabemos que el fútbol es el deporte más practicado en todo el mundo y también el más seguido, por eso es uno de los deportes con más potencial de influencia en la sociedad y el entrenador es su figura más influyente por la acción de liderazgo que promueve junto a los demás, que lo rodean, sobre todo si hablamos de niños y jóvenes. Es el entrenador que puede mantener la práctica del fútbol del lado positivo, donde se pretende que esté y donde debe permanecer, en el fomento de los valores educativos y en el aprendizaje armonioso de la modalidad. Dada la importancia que tiene esta figura en el deporte en general y en el fútbol en particular, es determinante que su formación sea un punto fundamental de sus cualidades, ya que de ella pueden emanar muchas otras competencias, capaces de influir al joven futbolista de forma favorable en todas sus dimensiones. De esta forma, se hace preponderante el estudio sobre la formación del entrenador de fútbol, que todos los días es una pieza importante en el entrenamiento de nuestros jóvenes, no sólo en el capítulo deportivo, sino también en el capítulo social. Comenzamos nuestro trabajo buscando realizar la fundamentación teórica del tema. En una primera parte iniciamos un marco global haciendo referencia a la legislación reciente que rige la figura del entrenador y su formación, revisamos todos los documentos internacionales y nacionales sobre la formación de entrenadores y sus competencias recogiendo la información pertinente. En una segunda parte, más específica, fuimos gradualmente entrando en las características que debe tener el entrenador, en las concepciones de enseñanza y en las necesidades de formación de entre otros aspectos desarrollados. Uno de los grandes objetivos de esta investigación fue el desarrollo de una herramienta válida y fiable para el estudio de la formación de entrenadores que posibilitase su posterior aplicación en Portugal y para permitir la replicación del estudio en diferentes contextos. Para ello construimos un cuestionario que partió del estudio de Abad (2009) y sometemos esa herramienta a un proceso de validación con el objetivo de analizar la formación de los entrenadores de fútbol de base en los clubes de la Asociación de Fútbol de Beja. Hemos diseñado un cuestionario que al final del proceso de validación quedó con 121 ítems agrupados en 8 dimensiones (Características Sociodemográficas, Experiencia Deportiva, Aspectos Personales, Formación como Entrenador, Formación Continua, Concepción de Enseñanza, Planificación y Programación, Necesidades de Formación). Hemos realizado un análisis cualitativo y cuantitativo que se realizó a través de la evaluación de 12 expertos. La validez del contenido fue analizada a través del coeficiente V de Aiken, estableciendo un intervalo de confianza del 99% y el coeficiente de variación. Para establecer la fiabilidad, el cuestionario fue aplicado a 20 entrenadores de cuatro clubes diferentes de la región en dos momentos diferentes, la consistencia interna fue analizada por el método Alpha de Cronbach (0.915) y la fiabilidad test-reteste usando el coeficiente de correlación intraclase resultando 0.890 (p <0.01). Los resultados muestran que el cuestionario reúne suficientes propiedades psicométricas para ser considerado una herramienta válida y fiable para estudiar y analizar las necesidades de formación de los entrenadores de fútbol (Paixão, Abad & Giménez, 2019). En un segundo momento, los cuestionarios construidos fueron aplicados a 124 entrenadores de la región de Beja que estaban trabajando con niños y jóvenes en el fútbol de formación. Esta muestra representó el 91% del total de la población de estudio y a través de un análisis descriptivo e inferencial permitió analizar el perfil del entrenador, su formación y su intervención en los diversos dominios y parámetros. Destacamos algunos resultados como, el hecho de que la mayoría de los entrenadores aún no tienen siquiera el título de entrenador y sólo una minoría tienen una formación superior en el área del deporte; por otro lado, el gusto en entrenar y enseñar es el motivo por el cual los entrenadores están en el fútbol de formación, en lo que se refiere a las estrategias de formación continua: la creación de grupos de trabajo entre entrenadores, la visualización y análisis de juegos y entrenamientos en vídeo, y la participación en talleres prácticos, son las preferenciales; destacamos también que persiste una división entre los métodos directivos y los métodos de descubrimiento, entre otros resultados interesantes. Concluimos con la concreción de los objetivos generales y específicos, la presentación de las implicaciones del estudio, añadimos algunas propuestas de mejora, exponemos las limitaciones del estudio y por último indicamos las perspectivas futuras. ; Sabemos que o futebol é o desporto mais praticado em todo o mundo e também o mais seguido, por isso é um dos desportos com mais potencial de influência na sociedade e o treinador é a sua figura mais influente pela ação de liderança que promove junto dos que o rodeiam, principalmente se estivermos a falar de crianças e jovens. É o treinador que pode manter a prática do futebol do lado positivo, onde se pretende que esteja e aonde deve permanecer, no fomento dos valores educativos e na aprendizagem harmoniosa da modalidade. Dada a importância que detém esta figura no desporto em geral e no futebol em particular, é determinante que a sua formação seja um ponto fundamental das suas qualidades, até porque dela podem emanar muitas outras competências, capazes de influenciar o jovem futebolista de forma favorável em todas as suas dimensões. Desta forma, torna-se preponderante o estudo sobre a formação do treinador de futebol, que todos os dias é uma peça importante no treino dos nossos jovens, não só no capítulo desportivo mas também no capítulo social. Começámos o nosso trabalho procurando realizar a fundamentação teórica do tema. Numa primeira parte iniciámos por um enquadramento global fazendo referencia à legislação recente que rege a figura do treinador e a sua formação, revisámos todos os documentos internacionais e nacionais sobre a formação de treinadores e as suas competências, recolhendo a informação pertinente. Numa segunda parte, mais específica, fomos gradualmente entrando nas características que deve ter o treinador, nas conceções de ensino e nas necessidades de formação de entre outros aspetos desenvolvidos. Um dos grandes objetivos desta investigação foi o desenvolvimento de uma ferramenta válida e fiável para o estudo da formação de treinadores, que possibilitasse a sua posterior aplicação em Portugal e que permitisse a replicação do estudo em diversos contextos. Para esse fim, construímos um questionário que partiu do estudo de Abad (2009) e submetemos essa ferramenta a um processo de validação com o objetivo de analisar a formação dos treinadores de futebol de base nos clubes da Associação de Futebol de Beja. Desenhámos um questionário que no final do processo de validação ficou com 121 itens agrupados em 8 dimensões (Características Sociodemográficas, Experiencia Desportiva, Aspetos Pessoais, Formação como Treinador, Formação Contínua, Conceção de Ensino, Planificação e Programação, Necessidades de Formação). Efetuámos uma análise qualitativa e quantitativa que foi realizada através da avaliação de 12 especialistas. A validade do conteúdo foi analisada através do coeficiente V de Aiken, estabelecendo um intervalo de confiança de 99% e o coeficiente de variação. Para estabelecer a fiabilidade, o questionário foi aplicado a 20 treinadores de quatro clubes diferentes da região em dois momentos diferentes, a consistência interna foi analisada pelo método Alpha de Cronbach (0.915) e a fiabilidade teste-reteste usando o coeficiente de correlação intraclasse resultando 0.890 (p <0.01). Os resultados mostram que o questionário reúne suficientes propriedades psicométricas para ser considerado uma ferramenta válida e fiável para estudar e analisar as necessidades de formação dos treinadores de futebol (Paixão, Abad & Giménez, 2019). Concluímos com a concretização dos objetivos gerais e específicos, a apresentação das implicações do estudo, aduzimos algumas propostas de melhoria, expomos as limitações do estudo e por último indicamos as perspetivas futuras. ; We know that football is the most practiced sport in the whole world and it is also the most followed. So, it is one of the sports with more potential to influence society and the coach is its most influential person by the leadership action that he promotes near those surrounding him, especially if we are talking about children and young people. The coach is the one who can maintain the practice of football on the positive side, where it is intended to be and where it should remain, to foster educational values and to learn the sport in a harmonious way. Considering the importance of this figure in sports in general and in football in particular, it is essential for training to be a fundamental aspect of his qualities, namely because many other skills can emanate from this training, skills which may influence the young player in a favourable way in all its dimensions. Thus, the study on the football coach's training, which usually plays an important part on our young people's training, is not only important in the sports chapter but also in the social chapter. We have started our work by looking at the theoretical basis of the theme. In the first part, we started with a global framework concerning the recent legislation governing the coach and his training, we reviewed all the international and national documents on the training of coaches and their skills, collecting the relevant information. In a second, more specific part, we gradually approached the characteristics that a coach must have, in terms of the concepts of education and training needs among other aspects developed. One of the main objectives of this research was the development of