The normative basis of the republican conception of justice is freedom as non-domination. This concept of political freedom comprises social relations in equality of power. Non-domination represents the social condition of not being submissive to the capacity of arbitrary interference of others. Republican freedom presupposes the development of human capabilities in their fullness. The potential for human capacity development must be protected by the legal structure of the State. The State has the function of equating the differences of individuals' assets and resources with their institutional structure. It acts to offer the necessary conditions, rights and basic liberties, to individuals in their social and political life. The Republican perspective of Philip Pettit leads to the normative deduction of republican liberty and to demonstrating that the theory of justice has to presuppose the resources necessary for the development of human life in its condition of equality and freedom. The democratic structuring of society presupposes the establishment of social relations that are characterized by the social status of non-domination.

This article aims to analyze the discussion of justice in Book I of Plato's 'Republic'. At first, it should be noted that the way Book I is built makes it very close to the Platonic dialogues of the youth, the controversy remaining in relation to its writing as an independent text or preface deliberately elaborated. In Book I Plato maps the common meanings of justice and deconstructs them in an intellectual path that responds to the traditional notions of morality and to the already degenerated political perspective of the sophists. With this, it signals the need to transcend the domains of mere opinion, in the name of a superior foundation for justice, universal and with a rational seal. The process of conceptual purification and contextual delimitation perpetrated in the first book helps to understand the complex ethical, metaphysical and political-educational reflections of the 'Republic', reason that leads us to infer the essentially propaedeutic character with which Book I it was elaborated.

The interrelationships between regulatory agencies and judicial courts generally have a high impact on social relations. However, there is little empirical research and a need for greater systematization of knowledge from a multidisciplinary perspective. This essay discusses the main tensions between the executive and judicial branches of government in decisions about the regulatory activity. The discussion is facilitated through the main theoretical lenses and previous studies on the application to the phenomena. The relationship between agencies and courts is marked by divisions, and the institutional approach to the regulatory space and reflections stimulated by law and economics theory, among other theoretical approaches, are very useful for interpreting institutional tensions in this relationship. The literature on judicial review of regulatory agency decisions points to factors that explain judicial deference or motivate a more prominent role of courts, as well as on topics related to: a) court involvement with technical and scientific issues; b) efficiency and performance; c) calculated behaviors; d) transaction costs; and e) cost-benefit analysis. A research agenda is suggested to explore the perceptions of key players about regulatory disputes, and factors and conditions that explain judicial deference in different contexts. ; Las interrelaciones entre las agencias reguladoras y los tribunales judiciales son un tema de alto impacto en las relaciones sociales en general, pero aún carecen de investigación empírica y una mayor sistematización del conocimiento desde una perspectiva multidisciplinaria. En esta línea, este ensayo tiene como objetivo llevar a cabo una discusión articulada de las principales tensiones entre el Poder Ejecutivo y el Judicial en las decisiones inherentes a la actividad reguladora, con el apoyo de las principales lentes teóricas y el estado de la cuestión aplicable al fenómeno. La relación entre agencias y tribunales se caracteriza por las dicotomías y el enfoque institucional del espacio regulatorio, y las reflexiones aportadas por el análisis económico del derecho, entre otras lentes de análisis, son muy útiles para interpretar las tensiones institucionales existentes en esta relación. La literatura sobre la revisión judicial de las decisiones de las agencias reguladoras apunta a la investigación de factores que explican la deferencia judicial o motivan un papel más prominente de los tribunales, así como de temas relacionados con: a) participación de los tribunales en cuestiones técnicas y científicas; b) eficiencia y performance; c) comportamientos calculados; d) costos de transacción; y e) análisis de costo-beneficio. Se propone una agenda de investigación que explore las percepciones de los actores clave sobre disputas regulatorias, así como estudios sobre factores y condicionantes que expliquen la deferencia judicial en diferentes contextos. ; As inter-relações entre agências reguladoras e tribunais judiciais constituem tema de alto impacto nas relações sociais em geral, porém, ainda carecem de pesquisas empíricas e maior sistematização do conhecimento, sob uma perspectiva multidisciplinar. Nessa linha, este ensaio tem por objetivo realizar uma discussão articulada das principais tensões entre o Poder Executivo e o Poder Judiciário em decisões inerentes à atividade regulatória, apoiada nas principais lentes teóricas e no estado da arte aplicáveis ao fenômeno. O relacionamento entre agências e tribunais é marcado por dicotomias e a abordagem institucional do espaço regulatório e as reflexões trazidas pela Análise Econômica do Direito, dentre outras lentes de análise, revelam-se bastante úteis para a interpretação das tensões institucionais existentes em tal relacionamento. A literatura sobre revisão judicial de decisões de agências reguladoras aponta pesquisas sobre fatores que explicam a deferência judicial ou motivam um papel mais proeminente dos tribunais, passando também por temas relativos a: a) envolvimento de tribunais com questões técnicas e científicas; b) eficiência e desempenho; c) comportamentos calculados; d) custos de transação; e e) análises de custo-benefício. Propõe-se uma agenda de pesquisa que explore percepções de atores-chave desse ambiente acerca de litígios regulatórios, bem como estudos sobre fatores e condicionantes que explicam a deferência judicial em diferentes contextos.

