ABSTRACT:Post-Reform and Amendment to the 1945 Constitution of the Republic of Indonesia in 1998-2002, gave rise to various new things in the legal and constitutional system in Indonesia, one of which is the change in State Institutions in Indonesia, the biggest change is the change in the People's Consultative Assembly which was originally an Institution. Highest State Institutions become Higher State Institutions and the emergence of New State Institutions. Therefore, this study aims to determine the meaning of state institutions and the terms of state institutions in the constitutional system in Indonesia, as well as how the classification and hierarchy of state institutions in Indonesia. The research method used in this research is Normative Juridical. The results showed that State Institutions, State Bodies and State Organs have similarities in terms of language and terms, namely organs that have certain functions in exercising power or state functions. The three terms have been used interchangeably in the Indonesian constitutional system, either in the Constitution or in other regulations. The two State Institutions can be classified based on the legal basis that underlies them, the function of the institution and their position. Meanwhile, based on the hierarchy of State Institutions, it is divided into two levels, namely the central level and the regional level, however the hierarchy does not always discuss which institution is higher and lower, as long as the State Institution is based on the 1945 Constitution and experiences disputes, then in the handling of disputes between State Institutions can be resolved through the authority of the Constitutional Court. AbstrakPenelitian ini bertujuan untuk mengatahui tentang tata cara pembentukan struktur kepemimpinan di masyarakat Kampung Mawesday, dalam bentuk kepemimpinan secara yuridis dan historis, peran dan fungsi struktur kepemimpinan di masyarakat Kampung Mawesday dalam bentuk kepemimpinan secara yuridis dan hsitoris, serta untuk mengetahui tentang apa saja hambatan- hambatan yang dihadapi, serta solusi dalam kepemimpinan secara yuridis dan historis di Kampung Mawesday. Metode yang digunakan dalam penelitian ini, adalah metode diskriptif dengan pendekatan kualitatif. Hasil dari penelitian ini menunjukan bahwa tata cara pembentukan struktur kepemimpin secara yuridis di Kampung Mawesday melalui pemilihan secara demokrasi yang diselenggarakan oleh panitia pemilihan kepala Kampung lewat tahap pencalonan, pemungutan suara, pengitungan dan penetapan hasil pemelihan. Peran dan fungsi kepemimpinan secara yuridis merupakan bentuk peran dan fungsi dalam menyelenggarakan urusan pemerintahaan, pembangunan dan kemasyarakat sesuai dengan ketentuan yang berlaku. Hambatanya dalam kepemimpinan secara yuridis adalah kurang adanya kerja sama antara pimpinan dengan perangkatnya dan kurang adanya kerja sama antara pimpinan dan masyarakat. Kemudian tata cara pembentukan struktur kepemimpinan secara historis adalah berdasarkan sejarah, asal-usul, kualitas pengetahuan dan garis keturunan yang bersifat turun-temurun. Peran dan fungsi kepemimpinan secara historis adalah dalam menjaga kebudayaan, memberikan pemahaman tentang adat, serta menjaga hak-hak masyarakat adat di Kampung Mawesday. Hambatan dalam kepemimpinan adat adalah, kurang adanya kerja sama, kurang adanya pemahaman tentang adat dan tidak melakukan trasformasi ilmu pengetahuan tentang adat kepada anak-anak adat di Kampung Mawesday.Kata Kunci: Kepemimpinan Secara Yuridis dan Historis. AbstractThis study aims to find out about the procedures for forming a leadership structure in the Mawesday village community, in the form of juridical and historical leadership, the role and function of the leadership structure in the Mawesday village community in the form of juridical and historical leadership, and to find out what are the obstacles faced, as well as solutions in juridical and historical leadership in Mawesday Village. The method used in this study is a descriptive method with a qualitative approach. The results of this study indicate that the procedure for the formation of a juridical leadership structure in Mawesday Village is through elections held by the village head election committee through the stages of nomination, voting, counting and determining the results of the election. The juridical role and function of leadership is a form of role and function in carrying out government, development and community affairs in accordance with applicable regulations. The obstacle in juridical leadership is the lack of cooperation between the leadership and the apparatus and the lack of cooperation between the leadership and the community. Then the procedure for forming the historical leadership structure is based on history, origin, quality of knowledge and hereditary lineages. The role and function of leadership historically has been in maintaining culture, providing an understanding of adat, and safeguarding the rights of indigenous peoples in Mawesday Village. The obstacles in traditional leadership are lack of cooperation, lack of understanding of adat and not transforming knowledge about adat to indigenous children in Mawesday Village.Keywords: Juridical and Historical Leadership.
