The far right ĽSNS in Slovakia and its reconstruction of the nation

Societies around the globe have been witnessing the emergence of the radical right, often seen as the result of neoliberal globalization. Democratic governance, liberalism, human rights, and values are being questioned while populist, authoritarian, and ethnonationalist forms of governance are being offered. In the European Union, the tumultuous developments have been testing the viability of the identity marker of Europeanness and its perseverance in EU member states. What we are witnessing are significant shifts in the discourse about sameness and otherness, the convergence of left and right ideologies and the emergence of hybrid forms of authoritarianism and democracy that have been dubbed as illiberal democracy or authoritarian liberalism. The rise of the radical right and its mobilization across the EU member states is reflective of these processes, and it is the goal of this author to understand the mechanisms behind the empowerment, mobilization, and normalization of radical right through the case study of Slovakia. In particular, the effort of this paper is to understand how the far-right party Kotlebovci – Ľudová Strana Naše Slovensko (ĽSNS) in Slovakia re-conceptualized the notion of nation and normalized far-right ideology as a pretext of a broader mobilization.
Międzynarodowa ochrona pracowników migrujących: Współczesne debaty prawne i perspektywy na przyszłość

Adjusting the legal status, and support policies for migrant workers is an issue on the agenda of international institutions for nearly a hundred years. The first efforts to protect foreign workers have been taken during the first session of the International Labour Conference in 1919. In the following decades ILO activities has led to the preparation of three international documents concerning this issue (non-binding ILO Convention No. 66 in 1939, and Convention No. 97 of 1949, and No. 143 of 1975). For many decades, the problem of the protection and assistance of migrant workers' rights was considered as a narrow issue of international labor law. Codification efforts, undertaken during seventies, has led to the adaptation of the UN document (International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families) in 1990, and inclusion this issue into more general area of international human rights law. Despite this fact, and the existence of several categories of documents concerning migrant workers within Council of Europe, the European Union, and even ASEAN, the protection of migrant workers has never been effectively functioning system. The aim of this article is the analysis of the codification of that issue, and the main obstacles to consensus on the protection of migrant workers' rights. The state parties of the UN Convention contains primarily countries of origin of migrants (such as Mexico, Morocco and the Philippines). It seems, therefore, that despite 46 ratifications the, UN convention does not have a global character, and activities of its monitoring body (Committee on Migrant Workers-CMW) reflects primarily demands of sending countries. The article closely examines particularly controversial provisions of the ILO and UN documents from the point of view of current labour migrations and policies of sending and host countries.
Mediation: education for human rights and skills in the culture of dialogue
Mediation is proving to be an effective way to manage conflicts in aconstructive way. But mediation not only helps to solve specific problems, because its potential encompasses aspects of greater complexity. Thus, mediation helps us to know ourselves better, to better understand others, and to use what we have learned to better manage future conflict situations. In asociety where there is no culture of agreement and where there is no education in the field of emotions, mediation becomes an adequate and effective tool to resolve conflicts in apeaceful and constructive manner. On the other hand, mediation allows the parties to take responsibility for the resolution of their own conflict, to be active agents in the process. The greater the citizens' participation in the different decision making processes, the more democratic asociety will be. That is why, in the restoration of social peace, citizenship should play arole as an active agent, and mediation is asuitable instrument for this purpose because the individuals in conflict find the way to solve it without third party impositions. ; Mediation is proving to be an effective way to manage conflicts in aconstructive way. This book explores the issue of development-induced population displacement from the point of view of development studies and development ethics. Based on an ethical approach, specifies the measures to minimize the problems of displaced persons and strengthening their participation as a beneficiaries of development projects. The book combines a thorough examination of the most important causes of involuntary population resettlement with numerous references to ethical and social aspects of this problem. Ethical considerations have become a starting point for the analysis of the decision-making process in the most spectacular cases of development-induced displacement and resettlement, associated, inter alia, with the construction of the Sardar Sarovar Project on the Narmada River, and the Kariba Dam on the Zambezi River. In addition to the groundbreaking theoretical approach to the problem, the significant advantage of the book is to draw attention to the lesser-known causes of displacement and notable historical considerations. The interdisciplinary nature of the study is reflected in the application of ethical approach as a point of reference for considerations on the basis of development studies, decision-making mechanisms and legal framework for resettlement planning, defining the responsibilities and the nature of the displaced (DIDPs) and affected (PAPs) communities (rights-based approach).