a valid and reliable tool for the study of coach's training, which might allow its subsequent application in Portugal and that might allow for the replication of the study in different contexts. For that purpose, we have created a questionnaire that started from the study by Abad (2009) and we have submitted this tool to a validation process with the aim of analysing the training of base football coaches in the clubs of the Beja Football Association. We have designed a questionnaire that, at the end of the validation process, included 121 items grouped in 8 dimensions (Sociodemographic Characteristics, Sport Experience, Personal Aspects, Training as a Coach, Continuous Training, Teaching Conception, Planning and Programming, Training Needs). We have carried out a qualitative and quantitative analysis that was performed through the evaluation of 12 specialists. The validity of the content was analysed through the Aiken V coefficient, establishing a 99% confidence interval and the coefficient of variation. To establish reliability, the questionnaire was applied to 20 coaches from four different clubs in the region in two different times, the internal consistency was analysed by Cronbach's Alpha method (0.915) and the test-retest reliability using the intra-class correlation coefficient resulting in 0.890 (p <0.01). The results show that the questionnaire gathers enough psychometric properties to be considered a valid and reliable tool to study and analyse the training needs of football coaches (Paixão, Abad & Giménez, 2019). In a second moment, the questionnaires created were applied to 124 coaches from the region of Beja, who were working with children and youth in football training. This sample represented 91% of the total study population and, through a descriptive and inferential analysis, it allowed us to analyse the profile of the coach, his training and his intervention in the different domains and parameters. We highlight some results, such as the fact that most coaches still do not even have the title of coach and that only a minority holds a higher education in the field of sports; on the other hand, the pleasure involved in training and teaching is the reason why coaches are in football training; as far as continuous training is concerned, the preferred strategies are: the creation of working groups between coaches, the visualization and analysis of games and video training, and the participation in practical workshops; we also emphasize that there is still a division between the directive methods and the discovery methods, among other interesting results. We conclude with the achievement of the general and specific aims, the presentation of the implications of the study, we present some improvement proposals, we show the limitations of the study and, finally, we indicate perspectives for the future.
In Italy, Protection System for Asylum Seekers and Refugees (SPRAR) manages the second reception of forced migrants. This organization was founded by the Bossi-Fini law n. 189/2002 and is composed by the network of local governments, which uses the available resources of National Fund for Asylum Policies and Services provided by Government finance law and managed by the Ministry of Interior. Its principal goal is to realize integrated reception projects for refugees, asylum seekers, subsidiary and humanitarian protection holders in order to ensure their socio-economic inclusion within local contexts in cooperation with voluntary and third sector organizations. On 10th July 2014, local governments were signed an agreement between national and regional executive to create a national reception system to face the growing number of people who have arrived on the Italian coasts. The main goal of this system is to overcome only a material reception (food and lodging), in order to offer a "widespread reception" within urban areas. The strategy is to create an individual project and an accompaniment to ensure the integration of each person in the local community. The services provided consist in inclusion of migrants in the national health and scholastic system, orientation and access to other local services, professional training, job placement, legal assistance and social and housing integration . Indeed, it is crucial to emphasize that the Italian reception system is characterized by extreme fragmentation. Only SPRAR provides these services with the goal of enabling social and economic inclusion of hosted people in local context, which is why we talk about second reception centres. In Italy, there are, however, many different types of first and extraordinary reception centres for migrants . They are managed by the prefectures and differ in terms of goals, structural characteristics, services and receptive capacity. Only 18.7% of migrants are hosted in the SPRAR structures, while the remainder incurs the possibility of carrying out the entire procedure of the asylum application in the centres of first and extraordinary reception (IDOS, 2017). In recent years, the Italian reception structures have undergone a reorganization and redenomination phase, in which the SPRAR should have become a reference standard. In fact, this system has positively distinguished itself for its objectives, the structuring of his interventions and many best practices. This did not prevent bad reception occurrences even within SPRAR structures, as well as a large number of violent and verbal conflicts, some of which carried out by Italian citizens to the detriment of asylum seekers and owners of a status of international protection. These episodes, exacerbated by a political and media discourse that represents migrants as a threat (Battistelli et al., 2016), are the consequence and symbol of the fragmentary and contradictory reception policies adopted at a European level, in the individual countries and at a local level (IDOS, 2016). Instability and political, economic and social uncertainty, rulers in this historical period, are manifested in an emergency approach that is characterized by insufficient planning and a lack of coordination between the reception agencies. This orientation, supported by many and incongruent legislative changes, deprives the system of a strong structure and facilitates the overturning of the same principles of "widespread reception" of migrants in local communities. Moreover, this facilitates the affirmation of nationalist, xenophobic and localist drifts, as well as reception situations in which human rights are violated and which do not provide real opportunities for inclusion in the territories in a safe and dignified manner. Therefore, the conceptual distinction of the terms danger, risk and threat, used as the interpretative line of this work, appears fundamental to understand why subjective responses, in terms of perception and actions, differ according to the situations, as well as to manage the effects that derive in a consistent manner (Battistelli e Galantino, 2018). In order to realize the analysis, I decided to use an ethnographic approach that is traced back to the constructivist philosophical paradigm, where the vision of facts is investigated locally. Ethnographers, indeed, study subjects, artefacts and actions in their interactions, from an interpretative-dialectical point of view, without the claim of absolute objectivity of the results (Piccardo and Benozzo, 1996). Then, I have chosen to use focused narrative interviews because they turn to individuals, they aim for their "understanding", and this is part of the renewed interest in the subject's centrality and in the "deliberately intentional" social action (Weber, 1922). It is also an approach that allows investigating deeply the phenomena. It is very interactive, flexible and able to empathize in the perspective of the subject being studied. This makes it easier to interview marginal subjects neglected by "official knowledge" and to rediscover the social function of research, which is "giving voice to those who do not have it" (Crespi, 1985, pp. 351) In addition, observation and fieldwork are supported by a strong theoretical basis that offers its help to the researcher for the understanding of the social world, providing an order that supports they in their critical analysis of the facts. So, empirical work and theory support each other (Silverman, 2002). Then, narrative approach is highly adaptable to the study of organizations and to analyse the collected data. In fact, this approach is characterized for attention given to concrete situations and not to general theorizations (Czarniawska, 2000). Hence, the empirical research carried out in 2016-2018 can be summarized in the following phases: 1- Analysis of secondary data and documents produced by European and national statistical institutes, private associations, protection bodies and by SPRAR itself. 2- Participant observation in: - a political protest demonstration against the opening of a SPRAR centre in XIII Town Hall, on the north-western suburb of Rome; - nine meetings of social operators working in SPRAR network of Rome and in the national CARA and CAS reception centres; - a SPRAR centre (20 reception places increased to 40 in the south-eastern suburbs of Rome, VII Town Hall). One year of observation and shadowing of operators: 16th January 2017 – 22th January 2018; - a SPRAR apartment (14 reception places for families in the residential area of Monte Sacro neighbourhood, Town Hall III). Five days of observation and shadowing of operators in January 2018; - a seminar of reflection organized by SPRAR and ANCI on the reception system in Lazio, focused on the role of the Regions and Municipalities. 