AbstrakPenelitian ini bertujuan untuk mengetahui pengaruh penerapan prinsip good governance terhadap peningkatan kualitas pelayanan publik di BPN (Badan Pertanahan Nasional) Kabupaten Pandeglang. Penelitian ini merupakan penelitian korelasi dengan pendekatan kuantitatif, dimana variabel independen adalah penerapan prinsip good governance dan variabel dependen adalah peningkatan kualitas pelayanan publik. Populasi dalam penelitian ini adalah masyarakat penerima pelayanan di BPN (Badan Pertanahan Nasional) Kabupaten Pandeglang yang diambil 100 orang untuk dijadikan sampel penelitian. Teknik pengumpulan data pada penelitian ini menggunakan angket tertutup. Teknik analisis data yang digunakan untuk menguji hipotesis adalah teknik analisis korelasi product moment dan analisis regresi linier sederhana untuk mengetahui pengaruh penerapan prinsip good governance (X) sebagai variabel bebas terhadap peningkatan kualitas pelayanan publik (Y) sebagai variabel terikat. Hasil penenlitian ini menunjukan terdapat pengaruh yang signifikan antara penerapan prinsip good governance (X) terhadap peningkatan kualitas pelayanan publik (Y) di BPN (Badan Pertanahan Nasional) Kabupaten Pandeglang. Hal tersebut berdasarkan pengujian analisis korelasi pearson product moment, nilai pearson correlation sebesar 1,000 dengan taraf signifikansi sebesar 0,000. Dimana, apabila nilai korelasi product moment yakni thitung lebih besar daripada ttabel atau taraf signifikansi kurang dari 0,05 dan koefisien determinasi bernilai menandakan bahwa terdapat pengaruh yang signifikan antara Penerapan Prinsip Good Governance Terhadap Peningkatan Kualitas Pelayanan Publik. Hasil penelitian ini juga diperkuat dengan uji t pada Analisis Linier Regresi Sederhana yang menunjukan bahwa thitung yaitu 4,910 lebih besar > ttabel yaitu 1,984.Kata Kunci : Good Governance, Kualitas Pelayanan Publik AbstractThis research is a correlation research with a quantitative approach, where the independent variable is the application of the principles of good governance and the dependent variable is the improvement of the quality of public services. The population in this study was the service recipient community at the BPN (National Land Agency) Pandeglang Regency, which were taken 100 people to be used as research samples. The data collection technique in this study used a closed questionnaire. The data analysis technique used to test the hypothesis is a product moment correlation analysis technique and simple linear regression analysis to determine the effect of applying the principles of good governance (X) as an independent variable to improving the quality of public services (Y) as the dependent variable. The results of this study indicate that there is a significant effect between the application of the principles of good governance (X) on improving the quality of public services (Y) at the BPN (National Land Agency) Pandeglang Regency. This is based on the Pearson product moment correlation analysis test, the Pearson correlation value is 1,000 with a significance level of 0.000. Where, if the product moment correlation value is tcount greater than ttable or the significance level is less than 0.05 and the coefficient of determination is worth indicating that there is a significant influence between the application of the principles of good governance on improving the quality of public services. The results of this study are also strengthened by the t-test on Simple Linear Regression Analysis which shows that tcount is 4.910 greater than ttable is 1.984.Keywords : Good Governance, Public Service Quality