War and peace have perpetually alternated in history. Consequently, peace has always been seen as an endless project, even a dream, to be in brotherhood realized by all members of international community. Since the XVII century the elimination of war and armed conflict has been a political and humanitarian objective of all nations in the world. Both the League of Nations and the United Nations were conceived with the spirit of eliminating the risk of war through the promotion of peace, cooperation and solidarity among Nations. The Universal Declaration of Human Rights and the subsequent human rights instruments were drafted with a sincere aspiration of promoting the value of peace and human rights worldwide. International practice shows the close linkage between the disregard of human rights and the existence of war and armed conflict. It follows that the role of human rights in the prevention of war and armed conflict is very important. Since 2008 the Human Rights Council has been working on the "Promotion of the right of peoples to peace." Pursuant resolutions 20/15 and 23/16 and 27/17 the Council decided firstly to establish, and secondly and thirdly to extend the mandate of the open-ended working group (OEWG) aimed at progressively negotiating a draft United Nations declaration on the right to peace. The OEGW welcomed in its second session (July 2014) the approach of the Chairperson- Rapporteur, which is basically based on the relationship between the right to life and human rights, peace and development. Consequently, this approach could be developed during the third session of the Working Group (April 2015). At its 8th meeting, on 24 April 2015, the Group adopted the draft report on its third session ad referendum and decided to entrust the Chairperson- Rapporteur with its finalization. ; Wojna i pokój stale zmieniały bieg historii. W konsekwencji, pokój postrzegany był jako marzenie, niedokończony projekt, możliwy do osiągnięcia jedynie dzięki braterstwu wszystkich członków społecznoœci międzynarodowej. Od XVII wieku eliminacja wojny i konfliktów zbrojnych była politycznym i humanitarnym celem wszystkich narodów. Zarówno Liga Narodów, jaki Organizacja Narodów Zjednoczonych powołane zostały w dążeniu do wyeliminowania ryzyka konfliktów przez promocję pokoju, współpracy i solidarnoœci między narodami. Powszechna Deklaracja Praw Człowieka i kolejne międzynarodowe akty prawne gwarantujące ochronę praw człowieka, przyjęte zostały jako wyraz dążenia do promowania wartoœci podstawowych, za jakie uznano pokój i prawa człowieka. Praktyka międzynarodowa pokazuje zależność między naruszaniem praw człowieka a pojawianiem się wojen i konfliktów zbrojnych. Jasnym jest więc, że w zapobieganiu konfliktom zbrojnym istotne znaczenie ma ciągłe podkreślanie wagi praw człowieka. Od 2008 r. Rada Praw Człowieka ONZ podejmuje prace nad promocją prawa człowieka do pokoju. W myœl rezolucji 20/15, 23/16 i 27/17 Rada zdecydowała o ustanowieniu, a następnie o rozszerzeniu mandatu grupy roboczej (tzw. OEWG), której aktywność skierowana jest na opracowanie projektu deklaracji w prawie prawa do pokoju. Podczas drugiej sesji w lipcu 2014 r. eksperci zaakceptowali propozycję Przewodniczącego, wskazującą na związek między prawem do życia, prawami człowieka, pokojem i rozwojem. To podejœcie zostało rozwinięte podczas trzeciej sesji grupy roboczej w kwietniu 2015 r.

The challenge of Populist Radical Right Parties to Europeanization – the cases of Estonia and Latvia, 2018-2021

Over the last two decades, family law has undergone changes in Western Europe, widening the definition of marriage to include same-sex couples. In addition, some East European countries offer a legal recognition of civil unions of same-sex couples, while others do not offer any legal recognition at all. This diversity in family law has been recently challenged by developments at the European level. It is argued here that this constitutes an adaptational pressure on those European Union (EU) member states that do not offer any or offer only formal recognition of same-sex couples. We examine two cases when member states faced such an adaptational pressure, namely Estonia and Latvia, focusing on the interplay of two types of factors. First is that of formal institutions which, due to their constitutional role or their expertise in the EU law, may act as facilitators of legal changes. On the other hand, there are also political actors which have tried to constrain such an adaptation. We examine here especially the role of two political parties which have made a considerable effort to oppose the change in the two countries. It is argued here that the ideological orientation of these parties explains, at least partly, their opposition to the ongoing Europeanization of family law. The paper concludes with a discussion of the main findings and their implications.
The Right to Education. Examples of Higher Education Systems of Argentina, Brazil and Chile ; Prawo do edukacji. Przykłady szkolnictwa wyższego Argentyny, Brazylii i Chile
Since the World War II three Latin American states: Argentina, Brazil, and Chile have been using three different approaches to their higher education policy. Although each of these states declared that higher education was fundamental for their economic, social, and political progress, but due to historical differences these states used different means of supporting access to colleges and universities. The connection between higher education and government policy has been so important because education is considered to be one of the most fundamental human rights. The UN Universal Declaration of Human Rights points out that education is necessary for free development of human personality. ; Po II wojnie światowej trzy kraje Ameryki Łacińskiej: Argentyna, Brazylia i Chile wybrały odmienne rozwiązania w swojej polityce wobec szkolnictwa wyższego. Każdy z tych krajów uznał, że wyższe wykształcenie obywateli jest warunkiem rozwoju ekonomicznego, społecznego i politycznego, ale ze względu na historię zastosowały różne metody wspierania dostępu do wykształcenia. Powiązanie wykształcenia z polityką państwa jest o tyle ważne, że dostęp do uczelni traktowany jest jako realizacja jednego z podstawowych praw człowieka – prawa dostępu do edukacji. Zgodnie z Powszechną Deklaracją Praw Człowieka jest to warunek pełnego rozwoju osoby ludzkiej.

