This paper tries to highlight how, in spite of the importance of the principles of law, due to the functions they satisfy, they seem to have lost prominence for the legislature and for the judiciary, as well as for universities. Is detrimental to justice, a value that should serve as a guide and to which the law must aspire. Beside the exposure and analysis of the problem, possible solutions are proposed. ; El presente trabajo trata de poner de relieve cómo pese a la importancia que poseen los principios generales del Derecho, por las funciones que cumplen, parecen haber perdido protagonismo tanto para el poder legislativo como para el poder judicial, así como para las Universidades, lo que redunda en perjuicio de la justicia, valor que debe servir de guía y al que ha de aspirar el Derecho. Junto a la exposición y análisis del problema, se proponen posibles soluciones.
RESUMEN: A lo largo de este trabajo se hará un análisis ordenado y general del trato que da el ordenamiento jurídico español al concurso de acreedores, una visión global de su regulación, tramitación, efectos y consecuencias, así como la aplicación jurisprudencial que los órganos judiciales efectúan. Es por ello, que la estructura del presente trabajo puede ser definida en cierto como dual, y ello porque se puede discernir una primera parte dedicada al enfoque legislativo del asunto, y una segunda en que se aborda cómo los jueces resuelven con arreglo al marco anterior los supuestos fácticos que el tráfico mercantil español produce. ; ABSTRACT: The main idea of this work is to offer a wide review of the regulation of the insolvency procedure according to the Spanish Law, this work is meant to be a wide view of that phenomenon, its regulation, proceeding, effects and consecuences, also the application of these in case law. El derecho internacional ha sido reiteradamente cuestionado por su carácter excluyente y sus usos imperiales. Estas críticas describen de manera precisa muchas de sus estructuras y dinámicas. Sin embargo, el derecho internacional puede ser un instrumento útil para proteger los intereses legítimos de los Estados del Sur Global, en general, y de los distintos grupos sociales y culturales que los componen, en particular. El uso estratégico de sus normas y procedimientos pueden contribuir eficientemente a alcanzar estos objetivos. No obstante, para entender el potencial emancipador o de resistencia social que tiene el derecho internacional es necesario complementar las discusiones y críticas teóricas con el examen de las formas concretas a través de las cuales el Sur Global hace uso del derecho internacional para resistir o transformar su realidad social. El artículo, siguiendo esta línea de argumentación, explora la manera como el derecho internacional puede ser usado como una herramienta para proteger los intereses de algunos de los grupos mas vulnerables del Sur Global: las comunidades indígenas y negras culturalmente diversas. Este análisis se hace a partir de un estudio de caso. El artículo examina el proceso que se inicia con la presentación de la acción publica de inconstitucionalidad que se presentó ante la Corte Constitucional colombiana en contra de la Ley General Forestal y que termina con la sentencia C-075 de 2008 que declaró su inconstitucionalidad. El análisis de este proceso se divide en dos partes: en la primera parte se examina la manera como el derecho internacional y el derecho nacional se entretejieron para la protección de los derechos de las minorías culturales colombianas. En la segunda parte, se presentan las razones jurídicas y políticas que explican porqué en Colombia, así como en otros países del Sur Global, el derecho internacional ambiental y el derecho internacional de las minorías culturales pueden ser (y son) usados eficientemente en las Cortes nacionales.Este artículo de investigación hace parte de un proyecto más amplio que tiene como objetivo examinar las relaciones entre derecho de interés público y minorías culturales. ; International law has been repeatedly challenged for its exclusionary character and its imperial uses. These critiques describe many of its structures and dynamics in a precise manner. However, international law may be a useful instrument for protecting the legitimate interests of the States of the Global South in general, and of the distinct social and cultural groups that form them, in particular. Yet, in order to understand international law's potential for emancipation or social resistance, it is necessary to complement theoretical critiques with the examination of concrete forms through which the Global South makes use of international law to resist or transform its social reality. However, this theorization must emerge, at least in part, from the particular experiences that social movements and organizations have had with the use of international law for the defense of their communities, their lands, and their natural resources. This article explores the ways in which international law may be used as a tool to protect the rights and natural resources of some of the most vulnerable groups in the Global South: indigenous peoples and culturally diverse black communities. This analysis proceeds by means of a case study. This chapter examines the strategic litigation project that began when a public action of unconstitutionality was brought before the Colombian Constitutional Court against the General Forestry Law (GFL), and that culminated with ruling C-075 of 2008 declaring the law unconstitutional. The analysis of this strategic litigation project is divided in two parts: the first part examines the way in which international law and national law are interwoven for the protection of the rights of Colombian cultural minorities and of the environment. The second part presents the legal and political arguments that explain why, in Colombia as well as in other countries of the Global South, international environmental law and the international law on cultural minorities may be (and are) used effectively in national courts.
