ÖZETÇalışmanın amacı, hiperenflasyonist sürecin teorik bazda ve gerçekleştiği ülkelerde incelenmesi ve enflasyonist süreç ile mücadele etmek için uygulanan istikrar politikalarının etkinliğinin analizidir. Sözkonusu incelemenin ardından Türkiye'de enflasyon olgusunun tarihsel süreç içerisinde gelişimi ve enflasyon ile mücadelede uygulanan istikrar politikaları hakkında bilgi verilip; bir model uygulaması ile Türkiye'de enflasyonist sürecin nedenleri amprik olarak ortaya konmaya çalışılmıştır.Hiperenflasyonist süreç ile ilgili olarak yapılan teorik çalışmaların ortaya koyduğu genel yaklaşım, aylık bazda 'leri aşan oranların hiperenflasyon olarak kabul edilmesidir. Dışsal şoklar (savaşlar ve uluslar arası krizler), siyasi zafiyet ve bütçe açıklarının para basılarak kapatılmaya çalışılması hiperenflasyonun nedenleri olarak görülmüştür. Sürecin görüldüğü ülkeler bu yaklaşımı doğrulamaktadır. Hiperenflasyonist süreç ile mücadelede sıkı para ve maliye politikaları temelli; heteredoks, ortodoks, monetarist ve IMF destekli istikrar politikaları uygulamaya konmuştur. İsrail gibi başarılı örnekler mevcutken, başarısızlıkla sonuçlanan programlar daha çoktur. İstikrar süreci demokratik ortamlarda uygulandığı gibi demokratik olmayan dikta yönetimler altında da uygulanmıştır. Türkiye, 24 ocak 1980 İstikrar Programı ile bir dönüşüm sürecine girmiş ve pek çok reform gerçekleştirilmiştir. İçsel dengesizlikler sonucunda Nisan 94 Krizi ile yeni bir istikrar programı uygulanmaya başlanmıştır. Kur kontrolü sağlandığı halde enflasyon düşürülememiştir. 1997 Asya Krizi ve 1998 Rusya Krizleri istikrar sürecini olumsuz etkilemiş ve Ocak 2000'de yeni bir program uygulamaya konmuştur. Kasım 2000 ve Şubat 2001 Krizleri ile süreç aksamış ve Güçlü Ekonomiye Geçiş Programı yürürlüğe girmiştir. Program ile devlet ekonomi ilişkilerinde yeni bir süreç hedeflenmiş ve devletin üstlene geldiği faaliyetlerden uzaklaşmaya çalışılmıştır. Ekonometrik model uygulaması ile döviz kuru, bütçe açığı, ödemeler dengesi, para arzı, faiz oranları ile enflasyon arasındaki ilişki incelenmiştir. Döviz kuru ile enflasyon oranı arasında güçlü bir ilişkiye ulaşılmıştır. Bu bağlamda enflasyon ile mücadele de döviz kurunun istikrarı sağlanmalıdır. SUMMARYThe purpose of the study is the research of hyperinflationist process on theoretical basis and in the occured countries and the analysis of the effectiveness of the stabilization policies applied for disinflation process. After the so-called research, the information was provided about the development of the inflation phenomenon in Turkey in the historical process and the stabilization policies applied during the disinflation and the reasons of the inflationist process were tried to be revealed ampirically.The general approach revealing the theoretical studies concerning the hyperinflationist process is the assuming the rates exceeding 50 % on monthly basis as hyperinflation. eksternal shocks (wars and international crisis'), political inanition and the print of the banknote to close budget deficits are considered as the reasons of hyperinflation. The countries which the process happens confirm the approach.In the struggle against hyperinflation process, very strong monetary and fiscal policies based, heteredox,ortodox ,monetarist and IMF supported stabilization policies were applied. While there are successful examples such as Israel, the unsuccessful examples are much more. While the stabilization process was applied in democratic places, it was also applied under the dicta governance, Turkey has penetrated into a transformation process with the Stabilization Policy in January 24, 1980 and many reforms were held. Due to internal imbalance, a new stabilization policy were applied with the April 1994 crisis. In spite of the fact that Exchange rate control was secured, it was failed to comb the inflation. The 1997 Asia and the following 1998 Russia crisis' affected the Stabilization Process negatively and a new program was put into force in 2000. The process was interrupted by the November 2000 and Febreuary 2001 crisis' and therefore The Transition Program to Strong Economy was put into force.A new process was targeted with the program and strived to get rid of the activities that the government undertook. The relation among the foreign exchange rate,budget deficit, balance of payments, money supply, interest rates and the inflation were studied with the Econometric model application. A strong relation was found between foreign exchange rate and inflation rate. Hence, for disinflation, the stabilization of foreign exchange rate must be achieved.
Küreselleşme sürecinin, hemen her alanda yarattığı dönüşümler şüphesiz sivil toplumun ve sivil toplum kuruluşlarının da kapsamını değiştirmektedir. Sivil toplum kuruluşları, yönetişim modelinin ortaya atıldığı günden beri karar alma aşamalarında daha aktif rol oynayarak etkin çalışmalar hayata geçirebilmektedir. Uluslararası kuruluşlarca yönetişim modelinin önerilmesinin arka planında yatan başlıca sebeplerden birini, doğal dengenin bozulması ve etkilerini tüm dünyada hissettirmesi oluşturmaktadır. Bu noktada ise her bir aktörün çevresel sürdürülebilirliğe yapacağı katkı çok değerli olmaktadır. Günümüzde kurumlar çeşitli sorunların altından tek başına kalkmaya çalışmaktadır. Bu da çevre gibi çözümünde her geçen dakikanın önem arz ettiği sorunların, çok yönlü bakış açısıyla değerlendirilemediği, etkin olmayan ve gecikmiş çözümlerin hayata geçirilmesine neden olmaktadır.Türkiye'de doğanın korunması hususunda sivil toplum kuruluşları zamanla daha fazla çalışma yürütmeye başlamıştır. Sivil toplum kuruluşlarının yürüttüğü bu çalışmaların etki alanını arttırabilmesi, gerçek anlamıyla "sürdürülebilir" çevresel gelişmelerin ortaya koyulabilmesinde kamu kurumlarıyla iş birliği büyük bir önem taşımaktadır. Bu çalışmada yönetişim modelinin Türkiye'deki yansımaları, çevre alanında çalışan sivil toplum kuruluşları üzerinden ele alınmıştır. Bu çalışmada sivil toplum kuruluşlarının, çevresel sürdürülebilirlik için varlığının gerekliliği ve önemini ortaya koyabilmek amaçlanmıştır. Bu kapsamda Türkiye'de faaliyet gösteren çeşitli sivil toplum kuruluşları ile yarı yapılandırılmış mülakatlar gerçekleştirilerek bu sivil toplum kuruluşlarının çevresel sürdürülebilirlik adına üstlendikleri roller ele alınmıştır. Aynı zamanda sivil toplum kuruluşları ve belediye iş birliğinin, doğanın korunmasına ve sürdürülebilirliğe katkısı değerlendirilmiştir. Bu doğrultuda belediye ve sivil toplum kuruluşu ortaklığında yürütülmüş olan bir proje örneklendirerek ortaya atılan amaç pekiştirilmeye çalışılmıştır. Bu projeyle birlikte hem belediyenin hem de sivil toplum kuruluşunun bu iş birliğine neden ihtiyaç duyduğunu ve bu iş birliğiyle hangi iş kolunun ya da hangi durumların daha etkin hale geldiğini gösterebilmek amaçlanmıştır. Çalışmanın veri toplama yönetimini, literatür araştırması, görüşülen kurumların incelenen faaliyet raporları, web siteleri, bültenleri ve kuruluşlarla yapılan yarı yapılandırılmış mülakatlar oluşturmaktadır. Tez çalışmasında ulaşılan sonuçlar açısından Türkiye'de çevre sivil toplum kuruluşları, alanlarında önemli çalışmalar yürütmekte; yönetişim modelinin gelişmesiyle birlikte sivil toplum kuruluşları daha fazla söz sahibi olabilmektedir. Bu süreçte birçok belediyenin tutumu farklılılık gösterse de sivil toplum kuruluşlarıyla iş birliğine açıktırlar. Bu da doğrudan karar alıcı organların ve sivil toplum kuruluşlarının dahil olduğu etkin bir çevresel yönetişimi beraberinde getirmektedir. Çevrenin korunması hususunda etkili çözümler sunan belediye ve sivil toplum kuruluşları iş birliği, aynı zamanda her kuruma kendi kapasitesini geliştirebilme imkanı da sağlamaktadır. --- The transformations created by the globalization process in almost every field undoubtedly change the scope of civil society and non-governmental organizations. Since the day the governance model was introduced, non-governmental organizations have been able to play a more active role in the decision-making stages and implement effective activities. One of the main reasons underlying the proposal of the governance model by international organizations is the deterioration of the natural balance and its impact all over the world. At this point, the contribution of each actor to environmental sustainability is very valuable. Today, institutions are trying to deal with various problems alone. This leads to the implementation of ineffective and delayed solutions that cannot be evaluated from a multi-faceted perspective, such as the environment, where the problems of which every passing minute is important.Non-governmental organizations for the protection of nature in Turkey has started to work more execution time. Cooperation with public institutions is of great importance in order to increase the impact area of these activities carried out by non- governmental organizations and to reveal "sustainable" environmental developments in the real sense. Reflections in Turkey is handled through civil society organizations working in the environmental field. It was aimed to put forward the necessity and importance of the existence of non-governmental organizations for environmental sustainability. Semi-structured interviews with various non-governmental organizations operating in Turkey was carried out in this context. The roles of these non- governmental organizations in the name of environmental sustainability were examined. At the same time, the contribution of non-governmental organizations and municipal cooperation to the protection of nature and sustainability was evaluated. In this direction, the aim was tried to be reinforced by exemplifying a project carried out in partnership with the municipality and non-governmental organizations. With this project, it is aimed to show why both the municipality and the non-governmental organization need this cooperation and which business line or situations have become more effective with this cooperation. The data collection management of the study consists of the literature research, the analyzed activity reports of the interviewed institutions, websites, bulletins and semi-structured interviews with organizations. Non- governmental organizations is carrying out important work in the field of environmental in Turkey. With the development of the governance model, non- governmental organizations can have more say. Although the attitudes of many municipalities differ in this process, they are open to cooperation with non- governmental organizations. This brings about an effective environmental governance involving direct decision-making bodies and non-governmental organizations. The cooperation of municipalities and non-governmental organizations, which offer effective solutions in the protection of the environment, also enables each institution to develop their own capacities.
