Georgia leads the nation in probation supervision, which has been the subject of recent legislative reforms. Probation supervision is the primary mechanism for monitoring and collecting legal financial obligations (LFOs) from people sentenced in Georgia courts. This Article analyzes how monetary sanctions and probation supervision intersect in Georgia using quantitative data from the Department of Community Supervision as well as interviews with probationers and probation officers gathered as part of the Multi-State Study of Monetary Sanctions between 2015 and 2018. Several key findings emerge: (1) there is substantial variation between judicial districts in the amount of fines and fees ordered to felony probationers in Georgia, with fines and fees in rural areas much higher than those in urban areas; (2) probationers express fear of incarceration solely for lack of ability to pay; (3) probation officers consider collecting LFOs as a distraction from their true mission of public safety; and (4) both probationers and probation officers question the purpose, effectiveness, and fairness of monetary sanctions in Georgia. This Article concludes with a discussion of reforms to date and further options for reform based on the findings from this research.
The article analyzes and reveals the peculiarities of the legal provision of licensing of educational activities of institutions of higher education as one of the main instruments of state regulation of educational activities and ensuring the quality of educational services. Systematized and analyzed regulatory legal acts regulating the organizational structure of licensing educational activities ofinstitutions of higher education, monitoring of the licensing bodies for compliance with licensing conditions for conducting educational activities and state supervision over the activities of licensing bodies. As a result of the analysis, inconsistencies in the wording of individual legal acts were identified to each other, the shortcomings of certain provisions of regulatory acts and the proposed vision of the author regarding the introduction of amendments to legislative acts on the reform of the organizational structure of the licensing of educational activities. ; В статье осуществлен анализ и раскрыты особенности правового обеспечения лицензирования образовательной деятельностиучреждений высшего образования как одного из основных инструментов государственного регулирования образовательной деятельности и обеспечения качества образовательных услуг. Систематизированы и проанализированы нормативно-правовые акты, регулирующие организационную структуру лицензирования образовательной деятельности высших учебных заведений, осуществления контроля со стороны органов лицензирования за соблюдением лицензионных условий осуществления образовательной деятельности и государственного надзора за деятельностью органов лицензирования.В результате анализа определены несоответствия в формулировках отдельных нормативно-правовых актов друг другу, освещены недостатки отдельных положений нормативно-правовых актов и предложено видение автора о внесении изменений в законодательные акты в части реформирования организационной структуры лицензирования образовательной деятельности. ; У статті здійснено аналіз та розкрито особливості правового забезпечення ліцензування освітньої діяльності закладів вищої освіти як одного з основних інструментів державного регулювання освітньої діяльності та забезпечення якості освітніх послуг. Систематизовано та проаналізовано нормативно-правові акти, що регулюють організаційну структуру ліцензування освітньої діяльності закладів вищої освіти, здійснення контролю з боку органів ліцензування за дотриманням ліцензійних умов провадження освітньої діяльності та державного нагляду за діяльністю органів ліцензування. В результаті аналізу визначено невідповідності у формулюваннях окремих нормативно-правових актів один одному, висвітлені недоліки окремих положень нормативно-правових актів та запропоноване бачення автора щодо внесення змін до законодавчих актів в частині реформування організаційної структури ліцензування освітньої діяльності.
This paper conceptualizes the somewhat neglected constitutional and constitutive roles of Article 114 TFEU in the establishment and functioning of EU integrated market supervision mechanisms. Relying on a virtually unlimited interpretation of that provision by the Court of Justice, EU institutions and Member States have been able to design an institutional 'supranational operational support' narrative that allowed for the expansion of supranational agencies as extensions of national supervisory bodies operating in an EU integrated administration framework. This paper submits that this interpretation of Article 114 TFEU incorporates a template within which a nascent ius commune underlying the organization and operationalization of EU internal market supervision mechanisms can effectively take shape. That template allows for circumvention of some infamous agency delegation limits and grants Member States and national authorities a more direct role in a supranational system of integrated administration. In doing so however, new constitutional problems are created that have not been adequately addressed by the post-Lisbon Treaty framework. This paper identifies those problems and their impact on the emergence of integrated EU market supervision structures.
