Državni je savjet dugo vremena priznavao prvenstvo međunarodnih ugovora, posebice ugovora Europske unije, samo nad zakonima koji su doneseni ranije. Najzad, nakon odluke Ustavnog vijeća Elections du Val d'Oise i priklanjajući se zaključcima javnog izvjestitelja Frydmana, Državni je savjet napravio preokret u sudskoj praksi s presudom Nicolo priznajući prvenstvo ugovorima Europske unije, kao i klasičnim međunarodnim ugovorima, čak i nad zakonima koji su doneseni poslije njih. Štoviše, za razliku od rješenja Kasacijskog suda, obrazloženje odluke Državnog savjeta zanemaruje argument o specifičnosti europskoga ustavnog poretka i poziva se samo na članak 55. Ustava ne izjašnjavajući se o klauzuli recipročnosti. Potom je upravni sudac priznao prvenstvo europskih akata sekundarnog prava, tj: uredbi, direktiva, te općih načela europskog prava. ; The State Council has for a long time acknowledged the primacy of international contracts, in particular contracts of the European Union, exclusively over the laws passed earlier. In retrospect after the decision of the Constitutional Council Val d'Oise elections (Elections du Val d'Oise) and accepting the conclusions of public reporter Frydman, the State Council changed its court practice with the Nicolo judgement acknowledging the primacy of contracts of the European Union, as well as classic international contracts, even over laws passed after them. Furthermore, in contrast to Kasacian Court judgements, explanation of the State Council neglects the argument of the specifics of European constitutional order and only calls upon article 55 of the Constitution stating the reciprocity clause. Thereby the administrative judge je recognised the primacy of European acts of secondary law, i.e.: regulation, directive, and general principles of European law.

