Este trabajo examina algunas de las normas contenidas en la
Ley 1/2023, de 16 de marzo, de la potestad sancionadora de las Administraciones
Públicas Vascas. Entre esas normas se comentan algunas de las relativas a algunos
principios de la potestad sancionadora, así como la posición de los menores,
las personas interesadas o la denominada víctima. También se analizan algunas
normas procedimentales y otras figuras como la conciliación y la ejecución de las
sanciones. Aunque la ley pretende regular de manera completa el régimen jurídico
de la potestad sancionadora, no se diferencia de la anterior Ley 2/1998, transcribiendo
numerosas normas de las leyes 39 y 40/2015.

buruzko martxoaren 16ko 1/2023 Legean jasotako arau batzuk aztertzen ditu.
Arau horien artean, zehatzeko ahalaren zenbait printzipiori buruzkoak aipatzen
dira, baita adingabeen, pertsona interesdunen edo biktima deitutakoaren jarrera
ere. Prozedurazko arau batzuk eta beste figura batzuk ere aztertzen dira, hala nola
adiskidetzea eta zehapenak betearaztea. Legeak zehatzeko ahalaren araubide juridikoa
osorik arautu nahi badu ere, ez da aurreko 2/1998 Legetik bereizten, 39 eta
40/2015 legeetako arau ugari transkribatuz.
This article examines some of the rules set out in Act 1/2023, of
March 16, on the sanctioning power of Basque public authorities. Among those
rules, the article considers some relating to the basic sanctioning principles
as well as the position of minors, interested persons or the so-called victim.
The article also analyses certain procedural rules and other institutions such as
the conciliation and the execution of sanctions. Although the law aims to fully
regulate the legal regime of the sanctioning power, it does not differ from the
regulation set out in former Act 2/1989 transcribing several rules included in State
Acts 39 and 40/2015.

Este comentario analiza la sentencia del Tribunal de Justicia en el asunto C-289/21, IG. El objeto de este asunto fue la compatibilidad con el art. 47 de la Carta de Derechos Fundamentales de la UE de una norma procesal, por la que quedaba sin objeto un recurso contra una disposición reglamentaria si esta era objeto de derogación. Así como el TJUE señaló que tal mecanismo no resulta incompatible con el principio de equivalencia, sí afirmó que era contrario al de efectividad y al art. 47 CDF, por cuanto no garantizaba la consideración de los efectos de la norma sobre el recurrente.
Iruzkin honetan, Justizia Auzitegiak C-289/21 gaiari buruz emandako epaia aztertzen da. Gai horren xedea EBko Oinarrizko Eskubideen Gutunaren 47. artikuluaren eta arau prozesal baten arteko bateragarritasuna izan zen; arau prozesal haren arabera, ez zegoen arrazoirik erregelamenduzko xedapenen aurkako errekurtsoetarako, erregelamenduzko xedapenak indargabetuz gero. Europar Batasuneko Justizia Auzitegiak adierazi zuen mekanismo hori ez dela bateraezinabaliokidetasun-printzipioarekin baina eraginkortasun-printzipioaren eta EBko Oinarrizko Eskubideen Gutunaren 47. artikuluaren aurkakoa zela, arauak errekurtsogilearentzat zituen ondorioak kontuan hartzea bermatzen ez zuelako.
This comment examines the ruling of the Court of Justice of the European Union in case C-289/21, IG. The subject-matter of this case was the compatibility with Article 47 of the Charter of Fundamental Rights of a procedural rule according to which, a case was devoid of object if it was previously derogated. Whilstthe CJEU indicated that such mechanism was not incompatible with the principle of equivalence it held that it was irreconcilable with the principle of effectivity and Article 47 as it did not guarantee the examination of the effects of the rule on the plaintiff.