3- Forty-one narrative focused interviews: - Twenty-four SPRAR operators working in SPRAR centres of Rome; - Seventeen asylum seekers and refugees from SPRAR centre observed in Town Hall VII of Rome. The intent behind this ethnographic research started in a restructuring phase aimed to make the SPRAR a reference standard of reception for all asylum seekers who came to our country. But it was characterized, as still today, by speculative situations, the high presence on the territory of large collective reception centres and managing bodies without the necessary experience (Olivieri, 2011; Lunaria 2016). Therefore, the analysis of the risk management and the operators perception of the SPRAR of Rome has the objective to unveil and analyse the contradictions and weaknesses that may arise within this model due to a reckless management that produces specific factors of risk. The hypothesis underlying the case study is that, although the SPRAR has been recognized as an ordinary model, it can also be reproduced in a distorted manner, not respecting the reference guidelines. The alteration between SPRAR in books, the theoretical expression of a principle, and SPRAR in action, its implementation (Pound, 1910), is caused by specific factors that can cause significant effects from several points of view. To bring to light these aspects, closely related to the risk management and the perception that its operators have, I achieve a classification of the risks that I applied to three different types of SPRAR structures (large, medium and single apartment). Then, I identified a series of outcomes involving the people hosted, the operators, the local community and the SPRAR organization itself. The decision to draw the case study at the SPRAR of the city of Rome is driven by the complexity that distinguishes this territory on a social, cultural and political level. In fact, I believe it can bring out the contradictions of the model as new forms of confinement compared to territories with reduced complexity. However, allowing a glimpse of a reception of asylum seekers and holders of a protection status also possible within urban and metropolitan areas. The empirical survey shows that an increase in the distortion compared to the assumptions of an integrated and widespread reception in the territories corresponds to a greater possibility that specific risk factors are produced. Which in their turn, crystallizing into unhealthy forms, can involve the people hosted, the operators, the local community and the SPRAR organization itself. The case study and the application of the risk classification, which I achieved based on the evidence revealed from the field, reveal how the identified risk areas (socio-spatial context, production of the service, recipients) and the corresponding categories, do not produce in itself a negative result. However, this can occur if a short-sighted management acts on these aspects and does not align with the proposed guidelines. Therefore, this classification appears to be a useful tool to identify problems and to develop preventive measures, aimed to improve the management of SPRAR centres in metropolitan cities such as Rome (and other contexts), by intervening on the identified risk categories and reducing the factors that eventually emerge. The analysis, focused on three different types of SPRAR structure (large, medium, single apartment) of the Capital, shows how this alteration occurs in a disruptive way in the large collective centres, the most represented in Rome. Meanwhile, greater adherence to the model is shown, with a modality proportional to the size, in the medium-sized structure and in the apartment. The distortion detected in the large SPRAR collective centres of Rome and partly also in the medium-sized centre, reflects the ambivalence of the general reception system. It promotes on the one hand the principles of a good reception that respects human rights and the autonomy of people and by another implements foreclosure practices and new forms of borders (Vacchiano, 2011; Van Haken, 2008). The field research shows that this happens on different levels due to specific material factors (location and capacity of the centres, management of internal spaces, activation of the services provided, etc.) and through the daily practices of the operators who, in a more or less assenting, controlling and disciplining the people hosted, shape their conduct. Therefore, in the daily life of the structures in which the situations described are involved, the principles of freedom, inclusion and autonomy supported by the rhetoric of reception system are governed by a neoliberal logic of citizenship that suggests the criteria to distinguish, in the same integration paths, who is more worthy than other beneficiaries (Van Haken, 2008). Although the case study highlights strong contradictions and weaknesses that come to life in the implementation of the SPRAR model, it also shows the realization of a good reception. That which, despite being included in an extremely complex context such as Rome, attempts to oppose the "logic of large numbers and profits" of large cooperatives and which implements functional inclusion paths to achieve the objectives. Alignment and consistency with the guidelines and the SPRAR operating manual, in fact, allow the construction of a real project of individualized socio-economic integration for the person hosted. Only by acting in a widespread manner on the territory, in apartments or small centres, the genesis of new forms of borders beyond those already present is avoided. In fact, through this management most of the risks identified are eliminated or at least reduced, precisely because the "trajectory of opportunities" of risk (Reason, 1997) towards unfavourable outcomes generally develops within large collective centres. Dottorato di ricerca in Economia e territorio ; Il cambiamento tecnologico comporta una "rimodellatura" e, a volte, un vero e proprio rovesciamento dell'ordine esistente all'interno delle organizzazioni produttive. La conoscenza generata dall'innovazione tecnologica, per essere "assorbita", necessita di un corredo di pratiche organizzative adeguate: per tale ragione è sempre più stretto il processo co-evolutivo tra sviluppo tecnologico e cambiamento organizzativo. Il coordinamento e la gestione delle sinergie e dei feedbacks tra diversi aspetti dell'attività innovativa diventa una specifica linea d'azione strategica per le imprese al fine di ottenere performances economiche superiori. La stretta complementarità tra investimenti in beni tangibili (nuove tecnologie) e intangibili (struttura organizzativa), da cui scaturisce una maggiore crescita della produttività, è il fulcro del nuovo approccio a queste tematiche. L'ipotesi di complementarità nei processi innovativi assume particolare rilievo con l'avvento delle tecnologie ICT, con la loro natura generalista o aspecifica (general purpose technology), il loro carattere ampiamente pervasivo, e l'esigenza connessa di una prestazione a più alto contenuto cognitivo e relazionale (Breshnahan et al. 2002, Brynjolfsson et al., 2000, Brynjolfsson et al., 2002, Bugamelli e Pagano 2004). La penetrazione di queste tecnologie nel tessuto produttivo favorisce lo sviluppo di diversi input complementari e comporta diverse ondate di innovazioni "secondarie" che creano nuovi prodotti e nuovi processi, dando luogo a periodi più o meno prolungati di aggiustamento strutturale che coinvolgono la riorganizzazione aziendale e l'implementazione delle pratiche del lavoro ad alta performance o High Performance Workplace Practices (Breshanan e Trajtenberg 1995). Quest'ultime si esplicitano in una serie di azioni che hanno nell'empowerment delle risorse umane l'elemento centrale, e che si concretizzano nella riduzione dei livelli gerarchici, nell'assunzione generalizzata di responsabilità, nel coinvolgimento dei lavoratori, nello svolgimento di ruoli attivi, nel lavoro in team, nella polivalenza e nella policompetenza, nei sistemi di valutazione della performance e dei suggerimenti dal basso, e infine nelle buone relazioni industriali. La concettualizzazione dell'organizzazione come un insieme di elementi profondamente eterogenei ma complementari risale a Milgrom e Roberts (1990 e 1995) che, dapprima, ne forniscono una definizione basata sulle proprietà di supermodularità della funzione di redditività dell'impresa, e poi modellano il raggruppamento delle pratiche risultanti dalla complementarità tra innovazioni tecnologiche e cambiamenti organizzativi. Implicita nella definizione di complementarità è l'idea che fare di più in una certa attività non impedisce di fare di più in un'altra, contrariamente alla teoria tradizionale dell'impresa in cui l'ipotesi di rendimenti di scala decrescenti può porre dei vincoli alla possibilità di incremento simultaneo delle variabili di scelta dell'impresa. Le analisi empiriche hanno messo in rilievo come frequentemente innovazioni tecnologiche ed organizzative siano adottate congiuntamente e come entrambe influiscano sulle performances delle imprese (Black e Lynch 2000, Bresnahan, Brynjolfsson e Hitt 2002, Brynjolfsson, Lindbeck e Snower 1996, Malone et al. 1994, Pini 2006, Pini et al. 2010). Nel nostro paese gli studi empirici sulle complementarità tra sfere innovative sono ancora pochi. I principali lavori di natura econometrica realizzati, sulla base di limitati campioni di imprese a livello provinciale, sono attribuibili a Cristini et al. (2003 e 2008), Leoni (2008), Mazzanti et al. (2006), Piva et al. (2005), Pini et al. (2010). Un aspetto poco indagato, anche nei lavori citati, è quello dell'interazione tra tecnologie ICT, cambiamenti organizzativi e pratiche lavorative ad alta performance sulla produttività del lavoro, che è proprio l'argomento specifico che ci siamo proposti di indagare. Preliminarmente abbiamo ricostruito il dibattito teorico ed empirico sul ruolo di driver al fine dell'ottenimento di performances superiori delle tecnologie ICT, dei cambiamenti organizzativi e delle nuove pratiche del lavoro, singolarmente presi. In una seconda fase abbiamo verificato l'esistenza di legami virtuosi tra le tre attività innovative e la produttività del lavoro mettendo in evidenza le