"L'Etat et la décentralisation en France ." n'ont rien d'exclusif. Cela ne signifie pas que la décentralisation n'est qu'un "travail" de l'Etat face aux pouvoirs territoriaux. L'État considère toujours le contexte auquel il ne peut pas seul faire face (en cas de crise économique ou financière ou en matière de sécurité), quand il délègue souverainement un certain contrôle, il peut en prendre autant qu'il peut dissoudre des sujets décentralisés (plus ou moins forcés). et plus ou moins directement convenu en rejoignant ou en réaffectant). À cette délégation de pouvoirs juridiquement confirmée, s'ajoute sa propre autorité définie par la loi sur la décentralisation. La collectivité locale représente un ensemble dans lequel les devoirs d'autorité sont différenciés (qui sont remplacés en cas de non-exécution par un devoir officiel) ou d'autorité non obligatoire. Ou, entre autorité exclusive ou commune, si l'on sait que l'autonomie locale peut être mise en oeuvre directement ou indirectement (dans le cas d'une concession ou d'une délégation de service public). Il faut aussi mentionner que dans la majorité des pays de l'UE, seule la loi peut déterminer le régime des municipalités (contrairement à ce qui existe dans les États fédéraux). La France est en ce sens un modèle pour un État unitaire, dans la mesure où un développement aussi bien du fédéralisme administratif (que politique) est rejeté, comme le confirme une organisation décentralisée valorisée dans ce pays (de la réforme de la décentralisation de 1982 à loi du 7 août 2015 sur la nouvelle organisation territoriale). À vrai dire, la France a traversé toutes les formes de régime, de gouvernement et d'administration en un peu plus de deux siècles, et pourrait donc servir à toute observation sur la décentralisation, ses qualités et ses inconvénients. ; Država i decentralizacija u Francuskoj ." nisu ništa isključivo. To ne može značiti da je decentralizacija samo "posao" države s teritorijalnim ovlastima. Država uvijek razmatra kontekst s kojim se sama ne može suočiti (u slučaju ekonomske ili financijske krize ili kada je riječ o sigurnosti), kada suvereno delegira određeni nadzor koji može potrajati jednako koliko može raspustiti decentralizirane subjekte (manje ili više prisilno i više ili manje izravno dogovoreno ulaskom ili ponovnim dodjeljivanjem). Ovome zakonski potvrđenom delegiranju ovlasti dodaje se vlastito ovlaštenje definirano Zakonom o decentralizaciji. Lokalna vlast predstavlja cjelinu u kojoj se razlikuju dužnosti ovlasti (koje se zamjenjuju u slučaju neprovođenja službene dužnosti) ili neobvezna ovlaštenja. Ili, između isključive ili zajedničke vlasti, ako se zna da lokalna samouprava može izravno ili neizravno provoditi (u slučaju koncesije ili delegiranja javnih usluga). Treba također spomenuti da u većini zemalja EU samo zakon može odrediti režim općina (suprotno onome što postoji u saveznim državama). Francuska je, u tom smislu, model za unitarnu državu, u onoj mjeri u kojoj je razvoj prema administrativnom federalizmu (kao i političkom) odbijen, što potvrđuje decentralizirana organizacija cijenjena u ovoj zemlji (od reforme decentralizacije 1982. do zakon od 7. kolovoza 2015. o novoj teritorijalnoj organizaciji). Istinu govoreći, Francuska je prošla kroz sve oblike režima, vlade i uprave u nešto više od dva stoljeća, i tako može poslužiti za svako promatranje o decentralizaciji i njezinim kvalitetama i manama. ; "The State and decentralization in France ." are nothing exclusive. It cannot mean that decentralization is just be a "job "of the state faced with territorial powers. The state always considers the context which it alone cannot confront (in the case of economic or financial crisis or where security is concerned), when it sovereignly delegates certain supervision it can take just as much as it can dissolve decentralized subjects (more or less forced and more or less directly agreed upon by joining or re-assigning). To this legally confirmed delegation of authority, its own authority defined by the Decentralization Act is added. Local authority represents a whole in which duties of authority are differentiated (which are replaced in the case of non-implementation by official duty) or non-compulsory authority. Or, between exclusive or common authority, if one knows that local self-government can directly or indirectly implement (in the case of concession or public service delegation). One also needs to mention that in the majority of EU countries, only law can determine the regime of municipalities (in opposition to what exists in federal states). France is, in that sense, a model for a unitary state, to that extent to which development according to administrative federalism (as well as political) is rejected, as confirmed by decentralized organization valued in this country (from decentralization reform in 1982 up to the law of 7 August 2015 on the new territorial organization). To tell the truth, France has gone through all forms of regime, government and administration in just over two centuries, and so could serve for every observation on decentralization, and its qualities and downsides.

