The immovable property taxes have a long tradition in the modern tax system, as well in the Hungarian regulation. They are now an important revenues of the Hungarian municipalities,but this taxation is now primarily an area-based system. First of all, the traditions of the property taxation and the current regulation on property taxes will be reviewedby the article. A tax system of a modern democracy which is based on the rule of law requires the high quality of the tax administration. Therefore in the second part of the article the quality of the Hungarian tax system and the quality of the local taxation will be reviewed. In the third part of the article the main problems and the failed reform attempts of the Hungarian property taxation and the barriers to the implementation of the ad valorem system will be reviewed. Finally, the main findings of the review will be summarized. ; Podatki od nieruchomości mają długą tradycję w nowoczesnych systemach podatkowych, w tym także w przepisach węgierskich. Stanowią istotne źródło dochodów dla węgierskich gmin, jednakże obecnie system opodatkowania opiera się przede wszystkim na wielkości powierzchni. Po pierwsze, w artykule omówiono tradycyjne rozwiązania z obszaru opodatkowania nieruchomości oraz obecne regulacje w zakresie podatków od nieruchomości. System podatkowy nowoczesnej demokracji, oparty na rządach prawa, wymaga obecności wysokiej jakości administracji podatkowej. Dlatego też w drugiej części artykułu odniesiono się do jakości węgierskiego systemu podatkowego oraz opodatkowania na poziomie lokalnym. Trzecia część artykułu została poświęcona najważniejszym problemom oraz nieudanym próbom zreformowania węgierskiego systemu opodatkowania nieruchomości, a także barierom, stojącym na drodze do wdrożenia katastralnego systemu podatkowego.

The aim of this paper is to present the current systems of immobile property taxation in the states of the Visegrad Group. In Europe, beside the systems which base on the value of the property, characteristic of the vast majority of the EU, there are also surface area and mixed systems occurring, They are still in force, even though since the beginning of the 1990s it has been noticeable in Central Europe that the systems based on the area of the real estate are abandoned in favor of the taxes on the its value. In Poland, Czechia and in Slovakia the area still dominates as the basis for taxation, and the value functions in reference to certain types of immobile property only. It is similar in Hungary, where local governments are not interested in the systems based on the property value, even though they have such a choice. Why are they these countries where the reforms of property taxes has not been implemented yet, despite numerous declarations and prepared concepts? This article is an attempt to anser the question. ; Głównym celem artykułu jest przedstawienie obowiązujących w państwach Grupy Wyszehradzkiej systemów opodatkowania nieruchomości. W Europie obok systemów bazujących na wartości nieruchomości (ad valorem), charakterystycznych dla zdecydowanej większości państw UE, funkcjonują także systemy powierzchniowe i mieszane. Obowiązują one nadal, chociaż już od początku lat 90. ubiegłego wieku daje się zauważyć w Europie Środkowej odchodzenie od systemów odnoszących się do powierzchni nieruchomości na rzecz opodatkowania wartości nieruchomości. W Polsce, Czechach i na Słowacji w dalszym ciągu dominuje powierzchnia jako podstawa opodatkowania, a wartość funkcjonuje jedynie w odniesieniu do niektórych rodzajów nieruchomości. Podobnie jest na Węgrzech, gdzie samorządy nie są zainteresowane wyborem systemów opartych na wartości nieruchomości, chociaż mają taką możliwość. Dlaczego akurat w tych państwach nie zrealizowano jeszcze reformy systemów opodatkowania nieruchomości? Niniejszy artykuł jest próbą odpowiedzi na to pytanie.