complementarità tra le sfere innovative. Per questo abbiamo effettuato un'analisi empirica utilizzando due fonti principali: IX e X indagine sulle imprese manifatturiere del Mediocredito Centrale (ora Capitalia) e la Community Innovation Survey (Cis-4) dell'Istat. Questi ultimi dati sono integrati con quelli di bilancio delle imprese società di capitali attive dal 2001 al 2008, con i caratteri strutturali del Registro delle imprese (Asia), con i dati del commercio estero (Coe), e dell'occupazione (Oros). Seguendo il productivity approach, abbiamo ricercato i legami di complementarità eseguendo, con il software STATA 10, una serie di regressioni multivariate, utilizzando funzioni di produzione aggiustate con le strategie innovative e le loro interazioni. I modelli, stimati con la tecnica dell'Ordinary Least Square (OLS), sono differenti a seconda della tipologia di dati disponibili: con i dati Mediocredito si è stimata una funzione di produzione di tipo Cobb-Douglas, per i dati Cis-4 un stimato un modello a effetti fissi tramite una funzione di produzione di tipo Translog. Se il ricorso alla funzione Cobb-Douglas è ricorrente nella letteratura internazionale, soprattutto per stimare gli effetti delle singole strategie innovative sulla produttività del lavoro (Black e Lynch 2001, 2004, Breshnan et al. 2002, Gera e Gu 2004), l'utilizzo di una funzione Translog, è scelta assolutamente non ricorrente in letteratura per quanto riguarda l'oggetto di analisi. A tal riguardo ci si è ispirati al lavoro di Amess (2003), nel quale vengono valutati gli effetti del management buyouts sull'efficienza di lungo termine delle imprese manifatturiere della Gran Bretagna. Inoltre abbiamo testato la presenza di complementarità attraverso l'analisi delle differenze in termini di performance, suddividendo le imprese in base a diverse combinazioni nell'utilizzo delle strategie innovative. Un aspetto da rilevare è che, le nostre analisi realizzate sul panel integrato Cis-4 utilizzano un campione particolarmente numeroso e rappresentativo della realtà industriale italiana, un fatto, come detto, non frequente negli studi sull'argomento condotti nel nostro Paese. I risultati ottenuti dall'analisi di entrambi i campioni sono in linea con i principali studi empirici italiani (Cristini et al. 2003 e 2008, Mazzanti et al. 2006, Pini 2006, Pini et al. 2010), convalidando ampiamente l'ipotesi di un impatto positivo delle tre strategie innovative sull'aumento delle performances produttive delle imprese, anche se implementate singolarmente in azienda. Per quanto riguarda la verifica di un legame di complementarità tra le tre aree innovative emerge, chiaramente un effetto additivo sul valore aggiunto attraverso l'analisi dei differenziali e seguendo l'approccio sulla supermodularità di Milgrom e Roberts (1990, 1995). L'aspetto più rilevante dei risultati ottenuti è costituito dal fatto che alcune variabili diventano particolarmente significative quando le imprese le adottano simultaneamente: ciò vale in particolare per la formazione e la partnership in R&D. L'attività di formazione è associata positivamente alla presenza di tecnologie ICT e all'innovazione organizzativa, intesa come instaurazione di partnership per la R&D. Inoltre dall'analisi sui dati Mediocredito emerge, in conformità alla teoria skill biased technical change, una propensione a domandare lavoratori in possesso di qualifiche più elevate da parte delle imprese che hanno implementato in maniera significativa cambiamenti tecnologico-organizzativi (Berman, Bound e Griliches1994, Breshnan et al. 2002, Draca, Sadun e Van Reenen 2006). ; Technological development results in a "reshaping" and, sometimes, a complete change within existing productive structures. The knowledge brought about by technological innovations, to be incorporated need a wealth of suitable structural procedures: for this reason the evolution between the technological development and the structural change is getting narrower. The coordination and management of the sinergies and feedbacks among the different aspects of the innovative activity becomes a line of strategic action within the companies to obtain superior economic performances. The strict complementarity between investments in tangible goods (new technologies) and intangibles ones ( organization structure), which brings about a better productivity growth, is the pivot of the new approach to these thematics. The complementarity hypothesis in the innovative processes is particularly important with the advent of the ICT technologies, with their general purpose technology, their widely pervesive characters and the associated requirements of a knowledge at a higher contexct. (Breshnahan et al. 2002, Brynjolfsson et al., 2000, Brynjolfsson et al., 2002, Bugamelli e Pagano 2004). The penetration of these technologies in the productive frame favours the development of the different complementary inputs and allows several flows of "secondary" innovations, which creates new products and processes, bringing more or less long sructural adjustments which include the business reorganization and to carry out work documentation at high performance or High Performance Workplace Practices (Breshanan e Trajtenberg 1995). The latter can be explained in a series of actions which have in the human resources empowerment its central element (unit) and which are reliased with the reduction of the hierarchical levels of employment at general responsibility level, bringing in the employees in active running roles, in working as a team with many duties and competence, in the methods of valuing performance and suggesions from below and lastly in good industial relations. La concettualizzazione dell'organizzazione come un insieme di elementi profondamente eterogenei ma complementari risale a Milgrom e Roberts (1990 e 1995) che, dapprima, ne forniscono una definizione basata sulle proprietà di supermodularità della funzione di redditività dell'impresa, e poi modellano il raggruppamento delle pratiche risultanti dalla complementarità tra innovazioni tecnologiche e cambiamenti organizzativi. Implicita nella definizione di complementarità è l'idea che fare di più in una certa attività non impedisce di fare di più in un'altra, contrariamente alla teoria tradizionale dell'impresa in cui l'ipotesi di rendimenti di scala decrescenti può porre dei vincoli alla possibilità di incremento simultaneo delle variabili di scelta dell'impresa. The notion of the organisation as a collection of elements extremely different, but complementary, goes back to Milgrom and Roberts (1990 e 1995) who, at first, gave a definition based on the properties of modular dimensions of the firm income capacity and then they (the set of elements) put together the resulting documentation due to the complementarity between technological innovations and structural changes. Implicit to the complementariety definition, is the idea that to do more in a certain activity does not exclude to do more in another one; this is to the contrary to the firm traditional theory where the hypothesis of decreasing range efficiency can limit the possible simultaneous increase of the firm variable choices. The empiric analysis have put in evidence that often technological and structural innovetions are taken together and that both influence the firms performances (Black e Lynch 2000, Bresnahan, Brynjolfsson e Hitt 2002, Brynjolfsson, Lindbeck e Snower 1996, Malone et al. 1994, Pini 2006, Pini et al. 2010). In our country the empiric studies on the complementarity within the innovative fields are still few. The major econometric works realised, based on limited samples at provincial level are ascribed to Cristini et al. (2003 e 2008), Leoni (2008), Mazzanti et al. (2006), Piva et al. (2005), Pini et al. (2010). The integration within the ICT technologies, stuctural changes, work habits at high performance on work productivity are aspects investigated insufficiently even on the studies already mentioned. This is the specific subject we propose to examine. At first we have reconstructed the theoric and empiric argument on the driver role aiming to obtain performances better than the the ICT technologies, stuctural developments, work habits, each taken individually. In a second phase we have verified the existence of virtual bonds between the innovative activities and labour productivity putting in evidence the complementariety within the innovative areas. For this reason we carried out an empiric analysis using two main sources: IX and X investigation on manufactury firms of Mediocredito Centrale (now Capitalia) and the Community Innovation Survey (Cis-4) by Istat. These last data are put together with the ones of active plc (public limited companies) balances from 2001 to 2008 with structural characteristics according to Companies Register (Asia), foreign trade data (Coe) and employment (Oros). By following the productivity approach we searched complementarity bonds, achieved with software STATA 10, a range of changeble regressions, using production activities related to innovative strategies and their interactions. The samples, based on the Ordinary Least Square (OLS) technique, are different according to the type of data: available with Mediocredito data, we valued a production function of the Cobb-Douglas type; for the Cis-4 was valued a sample at fixed results using a production function of Tanslog type. If going back to the Cobb-Douglas function appears again in the international literature, especially to value the consequences of single innovative strategies on labour productivity (Black e Lynch 2001, 2004, Breshnan et al. 2002, Gera e Gu 2004), the use of a Translog funtion, is chosen absolutely, without going back to literature when referring to the object of the analysis. From this point of view, we were influenced by Amess' (2003) work, where were valued the results of the management buyouts on the long term efficiency of manifacturing