Quelques réflexions sur les problématiques actuelles du contrôle des administrations ; Razmišljanja o aktualnim problematikama nadzora nad upravama ; Reflections on the current problems of oversight of administration
Il arrive que les énoncés les plus simples cachent de redoutables difficultés. Le problème est qu'elles n'apparaissent souvent qu'après coup, une fois les recherches engagées sur le thème innocemment proposé. C'est très exactement la situation inconfortable dans laquelle je me trouve ici ! Une chose est sûre : il me faut, pour développer le thème annoncé, en exposer préalablement les difficultés. Du sort réservé à ces dernières (A) dépend en effet le mode de traitement du sujet annoncé (B). ; Naslov ovog izvješća poziva na "sveobuhvatno" čitanje ove teme koja veći naglasak stavlja na glavne trendove u nadzoru, nego što predlaže podrobnu analizu različitih tehnika nadzora uprave i javnog djelovanja. Zato ćemo nastojati prikazati najznačajnije pokrete, kao što su oni koji utječu na samu strukturu sustava nadzora uprave. Stoga smo se odlučili vrednovati temu promjene, koja se javlja 80.-tih godina, uzimajući francusko iskustvo kao glavnu referencu. Ako se promatraju kroz prizmu promjene, o aktualnim problematikama nadzora uprava možemo izložiti tri pravca razmišljanja. Prvi se odnosi na utvrđivanje ključnih pokretača promjene. Kako bismo to izveli, moramo kratko predstaviti tri pojave koje mogu djelovati zajedno ili odvojeno: 1. Politička reorganizacija država i javnih uprava, 2. stalno obnavljanje demokratskog zahtjeva i 3. nastupanje menadžerske paradigme. Nakon ovog podsjetnika na pokretače promjene, razmišljanje može ići prema najvidljivijim oblicima promjene: istaknut ćemo dvije promjene, koje su komplementarne, ali moguće je i suprotstavljene, dok proširenju i produbljenju tradicionalnih oblika upravnosudske kontrole uprave, treba nadodati raznolikost u načinima provođenja nadzora nad javnim djelovanjem. U zaključku nam preostaje upitati se o dosegu promjena koje su u tijeku. Osim pitanja koje se odnosi na društvenu učinkovitost nadzora, treba postaviti i pitanje o njihovom doprinosu upravnoj demokraciji. ; The title of this report requires "all-inclusive" reading on this topic which emphasises more the main trends in supervision rather than suggesting closer analysis of various techniques of administration and public activity supervision. That is why we will try to demonstrate the most significant movements such as those which influence the very structure of the system of administrative supervision. We have therefore decided to evaluate the topic of change which appeared in the 80's, taking into account the French experience as the main reference. If considered through the prism of change, we can present three lines of thinking on the current problem area of administrative supervision. The first is related to establishing the key moving forces of change. For us to implement this, we must briefly present three items which can act together or separately: 1. political reorganisation of states and public administrations, 2. constantly refreshing democratic demands and 3. the appearance of managerial paradigm. After this reminder of the moving forces of change, contemplation can move towards the most obvious forms of change: we will focus on two changes which are complimentary but are also possible contradictory while the widening and deepening of traditional forms of administrative court control must include diversity of the means of supervision implementation over public activity. In the conclusion, we have only to question the scope of change which is in force. Apart from the question related to the social efficiency of supervision, one must also raise the question of its contribution to administrative democracy.

L'évolution des fonctions d'inspection : une mise en perspective

Résumé Comment l'héritage et la tradition revendiqués par les corps d'inspection de l'État s'accordent‑ils avec les transformations qui les traversent ? Si les praticiens tendent souvent à mettre en avant le « changement », les institutions sont aussi des espaces d'invariances. Après une réflexion sur la difficulté de penser le changement, cet article interroge la notion de « contrôle » et constate qu'elle est située dans des pratiques localisées, inscrites dans des savoirs institutionnels particuliers qui ne se recoupent pas forcément et qui relèvent, pour une part non‑négligeable, de l'auto‑persuasion. Toutefois les outils que sont la LOLF, la RGPP puis la MAP ont contribué au passage d'inspections en quête de régularité à des inspections plus focalisées sur la performance, ce qui a entrainé le développement d'un éventail plus large d'activités ainsi que certaines innovations institutionnelles.

Résumé Cet article s'interroge sur ce qu'il en est, en France, depuis les années 1990 des « pratiques croisées » du droit et de l'évaluation dans la mise en œuvre de l'action publique. C'est que, depuis une vingtaine d'années, le droit des politiques publiques est en train d'opérer un changement d'identité auquel les développements du management public ne sont pas étrangers, tandis que les pratiques évaluatives sont entrées dans leur phase d'institutionnalisation. Avant tout examen des éventuels rapports qui se nouent entre le droit et l'évaluation, ce sont les conditions même de la possibilité d'un tel exercice qui sont évoquées. Une fois ce travail préalable accompli, la réflexion se porte sur les chassés-croisés qui s'opèrent entre les deux démarches : celle du juriste et celle de l'évaluateur. L'article décrit tout à la fois ce que le droit donne à voir de l'évaluation (elle a vu son statut se construire dans l'écriture juridique) et ce que celle-ci donne à voir du droit, lequel devient à son tour production évaluable. Au bout du compte, on assiste à une redistribution des rôles dans la conduite de l'action publique : s'il faut aux juristes se faire de plus en plus évaluateurs, les évaluateurs doivent, de leur côté, emprunter aux juristes une part de leur identité.
