The 21st century was accompanied by fear, first of all of the terrorist threat, then of losing one's job, of losing one's traditional family values, and also of the weakness of the state. We live in societies of fear, a feeling that serves to win elections in the United Kingdom, the United States or Colombia, and is an excuse for some governments to backtrack on the recognition of human rights and their guarantees.If the unifying factor of the peoples is trust, fear causes the opposite effect, division, insecurity, suspicion, and many take advantage of these weaknesses in their electoral speeches and when they come to power they govern by sowing fear. Now the West lives in a democracy of fear. ; El siglo XXI vino acompañado del miedo, primero a la amenaza terrorista; luego, a perder el trabajo, a perder los valores tradicionales de la familia, y también, miedo a la debilidad del Estado. Vivimos en sociedades del miedo, sensación que sirve para ganar elecciones en Reino Unido, Estados Unidos o Colombia, y es excusa de algunos gobiernos para retroceder en el reconocimiento de los derechos humanos y sus garantías.Si el factor aglutinante de los pueblos es la confianza, el miedo provoca el efecto contrario, división, inseguridad, sospecha, y muchos aprovechan estas debilidades en sus discursos electorales y cuando llegan al poder gobiernan sembrando el temor. Ahora Occidente vive la democracia del miedo. ; O século XXI veio acompanhado do medo, primeiro da ameaça terrorista; depois, de perder o trabalho, perder os valores tradicionais da família e, também, medo da debilidade do Estado. Vivemos em sociedades do medo, sensação que serve para ganhar eleições no Reino Unido, nos Estados Unidos ou na Colômbia, e é a desculpa de alguns governos para retroceder no conhecimento dos direitos humanos e suas garantias.Se o fator aglutinante dos povos é a confiança, o medo provoca o efeito contrário, divisão, insegurança, suspeita, e muitos se aproveitam dessas debilidades em seus discursos eleitorais e, quando chegam ao poder, governam disseminando o temor. Agora o Ocidente vive a democracia do medo.

The «imperial presidency» and its evolution in the constitutional structure of the United States America ; La «presidencia imperial» y su evolución en la estructura constitucional de los Estados Unidos de América
This article analyzes «Imperial Presidency» in US Constitutional Law from a historical and institutional perspective. This is firstly made from a philosophical foundation of American constitutionalism and secondly from an evolution of the Presidential government. These two parts try to answer the question about the limits of the Federal presidency. It should be noted that these are not enough, because the executive orders promote the President's role, allowing the US to become a powerful country. The conclusion of this work that the «imperial presidency» is opposed to the moderate republic of the Founding Fathers; the blur limits of the executive department always adjust to the political powerfacts and situations.Summary:INTRODUCTION. II. THE SPIRIT AND ITS STRUCTURE OF THE AMERICAN CONSTITUTION OF 1787. 1. An oxymoron: the weakest power. 2. The separation of powers and the check and balances system. 3. Hamilton, Madison y Marshall: defenders of the Constitution of 1787. II. THE IMPERIAL PRESIDENCY: A THREAT TO THE CONSTITUTIONAL STRUCTURE. 1. Birth of the «imperial presidency». 2. Consolidation of the «imperial presidency». 3. Fullness of the «imperial presidency». 4. The «imperial presidency» in a constitutionalism point of view. CONCLUSION. ; Este artículo analiza el concepto de «presidencia imperial» en el derecho constitucional de los Estados Unidos de América desde una perspectiva histórico-institucional. Este análisis se plantea, primero, desde los fundamentos jus-filosóficos del constitucionalismo norteamericano y, segundo, desde el devenir del gobierno presidencial. La bipartición responde la pregunta sobre los límites, institucionales y reales tiene la Presidencia. Se observa que estos no son suficientes, pues las órdenes ejecutivas promueven el protagonismo del Presidente, permitiendo a aquel país transformarse en una gran potencia. Se concluye que la «presidencia imperial» se opone a la república moderada de los Padres Fundadores; la desestructuración de los límites al poder ejecutivo siempre se ajusta a los hechos y avatares del poder político.

Estado de derecho y modelo constitucional frente a la pandemia 2020
El objetivo de este trabajo es discutir la relación existente entre el Estado de Derecho y las crisis del tipo de Estado. El Estado Legislativo de Derecho surgirá de la crisis del modelo absolutista, las revoluciones inglesa, estadounidense, francesa y los procesos independentistas de América Latina, permitieron su consolidación. Ya con la crisis surgida de la Segunda Guerra Mundial, muchos estados asumieron el modelo constitucional de Derecho. Con una metodología analítico-descriptiva, se pudo concluir que, frente a la mayor crisis sanitaria de los últimos 100 años en el mundo, generada por la pandemia del covid-19 y el uso y abuso de los estados de excepción por parte de los estados para enfrentar dicha crisis, será el Sistema Interamericano de Derechos Humanos uno de los llamados a preservar el Estado de Derecho, consolidando lo que algunos han llamado el Estado Convencional de los Derechos.

ABSTRACT The objective of this work is to show the relationship between the rule of law and crises. The Legislative State of Law will emerge from the crisis of the absolutist model, the English, American, French revolutions and the independence processes of Latin America will allow its consolidation. In other crisis, that arouse from the Second World War, many states assumed the constitutional model of Law. With an analytical-descriptive methodology, it was possible to conclude that, in the face of the greatest health crisis of the last 100 years in the world, generated by the covid-19 pandemic and the use and abuse of states of exception by states to face this crisis, the Inter-American Human Rights System will be one of the calls to preserve the rule of law, consolidating what some have called the Conventional State of Rights.