industies in Great Britain. Besides we tested the presence of complementarity by using the analysis of the differences based on performance, by dividing the firms according to their different utilization of innovative strategies. An aspect to take into consideration is that, our analysis carried out on the integrated Cis-4 panel utilise a rather special and large sample which represents the Italian industrial reality, a fact, as already mentioned, not common in the studies undertaken in our Country on this subject. The results obtained from the analysis of both samples are in line with the principal Italian empiric studies (Cristini et al. 2003 e 2008, Mazzanti et al. 2006, Pini 2006, Pini et al. 2010), widely confirming the hipothesys of a positive impact within the three innovative strategies on the companies increase of the producteve performances, even if singularly employed by the business. As regards the examination of a complementarity connection within the three innovative areas, emerges clearly an additive effect on its added value using the analysis of the differentials and approching the super modularity of Milgrom e Roberts (1990, 1995). The most important aspect of these results is that some variables become particularly significative when the firms use them simultaneously: this is particularly valid at educational level and partnership in R&D. The activity at educational level is positively associated to ICT technologies and structural innovetions, understood as the setting up of partnership for R&D. In addition from the analysis of Mediocredito data emerges, according to the skill biased technical change theory, a tendency by the companies, which have made significant techinical-structural changes to look for employees with higher qualification levels (Berman, Bound e Griliches1994, Breshnan et al. 2002, Draca, Sadun e Van Reenen 2006).
SENTIERI Project (Mortality study of residents in Italian polluted sites) studies mortality of residents in the sites of national interest for environmental remediation (Italian polluted sites, IPS). IPSs are located in the vicinity of industrial areas, either active or dismissed, near incinerators or dumping sites of industrial or hazardous waste. SENTIERI includes 44 out of 57 sites comprised in the "National environmental remediation programme". For each IPS contamination data were collected, both from the national and local environmental remediation programmes. Contamination data are mainly for private industrial areas; municipal and/or green and agricultural areas were poorly studied, therefore it is difficult to assess the environmental exposure of populations living inside and/or near IPSs. Each one of 44 SENTIERI IPSs includes one or more municipalities. Mortality in the period 1995-2002 was studied for 63 single or grouped causes at municipality level computing: crude rate, standardized rate, standardized mortality ratios (SMR), and SMR adjusted for an ad hoc deprivation index. Regional populations were used as reference for SMR calculation. The deprivation index was constructed using 2001 national census variables on the following socioeconomic domains: education, unemployment, dwelling ownership and overcrowding. A characterizing element of SENTIERI Project is the a priori evaluation of the epidemiological evidence of the causal association between cause of death and exposure. Exposures for which epidemiological evidence was assessed are divided into IPSs environmental exposures and other exposures. The former are defined on the basis of the decrees defining sites' boundaries; they are coded as chemicals, petrochemicals and refineries, steel plants, power plants, mines and/or quarries, harbour areas, asbestos or other mineral fibres, landfills and incinerators. The other exposures, considered for their ascertained adverse health effects are: air pollution, active and passive smoking, alcohol intake, occupational exposure and socioeconomic status. The epidemiologists in SENTIERI Working Group (WG) developed a procedure to examine the epidemiological literature published from 1998 to 2009; the WG identified a hierarchy in the literature examined to classify each combination of cause of death and exposure in terms of strength of causal inference. The selected epidemiological information included primary sources (handbooks and Monographs and Reports of international and national scientific institutions), statistical re-analyses, literature reviews, multi-centric studies and single investigations. This hierarchy relies on the epidemiological community consensus, on assessments based on the application of standardized criteria, weighting the studies design and the occurrence of biased results. Therefore, to put forward the assessment, the criteria firstly favoured primary sources and quantitative meta-analyses and, secondly, consistency among sources. The epidemiological evidence of the causal association was classified into one of these three categories: Sufficient (S), Limited (L), and Inadequate (I). The procedures and results of the evidence evaluation have been presented in a 2010 Supplement of Epidemiologia & Prevenzione devoted to SENTIERI. SENTIERI studied IPS-specific mortality and the overall mortality profile in all the IPSs combined. Some IPS-specific results are noteworthy and are herementioned. The presence of asbestos (or asbestiform fibres in Biancavilla) was the motivation for including six IPSs (Balangero, Emarese, Casale Monferrato, Broni, Bari-Fibronit, Biancavilla) in the "National environmental remediation programme". In these sites (with the only exception of Emarese) increases in malignant pleural neoplasm mortality were observed, in four of them the excess was in both genders. In six other sites (Pitelli, Massa Carrara, Aree del litorale vesuviano, Tito, Area industriale della Val Basento, Priolo), in which additional sources of environmental pollution were reported, mortality from malignant pleural neoplasm was increased in both genders in Pitelli, Massa Carrara, Priolo and Litorale vesuviano. In the twelve sites where asbestos was mentioned in the decree, a total of 416 extra cases of malignant pleural neoplasms were computed. Asbestos and pleural neoplasm represent an unique case. Unlike mesothelioma, most causes of death analyzed in SENTIERI have multifactorial etiology, furthermore in most IPSs multiple sources of different pollutants are present, sometimes concurrently with air pollution from urban areas: in these cases, drawing conclusions on the association between environmental exposures and specific health outcomes might be complicated. Notwithstanding these difficulties, in a number of cases an etiological role could be attributed to some environmental exposures. The attribution could be possible on the basis of increases observed in both genders and in different age classes, and the exclusion of a major role of occupational exposures was thus allowed. For example, a role of emissions fromrefineries and petrochemical plants was hypothesized for the observed increases in mortality from lung cancer and respiratory diseases in Gela and Porto Torres; a role of emissions frommetal industries was suggested to explain increased mortality from respiratory diseases in Taranto and in Sulcis-Iglesiente-Guspinese. An etiological role of air pollution in the raise in congenital anomalies and perinatal disorders was suggested in Falconara Marittima, Massa-Carrara,Milazzo and Porto Torres. A causal role of heavy metals, PAH's and halogenated compounds was suspected for mortality from renal failure in Massa Carrara, Piombino, Orbetello, Basso Bacino del fiume Chienti and Sulcis-Iglesiente- Guspinese. In Trento-Nord, Grado and Marano, and Basso bacino del fiume Chienti increases in neurological diseases, for which an etiological role of lead, mercury and organohalogenated solvents is possible, were reported. The increase for non- Hodgkin lymphomas in Brescia was associated with the widespread PCB pollution. SENTIERI Project assessed also the overall mortality profile in all the IPSs combined. The mortality for causes of death with a priori Sufficient or Limited evidence of causal association with the environmental exposure showed 3 508 excess deaths for all causes, corresponding to 439 per year; the number of excess deaths was 1 321 for respiratory diseases, 898 for lung cancer and 588 for pleural neoplasms. When considering excess mortality with no restriction to causes of death with a priori Sufficient or Limited evidence of causal association with the environmental exposure, the number of excess deaths for all causes was 9 969 (SMR 102.5, about 1 200 excess deaths per year; the excess was 4 309 for all neoplasms (SMR 103.8, about 538 excess deaths per year), 1 887 for circulatory systemdiseases, and 600 for respiratory systemdiseases. Most of these excesses were observed in IPSs located in Southern and Central Italy. The distribution of the causes of deaths showed that the excesses are not evenly distributed: cancer mortality accounts for 30% of all deaths, but it is 43.2% of the excess deaths (4 309 cases out of 9 969). Conversely, the percentage of excesses in noncancer causes is 19%, while their share of total mortality is 42%. SENTIERI is affected by some limitations, such as the ecological study design and a time window of observation possibly inappropriate to account for induction-latency time; the analyzed outcome (mortality instead than incidence) might be unsuitable as well. Despite its limitations, SENTIERI documented increased mortality for single IPSs and an overall burden of disease in residents in Italian polluted sites. These excesses could be attributed to multiple risk factors, that include also the environmental exposures. The study results will be shared with the Ministries of Health and Environment, Regional governments, Regional environmental protection agencies, Local health authorities and municipalities. A