This article aims to open the debate on the recurrent property tax in the Czech Republic, to define most important problems of the existing legal regulation and to set the list of possible solutions de lege ferenda. The hypothesis that the immovable property tax is a good tax and a traditional part of the Czech tax system, was confirmed. The most problematic issue is the low tax revenue. However, ad valorem system does not seem to be the solution and the unit system (area) tax base should be retained. There should be one maximum tax rate in the legislation for every type of property, and municipalities should have the right to introduce their own specific tax rates below that level. At the same time, there should be another rate (standard rate) in the legislation for those municipalities that do not set their own specific tax rates. ; Niniejszy artykuł ma na celu zainicjowanie debaty na temat pobieranego okresowo podatku od nieruchomości w Republice Czeskiej, a także wskazanie najważniejszych problemów, jakich nastręczają obowiązujące przepisy prawne, oraz zaproponowanie możliwych rozwiązań de lege ferenda. Potwierdzono hipotezę, że podatek od nieruchomości jest podatkiem korzystnym i stanowi tradycyjny element czeskiego systemu podatkowego. Najbardziej problematyczną kwestią są niskie dochody podatkowe. Podatek katastralny nie wydaje się jednak skutecznym rozwiązaniem i dlatego należy utrzymać system, w ramach którego podstawę opodatkowania nieruchomości ustala się w oparciu o wielkość powierzchni. Ustawodawstwo powinno przewidywać jedną maksymalną stawkę podatkową dla każdego typu nieruchomości, natomiast gminy powinny mieć prawo do ustalania własnych stawek podatkowych poniżej tego poziomu. W przepisach prawa powinna także funkcjonować dodatkowa (standardowa) stawka podatkowa, obowiązująca w gminach, które nie ustalają własnych stawek podatkowych.

The aim of this article is to assess the surface area and value property taxation on the example of Poland and Germany. The analysis refers to the theoretical concepts in the literature, other research and it also includes such criteria as macroeconomic efficiency (fiscal meaning), the issues of fairness, neutrality and technical elements. We noticed a greater fiscal significance of real property taxation in the cadastral system. Nevertheless, our analysis does not give an explicit answer to the question which tax system is better. Either of them has its own strengths and weaknesses. The choice depends on the social factors and political decisions that may, but do not need to be derived from the financial needs of local government units. ; Celem artykułu była ocena powierzchniowego i wartościowego opodatkowania nieruchomości na przykładzie Polski i Niemiec. W analizie odwołaliśmy się do teoretycznych koncepcji zawartych w literaturze oraz do innych badań, a także uwzględniliśmy takie kryteria, jak makroekonomiczna efektywność (znaczenie fiskalne), kwestie sprawiedliwości i neutralności oraz elementy techniczne. Zauważyliśmy większą istotność fiskalną opodatkowania nieruchomości w systemie katastralnym. Niemniej przeprowadzona przez nas analiza nie daje jednoznacznej odpowiedzi na pytanie, który system opodatkowania jest lepszy. Każdy z nich ma swoje zarówno mocne, jak i słabsze strony. Wybór zależy od czynników społecznych i decyzji politycznych, które mogą – ale nie muszą – być pochodną potrzeb finansowych jednostek samorządu terytorialnego.

Establishing legal forms of nature conservation entails a restriction on the right of ownership and other property rights. For this reason, the legislature introduced in the Act of 27 April 2001 on Environmental Protection Law solutions allowing for the purchase of real estate or payment of damages. The provisions of the Environmental Protection Law set out an administrative-judicial procedure of claiming for remedying a damage caused by the legal operation of the public administration related to the protection of environmental resources. This procedure is based on the fact that a claim, essentially of a civil nature (a claim for remedying a damage caused by restricting the use of property) is pursued in two stages – the first in an administrative proceeding in which the administrative authority issues a decision and in the second, where the case is decided by a general court. The first stage is obligatory, in the sense that in the event of a dispute for compensation, the aggrieved party must apply to the administrative body for compensation. The second is initiated as a result of the action of the party dissatisfied with the compensation awarded by the administrative body. ; Ustanowienie prawnych form ochrony przyrody wiąże się z ograniczeniem prawa własności i innych praw rzeczowych. Z tej przyczyny ustawodawca wprowadził w ustawie z dnia 27 kwietnia 2001 r. – Prawo ochrony środowiska rozwiązania umożliwiające domaganie się wykupu nieruchomości lub zapłaty odszkodowania. Przepisy ustawy Prawo ochrony środowiska przewidziały administracyjnosądowy tryb realizacji roszczenia o naprawienie szkody wywołanej legalnym działaniem administracji, związanym z ochroną zasobów środowiska. Tryb ten polega na tym, że roszczenie co do zasady o charakterze cywilnym (roszczenie o naprawienie szkody spowodowanej ograniczeniem sposobu korzystania z nieruchomości) jest dochodzone w dwóch etapach: 1) w postępowaniu administracyjnym, w którym organ administracji wydaje decyzję, oraz 2) w postępowaniu, w którym orzeka sąd powszechny. Pierwszy etap jest obowiązkowy w tym sensie, że w razie sporu o odszkodowanie poszkodowany musi wystąpić do organu administracji o ustalenie odszkodowania. Drugi natomiast jest inicjowany na skutek powództwa strony niezadowolonej z przyznanego przez organ administracji odszkodowania.