В статье рассматривается развитие правового регулирования кредитных организаций как необходимое условие для выхода из финансового кризиса. Одним из путей преодоления финансового кризиса является усиление банковского надзора. Банковский надзор усиливается, в частности, посредством применения кураторства в отношении кредитных организаций, получивших финансовую помощь в рамках государственных антикризисных мер. В целях повышения эффективности антикризисных мер государство должно сочетать усиление банковского надзора с мерами, способствующими выходу банков из состояния финансовой неустойчивости, например, путем повышения ликвидности банков.The article describes the following issues: development of legal regulation of the credit organizations as a necessary condition to overcome the financial crisis; tightening the banking supervision as one of the key measures to prevent the financial crisis; the banking supervision is becoming stricter, particularly central bank curators are being employed in the banks which have received anti-crisis aid from the Government; directions of raising the efficiency of the anti-crisis measures undertaken by the state: stricter rales in the field of banking supervision have to be combined with measures of strengthening the financial stability of the banks, e.g. stimulating the liquidity of the banks.
Although not directly tied to the foreign debt problem, the recent loss of congressional confidence in United States bank regulatory agencies caused by the failure of the Continental Illinois Bank may also compel reevaluation of the Act. The purported failure of the regulators to discover the extent of Continental Illinois' imprudent loans has led several legislators and regulators to call for greater supervision of lending institutions. This Recent Development will briefly examine the International Lending Supervision Act of 1983, including the regulatory scheme that predated the Act and the restrictions the Act places on the private banking industry in the United States. It then will comment on the Act's major drafting infirmities and the need for additional regulatory requirements not included in the Act.
Abstract. The problem of elaborating the comprehensive state policy on regulatory and legal provision of the financial security at all levels of economy is significantly important for Ukraine. It is crucial to ensure development and implementation of the legislative framework that would determine the types of internal and external threats to the stability of financial activity and the means of counteracting these threats; the full power and responsibility of state authorities concerning the financial and legal regulation aimed at warranting order in financial sphere; the mechanism of financial control organization as the means of preventing financial offences. The aim of the research is to outline the essence of new threats to the economic and financial security of the state under modern economic conditions and search for the required mechanisms and means of regulatory and legal provisioning of the financial security of Ukraine. In the course of research, the general scientific and theoretical methods have been applied. These include systemic analysis (for defining the object and the subject of research); abstract and logical method (for preparing the scientifically justified generalizations and conclusions about the essence, the mechanism of provisioning financial security of the state, and the factors that designate it); graphic method (for representing visually the mechanism of ensuring financial security of the state). The article introduces improvements to the list of modern internal and external threats to the financial and economic security of the state with respect to the immanent nature of the World Band and the International Monetary Fund. It has been emphasized that the new list of indicators and sources of initial information about the constituent components of financial security should be developed and approved because the current list was outlined in the end of 2013 and does not take into account modern realia. It is necessary to determine the functions of the Ministry of Economy of Ukraine in the realm of monitoring and regulating financial stability of the state, particularly in the real economy sector. It has been specified that scientific development of the range of problems related to the methodology and legal regulation of the state security provisioning, as well as the means and methods of preventing and mitigating the threats, is tightly connected with the development of macroprudential supervision and regulation under the aegis of the National Bank of Ukraine. The introduction of new indicators by the Bank (such as the level of non-performing loans, the financial stress index, and others) is the positive step. Nonetheless, the large quantity of private indicators interferes the process of elaborating the set of measures for financial and legal regulation of the financial security level. The new methodological approach to development of the integrated indicator of financial stability at the macro level has been suggested. The research results enable the possibility of improving the mechanism of state financial security and justifying the set of measures for its reinforcement. The review and improvement of the current legal framework in the area of financial and regulatory economic security, and development of the new integrated indicator of financial security level are necessary. Проблема створення цілісної державної політики нормативно-правового забезпечення фінансової безпеки на всіх рівнях економіки є надзвичайно актуальною для України. Існує доцільність розробки та впровадження законодавства, що визначало би види внутрішніх та зовнішніх загроз стабільності фінансової діяльності та засоби протидії цим загрозам; повноваження та відповідальність органів державної влади щодо