Regulation of Protection of Agricultural Land and Limitation of Ownership Rights to Real Estate ; Regulacja prawna ochrony gruntów rolnych a ograniczenia prawa własności nieruchomości
Regulations of the Act on Protection of Agricultural and Forest Land are treated as a limitation of the right of ownership of the real estate. Unlike civil law regulations, in this Act the legislator defines agricultural land as the subject of obligations specified in the Act, treating them in separation from the issue of ownership relationships. Unlike in civil law regulations, apart from the owner, a number of obligations associated with the protection of agricultural land is also imposed on other entities, which make economic use of the real estate property. According to the Act, the owner of real estate property has a number of obligations, such as prohibition to use land for non-agricultural purposes without having obtained a decision to designate the land for non-agricultural purposes and consent for exclusion of land from production. The owner also has other positive duties, such as the duty to prevent land degradation and devastation. These obligations, however, do not shape the subjective right of ownership, but are external to it, although they should be treated as a limitation to this right. ; Uregulowania ustawy o ochronie gruntów rolnych i leśnych są traktowane jako ograniczenia prawa własności nieruchomości. Odmiennie niż w regulacji cywilnoprawnej prawodawca przedmiotem obowiązków określonych w tej ustawie czyni grunty rolne, których ujęcie abstrahuje od problematyki stosunków własnościowych. W przeciwieństwie do przepisów prawa cywilnego, oprócz właściciela, szereg obowiązków związanych z ochroną gruntów rolnych został nałożony także na inne podmioty, które wykorzystują nieruchomości w sposób ekonomiczny. Właściciel nieruchomości ma zgodnie z regulacją ustawy szereg obowiązków, takich jak zakaz jej nierolniczego wykorzystania bez uprzedniego przeznaczenia terenu na cele nierolnicze oraz bez uzyskania zgody na wyłączenie gruntów z produkcji. Obciążają go również czynne obowiązki, m.in. obowiązek przeciwdziałania degradacji gruntów. Powinności te nie kształtują podmiotowego prawa własności, ale pozostają wobec niego zewnętrzne, jakkolwiek powinny być traktowane jako jego ograniczenia.

Artykuł dotyczy możliwości zbudowania nowego systemu orzekania o niepełnosprawności opartego na prawnoczłowieczym modelu niepełnosprawności i Konwencji o prawach osób niepełnosprawnych (KPON). Przeprowadzona krytyka obecnego systemu orzekania jako opartego na modelu medycznym niepełnosprawności, jak również dyskusja z nomenklaturą proponowaną w zbliżającej się reformie orzecznictwa w Polsce, prowadzą do postulatu o wypracowanie orzekania respektującego zasadę godności osób z niepełnosprawnością. Proponowany nowy system orzekania pozytywnego opiera się nie na deficytach jednostki, ale na jej możliwościach i potrzebie wsparcia. W propozycji znalazły się obszary życia osób z niepełnosprawnością, które powinny być brane pod uwagę w procesie orzekania, jak również nowe rozwiązania w obszarze świadczeń i rent.
The right to freedom of expression and the irremovability and appointment of judges – democratic standards of the Council of Europe ; Prawo do swobody wypowiedzi a nieusuwalność i powoływanie sędziów – standardy demokratyczne Rady Europy
The right to freedom of expression and the irremovability and appointment of judges - democratic standards of the Council of EuropeThe right expressed in Article 10 of the Convention stresses the importance of the freedom of expression and the freedom of information as the cornerstones of ademocratic and pluralistic society. The main issue in this article is defining the limits of the freedom of expression enjoyed by judges in those circumstances when they are the authors of critical statements, not only when the critical opinions are addressed at judges and courts. The apolitical nature of judges means that their participation in apublic debate on current political issues should be subject to special rules. The parent value of participation in apublic debate is the special restraint. However, that does not change the fact that judges should comment on the current problems of the judicial system and the system of common courts. Judicial freedom of expression cannot be limited by asanction threat violating the principles of the irremovability and appointment of judges. ; Przepis art. 10 Konwencji oOchronie Praw Człowieka iPodstawowych Wolności podkreśla znaczenie wolności ekspresji wypowiedzi oraz wolności informacji jako kamieni węgielnych demokratycznego ipluralistycznego społeczeństwa. Celem niniejszego artykułu jest wskazanie granic korzystania przez sędziów ze swobody wypowiedzi wtej sytuacji, gdy to oni są autorami wypowiedzi krytycznych dotyczących aktualnych problemów demokratycznego ustroju państwowego, nie zaś tylko wówczas, gdy wypowiedzi krytyczne kierowane są pod adresem sędziów isądów. Apolityczność sędziów powoduje, iż ich udział wdebacie publicznej poświęconej aktualnym problemom politycznym powinien zostać poddany szczególnym zasadom. Wartością nadrzędną nadającą ramy udziału sędziów wdebacie publicznej jest powściągliwość. Nie zmienia to faktu, iż sędziowie powinni zabierać głos wsytuacji, gdy publiczna debata dotyczy funkcjonowania wymiaru sprawiedliwości czy ustroju sądów powszechnych. Wolność wypowiedzi sędziego nie może być jednak ograniczana przez groźbę sankcji przyjmującą postać naruszenia zasad nieusuwalności oraz powoływania sędziów.