collaborative approach between institutions in charge of environmental protection and health promotion will foster, among else, a scientifically sound and transparent communication process with concerned populations. ; Il Progetto SENTIERI (Studio Epidemiologico Nazionale dei Territori e degli Insediamenti Esposti a Rischio da Inquinamento) riguarda l'analisi della mortalit? delle popolazioni residenti in prossimit? di una serie di grandi centri industriali attivi o dismessi, o di aree oggetto di smaltimento di rifiuti industriali e/o pericolosi, che presentano un quadro di contaminazione ambientale e di rischio sanitario tale da avere determinato il riconoscimento di "siti di interesse nazionale per le bonifiche" (SIN). Lo studio ha preso in considerazione 44 dei 57 siti oggi compresi nel "Programma nazionale di bonifica", che coincidono con i maggiori agglomerati industriali nazionali; per ciascuno di essi si ? proceduto a una raccolta di dati di caratterizzazione, e successivamente a una loro sintesi. La maggior parte dei dati raccolti proviene dai progetti di bonifica ipotizzati per i diversi siti, da cui si evince che oggetto di caratterizzazione e di valutazione del rischio sono state prevalentemente le aree private industriali, quelle, cio?, ritenute causa delle diverse tipologie di inquinamento (definite in SENTIERI esposizioni ambientali). Le aree pubbliche cittadine e/o a verde pubblico e le aree agricole comprese all'interno dei SIN sono state poco investigate. I SIN studiati sono costituiti da uno o pi? Comuni. La mortalit? ? stata studiata per ogni sito, nel periodo 1995-2002, attraverso i seguenti indicatori: tasso grezzo, tasso standardizzato, rapporto standardizzato di mortalit? (SMR) e SMR corretto per un indice di deprivazione socioeconomica messo a punto ad hoc. Nella standardizzazione indiretta sono state utilizzate come riferimento le popolazioni regionali. L'indice di deprivazione ? stato calcolato sulla base di variabili censuarie appartenenti ai seguenti domini: istruzione, disoccupazione, propriet? dell'abitazione, densit? abitativa. Gli indicatori di mortalit? sono stati calcolati per 63 cause singole o gruppi di cause. La presenza di amianto (o di fibre asbestiformi a Biancavilla) ? stata la motivazione esclusiva per il riconoscimento di sei SIN (Balangero, Emarese, Casale Monferrato, Broni, Bari-Fibronit e Biancavilla). In tutti i siti (con l'esclusione di Emarese) si sono osservati incrementi della mortalit? per tumore maligno della pleura e in quattro siti i dati sono coerenti in entrambi i generi. In sei siti con presenza di altre sorgenti di inquinamento oltre all'amianto, la mortalit? per tumore maligno della pleura ? in eccesso in entrambi i generi a Pitelli, Massa Carrara, Priolo e nell'Area del litorale vesuviano. Nel periodo 1995-2002 nell'insieme dei dodici siti contaminati da amianto sono stati osservati un totale di 416 casi di tumore maligno della pleura in eccesso rispetto alle attese. Quando gli incrementi di mortalit? riguardano patologie con eziologia multifattoriale, e si ? in presenza di siti industriali con molteplici ed eterogenee sorgenti emissive, talvolta anche adiacenti ad aree urbane a forte antropizzazione, rapportare il profilo di mortalit? a fattori di rischio ambientali pu? risultare complesso. Tuttavia, in alcuni casi ? stato possibile attribuire un ruolo eziologico all'esposizione ambientale associata alle emissioni di impianti specifici (raffinerie, poli petrolchimici e industrie metallurgiche). Tale attribuzione viene rafforzata dalla presenza di eccessi di rischio in entrambi i generi, e in diverse classi di et?, elementi che consentono di escludere ragionevolmente un ruolo prevalente delle esposizioni professionali. Per esempio, per gli incrementi di mortalit? per tumore polmonare e malattie respiratorie non tumorali, a Gela e Porto Torres ? stato suggerito un ruolo delle emissioni di raffinerie e poli petrolchimici, a Taranto e nel Sulcis-Iglesiente-Guspinese un ruolo delle emissioni degli stabilimenti metallurgici. Negli eccessi di mortalit? per malformazioni congenite e condizioni morbose perinatali ? stato valutato possibile un ruolo eziologico dell'inquinamento ambientale a Massa Carrara, Falconara, Milazzo e Porto Torres. Per le patologie del sistema urinario, in particolare per le insufficienze renali, un ruolo causale di metalli pesanti, IPA e composti alogenati ? stato ipotizzato a Massa Carrara, Piombino, Orbetello, nel Basso bacino del fiume Chienti e nel Sulcis-Iglesiente-Guspinese. Incrementi di malattie neurologiche per i quali ? stato sospettato un ruolo eziologico di piombo, mercurio e solventi organo alogenati sono stati osservati rispettivamente a Trento Nord, Grado e Marano e nel Basso bacino del fiume Chienti. L'incremento dei linfomi non-Hodgkin a Brescia ? stato messo in relazione con la contaminazione diffusa da PCB. Ulteriori elementi di interesse sono stati forniti dalle stime globali della mortalit? nell'insieme dei siti oggetto del Progetto SENTIERI. In particolare, ? emerso che la mortalit? in tutti i SIN, per le cause di morte con evidenza a priori Sufficiente o Limitata per le esposizioni ambientali presenti supera l'atteso, con un SMR di 115.8 per gli uomini (IC 904.4-117.2, 2 439 decessi in eccesso) e 114.4 per le donne (IC 902.4-116.5; 1 069 decessi in eccesso). Tale sovramortalit? si riscontra anche estendendo l'analisi a tutte le cause di morte, cio? non solo per quelle con evidenza a priori Sufficiente o Limitata: il totale dei decessi, per uomini e donne, ? di 403 692, in eccesso rispetto all'atteso di 9 969 casi (SMR 102.5%; IC 902.3-102.8), con una media di oltre 1 200 casi annui. Si ritiene opportuno ricordare che il Progetto SENTIERI, per obiettivi, disegno e metodi, rappresenta uno strumento descrittivo che verifica, in prima istanza, se e quanto il profilo di mortalit? delle popolazioni che vivono nei territori inclusi in aree di interesse nazionale per le bonifiche si discosti da quello cause delle popolazioni di riferimento. Ai fini dell'interpretazione dei risultati, si ricorda che la presenza di eccessi di mortalit? pu? indicare un ruolo di esposizioni ambientali con un grado di persuasivit? scientifica che dipende dai diversi specifici contesti; invece, un quadro di mortalit? che non si discosti da quello di riferimento potrebbe riflettere l'assenza di esposizioni rilevanti, ma anche l'inadeguatezza dell'indicatore sanitario utilizzato (mortalit? invece di incidenza) rispetto al tipo di esposizioni presenti, o della finestra temporale nella quale si analizza la mortalit? rispetto a quella rilevante da un punto di vista dell'esposizione. La condivisione dei risultati con i ministeri della salute e dell'ambiente, le Regioni, le ASL, le ARPA e i Comuni interessati consentir? l'attivazione di sinergie fra le strutture pubbliche con competenze in materia di protezione dell'ambiente e di tutela della salute, e su questa base l'avvio di un processo di comunicazione con la popolazione scientificamente fondato e trasparente. Das Schulregister des Kultusministeriums MIUR verzeichnet, dass mehr als jede/r zehnte aller Schüler/innen in Italien keine italienische Staatsbürgerschaft hat, obwohl sie mehrheitlich dort geboren wurden. Zahlreiche Erhebungen weisen für sie im Vergleich zu den italienischen Mitschülern/innen geringere Italienischkenntnisse und weniger schulischen Erfolg auf. Innerhalb dieser explorativen Feldforschung haben Einzelinterviews mit 121 Schülern/innen (5.-8. Klasse) in Turiner Schulen und mit 26 Eltern, sowie die Auswertung von 141 an 27 Italienisch- und Herkunftsprachlehrer/innen verteilten Fragebögen ergeben, dass viele Schüler/innen "zweisprachige Natives" sind, da sie mit Italienisch und einer anderen Sprache aufwachsen. Dieser Polyglottismus, den die Interviewten sehr positiv bewerteten, findet jedoch in der Schulpraxis keine Entsprechung: Gezielte Förderung im Italienischen und der Unterricht der Familiensprache sind meist Wunschdenken. In der Kohorte haben die Schüler/innen mit den besten Italienischkenntnissen einen italophonen Elternteil bzw. kamen im Vorschulalter nach Italien und besuchten dort den Kindergarten. Dagegen sind, wie auch bei den INVALSI-Tests, die in Italien geborenen und die dann die Krippe besuchten, leicht benachteiligt. Was die Familiensprache angeht, verbessert ihr Erlernen die Kompetenzen darin, ohne dem Italienischen zu schaden: Im Gegenteil. Diese Ergebnisse bestätigen die wichtige Rolle der "anderen" Sprache für einen gelungen Spracherwerb. Das MIUR sollte also sein Schulregister mit Sprachdaten ergänzen, um die Curricula im Sinn der EU-Vorgaben umzuschreiben und den sprachlich heterogenen Klassen gezielte Ressourcen und definierte Vorgehensweisen zur Verfügung zu stellen. Mit geringeren Mitteln, im Vergleich zu den jetzigen Kosten für Herunterstufung, Klassenwiederholung und Schulabbruch würde man Schulerfolg, Chancengerechtigkeit und Mehrsprachigkeit fördern, mit positiven Folgen für den Einzelnen sowie für die Volkswirtschaft. ; The Italian Ministry of Education (MIUR) student register records that today in Italy more than one out of ten students is not an Italian citizen, although the majority of them were born there. Several statistical surveys indicate that "foreign" students, when compared to native students, show a poorer performance in Italian and in academic achievement. This exploratory fieldwork carried out in schools in Turin (5th to 8th grade) analyzed data obtained through semi-structured interviews with 121 students and 26 parents as well as 141 questionnaires filled in by 27 teachers of Italian and family language. It showed that many students are "bilingual natives", as they grow up acquiring both Italian and another language; however, despite the fact that the interviewees rate polyglottism positively, schools don't usually offer targeted support in either language. Within the cohort the broadest range of competences in Italian are found first