Dünya'nın çeşitli bölgelerinde yaşanan iç çatışmalarda tarafları harekete geçiren temel motivasyon unsurları arasında, kimliğe dayalı farklılıklardan doğan gerilimler önemli bir yer tutmaktadır. Bu doğrultuda; birbirinden farklı birçok etnik ve dini kimliği bünyesinde barındıran Suriye'de, bu çeşitliliğin ülkenin siyasi tarihine ve ülkedeki iç savaşa ne şekilde ve hangi ölçülerde etki ettiği bir tartışma konusudur. Her ne kadar iç savaşı bütünüyle bu dinamikler üzerinden açıklamak doğru değilse de ülkede etnik ve dini kimlikler arasında modern tarihi süreçte görülen kutuplaşmalar, Suriye'nin 20. Yüzyıl tarihini şekillendirdiği gibi, manda dönemindeki Fransız idarecilerin azınlıklar üzerinden güç devşirme politikası da uzun vadede ülkede bir azınlık iktidarının doğmasına yol açmıştır. Geniş bir toplumsal meşruiyetten yoksun olan Esad ailesinin Nusayri azınlık iktidarı, ülkeyi kırk yılı aşkın bir süre boyunca her türlü demokratik temelden yoksun ve oldukça otoriter bir şekilde yönetmiştir. Bu süre zarfında devletin bütün güç aygıtları kullanılarak ülkede çoğunluğu teşkil eden toplumsal bileşenlere yönelik her türlü baskı ve şiddet politikası uygulanmıştır. Bu sindirme politikası, ülkede etkin bir muhalefetin oluşmasını engelleyemediği gibi aksine toplumda içten içe büyüyen bir öfke birikmesine yol açmıştır. 2011'de patlak veren iç savaş bu öfke birikmesinin bir sonucudur. Bu çalışmada; Suriye'deki etnik ve dini farklılıklardan kaynaklanan çatışmaların, ülkenin siyasi tarihi üzerindeki şekillendirici etkisi ve iç savaşın başlamasındaki rolü araştırılmış ve bu farklılıkların iç savaş sürecinde de tarafları harekete geçiren temel saikler arasında olup olmadığı incelenmiştir. Araştırma bulgularına göre; ülkedeki etnik ve dini farklılıkların hem ülkenin modern siyasi tarihini şekillendirici temel ekenlerden biri olduğu hem de tarafların çatışma hatlarındaki konumlarına bakıldığında iç savaşın başlamasında belirleyici rol oynadığı görülmüştür. İç savaşın radikalleşen safhalarındaki söylemlere bakıldığında ise başlardaki demokratik dönüşüm beklentilerinin, mezhep savaşına dayalı bir propagandaya terk edildiği görülmüştür. Sonuç olarak yaygın kanaatin aksine, Arap Baharı ya da Suriye'deki rejimin salt otoriter doğası, ülkedeki savaşın ortaya çıkmasındaki yegâne etkenler değildir. Başlangıcı itibariyle Suriye İç Savaşı; ülkenin uzun yıllar içinde bulunduğu kimliğe dayalı kutuplaşmanın ve bir azınlık diktatörlüğü altında ezilen toplumun çoğunluğunun, kendileri açısından uygun konjonktür oluştuğunda taleplerini şiddete dayalı bir şekilde ifade etmesinin sonucudur. --- Tensions arising from differences based on identity have an important place among the basic motivation factors that mobilize the parties in the internal conflicts in various regions on the world. Accordingly, in Syria where many different ethnic and religious identities live, it is a matter of debate in what way and to what extent this diversity has affected the political history of the country and the civil war in the country. Although it is not true to explain the civil war entirely through these dynamics, the polarization between ethnic and religious identities in the country in the modern historical process shaped Syria's 20th century history, and the policy of French administrators in the mandate period to recruit power over minorities has also led to the emergence of a minority power in the country in the long term. Deprived of a wide range of social legitimacy, the Nusayri minority government of the Assad family has ruled the country in a rather authoritarian manner, devoid of any democratic basis for more than forty years. During this period, all kinds of pressure and violence policies have been applied against the social components that constitute the majority in the country by using all the power devices of the state. This intimidation policy has not prevented the formation of an effective opposition in the country, and on the contrary, it has caused an internally growing anger in the society. The civil war that broke out in 2011 is the result of this anger buildup. In this study, the shaping effect of the conflicts arising from ethnic and religious differences in Syria on the political history of the country and its role in the onset of the civil war has been investigated and whether or not these differences are among the basic motives that mobilize the parties during the civil war process have been examined. According to the research findings, it is seen that the ethnic and religious differences in the country are one of the fundamental factors that shape the modern political history of the country, and when the positions of the parties in the lines of conflict are examined, they play a determining role in the beginning of the civil war. Considering the statements in the radicalizing phases of the civil war, it has been seen that the initial expectations of democratic transformation were abandoned to propaganda based on sectarian warfare. In conclusion, contrary to popular belief, the Arab Spring or the purely authoritarian nature of the regime in Syria are not the only factors in the emergence of the war in the country. As of the beginning, the Syrian Civil War is the result of the polarization based on identity in the country for many years and the majority of the society oppressed under the dictatorship of a minority, expressing their demands based on violence when the appropriate conjuncture is formed for them.

Bakıldığında sivil toplum insanların kendi kendine bir araya gelerek toplumsal fayda üretebilmek adına yapılan çalışmaların bütünüdür. Söz konusu toplumsal fayda devletten bağımsız bir şekilde üretilir. Türkiye'deki sivil toplum tartışmaları her ne kadar çok partili dönem sonrasında başladıysa da sivil toplumun somut örgütlenme biçimlerinin son otuz yılda arttığını görmek mümkündür. Bu tez, sivil toplum kavramını, bu kavramın Batı'da ve Türkiye'deki tartışma biçimleri içerisinde ele almaktadır. Bu tarihsel kabın içerisinde Türkiye'nin tarihsel gelişimini "din" ve "inanç" yönünde toplumsal fayda üreten sivil toplum kuruluşlarının seyri, dönemlerin politik, siyasi, ekonomik ve toplumsal yönüyle tartışılmaya çalışılmıştır. Türk modernleşmesinde inanç tabanlı sivil toplum kuruluşlarının seyri ve hareket alanlarının sınırları, özellikle 1980 sonrasındaki Türkiye'deki hızlı değişim ve dönüşüm ile birlikte inanç tabanlı sivil toplum kuruluşlarının bu değişime nasıl entegre oldukları incelenmeye çalışılmıştır. Türkiye'de 1980 sonrası dönemde odaklanılan nokta ekonomik anlamda liberalleşme ile birlikte kamusal alandaki sivil toplum kuruluşlarının hareket alanlarının çoğalması dikkat çekicidir. Özellikle 2002 sonrası siyasi aktörlerinde sunmuş olduğu imkânlarla birlikte inanç tabanlı sivil toplum kuruluşlarının sayılarında ve faaliyet alanlarındaki artış kurumların faaliyet raporları üzerinden görülmektedir. Topluma dönük çalışmaların yoğunlaştığı bir dönem olan 1980 sonrası ve 2002 sonrası İslami kesimin her alanda oldukça etkili olduğu tartışılmaz bir gerçektir. Bu sebeple İslami ve dindar çevrenin sivil toplum kuruluşları bazında topluma yönelik yapmış oldukları çalışmaları incelemek bir zorunluluk halini almıştır. Fakat araştırmanın başında da görüldüğü üzere inanç tabanlı sivil toplum kuruluşları da kendi içerisinde belirli ayrımlara sahiptir. Dinî eğitim odaklı ilerleyen inanç tabanlı sivil toplum kuruluşları mevcut iken bundan farklı olarak cemaat eksenli ilerleyen inanç tabanlı sivil toplum kuruluşları da ülkemizde mevcuttur. Bu anlamda çalışmada, inanç tabanlı sivil toplum kuruluşları kapsamında cemaat ve cemiyet temelli iki ayrı sivil toplum kuruluşu İslam- sivil toplum ekseninde araştırılmaya çalışılmıştır. Bu kapsamda cemiyet temelli bir bakış açısına sahip olan İlim Yayma Cemiyeti ile cemaat temelli ve eksenli Hakyol Vakfı adlı iki sivil toplum kuruluşu incelenmiştir. Bu kuruluşların faaliyet alanları, topluma katkıları ve modern dönemdeki dinamizmlerinin analizi yapılmaya çalışılmıştır. Her iki kurumun çalışma ve projeleri incelendiğinde, ulusal ve uluslararası mercekte topluma fayda üretilmesi anlamında olumlu katkılarda bulundukları kanaatine varılmıştır. --- The civil society is a concept that has been discussed for many years. When examined, civil society is the whole of the work done for people to come together and produce social benefits. The social benefit here is produced independently of the state. It is possible to see that the concrete form of organization of civil society in Turkey has increased over the last thirty years although it began after the multiparty era. This thesis deals the concept of civil society as it is addressed in the discussion of this concept forms in the West and Turkey. The course of the non-governmental organizations that produce social benefits in the direction of "religion" and "faith", has been tried to be discussed with the political, economic and social aspects of the periods among the development of Turkey in this historical process. The progress and movement areas' limits of the faith-based NGOs in Turkish modernization; especially with therapid change after 1980 and the integration of faith-based NGOS to the transformation have been tried to analyzed. The focus point is the increase in the fields of action of NGOs among the public area with the economic libelarization after 1980 in Turkey. In particular, the increase in the number of non-governmental organizations based on beliefs and their fields of activity, together with the opportunities offered by political actors after 2002, can be seen in the annual reports of the institutions. It is an indisputable fact that Islamic groups, post-1980 and post-2002 when social studies were increased, were highly effective in every field.For this reason, it is a necessity to examine the activities of the Islamic and religious circles towards the society on the basis of non-governmental organizations. However, as can be seen at the beginning of the research, faith-based non-governmental organizations also have certain distinctions within themselves. While there are advancing faith-based non-governmental organizations focused on religious education, there are also community-based advancing faith-based non-governmental organizations in our country. In this sense, within the scope of faith-based non-governmental organizations, two separate non-governmental organizations based on the community and society were tried to be searched on the axis of Islam-civil society. In this context, two non-governmental organizations, İlim Yayma Society which has a society-based perspective and Hakyol Foundation which has a community-based perspective, have been examined.The activity fields of these organizations, their contributions to society and their dynamism in the modern period have been tried to be analyzed. When the studies and projects of both institutions were examined, it was concluded that they contributed positively in terms of producing benefit to society in national and international lenses.