Resumen: Los diferentes modelos constitucionales en la historia de la cultura occidental nos dieron dos formas alternativas de entender el rol del poder judicial y la ciencia jurídica. Uno de esos modelos constitucionales es el Estado de Derecho Legal, que nos lleva a comprender que el juez es un esclavo y un custodio de la voluntad del legislador. El sistema del common law, por el contrario, adopta el Estado de Derecho Constitucional, que es un sistema político que ve a los jueces como los guardianes de los más altos principios sociales plasmados en la Constitución y configuran la identidad de esa sociedad. La Teoría General del Derecho debe depender, y debe ser una proyección, de esa configuración. En el caso de Argentina, existe un conflicto entre el modelo constitucional, su historia y las tradiciones académicas. ; Abstract: The differents constitutional models in the history of occidental culture, gave us two alternative ways to understand the role of the justice. One of those constitutional models is the Legal State of Law, that bring us the understanding that the judge is a slave and the guard of parliamentary will. The common law system, conversely, adopts the Constitutuional State of Law, wich is a political system that sees the judges as the guards of the highest social principles captured in the Constitution and configures the identity of that society. The General Theory of Law must depend, and should be a projection, of that configuration. In the case of Argentina, there is a conflict between the constitutional model, its history and the academical traditions.
En el sistema legal interno, el papel del poder judicial en el campo de la legislación está creciendo, lo que junto con las autoridades legislativas y ejecutivas, complementan la regulación legal existente, llenando los vacíos y eliminando situaciones de inseguridad jurídica. Durante muchos años, el precedente judicial ha sido negado en la teoría del derecho soviético, aunque ha habido intentos de justificar teóricamente la creación y aplicación de precedentes judiciales (práctica judicial) por parte de los órganos judiciales superiores. Esta pregunta sigue siendo insuficientemente estudiada y aplicada al sistema legal de la Rusia moderna. ; In the domestic legal system, the role of the judiciary in the field of lawmaking is growing, which, along with the legislative and executive authorities, supplement the existing legal regulation, filling in the gaps and eliminating situations of legal uncertainty. For many years, judicial precedent has been denied in the Soviet theory of law, although there have been attempts to theoretically justify the creation and application of judicial precedent (judicial practice) by higher judicial bodies. This question remains poorly understood and applied to the legal system of modern Russia.
On the occasion of the recent legislative changes contained in the Ordered Text of law 27444, Law on General Administrative Procedure, the legal nature of the most recent exemptions of administrative liability is analyzed. Likewise, a count is made of the exemptions that already existed in the environmental legislation and how they had been operating; in order to see the points of contact between a subjective liability regime, based on guilt, and a relative, risk-based objective liability system.