among those with an Italian-speaking parent, then among those who arrived in Italy at pre-school age attending kindergarten there; this latter group shows higher competences than those born in Italy attending nursery there, as also in the INVALSI tests. As far as family language is concerned, data illustrate that its teaching increases its competences without affecting those in Italian: quite the opposite in fact. These results confirm the remarkable role played by the "other" language in successful language education. MIUR is therefore called upon to include also linguistic data in its student register, so as to redefine its curricula according to EU Guidelines, and to identify specific procedures and resources for multilingual classes. This new policy would reduce the current cost of placing students in a lower grade, grade retention and drop-outs, and would promote school success, equal opportunities and multilingualism, with positive consequences both for the individuals and for the national economy. ; L'anagrafe studenti del MIUR registra come oggi in Italia più di uno studente su dieci non è cittadino italiano, pur essendo la maggioranza di loro nata in questo paese. Numerose indagini statistiche mostrano come gli allievi "stranieri" presentino, rispetto a quelli italiani, ridotte competenze in italiano e minore successo scolastico. Questa ricerca esplorativa svolta in alcune scuole di Torino (V elementare-III media) ha analizzato dati ottenuti tramite interviste semi-strutturate a 121 studenti e 26 genitori e 141 questionari compilati da 27 insegnanti di italiano e di lingua di famiglia. Da essa è emerso che molti studenti sono "nativi bilingui", poiché crescono usando l'italiano e un'altra lingua. Questo poliglottismo, valutato dagli intervistati assai positivamente, non si rispecchia però nella prassi scolastica: un supporto mirato in italiano e l'insegnamento della lingua di famiglia sono di regola una chimera. All'interno del campione le più ampie competenze in italiano si trovano fra chi ha un genitore italofono e chi è arrivato in Italia in età prescolare frequentandovi la scuola materna; come constatato anche nei test INVALSI, chi è nato in Italia e vi ha frequentato l'asilo nido è leggermente svantaggiato. Rispetto alla lingua di famiglia risulta che il suo studio porta a migliori competenze in essa, senza nuocere all'italiano: anzi. Emerge quindi il ruolo significativo della lingua "altra" per un'educazione linguistica efficace. L'invito al MIUR è quindi di integrare la propria anagrafe con dati linguistici, così da ridefinire i propri curricula secondo le Linee Guida Comunitarie, individuando procedure e risorse specifiche per le classi multilingui. Con un investimento ridotto, paragonato con il costo attuale dato da retrocessioni, ripetenze e abbandono scolastico, si riuscirebbe a sostenere il successo scolastico, le pari opportunità e il plurilinguismo, con conseguenze positive per i singoli e per l'economia nazionale.
La nozione di "dati personali" è particolarmente ampia nel diritto dell'Unione. La Corte di giustizia ha precisato che comprende, per esempio, "il nome di una persona accostato al suo recapito telefonico o ad informazioni relative alla sua situazione lavorativa o ai suoi passatempi", il suo indirizzo i suoi periodi di lavoro e di riposo nonché le relative interruzioni o pause, gli stipendi corrisposti da taluni enti ed i loro beneficiari, i dati sui redditi da lavoro e da capitale nonché sul patrimonio delle persone fisiche, le banche date sugli stranieri presenti sul territorio. Nei limiti in cui le informazioni riguardano una persona fisica identificata o identificabile, il loro contenuto può riguardare tutti gli aspetti relativi alla vita privata o professionale in una sfera pubblica. La forma può essere scritta, sonora o visiva. Un'altra nozione importante è quella della nozione di "flusso transfrontaliero dei dati" che riguarda la comunicazione diretta "a destinatari specifici". Da questo concetto, è esclusa la semplice pubblicazione online (di dati personali) quali i registri pubblici o i mezzi di comunicazione di massa (giornali elettronici e televisione). In un primo periodo della sua giurisprudenza sulla Carta, la Corte di giustizia si riferisce alla protezione della privacy con un riferimento spesso cumulativo agli artt. 7 e 8 senza riconoscere l'autonomia del "diritto alla protezione dei dati personali"rispetto al "diritto al rispetto della vita privata". Inoltre, sino al momento in cui è emersa la questione delle limitazioni consentite ai diritti previsti dagli artt. 7 e 8, con riferimento all'applicazione dell'art. 52 Carta, la Corte non ha distinto il profilo relativo all'applicazione del principio di proporzionalità, da quello riguardante la violazione dei "contenuti essenziali" dei diritti in gioco. In questo senso particolarmente significativa è il ragionamento della Corte nella sentenza Volker del 2010: si deve ritenere, da un lato, che il rispetto del diritto alla vita privata con riguardo al trattamento dei dati personali, riconosciuto dagli artt.7 e 8 della Carta, sia riferito ad ogni informazione relativa ad una persona fisica identificata o identificabile e, dall'altro, che le limitazioni che possono essere legittimamente apportate al diritto alla protezione dei dati personali corrispondano a quelle tollerate nell'ambito dell'art. 8 della CEDU". Il riferimento all'art. 8 della CEDU sottolinea come il diritto alla protezione dei dati sia considerato semplicemente quale accessorio rispetto al diritto al rispetto alla vita privata previsto dall'art. 7 della Carta. La conservazione dei dati può costituire una limitazione del diritto al rispetto della vita privata e del diritto alla protezione dei dati personali. In parallelo con l'art. 8, par. 2, della CEDU, la Carta riconosce che l'ingerenza di un'autorità pubblica nell'esercizio del diritto al rispetto della vita privata può essere giustificata se necessaria alla sicurezza nazionale, alla pubblica sicurezza e alla prevenzione dei reati. In particolare ai sensi dell'art. 52, par. 1 della Carta, tali limitazioni devono essere "previste dalla legge e rispettare il contenuto essenziale di detti diritti […] nel rispetto del principio di proporzionalità," ed essere necessarie e rispondere a finalità di interesse generale riconosciute dall'Unione o all'esigenza di proteggere i diritti e le libertà altrui. In pratica, ciò significa che le eventuali limitazioni devono essere: formulate con precisione e prevedibilità; necessarie per realizzare una finalità di interesse generale o per proteggere i diritti e le libertà altrui; proporzionate alla finalità perseguita; e conformi al contenuto essenziale dei diritti fondamentali in questione. Pertanto, la protezione dei dati personali prevista dall'obbligo prescritto dall'articolo 8 par. 1 della Carta risulta particolarmente importante per il diritto al rispetto della vita privata di cui all'articolo 7 della stessa Carta. La Convenzione di Roma per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali (CEDU) stabilisce un elevato livello di protezione dei dati personali. Secondo l'art. 8, ogni persona è titolare del diritto al rispetto della sua vita privata e familiare, del suo domicilio e della sua corrispondenza. Sulla base di un'interpretazione estensiva della nozione di "vita privata", sono stati individuati dalla Corte europea principi o diritti propri della materia. In base alla giurisprudenza della Corte EDU, la protezione dei dati ex art. 8 CEDU ha ad oggetto il loro trattamento, che può comprendere diverse operazioni (raccolta, registrazione, conservazione, impiego, trasferimento, divulgazione, rettifica o cancellazione). Il trattamento deve essere compiuto nel rispetto dei principi di legalità, legittimità, temporaneità e proporzionalità. Per ciò che attiene alle limitazioni ammissibili, il requisito fondamentale è la "prevedibilità" e "accessibilità" della legge. L'accertamento di una violazione può dipendere da fattori, quali la qualità, la modalità e la tipologia dei dati e dal diritto di esercitare il diritto di accesso e dalla possibilità di richiesta, di rettifica e cancellazione da parte del soggetto interessato. Sono ammissibili deroghe relative alla sicurezza nazionale o alla prevenzione o alla repressione del crimine. Una particolare categoria è costituita dai dati sensibili (ad esempio stato di salute ed origini etniche) che richiedono specifiche garanzie per evitare qualsiasi forma di discriminazione. Per quanto riguarda la possibilità di interpretare estensivamente la nozione di vita rivata la Corte ha più volte ribadito che: "Private life is a broad term not susceptible to exhaustive definition". Si tratta di un termine ampio non suscettibile di definizione esaustiva. La Corte ha più volte statuito che elementi quali il sesso, il nome, l'orientamento sessuale e la vita sessuale sono elementi importanti della sfera personale (ex art. 8 CEDU). Vi è però anche una zona di interazione di una persona con gli altri, anche in un contesto pubblico, che può rientrare nell'ambito dell'applicazione della "vita privata". Il diritto di identità e sviluppo personale, e il diritto di stabilire e sviluppare relazioni con altri esseri umani può persino consentire di estendere l'ambito di applicazione alle attività di natura professionale o commerciale. Il Trattato di Lisbona ha creato per la prima volta una nuova base giuridica per la protezione dei dati personali nello Spazio di libertà, sicurezza e giustizia, utilizzabile sia per l'armonizzazione legislativa del mercato, che per la cooperazione giudiziaria civile e penale (ex terzo pilastro). Tuttavia, la base giuridica dell'art. 16 del TFUE consente all'Unione europea di adottare direttive e regolamenti per la cooperazione di polizia solo dopo la fine del periodo transitorio di cinque anni, vale a dire alla fine del 2014. La competenza prevista dall'art. 16 del TFUE è una competenza concorrente dell'Unione con