The course of the non-governmental organizations that produce social benefits in the direction of "religion" and "faith", has been tried to be discussed with the political, economic and social aspects of the periods among the development of Turkey in this historical process. The progress and movement areas' limits of the faith-based NGOs in Turkish modernization; especially with therapid change after 1980 and the integration of faith-based NGOS to the transformation have been tried to analyzed. The focus point is the increase in the fields of action of NGOs among the public area with the economic libelarization after 1980 in Turkey. In particular, the increase in the number of non-governmental organizations based on beliefs and their fields of activity, together with the opportunities offered by political actors after 2002, can be seen in the annual reports of the institutions. It is an indisputable fact that Islamic groups, post-1980 and post-2002 when social studies were increased, were highly effective in every field.For this reason, it is a necessity to examine the activities of the Islamic and religious circles towards the society on the basis of non-governmental organizations. However, as can be seen at the beginning of the research, faith-based non-governmental organizations also have certain distinctions within themselves. While there are advancing faith-based non-governmental organizations focused on religious education, there are also community-based advancing faith-based non-governmental organizations in our country. In this sense, within the scope of faith-based non-governmental organizations, two separate non-governmental organizations based on the community and society were tried to be searched on the axis of Islam-civil society. In this context, two non-governmental organizations, İlim Yayma Society which has a society-based perspective and Hakyol Foundation which has a community-based perspective, have been examined.The activity fields of these organizations, their contributions to society and their dynamism in the modern period have been tried to be analyzed. When the studies and projects of both institutions were examined, it was concluded that they contributed positively in terms of producing benefit to society in national and international lenses.
Uyuşmazlıkların eskiye göre daha karmaşık ve uzmanlık isteyen hale gelmesi ve insanların ilişkilerini koruma ve devam et-tirme istekleri gibi nedenlerle uyuşmazlık tarafları, ihtiyaçları olan çözüme erişebilmek için yargısal süreçler dışında alternatif yöntem-ler aramışlardır. Bu arayış alternatif uyuşmazlık yöntemlerini do-ğurmuştur. Arabuluculuk, en hızlı yayılan ve tercih edilen alternatif uyuşmazlık yöntemi olmuştur. Arabuluculuk, işçi ve işveren arasında yaşanan anlaşmazlıkların kısa bir zaman zarfında ve düşük maliyet-lerle çözümlenmesini sağlayacak adil ve dostane bir yöntemdir. 5521 sayılı İş Mahkemeleri Kanunu kabul edildiği 1950 yılından günümüze kadar çalışma hayatında yaşanan köklü dönüşümler kar-şısında iş uyuşmazlıklarının çözüm yöntemlerinin yetersiz kaldığı gerekçesiyle, mahkemelerin iş yükünü azaltacak alternatif uzlaşma yöntemlerini benimseyen yeni bir kanun (7036 sayılı İş Mahkemeleri Kanunu) getirilmiştir. 7036 sayılı Kanun'un genel gerekçesinde, alternatif uzlaşma yöntemlerine olan gereksinim, iş mahkemelerinde artan iş yükünün ve işin yapılma şeklinde yaşanan değişim, nüfus artışı, teknolojide yaşanan olağanüstü gelişim, sosyal güvenlik hukuku alanın genişle-mesi ve işçi-işveren uyuşmazlıklarının çeşitlenmesi nedenlerine bağ-lanmıştır. 01.01.2018 itibariyle yürürlüğe girmiş olan "Dava Şartı Olarak Arabuluculuk" sistemini de içeren 7036 sayılı İş Mahkemeleri Kanu-nu bu anlamda çalışma hayatının önemli bir ihtiyacını karşılamış ola-caktır. Dava şartı olarak arabuluculukta, uyuşmazlık taraflarının bir araya getirilerek alanında uzman arabulucuların objektif bir şekilde taraflarla görüşme sağlayarak kendi çözüm yöntemlerini geliştirme-leri sağlanmakta ve iletişim kurmalarına aracı olunmaktadır. Arabuluculuk, Türk hukuk sistemi içerisinde tarafların ihtiyari başvurduğu bir çözüm yöntemiyken, 7036 sayılı Kanun'la yapılan dü-zenlemeyle işçi-işveren uyuşmazlıklarında dava şartı olarak ilk defa yer almıştır. Bireysel veya toplu iş sözleşmesine dayanan işçi veya işveren alacağı ve tazminatı ile işe iade talebiyle açılan davalarda, arabulucu-ya başvurulmuş olması dava şartı olarak kabul edilecek ve mahkeme öncelikli olarak arabulucuya başvurmuş olma koşulunu arayacaktır. 7036 sayılı İş Mahkemeleri Kanunu ile getirilen yeni düzenle-meye göre dava açılmadan önce arabulucuya gitmek zorunlu, ancak tarafların arabulucuda uzlaşmaları zorunlu değildir. Taraflar arasında anlaşma sağlanamazsa anlaşmazlık konusunun iş mahkemelerine götürülmesine herhangi bir engel bulunmamaktadır. Ancak ilgili kanunla yapılan düzenlemede bazı belirsizliklerin olduğu görülmektedir. Belirsiz konuların başında, arabuluculuk tuta-nağında yer alan boşta geçen süreye ait ücretle ilgili Sosyal Güvenlik Kurumu'na yapılacak bildirimlerin usul ve esaslarının belirlenmemiş olması gelmektedir. Bu çalışmada, söz konusu belirsizliklere neden olan hususlara yer verilerek, konuya ilişkin değerlendirmelerimiz ak-tarılmaya çalışılmıştır. ; As the conflicts are becoming more complex and de-manding expertise than the previous practices and as people are re-quiring to maintain their relations, the parties to disputes have star-ted to sought alternative methods outside of the judicial procedures in order to access the solution they need. This search has led to the emergence of alternative dispute resolution methods. Mediation has become the fastest-spreading and most-preferred alternative dispute resolution method. Mediation is a fair and amicable way to ensure the resolution of disputes between the employees and emp-loyers within a short period of time and at low costs. A new act (Act No. 7036 Regarding Labour Courts) has been introduced, which adopts alternative methods of resolution to redu-ce the workload of the courts, with the reason that the conventional methods of resolving labour disputes are inadequate in the face of radical transformations occurring in the labour life since 1950, when the Act No. 5521 on Labour Courts was adopted. On the general reason of The Act No. 7036, the need for alter-native methods of reconciliation has been attributed to the increa-sing workload in the labour courts, the radical changes in the ways of doing business, the population growth, the extraordinary deve-lopments in technology, the expansion of social security law, and the diversification of employee-employer disputes. The Act No. 7036 Regarding Labour Courts No. 7036, which includes "the practice of mediation as a condition of trial", which has come into effect as of 1st of January, 2018, is expected to meet the important needs of working life in this sense. In the practice of mediation as a condition of trial, the parties to the dispute are brought together, and experts in the field are ensuring an objective negotiation between the parties to develop their own solution met-hods through communication. While previously, the practice of mediation was a discretionary solution for the disputing parties in the Turkish legal system, for the first time the regulation is being regulated as a condition of trial for all labour disputes between employee and employers. In the labour disputes arising from an individual or collecti-ve labour agreement (employment contract) and based on the employee's or the employer's claim or a compensation demand or a demand for return to work, the application for mediation first will be applied as a precondition for filing a claim at a labour court. According to the new regulation introduced by the Act No. 7036 on Labour Courts, applying to mediation is compulsory before file the suit however to reach a common ground is not compulsory. If there is no agreement between the parties at the end of the medi-ation procedures, there is no obstacle for the dispute to be brought to relevant labour court. However there seems to be some uncertainty in the regulation made with the applicable law. One of the most important uncerta-in topics is the procedures and principles of the notifications to be made to the Social Security Institution regarding the wages for the idle time passed during the mediation sessions are not being deter-mined. In this study, it has been tried to convey our evaluations abo-ut the issue by mentioning the subjects that cause the uncertainties.