Deprivation of an entity of acquired rights deriving from an administrative act is possible through the combined application of administrative provisions of substantive and procedural law. The limits of durability acquired under an administrative decision rights are the constitutional principle of the protection of acquired rights and the general principles of administrative procedure. The permanence of the right acquired by the administrative decision is not absolute. Repeal or change of the administrative decision is possible only in the mode provided in the law, since the administrative decision makes use of the presumption of regularity. The deprivation of administrative and legal powers in the area of public law takes place in the context of an assessment of the implementation of an administrative decision carried out by a state body. This assessment is possible with the use of two procedural institutions for the expiry of an administrative decision and a substantive institution for the withdrawal of rights. The body assesses whether the addressee of an administrative act has implemented the administrative decision not only in accordance with its content but also the provisions of the generally applicable law. The deprivation of a party of an acquired right is often accompanied by the need to award damages (grant compensation). The procedure and premises for claiming compensation liability have been regulated in the provisions of substantive administrative law. The principle of the effectiveness of public administration bodies is one of the basic principles of administrative law. Its application is not limited only to the creation of law, but also includes the application of law by public administration bodies. The problem of the efficiency of operations of state bodies is of particular importance not only in the area of enforceability of an administrative decision, but also its authorising function. The efficiency of operations of entities in the State structure is assessed through the prism of the implementation of a given administrative decision.

Artykuł został zamieszczony w numerze specjalnym czasopisma pt. "Rola prawa w życiu jednostki w ujęciu nauk społecznych". ; Celem niniejszego opracowania jest systemowa i oryginalistyczna (tj. historyczno-językowa) analiza II Poprawki do Konstytucji Stanów Zjednoczonych, stanowiącej następująco: "dobrze zorganizowana milicja jest niezbędna dla bezpieczeństwa wolnego państwa; prawo ludzi do posiadania i noszenia broni nie może być naruszone". Zadanie to wymaga przedstawienia analogicznych do II Poprawki regulacji występujących w konstytucjach poszczególnych stanów, charakterystyki umiejscowienia przepisu w indywidualistycznie zorientowanej Karcie Praw (Bill of Rights) oraz zwięzłego opisania ewolucji pojmowania prawa do posiadania broni przez amerykańskie sądy federalne, w tym zwłaszcza wiążących interpretacji poczynionych w wyrokach Sądu Najwyższego USA, który ostatecznie w sprawie District of Columbia v. Heller z 2008 roku uznał prymat indywidualistycznego modelu prawa do posiadania i noszenia broni jako naturalnego i niezbywalnego prawa każdego człowieka. Niniejsze opracowanie, choć opierające się na doświadczeniach prawnych Stanów Zjednoczonych, stanowić może również istotny głos w dyskusji nad prawem do posiadania broni w Polsce. ; The purpose of this paper is a systemic and originalist (i.e. historical and linguistic) interpretation of Amendment II to the U.S. Constitution which states: "a well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed". This task requires providing an account of regulations found in constitutions of particular American states which are analogous to that of Amendment II, characterization of the placement of law in an individualistically-oriented Bill of Rights, as well as a concise overview of an evolution of interpretative conclusions regarding the right to own arms reached by federal courts, especially the rulings of the Supreme Court of the United States which in the case Heller v. District of Columbia of 2008 finally recognized the right to keep and bear arms as a natural and inalienable right of every individual. This paper, although based on the American legal experiences, could also be a stimulus for discussion about gun possession in Poland.