фінансово-правового регулювання з метою забезпечення порядку у фінансовій сфері держави; механізм організації фінансового контролю як засобу попередження фінансових правопорушень. Мета дослідження — виявлення сутності нових загроз економіко-фінансовій безпеці держави в сучасних умовах господарювання, а також пошук необхідних механізмів та заходів нормативно-правового забезпечення фінансової безпеки України. У процесі виконання дослідження використано загальнонаукові теоретичні методи: системний аналіз — для з'ясування об'єкту та предмету дослідження; абстрактно-логічний метод — для здійснення науково-обґрунтованих узагальнень та висновків про сутність, механізм забезпечення фінансової безпеки держави та фактори, що її визначають; графічний метод — для наочного представлення механізму забезпечення фінансової безпеки держави. У статті удосконалено перелік сучасних внутрішніх та зовнішніх загроз фінансово-економічній безпеці держави з урахуванням іманентної сутності Світового банку та МВФ. Наголошено, що необхідно розробити та затвердити новий перелік індикаторів та джерел вхідної інформації за складовими фінансової безпеки, бо діючий перелік затверджено ще наприкінці 2013 року і не враховує сучасних реалій. Необхідно визначити функції Міністерства економіки України щодо моніторингу та регулювання фінансової стабільності держави, зокрема її реального сектору економіки. Встановлено, що наукова розробка низки проблем, що стосуються методології та правового регулювання забезпечення безпеки держави, а також заходів та методів попередження та нейтралізації загроз тісно стикається з розвитком макропруденційного нагляду та регулювання під егідою Національного банку України. Позитивним є запровадження банком нових індикаторів (рівень непрацюючих кредитів, індекс фінансового стресу та ін.). Проте велика кількість приватних індикаторів заважає виробленню заходів з фінансово-правового регулювання рівня фінансової безпеки. Запропоновано новий методологічний підхід до розробки інтегрального показника фінансової стабільності на макрорівні. Результати дослідження дозволяють поліпшити механізм фінансової безпеки держави та обґрунтувати систему заходів стосовно її зміцнення. Перегляд та удосконалення чинної правової бази в галузі фінансово-нормативної економічної безпеки, розробка нового інтегрального показника рівня фінансової безпеки. Finance and Development Supervisory Agency (BPKP) is one of the institutions stipulated in Presidential Regulation of the Republic of Indonesia No. 192 of 2014 in charge of organizing government affairs in the field of state/ regional financial supervision and national development. This research raises several problems which include: First, what is the form of regulation of BPKP's authority in legislation related to audits in calculating state financial losses in the case of corruption crime. Second, how is the legal standing of the BPKP Representative of West Sumatra Province in calculating state financial losses in the decision Number: 31/Pid.Sus/TPK/2017/PN Pdg on behalf of the defendant Vera Aldilla Roza, ST related to corruption crime in Padang District Court. This is a normative juridical research which applied an approach to legislation (statute approach) and to the case (case approach). This research used a technique in the form of a library study that utilized primary, secondary, and tertiary legal materials. The legal materials were then analyzed qualitatively to answer the problems discussed in this research. Based on the results of the research, it was concluded that the legal standing of BPKP was in the executive power. In this case, the regulation of authority related to calculating state financial losses contained in the legislation, i.e. Presidential Regulation No. 192 of 2014 concerning BPKP. In addition, this authority was strengthened by the Decision of the Constitutional Court Number: 31/PUU-X/2012 dated October 23, 2012. The legal standing of BPKP, in calculating state financial losses in the case of procurement of medical devices at Health Office of Pesisir Selatan Regency, was as auditor. The judge was guided by the calculation of state financial losses carried out by BPKP and used it as a basis for consideration of decisions.

Brexit is not only a historical chapter of the British - EU relationship, but it also carries immense challenges for fi nancial market stability in the short and medium run for the 28 member states of the European Union. The scale of these challenges depends heavily on the outcome of EU-UK negotiations. The European Systemic Risk Board plays a critical role in macroprudential supervision, a crucial policy challenge for the EU. However, there are doubts as to whether it will fulfill its mandate. The EU27 faces major problems in terms of prudential supervision after Brexit since a very large part of their wholesale banking markets are in the UK and thus will not be regulated by the EU after 29 March 2019. Indications point to a considerable risk of a new transatlantic banking crisis in the future.

Public procurement is one of the key points of contact between public administration and the economy, while the amount of public resources is a possible source of conflict of interest and corruption. The article aims to contribute to improvements in public procurement legislation and practice. The article examines the practice of supervisory bodies and assesses the frequency of violations of the principle of transparency. The main findings of the article are that over the years of application of the Public Procurement Act in versions ZJN-2 and ZJN-3, the number of violations of the basic principle of transparency increased - the most frequent violations concerning discriminatory criteria set by the contracting authorities and their implementation in the selection phase - and that local municipal bodies violated the principle of transparency more often than state bodies.