Tarihsel süreç içinde yaşanan sosyo-ekonomik, teknolojik ve siyasal değişimlere bağlı olarak devletin üstlendiği görev tanımları yenilenmiştir. Dönemsel açıdan devlet güvenlik ve adalet gibi temel kamu hizmetlerini üstlenmiştir. Nüfus artışına bağlı olarak toplumsal kesimlerin çeşitlenmesi farklı talep ve beklentiler devletin özellikle mali açıdan yükünü arttırmıştır. Bu durum devletin kamu hizmetlerinin sunumu noktasında konumunu tartışmalı hale getirmiş ve minimal devlet olgusu ortaya çıkmıştır. Yeni sistem kamu hizmetlerinin sunumunda merkezi yetkileri yerel unsurlar, özel sektör ve sivil toplum kuruluşları arasında paylaştıran bir modeli ortaya çıkarmıştır. Bu modelde devletin doğrudan üreten değil düzenleyen ve denetleyen bir pozisyona geçmesi öngörülmüştür. Devletin yeni konumu ise yönetim süreçlerinde demokratik ve katılımcı anlayışı gerektirmiştir. Devlete biçilen yeni pozisyon sosyo-ekonomik kalkınma ve toplumsal refahın geliştirilmesi hedefini ertelemiş değildir. Küreselleşme süreci kalkınma hedefinin sağlanmasında devletin sivil toplum ve özel sektör vb. aktörler ile ortaklık kurmasına yol açmıştır. Küreselleşme süreci yönetsel kademe olan yerel yönetimleri iki başlıkta öne çıkarmıştır. Birincisi; katılım ve demokrasinin birincil uygulama alanı olarak yerel yönetimler ön plana çıkmıştır. İkincisi; yerel yönetimler sahip olduğu imkan ve potansiyel itibariyle kalkınma açısından merkez(ler) olarak kabul edilmiştir. Türkiye planlı kalkınma olgusu ile Cumhuriyetin ilanı ile tanışmıştır. Türkiye açısından 1923 İktisat Kongresi, Devlet Planlama Teşkilatının kurulması ve 1963 tarihli ilk Kalkınma Planı temel hamleler olmuştur. Kalkınma hamleleri içinde yerel unsurlar ve yerel yönetimler çeşitli dönemlerde öne çıkmışlardır. Bu açıdan kalkınma planları ülkemizin sosyo-ekonomik hedeflerinin belirlenmesinde yerel yönetimleri de bir aktör olarak görmüştür denilebilir. Cumhuriyetin ilk yıllarında köy kalkınması öne çıkarılırken sayısının ve nüfusunun artması ile kent sorunları kalkınma planlarında ele alınmaya başlanmıştır. Kalkınma planlarında kent daha çok yetki, görev ve mali yapıları ile ele alınmış bu konularda kısmi iyileştirmelere gidilmiştir. Dünya toplumlarının yaşadığı siyasal değişimler yerel yönetimlerin demokratik ve katılımcı yönünü ortaya çıkarmıştır. Bunun yansıması olarak ülkemizde de yerel yönetimlerin demokratik ve katılımcı bir modele evrilmesine yönelik temel hedefler kalkınma planlarına yansımıştır. Kent yönetimleri demokratik ve katılımcı yapılar olarak tanımlanmaya başlanmıştır. Ayrıca kalkınma planları yerel yönetimlerin asıl sorumluluk alanı olan kent hizmetlerinin nitelikleri ve türleri açısından vizyon ve hedef belirleme aracı olmuştur. Bu çerçevede Kalkınma planlarında kent odaklı; ulaşım, alt yapı, barınma, sosyo-kültürel, sosyo-ekonomik vb. pek çok alanda hedefler konulmuştur. Türkiye'de 1963'den bu yana 10 kalkınma planı hazırlanmıştır. Son olarak 23 Temmuz 2019'da 11. Kalkınma Planı uygulamaya girmiştir. Kalkınma planları sosyo-ekonomik açıdan öne çıksa da aslında tüm kurumsal yapılara yönelik hedef ve politikalar belirler. Türkiye'de hazırlanan kalkınma planları da yerel yönetim alanında da değişim ve dönüşüm odaklı olmuştur. Yayınlanan 11. Kalkınma planının içeriğinde geçmiş dönem planlarına ait atıflar bulunmaktadır. En önemli nokta ise; yerel yönetimlere ilişkin yeniden reform yapılacağı belirtilmesidir. Ayrıca insan odaklı şehir; yeşil şehir; akıllı şehir; kaliteli hizmet sunumu; katılımcılık; şeffaflık; hesap verilebilirlik; optimum coğrafi alan vb. kavramlara yer verilmektedir. Tüm bunlar 11. Plan döneminde yerel yönetimlere ilişkin değişimin devam edeceğini göstermektedir. ; Depending on the socio-economic, technological and political changes in the historical process, the responsibility of the state has been renewed. As far as the era is concerned, it undertook basic public services such as state security and justice. Diversification of social segments due to population increase, different demands and expectations have increased especially the financial burden of the state. This situation rendered the status of the state controversial in terms of offering public services and introduced the phenomenon of a minimal state. The new system introduced a model that distributes central powers among local elements, the private sector, and non-governmental organizations in the offering of public services. The model provides that the state should adopt a regulating and supervising position instead of directly producing one. And the new position of the state required democratic and participatory understanding in the governing processes. This new position seen fit to the state has not delayed the goal of socio-economic development and social welfare. The process of globalization enabled the state to form a partnership with actors such as the civil society and the private sector in fulfilling the aims of development. The globalization process called for local administrative governments, in two ways. First; local governments were at play as the means of primary application of participation and democracy. Second; local governments were accepted as the center(s) concerning development thanks to their capabilities and potential. Turkey was introduced with the concept of planned development with the proclamation of the Republic. For Turkey, the Economic Congress of 1923, the establishment of the State Planning Organization and the first Development Plan of 1963 have constituted the main steps. In the development steps, local elements and local administrations came to the fore in different periods. In this respect, it is safe to say that development plans also regarded the local governments as actors in determining the socio-economic goals of our country. While rural development was emphasized in the first years of the republic, increasing urban population and urban problems necessitated these problems to be addressed in development plans. In the development plans, a city was mostly treated keeping in mind the authorities, duties and financial structure; and partial improvements were made on these issues. Political changes experienced by the world's societies revealed the democratic and participatory aspects of local governments. As a repercussion of this, the main aims for the evolution of local governments into a democratic and participatory model in our country are reflected in the development plans. City administrations started to be defined as democratic and participatory structures. Besides, development plans have been a vision and goal setting tool in terms of characteristics and types of urban services, which are the main areas of responsibility of local governments. In this framework, in city development plans, cityfocused aims have been defined in various fields such as transportation, infrastructure, shelter, socio-economics, etc. Since 1963, 10 development plans have been issued in Turkey. Finally, on July 23 2019, the 11th Development Plan was issued. Although development plans come to the forefront from a socio-economic point of view in general, they actually set goals and policies for all institutional structures. In Turkey, the development plans prepared has been focused on the changes and transformations in the local government area. The 11th Development Plan contains references to these previous plans. The most important point seems to be the strong emphasis on the re-reform of local governments. Also; people oriented cities, green cities, smart cities, quality service delivery, participation, transparency, accountability, optimum geographical area and etc. concepts take part in the plan. All this shows that change in local administrations will continue in the 11th plan period.