This paper explores the existence of a close relationship between organic and pro- cedural reforms to the administration of justice and the economy, insofar as this science analyses the decision-making processes under the consideration of the link between goals and scarce means, giving also special attention to how the impro- vement of the administration of justice fosters economic development. For these e ects, the situation of Chile is analyzed. In this country, since the return to demo- cracy, in the early 1990s, several global reforms to the administration of justice have taken place. Links between the reforms of the administration of justice, the economy and the economic development, in Chile, are found in three di erent stages, namely: (1) in the origin and design of the global reforms to the administration of justice; (2) in the reconstruction of the map of the administration of justice; and (3) in the current situation of the administration of justice, their decisions and pending reforms, mainly the civil justice reform. ; El presente trabajo explora la existencia de una estrecha relación entre las reformas, orgánicas y funcionales, a la Administración Justicia y la Economía, en cuanto ciencia que estudia la toma de decisiones en consideración a la revisión de la relación entre nes y medios escasos susceptibles de usos alternativos1, otorgándose, asimismo, una especial atención a cómo el mejoramiento de la Administración de Justicia impacta el desarrollo económico. Para dichos efectos se analiza la situación de Chile, país en que se advierte, a partir del retorno a la democracia, la emergencia de varias reformas globales a la Admi- nistración de Justicia. Los vínculos entre las reformas a la Administración de Justicia y la Economía y el desarrollo económico, en Chile, se mani estan en tres etapas, a saber: (1) en la gé- nesis y diseño de las reformas globales a la Administración de Justicia; (2) en la reconstrucción del mapa de la Administración de Justicia; y (3) en la situación actual de la Administración de Justicia, sus decisiones y reformas pendientes, en especial la Reforma Procesal Civil. ; O presente trabalho explora a existência de uma estreita relação entre as refor- mas, orgânicas e funcionais, à Administração, Justiça e Economia, como ciência que estuda a tomada de decisões em consideração à revisão da relação entre ns e meios escassos susceptíveis de usos alternativos2, outorgando-se, igualmente, uma especial atenção para como o melhoramento da Administração de Justiça impacta o desenvolvimento económico. Para ditos efeitos analisa-se a situação do Chile, país em que se adverte, a partir do retorno à democracia, a emergência de árias reformas globais à Administração de Justiça. Os vínculos entre as reformas à Administração de Justiça e a Economia e o desenvolvimento econômico, no Chile, manifestam-se em três etapas, a saber: (1) na gênese e desenho das reformas globais à Administração de Justiça; (2) na reconstrução do mapa da Administração de Justiça; e (3) na situação atual da Administração de Justiça, suas decisões e refor- mas pendentes, em especial a Reforma Processual Civil.
