Traducción del artículo "Généalogie de l'implicite. La loi pacte de 1442 ou la contre-filiation du contrato callado", publicado en Jean-Philippe Genet (dir.), La légitimité implicite, París-Roma, Publications de la Sorbonne-École française de Rome, 2015, t. II, pp. 269-319. ; La referencia a un «contrato callado» entre el rey y el reino realizada por los procuradores de las ciudades en las Cortes de Ocaña en 1469 es vista como un hito en la historia del contractualismo castellano. La búsqueda de antecedentes ha llevado a establecer la relación entre esta referencia y la formula «ley real e por pacçion e contracto» utilizada en la ley de inalienabilidad del realengo del 5 de mayo de 1442. Sin embargo, el origen de tal formula y su utilización, ligadas a la concesión de privilegios, demuestran que fue funcionando como una formula soberana de auto-limitación, que no dejaba pues de afirmar el absolutismo jurídico. Por tanto, si bien existe una filiación entre tal formula y el «contrato callado», ésta ha de ser interpretada de manera negativa, a la manera de una contra-filiación. Con esta referencia, que aludía implícitamente al principio de soberanía popular contenido en la Lex regia romana, se pretendía así invertir el principio de soberanía reivindicado por la anterior fórmula. ; The reference to a 'contrato callado' or 'silent contract' between the king and the kingdom made by the proxies of the cities in the Parliament of Ocaña in 1469 has been seen as a milestone in the history of Castilian contractualism. FRANÇAIS: Le jaillissement du verbe législatif alphonsin est envisagé dans cet article à partir de la représentation iconographique qui en est faite dans le manuscrit Add. 20787 de la British Library de Londres (folio 1v°), dont la réalisation se situe après l'aggiornamento de la restauration de la figure du roi-législateur, et plus probablement encore pendant le réarmement sanchiste. L'hypothèse de lecture consiste à rapporter les scènes de dictée et de dédicace de l'œuvre à l'activation d'un modèle mosaïque qui pointe le passage d'une loi unilatérale à un mode de production dialogique de celle-ci, dans l'objectif de reconduire, en direction d'une monarchie sacerdotale, l'ambition alphonsine. / ESPAÑOL: El surgir del verbo legislativo alfonsí es cuestionado en este artículo a partir de la representación iconográfica que se hace del mismo en el manuscrito Add. 20787 de la British Library de Londres (folio 1v°), cuya realización se sitúa después del aggiornamento de la restauración de la figura del rey-legislador, y más probablemente aún durante el rearme sanchista. La hipótesis de lectura consiste en relacionar las escenas de dictado y de dedicación de la obra con la puesta en marcha de un modelo mosaico que apunta el pasaje de una ley unilateral a un modo de producción dialogado de esta, con el objetivo de reconducir la ambición alfonsina hacia una monarquía sacerdotal.

FRANÇAIS: Face à un roi qui à présent pousse les effets de son ire jusqu'au meurtre pour faire le vide autour de lui et imposer sa différence souveraine, ses parents et les riches hommes, soit les principaux visés par cette politique de l'arbitraire qui enfreint les règles du jeu autant qu'elle contribue à les redéfinir, disent la peur (metus) qu'ils ressentent, qu'ils utilisent aussi afin de donner à leur stratégie de pouvoir un fondement légitime. Et l'expression de cette émotion politique, qui tend à se muer en un stéréotype d'un discours aristocratique d'opposition, surtout présente dans les chroniques, mises ici en relation ici avec d'autres sources, notamment des correspondances, marque profondément l'histoire des relations souvent conflictuelles au sein de cette compagnie en définitive très étroite pendant un siècle, de la fin du XIIIe siècle à la fin du XIVe siècle. Cet article se propose d'ébaucher une première réflexion sur le sujet et d'en présenter les principales sources. / ESPAÑOL: Frente a un rey que ahora lleva hasta la muerte los efectos de su ira para hacer el vacío entorno a su persona e imponer su soberana, sus parientes y ricos hombres, o sea los principales afectados por esta política de la arbitrariedad que rompe las reglas del juego a la vez que contribuye a redefinirlas, dicen el miedo (metus) que sienten, que utilizan también para darle a su estrategia de poder un fundamento legítimo. Y la expresión de esta emoción política, que tiende a convertirse en un estereotipo de un discurso aristocrático de oposición, sobre todo presente en la crónicas, aquí puestas en relación con otras fuentes, en particular cartas, marca profundamente la historia de las relaciones a menudo conflictivas dentro de esta compañia finalemente muy estrecha durante un siglo, de finales del XIII a finales del XIV. En este artículo, me propongo esbozar una primera reflexión sobre el tema y presentar sus principales fuentes.

Liée à un système gouvernemental où le roi a vocation à s'abandonner au pouvoir de ses privados, cette liturgie politique d'origine nobiliaire tend à impliquer des groupes toujours plus larges, donnant ainsi à voir le dépassement de la compagnie royale en une communauté politique. Afin de cerner le fonctionnement de ce rituel politique d'intégration et de prendre quelques distances avec sa mise-en-texte par les chroniqueurs castillans — Pedro López de Ayala, "Suma de Reyes", "El Victorial", Alvar García de Santa María, Fernán Pérez de Guzmán, "Crónica del halconero de Juan II2, sa "Refundición", son "Abreviación", "Crónica de don Álvaro de Luna", Diego Enríquez del Castillo, "Crónica anónima", "Memorial de diversas hazañas", Alfonso de Palencia, Lorenzo Galíndez de Carvajal —, cette étude propose d'en passer par une analyse lexicale et factorielle des événements envisagés — Toro (1354), Tordesillas (1420), Rámaga (1443-1444), Cordoue (1455), Madrid (1464), Ségovie, San Pedro de las Dueñas, Avila (1465), El Pardo (1467), Madrid (1467).