Bu süreçle paralel olarak uluslararası etkileşimlerde büyük artışlar yaşanarak, çok uluslu şirketlerin aktörleştiği ve diğer aktörler ile (sivil toplum örgütü, devlet ve uluslararası örgütler) bağımlılık ve güç ilişkisi kurduğu bir sistem var olmaktadır. Serbest piyasanın tüm dünyada yaygınlaşması ulus devletin etkinlikleri azaltarak yönetim tekelini kırmış ve çok uluslu şirketlerin hakimiyetinin genişlediği bir yapı oluşturmuştur. Finans piyasalarının dönüşüme dahil olması ile sermayenin uluslararası dolaşımı artmıştır. Bu durum çok uluslu şirketlerin yabancı yatırımları, küresel piyasada faaliyetleri sürdürebilmenin en önemli aracı olarak görmelerine neden olmuştur. Özellikle sermaye birikiminin yetersiz kaldığı gelişmekte olan ülkelerin kalkınması adına önemli olan doğrudan yabancı yatırımlar alternatif dış finansman kaynağı olarak görülerek, sorun çözümünde en değerli yol olmaktadır. Doğrudan yabancı yatırımların etkilerinin ülkeden ülkeye veya şirketten şirkete değiştiği görülmektedir. Her koşulda doğrudan yabancı yatırım gelişmekte olan ülke için önemli bir kaynak artışı sağlamaktadır. Gelişmekte olan ülkeler beklenilen etkin sanayinin kurulamaması üzerine çok uluslu şirketlerin bu ilişkide köprü görevini üstlenmesini olumlu bularak şirket faaliyetlerini teşvik etmektedirler. Yaşanılan bu ilişkide gelişmekte olan ülkelerin yapılarında büyük değişimler yaşanmakta ve ülke üzerinde baskı oluşturmaktadır. Bu durumda çok uluslu şirketler siyasal yapılar haline bürünerek devlet ile sermaye arasındaki ilişkilerin azalmasına neden olmuştur. Piyasada aktörlerin ulus devletin etkilerini negatif şekilde hissetmesi aktörlerin sivil toplum örgütleriyle işbirliklerini arttırmıştır. Bu işbirliğinin oluşmasının nedeni, devletin sosyal uygulamalarını azaltması ve şirketlerin sadece ekonomik faydayı değil sosyal faydayı da benimseme mecburiyetidir. Bu süreç bağlı kapitalizm kavramını oluşturmuş çok uluslu şirketler ile sivil toplum örgütlerinin birbirine bağımlı olduğu, birbirini etkilediği ve sistem içerisinde güç oluşturduğu ilişki bütünü var olmuştur. Kurulan işbirliği piyasa içi ve piyasa dışı pek çok avantajı taraflara sunmaktadır. Bu ilişkinin giderek güçlenmesi sosyal yardımların melez kurum (sivil toplum örgütü ile çok uluslu şirket bileşimi) üzerinden yapılmasına neden olmaktadır. Bağlı kapitalizmin daha çok gelişmekte olan ülkelerde var olma nedeni, sivil toplum anlayışının gelişmediği, demokrasinin içselleştirilemediği ve politik süreçlerden bağımsız olarak düşünülemeyen kurumsal sosyal sorumluluk anlayışının var olması bağlı kapitalizmi bu ülkelerde etkin kılmaktadır. Ayrıca devletin çok uluslu şirketin aktörlüğüne müdahale etme isteğinin çıkış noktası olarak görülen bu işbirliği, bağlı kapitalizmin bu ülkelerdeki etkisini arttırmıştır. Ülkelerdeki yönetim başarısızlıkları ve yönetim boşlukları sivil toplum örgütlerine ihtiyacı arttırarak bu bölgede işlerlik kazanmasına neden olmuştur. Gelişmekte olan ülkelerde krizlerin olumsuz etkilerinin daha fazla olması sivil toplum örgütlerinin işbirliğini tercih etmesinin nedenini oluşturmaktadır. Çok uluslu şirket ile sivil toplum örgütü işbirliği taraflar açısından karşılıklı değer yaratma süreci olarak tanımlanmaktadır. Bu değer yaratma sürecinde tarafların iki kurumdan ziyade tek bir kurum gibi hareket edildiği görülmektedir. Karşılıklı çıkarlar doğrultusunda etkinliklerini sürdüren melez kurum var olmaktadır. Bağlı kapitalizm kavramı, sivil toplum kuruluşu ve çok uluslu şirketlerin kapitalist sistem içerisinde ayakta kalabilmeleri adına karşılıklı çıkarlarının gözetildiği, güçlerin birleştirildiği sistemi ifade etmekte ve tüm dünyayı etkilemektedir. --- The impacts of globalization were observed on its peak point since 1980s. In parallel to this process, major increases were experienced in international interactions, and a system, in which multinational corporations became actors and established dependency and power relations with other actors (i.e. non-governmental organization, governmental and international organizations), came into existence. The spread of free market throughout the whole world has destroyed the monopoly in terms of management by reducing the effects of nation-state, and it generated a construct, in which the dominance of multinational corporations expanded. The circulation of the stock in international platforms has increased with the involvement of the finance market to this transformation. As a consequence of that, multinational corporations consider foreign investments as the most crucial tool to sustain transactions in the global market. First-hand foreign investments, which are important for the developing countries where the capital stock is insufficient, are seen as an alternative external financing source and become the most valuable way to the solution of the problem. It is seen that the effects of direct investments vary across different countries and corporations. In all circumstances, first-hand foreign investments provide the developing countries with a significant increase in sources. Due to not establishing an effective industry in developing countries, the bridging role undertaken by multinational corporations in this relationship is found positive and their operations are promoted. Major structural changes are experienced in the developing countries in this relationship and this condition generates a pressure on these countries. In this case, multinational corporations disguise in political structures and cause a decrease in the relationship between the government and the capital. Feeling the impacts of nation states in a negative way by actors in the market facilitates the corporation between the actors and non-governmental organizations. The reasons behind this corporation are the decrease in social execution by the government and the requirement of adopting not only an economical gain but also a social benefit. This process leads to the emergence of the term "dependent capitalism" and there exists an entirety of relation, in which multinational corporations and non-governmental organizations are dependent to each other, are affecting each other, and are generating power within the system. The cooperation provides advantages to each side in terms of external and internal market. The gradual consolidation of this relationship leads to providing the social assistance through a hybrid institution (which is the combination of a non-governmental organization and a multinational corporation). The reason why dependent capitalism mostly exists in developing countries is the institutional social responsibility perception which cannot be thought independent of political processes and in which sense of civil society does not improve, and the democracy is not internalized. Besides, this corporation, which is regarded as the starting point of the desire of interference of government to the multinational corporations, increases the effects of dependent capitalism in these countries. The administration failures and vacancies in these countries lead to the need for non-governmental organizations and to the functionality of these organizations in these regions. The dominant negative effects of crisis in the developing countries lead to the preference of non-governmental organizations for a cooperation. The cooperation between a multinational corporation and a non-governmental organization is defined as a process of creating reciprocal value in terms of each side. It is seen that these sides act as a single institution in this value-creation process rather than two different institutions. They are regarded as hybrid institutions which maintain their operations in accordance with their mutual benefits. The term "dependent capitalism" refers to a system, in which the non-governmental organizations and the multinational corporations look after their mutual benefits to maintain their existence and in which theyunify their strengths, influences the whole world.

Bu süreç bağlı kapitalizm kavramını oluşturmuş çok uluslu şirketler ile sivil toplum örgütlerinin birbirine bağımlı olduğu, birbirini etkilediği ve sistem içerisinde güç oluşturduğu ilişki bütünü var olmuştur.Kurulan işbirliği piyasa içi ve piyasa dışı pek çok avantajı taraflara sunmaktadır. Builişkinin giderek güçlenmesi sosyal yardımların melez kurum (sivil toplum örgütü ile çok uluslu şirket bileşimi) üzerinden yapılmasına neden olmaktadır. Bağlı kapitalizmin daha çok gelişmekte olan ülkelerde var olma nedeni, sivil toplum anlayışının gelişmediği, demokrasinin içselleştirilemediği ve politik süreçlerden bağımsız olarak düşünülemeyen kurumsal sosyal sorumluluk anlayışının var olması bağlı kapitalizmi bu ülkelerde etkin kılmaktadır. Ayrıca devletin çok uluslu şirketin aktörlüğüne müdahale etme isteğinin çıkış noktası olarak görülen bu işbirliği, bağlı kapitalizmin bu ülkelerdeki etkisini arttırmıştır. Ülkelerdeki yönetim başarısızlıkları ve yönetim boşlukları sivil toplum örgütlerine ihtiyacı arttırarak bu bölgede işlerlik kazanmasına neden olmuştur.Gelişmekte olan ülkelerde krizlerin olumsuz etkilerinin daha fazla olması sivil toplum örgütlerinin işbirliğini tercih etmesinin nedenini oluşturmaktadır.Çok uluslu şirket ile sivil toplum örgütü işbirliği taraflar açısından karşılıklıdeğer yaratma süreci olarak tanımlanmaktadır. Bu değer yaratma sürecinde tarafların iki kurumdan ziyade tek bir kurum gibi hareket edildiği görülmektedir. Karşılıklı çıkarlar doğrultusunda etkinliklerini sürdüren melez kurum var olmaktadır. Bağlı kapitalizm kavramı, sivil toplum kuruluşu ve çok uluslu şirketlerin kapitalist sistem içerisinde ayakta kalabilmeleri adına karşılıklı çıkarlarının gözetildiği, güçlerin birleştirildiği sistemi ifade etmekte ve tüm dünyayı etkilemektedir. --- The impacts of globalization were observed on its peak point since 1980s. Inparallel to this process, major increases were experienced in international interactions, and a system, in which multinational corporations became actors and established dependency and power relations with other actors (i.e. non-governmental organization, governmental and international organizations), came into existence. The spread of free market throughout the whole world has destroyed the monopoly in terms of management by reducing the effects of nation-state, and it generated a construct, in which the dominance of multinational corporations expanded. The circulation of the stock in international platforms has increased with the involvement of the finance market to this transformation. As a consequence of that, multinational corporations consider foreign investments as the most crucial tool to sustain transactions in the global market. First-hand foreign investments, which are important forthe developing countries where the capital stock is insufficient, are seen as an alternative external financing source and become the most valuable way to the solution of the problem.It is seen that the effects of direct investments vary across different countries andcorporations. In all circumstances, first-hand foreign investments provide the developing countries with a significant increase in sources. Due to not establishing an effective industry in developing countries, the bridging role undertaken by multinational corporations in this relationship is found positive and their operations are promoted. Major structural changes are experienced in the developing countries in this relationship and this condition generates a pressure on these countries. In this case, multinational corporations disguise in political structures and cause a decrease in the relationship between the government and the capital. Feeling the impacts of nation states in a negative way by actors in the market facilitates the corporation between the actors and non-governmental organizations. The reasons behind this corporation are the decrease in social execution by the government and the requirement of adopting not only an economical gain but also a social benefit. This process leads to the emergence of the term "dependent capitalism" and there exists an entirety of relation,in which multinational corporations and non-governmental organizations are dependent to each other, are affecting each other, and are generating power within the system. The cooperation provides advantages to each side in terms of external and internal market. The gradual consolidation of this relationship leads to providing the social assistance through a hybrid institution (which is the combination of a non-governmental organization and a multinational corporation). The reason why dependent capitalism mostly exists in developing countries is the institutional social responsibility perception which cannot be thought independent of political processes and in which sense of civil society does not improve, and the democracy is not internalized. Besides, this corporation,which is regarded as the starting point of the desire of interference of government to the multinational corporations, increases the effects of dependent capitalism in these countries. The administration failures and vacancies in these countries lead to the need for non-governmental organizations and to the functionality of these organizations in these regions. The dominant negative effects of crisis in the developing countries lead to the preference of non-governmental organizations for a cooperation. The cooperation between a multinational corporation and a non-governmentalorganization is defined as a process of creating reciprocal value in terms of each side. It is seen that these sides act as a single institution in this value-creation process rather than two different institutions. They are regarded as hybrid institutions which maintain their operations in accordance with their mutual benefits. The term "dependent capitalism" refers to a system, in which the non-governmental organizations and the multinational corporations look after their mutual benefits to maintain their existence and in which theyunify their strengths, influences the whole world.
