Tout d'abord envisagées et créées pour régler les différents entre Etats, les institutions du Droit pénal international s'intéressent désormais aux victimes de violations du Droit international humanitaire. Toute personne est passible de poursuite devant la Cour Pénale Internationale nonobstant son statut. Ici, l'immunité des diplomates n'est pas prise en compte, encore moins celle des gouvernants (chef d'Etat, parlementaires, ministres, agents de l'état…) Bien plus, la responsabilité pénale se limite aux personnes physiques et ne couvre pas les personnes morales publiques ou privées. C'est surtout cette dernière compétence qui pose véritablement problème à certains pays. Les uns redoutent l'instrumentalisation de la Cour à des fins politiques et craignent la prolifération de plaintes à l'endroit de leurs leaders ou de leur personnel militaire. Ceux là refusent simplement de ratifier le statut. C'est le cas de la Chine, de l'Inde, d'Israël ou de la Russie. Les autres soutiennent que la compétence reconnue à la Cour de juger des ressortissants d'Etats non parties, y compris des officiels est contraire au droit des traités. C'est le cas des Etats Unis qui entreprennent une croisade contre la CPI en vue d'empêcher l'entrée en vigueur du Statut. Pourquoi toutes ces inquiétudes ? Et quels sont les enjeux géopolitiques que portent cette Cour ?
This paper gives a critical overview of the rules of private international law to be found in the Code of Private International Law adopted in Belgium in 2004 in relation to cross-border commercial contracts. These rules apply in a marginal number of cases due to the priority enjoyed by European rules (such as those found in the Brussels I Regulation and the Rome I Regulation). Nonetheless it is important to analyze whether these rules are well drafted. The analysis reveals serious shortcomings mainly in relation to rules of jurisdiction. On the one hand, the rule pertaining the choice of court agreements gives courts an unnecessary margin of discretion to disregard the agreement of parties. On the other hand, the rule pertaining to the law applicable to agreements, is outdated and based on archaic method of identifying the applicable law.

The context and the conditions under which the media phenomenon has grown so swiftly on a worldwide basis have been analyzed throughout this thesis. On one hand by the study of international information media, on the other by the study of the financial stakes which transformed the communication industry into a powerful actor of the global economy. This major implication of the media in the international system gave rise to the emergence of a worldwide public opinion being now targeted by operations of influence destined to orient hearts and minds with specific contents. Furthermore, States' actions and reactions facing a media phenomenon, now fully part of international relations, and regardless of classical concepts of sovereignty, have been studied in this work. States themselves used media as a propaganda tool to emphasize their ideologies and policies. Besides, the growing involvement of media in military conflicts, as witnesses or now as direct and indirect actors of these wars, has been established. As a result, is the geostrategic impact due to global use of media likely to generate a growing weakness of States facing relentless flows of information especially since legal, economical and technical aspects have favored this situation? Maritime labour markets were initially formed on a national level to provide the nation-states manpower needs for, specially in the military context of the struggle for the seas domination within colonial Europe. With the decolonization, new maritime states could accede to the fiscally and socially competitive flags, precipitating the dismantling of formerly closed national markets. This phenomenon, seen as a manifestation of the globalization process of exchanges and law, led to the trade union to classify the flags of convenience. Can the dismantling of the national maritime labour law lead to the conclusion that an international market would have been substituted to the former? The answer is negative. According to the legal approach of the concept, the exercise of three main prerogatives conditions are required to characterize a labour market. These prerogatives are regulation, inspection and justice. Despite a redistribution of their exercise, originally performed by the flag state, in direction of port state, factors are not met conclude to the existence of an international maritime labour market. However, the study of social maritime conflicts point out new areas of regulation, replacing the national markets by a complex public and private legal framework. ; Des marchés nationaux du travail maritime furent constitués dans le cadre des Etats nations pour répondre à d'importants besoins en main-d'oeuvre, sur le plan militaire et dans la lutte pour la domination des mers au sein d'une Europe coloniale. Est-ce à dire qu'un accord multilatéral est inutile dans ce domaine ? Cette contribution répond à cette question en développant l'hypothèse qu'un besoin de régulation existe à l'échelle multilatérale, mais que la coopération des Etats (le régime international) doit porter sur la sélection et l'orientation des choix de localisation des firmes (transnationales) et non pas simplement sur la promotion et la protection des IDE. Elle décrit le problème d'action collective auquel est confrontée la communauté des Etats à ce sujet avant d'avancer des pistes sur le design d'un tel régime international sur les firmes (RIF). L'argumentaire est construit en 6 parties. La première construit une grille d'analyse des stratégies de localisation des firmes à partir des typologies léguées par la littérature économique. La deuxième partie met en œuvre cette grille sur différents types d'environnement. La troisième en déduit qu'il existe aujourd'hui une "prime" au modèle de l'intégration verticale et aux stratégies de "mondialisation à somme nulle". La quatrième partie aborde les enjeux d'économie politique internationale de la question et avance l'hypothèse d'une configuration de type "querelle de ménage" dont l'enjeu institutionnel est de trancher un problème de répartition des gains potentiels de la libéralisation du capital. The approach in terms of the common good or the global public good is difficult to apply to biodiversity, as it is claimed by states on the basis of sovereignty over their territory and appropriate by industry in a globalised market logic. Moreover, biodiversity conservation/management policies do not have the same content at local and global level. The articulation between international regimes, national policies and local behaviours is at the heart of the definition of cross-sectoral biodiversity governance. ; International audience Notions like "global commons" and "global public goods" do not easily apply to biodiversity because the latter is claimed by the states in the name of sovereignty and apportioned to business companies in the context of a globalised market. International audience ; In a decade, two main changes have transformed the Geographical Indication (GI) political economy: the first related to the market globalisation and the second to public policies in the context following the WTO creation. These changes are inscribed in the general trade of the reform of agricultural policies (prices regulation) and definition and extension of rural and regional policies. This geographical extension of GI-related initiatives introduced new concerns for the implementation of that standard as a tool for global or regional public goods provision of rural development and biodiversity. After presenting the main results of the SINER_GI project, this text analyzes the new market regime implications and positions the project case studies. ; En une décennie, deux changements principaux ont transformé l'économie politique des indications géographiques (IG), l'un lié au marché avec la globalisation et l'autre aux politiques publiques dans le contexte qui suit la création de l'OMC. Cette dynamique s'inscrit dans un mouvement général de réforme des politiques agricoles (suppression de la réglementation publique des prix agricoles) et de définition de politiques rurales et de développement régional. L'extension géographique des initiatives dans les différents Suds a introduit de nouvelles préoccupations et de nouvelles justifications autour de la mise en oeuvre du standard IG comme instrument de politique publique pour la fourniture de biens publics locaux, régionaux ou globaux pour le développement rural, la sécurité alimentaire et la biodiversité. Après avoir présenté les principaux résultats du projet Siner-gi (2005-2008), ce texte présente une analyse du nouveau régime de marché en illustrant l'analyse par le positionnement des cas étudiés dans ce projet.
