TREATMENT OF INTERNATIONAL BUSINESS IN SERBIA // TRETMAN INTERNACIONALNOG BIZNISA U SRBIJI
The international business has been consistently represented in the world economy for more than 150 years and has been continuously increasing and strengthening all the time, making it today the most important economic and globalization factor that undoubtedly dominates the world economy. It is characterized primarily by the so-called. multinational corporations that operate through their affiliates in several countries with the main goal of maintaining and increasing their profits. They are now present practically in all countries of the world, and it is estimated that their business activities now contribute to generating the global GDP of about 75%. Such a progressive multinational business generally bases itself on highly competent management and the use of the latest and increasingly productive technologies as a materialized expression of the development of applied economic and social sciences. Within all this, regarding the world-established freedom of movement of capital and labor, national states are making increasing efforts to regulate the breakthrough and functioning of an international business in their territories in the interest of their progress.In this context, in order to regulate the operation of the international business, it has been selected to study the treatment of international business in Serbia, as a small transition country, with the results thus obtained being representative for all the countries of the present day. Consequently, the focus of these studies is the attitude of the state of Serbia and its higher education towards the emerging international business. In this paper, with the help of an adequate questionnaire and respondents from higher education institutions, the attitude of the state and higher education towards the international business is considered, where adequate breakthrough of the positive and inert suppression of the negative activity of that business is ascertained. The positive treatment of this business is reflected in the state stimulation of its attraction in order to raise the level of GDP and employment, while the negative sides refer to the insufficient protection of national economic entities, the poor protection of the available natural resources, and the insufficient study of that business in higher education system of Serbia.On this basis, the paper presents suggestions that the state of Serbia and its higher education should even more constructively treat international business in the function of its further economic prosperity. Of course, all these results are not representative for Serbia only, but practically for all other countries.

(Un)success of social reforms
Social reforms had an important position in the process of transition changes in Serbia in the previous decade. Their strategic framework and aims have been defined in the first years after the 'democratic changes' of 2000 and their realization followed by a series of problems. The transition from the 'socialist welfare state' to the concept of 'active social policy' has been in compliance with the accepted model of (liberal) reforms and changes in the institutional sphere. Analysis of effects and achievements have pointed to an inadeaqucy of the accepted model and deficiencies in the practice. From the point of view of the current situation and expected changes in the future, there is an obvious need for a comprehensive evaluation of cause of (un)success of social reforms. The reason for that lies in the elimination of insufficiencies and creation of a basis for the construction of a system in compliance with the national objectives, the European standards and global challenges.

Корупција и одговорност правних лица за кривична дела ; Corruption and responsibility of legal persons for criminal acts
Корупција представља једну од најважнијих тема међународне политике сузбијања криминалитета. Управо нас она упућује, заједно са савременим облицима коруптивног деловања, на потребу увођења одговорности правних лица за дела корупције. Дуго година владајућа максима societas delinquere non potest, која је одбацивала идеју о кривичној одговорности правних лица, у савременом кривичном законодавству је доведена у питање. О неопходности законског уређења проблематике одговорности правних лица за кривична дела говоре многобројни међународни документи које је наша земља ратификовала и на тај начин преузела обавезу имплементације норми међународног права. Овом приликом проблематизујемо питање које се односи на одговорност правних лица за кривична дела и кривичноправно сузбијање корупције. На овом месту размотрићемо да ли је потребно да се говори о кривичној одговорности правних лица, или је примереније терминолошки и са становишта теорије говорити о казненој одговорности правних лица. ; Corruption is considered a social problem not only in Serbia. This phenomenon is given more and more attention at the international level as well. This primarily means coordinated efforts in opposing this obstacle and threat to the development of every country. It is surprising how material-criminal legal norms were narrowly determined in the field of one of the most important topics of international and national policy of crime suppression. For decades, and particularly thanks to sensations of the last years, the practitioners, especially those in the field of judiciary and police, have been warning of corruption and the need of its suppression and limiting. The connection between corruption and organized crime has intensified even more the discussions on counter measures that could be incorporated into the existing laws and remove their weaknesses. Every country should undertake a number of measures and activities in the field of battle against corruption taking into account the international standards in this field. These measures may be of preventive or repressive character. This paper deals with criminal legal intervention that represents ultima ratio, i.e. the last resort that should not be used until all other means and manners to protect someone have been exhausted. Our legislator has responded in the meantime, removed the most important flaws that distort the picture about our criminal legal regulations and incriminated corruptive behaviour, taking into account at that the obligations undertaken based on international conventions. Very delicate field of the responsibility of legal persons for criminal act remains unregulated. In this paper we point out to the need and state the reasons, with parallel study of the achieved solutions in some countries and Anglo-Saxon and continental legal culture, why the issue of responsibilities of legal persons for acts of corruption and even more widely should be regulated by a separate law.

IMPACT OF SOCIAL CAPITAL ON THE DEVELOPMENT OF DEMOCRACY
This paper introduces the concept of social capital as a valuable social resourcewhich is accumulated and developed via activities of civil society organizations: through reciprocal relationships as well as through relations with the domain of political power. Civil society, as the institutional actor of political participation, is in a relationship with social capital, which, to a great extent, improves the political, economic and cultural aspects of societies – those with consolidated democracy and institutions, as well as post communist societies with nonconsolidated democracy. Strengthening and development of civil society has a positive impact on the strengthening and development of social capital and vice versa. On the other hand, social capital lays a solid foundation and a base for the growth and strengthening of civil society, thus raising citizens' awareness about political participation which is an indispensable ingredient of the development of democracy. By depicting norms, networking and trust, as well as by distinguishing bonding from bridging social capital, this paper is going to portray the subject matter of social capital which is "utilized" by the citizens' and stakeholders' effi cient collaboration, thus contributing to democratic development. The stability of developed social capital facilitates the development of political participation and enhances democratic development.