Petrol dünya yüzeyinde en fazla tüketilen enerji kaynağıdır. Dünyanın tüm ülkeleri için olduğu kadar Türkiye açısından da vazgeçilmez stratejik öneme haizdir. Küresel ve/veya bölgesel pek çok askeri ve siyasi gelişme bu çok değerli enerji kaynağı etrafında şekillenmektedir. Türkiye, bu enerji kaynağına sahip ülkelere çok yakın komşu ülke olmakla birlikte kendi yer altı zenginlikleri bakımından fakir bir ülkedir ve petrol tüketiminin % 90'dan fazla miktarını ithal etmektedir. Türkiye ekonomisi petrol fiyatlarındaki dalgalanmalardan etkilenmekte, cari açık, ödemeler dengesi, dış borç yükü ve enflasyon gibi makroekonomik dengeler petrol fiyatlarına göre şekil almaktadır. Ülkemizde petrol piyasası dikey bütünleşik bir kamusal örgütlenmeye tabi iken 2000'li yıllarda başlayan özelleştirme çalışmaları ile rafineri, petrokimya petrol dağıtım alanlarında yapısal regülasyon tesis edilmiş ve petrol piyasası rekabete açık bir piyasa yapısına kavuşmuştur. Yapısal regülasyon yanında sosyal regülasyonun bir parçası olarak çevresel hassasiyetler ve tüketicilerin korunmasına yönelik kurallar, akreditasyon, standardizasyon ve ürün/hizmet güvenliğini esas alan teknik regülasyon da yasal çerçeveye oturtulmuştur. Bağımsız bir düzenleyici otorite olarak EPDK'nın kurulması ile birlikte petrol piyasası yakın gözetim ve denetim altında bulundurulmaya başlanmıştır. Petrol açısından dışa bağımlı bir ülke konumunda olan Türkiye hazine gelirlerinin büyük miktarını yine bu enerji kaynağı üzerindeki dolaylı vergilerden karşılamaktadır. Akaryakıt satış fiyatlarının % 60-65'e varan miktarlarda vergi yükü bulunmakta olup petrol satışlarından dolayı 2011 yılında devlet kasasına giren toplam vergi miktarı 39,2 milyar liradır. Bu miktar, ülkemizde 2011 yılında toplanan verginin % 13'üne tekabül etmektedir. Petrol ürünleri üzerindeki bu aşırı vergi yükü, komşu ülkelerde 4-5 kat ucuza satılan bu ürünün kaçak yollarla ülkeye sokulması riskini de beraberinde getirmektedir. Ülkemizin oldukça uzun doğu ve güneydoğu kara sınırları ile bu bölgelerdeki istikrarsız yapı, ayrıca 3 tarafının denizlerle çevrili olması ve bu geniş alanda denetim kurulması noktasında yaşanan zorluklar hem karayolu hem de denizyolu ile yapılan kaçakçılığın artmasına yol açmaktadır. Aynı şekilde akaryakıt olarak kullanılabilen atık yağlardan elde edilen ve 10 numara yağ adı altında yapılan satışlar da rekabetçi piyasa yapısı, can, mal ve çevre güvenliği üzerinde tehditler meydana getirmektedir. EPDK özel ve genel kolluk birimleri ile birlikte petrol piyasasında denetime yönelik yoğun çaba sarfetmekte olup Kurum bütçesinin yaklaşık üçte birini bu alana aktarmaktadır. Ülkemizde ulusal marker uygulamasını merkezine alan bir denetim sistemi yürütülmektedir. Ülkemizde rafineri, işleme, depolama, iletim, taşıma, ihrakiye, serbest kullanıcı, dağıtım, bayilik faaliyetleri EPDK tarafından verilen ve belli kurallara bağlı lisanslar çerçevesinde yürütülebilmektedir. Lisans sahiplerine tehlike sorumluluğu çerçevesinde sigorta yükümlülüğü ile piyasa şeffaflığının sağlanabilmesi ve spekülatif fiyat hareketlerinden korunulabilmesini teminen de bildirime ilişkin regülasyon yükümlülüğü getirilmiştir. Ayrıca bu enerji kaynağının ülkenin kamu düzeni üzerinde üstlendiği vazgeçilemez rol nedeniyle acil durum stokları tutuma yükümlülüğü de belli lisans sahipleri açısından zorunlu hale getirilmiştir. Petrol rezervlerinin önümüzdeki 40-50 yıllık süreçte dünya ekonomileri, siyasi ve politik gelişmeleri üzerinde rolünü artırarak sürdüreceği hesaplanmakta olup piyasa yapısının yakın gözetim ve denetim altında bulundurulması hayati önem taşımaktadır. Bu doktora tezinde birincil ve ikincil mevzuat hükümleri ile birlikte EPDK ve Danıştay kararları çerçevesinde piyasa yapısı üzerindeki devlet kontrolü ve idari müdahaleler incelenmeye çalışılmıştır. ; Petroleum, consumed mostly on earth with the biggest share, is an energy sourcewith inescapable strategic importance for all the countries in the world as well as Turkey. Many military and political improvements in the world acquire a shape around this valuable energy source. Turkey, along with being a close neighbor country to the countries with this energy source, is a poor country from underground richness point of view and imports more than 90 % of her consumption. As a country at a position dependent on external sources for this energy source, Turkish economy has been affected from the fluctuations in the petroleum prices; macroeconomic equilibrium such as current gap, payment balance, external debt load and inflation take a shape according to the fluctuations in the price of petroleum. For this reason, stability in the petroleum market has a great importance for our country to continue economic public order. As petroleum market in our country used to have a vertical united public organizational structure, with the privatization efforts in the years of 2000, structural regulation was established in the fields of refinery, petro-chemistry, petroleum distribution areas, and the petroleum market has gained a structure open to competition. As a part of social regulation in addition to structural regulation, rules towards protection of environmental sensitivenesses and consumers, accreditation, standardization and technical regulation based on safety of goods/services have been made fit on legal frame. With the establishment of EPDK as an independent organizer framed below liberal economic understanding in the energy markets, petroleum market has also been started to be kept under supervision and inspection. Turkey, as a country dependent on external sources, has been making most of her treasury income through indirect taxes on this energy source. Tax load reaches up to 60-65 % of fuel oil prices and the total tax collection of the government through petroleum sales is 39.2 billion liras in 2011. This amount is equivalent to the 13 % of the total taxes that have been collected in our country in 2011. This excessive tax load on petroleum products brings the risk of illegal transformation of this product into the country since it is 4-5 times cheaper in neighborhood countries. Quite long east and southeast land borders of our country and the inconsistent structure in those regions, besides being surrounded with seas at 3 sides, and the difficulties that have been faced to set up a control system in this wide area causes the smuggling through both overland routes and maritime lines. In the same way, sales under the name Number 10 Oil that is obtained from waste oils but can be used as a fuel-oil, threatens the competitive market structure, life, property and environmental safety. EPDK has been spending intense efforts by allocating almost one third of the institution?s budget for the inspection of petroleum market together with private and general police force. In our country, an inspection system that is centralized on the national marker application has been performed. Refinery, processing, storage, conveyance, transportation, free user, distribution, franchising activities in our country can only be performed under the frame of licenses bound to certain rules and franchising activities given by EPDK. License owners are also held responsible for regulation related to declaration to be protected from speculative price changes and to provide insurance liability under the frame of threat responsibility with market transparency. In addition to all, due to the inescapable role of this energy source over the public order, responsibility of keeping emergency stocks is brought to be obligatory for some license owners.