On July 12, 2012, the Colombian legislator handed over to the country the law 1564 of that same year, by means of which it issued the General Code of Procedure (hereinafter Cogepro) and issued other provisions. The full validity of this law took place from January 1, 2016.The academics who were part of the code drafting commission and other prominent jurists presented the law to the general public as the modernizing provision of procedural law and that which would finish introducing orality in civic, family, commercial, and however, due to the dynamics achieved in judicial practice as of the date of delivery of this paper for review, this can become an illusion of more than many that abound in the country, and of course the ratification of that said which expresses that in Colombia "the law is fulfilled, but it is not obeyed".The previous diagnosis has multiple causes, one is that Cogepro unjustifiably maintained provisions that are not in keeping with its spirit and contained some that, because of their imprecision, have allowed an interpretation that is not in line with the new judicial procedures; in addition, to the fact that there are within the judicial community, officials who at times by ignorance and others by rebellion do not apply the new provisions. It is also a matter of the little success of the new Code, that litigants have not sufficiently trained themselves in new ways of civil prosecution, conveying complacency with the way judges prosecute.With the lines of this article we intend to draw attention to some of the points that we have identified as problematic in the application of the new law, and also to launch a proposal so that if it contains something useful be taken into account not only for one future legislative reform, but also as a hermeneutical criterion for judicial operatives, because many of the things we indicate here start from a normative interpretation of the same procedural work, different from those that have begun to make a career in our offices Judicial proceedings in detriment of the legislative intention embodied in the explanatory memorandum of that norm, which we consider as fleeing to the Code of Civil Procedure ; El 12 de julio de 2012 el legislador colombiano entregó al país la Ley 1564 de ese mismo año por medio de la cual expidió el Código General del Proceso (Cogepro) y dictó otras disposiciones. Using as a reference the 1970 General Education Act, as well as other earlier and later education laws, I address the evolution of adult education from the 19th century to the present day, exploring three great challenges essential for the implementation of a credible and viable educational policy: a) Specific educational offer versus compensatory and substitute character; b) Differentiated pedagogy versus school model; and c) Legislation on the educational universe versus formal and official educational system. This analysis, in which legislation is contrasted with educational achievements and with the theories of authors, leads us to conclude that, throughout more than two centuries of existence, in Spain there has been no educational policy whatsoever in the area of adult education. There are several reasons for this fact: because the growth that this educational sector has experienced is unknown, and the personal, cultural, economic, social, and political benefits of this reality are not known; because the laws have been limited to the regulation of the formal and official educational system, leaving out a good part of the education that adults have and carry out; and because the pedagogical concept that justifies it has not transcended society or the competent institutions in the field. ; Utilizando como referencia la Ley General de Educación de 1970, así como otras leyes educativas españolas anteriores y posteriores, se aborda la evolución que ha experimentado la educación de personas adultas desde el siglo XIX hasta la actualidad, analizando tres grandes desafíos que consideramos imprescindibles para la implantación de una política educativa creíble y viable en este campo: a) Oferta educativa específica versus carácter compensatorio y sustitutorio; b) Pedagogía diferenciada versus modelo escolar; y c) Legislación sobre el universo educativo versus sistema educativo formal y oficial. Dicho análisis, en el que se contrasta la legislación con las realizaciones educativas y con las teorizaciones de autores, nos lleva a concluir que, a lo largo ya de más de dos siglos de existencia, en España no ha habido política educativa alguna en materia de educación de las personas adultas. Y todo ello por varias razones: porque se desconoce el crecimiento que ha experimentado este sector educativo, ignorando asimismo los beneficios personales, culturales, económicos, sociales y políticos que tiene esta realidad; porque las leyes se han limitado a regular el sistema educativo formal y oficial, dejando fuera buena parte de la educación que tienen y realizan las personas adultas; y porque la concepción pedagógica que lo justifica no ha trascendido a la sociedad ni a las instituciones competentes en la materia.
This article recreates from a historical perspective the constructive evolution of the general principles of Law in the Cuban legal ideology prior to 1959. For a thorough understanding of the subject under analysis, the discourse is constructed from a philosophical approach around the problematic between the naturalist and positivist positions about the Law and its influence on the mainstream phenomenon. In order to provide exhaustive notes, three major courses of interpretation of the general principles of Law in the prerevolutionary Cuban reality are assumed: doctrinal, legislative and jurisprudential. ; El presente artículo recrea desde una perspectiva histórica la evolución constructiva de los principios generales del Derecho en el ideario jurídico cubano anterior a 1959. Para una cabal comprensión del asunto sometido a análisis, el discurso se construye desde un enfoque iusfilosófico en derredor de la problemática entre las posturas naturalistas y positivistas en torno al Derecho y su influjo en el fenómeno principalista. A fin de brindar notas de exhaustividad se asumen tres grandes derroteros de plasmación de los principios generales del Derecho en la realidad cubana prerrevolucionaria: el doctrinal, el legislativo y el jurisprudencial. ; Cet article retrace historiquement l'évolution constructive des principes généraux du droit dans l'idéologie juridique cubaine avant 1959. Pour une compréhension approfondie du sujet analysé, le discours est construit à partir d'une approche iusphilosophique de la problématique existente entre les positions naturaliste et positiviste autour de la loi et leur influence sur le phénomène principal. Afin de fournir une analyse exhaustive, trois grands courants d'expression des principes généraux du droit dans la réalité pré-révolutionnaire cubaine sont assumés: la doctrine, la législation et la jurisprudence.