This article is a comparative analysis of the legal nature and the rights and obligations of parties concluding property insurance contracts under the provisions of the Maritime Code and the Civil Code. When navigating a ship, the shipowner conducts a business commonly referred to as the operation of a ship, which includes, inter alia, its use for business purposes. The shipowner business is therefore an economic activity and the owner is the entrepreneur who runs his business which s/he is liable for. It is his/her broad interest to insure permanent assets of his/her company against damage as well as his/her civil liability. As the text indicates, s/he is treated by the legislature more severely than a person conducting a standard property insurance. In addition, the legal nature of the policy, due to the requirements of maritime traffic, differs from that from the Civil Code. The purpose of this study is to identify the key differences between the two regulations.

Artykuł przedstawia zmiany systemowe wprowadzone w Polsce po 1989 r., które umożliwiły przejście z gospodarki centralnie sterowanej do wolnorynkowej. Podjęcie głębokich i szerokim reform o charakterze prawnym, gospodarczym i społecznym pozwoliło na ukształtowanie demokratycznego ustroju po wielu latach sprawowania władzy komunistycznej. Transformacja systemowa była możliwa dzięki znaczącym przemianom podstaw prawnych, począwszy od zmian w ustawie zasadniczej, określającej istotę prawa własności i obowiązek jego poszanowania, poprzez uchwalenie innych aktów prawnych koniecznych do zmiany stosunków własnościowych (takich jak ustawy o komercjalizacji i prywatyzacji przedsiębiorstw państwowych, prawa o działalności gospodarczej czy ustawy o gospodarowaniu nieruchomościami rolnymi). Równoległe reformy systemu bankowego oraz polityki pieniężno-kredytowej umożliwiły napływ kapitału zagranicznego i pozwoliły na rozwój prywatnej przedsiębiorczości. W wyniku przemian ustrojowych, jakie zaszły w ostatnich 25 latach, Polska jako demokratyczne państwo prawa jest członkiem Unii Europejskiej, a polska gospodarka rynkowa staje się coraz bardziej konkurencyjna. Niestety, mimo głębokich przekształceń w sferze własnościowej, Polska przez ostatnie ćwierćwiecze nie rozwiązała kwestii zwrotu prawowitym właścicielom własności przejętej bezprawnie przez władze komunistyczne. ; This paper presents structural changes that took place in Poland after 1989, and which enabled its transition from a centrally planned economy to a market economy. The deep and thorough legal, economic and social reforms undertaken in that period made it possible, after years of communist rule, to shape a new, democratic system. The systemic transformation was possibleowing to some basic amendments to the Constitution, including the articles defining the essence of ownership and the duty to respect it, as well as the adoption of other legal acts necessary to re-define ownership relationships (such as the law on commercialisation and privatisation of state-owned enterprises, or the law on the management of agricultural property). The concurrent reforms of the banking system and the monetary and credit policy enabled inflow of foreign capital and development of private entrepreneurship. As a result of the transformations of the past 25 years, Poland is now a democratic state and a member of the European Union, while Polish economy is getting increasingly competitive. Sadly enough, despite these substantial structural transformations in the ownership sphere, in the last quarter of the century Poland has continued to be unable to resolve the problem of returning to the lawful owners the property taken by the communist regime.

Reprivatization is one of the problems Polish politicians have failed to solve for 15 years. They developed nearly a score of drafts of reprivatization acts, none of which has been implemented. Election campaigns and government changes most frequently obstructed them. This happened to the draft developed by Hanna Suchocka's government, later withheld by the next government of Waldemar Pawlak and the coalition of SLD-PSL (Democratic Left Alliance – Polish People's Party). The coalition AWS-UW (Solidarity Election Action – Freedom Union) was very likely to launch reprivatization. Although it had the required majority in the Parliament, the political disputes inside the Solidarity Election Action prevented reprivatization. For the Solidarity Election Action with Marian Krzaklewski, general endowment was to ensure the victory to the party and himself in the next parliamentary and presidential elections respectively. As a result of the internal disputes, the reprivatization act was vetoed by President Kwaśniewski and the elections marked the AWS's collapse.