Kuraklık, küresel iklim değişikliği, biyoçeşitliliğin bozulması gibi nedenlerle artan gıda yetersizliği, günümüz dünyasında 821 milyondan fazla insanın yetersiz beslenme sorunu, 90 milyondan fazla çocuğun tehlikeli derecede zayıflık yaşamasına ve her yıl binlerce kişinin yoksulluğa bağlı nedenlerle ölmesine neden olmaktadır. Beslenme ihtiyacının insanoğlunun en önemli ve hayati ihtiyacı olması her ülkenin tarımsal üretime özel bir önem vermesine yol açmaktadır. Bu önemin farkında olan Avrupa ülkeleri günümüzde Avrupa Birliği (AB) olarak adlandırılan ekonomik ve siyasi entegrasyon hareketini başlatırken tarım sektörüne yönelik politikaları Ortak Tarım Politikaları (OTP) adı altında diğer tüm ekonomik faaliyetlerden ayrı bir politika alanı olarak ele almışlardır. Bu önemine istinaden AB'nin başlangıcından itibaren yaptığı bütçe harcamalarının ortalama olarak yarısından fazlası daima bu politikalara ayrılmıştır. AB'nin tarıma sağladığı bu korumacı ayrıcalık zaman içerisinde AB üyesi İspanya gibi birçok ülkeyi tarımsal üretim alanında dünyanın sayılı ülkeleri haline getirirken Polonya gibi yapısal sorunları çok fazla olan yeni üye ülkelerin de yapısal dönüşüm geçirerek tarımsal üretim ve verimliliklerini artırmasını sağlamıştır.Geçmişten bu yana dünyanın sayılı tarım ülkelerinden birisi olan Türkiye'de 1930'lardan itibaren tarım sektörünü destekleyen politikalar uygulamasına karşın değişen dünya koşulları ve 2000'lerde kronikleşen yapısal sorunlarına bağlı olarak ihracatçı kimliğini kaybetme noktasına gelmiştir. Yapılan araştırmalar, Türk tarımının destekleme politikalarına rağmen gerilediğini buna karşın İspanya, Polonya, Litvanya, Letonya, Bulgaristan gibi ülkelerin ise OTP kaynakları ve reformları sayesinde tarımsal alanda önemli ilerlemeler kaydettiğini ortaya koymaktadır.Türk tarımının gerileme yaşadığı günümüzde AB üyeliğinin Türk tarımına önemli kazanımlar sağlayacağı düşünülmektedir. Ancak öte yandan AB tarafı ise Türk tarımının OTP için ağır yüklere yol açacağını düşünerek bu noktada çekinceli hareket etmektedir. Araştırmada Türkiye için veriler ilgili bakanlıklar ve resmi kurumların yayın ve raporlarından derlenirken Polonya ve İspanya ile ilgili veriler ise AB'nin ilgili kurumlarının yayın ve raporlarından derlenmiştir. Elde edilen verilerin tablo ve grafiklere dayalı olarak karşılaştırması yapılarak sonuçlara ulaşılmıştır. Bu araştırmada elde edilen bulgular, Türk tarımının ileri sürüldüğü ölçüde desteklenmediğini, sektöre sağlanan tarımsal desteklerin OTP kapsamında İspanya ve Polonya tarımına sağlanan desteklerin çok altında olduğunu ortaya koymaktadır. Bunun yanında AB'nin üyelere sağladığı OTP desteklerinin Türkiye'nin bütçeden tarıma ayırdığı desteklere göre çok yüksek olduğu ve AB üyeliği durumunda Türkiye'nin OTP'ye ek bir yük getirmeyeceği görülmektedir. Son olarak ise AB standartlarına göre çok daha düşük desteklemelerle hala dünyanın en önemli tarım ülkelerinden birisi olma özelliğini koruyan Türkiye'nin İspanya, Polonya gibi ülkelerin tarımına sağlanan kaynaklara kavuşması durumunda AB tarım arz güvenliği için en önemli ülkelerden birisi olabileceğini söylemek mümkündür. --- Drought, global climate change, the increase in inadequacy of nutrition because of such reasons like degradation of bio diversity, the problem of malnutrition of more than 821 million people in today's World have caused children, more than 90 million, to experience dangerous weakness and the death of thousands of people due to the reasons of poverty every year .As the most and essential need for humanbeing, Nutrition has caused the countries to attach particular importance to agricultural production. The European Countries,aware of this importance, deal with the policy toward agricultural sector under the name of Common Agricultural Policy , a policy area apart from all the other economic activities ,when initiating the economic and political integration movement called Europion Union (EU) today. Referring to this importance the EU has always allocated fund from the half of the bugdget,for these policies from the beginning. This protective policy of EU for agriculture, has provided the new member countries, which have too much structural problems like Poland, to increase agricultural output and productivity by having structural transformation, while it has made many EU member countries like Spain one of the few countries in the World,in the area of agricultural production.As one of the few agriculture countries of World from the history, Turkey has came to a losing point for exporting country identity, depending on the change of World conditions and the structural problems which have became chronic in 2000s, despite the practices of policies supporting the agriculture sector from 1930s. Reserches have revealed the Turkish Agriculture stands back despite the supportive policies, however, the countries like Spain,Lithuania, Latvia, Bulgaria have made majör progress in the area of agriculture thanks to the source of CAP(Common Agricultural Policy) and their reforms.It has been thought that EU membership will make important achievements to Turkish Agriculture. However, on the other side EU acts hesitatingly thinking the Turkish agriculture will give heavy-duty to CAP. In this research, it has been studied on the most important policies of EU called CAP and the effects of the agriculture supports the EU has provided to Spain and Poland as part of CAP with the existing agricultural supports in Turkey. On the hypothesis of research, It has been examined if Turkey is protectionist in agriculture or not the membership of Turkey will bring heavy duty to EU or not, Turkey will contribute to EU food safety or not, and the agricultural supports ,which Turkey performs, are enough campared to the CAP supports for Spain and Poland. İn the research, the data related to Poland and Spain has been compiled from the publishings and reports of relevant institutions of EU while it has been compiled from the publishings and reports of relevant ministry and government agencies for Turkey. It has been concluded by making comparisons of the obtained datas based on charts and graphics. Findings, obtained from this study have revealed that the Turkish Agriculture isn't supported as it is claimed, the Agricultural supports provided for the sector are for below the funds which the CAP intends for Spain and Poland. Besides, it has been seen that, the CAP supports, EU provides to the members are a lot more than the supports Turkey provides for the Agriculture and the membership of Turkey brings no special heavy duty to CAP. Consequently, It is possible to say that Turkey, which is one of the most important agriculture country in the World although there is far less support compared to EU standarts. Will be one of the most significant countries for the EU agriculture security of supply if it reaches the funds of the countries like Spain and Poland which are supported for agriculture.

The European Countries,aware of this importance, deal with the policy toward agricultural sector under the name of Common Agricultural Policy , a policy area apart from all the other economic activities ,when initiating the economic and political integration movement called Europion Union (EU) today. Referring to this importance the EU has always allocated fund from the half of the bugdget,for these policies from the beginning. This protective policy of EU for agriculture, has provided the new member countries, which have too much structural problems like Poland, to increase agricultural output and productivity by having structural transformation, while it has made many EU member countries like Spain one of the few countries in the World,in the area of agricultural production. As one of the few agriculture countries of World from the history, Turkey has came to a losing point for exporting country identity, depending on the change of World conditions and the structural problems which have became chronic in 2000s, despite the practices of policies supporting the agriculture sector from 1930s. Reserches have revealed the Turkish Agriculture stands back despite the supportive policies, however, the countries like Spain,Lithuania, Latvia, Bulgaria have made majör progress in the area of agriculture thanks to the source of CAP(Common Agricultural Policy) and their reforms. It has been thought that EU membership will make important achievements to Turkish Agriculture. However, on the other side EU acts hesitatingly thinking the Turkish agriculture will give heavy-duty to CAP. In this research, it has been studied on the most important policies of EU called CAP and the effects of the agriculture supports the EU has provided to Spain and Poland as part of CAP with the existing agricultural supports in Turkey. On the hypothesis of research, It has been examined if Turkey is protectionist in agriculture or not the membership of Turkey will bring heavy duty to EU or not, Turkey will contribute to EU food safety or not, and the agricultural supports ,which Turkey performs, are enough campared to the CAP supports for Spain and Poland. İn the research, the data related to Poland and Spain has been compiled from the publishings and reports of relevant institutions of EU while it has been compiled from the publishings and reports of relevant ministry and government agencies for Turkey. It has been concluded by making comparisons of the obtained datas based on charts and graphics. Findings, obtained from this study have revealed that the Turkish Agriculture isn't supported as it is claimed, the Agricultural supports provided for the sector are for below the funds which the CAP intends for Spain and Poland. Besides, it has been seen that, the CAP supports, EU provides to the members are a lot more than the supports Turkey provides for the Agriculture and the membership of Turkey brings no special heavy duty to CAP. Consequently, It is possible to say that Turkey, which is one of the most important agriculture country in the World although there is far less support compared to EU standarts. Will be one of the most significant countries for the EU agriculture security of supply if it reaches the funds of the countries like Spain and Poland which are supported for agriculture.