gli Stati membri come per tutto lo Spazio di libertà, sicurezza e giustizia (cooperazione in materia di immigrazione, cooperazione civile e penale). In quest'ultimo settore potranno comunque essere previste norme specifiche (Dichiarazione 21 Allegata al Trattato di Lisbona). Infatti, le informazioni nel settore della libertà, della sicurezza e della giustizia vengono scambiate anche per analizzare le minacce alla sicurezza, identificare i trend delle attività criminali o valutare i rischi nei settori correlati. La seconda base giuridica riguarda il settore della politica estera e di sicurezza comune, in cui il TFUE prevede invece solo l'adozione di una decisione ad hoc del Consiglio. La direttiva 95/46/CE costituisce la parte principale della normativa secondaria sulla protezione dei dati personali nel mercato che contiene gli elementi principali della tutela, concretizzando e ampliando il contenuto della Convenzione 108. La direttiva rappresenta un quadro generale completato da strumenti normativi specifici quali il regolamento (CE) n. 45/2001 del Parlamento europeo e del Consiglio, del 18 dicembre 2000, concernente la tutela delle persone fisiche in relazione al trattamento dei dati personali da parte delle istituzioni e degli organismi comunitari e la direttiva 2002/58/CE relativa alla vita privata e alle comunicazioni elettroniche nonchè la libera circolazione di tali dati (in particolare l'art. 41) La direttiva 95/46/CE prevede di promuovere la libera circolazione delle informazioni nel mercato interno; l'armonizzazione di disposizioni essenziali del diritto nazionale; esprime la fiducia reciproca degli Stati membri nei rispettivi sistemi giuridici nazionali. Le disposizioni della direttiva non si applicano ai trattamenti di dati personali effettuati per l'esercizio di attività che non rientravano nel campo di applicazione del diritto comunitario e, comunque, ai trattamenti aventi come oggetto la pubblica sicurezza, la difesa, la sicurezza dello Stato e in materia di diritto penale. A livello del diritto comunitario, la conservazione e l'uso di dati a fini di contrasto dei reati sono stati affrontati per la prima volta dalla direttiva 97/66/CE sul trattamento dei dati personali e sulla tutela della vita privata nel settore delle telecomunicazioni. Detta direttiva ha stabilito, per la prima volta, che gli Stati membri possono adottare le disposizioni legislative che considerano necessarie per la salvaguardia della pubblica sicurezza, della difesa o dell'ordine pubblico (compreso il benessere economico dello Stato ove le attività siano connesse a questioni di sicurezza dello Stato), e per l'applicazione del diritto penale. La direttiva 2002/58/CE relativa al trattamento dei dati personali e alla tutela della vita privata nel settore delle comunicazioni elettroniche riguarda principalmente il trattamento dei dati personali nel quadro della fornitura dei servizi di telecomunicazione. La direttiva contiene norme fondamentali destinate a garantire la fiducia degli utilizzatori nei servizi e nelle tecnologie delle comunicazioni elettroniche. Esse riguardano in particolare il divieto di "spam", il sistema di consenso preventivo dell'utilizzatore (opt–in) e l'installazione di marcatori (cookies). Si accresce la tutela contro i trattamenti invisibili di dati che si attivano ogniqualvolta si accede ad un sito internet. Le norme in materia di Privacy online si rafforzano, quindi, in merito all'uso dei cookies (stringhe di testo che possono anche memorizzare le scelte di navigazione degli utenti) e simili sistemi. Gli utenti di internet dovranno essere maggiormente informati sull'esistenza di tali sistemi e su ciò che accade ai loro dati, potendo così controllarli più facilmente. Anche per i "cookies" devono valere i concetti di informativa e consenso. Ai fini dell'espressione del consenso possono essere utilizzate specifiche configurazioni di programmi informatici o di dispositivi che siano di facile e chiara utilizzabilità per il contraente o l'utente. La direttiva stabilisce come principio di base, che gli Stati membri devono garantire, tramite la legislazione nazionale, la riservatezza delle comunicazioni effettuate tramite una rete pubblica di comunicazioni elettroniche. In particolare, devono proibire ad ogni altra persona di ascoltare, intercettare, memorizzare le comunicazioni senza il consenso degli utenti interessati. Per quanto riguarda la sicurezza dei servizi, il fornitore di un servizio di comunicazione elettronica deve garantire che i dati personali siano accessibili soltanto al personale autorizzato; tutelati dalla distruzione, perdita o alterazione accidentale. Eventuali violazioni devono essere comunicate alla persona interessata, nonché all'autorità nazionale di regolamentazione (ANR). Per garantire la disponibilità dei dati di comunicazione per la ricerca, l'accertamento e il perseguimento di reati, la direttiva stabilisce un regime di conservazione dei dati. La direttiva adotta l'approccio di libera scelta (opt–in) in relazione alle comunicazioni elettroniche commerciali indesiderate, cioè gli utenti devono dare il loro accordo preliminare prima di ricevere queste comunicazioni. Questo sistema di opt–in copre anche i messaggi SMS e altri messaggi elettronici ricevuti su qualsiasi terminale fisso o mobile. Sono tuttavia previste deroghe. A norma della direttiva 2002/58/CE relativa alla vita privata e alle comunicazioni elettroniche in linea di principio tali dati relativi al traffico, generati dall'uso dei servizi di comunicazione elettronica, devono essere cancellati o resi anonimi quando non sono più necessari ai fini della trasmissione di una comunicazione, salvo i casi in cui risultino necessari per la fatturazione, e solo per il periodo necessario a tal fine, o in cui sia stato ottenuto il consenso dell'abbonato o utente. I dati relativi all'ubicazione possono essere trattati soltanto se sono resi anonimi o con il consenso dell'utente interessato, nella misura e per il periodo necessari alla fornitura di un servizio a valore aggiunto. Le modifiche introdotte dalla direttiva 2009/136/CE, in materia di trattamento dei dati personali e tutela della vita privata nel settore delle comunicazioni elettroniche sono finalizzate a promuovere una maggiore tutela dei consumatori contro le violazioni dei dati personali, le comunicazioni indesiderate e lo "spam". A questo proposito, il soggetto tutelato dalle comunicazioni indesiderate e dallo spam viene definito in modo nuovo: "contraente" o "utente" (in sostituzione del concetto di interessato o abbonato). La direttiva data retention ha modificato l'art. 15, par. 1, della direttiva relativa alla vita privata e alle comunicazioni elettroniche, inserendo un paragrafo che esclude che tale normativa si applichi ai dati conservati in base alla direttiva data retention. Secondo tale direttiva (art. 11) gli Stati membri possono adottare disposizioni legislative in deroga al principio della riservatezza delle comunicazioni, tra cui, a talune condizioni, la conservazione, l'accesso e il ricorso ai dati a fini di contrasto. L'art. 15, par. 1, permette agli Stati membri di limitare i diritti e gli obblighi attinenti alla vita privata, anche mediante la conservazione di dati per un periodo di tempo limitato, qualora la misura sia "necessaria, opportuna e proporzionata all'interno di una società democratica per la salvaguardia della sicurezza nazionale (cioè della sicurezza dello Stato), della difesa, della sicurezza pubblica; e la prevenzione, ricerca, accertamento e perseguimento dei reati, ovvero dell'uso non autorizzato del sistema di comunicazione elettronica". La giurisprudenza della Corte di Strasburgo riguardante il bilanciamento della tutela dei dati personali con l'interesse pubblico alla sicurezza in materia di dati conservati dai servizi d'intelligence ha avuto per oggetto i seguenti casi: Rotaru v. Romania; Haralambie v. Romania; Turek v. Slovakia; Segerstedt-Wiberg and O. v. Sweden e Shimovolos v. Russia. In materia di conservazione del DNA: S. and Marper v. United Kingdom e Peruzzo and Martens v. Germany. In materia di conservazione dei dati in speciali banche dati: Bouchacourt; Gardel e M.B. v. France; Khelili v. Switzerland; M.K. v. France; Dalea v. France; E.B v. Austria e Bernh Larsen v. Norway. In materia di controlli e videosorveglianza: Peck v. the United Kingdom; Vetter v. France; Kopke v. Germany e Van Vondel v. Netherlands. La Corte EDU si è occupata di bilanciamento con la tutela della salute nelle sentenze: Armonas v. Lithuania; Gillberg v. Sweden e Avilkina and Others v. Russia. Mentre il bilanciamento con la libertà di espressione e il diritto di reputazione è stato affrontato nelle sentenze: Von Hannover v. Germany; Axel Springer AG v. Germany; Mosley v. United Kingdom e Nagla v. Lettonia. La giurisprudenza della Corte di giustizia in relazione all'esercizio di poteri pubblici si è occupata dei casi: Österreichischer Rundfunk, Huber e YS. Nelle sentenze Commissione c. Germania, Commissione c. Austria e ommissione c. Ungheria, il giudice dell'Unione si è occupato del ruolo delle autorità indipendenti di controllo sui dati e in Volker und Markus Schecke e Commissione c. Bavarian Lager della problematica relativa all'accesso agli atti. In particolar modo le questioni interpretative della direttiva 95/46/CE sono state affrontate nelle sentenze Asociación Nacional de Establecimientos Financieros de Crédito; Deutsche Telekom AG; Institut immobiliere e Ryneš. Copiosa è stata la giurisprudenza sia della Corte di Strasburgo (KU v. Finland; Editorial Board di Pravoye Delo e Shtekel v. Ukraina; Ahmet Yildirim v. Turkey; Animal Defenders International v. United Kingdom; Delfi AS v. Estonia; Times Newspapers Limited v. United Kingdom e Ashby Donald e Neij e Sunde Kolmisoppi) e della Corte di Lussemburgo sulle problematiche poste da internet in relazione alla tutela dei dati personali (SABAM, Promusicae, UPC Telekabel Wien, Digital Rights, Google Spain).