ÖZETOrtadoğu'nun sınırları kesin olarak tespit edilmeyip farklı tanımlar yapılsa da bilinen en önemli gerçek bu bölgenin tarihin başlangıcından beri jeopolitik, stratejik ve yer altı kaynakları yönünden çok önemli olduğudur. Bölge I. Dünya savaşından sonra Osmanlı devletinin hakimiyetinden çıkarak, 1920 San Remo konferansında İngiltere ve Fransa arasında manda rejimi altında paylaşılmıştır. II. Dünya savaşından sonra bölgedeki siyasi olayları yönlendiren en önemli faktör İsrail devletinin kuruluşu olmuştur. Bu tarihten sonra bölge Arap - İsrail sıcak çatışmalarına; büyük devletler arasında ise soğuk savaşa sahne olmuştur.Türkiye'nin bu dönemdeki Ortadoğu politikası bölgede Arap ülkeleriyle yakın ilişkiler içinde bulunma ve onların davalarını destekleme şeklinde olmuştur. Ancak bu dönem uzun sürmemiştir. Bu yakınlaşma artan Sovyet tehdidi, Türkiye'nin Batı ittifakına girme çabaları ve bunun bedeli olarak 1949 da İsrail'i tanımasıyla sona ermiştir. Çünkü önce Truman Doktrini ardından Marshall yardım planıyla Türkiye'nin ulusal çıkarını hızla Amerikan çıkarlarıyla özdeşleştirme yoluna girmesiyle, Türkiye bu politikasını terk etmiştir. Artık Türkiye'nin Ortadoğu politikası Amerikan çıkarları çerçevesinde şekillenmeye başlamıştır .II. Bu dönemin ilk partisi olarak Demokrat Parti 1946 da politika sahnesine çıkıyor ve 14 Mayıs 1950 seçimlerinde 27 yıllık tek parti dönemini yıkarak iktidara geliyordu. Muhalefet döneminde CHP'nin dış politikasını eleştiren Demokrat Parti'nin kendi programında da farklılık yoktur. Hatta partiler arası birlik bu dönemin özelliklerinden biridir. Yani CHP ve DP dış politikada hedef yönünden farklı olmayıp sadece aktiflik, cüretkarlık yönünden farklıdır. SUMMARYSince the definite borders of the middle east hasn't been strictly determined and there are several different definitions about it, the most important reality known about here is that the middle east is very important in sense of the geopolitics,strategy and the richness of the its underground sources, since beginning of the history. The region released from the OtomanSovereignity after the first world war and in the San Remo Conference (1920) it was shared between England and France under a mandatery regime.After the World War 2 the most effective political factor that leads the events in this region has been the establishment of the Israeli government. Since this date, the area witnessed hot conflicts between Arabs and Israel , also cold conflicts among the great powers. Turkey's middle east politics had been in a direction that making close relationship with Arabian governments and supporting their allegations. However it didn't last too long. This getting closer with them ended by the increasing Soviet threat,Turkey's attempt to enter the West Alliance and as a price of this accepting the existing of İsraeli government. Additionally by the Truman Doctrine and then the Marshall helping project Turkey's national self-interests started to become identical with the America's own interests. Because of these, Turkey abandoned its approach to the area. From then on Turkey's middle east politics started to take shape in accordance with the America's self - interests. After the world war 2 Turkey was transferring into the poly-party system again by the effects of foreign conjuncture and the developments of the internal affairs. Democratic Party was getting into the politic stage in 1946 and in 14 May 1950 was coming to the power , demolishing the 27 year long period of single party. However it used to criticize the CHP's foreign affairs severely when it was the opposition party, there is no difference in its own party programme. İn fact the association between the parties was one of the main characteristics of that period. That is to say ,the CHP and the DP aren't different in sense of foreign politics' goal but in sense of activeness and boldness. By the DP's coming to the power ,Turkey's middle east politics towards the Arab states changed into an active transformation. Actually this activeness which was started beforehand was a consequence of attempts for getting closer to that world. The aim of Menderes' this active middle east politics was that America's and West's will of preventing the Soviets who wanted to enter the middle east of which value had been gradually rising then. Menderes' government was nourishing a unilateral way while it was trying to make a balanced policy between West and Arab governments. The real reason of this was that in fact there wasn't any clear policy about middle east by Menderes' government. Actually having no political approach was true but Menderes' fundamentals of diplomacy were based on making the western governments get involved in middle east affairs as much as possible. He saw the both two balance of power and was attempting towards to make benefit for Turkey's aims from any lack of power existing in this region. There are three main aim of Menderes' government that leads its middle east policy: a) Proving stability and security in the areab) Obtaining satisfactory solutions for conflictions between İsraeli and Arab governments. c) Establishing an effective security system in order to prevent communism to enter this touchy region. In the limits of this policy Turkey made close relationships with Jordan and Iraq until the revolutions in 14 July 1958, but with EGYPT and Syria there occasionally was some high tensions because of their positions under the Soviet control.This activeness doesn't come from Democrat Party's

Ancak, Birlik AB politik üyelik koşulları yoluyla kurallarını Orta ve Doğu Avrupa ülkelerine kıyasla Batı Balkanlardaki diğer üye olmayan ülkelere aktarırken birtakım zorluklarla karşılaşmıştır. Burada akla iki soru gelmektedir: Birinci soru, "Hangi şartlar altında bu koşullar etkili olabilir?" iken; ikinci soru, "AB üyelik koşulları neden Batı Balkanlarda bulunan ülkelerin iç politikasında kısmen sınırlı bir rol oynar?" şeklindedir. Here are two questions to mind: 'Under what circumstances could the conditionality be effective?' and 'why does the EU conditionality play relatively limited role in the domestic politics of the Western Balkan states?' An "external incentive model" is adopted by Schimmelfennig and Sedelmeier (2004) to articulate the issue. This study addresses this contestation, arguing that the "external incentive model" is incapable of fully answering these questions and that national identity has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. The reasons why the paper has chosen Croatia and Serbia as case studies are that they are republics of former Yugoslavia and that they have shared war history in the 1990s, however act differently on the way to the European Union (Massari, 2010). Although Croatia has become a member of the Union, Serbia still has got a long way to go The European Union has utilised political conditionality as one of the most significant strategies to export its governance and to encourage non-member countries to obey the rules of the EU (Schimmelfennig and Sedelmeier, 2004). Political conditions, which are necessitated by the Union from the very beginning, can be described as a competitive party system, and free and fair elections. As for the essential political conditions of EU accession that the EU confirmed in 1993, which are also defined as the Copenhagen Criteria, they are the stability of democratic institutions, rule of law, liberal market economy, human rights and lastly the protection of minority rights (Bieber, 2013:2). The required political conditions are flexible. By which it means that some specific requirements could be added to the conditions. For instance, the UE required cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY) in the context of Western Balkans (Frerburh and Richter, 2010:269-71). Predominant studies select "external incentive model" to articulate the logic of EU conditionality and political conditions. This model is based on a rationalist cost-benefit calculation that assumes that states are regarded as rational actors, seeking to boost their interests (Schimmelfennig and Sedelmeier, 2004). The tool of conditionality is perhaps the most significant instrument that the EU external governance applies to force would-be member states to obey the rules of the EU. That is, the Union decides its instructions as conditions and would-be member states are expected or required to accept these conditions to receive rewards. Consequently, the target government would face three various pressures namely from the Union, domestic and international politics in return for EU external incentives (Trauner, 2011:8). It is therefore the credibility of the EU conditionality plays a key role in evaluating the pros and cons of EU rewards as opposed to domestic compliance (Schimmelfennig and Sedelmeier, 2004:663-7). This model is, however, unsuccessful in fully articulating why the EU political conditionality could perform better in states like Croatia than in states like Serbia in the context of Western Balkan despite the fact that the Union has provided these countries with rewards. At this point, national identity, as a constructivist variable, has a huge impact on the determination of the effectiveness of EU accession conditionality by focusing on the problems limiting this effectiveness in two Balkan states, namely Croatia and Serbia. National identity is the main theme that determines whether conditionality can be effective or not. Constructivists argue that wouldbe member states would acknowledge the influence of the Union by means of socialisation and persuasion processes. It is these processes internalizing identities with the help of domestic actors (Trauner, 2011). Considering the rules of the EU appropriate and compatible with political conditionality helps domestic actors to stick to given EU rules (Schimmelfennig et al., 2006:27-52). In this sense, national identity, as a filter actor, influences EU conditionality. It is, therefore, crucial to note that states, as social actors, often shape and reshape national identity when they face or interact with different social structures. The EU political conditionality has raised doubts about its effectiveness in the countries in question. This is because they had ethnic conflicts in 1990s that shaped their national identities. It is this historic background affecting the effectiveness of EU political conditionality in Croatia and Serbia in different lights. The way in which the transformation of the EU rules, however, quite varied from one another. Croatian elites saw the cooperation with ICTY as indispensable part of EU accession and in line with Croatian respect of European organizations. Croatia met EU requirements. This is simply because the country was one of the European countries in which the rule of law is respected and obeyed. As far as Serbia is concerned, the cooperation with the ICTY was ensured by Serbian elites who felt forced and oppressed to do so. But they rejected the Hague tribunal. Even though they rejected it, a sense of obligation arising from the fear of being punished by the international community through the cancellation or postpone of EU talks took place regarding detaining suspects. This problematic issue resulted in different images of the EU in the eyes of these two countries. Serbia regards the European Union as a punisher and a superior force that inclined to in Serbia. This could be one of the reasons why there is distance between Belgrade and Brussels. As for Croatia, the image of Europe in the eyes of Croatian people is related to high democratic standards, liberty and civilization (Subotic, 2011:326-7). This could be one of the reasons why there is close cooperation between Croatia and the European Union. The rational incentive model is important for explaining the choice of would-be member states. It is crucial to clarify that this model is valid once the rules of the European Union are compatible with national identity of the would-be member states. Once the national identity of the target state is incompatible with the rules of the EU, it is fair to say that any material condition does not serve a very useful purpose. Main problem on agriculture sector is delivery prices of goods.A stagnation indicator on Bulgarian economy is weakness of building and construction sector.
